Well the City Attorney in Springdale Arkansas defending the release of a 2006 Police Report involving allegations josh duggar sexually molested five girls, including his sisters, five years ago. The city said they were abiding by the media request and had to release it because he was 18 when the report was fired. But two of his isissisters are blasting the release of the report saying they feel revictimized by the media. When you foupd out this was going to be on the cover of in touch weekly what was your reaction . Like they dont have a right to do this. They cannot do this to us. And yet they did. And they did. I just know it is tragic when someone who has been victimized once is victimized all over again. There is a lot talk about the Police Report being released. I think if you have a Police Report talking about sensitive as a Police Department need to make sure the Sensitive Information in there isnt in there so when you read back the name you can identify them. If you redact the name of the victim but say who lived at this address it doesnt make a difference. None of the victims should be put through that. That is what i wanted to ask you. I know you were a Police Officer before being a judge. Is this standard protocol or was it sloppy . Or were they trying to get the duggars . I cannot say they. The statutes that deal with the release of public reports vary from state to state. In arkansas and in most states, what the law deals with is the records of a juveniles conviction, ajudication of any crime, and the purpose is we dont want a mistake when you are 14 or 15 to haunt you the rest of your life. This would not have qualified under that definition anyway because this wasnt an arrest of the juvenile. This was at best an interview. Even then i am hearing it happened when he was an adult. So you have a loophole where he wasnt a juvenile at the time he was interviewed so it would not get the protection a juvenile would. From a policy standpoint it should because if the goal is we dont want the act to follow for the rest of the life do you care if they find out about it at 16 or 25 . No, you should not. The arkansas version of this law as we understand it is one of the stronger versions of the law and if you disobey that it is a misdemeanor but what protection for the victims . The victims i started with saying if you protect the victims identity of any rape it doesnt do good to leave enough details in the Police Report you can identify them.
