"factor" begins right now. hi, i'm bill o'reilly reporting tonight from los angeles. thanks for watching us. more trouble overseas for president obama and america. that is the subject of this evening's talking points memo. remember back in 2009 mr. obama's first year in office he made a series of speeches sending a signal that america's really no better than any other nation. >> i believe in american exceptionalism just as i suspect that the brits believe in british exceptionalism and the greeks believe in greek exceptionalism. >> well, some americans applauded president obama's position as being generous. but here are the unintended consequences. the president has not acted as a dominant world leader. he has not taken on the authority that, say, ronald reagan did. the sad truth is vladimir putin, considered by many to be a stronger leader than barack obama. and that has led to all kinds of problems. that idiot karzai in afghanistan now insulting america in outrageous ways. iran jacking us around. assad in syria continues to kill civilians and pretty much does what he wants. and now in ukraine there's a civil war brewing. the president says there will be consequences for oppressive actions in ukraine. but does anybody take that threat seriously? talking points doesn't think so. early on president obama undermined his own authority to stand with freedom fighters. >> i know there has been controversy about the promotion of democracy in recent years and much of this controversy is connected to the war in iraq. so let me be clear. no system of government can or should be imposed by one nation by any other. >> well, now we have ukraine and other countries trying to get some freedom, but the president has lost moral authority and clearly doesn't want conflict. remember, his base, the liberal wing of the democratic party, opposes almost all strong action against overseas villains. that means that petty tyrants all over the world like assad and the mullahs in iran can give us the proverbial finger, and they are. now, it is certainly true that the wars in iraq and afghanistan have harmed this nation. just as vietnam did. that is the truth. but that doesn't mean we cannot have a smarter strategy and lead the world to better places. all ukrainians want is freedom to develop their economy. they want to be part of the european union so they can make some money. but the dastardly putin opposes that. therefore, the conflict rages, people die because putin controls the president of ukraine. i think it's safe to say ronald reagan would have handled the situation differently. and president obama might want to think upon that certainty. and that's the memo. now the top story tonight. carl cameron, james rosen from washington. rosen, how's the state department evaluating ukraine right now? >> well, secretary of state kerry said in paris yesterday he's deeply disturbed by the violence there. but state has only taken limited actions to protest it, restricting visas for a few unnamed ukrainian officials who probably weren't clamoring to visit boston or los angeles anytime soon. here's what's going on over there. and here's why it's important to us. this situation's been simmering since november. that's when the ukrainian president viktor yanukovych announced he was suspending this deal with the eu in favor of closer ties with russia. there were protests in the streets back then. those too were suppressed with force and then what really inflamed things was that yanukovych tried to ram through the legislature a set of laws that would have effectively banned the opposition from having any voice at all. things have escalated dramatically just in the last week. you've got 100 people killed. the protesters have turned themselves from peaceful to guerrilla. they're taking policemen hostage. they're hurling molotov cocktails and seizing government buildings. president obama, as you just mentioned in your talking points, called on the government yesterday to show restraint and said "there will be consequences if people tell over the line." today when the police mowed down 70 people in the central square in kiev the deputy white house press secretary josh earnest was asked if that line had been crossed and he declined to answer. this is reminiscent of syria last summer where the president drew a red line on the use of chemical weapons and then when that line was crossed had drawn it. bottom line, people like to frame this in terms of the cold war. in fact, ukraine marks the first time that the upheavals of the arab spring in the middle east have spread to the former soviet bloc. putin and populations around the world are looking to see the caliber of leadership demonstrated by the united states because basic democratic freedoms are at stake in all of this and instead what leadership is being demonstrated appears to be coming chiefly from the european union, bill. >> all right. yeah. merkel and the french guy saying they're going to punish ukraine. but really there isn't much that president obama can do directly to ukraine. i mean, we don't want to get involved with any fighting or anything like that. i guess he could slap some sanctions on a country. but that hurts the folks over there. if putin continues to prop up the government, which he is. what did he send -- he promised 10 billion more dollars to prop up this stupid government or something? >> look -- >> so i don't know what president obama can do. >> you said -- you mentioned that which the president can do directly. a better word might be overtly. there are limited things he might be able to do overtly. there's almost an unlimited universe of things he might be able to do covertly. but there's no indication that this president wants to get that engaged with this kind of freedom struggle. and he has a kind of an innate repulsion to the projection of american force abroad. >> he does. and i don't disagree with that. and i believe that that has undermined -- look, there's soft power and there's hard power. okay? and soft power is look, we want to persuade you and if you do it we'll help you out. and hard power is if you don't do it we'll hurt you. he doesn't use hard power. except with the drone thing. that's the exception to the rule. all right. now, cam rorngs let's go over to you. i understand that iran is now saying they're not going to live up to the original nuke deal they agreed to. frame that for me. >> the question is whether or not they're going to. and for the last four or five months they've been under this agreement from last year that was to come up with a plan that would allow the iranians to actually do away with their nuclear weapons programs and prove it to the world. there's been a lot of talk about new sanctions in the u.s. and around the world for iran. today the u.n.'s nuclear watchdog -- today the u.n.'s nuclear watchdog actually said that iran is meeting its commitments under last year's interim agreement. and they actually went so far as to say that the iranian stockpile there in iran has declined for the first time in four years. but these talks were i supposed to have come up with a permanent arrangement by july of this year to prove that iran is not building a nuclear bomb. and now the iranians are basically saying they want some of these types of inspections off the table, not up for discussion, and that the deadline ultimately will have to be pushed back if they're going to continue these negotiations. there is a -- >> all right. >> go ahead. >> the iranians are basically saying we agreed to something but now we're going to change it? >> they're dragging their feet. they don't want to have a whole series of areas that were not under pre-existing lists looked at. they're dragging their feet about the scope of the inspections. >> i don't think the obama administration -- they have to hold to the six-month thing. either they have a plan at six months or you don't. now, harry reid, i understand, is not going to allow a vote on sanctions that the u.s. might reimpose on iran. >> there's a bipartisan billion in the senate, bob benened ez from new jersey, mark kirk the republican from illinois. it's been around for a couple of months now. the president has made it dlaer he doesn't think that should be voted on, he doesn't think should be passed. harry reid the democratic senate majority leader has no intention of bring dg up on the senate floor. and the truth of the matter is the u.s. government is not alone in its reluctance to want to see new sanctions imposed. china, france, russia, uk all party to these discussions with iran all say now is not the right time but just to give you an idea they're feeling it. the ayatollah yesterday said he wants an economic jihad against sanctions. which suggests they are feeling it. bill? why are you making a big deal of this by saying there's a 3% surcharge? why don't you add it into the bill so no one would know it and take the 3% and pay for insurance? >> in california we have a very restrictive gratuity system and none of the gratuity can actually be shared with the kitchen. the genesis of this was a way to give something to the kitchen to show appreciation for the service staff. >> so the government in country, state government actually regulates your tips, where they go and how they're distributed? >> correct. >> so they've got your tentacles all over you guys. so what is the statement you wanted to make to the consumer? see, if i walk in and i see 3% for health care added on to my bill, i'm going to want to know why. what do you tell them when they ask? >> this goes -- it's a way of taking a portion of the gratuity and dispersing it to the kitchen. >> do i get 12% instead of 15% or 17% instead of 20% tip because you take 3% and add it on to the bill? >> you should tip like you always do. you should tip as much as you feel necessary. >> basically, what you guys are doing is telling me and the consumer when i come in and your restauranting not inexpensive but i'm paying 3% more for the health care of your 80 employees. that's what i'm doing. right? >> you're paying 3% in lieu of a gratuity because what we're doing -- >> you just said you -- >> it's completely voluntary. >> okay. >> so in other words, if you were to adjust it down, the service staff is actually fine with that. >> but i would feel bad if i did that. i don't want to adjust it down. particularly me because then it would be in every gossip column in the world. >> we expect you to adjust it up. >> right. and i usually am a generous tipper. but i'm still not getting why you just didn't build it into the price of my chicken kiev or whatever i'm getting. just give it there. you guys went out of your way, and you know, it you're getting publicity, you're on a program tonight, to say look, you guys, i want to pay for my kaelt health care, got 80 employees, i'll make the customer pay 3% more on his meal. to do that. some customers are going to say i don't really want to do that, you should do that with your own business, don't impose it on me. >> should-some have. we could have called it kitchen appreciation. and maybe in the next restaurant i have i will do that. i have a number of restaurants. this is the only one that it's in so far. >> i don't know whether this is a good or bad thing. i like talking about it, so it's good for us. this doesn't have anything to do with obamacare at all, right? >> it has nothing to do with obamacare. >> you're an 80 employee institution. so you just got a waiver you that don't have to do obamacare this year. >> or next year. >> or next year. right. you got that waiver. but you're buying health insurance for your folks anyway, right? >> yes. >> that's nice of you. you don't have to do that, do you? >> no. >> they could be self-employed and they have to get their own insurance. whereupon they would have to go to the obamacare exchanges. but you're buying their own insurance for them. good thing. but you're making the customer pay 3% more, which may not be a good thing. >> well, arguably, if you really look at the system, when you walk into our restaurant, you spend $120, you don't remember whether you spent $120 and 90 was food and $10 was tax and $20 was tip. you think you spent $120. >> it's $120 a head, right? >> right. i'm giving you an example. >> does that include wine -- >> our check average is probably about $65. but if you add on the tax you pay plus the gratuity, you end up spending, you know, 30% more than that. 2-2 20% for tip and 10% tax. it's a big tax state. >> it is. >> the consumer has a certain amount they're going to spend and once you get up too high they don't remember if they spent it in a gratuity or spent it in tax. this was a way to basically take a portion of what was all going to one half of the workers. so you're talking about a huge number. >> in the menu 3% going for health care everybody's seeing that. >> we used health care as the compensation rather than minimum wage or additional wages because it was actually a very efficient way, a tax-free way for people to get a benefit because health care's not taxed. >> big controversy in this country about obamacare. >> unfortunately we now know. >> you guys are right in that zone of small business guys. okay? >> look, the thing in iran actually, as your previous guest pointed out, the lowest level that they've had in recent times and that they're in compliance with the agreement they did. furthermore, today it was announced that they were going to round 2 and they'd agreed on a framework and they're restarting the talks on march 17th. now, whether or not they get there by skrul i don't know, but these sanctions appear to be working somewhat. we won't know until july, but it seems to be moving in the -- >> okay, and i think that's a fair point. i think that's a fair point. you've got to give it some time to see if they're going to comply. but as you know, they're making outrageous statement, they want it back at a year, not six months. reid is blocking any kind of sanity where you would pass a reintroduction of sanctions if they didn't hit the agreed upon date. that's what they should do. but this dope reid, and he is -- he is one of the worst. he wouldn't even bring it up to do a sane thing that would protect this country. come on. you know what i'm talking about. >> you know, not just -- i think actually, you know, we're negotiating but the negotiations have continued and i think thus far it's actually pretty gp let's give it a chance. we don't -- >> you already said that. >> aipac, which is a very strong pro-israel group in washington doesn't want these brought up either. it's not an unreasonable position to take. i'm not -- >> i unreasonable, but the wise position is to reinstitute sanctions, to have them there so the mullahs can see them. if you don't do what you said you were going to do. that's the sane position. let's go to ukraine. let's go to ukraine. >> no. okay. just go to ukraine. but let me point out that the sanctions set by president obama and secretary of state clinton were working and that's what brought the iranians to the table. but let's go to ukraine. >> all right, carville, you know what i'm saying is right. let's go to ukraine. you've got to violence and you've got all of this stuff. then you have president obama saying there will be consequences. less than 24 hours after he says it the ukrainian army shoots down 70 people in the street. then the obama administration spokesperson is asked, is that going to evoke consequences? and he doesn't answer. come on, carville. >> first of all, i've worked in the ukraine. so it happens to be something i know a little bit about. and the europeans are -- it's kind of a european-russia issue. we're also very involved in sanctions, working with the germans, working with the french, working with the people in the eu. now, the truth of the matter is that russia's right there. yanukovych, i don't like him but i certainly worked for the other party, but he was actually elected. it's actually a democratic country. >> but he's now -- he's rolling back freedoms now. that's what happens. >> and i think he's a bad guy. but he's elected. and i sure am not for use of any u.s. hard power in the ukraine. i'm completely supportive of the eu. i'm completely supportive of being part of a solution there or putting pressure on him. and ukraine now really wants to -- >> what kind of pressure? >> i think it really wants to look to the west. but i don't want to exercise any hard power in the ukraine right now. not at all. >> well, what kind of pressure are you going to put on them if you're not going to exercise any hard power? >> well, i agree with you. this guy called himself a bully as a child. he's still a bully. whether we look to chechnya and a village where he commanded more than 300 civilians to be killed or people that speak their mind and criticize him or his government who are imprisoned or sent out of the country. secondly he supports countries that are enemies to the united states or appear to be enemies to the united states. syria. iran. and thirdly, the anti-gay measures. he's not in favor of equal rights. >> but his background as a kgb guy. i mean, this guy is a ruthless s.o.b. and he needs to be called out. so i'm happy i do it. letter number two comes from manny de la rodriguez el paso, text. i'm mad as hell about you because you said on jimmy kimmel obama's a patriot. really? i seriously doubt you that know the definitions of the words of the day. you big phony. another happy customer. i said on kimmel that both president bush the younger and barack obama are patriots because they serve their country. you may not agree with them. all right? but i don't think you say they're not patriots unless you have, you know, evidence that is just through the roof. i think almost every president that's ever served this nation has been a patriot, including richard nixon. you say? >> oh, i agree with you. but definition -- the definition of patriot, a person who loves, supports, and defends his country and its interests with devotion. and whether you like the man or his policies i believe that the sincere intent of this president barack obama and i think most presidents is to improve the nation for the people. >> i agree. but the far right thinks he is subverting the nation and the constitution on purpose. that's what the far right believes. and they believe it sincerely. you don't. >> no. >> okay. i respect the far right's point of view. but it's not based on fact to me. it's based on opinion. so unless i see a fact that says barack obama is intentionally harming this country, intentionally the key word, i'm going to go with what i said. >> i agree. >> number 3 from rachel olinski, miami beach, florida. really mad about all the fas the imaginary war on women is making. michelle obama would have a tremendous impact on our black daughters if she would encourage them to reach higher not have children when they thefltz are children. interesting point. what are the stats on black kids having children? >> this is outrageous. and something needs to be done because this is a preschool through sixth grade facility, bill. this is all little ones. and someone in this school is shooting up heroin. and the unions seem much more interested in protecting the due process rights, which i agree are relevant here, of the teachers than in protecting the safety and lives, also relevant, of the little ones. the constitution requires a balancing test. they have due process rights. you can't just go in there and, you know, get their blood or get their urine without their consent. they have to meet a certain standard. but what initially happened here was apparently all eight of the teachers who had been seen using the facility agreed to a urine test. agreed to give urine. and then the union got involved and only one of them was brave enough. he was a non-union guy. >> union told them not to do it. >> all of them said we won't. >> that's so sick. >> it's disgusting. >> that's so sick. it's not what the union is supposed to do. the union's supposed to look out for the kids as well as the teachers and say look, we advise you to take the urine test. if you don't want to, as your union we'll defend you. >> right. >> but our advice is do it because that's what's best for the children. >> let me say this is not one that you can blame entirely on the union, bill, because those teachers need to come forward. i used to be a teacher. >> absolutely. >> i ask you in your due process rights if somebody said to you bill, they found heroin and needles twice, not once but twice in this school, december 23rd, and then again on february 14th and we need a urine sample in, if you were innocent you'd get it in a heartbeat. >> absolutely. but there are so many bad teachers. i put the number at about 20%, 25%. 75% of american teachers, great. but there are a lot of bad ones. and you know -- >> it looks like -- >> if i were a teacher and i refused to take a test there, if i were the principal those teachers would be -- >> well, that's the thing. >> -- like -- >> they're in the classroom teaching right now. they could be teaching a 4-year-old. there could be little 4-year-olds being taught by somebody who's apparently addicted to heroin. >> we've got a new york city teacher who was involved in this. and then he's back in the classroom. teachers union got him back in the classroom. and he was -- >> philip seymour hoffman, just in case people needed further evidence of how dangerous that drug is. and not only is the person obviously addicted to heroin but so addicted and dependent upon it that they're bringing -- they're going to do it during school hours. and then they're interacting with the children. something needs to be done because they're all still teaching those children at this moment. >> all right. there's this crazy 19-year-old woman in pennsylvania charged with murder. gives an interview to newspapers, says she killed 22 other people. are you buying it? >> maybe. i don't know why people are so quick not to buy it. you know, she called up the reporter who'd been covering her case. she was arrested for one murder on which they have her dead to rights. and she said i want to talk to you. and in the jailhouse interview she confessed to she said over 22 murders. she said once she hit 22 she stopped counting. she said she's a member of a satanic cult, that apparently it's been documented she was sexually abused as a child and obviously is a very messed up person. and the murder that she cops to and that they have her on was so horrific. she lured this guy in via craigslist allegedly for a prostitution stint. she told him she was only 16 and he still wanted to go forward with it. this is the victim. and then she stand him over 20 times while her husband put a rope around his neck from the back sxaet murdered him. and now she claims she's been murdering people for the past seven years or so. they say they're looking into it, they don't have proof of it right now. but i'm not willing to say it's not true. >> her father says it isn't true. >> well, what's he going to say? he doesn't know. >> all right. that's a good answer. i just want to get that on the record. >> she calls the reporter, she says i have no beef -- i'm not trying to build myself up. i just want the truth out there. i realize i'm never going to see the light of day again. and she says i know that they shouldn't let me back out. if they let me back out i'm going to do it again. >> she's not going to get back out. >> on troy's murder. >> absolutely. and the husband is also facing it too. she's 19 years old. that's a stunner. all right. we're going to continue following the story. what have you got on "the kelly file" tonight? >> a family brings their 15-year-old daughter in for treatment at a boston hospital. a top hospital said this is the treatment. they bring her to another hospital. that hospital disagrees. they decide to go with tough. the boston hospital, the second hospital, calls division of child and family service because their advice has been rejected. the daughter has been taken away. they have only seen her once a week for a year. her condition is deteriorating. the court imposes the gag order on the parents. they're breaking the gag order and coming on "the kelly file" tonight. >> all right. hope you can get justice for the child. how old is the kid?
