Good to see you. Steve all right. So were talking about two different trials. The first one was the murder trial. He was found not guilty. What exactly did you do in that trial . Im a forensic pathologist. I discussed the autopsy, what was done well and what wasnt done well with it and what the autopsy shows. Forensic scientists dont say he is innocent or not innocent. Thats the jury. But we go with the science. And i think the science in the first murder trial was not it wasnt there for conviction in the way it was presented to the jury. Steve sure. So, from the scientific standpoint, you were in charge of that kind of evidence, blood evidence and stuff, you and dr. Henry lee as well. Right. Steve majority of people actually think he probably did it. Yes. A majority does feel that way. Steve even based on the evidence. Things they have heard. Based on whats in the newspapers and media. But based on what was presented to the jury, at trial, the jury felt unanimously very quickly, within an hour or two that they didnt the prosecution did not present enough evidence to convict him. Steve fast forward a couple years he is in las vegas. He bursts into somebodys hotel room. He tries to take back stuff he felt was his. He winds up in another trial. He winds up with a 33 year sentence. Many people, dr. Baden, felt that particular sentence was so heavy because they were essentially convicting him of the double murder that he was found not guilty of. Yes. It was a revenge verdict. Not a verdict, not a verdict. He was guilty of stupidity, but the sentence was teach him a lesson. I think he has been a model prisoner since. Nine years. Whats interesting, he has now been in there longer than plea deal that the District Attorney had offered in the las vegas trial, which was turned down by the defense. Steve its interesting. Fred goldman, the father of one of the people who was murdered back in 1994, he feels that o. J. Still stay in jail. Again the victim in this particular crime this bruce fromlong guy says let him out. Its interesting get very close to our children, our clan we want vengeance often. Thats an emotional reaction. It shouldnt be a criminal justice reaction. He should not be further sentenced as vengeance or revenge, even though i, as a parent, might want it to be. And thats one of the reasons we have a criminal justice system. In the old days hamilton and burr used to fight it out because of revenge rather than having the law take over. And i think that, if he doesnt get parole, it will be really for revenge and vengeance rather than for whats right in the criminal justice system. Steve back in 93 did was referred to as the trial of the century. Now theyre talking about whats happening this afternoon in las vegas parole hearing of the century. Is that the best place for him . Mayo clinic, arizona im partial to because did i my training. I was born and raised in arizona i did my training in mayo clinic. I was never directly involved for his care. I feel for him and a connection. He is in great hands. Steve famously he was diagnosed with melanoma close to 20 years ago. Did this particular aggressive form of brain cancer did it that as it size from the melanoma. Whats happening to senator mccain is highlighting what happens. He has been battling for decades. What happened he went and saw his primary care for a check up or im not sure what type of special isles he went for his checkup. They saw what they said was he had mentioned he had some double vision, blurry vision. He was feeling a little off. Not so sharp. What happened this prompted a ct scan. Ct scan showed what called a blood clot or hemorrhage bleeding in the brain. They did surgery to remove it i suspect that they already suspected that there was possibly a tumor under there because they did send it to pathology. What happened is there is bleeding in the brain, caused by a tumor. Now, the diagnosis came after the blastoma or gbm. This has nothing to do with his melanoma. This is a primary brain cancer not mess tactic. Brian there are 400,000 new cases this year alone of the same cancer. I understand there are two main strains of it both are extremely challenging. What are his options . There are actually more than two types of blastomas. They are very different. This specifically is the most aggressive type. Called stage 4 grade 4 not stage 4 of brain tourism. He has the standard options are tumor debulking surgery which he has already done. Once it heals combination of riddation coupled with chemotherapy. We do have trials throughout the nation. Amoon know therapy, gene therapy and even vaccines. Im not sure which route he is going to go. They did mention chemotherapy and radiation. Brian personal decision. Yes. Steve real quick, last question. Of course our thoughts are with him and his treatment. The people in washington, you know, he has a day job, still they are curious when he might be able to travel back. This is going to be a personal decision. It will be up to our senator and his family and what he can tolerate. When he came out of surgery he was sharp as a whip and cracking jokes. It does not surprise me. This man has been through a tremendous amount in his life it depends on if he wants to be away from his family. What are his priorities going to be. Brian physically can he walk . Can he function. He is doing absolutely fine. If this were to progress he may see more neurological symptoms. He is intact and just recovering from surgery. Ainsley is he in pain . Its hard to say right now. Probably his most discomfort is from the actual surgery itself. Sounds like the only symptoms he had was blurry vision before. Ainsley all right. Grim stats but some people do beat the odds and live a fairly long time with, this right . If anyone can beat the odds, it would be this patriot. It is, unfortunately, it is a grim diagnosis. Honestly i dont think that Jeff Sessions should have recused himself and i said it at the time. And i will say now that he probably should not have accepted the nomination to be attorney general. They embarrassed mike flynn by selectively leaking portions of conversations he had with one of the russians. Thats going to make me, Jeff Sessions, a witness at worst. You can sit here and have a discussion about how many people might lose coverage under some program in the future when the real issue is that there are people who are actually losing Coverage Today under obamacare. Well, discussions are ongoing. Were still trying to get to something that relieves the American People from the oppressive yoke of obamacare. I continue to believe there is a way to get there but we have to remember, steve, when the democrats built obamacare, they built a berlin wall to keep the American People inside. Look, most are yeses. There are some who say they have got some conditions attached, conditions of smaller or greater degrees of magnitude. Im not going to attempt to identify where everyone is because that can change from one moment to moment. And i dont have the authority to speak for anyone but myself. Steve i understand that apparently the Senate Leadership is adding 200 billion to states that expanded medicaid. Is that what you are hearing to try to get some of the moderates on board as well . To my knowledge, no decision like that has been made. That would seem to be a pretty big step in a particular direction. Steve its a lot of money. That is a lot of money that amounts to 1 of our national debt. That is an enormous amount of money. And i would like to know where thats going if its not going to deficit reduction. Steve so as we sit here on this thursday, do we have any idea what the timetable is with john mccain out in arizona convalescing. We are wondering is there going to be a vote next week or the week after. Just wondering what the plan. As close as these vote margins are its hard for me to imagine moving on to this without john mccain present. Hes 70 years old, been a model prisoner, case closed, it will be a 40 ruling in favor of parole, oj simpson will be paroled, and he will be a free man on october 1st. Of course, the news is breaking after the president s big interview, surprise interview with the New York Times. A lot of news, of course, his remarks this afternoon with the senators, urging them to stay in town and work this out. Not just to repeal, but come up with a plan thats workable, and then the stunning news about john mccain that they discovered a brain tumor, and hes going to be dealing welcomings some type of treatment for cancer. Joining us right now is a medical doctor himself. Senator rand paul. Senator, were you in a meeting with the other senators when you got the word . And what was your first thought . You know, senator mccain and i have had a long and storied history. We have tangled quite a bit. But, you know, my sympathy and prayer go out to him in this time of crisis. And the only thing i would try to say encouraging is while obviously the diagnosis is not great, i have met people who have lived years and years. Its not a good diagnosis, but i have that, and there are exceptions to every rule, and i hope senator mccain will be an exception to that rule. Steve absolutely. Of course, now we all want him back on the job. He would like to come back, senator, as quickly as possible. But theres another big story, and that is for the last couple of weeks, weve been talking about what are you guys going to do about health care . So people are going when will he be able to come back . I understand the president of the United States called you last night. How did that phone call go . You know, the president and i i think have a good rapport. Hes the most adamant that we should repeal obamacare. Ive given him options and the leadership some options. One thing i object to on the bill is theres an enormous insurance bailout fund. Ive told them if they will take that insurance bailout money and put it on a separate bill that is likely to pass, they could probably get what they want and conservatives wouldnt be forced to vote for something that we philosophically think the federal government shouldnt be involved with. Brian so if you take the 200 billion what they did is offer tax credits for people to buy insurance plans, and its up to maybe 200 billion. Is that 200 billion; right . And you want that moved out, but you know if you move out at that out, moderates will say how can i justify voting for this. Well, the thing is you could move both bills on the same day. So, for example, theres a medicaid bill, the s chip bill that moves every year. Democrats vote unanimously for it. You could move that bill even just prior to the Obamacare Repeal bill, same day, same time, just after. But basically simultaneously. And then they would see that theyre getting their money, and conservatives would see that were doing what we promised, which is repeal. See, we didnt promise as conservatives on to vote for a insurance bailout fund. In fact, most of us are opposed to a philosophical giving money to an industry that has doubled. Brian but they hate it, and theyre dropping out of the exchanges. Well, heres what theyre doing. Theyre whining, and they want more taxpayer money. So theyre willing to pay if they subsidize them. These are the richest corporations in america. Why should taxpayers have to subsidize rich corporations . Ainsley we had you and senator mike lee were the two that said you dont like the repeal and replace bill. Then they took your advice and said you know what . Were just going to repeal. And then the day before we were talking about the four holdouts on that plan. That was yesterday. So when is the what can we expect . The republicans or the American People just want to see something done. We keep hearing from this person who has a different plan, this person who has a different plan. They just want you all to come together. Is that going to be possible . And at this point its going to be confusing because yesterday i announced i would go to the bill because the Senate Leadership said it was going to be the 2015 clean repeal bill. So im on favor to repeal, im just not on to keep the insurance out. Yesterday Senate Leadership sort of equivocated, so im not sure. Are they going to the 2015 bill brian its a waste of time to do the repeal bill because you know these are your colleagues and your friends, and theyre not going to vote for it. I dont agree with you. But i would say that there is a variation of the 2015 bill, and i have talked with the three or four people who are saying they wont vote for the clean repeal bill anymore, and i have offered to them something that i think would be a combination of the repeal bill and the new bill put together, and i think we could please all parties to do that. Ainsley what does that combination look like . One of the things that people no longer want to vote for the 2015 repeal bill are worried about is that medicaid goes away in two years. The Medicaid Expansion. However, it doesnt do anything to underline medicaid, so it doesnt reduce the cost there, and some of them are worried about that. But i have offered that in the brca, the Senate Leadership bill, theres a sevenyear relaxing window where the Medicaid Expansion gradually doesnt go away because its paid for by the states over a sevenyear period. I said we would put that on the clean bill, and i would accept that as a compromise, and i think some of them are thinking about it. Brian all right. So we have ted cruz saying this is my amendment, im putting that in. Mike lee just told steve that hes got something out there. Steve the Consumer Freedom amendment where there are dual risk pools, not a single risk pool, and if thats accomplished, that would be a yes. Brian would that help you . Well, what i have told the president is i have one and also. We separate the pork from the repeal. To put the pork on another bill. Put the spending on another bill, both of them will probably pass. The repeal bill passes only with republican votes. Brian when you realize in the big picture if this does not pass and repeal does not pass, it is a vote for obamacare. So you have to ask yourself. Yeah. I disagree with you. I disagree with your analysis. What i would say is theres greater danger to passing something that doesnt work, and we come to 2018 elections, and guess what . We still have the fundamental flaw of obamacare. The death spiral continues. In fact, i think all of these plans allow the death spiral to continue. And the republican plan, they subsidize the death spiral by giving money to insurance companies. In the president s plan, they force people to buy insurance. Neither one of them are going to work. The only thing that would work is get rid of federal regulations, all of them, and let states handle this and send it back to the people. Steve well, there are certainly a lot of plans out there. Lets see what happens ultimately is as you know it has to be a lot better and cheaper. Meanwhile, the president of the United States sat down with the New York Times reporters yesterday. Today marks his sixth month in office. He was looking back at some of the things he has done. One of the things he regrets, it sounds like request were going to play a little audio. It sounds like he regrets having asked Jeff Sessions to be attorney general benjamin turned around and recused himself after the russia deal. Listener to this. Trump Jeff Sessions takes the job, gets into the job, recuses himself, which frankly, i think is very unfair to the president. How do you take a job and then recuse yourself . If he would have recused himself before the job, i would have said thanks. Its extremely unfair, and thats a mild word to the president. Steve you know, hes a businessman. Looking back at the last six months, and he said that was a mistake. What do you think . Do you think it was a mistake for him to ask Jeff Sessions to be attorney general knowing that because there was a russia investigation, he would have have to recuse himself . You know, i think the president has a point because the thing is here is that if everybody is going to recuse themself just for digits contact, i think i dont have to go really good governance. I think Jeff Sessions contact with the russians was digits. Steve handshake. In the usual duties of being senate, and he should have stayed in the fray and been more supportive of the president. But my other objection with senator sessions is that he also now is going after peoples property through what we call asset forfeitter. This has been big to minorities and poor people, and i think we shouldnt take peoples property without conviction. This is something im disappointed that sessions is going after a lot of poor minorities to take their property without due process. Brian yeah, thats a policy that i assume the president separates from his the bottom line is he didnt disclose contact he had with russians. And therefore, it was brought back, and thats how he got to this spot. I have to ask you Something Else about that story with the New York Times. And that is Robert Muller and the president says he i reject Robert Muller as the next fbi director. I think theres some conflict of interest with his investigation, and hes upset that Robert Muller may be looking into his business finances. Do you also feel as though the president has a reason to worry . Well, you know, i do think theres a witch hunt, and this is a partisan thing. The democrats lost the election, so theyre going to investigate trump for as long as hes in office. Now, to be fair, i think republicans have done the same to democrats. So i think this is a partisan witch hunt. I also think theres an observer bias to history. Theres a story in he herbert butterfield, every meeting you connect and say its a big, grand conspiracy. When in reality, its a bunch of random events that we are now putting or someone is putting their own impression on to say its a big conspiracy. When in reality, a lot of people meet with Russian Ambassadors, Foreign Ministers around washington. And i think what weve done is conconducted a story line here that really is a witch hunt. Ainsley real quickly. If youre Jeff Sessions, and your boss says that about you, do you step down . You know, my objections, im not personally involved with, you know, the appointment of special counsel and things like that. Im more involved with pole of, and i have been disappointed in senator sessions wants to take the property of people without a trial. Civil asset forfeiter is a big abuse of our system, and ive been trying to fix it. And im disappointed that hes going his own way. So i have big beef with steve well, today does mark the president s sixth month in office. How do you think hes done . You know, im a Glass Half Full guy. I think gorsuch was a great pick for Supreme Court, we repeeled 60 billion, so theres a lot of good to be had. I think the media gets self occupied with a story thats sort of made up in a way, russian story. But we got so occupied with it, that we forget the good things that are happening. And i think a lot of good have things happened so far. And i compare it every day and say it could have been Hillary Clinton. Thats a serious, serious thing. But, hey, we talked about this. He wanted items back, he was supposed to go there, tell these guys, like, this is my stuff, return it or im calling the cops, and he was confident that they were just going to give the stuff back, which they did. For the first 30 seconds of the tape, you can hear them apologizing. And then some reason he insisted on these guys bringing guns and doing an Armed Robbery. And when you do the crime, you have to do the time. Brian geraldo, did he answer it is question . First of all, asked him if he thought oj was going to come cut his head off the way oj tried to cut his exwifes head off, the mother of his children. He said im not a snitch. Im not a rat. I did record everything that happened in that Las Vegas Hotel room. But hes kind of hes a whimsical kind of character, very colorful kind of shady at times. But the real focus, obviously, oj simpson and this 9 to 33year sentence. I dont think as a person in Law Enforcement when youre talking about the crime he committed here in the state of nevada as the crime for which the state patrol board commissioners will be deciding at 10 00 local, 1 00 p. M. Eastern time whether or not he has served sufficient time, and will be able to go free. They are considering that crime. Not the two murders that he got away with in california. I think hes correct in a sense hes doing the time. But simpson has done plenty of time. Nine years. It should have been one year on that crime. And i think the payroll board will be unanimous and set him free in just a few hours. Brian people are expecting a trial. Its not going to be a trial; right . This is going to be in and out. Well, hell be on camera. Youll see him. Youll see the parole board commissioners 20 minutes after they hear from oj simpson, they will be deliberating. They will come out with their verdict, and i expect that they will rule that he has served enough time. These are the same four commissioners that several years ago paroled him on other charges. I have a real problem what comey did. Is he in legal jeopardy . Well, i certainly agree with it. Weeks ago when comey first released these memos, i said that they were presumptively fbi documents, and they very likely were classified. We now know that the fbi is claiming these as their documents, and some of the memos that he made were named indeed classified. So he clearly violated rules and regulations, and he never would have tolerated this when he was director of the fbi. I considered what he did to be really unprofessional and likely unethical. Ainsley and then leaking it to a professor who leaks it to the media, and he did it just so he could get the special prosecutor. Well, thats the odd thing about this, you know . He had a president who asked him to combat leakers in the administration, and he immediately became a lyric. I mean, thats a really troubling issue. Steve professor, i have a feeling thats not going to be in mr. Comeys new book. Probably not. Steve because there are restrictions about what he can write about the president of the United States and other people; right . It is. And this is very destructive to the government. He prepared these memos on a fbi computer about an Ongoing Investigation about meetings he had with the president. Obviously, those are fbi documents. And the mode made a has portrayed these as Something Like a diary entry. That is a very serious breach of professionalism at the fbi. Brian in the way that he told the story and the way it has been examined after, it made me think what else that he did in a way that i think might be questionable. But i want to bring what the president spoke about yesterday to the New York Times. Three reporters come down, and he looking back at his six months, let it be known that he is not for the attorney general sessions is really responsible for the mania thats happening right now with these investigations. He said he never should have recused himself. Do you agree with the president s assessment . I dont. The department of justice ethics people and his staff recommended to Jeff Sessions that he recuse himself. I agreed with that. Most lawyers. You dont simply recuse yourself for a conflict but the appearance of conflict. He did the right thing where i think the president has grounds to reject is with regard to Robert Muller. I supported the appointment of special counsel after termination of comey. But lord had no business on that list, let alone being selected. He does have a very serious conflict. Brian what do you mean . Well, he interviewed with the president for comeys job. I dont know how rosenstein could have put him on the list. And, by the way, Rod Rosenstein had an even greater conflict of interest. Rosenstein was involved in the termination of comey. He is a key witness to that investigation. How you could be a key witness and be involved in the investigation simply escapes me. Steve sure. I think that could be some of the frustration that President Trump is feeling where today marks six months into his administration. And as he looks back although how the sweep of what has happened, hes thinking to himself. If i would have known that and these are the restrictions that youre talking about if youre involved in a campaign, and its under investigation, you have to recuse yourself. If i would have been told by somebody in the department or by mr. Sessions, i wouldnt have made him the attorney general. He could have been department of Homeland Security or Something Else. Well, this is where i disagree with the president. I think in many ways sessions reaccusing himself helped the administration. I think this administration has been a few steps behind the beat on a lot of this stuff. Sessions recused himself helped reduce the controversy. I think ultimately there will well, certainly as we know look at it now. I dont see evidence of a crime here. So i think an independent investigation could clear this administration. Brian yeah, very interesting because if sessions should disclose the meetings with kislack, it wouldnt have been a problem. He didnt answer completely or forgot, and then he amended it, and that caused the problem. But im very curious to see to have you back because we have to talk about what don jr. s up against next week as he testifies with Paul Manafort and Jared Kushner behind closed doors. Steve plus, we have to know the latest of what happened with the eject. You didnt wear a jacket because somebody took it from the greenroom . Thats right. And i have to tell you, this goes deep. Bob, good morning to you. Good morning, steve. Steve okay. I know a lot of people are speculating. It sounds like oj simpson probably is going to make his case and will get out. He was up for parole a couple of years ago. Why didnt he get out then . Well, obviously, theres a lot of different reasons. One of the most important things is was he remorseful . He apologized, but theres an element here that the parole board wants to get a sense is is this person remorseful for what happened . The other thing is the charges were on top of one another. But he still had consecutive charges, so now they continue to run. And thats why he has this parole hearing today. Steve all right. So his future here at the parole hearing of the century, the New York Daily News called it yesterday in the hands of the parole board. Who are these men and women . Well, remember, these men and women are wardens, and i think its important to understand these men and women. This is a job they do every day. These people have to make very important decisions. And although this is the normal course, it is oj simpson. You know, they have real feelings, they have to have a sense of discernment, they have to look at the facts that have been given to them, they have to look at all the information given to them, but theyre still human beings that recognize all the medias here. And im not saying theyre going to play to that. Im just saying remember that they are people too. And they have a tough job because they know when this is over, if they let them out, theres always going to be discussions about this is the parole board that let oj simpson out. Steve and ive seen a number of stories in the last 24 hours about things that might hang them up and cause them to keep him in prison for a while longer, including something about a cookie years ago. They dont take that in consideration, do they . No. No, they really dont. They have a mathematical formula, steve. And they score it. Educational courses, engagement to prisoners, model prisoners. All the Different Things that, you know, a model inmate. So those things are scored. But the other thing is they look at is he a threat to society in any way . Can he be a threat . Because this is a guy who obviously over years sort of had some representative behavior. And as a result of that, is he a danger . Most people conventional wisdom think so, i think even mr. Dershowitz this morning indicated that he should get out. The da in las vegas who is married to the judge that sentenced him, he believes that. David rodger who prosecuted him. I think most people that see this feel that number one, he was probably oversentenced. And number two, he should most likely be released and then get out in october.
