It would be far better for him to end the discussion and say im not going to talk about that any longer. Ive said what im going to say. Now i want to talk about the issues people care about. That might be able to win him back some people and convert some undecided his way but he way he has conducted his campaign makes it very difficult to get back in the game. Democrats seem to be excited about the turn of events. Obviously trump denied all of the allegations and he continues to talk about it. On the flip side, when asked about any bill clintons, the allegations against bill clinton from the past, Vice President biden today said it shouldnt matter. I cant make an excuse for bill clinton. I wouldnt attempt to but he has paid a price for that. He was impeached. Thats true. The key point is bill clinton is not on the ballot and if you say bill clinton did wrong, well, then gee, i guess donald trump did wrong. Thats a broad i association but i think its the one that donald trump is trying to push. Id pick up on what karl was talking about, though, and say that donald trump is spending so much time fighting off the allegations that he is not succeeding and expanding his base of support or the electoral map. What we have seen here at fox, the fox poll had him clinton up plus two a week ago. Now clinton is up but seven. Where you see this collapse in terms of his support is among republicans. Clinton is going up slightly but a lot of republicans, especially and surprisingly workingclass white women who worked for trump previously now split. I think that is a big problem for donald trump. Karl, what does donald trump have to do . You mentioned some of it, to turn this around. Obviously the big debate next week in las vegas. Chris wallace the moderator from fox news. What does donald trump have to do . Remember, Hillary Clinton has gone up a little. Donald trump has dropped by more. That means he could win these people back if if he returns to the campaign to the issues that are driving the change dynamic in the electorate. The binary choice for Senate Republican candidates. The democrats want to make it about donald trump, right . Right now it is working for them. I dont think there is any question. When you see states like texas, utah, alaska, trump has a barely a narrow lead. You think what is going on . Clearly where we started the conversation about the electoral map you see states in play that should not be in play. When you talk about paul ryan and by the way, that is something that donald trump is spending time on, attacking paul ryan because he is attacking fellow republican instead of broadening or shore up his base with republicans. So when you ask me, yes, democrats are certainly happy at this turn of events, but it doesnt seem to be the case that, as Hillary Clinton takes more time off the campaign trail that it is anything democrats are doing, so much as what donald trump is doing to himself. On thursday her lawyers filed the answers which clinton signed under penalty of perjury. Joining me now is tom fenton the president of Judicial Watch, a group that filed the lawsuit to get clintons answers. And author of the book clean house. Whats the headline . Her remarkable lapses of memory. We only gave her 25 questions that were simple and straightforward. I think 20 times she said i dont recall. I dont recall why the email system was set up to begin. I dont recall if i ordered the destruction of records. I dont recall if i had any discussions about people asking for Clinton Emails under the freedom of information act. They dont recall if there were warnings about security. In fact at one point she didnt want to answer questions about whether she was warned specifically about her blackberry use because it was not secure and we know it was warned and she understood the warning and continued to use it any way. Remarkable lapses of memory about pretty much everything related to the clinton email issue and i dont think it is terribly credible. It shows she doesnt want to disclose what she does recall about the email issue. There are some lawmakers are capitol hill who said in her testimony she essentially lied and they can prove that but they have not brought anything forward with the fbi. Anything in these documents beside the i dont recall that suggest she didnt tell the truth . Thats why you have lawyers to make sure when you present information like this. It is hard to make a case of misleading the court. When you say you dont recall something and there are a bunch of documents that show that you were involved and should remember and its not credible that you dont recall it. The judge may not say you are in contempt or court or do go to jail but they may look at her testimony and find her allegation that i dont remember anything not to be credible. Where does this go from here . Were going to have to figure out what to do with the answers. We have a pending request to depose her with another federal court judge and may fight to get the answers she refused to give us in this set oaf interrogatories or questions and almost new Clinton Emails coming to us weekly. I think the question is where does this go from here . The Judicial Watch organization has been pursuing the clintons for 25 years. They have pretty much turned up nothing during the course of that 25 years. James comey, the republican head of the fbi said there is no legal case in terms of a criminal case. If any law students are watching they should look at these interrogatories. They are probably the most artful interrogatories that i have ever seen, ever written. They ask things like do you remember conversations occurring three levels down from you, secretary clinton, about possible conflicts with the federal recordkeeping laws or possible dangers, dangers of cybersecurity and hacking and her answers were no, to the best of my recollection i dont remember these conversations. She wouldnt normally participate in those. We are looking at these wikileaks emails and some of the conversations after a subpoena has been issued to protect the emails and the server. They are communicating with staff to say what should we hand over. What shouldnt we hand over. Is the server really under the subpoena . Doesnt that raise some questions . That is an entire different question from the subject you are talking about with tom. The inartful questions asked and responses from her attorney. Did you order the discussion . Yes, let me respond to that. The Congressional Committee and i used to be the staff director, if the Congressional Committee subpoenas a document from secretary clinton, the question john podesta would say should we hold these back . Two reasons they would be entitled to hold them back, one is executive privilege. A conversation between secretary clinton and president obama would by its definition be subject to be executive privilege, not something turned over to the Congressional Committee or if they were personal emails that had nothing to do with personal business they would not be subject to the subpoena. There are legitimate reasons that fall outside of the subpoena. Working emails were erased in that server. We know that, the fbi told us that. The fact she couldnt remember whether she ordered the destruction of the server or not is interesting. I think what she said in the response, if you read it closely this is real clear con textually. Her teattorneys and legal team went through what were official records and needed to be maintained and what were personal. The ones her legal team determined personal were not preserved. Thats consistent with the law. Comey had access to the email and still came up with the same conclusion there was no violation of law here. As air strikes pummel the areas around that city, and iraqi troops start to move closer, mosul remains under isis control as of tonight. Its last big stronghold in that country. I spoke to general petraeus about how he thinks the fight in mosul may shape up and what we know about the isis leader. I think this will be a tough fight. Isis is dug in. They have tunnels. They will have improvised explosives, ambushes and the rest of that, but i dont think it will be as tough as we would have imagined it six months or certainly a year ago. Each fight against the Islamic State has seen the iraqis do a better job. We will feet the Islamic State. The real issue is the post Islamic State governance. In the city of 2 million people, this is the most complex human terrain in all of iraq. If mosul falls to iraqi forces with u. S. Help, the threat or danger from isis in iraq doesnt immediately go away. The threat from the Islamic State will not go away for a number of reasons. The first is they are going to be more guerrilla, insurgentlike elements. They will break out, break in to cells are. There will be continued terror attacks. The real issue is can you drive the level of violence down considerably so you have a security situation that allows you to tackle the real issues, which are indeed political issues. These are issues of governance. Should the u. S. Be more willing to accept civilian casualties in an effort to go after isis chief al baghdadi or other alqaeda leaders. We will catch up with al baghdadi as we caught up with his operations chief and as we have caught up with a number of his other senior lieutenants. Will this Operation Take more bad guys off the street than it creates by its conduct. You kill lots of civilians, even if you get baghdadi and you might create more bad guys than you take off the street. Joining us now from atlanta, an International Lawyer and former state department official. David just returned from a trip to iraq. David, what do you make of the generals assessment . Well, general petraeus is very knowledgeable about iraq and particularly about mosul. He was not just the commanding general in iraq in 07 and 08 when i happened to serve there but he was the general in charge of Northern Iraq right after the 2003 invasion. He was responsible for pass fieing mosul. He nows how hard it is to do that and contend with the different groups inside mosul and how hard it is to fight door to door inside mosul. What perhaps you didnt get a sense of with your excellent interview with him is how high the stakes are in iraq. I just returned from iraq. I saw all of the different groups there putting aside their differences, at least temporarily to Work Together to try to take back mosul. That means the iraqi army, the sunni arab militias and they were really have to show the population in mosul that theyre not just being liberated by shiite arabs. There are peshmergas that play an Important Role and even ore religious militias like christian militias and yazidi malit m militias. Its complicated to get all of them working together that ieer going to approach mosul and then go into mosul working together with the u. S.
