You know, americans can count at least up to three. If you take the senate, and the house independent republican control and the white house, there has never been a shutdown with the republicans in charge of all of those bodies. There was hope the afternoon when Senate Democratic leader Chuck Schumer was invited to the white house to meet with President Trump. And it would be except the democratic leader has convinced his members to filibuster any funding bill that doesnt include legislation, they are demanding for people who came into the United States illegally. We have heard, though, from Sarah Sanders that maybe will be a written statement in her name or the president s name, well bring that to you this hour once we get it. In the meantime, the president on twitter, his focus oftentimes in terms of getting the word out, there saying, quote, not looking good for our great military or safety and security on the very dangerous southern border. Dems want to shut down in order to diminish the Great Success of the tax cuts and what theyre doing for our booming economy. That word from the president. Talking to senior officials here, they believe that while, yes, obviously republicans are in charge of the white house, the house and the senate, as mike emanuel reported they are jumping on the fact at the white house and they did all day they only have 51 votes in the senate, they dont control. That they needed democratic votes in the senate f you look at the New York Times website theyre framing this as Senate Democrats block a bill to keep the government open. In fact white house officials are looking at this poll coming from cnn, a source they dont usually cite. Cnn has a poll, what do you see as more important they asked people avoiding a 14u89 down or continuing daca. 56 saying avoid a shutdown, only 34 continuing daca, shuck schumers main point. You flaerd Lindsay Graham, put out a great, general james mattis said, quote, the damage defense cuts in continuing resolutions are having on the military is sobering. I have full confidence we will be able to respond in a bipartisan manner. What hes referring to is one, general mattis suggested that this budget from daytoday, weektoweek is hurting military readiness in a time when we have all of these hot spots around the world, all of these big threats from north korea to iran and the rest. They had to get 60 votes for closure to move on to the actual bill, which was a month of funding for the Government Plus six years for the Childrens Health insurance policy, chip. And it wasnt even close. Right now, you have democrats, donnely from indiana, highcamp from north dakota, man chin from West Virginia, jones from alabama, and mccaskill from missouri all voting with, saying yes. You had graham, flake, paul, lee vote nothing. You will have senator mcconnell, believe it or not, vote nothing so he can bring the bill back up. Shannon thats a procedural trick, you have to be in the prevailing party to bring it back up. To reopen the vote. Bret yes, but were heading for a shutdown. Shannon in 52 minutes. Bret i think its going to look different. Past shutdowns, 2013, it was very visible. The Obama Administration decided they wanted it to be visible. They felt that the politics were working in their favor and that republicans would really feel the brunt. You remember, the veterans showing up at the world war ii memorial and getting turned away. And all of the press conferences about how bad it would be. Today, Mick Mulvaney said it wont that be way. We thought it would be interesting to hear from somebody our viewers know very well, who is talking about this very thing, president obama back in 2013, charles krauthammer. The president is the one who carries the burden and the blame for the overall economy which is why he enjoys the shutdown. He enjoys it politically, because it hurts the republicans. And everything hes done, is to play to it and to show himself as the one who rides above these crazies on the other side. I think that that part of it, the feeling of this shutdown, is not going to be as intense. Theyre going to work, i bet, to get some number of days where they get the funding. Whether its three weeks as Lindsey Graham suggested, or five days or seven days, that by monday morning i doubt youre going to have workers furloughed, there is going to be an effort to get to the bottom of this. The president tweeting not surprisingly today and tonight, he said excellent preliminary meeting in overrule with senator schumer working on shugss for security and great military together with Senate Majority leader mcconnell and speaker ryan. Four week extension would be best. We heard it was positive meeting. Then later schumer was upset because he said i thought things were going well, i walk out of the offers and now he, quote, talked to his hard right and things are changing. You look at a new cnn poll and it says that democrats will get the blame as of tonight. The American People are supportive of find something kind of solution to that. The devil is in the details, thats the problem. Versus avoiding a Government Shutdown. They do really well in Government Shutdowns. Often they have the media on their site as well make tharg case for them. Bret and republicans were really good on messaging today. They all said the same thing. Nothing in the bill the democrats oppose. And every democrat who was asked that didnt have an answer. Its all about daca. Senators mcconnell and schumer just left the floor. Whether they are taking a phone call from some one, whether they are negotiating the next steps, we dont know. But there could be a shorter term c. R. That comes out of this whether its tonight or tomorrow morning. Shannon we know that the House Democratic caucus called everyone together for tomorrow morning. House members didnt run home as they off do on thursday or friday. Whatever happens in the senate may come back to them, they may have to vote again. But its highly possible we get through the weekend and people wake up on monday morning no, Major Services disrupted, there arent people being furloughed, then we come to a cliff again in five days of funding, two weeks, whatever it is, seems like this is the way they govern. Bret it is much its not a we to run a railroad. It will be that they have to deal with the big deal. They have to come to some, you know, conclusion on that. But they need time to be able to do that. The administration would like more time, democrats would like to leverage to be able to have it as short a time. I think youre going to see some republicans really feel pretty good about this. This is the danger that, both sides feel okay. Democrats say, no, its republicans. Republicans say its democrats. In that scenario, if theres not a deal struck you could have one of these deals where it goes 16, 17 days of shutdown. Then you are feeling it. Because nobody is getting paid. Still showing up for work but they arent getting paid, thats not fair. Shannon and they do, we understand most of them, get that pay back. Bret not getting paid there. Shannon but there are costs with stopping and starting major functions of the government, all kinds of studies nonpartisan that say you know our economy takes a hit, the gdp takes a hit, if this goes on any substantive amount of time. It does cost money to turn levers off and on. A lot of agencies fades people out, they have a phase people out, stepdown plan, not like it happens overnight. Bret right, but there was a choice the last shutdown, they wanted it to happen overnight. Mick mulvaney talked about that today, theres money that can be used to lessen the blow which they, i think, are doing. Only other caveat is that a lot of these agencies dont have lower level appointments. The nominees were never put in, didnt fill the spots. Some of these places are kind of, you know, holding the dwiek their fingers because theres a lot of things going on. Holding the dike with their fingers. What governmentrelated services will continue to fully function, what wont, so many questions. Leland vittert is here to answer them for us. Good evening. In 46 minutes its not like cinderella, the clock doesnt strike midnight and the lights go out. For most americans in the short and even medium term not much changes. Social security checks will still go out and the United States Postal Service will be there to deliver them. Air Traffic Controllers keep directing planes. Federal Law Enforcement keeps working and the United States military will stand watch around the globe. For hah mat irrelevant and some of the most dangerous places they will wage war around the globe. The big difference who gets paid. Government employees will not get paid if this keeps going for a long period of time. What are called nonessential Government Employees will be furloughed. James langford, the senator from oklahoma, pointed out in every one of the Government Shutdowns there have been more than a dozen that date back to the 1970s, all federal employees have been made whole. Of course theres the issue between essential Government Employees who come to work and the nonessential ones who stay home. The debate after the shutdown about why the government has nonessential employees to begin with. That is the reality in terms of what happens tomorrow, and over the coming days and weeks. Things sort of slowly shut down, the larger agencies that have what they call the nonessential activities. The political reality is very different. That really depends on who you ask. This is from Dianne Feinstein, who is out talking in terms of what might happen, talking about how shutting down the government is a very serious thing. People die. Accidents happen. You dont know necessary function can cease. This is going on look very different than in 2013. Mick mulvaney at the white house, from the podium earlier today, talking about how if anything they wanted to make sure the average american felt the least amount possible because of this Government Shutdown. The Obama Administration weaponized the shutdown in 2013. They could have made the shutdown much less impactful but they chose to make it worse. The only conclusion can i draw is they did so for political purposes. Now there have been more than a dozen shutdowns since the 1970s, some very short, some much longer. One thing, though, has stayed constant in all of those shutdowns, that is the people who occupy this building, who cannot figure out how to come up with a budget, who cannot come together to figure out how to provide all of the taxpayers the government functions that we all pay taxes for, they get paid unquestionably and regardless of whether there is a shutdown or not, not only comes from the constitution and a longstanding law in which congress passed, that makes their own salaries what are called a permanent appropriation. A bit of irony for all of those deciding about the salaries of so many federal workers that now are in their hands. Shannon folks in the heart land dont have a taste for things being passed or done that dont apply to the members. So well see. No, look, rush is right. For eight years i was in congress, on the subcommittee on immigration. When the democrats have the house, senate. Si all of the levers of power, they didnt even introduce a bill. The two years i sat on the immigration subcommittee, guess what, they had two hearings. One was to have a photo and the other was to hear testimony from steven colbert. The democrats have no moral standing on this, because in eight years, you never saw barack obama get behind anything other than deferring it. Thats what daca stands for, is the deferral. They have no moral standing on this. Shannon all right, juan, theres talk if you would put some of these bills to a vote then you can see where people stand. The house bill and the senate bill are wildly different. So far apart. You know theres pressure for the leadership in the gop to get the house bill sponsored primarily by congressman goodlatte, put to it the floor, put to it a vote. Everybody has to know its doa in the senate. Right, this is a challenge to leadership. Here were talking about Mitch Mcconnell in specific. And what hes willing to do. Because if he brings it and he loses, you know, you see there are about four republicans not voting for the bill, then it creates a whole new dynamic. Hed rather have the bill fail with him voting for it so he can bring it back as he chooses. But he wants to bring it to the floor on his conditions with his understanding of what is possible. He wants to remain in control of that political dynamic. Now, let me say in response to what the congressman cha fetses said, im thinking chaffetz said, the last opportunity we had, the gang of eight in the senate, that had a bipartisan immigration bill. That bill went nowhere. Got defeated by republicans especially House Republicans who talked about amnesty and the like. Now, coming forward, we know the last couple of weeks we have had President Trump who says that he wants a deal on daca, he set the march deadline, say that, you know, hey, the bipartisan deal presented to him in the white house initially looked like it was promising. Then we come back and see that it explodes. Of course he makes that unfortunate statement. I dont know, i dont think there is a onesided deal at all. And of course when you look at the polls at the moment, i think its 20point gap in the abc poll in terms of who gets blamed, its republicans. Shannon so that point, lets hear from dnc chair on with Martha Maccallum tonight, about putting it to a vote. If you brought a clean daca bill up in front of the house and in front of the senate it would pass comfortably. The overwhelming percentage of the American People support it. Shannon all right, congressman, quick comment from you there. Because define what is a clean daca bill. What are we doing with these people . The question is, do you want these people to be given a special pathway to citizenship, or do you want to do what the goodlattemccall bill says be a good person, dont get in trouble with the law, dont join a gang, check in every three years and get in line like everybody else. I think the moral authority of this, where were really missing the beat, with the people who arent willing to break the law, the people waiting in line trying to do it legally and lawfully. Thats the way the dreamers should have to do it without having to cake them out of the country. Dont put them on the pathway to citizenship. Shannon the cnn poll that shows all kinds of things bhshgs it comes to daca, 96 of democrats, 72 of republicans want some kind of legal status resolution. We know the appetite is that, is there. But its getting to that point exactly what it means, does it mean citizenship, where does it go. We have much more to talk about, if you stay put where are you. We want to check in on capitol hill. There has been a lot of interesting activity there tonight. We want to check in with our senior producer, chad pergrum. This vote is open. Technically they have not closed the vote. Its going to fail. Unless they come up with an emergency compromise which is unlikely at this hour, the government will shut down. They needed 60 votes and theyre going to come in short of that. Let me read the vote tally to you, this is very important. They needed 60. The vote when they closed is likely to be 50yeas and 49 nays. They needed 60 votes. There were going to be five dechl krats voting yes, donnely of indiana, highcamp, man chin, doug jones the new senator from alabama, and Clare Mccaskill of vo. Of missouri. Four of the five from competitive states in cycle this fall. They are moderate democrats, good vote for them to take. There are going to be five republican no votes. Lindsay graham from south carolina, jeff flake of arizona, rand paul of kentucky, mike lee of utah, and mitch mccanal. This is where it gets mcconnell. You say hes not for shutting down the government. Mitch mcconnell proper pounded this bill why is he voting no. What happens in the senate if you need on recall the vote, and vote again, say they get a deal, you want to keep this bill alive. And you have to be on the prevailing side of the vote. If this case the nos will prevail. So mcconnell will vote no, this vote has been open, they started at 10 13, were now at 11 24, a little more than an hour. And mcconnell will be able to recall this vote at some point. Heres something i want to talk about, too. Lets say the government shuts down, they have a lapse in funding, technically the term that we should use at this hour here, the house and senate dont have a deal. Well, whenever they get a deal tonight, tomorrow, over the weekend, next week, you say wait a minute, they kept some of these organizations in the government open, things were being funded how can they do that. Article 1 section 9 of the constitution says you cant spend money without at appropriation of congress. What theyre do is put in fiscal caulk, grout, represent row actively funneled those agencies so theyre in compliance with the constitution. What we dont know is what happens next. We saw Mitch Mcconnell, the majority leader, and the minority leader go off the floor. There was some speculation whether or not they were taking a phone call, talking to the president. Thats unclear at this hour. The house of representatives is still out subject to the call of the chair. Even if they come up with some sort of a compromise, and were hearing talk they could do something thats maybe a threeweek interim spending bim, a c. R. , continuing resolution, which just means they renew all funding, maybe through the 7th or 8th of february, the house and senate would not be in sync. The senate will have passed something but the house has to do it as well. Thats what were waiting for. Only thing that we know at this stage that will happen tomorrow is the House Democratic caucus is scheduled to meet at 10 00 in the morning. Presumably to determine, discuss what might be next if the government shuts down in about 35 minutes. Shannon and quickly, i know that you reported just minutes ago before we went to air, that senators mcconnell and schumer had walked off the floor together. Any developments on that front . And thats what were trying to figure out if theyre saying, my street on this side have the aisle can bear this much weight, my street can bear this much weight, go back to the caucus. The Senate Democratic caucus had a meeting started about 8 30, i was told it kid not go very well. On the house side, Minority Leader Nancy Pelosi talking with her leadership team. She actually left the building, we saw her leave through the senate side of the building a couple of hours ago. I wondered if maybe she was coming over to meet with the Senate Democrats. But that was not the case, she left the capitol through the senate side. Were not sure why that was. So, theyre trying to figure out what is next f they knew what was coming next they would have closed this vote and be on to something else. And the fact they have not closed this vote theyre keeping it open, that tells you a lot. Something is in play. But exactly what that something may be, we dont know. I want to get back to our panel Juan Williams, cohost of the five and jason chaffetz, former congressman. I want to ask you about interesting comments from Peter Pierson a member of the u. S. Commission on civil rights, himself an africanamerican. He has expressed concerns about what daca, if 700,000 to 800,000 people are legalized in a way that gives them permanent status. He has dire warnings. He said it will disproportionately harm unskilled American Workers particularly lower skilled africanamericans. He says it will drive more of them into unemployment, could, and crime. He says it will undermine black families and marriages as well. Whats your response to this comments . Well, its very political. The thing is weve always had this argument about immigrants in general, shannon, and who does it impact. Part of the argument, low income workers, people at the edge of the job market are disproportionately impacted. Hes pointing to i think its 16 , the black youth Unemployment Rate in the country. But i think theres also a counter argument and its the one that has most of the major civil rights groups, naacp, urban league and others, on the other side of the fence. That is that these people add to the american economy. If you see it as a growth project rather than a limit where some one takes a piece of the pie that otherwise would go to you, you start today it as economic expansion and mourning in america. Theres more opportunity the theres a vital 134r50i of workers for the vital supply of workers for the american employer. Thats what theyre after. A legal supply of workers who are going to be tacked, on the tax rolls, and who have to meet all the requirements, legal requirements, to get into that job market. Shannon congressman, your take . Well, look, i think most people want to take care of people brought here, you know, as little kids, some were infants, we want to be compassionate. The core question, should they or should they be on a pathway, a special pathway to citizenship. There are ways to get to citizenship if they earn it and do it the way other people are having to do it who didnt come here illegally. These are people that grew up here, they know the United States, they like the United States, they speak english. In many cases they dont know the other country. But if youre going to take care of daca and the socalled dreamers, you also need to take care of the nightmare down on the border. I think what republicans are asking for, what the president is asking for, build the wall, add people and personnel to the border, and make sure that we dont continue to perpetuate that problem is a very reasonable act that i think most americans say, yeah, thats the right thing to do. Thats why the democrats are out over their skis but the republicans and donald trump have been putting forward in the first year of the Trump Presidency when obama didnt really do anything i think its reasonable in retrospect, the republicans will be lauded for this, they think ultimately we will solve this problem. The public outrage was severe when military vet rants were turned away from the world war ii memorial in d. C. If the government shuts down, ryan sin can i says things are going to be different. The federal government is working on a plan to keep the countrys 59 National Parks, quote, as accessible as possible. But no one is quite sure what that means. For example the head of the countrys Largest Federal Employee Union says workers havent been told how the parks will operate or which Staff Members will work if the shutdown happens. The initial concern is to maintain basic Services Like restrooms and emergency response. Beyond that, were told roads that are currently open in and out of the parks will stay open and roads that are closed because of snow or other reasons will stay closed. Many parks will also not be able to accommodate overnight stays. Instead of just kicking campers out most parks phase them out. Restaurants and investigatetor centers will be phased out. Except for parks that are operated by xantera, yellowstone, the grand canyon, kramenter lake, oregon, mount rush more, zion and oasis at death valley, all of those parks have restaurants and dodges that are fully operational. On top that the state of arizona is providing up to 100,000 dollars to make sure the grand canyon stays fully open. But experts say if you plan to spend time in a National Park in the coming days, you are better off playing it safe and bringing some food and some water with you. And if youre unclear about the status, call your park because were told information will be continuously updated. Right now, shannon, just kind of unclear whos on, whos off. We know they will have security and police. Beyond that, we dont know whats going to happen at the National Parks. Shannon we are standing by as are you as well. Trace gallagher, thank you. Together thats 47 of this going to the gop. 31 say democrats in congress. 10 say all of them. It looks like at this point, kelsey, plenty of game blame to go around. I think maybe 10 is right. We know the media, the media and the democrats are going to do all they can to blame republicans for this. But very clearly this was not republicans fault. President trump couldnt have been more transparent in this process, in his attempt to reach a deal. He allowed national tv to actually with it the negotiations where we did see him attempt to compromise with democrats and work with democrats across the table. Democrats are the ones voting no. Republicans need 60 votes, they cant do this on their own. Shannon and tonight they lost republican votes. Maybe its because they knew it wasnt going to pass anyway and they voted on palestinian. Senator mcconnell, his vote was so he can say procedurally, able to reopen the vote. On the four other republicans answer were true no votes. Republicans are frustrated with the fact that we keep having continuing resolutions instead of an omnibus that funds the government through the end of the fiscal year. We saw a red state democrats cross the aisle and join with republicans. There are 10 red state democrats up for reelection in the senate in states that trump won. So far we havent seen them join republicans on any major policy. Obamacare reform, tax cuts, but they recognize the potentially this would create a backlash with those constituents. Interesting that this is the moment they caucus with republicans. Weve been waiting to see what issue would push those vulnerable democrats into the republican camp. Well see if they can shannon 23 minutes. The midnight deadline. What is important, and what americans actually realize, that republicans had good intentions going into this. A lot of where the issues are coming up are in regards to immigration issues. We know democrats want daca, and we also know that republicans would love some more money to funneled the boreder and secure our country. Neither one of them are getting what they want in this case. Can i understand blaming republicans, if they did sneak in some of their border wall funding to this bill. But they cant do that. Didnt do. That neither side is getting what they want. I think americans are going to see through the blame game when democrats try to blame republicans. There are the democrats getting something, because Public Opinion tends to be on their side rightly or wrongly. For them if they think its a winning p. R. Argument even if theyre not substantive getting what they want do they count it as a win . Maybe in the past democrats have successfully passed the blame off to republicans in when a shutdown happens, they think they can repeat it in this case. Republicans are in charge of all three branchs of government, to a person who is not engaged in what is going here, it would be logical to conclude that republicans are sfon for the shutdown. But it is true that republicans sort of exhausted all their options in this case to try and get democrats to the table. When you do see interviews with democrats, theyre being pressed on their rationale, why arent you voting for the continuing resolution, the white house laid it out, theres nothing in the c. R. That democrats on post. Pose. What they oppose, which is daca, the white house tried to outline, theres not a daca deal to be attached to the bill. To the bill. Even if they want it, one doesnt exist. Its not ready. Thats why i think were seeing the ta, you about not the four week c. R. But maybe a few days to buy time to get immigration deal. Shannon its not new that a Minority Party wants to use, something that has to get passed, whether its funding the government or another major measure more popular, to leverage it to try to get something that they want. Not unusual that even though the funding bill and the funding fight has nothing to do with immigration that they would say, well, listen the country needs this, republicans need this, they wont meet us half way, we have to leverage this. And i think republicans have offered them solutions in the c. R. Like a sixyear funding for the chip program, which provides Health Insurance for children. Thats longer than its ever been reauthorized for before. So, i think again democrats of a hard time defending themselves in this situation. Weve already seen that republicans are taking the high road, they have said theyre not trying to politicize Government Shutdown, which is what the obaba administration did when they faced the government shut down in 2013. You heard the sob stories about world war 2 vets not being able to visit the memorial. Seems like republicans are doing everything they can in this case to avoid that and help things go on as usual. Shannon business as usual, wake up tomorrow, everything will be fine. It will be different than parks closed, signs hanging everywhere. Kelsey and sarah, thank you, dont go far. We are about 20 minutes from the deadline as President Trump said, its not looking good. Lets talk about where we are with the minutes ticking away. Juan williams and ed henry, monitoring the senate floor and white house reaction as well. Ed, i know you are in constant communication with the white house. They have not put out an official statement. What is interesting is that we su e expect based on what is happening in the Senate Chamber right now, the conversations are going on with the white house. That may explain why the white house hasnt put out a statement, meaning on a normal night if you were moving on to the next battle quickly and you knew what was going to happen, you might put out a statement from the president blasting the Senate Democrats. But instead, frankly, the Senate Leaders in both parties do not know what is happening next. So they dont want the president to put out a statement or Sarah Sanders to put out a statement blasting anyone. They may need the democrats to get some more votes on sort of plan b or plan c or whatever you want to call it. As it goes forward. Chad pergram has been reporting that schumer and mcconnell after it was clear the vote was failing went out of the chamber to the side lines in some private area to kind of figure out the way forward. One would expect theyre talking to administration officials, mark short, the white house legislative liaison, has been on the hill. They can be having direct talks with him. And or being on the phone with the president , chief of staff kelly, and others. Theyre simply putting together what happens next. And clearly, if they knew what was next, they would simply say, okay, the vote is over, limited move on to the next thing. But instead, they dont know what theyre doing next. That is why were seeing the vote still open, even though its been counted, even though Everybody Knows that this motion, this bill to keep the government open has failed. And were just minutes away from it technically closing down. Theyre leaving the vote open, procedurally. Hoping that they come up with some other plan. Shannon all right. Juan, want to bring new here, i read an interesting piece by a political analyst who lanes to the left who said this is do or die time for the democrats. That it could be about for them, making a statement, saying it helps them or hurts them in the mid terms. How is it playing, for or against them at this point . You have a lot of constituencies here. And of course one of the key constituencies are the young people who are going to be directly impacted, the socalled dreamers. What we have seen, remember i think you will remember this pretty clearly, is nancy pelosi being under siege as he was trying to speak out in San Francisco by dreamers, who absolutely condemneded her as given in to President Trump and given them away, just throwing them overboard. By allowing continuing resolutions to go forward back in december. They accused her as using them as a bargaining chip. I think you will see pressure coming from the immigrant community, from the Congressional Hispanic Caucus specific saying this is something that we promised to do, lets get it done. Now, the larger issue for democrats, and i think you see it in terms of a number of democrats who voted with republicans tonight, people in states where donald trump won easily, talking about people like heidi highcamp, joe donnely in indiana, mank4i7b in West Virginia manchin in West Virginia. Looking toward the mid terms that you reference and trying to imagine how their constituencies respond. If you right now look at red states, including those red states that have democrats in the senate, that does not look good for the democrats. Thats why you see charles schumer, the minority leader, allowing them to vote with the republicans. On the other hand, i think you have most democrats in the country, according to the polls, siding with Senate Democrats and saying you know, what its time to get a deal done, 79 trump has said he was interested in a deal, that he wants a deal. You shouldnt simply be capitulating to the House Freedom caucus, the far right that, blocked the bill. Shannon Juan Williams and ed henry, thank you both, well check back with you. Kimmel tweeting this, shame on you for making chip a bargaining chip, shame on you for tying our kids lives to immigration and shame on you speaker ryan for doing anything other than funding chip cleanly and immediately. Prominent democrats Dianne Feinstein claim people could die because of the shutdown. Are republicans really that heartless . Congressman Steve Stivers and mimi walters, the chair and vice chair of the National Republican con congressional committee, great to have you in. Good to be on. Shannon are you that heartless . That is the way the mead yeas going to play this. Well, no. We funded chip, we reauthorized chip in november. We sent it to the senate, the senate hasnt done anything with it. We passed it in december, standalone, senate hasnt done it. We added it to the continuing resolution, states like ohio where i live are starting to run out of money and this is a compassionate thing to do to add to it the funding bill. Theres nothing in the funding bill that democrats disafree with. Theyre disagree with. Theyre putting politics ahead of paying our troops and reauthorizing the chip program. We just need to move on, get a funding bill done, and continue the negotiations. From what i hear, we are chose to a deal on immigration. We need to allow those negotiations to continue. But government, as diane stein feinstein said, people could die if government shuts down, people depend on government. Military families wont get paid. Reservists and National Guardsmen will be sent home at midnight. And also the families of soldiers who are deployed are not going to have their pay and benefits. We have to fix this. Shannon congresswoman, were you hopeful or optimistic what you all sent over to the senate was going to get to a vote . We arent getting through the procedural hurt toll get to the vote on the merits. Were you hopeful it might have gone differently . I was very hopeful. Im very disappointed that Chuck Schumer and the democrats have been obstructionist, havent moved the bill fovd forward. As steve said, its critical we make sure that we have funding for the kids in the chip program. These are the kids that need this Health Insurance, the low income children. And the daca issue is an issue that we are close on but its completely separate issue. And we have until march 5 until we can solve that problem. So we need to get the government open, we need to keep it open, and we need to make sure that we handle daca at a later date. Shannon theres talk ofts fiveday range two or three week range, do you think thats where we go next . Ill vote for whatever they put in front of us. Im hopeful that the senators keep talking and find a deal. Because shutting the government down is playing politics with the American People. And we shouldnt do it. And i dont want to do it. Im working were all going to work to keep it open. Unfortunately, a lot of House Democrats are now on the record being against Childrens Health insurance program. And against funding the government. Id like to give another opportunity. Iel give them a doover, i want to hold them accountable for the last one but give them a doover and keep sending it to the senate. Shannon theres been a general frustration on many different mess frurs the house, a lot of things that go to the senate never get to a vote or opportunity to go on the floor. This impacts everyone, though. So you have five democrats who actually voted yes on this, today. Weve talked about how a lot have them are in districts that they may be up for reelection, districts or states that were positive for President Trump. What do you make of those five votes . Even you would need more than that even if you corralled the republicans and voted no. I think they made the right decision. They see the implications they can have in their own election if they dont vote for this bill this evening. Its going to be interesting to see as we move forward how many other democrats decide to come onboard. Shannon under 12 minutes as we get to that ticking down to the deadline at midnight when funding runs out. You talked about daca, you believe youre getting closer to the hill. Looking at the measure, primary measure from chairman goodlatte and others and what we saw from the durbingraham piece in the senate they are wildly different. Chain migration, visa lottery, path to citizen sthp, there seem to be huge gaps there. How close do you think you are . I think there is general agreement on the big principles of doing something that the daca recipients. And then doing something for bortder security. Its really two things that have to be solved and they need to be solved together, theyre two sides of the same coin. Shannon i want to play a little bit from one of your colleagues on the other side of the aisle from one of the top democrats, stenny hoyer. Democrats have consistently been ready and willing to sit down at the negotiating table and reach an agreement with our republican colleagues. But we will not be blackmailed. We will not be blackmailed because republicans are unwilling to compromise. Shannon they say are you the ones that wont compromise, theyre sitting at the table. I just want to ask the democrats back in 2008 when they had complete control, they had the presidency, they had the house, and they had the senate, they could have had Immigration Reform back then when f. They truly, truly wanted Immigration Reform. For them to cast a stone that its our fault is very disingenuous. And another thing that i think should be brought up, mr. Hoyer is saying that we are blackmailing the democrats when theyre the ones who voted to shut the government down. Most democrats voted to shut the government down. That sounds more like blackmail with the American People than giving them a deal to keep government going and telling them we will continue to negotiate with you. Which is what our leadership has told them consistently and the talks had continued. So im hopeful that we can keep government open, open it back up, and continue these talks. Because daca doesnt end until march. Weve got six weeks to deal with that. We have 12 minutes to deal with the shutdown. Shannon down to nine minutes. When we look at these deadlines out there, march 5, and we have had a federal judge who says even if you get to that point essentially banning the administration from being able to roll back daca or undo the program. Thats been appealed directly. To the ninth circuit and the supreme court. Well see, a lot can happen before march 5. A lot of folks think we will be at march 1 and there wont be a solution and we will have another fight. Well, my hope is that we do have this solved. I think trs a willingness on the republican side. I come from the state of california, this is a big issue, a big issue in my district. I know there is a willingness on our side to find a compromise and to get this issue resolved. Remember, when this daca issue was put forward it was an executive order by president obama. And its congresss job to make sure that we solve this issue. So it is our responsibility and my hope is that the democrats will come to the table and help us resolve it. Shannon it feels like to a lot of americans watching what you are saying and what were hearing from stenny hoyer, he says were at the table and we want a conversation. Where is that getting lost . Well they have been at the table and weve been at the table and those negotiations have actually been going okay. Weerp ee closer today than we were before. We cant shut the government down that, doesnt do anything to move the negotiations forward. Theyre unrelated topics to tie them together. This is a problem. We need to fund the government. Our military families are gee penning on it. We kneeled to continue the chip program. But apparently theyre willing to vote against that too. Im sure we will come back to the table tonight or tomorrow morning early and try to figure out what we can do to keep the government open or reopen it technically now. Were going keep working at it. Shannon senator heitkamp voted yes to get this matter to a substantive debate in the senate. She introduced a bill to withhold the pay of congress if there is a Government Shutdown, thats not possible. But congress cant do their job shouldnt get paid. I agree. I agree we shouldnt get paid if we cant do our job. I would support that. Shannon you . Ive signed a letter asking that my pay be withheld until we have a budget resolution. Turned in tomorrow. I guess whenever the clerk is open. Shannon you have six minutes. I just signed it before i left the office in anticipation of the worst happening. I did it before when we had the shutdown in 2013. I agree with that, but i also think its about getting a deal not about not getting paid. Im withholding my own pay until we have a deal. Shannon do you have good friends who are colleague is a cross the aisle, democrats, who you trust that can have conversations about these things that gives you hope there is a Common Ground . Yes, yes, definitely. Thats why im hopeful that we are going to get to the solution ultimately. It is in the best interests of our country to make sure that we do. I know there are people on the other side of the aisle that want to solve this problem just as much alses we do. But aisle as much as we do. We have differences that we have to figure out how to handle it. Shannon how do those conversations go . Well, were having conversations at a rank and file level, conversations at the leadership level, they need to happen at every level possible. Ive talked to several Democrat Members this evening and tried to figure out if theres something that can, we can take leadership to say, what we think we have something that can create a deal. We continue to talk and hopefully well get something late this evening. Shannon five minutes to go on the deadline. In the meantime, fresh poll out today that wont surprise you, congressional approval stands at 18 according to the latest cnn poll. Im sure you understand the frustration when were watching situations like. This how does it make you feel to know that thats where youre at, 18 . Interesting that, we see these polls and ive been an elected official for 20 years. And it always seems that we see these polls, as a collective body we never poll very high. But when you go home and you go to your district and your constituents see you and talk to you and they like you and youre popular. So its really interesting, to break down these polls and to see where collectively we arent very popular but when you go back home to your district you as an individual are. Shannon makes a lot of difference. Let me touch back on what we were talking about with the president , Senate Minority leader Chuck Schumer went to the white house, everybody thought publicly that it went well, the president tweeted they had a great meeting. Then we hear from schumers folks, close to him, saying the president then went and talked to, quote, his hard right and things sort of started to fall apart. The president tweets things are not going well. What do you make of their relationship . The president has had friction within his own party. But clearly the opposing party, at times they seem theyre doing well other times seems like it turns on a dime. I think the president showed leadership by inviting senator schumer to the white house and trying to find a deal. But there are legitimate differences. So i dont want to make light of those. I think, you know, the president is trying. I think senator schumer is trying, i think we need not to talk past each other and try to find a deal. I think we can get there. I am still optimistic, you know, at my core and i think we are going to find a deal. We have to, for the American People. Shannon do you think theres good faith on both sides . I do. I think their heart is in it. But we dont philosophically feel differently about certain issues. Its a very helly, healthy debate for the country when you are creating legislation. We saw when the president had people to the white house, a week or so ago, talking about immigration and the public was invited to be in, the press was, in and you got to see how the talks were going and how do you make legislation and how do you compromise. I thought it was very healthy for the American Public to see. Thats what were doing. I am confident well get on a good solution. But its going to be a rocky road on the way. I wonder if we can take that shot of the floor full. Can you get a look in the corner of the screen, there, Lindsay Graham is Holding Court with a number of democratic senators. You can see theyre gathered there. Hes laying out, next to him is debbie stabenow, asking a question in the red to his left, from michigan. This has been happening throughout the last 40 or so minutes. And Lindsey Graham has bounced back and forth from republican gagles of senators on the floor to democrats. Now, it seems, they are trying to iron out some deal to rework this bill, that is still open on the floor. We dont have the details of whats being talked about. It had been suggested they were going to do some shorter continuing resolution, short of four weeks, again another angle from a different side, different side of the camera. And perhaps some agreement to then move forward on daca after that. Graham suggested that the bill go past the state of the union, which is january 30, where the president obviously will present his policies going forward. And to get past that, we dont know the specifics, but you can see the senators huddled here. As were closing in on 12 00 midnight, remember this is going to be january 20, one year and 12 hours ago President Donald Trump was sworn in as president of the United States. Now, were talking about a possible Government Shutdown. Shannon we are. Brett, as you watch Lindsay Graham he was on the show last night, has been a key player in so many of these conversations and discussions, has been in the white house for some of those big meetings, the big meltdown, and he was adamant that he would not vote for something that took on weeks. The United States senate has not been able to finish the job before the midnight deadline. Now the very functions of the government that weve been talking about will slowly start to phase out and shut down in many agencies across the country.
