Last year. The war was lost on trade many years ago. When they say not a free trader, i say, no, no, the war was lost but now were going to win it because we have all of the car cards. Dana and here now to break down the numbers, colin from the Fox Business Network, what is going on . We may all end up paying more for different items. Rhetoric is one thing, weve had for all time. But this is a real trade war right now to the extent that the u. S. Fired that first shot and the chinese coming back applying tariffs on they say 545 different items and a spokesperson for the Chinese Ministry of commerce saying that the United States has ignited the largest trademark in economic history. Whether that is the case or not, we can tell you that American Farmers with all of this back and forth are definitely already feeling some pain. I was in iowa last month and i met a soybean farmer there, ron heck, and he told me that things might have gotten worked out before the tariffs actually took effect but this morning he appeared on Fox Business Network with a more sober outlook. Farmers may get one paycheck a year when they sell their crop and when there a 25 cut in that paycheck like there has been for soybeans in the last month, that changes the sideways from making a profit to having a substantial loss for the year. The way it works one in three of u. S. Soybeans find their way to china and those prices are come down. And pork producers could be slammed as well. A quarter of the pork produced in the United States goes overseas, much of it to china. That is the concern, dana. But the Trump Administration insists that the costs are all worth it. And one individual from the white house came on earlier today saying that the president has promised and promised to take the fight for trade deals to our allies, and to others and to make the deals more fair and he says that this is just a move in that direction and a part of the process. Dana and so the tariffs in retaliation are the headline today. Yes. Dana but i wonder about the longer term issues, ongoing trade negotiators and partners. Have we figured out a way to best china or will china possibly be able to do a deal with other asian nations, the 16 nations and basically blocked United States from those markets . Well, you are free of the tpt, the transpacific partnership. It was a hedge against china and then the u. S. Backed out of it. And the other nations are moving ahead without us. It is a chess game. Very complicated. I had made contact with a man who does business with American Farmers that do business in china who emailed me today about this, saying that one of the things that they are worried about, what will the chinese do next . Will they go to russia to incentivese them to up their production of products like soybeans . Every move has a counter move. Well see what happens next. Dana and that former that you had just spoken of in iowa, the tariffs go in to place for, say, six weeks, is it easy to undo, in terms of the damage done to a farmer . Could they recover quickly . Not necessarily. That comment that he made right there, telling, sometimes the farmers are paid just once a year and it is hard to undo. What they are talking about right now, the soybean market istic to soybeans because their largest market is the chinese market. The fall harvest, right . This time of the year in the summer soybeans are bought from other parts of the word jean ways, brazil, argentina, but in the fall is when they buy them from us, the United States. If all of this is not resolved by then then people like him and others could have issues. Dana and our markets here, wall street slugging it off . Yes, sort of, some of it could be factored in with markets and that jobs report this morning, strong, that is a big part of it. One interesting thing that i will point out before i go, we are seeing some concern in china. The benchmark stock index there, the shanghai deposit, down 12 in the last month. And for china, their currency, a good deal of money coming out on the chinese yuan, their currency, this week, there is speculation that the government is involved. It has been in the past. But we saw it this week, interesting, Foreign Investors pulling money out, not a great sign for china. We are affected by this. As is china. Dana and that is a big market to effect. Yes. Dana the other big story of the day, President Trump narrowing down his choices to replace Justice Kennedy on the Supreme Court and the white house is preparing to roll out four possible announcements on monday focusing on these front runners and whoever gets nod will face questions about roe v. Wade in a tough Senate Confirmation battle. In 1973 by a vote of 72 the Supreme Court struck down a texas law criminalizing abortions but in cases where the act would save the life of the mother and the justice majority decision said that it was a privacy issue protected under the clause of the 14th amendment and opponents of roe v. Wade say that that decision was undemocrat and before 1973 citizens of each state could determine determine the degree to which they wished to criminalize abortions and roe v. Wade is said to have short circuited that democrat process and one chief justice who was a liberal supporter of a constitutional right to abortion criticized that case saying in 1985 that roe ventured too far in the change it ordered, going on to say,. Other opponents say that the roe v. Wade reliance on an implied right to privacy has little basis and one justice in 2005 wrote, saying, and even one former law clerk to Justice Blackmon had concerned about roe v. Wade saying in 2002 as a matter of constitutional interpretation and method, roe borders on the indefensible and went on to say, and still, critics of the decision face pushback from the majority of Miles Per Hour who is support it. A recent poll shows that 63 of voters today agree with it. Dana joining me now for more on this, a former d. O. J. Prosecutor, james, in 2005 when i was a spokesperson for john roberts and i was getting all of these press requests, asking me what i thought was about the roe v. Wade decision and about abortion but it was very specific. Do the justices, those nominees at the time, believe in a right to privacy in the constitution. I went, had i to have someone explain all of this to me. How did we ever get here . It is an emotional argument that people are having. But i wanted to have you on to help us to understand how the Supreme Court got to the roe v. Wade decision and why it is so controversial even 45 years later. Okay. Well, it is. It is still one of the most wellknown and controversial opinions that is out there. It started with a pretty inauspicious start, which is a woman who had given up two kids to adoption and wanted to aboard the third and the state of texas said that you are not allowed to do it, and she sued the district attorney, a gentleman named wade and she used the name roe and it was wade who by the way had prosecuted the shooting of oswald but anyone who has read the first ten amendments to the constitution knows that there is nothing in there speaking of abortion or privacy. But they found that it was in the penumbra, a shadow in the rights creating something that would protect privacy and it would also therefore protect abortions. At least allow for a balancing between the state interests and a viable fetus surviving and the rights of the individual and so the tug here was that they looked to the case and came down on the side of individual liberty for abortion up to the point of viability for the fetus but that rationale is difficult for many people and constructionists cannot stand the case because it created a right out of the shadows rather than the constitution text and now we have 45 years of adherence to this as the law of the land, creating another pressure to keep it as good law. Dana the other thing, i know that the states can continue to make its own laws. Of course they can be challenged. And i guess that that might be a way that, eventually, this issue would come back to the Supreme Court in the future. But the other thing is, what about does the Supreme Court take into account sort of new facts, you know, new science that we have now, that we did not have 45 years ago . Well, there is a way to do it. Im not predicting that this is how it plays out. But what you could do is to basically balance the findings of the roe v. Wade case, that there is a right to privacy. And factor in stari decesarisis and then still make a change. This he could say that look, back in 1973, technology told the Supreme Court that a fetus was viable, meaning that it could live on the outside of the womb, at the third trimester and so therefore after the third trimester, baring danger to the life of the mother were not going to stop the state from probst hinting abortion but they could march that back. Most of us have seen in the last 20, 30 years where technology has developed to the point where there are a number of babies who survive out of the womb at shockingly early ages and they could march it back another trimester saying we give up on changing the law of the land and roe v. Wade will affect that first trimester where a person has an unfettered right to abortion but maybe it becomes at the threemonth mark at the end of the first trimester that you speak o of the restrictions from states as more severe. Dana no matter what, if the president is successful in getting a Supreme Court nominee to the Supreme Court, nothing changes the next day, possibly never, maybe it never will but it is not an immediate change . Is that right . Right. Were seeing this with the recent ruling on gambling, a prohibition on gambling was lifted and some states were ready to pounce to have sports gambling in their jurisdictions, other jurisdictions are looking at it and some will not change and it will create 50 different workshops where a number of different state cost figure out if they wanted to modify or increase the level of restrictions that they have with abortions, or not. And i would expect that we will have a patchwork of different regulations across the different states. Dana we appreciate your expertise, thank you. Sure, thanks. Dana three areas to get to, First Talking nato, what do you know of the europeans and how they are trying to position this meeting as being a success knowing that the president is kind of in a mood on his way over there. Kind of in a mood. That is a good way of putting it. I think that this is probably the most pivotal meeting since the founding of nato. What were really talking about here, dana, is bigger than are you or are you not paying the 2 . He is not the first president to criticize. We could go back to the Bush Administration and president barack obama. Secretary golden states, he had warned that nato would have a dismal future if it did not live up to its commitments and so this argument of who nato is, it is timely because we have entered into a new era. This is an era of great power competition, because you were talking about the trade war between russia, china, just ignited and for the rest of our lifetime that great competition between the u. S. , china, russia, we have to live and deal with this as a nation. Therefore we should not just be discussing nato allies living up to commitments but how will the allies factor in on the new era of warfare that well be in. Dana do you think that the United States position is that nato is necessary and russia constitutes a threat . Absolutely i think it is. I think that this president and his ambassador, his Homeland Security National Security advisor, that the two of them are skeptical by nature of these large institutions. And i think that the skepticism is warranted. They feel that we pay too much, get too little from these. Our nato allies need to know that the president is concerned about america getting a fair shake and come to the table saying what does the future of the alliance look like . That should be the discussion. Dana and meanwhile the secretary of state mike pompeo going to north korea issuing a Statement Today saying that our leaders made commitments at the singapore summit on the complete denuclearization of north korea and went on to say, dana and so he is over there with, again, a little bit skeptical but they want to keep the positive momentum going. Do you think that they can continue to do that . Well see. I would love to see the details on this. Secretary of state mike pompeo has a task set out for him that is, in some ways, seemingly impossible. I think that it is almost easier to get peace between the palestinians and the israelis than to get the North Koreans to live up to this. But i think that the president has made it clear, that we are negotiating in a good faith effort to change the trajectory of the country, not just the relationship between the North Koreans and us but the future of north korea. In saying that, you know, what we cannot live with, the president has made it clear, it is north korea having the ability to hit us. I think that the president and the secretary of state mike pompeo are making a good faith effort here. The alternative here is that the North Koreans have to know that that alternative is still war and no one wants that. Dana one more minute with her. The president has to meet with putin and syria an issue there, the final word. Im verbose but i will try to be quick. This is a difficult challenge. What the president inherited in syria, again, it is a state where russia and iran rule the day and so what you have to look to here every time that secretary john kerry made commitments with russia, they never live up to them. They have not lived up to any commitments. And so you say how do i get to a solution in syria. Russian and iranian economy are not in good shape. They have a vested interest in seeing a political end to the war as well. But Everyone Wants to save face and we have to look to the israelis as well. Israel does not want to see a syria taken over, emboldened by iran and so there is a potential wider middle east conflict here between israel and iran if the russians and iran do not come to the table in a meaningful way. And so an oxygen line is being brought through about three miles of cave where the boys are. They are a mileandahalf underground and a Communications Line as well to help with a rescue effort, dana and to connect these kids with their families. Now back to you. Dana and, greg, going back to the diver who passed away, what happened to him . Yeah, that is a big concern, a big sign of both heroism and also the risks of this whole thing. He is a 38yearold, expert, elite, former thai navy s. E. A. L. Diver who volunteered to help. He got in there, helped with the boys and providing oxygen but on his way out he ran out of oxygen and he could not be resuscitated and people say that if an expert diver cannot handle this kind of a maneuver, then how would the kids. The other reports are, that prior to this, the kids did not know how to swim and the other option is drilling into the side of the mountain or waiting until the rains and water subsides but it seems that, again, according to the official, that latest word that were getting that those two option also not be acted upon. Dana and he on sunday, i had a call earlier today sunday in an interview he said that he would not be asking that question of these particular nominees, well take a listen to that. We do not have it. Well, they will get it. You know what im talking about . Yes. Dana and on the campaign trail he definitely said that, putting out a list of possible nominees. Now he is in a situation where he is a sitting president. And just last week the Supreme Court said on the travel ban case that you cannot take something that the president said as a candidate and hold him to it as president. Now they have it. Well listen to what he had to say with maria. President trump well that is a big one and probably not. All of them are saying dont to that, you shouldnt do that. But im putting conservative people on. And im very proud of neil gorsuch. He has been outstanding. His opinions are, you know, so wellwritten, so brilliant. And im going to try and do Something Like that. But i dont think im going to be so specific in the questions that i will be answering. And im actually told that i shouldnt be. Dana what do you think the senators on the left will ask of these candidates, these nominees that might give you a reason to change your mind . Sure, dana. And first ill say it is no surprise that donald trump is walking that statement back. We know that the majority of the country does not want to see roe v. Wade overturned. Im not sure if his handlers have convinced him to walk back his statements but we still do take trump at his word and we can trust that he has gotten a list given to him by the federalist society, a conservative organization that does not believe that the constitution protects a womans right to have an abortion and so well take him at his word. Dana i did a piece at the start o of the show talking abot the roe v. Wade decision, even judge ginsberg said that it was not a good decision and the the way that they got to it, the constitution does not say in there, that there is a right to privacy which is what this really hinges on but i will give you your point, 63 of people in the poll say that they are well, do not want to see roe v. Wade overturned. And so there is a lot of activity. I know that you are planning ads in all 50 states and a lot of activity that you will put into the effort and what do you hope would be the ultimate good outcome for you on this if the president actually has the votes . Well, sure, absolutely. Well, you know, because the bar is so high and there is so much at stake we introduced the personal liberty standard where we encourage everyone in the senate to hold justices to a higher bar. In the past weve seen people kind of give vague answers on the question of roe v. Wade or even, you know, kind of say blanket statements about respecting precedent but we are asking it to go a stop further, asking for people to affirm that they believe that the constitution protects the individual liberty to make decisions about your body and relationships which would include access to contraception, access to abortion and the right to marry whom ever you choose. Dana but if the constitution does not actually say, there is no personal liberty standard, i think is what you called it, in the constitution and if the role of the Supreme Court is to interpret the constitution would you like the justices just to make it up . No. This is actually something that comes down to the legal difference genius tises who weve seen rule against access to abortion and access to reproductive rights over and over again and those who have upheld that fundamental right, it is a question of is the liberty in the constitution covering everyone in the country, evolving over time or strictly what the founders had written in the original. But i would just want your perspective about the energy that they are putting into trying to knock down one of the President Trump nominees when either they do not have the votes. But they are asking for the justices to come up with something that does not exist in the constitution. There is no personal liberty standard that is spelled out. You are absolutely right. There is a lot of misinformation going around. Number one, the left is pushing this narrative that when roe v. Wade is overturned that suddenly abortion will be illlegal nationwide be banned and that simply not true. What will happen when roe v. Wade overturned is that the abortion issue will return to the states, following the principles of federalism and state rights and the states at the local level will be able to talk to their constituents and make their own decision about what is best for their state, regulating abortion, protecting Womens Health and safety. It is time to stop misleading women about this issue of what happens when roe is overturned. Dana want you to look at this ad that the aclu will run in the state of maine targeting senator collins, watch this. The trump Supreme Court nominee must publicly declare a position on roe. Tell Susan Collins that we cant gamble on this. Americans nee need to know wher the nominee will protect the right of women to make their own healthcare decisions. Dana katherine, when you look to this from a political perspective and counting the votes, right . The republicans have a slim majority. We do not know how anyone will ultimately vote. But we assume that there will be maybe some defections on the republican side. But you could see some Senate Democrats up for election in red states decide that they want to vote with the president on this one. How are you approaching it politically . The ad, like the one that you just showed, it is really ludicrous because it is exactly the wrong way to approach this. This should not be a political vote. This is not something where you are asking a potential justice, a nominee, how they are going to rule in future cases. But with that said, roe v. Wade was wrongly decided and we do expect it to be overturned. Now more than ever. It was handed down by liberal activist judges back in 1973. It has been propped up in the decades since. In 92 in particular. Based upon that false notion that women rely upon abortion in order to plan our education, our careers, our families, our futures. And thats simply untrue. It is reviled really on the left and the right for its legal reasoning when even Justice Ginsberg calls roe v. Wade the most extreme law in our country, poorly reasoned and that it went too far, too fast. It is time to revisit it. That is what we expect. Dana let me ask you a final question, just taking a look at, you know, the poll that i had referenced in that previous block with erica, that 63 of people say that they do not want to see it overturned. I know the personal conviction from which united for life comes forward with its positions but i wonder what you think of that popularity of roe v. Wade even if everyone agrees that it was poorly decided . Right. Well, you have the legal aspect and you also do have the popular opinion aspect. But the interesting thing about that poll, there are a couple of other recent polls coming out, mbc and ipsos reid, a few new polls and when you look to the methodology and the questions that they ask they will ask do you believe that roe v. Wade which established or guaranteed a womens right to abortion should be overturned, without providing further information. But when you look to the most recent gallop poll more than 50 of americans, say that abortions should be legal in either no or limited circumstances which required overturning roe v. Wade and so actually a majority of americans do want roe v. Wade to be overturned and that is it what we are working towards. Dana all right, Katherine Glen foster, appreciate you being with us. Is only 15 years old, the country survived a long time without i. C. E. And can survive without i. C. E. But i want to cause democrats because calling for abolishment will not really change anything. As long as this administration is in place, there will be a challenge to the false narrative that we cannot exist and be a country of law order with secure borders but not rip apart families trying to cross the border and so i do not think that it is out of control at all and it is not just democrats. First off, not all democrats call for the abolishment of i. C. E. A small section of the party is. And there are 19 former i. C. E. Agents themselves raising concerns about the way the agency is running and i wanted to dispel that narrative. Dana certainly those on the right have fallen prey to three, four or maybe ten people saying it is a new policy and then a Republican Caucus is targeted or tagged on that. But on this issue do you think that it is actually better for republicans, for the democrats to be calling for its abolition, not all democrats but enough that it is getting attention. You only need a few because the president is very good at framing things around what a few say and in the pool they say that immigration is the number one issue and i think that that is a euphemism for security because i think that the views among the percentage who speak of it differ a little bit because there was a poll saying that some face legalization. But here they want security when they say immigration and the president portrays it at mf13 flows over the border and threatens you but people hear it, get scared and then they hear democrats even if it is just a few saying that they want to abolish i. C. E. Which is what i think that President Trump is framing here. Do you want safety . Security . A wall. Vote for republicans. If you want to abolish i. C. E. And have no security, vote for democrats. That is just playing into the hands of the president. Dana and while i have both of you here i wanted to ask you about the somebody fight and reading you this on the democratic strategy about the nominee. If democrats can make enough noise to sway moderates like Susan Collins and others over to their side it is possible that they could collectively stonewall a potential nominee and at the very least get people riled up for the next election. Do you think that that is the strategy . Is it a good one . I think that the democrats have very little leverage here, we cannot trumpet America First attitude and then the administration chips away at those Democratic Values controlling the house, senate, congress and the courts and we need balance. Dana but what values do you think are being chipped away . What is an example . There isnt a healthy debate and dana im way to the left, a progressive person but rooted on a healthy Republican Party and i do not think that we have that. I would champion a Healthy Exchange of ideas, and social norms and we do not have that right now. There are fractures in both parties, a healthy generational shift happening in the Democratic Party and in the Republican Party you have the never trumpers who are battling new trumpers who are politically active. The court has been a balanced court and it will not be balanced if we allow someone who is way to the right to get on the court and not Everyone Wants to focus that argument on roe v. Wade there are other issues that will surface as well. Affirmative action and dana and, jamie, lets just say, i do not think that the Republican Party is as fractured as it might have been three years ago but nothing can focus the mind for a party like a Supreme Court nomination. How do you think that that is shaping up . There is no question. Because in terms of the always balanced on the court, i do not know where that came from. I do not think that it has always been balanced. There have been problems with Supreme Court debates where it is getting more polarized but republicans or democrats in power, the somebody has become such an important issue that they will take out all stops to get their person on the court. It is not about balance, it is about, you know, trying to appease your voters and republicans want more conservative justices and the democrats want more liberal justices and whoever is in power, at this point, that is what they will do, looking to appease their base.
