We begin with breaking news. The New York Times is the first to report a story that President Trumps legal team sent a memo to Robert Mueller in january asserting broader president ial powers. The memo, the lawyers argue the president cannot be compelled to testify and cannot obstruct justice because he has authority over all federal investigations. New lead lawyer Rudy Giuliani tells abc news, if mueller tries to subpoena us, we are going to court. Joining us in manchester, new hampshire, corey lewandowski. Is that the president of you . That he cannot be compelled to testify and that he cannot as the president , obstruct justice . I am not an attorney so i want to be very clear about this but what this memo outlines what their team has said was, if the mueller team will subpoena the president , that is something they believe is not authorized because of his position. What they are trying to do is trying to sit down and figure out if the president will sit down for an interview, tha interview will be based on a narrow scope of questions that the team is trying to negotiate. What giuliani said, if the mueller investigators decide to subpoena, they will take it to court and i believe the court will be on the president s side on the. Chris in this specific issue, it has never been adjudicated. There is a long history of the courts orderpresident to do something and president s agreeing to do it. Subpoena is a court order. Thomas jefferson, Richard Nixon had two bouts of the Supreme Court and releasing the watergate tapes. Bill clinton had two bouts of the Supreme Court when it came to testifying in the paula jones civil suit. Thats exactly right but you have to remember, the giuliani legal team is trying to negotiate with the mueller team to decide if its the right thing to have this interview and if so, they want to understand the scope of the questions. Theres the potential to avoid teams cawork together and it is determined the questions that will be asked will be relevant to an investigation to prove once and for all, there was no collusion. It sounds like what giuliani and his team are saying, you dont need to go the subpoena route but if you do, we will fight it in court. The president has offered to sit down with the investigators but he has said, they want to understand what the scope of questions will be before they sit down and do that. Chris i want to try to lower this down a little bit. Giuliani says if mueller gets a subpoena which is a court order, giuliani and the legal team will go to court. What if the court says no, mr. President , you are wrong. Is the president prepared under his understanding of his powers and the executive branch. Is he prepared to defy a court order . I dont think so and i havent spoken to the president about it. Thats a question for his legal team. I think the president respects the rule of law, theres no question about that. There is a way to avoid all this. Theres a way to avoid a constitutional issue which is working with giuliani and his legal team and the mueller investigators if they can come up to a resolution which will ask the president to sit down and have a conversation which is limited in scope. Then the team will decide if the president s willing to do this. At the end of the day, what the mueller investigators can do, they can write a report to congress and to the Justice Department and show there was no collusion between the president and the russians and thats where we are. If the president is asked to sit down and discuss this, he will say exactly that because i know it to be true. You know it to be true and the American People know there was no collusion. Chris i want to talk about another part of the memo. We should point out, this was written by the president s former legal team in january, including john dowd. Was sent to mueller. Giuliani was not part of that but he is embracing that january memo. Another part of it basically says, the president has the ability to pardon anybody he wants. I want to look back at that because the president has thinbeen busy with his pardoning this week. Dinesh desousa. He says he may part in martha stewart. It may pardon former illinois governor rod lavoievich. I think the president is sending a message. Basically, i will use the pardon power to pardon people even if there convicted of leaking or obstructing justice. If you are with me, i have your back. Chris longtime Trump Advisor Roger stone said this, it has to be a signal to mike flynn and Paul Manafort and even Robert Mueller, insight people for crimes that dont pertain to russian collusion and that is what could happen. So, are you saying, is the president saying, he can pardon anyone he wants including people that are swept up in this investigation . The constitution is very clear and the power of the president as defined by the constitution allows him to pardon anybody he wants for federal crimes. No one is talking about the pardon of the heavyweight boxing champion, jack johnson which is something the Obama Administration had a chance to do butchose not to. But never has this president sent to the best of my knowledge, hes even thinking about a pardon for mike plan or poor Paul Manafort. Chris but you are sang he could if you wanted to. Of course under the constitution, he has the power to pardon anybody. No question. Chris lets turn to spy gate. The allegation by you and others in by President Trump that the fbi inserted a spy into the campaign. Heres what President Trump said and also what republican congressman trey gowdy said after he got up has five briefing from the Justice Department and the fbi. How do you like the fact they had people infiltrating our campaign . Can you imagine . Im even more convinced the fbi did exactly what my fellow citizens would want them to do when they got the information they got, and has nothing to do chris corey, thats trey gowdy. A conservative republican. He led the ben ghazi investigation and he is undercutting what the president and frankly people like you talk about when you discuss spy gate. I am very concerned what we dont know, unequivocally, is the fbi taken informant and put them in the campaign. Because i never spoke to anyone with the fbi as the mpaign manager. Never today notify me of their concerns about potential russian meddling. Never did they notify me or anyone else of a potential spy entering the campaign. Never did they notify anyone im aware of that they had those concerns. Whats more disturbing to me, theres only one campaign involved in the general election that took 5 million, hired a former spy to crte a fal dossier. That was the Clinton Campaign and it doesnt sound like they were so concerned that they put a spinto that campaign. Lective enforcemenall if it did take place, there better be accountability. While both of these cases, they are able to say these things. They are also very much able to face consequences if they do so. I agree with what marie was saying in the sense that this culture is in a place where we use this poker language. When you think about what Roseanne Barr had to say in terms of calling Valerie Jarrett and ape, a black woman. This speaks to race in our culture. Dehumanizing people, oppression, slavery. You dont think what samantha bee is dehumanizing . I do, let me finish. Is poker and rank and unnecessary. It does not speak to the idea of tearing apart the social fabric around the most central and difficult issue in america. Race. One of these items speaks to tearing at the social fabric in a way that cant be undone and puts us in great danger. Thats really juvenile compared to the seriousness of whats taking place. You think about the nfl players, you think about charlottesville, i can go on. You understand they are playing two separate us as a society. I think you can defend what abc did with Roseanne Barr. I am not calling for samantha bee to be fired by tbs but i am wonderinher there will be any consequences for samantha bee aside from a few advertisers temporarily suspending their support of the program. Wait, i want to move to another subject and that is the Russian Investigation because we do have this news of the president legal team back in january sending this memo. Brit, you and i have covered a lot of scandals and are taking a on the president s powers when it comes to obstruction of justice. Having to sit down and answer to a subpoena and pardoning. Your thoughts about it . I think obstruction of justice, the memo may be legally found in that the president has broad powers over the actions of the executive branch of which the Justice Department and special counsel is most certainly a part. The question whether hewould have to answer process , so respond to a subpoena is another. We do know the Supreme Court has ruled Richard Nixon had to produce material evidence which he ultimately did. Whether that would extend to sitting for an interview, or being called before a grand jury has never been fully adjudicated. I think the president may not be on as strong ground there arguing that. Will President Trump insist that kim shipped out all of his nuclear weapons, all of his nuclear fuel, all of his Ballistic Missiles before the u. S. Makes any concessions . I think thats what denuclearization means. We will start a process and i told themto take your time. We can go fast or slowly be. Chris now the president is talking about a process of negoti not what john bolton was talking about which was unilateral, immediately disarmament. I think at the end of the process, thats the goal. Unilateral disarmament. It will be a process. I am not directly involved in them. John bolton is and the president. But sure, these negotiations take time. Its the same on trade. All of these negotiations take time. Everythings on the table during the negotiations. You cant expect they wont change rome in a day. I think thats a realistic attitude. The key point is that we are sitting down. The second key point is that the president has been bolder on this and korea and on world trade than any other recent president. Everybody says you cant do it. The president says hang on a second, we may be able to do it. Chris lets pick up specifically on that aspect because the president says the main reason he has gotten kim jongun to negotiate is because of this policy of maximum pressure. To really squeeze him. But this week, north korea is talking with the South Koreans, talking with the chinese. Hes talking with the russians is what President Trump now says about his policy of maximum pressure. I dont want to use the term maximum pressure. Because we are getting along. You see the relationship. Ch hasnt tim in effect ended his economic isolation without giving up a thing . I didnt know that. The one hes talking with china and there seems to be every indication they will relax economic sanctions. South korea is talking about an economic partnership. This is longer maximum pressure. I think over time, it may be relaxed but right now, i dont think so. I think the sanctions are in place, and they are very tough, very strong. I think there was a moment a week or 10 days back where the president was concerned about the chinese sanctions. They said we are still hanging tough. This is tough economic pressure. I think president whole attitude with respect to north korea. People yelled at him and said you were too strong. Everything is on the Table Including military action. That stuff works over a period of time. As we head into negotiations, i think the president is being very realistic and will take a period of time. I dont think we will let up on any of these matters. Chris the question is whether the chinese and South Koreans in effect have already started to let up. Let me turn to tariffs and the president s decision to go ahead and impose tennis on metal imports from some of our closest allies. Canada, mexico, the european union. You dismissed it as a family quarrel. Canadas Prime Minister, Justin Trudeau said its a quote, turning point in relations. He went on to say this. These tariffs are an affront to the longstanding Security Partnership between canada and the United States. And in particular, an affront to the thousands of canadians who havefought and died alongside their american brothers in arms. Chris sounds like a lot more than a family quarrel. I dont think our tariffs are anything to do with our friendship and our Longstanding Alliance with canada. Chris but we are imposing the terror because of National Security reasons. That is the implication that some trust canada as a reliable National Security partner when it comes to supplying steel and aluminum. I dont think we are satisfied yet that they will protect or uphold all of the shipments of steecoming into canada from around the world. Could be china, could be brazil and a lot of different places. This trend shipping effort has been troubling to us. The president has declared our Steel Industry a National Security matter and he hopes through these actions to rebuild it, there are signs that may be possible. In the announcement from the white house, it said very good faith you negotiations. E thats why i regard this more of a family quarrel. This is a trade dispute if you will. It can be solved if people work together. But, i must say this. This president from day one wants to reform the world trade system. It it working. There is so much unfair trading and illegal trade practices. Virtually no reciprocity. The World Trade Organization which sets these rules has been totally ineffectual. It has in some cases damaged the American Economy and American Workers and manufacturing and other businesses. So the president stepped up to the plate and as somebody was a free trader, ive got to say, if y have a level playing field, you can operate freetrade. Chris you make it like this is the beginning or midway point in negotiations. In fact, it represents somewhat of a breakdown. Let me put the timeline on the screen. President trump first threatened to impose these tariffs on march 1. This weeks action comes after more than a month of negotiation. The eu is now imposing tariffs on 3 billion of u. S. Goods. Canada on 13 billion of u. S. Imports. And for all the talk of protecting american jobs, the American Steelworkers Union opposes putting tariffson canada sing their exports are fairly traded. This isnt the beginning of a family squabble, the family has broken up and going into separate rooms. Sometimes that happens. Sometimes families have disputes. Goodfaith negotiations were part of our announcement the other day. Chris this is what comes at the end. The American Economy is booming and that has to be part of the discussion with respect to trade and confidence is booming. So that has to be part of the discussion of these matters can be solved. No one said they cant. Whether they will be, i dont know. The president s vision here and its very important, hes a trade reformer. At end of the day, he wou to see free trade but these barriers have to beswept away. Unfair trade practices, illegal, places like china. Chris we send more steel to canada than they sent to us. We they buy our steel and we buy their steel. Im not satisfied that all the loopholes has been closed. There are difficult issues, the president has raised the issue of intellectual property and darien farming and agriculture which is very important to our farm folks. It may be worked out. These tariffs may go on for a while or they may not. I dont want to make predictions today. Im just saying lets talkit through , but to say this is an attack on canada is not right. Chris i didnt say it was an attack on canada, thats what Justin Trudeau, the Prime Minister said. I think hes overreacting. I dont want to get into the middle of that. A friend and ally of the United States, nobody denies that but we need to protect oures. Chris you were a tv analyst when the idea of tariffs on heres what you said. We are already hanging by a toenail. If we have to walk out of nafta or those negotiations break down, then this deal thing turns from a minor irritant to a major calamity for our economy and stock market. Chris mr. Kudlow, thats where we are now. The nafta talks have broken down. The tariffs are on. To quote larry kudlow, a major calamity for our economy and market products i hope it work. I hope it works out. Chris thats pretty cavalier. The nafta talks having broken down. As i said, take a look at the communiquc the white house put out. Goodfaith negotiations are welcome and we hope to continue. So i dont think things are broken down but i dont want to be cavalier about anything. These are very serious matters that can affect the economy. There are worries about that. So i dont wany that. But i do want to say this, if you cannot abide by the rules. Thats the thing. In the world trade game, rule breaking is all over the place. Thats why i think the president is right. Weve got to make reforms and stand up for u. S. Interests as we go along. Dont blame trump. Blame china. Blame europe. Blame nafta. Blame those that dont want reciprocal trading. Tariff rates and protectionism. Trump is responding to several decades of trade abuses. Chris want to get to something i know you want to talk about which is the very solid jobs report on friday. 3. 8 percent unemployment. The lowest rate since 1969. 3. 6 percent for women. The lowest since 1953. 5. 9 percent for black americans. How long can this last and sitting here right now, can you honestly say the possibility of trade disputes couldnt jeopardize that . It might be i dont deny that. You to keep an eye on that. Chris it can jeopardize that. Its possible. I think whats turned out to be the best prosperity boom in decades. The economy is clicking on all cylinders. As you noted jobs and unemployment. Money is being repatriated, trillions of dollars coming back home to the usa. We are right on the cusp of the three percent growth all of our critics said we couldnt have. Other private broadcasters are looking at four percent growth in the second quarter. I hope we get there. I would take another three percent growth. I think the tax thats in the rollback of regulations has created not only new incentives for tremendous confidence. Consumer surveys, business surveys, Small Business surveys. Trade conduct tale into this in a very positive way if the president is able to change these trading practices. Chris last question. There is a federal directive since the reagan years. The president you worked for and where we first met that the president does not comment on the jobs numbers until at least an hour after their formally announced. The president , 7 30, an hour before said looking forward to those numbers. And the markets reacted. You have said he did nothing wrong. Question, has he agreed he wont do it again . By law and custom, i was doing my job and it was number and i got a hold of him on air force one. Has he done anything wrong, other president s have done this before. Chris no, he did it before he got the numbers. President s can say what they will say. If you put the number out, that would been a much more difficult proposition. Will he do it again, i dont know if he will do it again but i hope he doesnt but you know, just saying lets look at the job numbers. All of america is looking at the job numbers. Is the president giving up too much without any guarantee of what he will get . Its long been thought for the president of the United States to sit down with some rope dictator would confer legitimacy on that person and is therefore not a good idea to do unless exchange for something worthy. Theres a few in this administration, we dont know if its right yet. Something really is different with the north koreans at this time. We will find out. I think the president seeming eagerness for this to go forward is a little troubling because it may look like he wants the deal too badly which weakens your position. At the same time, he does appear to be prepared for the fact that it wont be some staggering breakthrough in his first round of discussions and it could lead to a long process. Which is a realistic way to look at it. And thats what you hope for in a negotiation like this is that the president has realistic expectations which mr. Trump at times seems not to. Chris i go back to what bolton and pompeo were staying in the beginning when they were talking about the first meetin , when will you get rid of everything and if they didnt give you a date, you get up and walk out. Now theyre talking about a process, a series of meetings. Negotiations. Givenorth koreas history where they make promises and renege on them, does the summit still make sense . No, if you put in those terms but brit makes a wise point. You hope this leads to something and that it is rewarded in the end. The problem is we know historically going back to kim jonguns grandfather, bill clinton and in 1994. These people live. They are deceitful. They will take the concessions. Keep them in their pocket and then they will deliver. So it looks like the president is saying, maybe we can and the korean war that will be the big announcement at the summit. Maybe we can say that we are lessening sanctions in the hope abut that seems like a lengthy process and it does not seem to justify rewarding a brutal dictator with a position on the International Stage lets turn to the other big news and that is the president announcing new sanctions going into effect on june 1 against some of our closest allies. The eu and canada and mexico. Heres what the president said on friday. The American Worker agrees with me. Obviously, ttock market agrees because when you look at the stocks, you are starting to see them chris going after china is one thing, going after our closest allies is a different matter. Its a terrible idea. He talks about the American Worker and hes talking about 140,000 steelworkers in america. The wall street journal points out there are 6. 5 million American Workers in Steel Using Industries that will be harmed by this. Chris the auto business. Across a ton of different industries. Whether its trade or diplomacy, hes really good at tearing things down. He ripped up ptd, nafta, so far hes been good at ripping things up and not good at building things back up or putting new agreements in place. Thats what will be interesting but as you get tariffs and trade and nafta which the canadians are very upset about or north korean diplomacy, whether he can actually make deals or just tear them up. That is an open question today. Chris i want to pick up on the last thing i discussed with larry kudlow and that is these astonishing job numbers.
