Possible witness as the Russian Investigation continues. Reporter the president firing off just one tweet about this morning and is safe to say that the president is not happy about this recorded conversation. Michael cohen because he was in that conversation could be that one party. Sources tell fox news the conversation involved a possible payment to a former play boy model who claims she had a nearly yearlong affair with trump in 06. Karen mcdougal sold her story to the Parent Company that owns the National Enquirer in august of 2016 for 150,000, but that story never ran. The payment the two were discussing on the recording in question reportedly involved possibly buying the rights to her story, but that payment was never made. Meanwhile, investigators and special counsel Robert Muellers office have given notice to an attorney for Kristen Davis as part of their digging into russian interference in the 2016 election. You might remember this name, davis is known as the manhattan madame who was in the headlines back in the 2,000s for running a high end prostitution ring, also connected to former new york governor spitzer. Investigators want to talk to with her about her close friend roger stone, who was a long time confidant of President Trump. This all comes one week after prosecutors announced an indictment of 12 russian Intelligence Officers who are accused of conspireing to hack democrats during the campaign. Davis giving a quote to a reporter yesterday saying in terms of russian collusion, she knows nothing. Back to you. Eboni thank you very much laura. For more on this were going to go to alex little, a defense attorney and a former assistant federal prosecutor. Thanks for joining, alex. Good afternoon. A lot to unpack here m were going to start with some of things in lauras report. As we know in new york state the one party consent, i think thats important to note because theres some outstanding question around the legality of the tapes themselves. Of course with President Trump tweeting that they could be illegal, looked into it, new york state bar issuing that it is unethical for a lawyer to tape a conversation with his or her own client, but your take as a former prosecutor and now defense lawyer, are the tapes themselves legal . They appear to be, yes. I mean, you certainly in new york can record a conversation you have with someone else, that appears to be what cohen did. As for whether or not President Trump was his client at the time the recording was made. Theres a whole process the federal judge down there in new york went through to determine what recordings and documents were privileged and what wasnt privileged. You can assume this was one of the recordings. Theres a judge who determined it wasnt privileged in any way which means it wasnt recording about legal matters. Eboni i want to turn to a statement made by rudy giuliani, the president s attorney. This is what he had to say, nothing in that conversation suggests that he had any knowledge of it in advance. In the big scheme of things, its powerful exculpatory evidence. Obviously we dont know yet whats on the recording themselves, but giuliani is saying it could clear the president of any wrongdoing. Your reaction to that . I mean, i am sure i would say the same thing if i were him. It is sort of an insane idea. The president we know has lied about this already. Its evidence that hes lied again to the public. It is also evidence that he is talking with Michael Cohen about things to suppress negative information which is the same issue that happened with Stormy Daniels and sort of sets the tone that during the campaign they were willing to do things like to keep things in the dark. Whats also important about this tape is the fact it exists. This is one tape, one recording, what else does cohen know and what else did he record when he was talking to the president . Eboni i think a lot of people are asking the same question, that this is likely not a one off. No. Eboni if this is existing, then theres probably the existence of other possibly more damming i mean even if you look at the quote by rudy giuliani, but what else is out there . I know we cant speculate too far down the road. As it relates to the investigation, do you think theres anything Michael Cohen would be able to offer from those tapes that would be damming for the president . Yes, it is not just the tapes. It may be text messages, emails, hes obviously kept things. Why is this coming out now . Why do we know about this tape . Obviously the fbi has had it for more than a month now. I think it is probably a signal to other witnesses that they need to tell the truth when they are dealing with the prosecutors in new york and they are dealing with the special counsel because there might be a record that proves they are lying if they try to. Eboni back to the Kristen Davis, known as the manhattan madame, roger stone, a lot of, you know, highprofile characters, if you will, in this narrative now. How do you see that impacting the investigation because certainly its sounding like they are trying to talk to her very specifically about her relation to roger stone and thus the relationship to President Trump . So roger stone is definitely a central figure in this. Hes admitted he had communications with this individual who was indicted as part of the russian intelligence indictment, the folks who were meddling and hacking the dnc emails. Which of his associates are going to have information . I think not being in the investigation, we cant tell, but they are certainly starting to focus on roger stone to the extent that gets closer to trump, i would be worried if i were him. Eboni based on your experience as both a federal prosecutor and also on the other side a defense attorney, i want to ask you, looking back and trying to see where mueller is going with all of this, again, lots of pieces, lots of highprofile people involved here, what is the overall kind of connection of the dots that you think the chief prosecutor in this is trying to make . I think that were going to get at the end of this investigation a very thorough look into what the Trump Campaign was doing in those weeks and months leading up to the election and immediately afterwards. You know, whether those were all crimes, its unclear, but this is a much bigger case than just a single indictment or a series of indictments. It involves the president of the United States. It involves a foreign adversary. And i think ultimately the question is, how is congress potentially doing to deal with that going to deal with that information once we know what actually happened during the campaign . Eboni final question for you, again, we dont know how this will end, lets just say it ends short of collusion of russia around the president , lets say the evidence doesnt take it that far, are there other legal concerns that are consequential as it remains with the president . I think what this investigation has already shown is that President Trump was very i think untrue with the American Public about the statements he made during the campaign. And i think more problematic the statements hes made with President Trump, with president putin of russia the past week, theres certainly something that does not smell right. Whether or not it is a crime or a subject of impeachment i think is what we will deal with the next coming months. Eboni thank you very much for joining us. The elements of National Power of diplomacy, information, the military and the economy. Russia is doing everything they can to apply Information Operations against us, and weaken our democracy. It can be argued that they are being successful as a result of the discord within our own country right now. Mike you anticipate Russian Election meddling skills will be improved in 2018. What are your expectations . Well, every organization in the military and Government Entity does an afteraction review and assesses their lessons learned. They will learn from the 2016 cyberattacks and influence operations that they did, they will try to improve those and target us during our midterm elections. They can we can expect to be targeted in ways such as direct disruption of our election process, direct disruption through cyberattack of political officials and campaign organizations. Also covert operations, russian bots on social media. Mike right. That are like i said selling discord and also just overt operations like lobbyists and foreign media that will all be used against us in 2018. Mike something to watch. Deputy ag rosenstein spoke about the indictment of 12 russian nationals. I want to play his comment and get your reaction to it. Some critics argue against prosecuting people who live in Foreign Countries that are unlikely to extradite their citizens. I think thats a shortsighted view. For one thing, the defendants may some day face trial. If theres a change in their government, or if they visit any nation that cooperates with america in enforcing the rule of law, the modern forms of travel and communication, readily allow criminals the Cross National boundaries. Do not underestimate the long arm of american law or the resolve of american law enforcement. Mike so lieutenant colonel, your thoughts on the indictment of 12 russian nationals . Was it a good move . It was. It at least puts something hanging over their heads, and it will restrict their travel. We just never know how complacent that they may become and take a trip or get out in international waters. Also it is worthwhile to indict these guys because then we can trace the money associated with them. Follow the money trail and do financial sanctions, just related to these 12 individuals. One thing that we can do is something that we did aggressively after 9 11, and that was form joint task forces at local, state and national levels. Everyone has heard of the Counterterrorism Task forces, but it is time if we havent built them already to do the cyber counter task forces with fbi, doj, states, federal and local, Everybody Knows elections are run at the smallest local level. Most people dont have investigative abilities and the ability to counter foreign governments, but the fbi does and other investigative agencies. It appears the process is working, it is on track and is on time. Some of the activists we spoke with say the separations only highlight the ongoing immigration problems. Shes pushing for things like 15 minimum wage, medicare for all i think shes very consistent with where democrats stand and i dont think thats a discord. Just this week the democrats launched the medicare for all caucus in congress. I think the real question is how concerned are republicans that shes gaining national traction in the advance of midterms while the leader of their party is interested in putting a foreign adversary in front of the american people. Mike Ocasio Cortez moving incumbent democrats too far to the left . I would like to encourage the Democratic Party to make her the face of the party and adopt all her positions. If that does occur, then lieberman is right. The democrats may never win another election. In fact i have got to imagine the democrats running in the trump red states, democrats running in montana, missouri, where she is, mccaskill has to be cringing every time she gets coverage up there. One thing when you have ocasio who is making comments with this far left wing ideas but when the Democratic Party starts to adopt a form of economic standard that is completely contrary to our American Values it shows the party has gotten off the rails and the inmates are now running the asylum. Mike what about the point there are a lot of red state democrats in states that President Trump won up for reelection this year . Are they being dragged too far to the left . I dont think so. I dont think that we can just focus on red state democrats. I think even if the democratic leadership, people like nancy pelosi and schumer arent necessarily leading the party to the left. They are being pushed to the left by people like alexandria Ocasio Cortez because they are a younger party. And they have a longer life to live. They are going to have to suffer the consequences of a g. O. P. Led congress thats chipping away at the core patriotic values that has thrived in america for so long. Mike chris, does this remind you a little bit of what the tea party did in terms of fighting for conservative values on the republican side of things, pushing republicans to the right . You know, i think there are some similarities between the tea party. The difference is, you look at somebody like up in alaska where you had a Tea Party Candidate the republicans looked at it and said this guy doesnt belong in the senate. They had a write in campaign for murkowski and put her back in the senate. I think we have done a good job of adjusting and finding the candidates that didnt represent the Republican Values and making changes there so they didnt get elected to congress. But i do agree with tiffanys point about pelosi and the democratic leadership being pushed to the left. Thats why frankly joe crowley wont be returning to congress. Feinstein isnt getting the state party endorsement. The ceo of starbucks made a comment that the Democratic Party is getting too far out there in terms of coming up with policy that theres no way the United States could pay for it without going bankrupt. This is a guy looking to run for president on the democratic ticket in 2020. I think the civil war thats happening in the Democratic Party is not a great face for them as they move into the crucial midterm elections. The United States is prepared to pay 12 Million Dollars for the president s military parade thats really just a charade. It is interesting when republicans want to bring up what costs taxpayers money in terms of having medicare and Free College Tuition for all people. Mike let me switch gears. What about the battle this week in congress over i. C. E. . Vice president pence weighed in today. Lets take a listen to him. While some leading democrats across this country actually calling to abolish this agency. Im going to make you a promise. Under this administration we will never abolish i. C. E. Despite all the rhetoric by many on the liberal left, here are the numbers last year alone, i. C. E. Agents arrested more than 127,000 illegal immigrants. Mike tiffany, was it wise making those folks villains for enforcing the law . I dont think that it was unwise. I think this country has survived without i. C. E. For a long time. The agency is only 15 years old. It was birthed out of 9 11. Not all democrats are calling for the abolishment of i. C. E. There are certain amount of democrats that arent. The Congressional Hispanic Caucus has distanced themselves from the call. As long as you have this administration in place, getting rid of i. C. E. I dont know what kind of problems that would solve. You would have still policies that feed into trumps base c l calling all undocumented immigrants as criminals is obviously false. Im not sure it was unwise. I think it is a Healthy Exchange of ideas in the Democratic Party as we see the generational shift happening. I dont support the call but i dont blame people for making the call. Mike your reaction to tiffanys take . I think democrats had a winning issue when they were focusing on children being separated from their families. Instead of focusing on that issue, they made it about the abolishment of i. C. E. This is something that is about as far radical of an idea as potentially could be pushed by the democrats right now. You have got it being led by some of the Democratic Senate candidates like in texas and others that are coming out and making far left wing calls that would weaken our National Security and border security. I think through how the democrats running in states like missouri and north dakota and montana and michigan and wisconsin have got to be like cringing every time that they open their mouth and say things like this because its so far outside the mainstream. Mike lets get to topic number three, comedian Michelle Wolf at the center of controversy once again after comparing i. C. E. To the terror group isis. The sketch from her netflix show, i. C. E. Recruitment video with immigration agents dressed like terrorists. Wolf portrays Homeland Security secretary. Its popular nowadays to say i. C. E. Is bad. But theres no better representation of American Values right now than isis. She also came under a firestorm of criticism earlier this year for her jokes during the white house Correspondents Dinner. So what about this . About, you know, is she taking comedy a little too far there, chris . Well, one, i dont think its funny. So i dont know i would say shes taking comedy too far. Shes certainly going too far. I wonder at what point does netflix or people who are inviting her to give speeches or come to comedy clubs say enough is enough. This is a woman who is continuing to push the envelope, continuing to embarrass the people who support her. I know i was sitting at a table at the white house Correspondents Dinner with some people on the board and they were cringing every time she spoke. Its going too far. It is at some point in this country were going to return to civility. Tiffany and i were having a great conversation earlier. It is a shame we cant have those sorts of ongoing civil conversations between the party all the time. People like Michelle Wolf make it difficult to do so. Mike your thoughts on i. C. E. And isis . I think it is a little bit ridiculous. I wouldnt put chris in this category. I think there are a lot of people in america who cheer on Roseanne Barr and her ridiculous comment and scoff at Michelle Wolf. This is where your hypocrisy comes into play. Lets not forget the comments made by the person who actually matters. All it takes is one look at the president s twitter feed and the disgusting rhetoric that comes out of his mouth and compare him to Michelle Wolf, a comedian who is an entertainer. When we have the leader of the free world making such ridiculous comments, i think thats where our focus should be not on what comedians are saying. Mike my sense is a lot of folks out there probably irritated because you have isis cutting peoples heads off and i. C. E. Enforcing our immigration laws. They are not the people who write the immigration laws. They enforce them. Final thoughts, chris . Well, you know, Roseanne Barr was cancelled. I think thats what should happen to Michelle Wolf after this. For them to tolerate this sort of rhetoric goes beyond the pale of what should be acceptable. Mike tiffany . I think thats where our thoughts and sympathies should be, not with conversations wasted on what comedians are saying. Its renegotiated every several years. Now it is my understanding, ethan, that prior the recent protests the past few years, there really wasnt much in the agreement by way of mandates concerning the anthem. So i want to get your reaction to the leagues handling of this. Whats your reaction to Roger Goodell and the leagues efforts at handling this thus far . This was kind of an issue that kind of sprang up out of nowhere. I dont think it existed in the contract. It began with one player and then it snowballed into an issue where lots of players began taking the knee. Thats when the nfl came up with the idea to have a policy. Actually i think the policy was a fairly elegant solution because they didnt want that sort of televised spectacle of people kneeling during the anthem. But they also werent going to punish people for not wanting to stand during it, so sort of allowing them to remain in the locker room. It think it kind of respected the wishes of both sides, the league and the owners and the players as well. I think it kind of threaded the needle fairly elegantly. Eboni apparently somebody didnt necessarily think it was the right fix, hence, they put a halt on that particular solution that just came down in may. And they are talking, you know, that there was a joint Statement Released from the nfl and the nfl players association, just this past week that said you know what . We know we just came up with that policy. Were going to put it on ice for now and go back to the drawing board and try to come up with something that feels more equitable. Yet the president at this point has now tweeted his prescription. You know, some people would say that theres north korea. Theres russia. There is immigration. Theres the american economy. Why do you think the president does feel compelled to enter this dialogue . Now, in fact, i might be one of those people. I mean, of course the president can walk and chew gum and tweet and watch tv and play golf, all at the same time. You know, he can focus on many issues, but i do think it is a little bit unnerving when you have the top official of the United States inserting into what is effectively a private dispute in a privately owned and operated league. I think theres a fairly obvious i would say two fairly obvious reasons that the president does keep getting back into it, one is that it is kind of political gold for him. I think hes kind of on the side of the people with this. I think the majority probably oppose the kneeling. Eboni actually let me just real quick only because theres recent data on this. You raise a good point. Most recently its been around low 50 percent, 52, 53 that support the right to protest. But continue. Thank you for that. Of course those are two separate things whether you support the right or the action itself. Eboni absolutely. I think the majority probably opposed the action. I think trump is trying to make hey with that. I also think he at a fundamental level actually does kind of care about this. I think his twitter feed is kind of useful as sort of a psychological portrait into the issues that actually get him going. I think theres a visceral level in which he is offended by the sight of players kneeling at the anthem. Thens why he keeps and thats why he keeps going back to it. Eboni let me ask you this, an interesting theory speaking of twitter, i did some social media perusing. I saw a theory. I want to get your take on it. Is that the president if you can remember back in history, he was interested in owning an nfl team, he wasnt permitted to owning a team, instead he formed his own league, that had a short shelf life so some people out there believe that this is the president kind of sabotaging the nfl, right, pitting nfl players and against owners all in an effort to sabotage the league that kept him out and this is some of his sour grapes. Again a theory. Your reaction . I dont think if its as deliberate an action to sort of sabotage a league. Look, we all know that the president , hes known to hold a grudge. And i think its fairly clear that hes got a beef against the nfl. Im sure it dates back to what he probably views as his mistreatment at the hands of the league, those many years ago. Eboni certainly. Last question for you, ethan, as the nfl and the nfl pa sit down over the next coming weeks, hopefully prior to the start of the new football season to come up with a solution, i appreciate your take that the previous stance might have been a nice elegant one to use your word, where do you think they can go from here . I think they will probably go back to that. You make a good point, this is the perfect time to be having this debate given that the league is not playing right now. I think they are going to try to find something that both respects kind of the political consciousness of the players players but also the National Anthem. The other solution would be to play the National Anthem without bringing the players out at all and do that instead. I think they will try to come up with something. This is not a good issue for the nfl, and they want the game to be about the game. Eboni i agree. It is certainly not a good look. And viewership was down of the nfl. These then start fires inside israel which has been a big problem there but has not led to any deaths. In the past, the israelis would not have responded with military force to those attacks.
