clan. did extremists just hijack the million man march? >> and it's the play everyone's talking about this morning. dodgers second baseman chase utley, not a philly anymore, taking out mets shortstop ruben tejada. did you see this? he did this to avoid a double play. but was this move fair? and he wound up with a broken leg. we'll tell you all of it and the fallout on twitter this morning. "fox & friends" begins right now. ♪ >> pay attention, it's national safety month. we have some tips all morning long out on the plaza. we have the jaws of life cutting into cars. they're going to show you all the things you know to be safe this morning. >> when you're rubber necking after accidents, you're wondering how are they doing that? we're going to find out. we're tipping our hat to them. >> hipping our hat to ed henry. >> i was trying to be here yesterday but caught in a little weather on friday night. >> good to have you. >> i like the pockets. >> does it match? >> mm-hmm. >> a lot to get to this morning. >> we're going to start with this fox news alert because bowe bergdahl, is this a big break for him? a military officer recommending no jail time for the man accused of deserting his unit in afghanistan in 2009. >> the lieutenant colonel says the case should be sent to a lower level court-martial which means basically bergdahl's punishment could be reduction in rank and just a bad conduct discharge. >> this is a huge step down from a possible life sentence. now on charges of desertion and misbehavior before the enemy. remember, after bergdahl left his unit he was captured by the taliban and held captive. that was until he was freed last year when the united states exchanged him for those five taliban commanders. so a lot to get to this morning on this story. let's bring in lieutenant colonel tony shaffer who's been following this case from the very beginning. tony, you disagree with this assessment. so he might not get any jail time? >> well, this is criminal negligence, as far as i'm concerned. let's face it. you brought up the very key point here, five four-star general equivalent to get him back and most importantly, this guy defected. he went over to the enemy. he gave them aid and comfort. and yes he was tortured. he was held for five years. but it was because he walked away, presented himself to the enemy, and let me be painfully clear here, at least seven u.s. soldiers, three british soldiers, died in the process of trying to recover him after his bad behavior. and one last mitigating fact, which i think is important, the defense's line that he left post, tried to walk 19 miles to find a general, is a lie. so, when you basically add the layers of stupidity up, the guy should be put away for at least another five years as far as i'm concerned. and, it's not over yet. much of the recommendation is for the special court-martial, general abrams, robert abrams, has the final decision. he could ratchet it back up to a general court-martial or go the other way and put it in administrative channels. but it's not over yet. >> well, in the beginning, it looked like he may have been abducted by -- by terrorists. and then, it came out, you know, there were -- there was this outrage from folks who were, you know, out there with him searching for him for 45 days the search goes on. >> right. >> and you mention that ten nato troops are killed. what does it do for morale, this new development this morning? >> well, two things. first, the general officers i am close to, and my mentors in the army are basically saying, you cannot have soldiers simply saying i've had enough, i don't want to play anymore, i'm going to walk away. especially in combat. that's the first factor he has to be held accountable for that. separate that from whatever punishment he gets. and you can't simply have people saying, after they've taken the oath of office, they put the uniform on, they deploy to a combat zone saying, you know, it's just too hard. or i just don't want to play anymore. i think this is where it's at right now. yeah, morale will suffer by the fact that you see people every day, going out and doing the hard work of defending the nation, seeing this one individual do things which are completely criminal, as far as i'm concerned. >> lieutenant colonel as a reporter i want to be fair here and try to figure out what possible justification would the army officer have here to say that it should be a lighter sentence? can you take us in at least, even if you disagree with his reasoning, what would be the reasoning here, number one, and number two, in terms of the general potentially stepping in and overturning this, how often do they accept the recommendations of an officer in this case? the -- >> latter part of the question first. i think it's fairly common that they do assess it. in this case, because everything is so political i don't know which way general aidan is going to go. this is one of those things, this has been political from day one. secondly, regarding the ostensible punishment, the major general, one of my closest friends well, you know, he suffered for five years. he spent five years under harsher conditions than he would have at leavenworth and maybe it's time to let him go. everybody believes he should get a bad conduct discharge and some other very harsh things. i think that's where the breakdown comes in. yes he's going to get court-martialed. the degree of which we don't know. he could still end up in a special court-martial with some level of jail time. he could still go to jail for ail year. it's not over on that account yet. basically, look, i've got to give my kred to his lawyer, they've done a great job of presenting this to create a sympathetic view of -- to the public and to the military court system. it's just not accurate. >> before you go, i want to get your take on the five fighters. because there are conflicting reports, sources telling fox news that three of the five fighters that were exchanged for bowe bergdahl have re-engaged with their terror network, although the state department disagrees with that and says none of them have re-engaged. and that they are being closely monitored. what's your take? >> well, look, i'm going to go with catherine herridge on this, talking to the intelligence committee not the state department. the state department, the credibility of those guys, some of the issues they're dealing with with hillary clinton's e-mail, the bottom line is this, those individuals were returned, very high price was paid. i believe that they are back in contact. and again, if you just look at the face of it, these are generals who are basically able to remotely influence troops that are now in combat with our forces. we just had kunduz, we just had a major engagement with the taliban. so these guys, being there, available for even intellectual or emotional support is significant. this is no small thing. >> lieutenant colonel shaffer, thanks for getting up early with us for your analysis. on your sunday morning, some other stories we're following now. this, new overnight a plane with two people on board crashes right into a california home, sparking a fire. the faa says the plane went down minutes after taking off from the lake tahoe airport. no one was in the house was hurt and the status of those on the plane is unknown. investigators still trying to figure out what went wrong. an explosive discovery on a golf course leaves a man arrested. police in northern california say kevin cornbuckle left two homemade acid bombs capable of spraying debris some 50 feet. one was detonated in a controlled explosion in the foxtail golf club. the other was found nearby already detonated. the golf course and club were evacuated. no one was hurt. and the teenager who wowed the world by singing for the pope in philadelphia. ♪ >> oh, wow. now 14-year-old bobby hill is catching the attention of the man who wrote that song. broadway composer andrew lloyd webber just invited the teenager to the december opening of his newest show right after his performance bobby told "fox & friends" it was completely last minute. >> well, i happened to be a change that they needed someone and my choir director recommended me. i was a little nervous but i was more excited. >> wow, man. i wouldn't even be able to get the words out. after he song the pope gave bobby rosary beads. some weather this morning. extreme weather, death toll rising in south carolina. 19 people killed so far. floodwaters soaking that state. >> and as thousands try to recover from the storm, more rain is falling. governor nikki haley asking people to stay off the unstable roadways. >> rick is all over this this morning. it's been a desperate situation for several days. >> it rained yesterday, but it's gone now. it was for the most part pretty light. just more an annoyance for people who are trying to work on that cleanup. and obviously a lot of the roads certainly unstable. still a lot of roads closed and bridges out. it's going to take months and months to get that back. you see a lot of widespread, maybe quarter inch. a few couple little pockets there. saw a couple thunderstorms move through, too. this is now all gone out of here. but there are still some flood advisories that's going to be with us for awhile because of the river flooding. that river flooding just takes a very long time for those rivers to go anywhere. this is a look at that storm here. still bringing rain showers across parts of the carolina coastline this morning. and then i just want to end this, guys, take a look at this up across parts of maine. snow. snow. snow. far northern maine it happens. right now, it's that time of year -- >> it's still baseball season. >> let's talk about this. listen, the internet exploded last night. let me set the stage for you. it's the seventh inning. chase utley for the dodgers on first base. hernandez on third base and then the dodgers get up to make this play. watch this play right now. chase utley at second slides into ruben tejada, and see if this is fair or foul. watch. >> up the middle. they will not get the double play. chase utley going hard at second as the tying run scores. tejada looked like a receiver coming over the middle. having his feet knocked out from under him. by a defensive back. check this out. >> this is going to be a tough turn any way. the ball behind second base he was going to turn that way to make a throw. utley got off to a great secondary lead. he gets right there to break up the double play. >> throwing himself -- >> that double play that was broken up there by chase utley sliding in there, he broke his leg. so tejada is out. >> and they ended up keeping the safe call because his foot wasn't even on the bag. what a lose-lose. >> and the mets coach terry collins said he thinks the umpires made the right call because he never touched the bag. never touched the bag to get him out. chase utley thought he was out. he goes back out to the dugout. they send him back out, no you're safe. the umpire called him out. they let him go back, said it's the umpire's fault he walked away. the desperate situation the dodgers were in was that they lost game one. they're at home. they've got to win game two. it's a very close play. but i think he's trying to break up a double play so that the runner can score from third. >> and this is common practice. >> it happens a lot. i think it was a freak. i don't think he intended to break his leg. here's a side bar to the whole deal. the backup shortstop, now that tejada is out for the playoffs, flores. he was the guy who thought he was traded. >> right. >> crying. started crying on the field. then became a big national -- >> there he is. >> the darling of the mets. >> he hit a homer a couple days later. and now, is this sending flores out for a dramatic postseason. >> my close friend who is a mets fan texted me last night, because he knows, obviously the phillies, oh, typical phillies, he's a dodger now. what are you going to do. >> was it a fair play or dirty? we want to >> good morning. >> go back and look at that moment, it was pretty brutal for hillary clinton right there. in that debate. because number one, barack obama had this great moment where he said let's stop tearing each other apart, let's come together. it was over charges that he was plagiarizing some of his speeches and hillary clinton, to me, it sounded like she was a little too practiced, rehearsed, saying that's not change. you know, that you can xerox. that is something you heard a groan from the audience, you got to be careful not to be too scripted. >> well, ed, you're absolutely right. and here, this is one of these krang worthy moments for hillary clinton at that moment. especially if you're dealing with a candidate like president barack obama. who is so evasive. i mean, he's just a very good debater. he's very good on this stage. and so these are one of those attacks that really fell flat. and actually painted hillary clinton in a negative light. so those kinds of attacks that you want to avoid as a candidate if you're hillary clinton. >> lisa, there was another key moment, they had over 20 debates between each other back in 2007-2008. watch this one and we'll react on the other side. >> what can you say to the voters of new hampshire on this stage tonight who see your resume and like it, but are hesitating on the likability issue, where they seem to like barack obama more. >> well, that hurts my feelings. i don't think i'm that bad. >> you're likable enough, hillary. no doubt. >> thank you. >> there's a couple ways to break that down. it's still brutal to watch. on one hand i think it kind of showed, to be fair to hillary clinton, the arrogance of then-senator obama by saying you're likable enough actually helped hillary clinton in that moment. but how did she do? because she's going to get that same question here almost eight years later. people don't like you. >> well, ed, you're absolutely right. and this underscores a big problem that hillary clinton has had for quite some time now and it's the likability factor. you see, whoops, her favorabilities have been continuing to go down. the number one word associated with her, especially with her e-mails, is liar. and so there really is this level of inoffensiveness, and just general distrust that voters have in hillary clinton. so i think this is going to be a problem for her and it's absolutely going to be something that she's going to try to overcome in the debate. but it's hard to -- it's hard to coach a candidate to be likable. it really is one of those things that you either are or you aren't and this isn't something that has plagued hillary clinton for quite some time now. >> lisa booth, likable this morning. bring your "a" game. tuesday night in vegas, i'll with the pontiff. joining us now george griffin who was captain of the plane. which they called shepherd 1. and tim howard the dispatcher who spent more than a year planning the trip. good morning, great to have you here. especially on a sunday morning, because captain, i understand that you believe -- you say that it was basically like seeing god. >> well, it was. first of all, happy to be here. but, it was -- he's a very powerful man, and when you're in his presence. and as you sit there, and talk with him, and interact with him, he's a very humble man. but you can see why he is known as the people's pope. because he is so popular amongst all faiths. >> yeah, well and when you're nearing 80 years old to be that charismatic is just awesome to be around, isn't it, tom? has this experienced trentoned your faith? are you feeling more blessed today? >> oh, yes. just being around him. just his charisma that he has about him. you can see it in his eyes. and you can see it in his smile when you get around him to talk to him. it is -- it was a very honor, a very honored to be around him. >> and captain, you -- talk about first meeting the pontiff. i understand you asked him to pray for a safe landing. talk about that, but also what was it like to actually meet him and talk to him? >> well, i would greet him every time he walked on the aircraft, of course, as we left. but, one of the special moments on the flight for me was on the leg from jfk down to philadelphia. i was flying the leg, and i asked the -- his holiness if he would just pray for my landing. because i wanted it to be a very good one for him. and without hesitation he turned to me and said, well you must pray for me because i have a very big day in philadelphia. >> oh. >> so we agreed to pray for each other and his prayers were answered, of course, for me. >> i mean the access that you were able to get, just being able to, you know, talk to him and say, can you pray for me. and him coming back and doing that is just amazing. what -- what -- give us some more ideas of, you know, what it was like to be around him. pull back the curtain a little bit. any specific examples of a moment? >>, you know, he is like your favorite grandfather, who is always smiling, very humble. he's easily approachable. and he's just a pleasure to be around. he is -- he actually acts like he's not a head of state or somebody very important. he is very easy to be around and talk with. >> did he make any special requests? >> no. he really did not. he was -- >> peanuts or popcorn? >> contrary -- on the contrary he was just totally opposite. he really wanted nothing special from us at all. >> well -- >> and as far as even on the like the configuration of the aircraft, he wanted nothing extra done on it. it big news as well. just came from d.c. when i was at the airport i saw thousands of people coming in for the million man march. quickly, though, turned to a lot of hate from the podium. a lot of good people, like i said, i saw at the airport coming in, said they wanted to talk about justice issues. they wanted to come together on the 20th anniversary of the original million man march. but if you watch what happened at the podium yesterday, much different story. listen. >> -- is still alive, so we say down, down, usa! down, down, usa! >> we've come together today on 10/10/15 because we're sick and tired of being sick and tired of seeing every other day a young black male being murdered by the blue klux klan. >> black lives matter. are welcome, have a cherished spot, because they represent the future leadership. these are not just young people who happen to wake up one morning. ferguson ignited it all. >> jesus was a palestinian. the palestinian people have had the europeans come and take their country. >> reverend wright there. >> louis farrakhan who 20 years ago led the original million man march. and -- >> had a different tone. >> certainly a different tone back then. back then it was about voters rights issues and civil rights issues, and of course the nation of islam at the time organized a bunch of other civil rights groups. this time, though, the tone completely different. you didn't hear a lot of the crowd cheering when they were saying -- maybe that's the heartening part. you bring your kids out to this type of event and you hear these people at the podium talking about police officers as the blue klux klan. >> hijacked by hate speech from that side. and then the problem with this, really, is that it's silencing out the grievances that this crowd need to be heard. >> all right. some other stories making headlines this sunday morning. oklahoma rattled overnight by two earthquakes. one of them near the world's most important crude oil storage hub. the strongest was a 4.5 magnitude quake which followed a 4.4 magnitude quake. no reports of any significant damage. six other tremors also reported in the area throughout the day. and the happiest place on earth turned downright scary for some. disney world visitors getting stuck more than 40 feet in the air after a monorail line into the park malfunctioned. crews having to rescue passengers with a lift. halting magic kingdom traffic to a standstill. no one was hurt. officials tried to figure out what caused the glitch. don't mess with the train. an indiana woman uses her medieval combat skills and a japanese sword to take down an intruder inside her indianapolis home. karen says she woke up after hearing a strange man's voice. she got out of bed and found him in her living room. she immediately started throwing punches. >> i could see the guy standing right about here and then i just came out and started punching like this, get out, get out, get out. >> the 43-year-old then backed him into a corner and grabbed her sword. check this thing out! wow. well then she holds him down until police arrive. 30-year-old jacob wessel was arrested. police say he was high on drugs when yesterday in south carolina. that will be gone. hot, not hot summer hot, but temps in the 90s all in towards the plains. 92 in north platte and headed toward mid-october. and out across the west, also you're inside your house, right? >> right. right. you can't taste it. you can't smell it. you can't see it. and it kills more than 400 people a year and sickens many, many more. >> what are the symptoms? would you notice it if it was happening to you that you were getting -- >> that's a great question. the symptoms start with headache, nausea, you might feel really confused. and many people may also pass out. and it could be from something as simple as a car's running in the garage, even with the garage open. >> well, we're going to do a lot this morning to learn about how to use the >> so i think this is absurd. so defend this for me. or talk me off the lunch here. preschool is meant for socialization. like the first hour of preschool when you get to class is for the kids to play, interact, learn the social skills. >> i agree with you 100%. but why this program is excellent is because there's some rural areas where they don't have access to schools. and they -- a lot of people can't afford to go to preschool. some states it's not -- >> but is this -- doctor, is this even school, though? i mean -- >> no. you know, just sitting in front of a laptop doing some federally funded programs on a computer. is that preparing them for kindergarten? >> you know, i don't think so. personally i think preschool is more about socialization, learning how to share, play with other kids well. so for me, i think preschool is very important. but if you can't get to a preschool, to spend all this money to do it at home doesn't make any sense. >> no it doesn't make sense. because if you spend every child, before they start kindergarten, they have to know their numbers, their colors, their geometric shapes. and if someone is in a rural area and they can't get to a school, this is one way that, if they can't afford a laptop, they will give them a laptop and they can have the lessons at home in the privacy and security of their own -- >> the state is spending $11 million to do this? i think the onus should be on the parents to work with their kid anyway. i used to read with my kid every night. do blocks with them. >> people can do that. but what's excellent about this program is, it's a program that everybody's on the same page. so you might be reading to your kids, which is excellent. but this is everybody is on the same curriculum. so when they start kindergarten, boom, they're ready to go out the door. and as far as soarization, i just want to say, people that do programs at home, they also have field trips, play dates with the kids, also -- >> now that's a good part of this. okay i will get that. but let's look at the money on this side of this. because i'm wondering if using it on a computer is smart money. smart way to use this money. so in face cal 2014, $27 million, this upstart program costs $5.3 million in 2015. so, the money is not there for these programs. >> i agree. i mean i wouldn't spend money on this program. you can do it for free online yourself. i mean there's so many things that the parents -- >> what about khan academy. >> you can do stuff for free. i would spend the money on preschool absolutely, the studies show it works, it helps socialize the kids, get them ready for kindergarten. how do we even know the parents are going to do it? >> well, they do regulate -- >> these teachers know when you have a kindergarten teacher, you talk any kindergarten teacher they can tell the kids that have been socialized and gone to preschool and interacted with other kids, and then they get these kids who have like never left the house and show up in kindergarten and it's totally different level of playing field for these kids. >> that's right. and they all have to interact together. and if these children that you say would never have this socialization kills, with their interacting and they are familiar with the reading and the writing, that's another tool that they have in their hip pocket to say, hey, oh, i read that. i learned that. and also, we want to empower the family. and this is one way to do it. >> i think we can do it without spending the money is what i think. >> final word. great to but they can clone it. they amplify the signal from your key inside your house and then they push it to your car, your car thinks the key is next to it and in very rare cases, they use that same you don't stop and do the breathing. just this. >> rick would take over? >> exactly. >> want to go in, rick? >> yes. >> you have to do this pretty hard? this isn't like a small thing. >> you go down about two to three inches or maybe at least 2/3 of their chest. people have different size chest. it is very hard work to do. you can switch off, switch off. >> you mentioned what you did with the police officer there. this happened a couple of weeks ago. how long should we think that we ought to be doing it ourselves, three minutes me, three minutes rick? >> the shark saved his life. joining me now is eugene finney, a guy that was bit by a shark. nice to see you this morning. >> nice to see you as well. >> you're out in the wave. you described it as being feeling like you're hit bay truck or something in your back. i guess the question is, why didn't you go to the life guard or try to get immediate medical help. you were kind of dazed. why didn't you go home? >> i knew i needed to be in some comfort and i kind of just needed to get out of the sun and i wasn't quite sure what had happened and i didn't want to alarm my children anymore, so we just decided to go home and rest and call it a day. >> and so did you realize you were hit by a shark? >> at that point it hadn't crossed my mind, actually. later that evening when i spoke with my girlfriend about the situation a little bit more and she recommunicated to me that she and my son had seen two sharks swimming in that area just after the incident happened, i started to put the pieces of the puzzle together and then the following day, another swimmer, a surfer was hit by a shark as well and that shark was seen, the story was on the news and in the paper. they closed the beaches. and at that point i came to a stronger conclusion of what had happened to me. >> your boss a few days later said you weren't looking so good and you decided to go to the hospital. is that right? >> yeah. i didn't want to cut my kids' vacation short, so even though i was experiencing severe chest and back pains i kept that to myself and we returned home and i returned back to work and went in that day and told my boss i was going to need to leave early to see the doctor and he pretty much demanded i go right away. >> what did the doctor say, lay down. did you tell him you were hit by a shark? >> well i went if complaining of chest and back pains and i was having irregular breathing at that point. and the story about the shark incident hadn't come out quite yet until after they had done some tests and ekgs, chest x-ray and cat scan and the doctors asked me if i had been in a car accident or struck hard by anything and that's when i told them about the story because what end up having, the doctors said, was i had interior bruising of the thoracic cavity due to blunt force trauma. >> when they start to look a little closer and see what was going on internally, what did the doctors come in and tell you about your kidney? >> well, after they gave me the diagnosis about why i had the chest pains they let me know they also made an incidental find on my cat scan and they told me that i had a tumor on my right kidney about the size of a walnut and that was most likely cancerous. >> what would have happened, did the doctors tell you, if you hadn't discovered it? >> well, when i met with my surgeon, he let me know that had this not been discovered so early, i would have never known about it until the cancer had progressed to stage 4, metastasized and spread throughout my lower abdomen, causing me full-blown stomach cancer, which you don't often come back from. >> which runs in your family? dogs and cats living together. and this crazy story of the morning and a fox news alert now, no jail time for bowe bergdahl. military officials recommending no jail time for bergdahl for deserting his unit before he was captured by the taliban back in 2009. basically saying look, torture and the amount of time he was captured five years with the taliban for time served is enough time instead of life imprisonment which he could have been facing. >> what does this do to morale? >> joining us to weigh in is fox news sunday chris wallace. i think people may have forgotten, that you really kicked a lot of this off last sunday when you had an exclusive with jason chaffetz who threw his hat in and shook up the race among the other factors out there. >> that's true. and what i'm told is that no one expects paul ryan to announce tomorrow or fae time soon. congress is on a break until a week from monday. if there's one thing paul ryan knows it's numbers and i'm told what he's going through right now is to see whether he can get a working majority of 218 republicans to back him on his main initiatives. if he doesn't get 218 and at this point nobody can because the so-called freedom caucus, about 40 members, keeps any republican from 218, he will be in the same boat john boehner is in and was in and that kevin mccarthy would have been in. i'm told the he's working very hard to see whether he can get some of those house freedom caucus members to join him to basically commit that they will support him on a number of measures. i'm told there's at love pressure from establishment groups, business groups, saying to some of those house freedom caucus members, if you don't, you know, get together and give us a working majority in the house, republicans, we're going to give you a primary opponent come the fall of 20 -- the spring of 2016. >> what kind of leader would he be if he were to lead as house speaker? some speculating he would be similar to john boehner politically. dana perrin no on our show saying she would be excited she was boehner fan and politically he does align himself that way, so what would the would the freedom caucus be satisfied by a ryan speaker? >> well, i think part of the question is what kind of followers would they be? again if you -- you can be the greatest leader in the world but if you can't get a working majority of 218, absolute majority in the house, because democrats are going to vote against you, you know, you can be winston churchhill and it isn't going to work. in terms of paul ryan, i think that the big difference with boehner is he would make the conservative argument more articulate and aggressively. in that sense rhetorically he would be more effective than boehner. on the other hand, you know, he's also not a blow them up person. he's not going to want to see a government shutdown, not going to want to see a gee fault on the debt limit. there are limits to how far he would go but he would make the conservative pace in a more aggressive and effective way than boehner or mccarthy would. >> left media have been having a heyday thinking halloween came early using this as can candy says the republican party is in chaos. how big of a scramble is going on and is it as bad as the left wing media seems to be trying to make it? >>. >> it's an honor to be on. the tweets i'm getting, people thinking i'm the other kevin mccarthy. "steve jobs" opening in limited release this weekend, new york, and los angeles before it expands to the other cities and states throughout the next coming weeks. this movie is not necessarily a biop biopic. it's a different type. aaron sorkin wrote the film wrote "newsroom" and "social network" and "west wing." the cool thing is they basically divided the film into three act structures. three acts, 40 minutes prior to the launch of a major plot. 1984 the macintosh, 88 the next cube and 98 the imack. the awesome thing about this, this is so inside nerdy filmmaking stuff and so cool to hear about it, danny boyle the director, decided to do 1984 in 16 millimeter grainy film, 88 in 35 millimeter film and 98 digitally. as the movie progresses in technology the image gets clearer. it's very cool how he was able to pull that off in the movie. performances are amazing. michael is brilliant as steve jobs. kate is amazing. the script feels like a two-hour action film but there's no action. it's all dialog rapid fire dialog and it's absolutely brilliant. >> kevin, people are floating michael for a possible oscar.ng christian bail turned down the role. do you think oscar? >> it's incredible. him this year or leonardo for the movie called [ inaudible ]. i sat down with kate wins loathe to talk about the movie and said it's the hardest accent. the character was polish and armenian. check this out. she goes into the accent in the interview. watch this. >> this was the hardest dialect i've ever done because joanna hoffman in reality, born in poland, moved to romania, some family spoke russia, moved to america. the thing i didn't want to do is make the accent too thick and obvious. when you do an accent like that it can come across as being [ inaudible ]. if i was talking to you, it can sound like that where actually joanna had been in america for a very long time and so there were these rhythms she had that lent into all of this language. >> wow. >> isn't that incredible. the movie 5 out of 5, my third 5 out of 5 of the year, my first was mad max and inside out. definitely check it out in theaters. >> what about "pan." >> yeah. unfortunately not so great. visually stunning. the problem is the story and the characters aren't that interesting. origin story of peter pan and captain hook. hugh jackman playing black beard. the visuals are incredible. the story doesn't really grab you. i was very forgettable. didn't do much for me overall. i thought jackman did a decent job as black beard. see it in 2 d. not worth 3d. the director is a great filmmaker. i just think this is the weakest of the movies so far. 2.5 out of 5. see "steve jobs" or "the martian." >> or "the walk". >> yes. amber smith senior military adviser for concerned vets for america joins us this morning. i want to go through these. first of all the va spent $250,000 on what it calls the blue eclipse. tell me about it? what do you think about that kind of spending? >> he y yeah. we're seeing more fraud, waste and abuse from the department of veterans affairs spending hundreds of thousands of dollars on fancy rock sculptures and abraham lincoln quotes in morris code that lights up and dances along the wall as veterans walk into whatever facility and that's not what veterans are looking for. they don't need this fancy elaborate art. what veterans want is plain and simple and what the va is supposed to be giving them timely and quality care and not getting it. >> let's look, you mentioned the next one, $1.3 million, this is $285,000, for this piece that's called the horizon. pretty remarkable. the next one is, $1.3 million on what's known as an aggregate courtya courtyard. do we know what an aggregate courtyard there. aren't veterans wondering after that big scandal why is the money not being put into their care? >> that's absolutely correct. it's skewed priorities. it's gross mismanagement and fiscal irresponsibility. and the va's quick answer, we need more money, we need a bigger budget. the department of veterans affairs is the second largest government agency in our country. its annual budget over $160 billion. and this in terms of how they're throwing it away on this art, millions of taxpayer dollars goes to show you that is where their priorities lie instead of fixing and reforming the system so it's better for veterans. >> definitely heard it on the campaign trail, donald trump, carly fiorina, brought it up. are you surprised this hasn't come up more about helping our veterans and fixing the system once and for all? >> look, frankly i think this is egregious. i applaud the army to for working through its process but the issue is accountability. particularly sergeant bergdahl was charged for misconduct in the face of the enemy which means he put his fellow soldiers in harm's way. i took command of the special forces the day he walked off his base and we were ordered to stop everything we were doing, ship all assets and soldiers for the search for him and soldiers were hurt, harmed and killed in the process of missions to find him that we otherwise would not have been doing. he needs to be held fully accountable for it. and frankly the administration needs to be held fully accountable for the trade that it made for sergeant bergdahl. those five taliban commanders now in qatar are recruiting, fund-raising and rejoining the fight and, you know, the final piece of accountability i think that needs to come into play here is can you imagine being the family of one of the hostages in iran, that didn't receive the benefit of this type of a trade, that the administration has done nothing for, that it could not even put into the iran nuclear deal? so i mean i think there's a lack of accountability all around here and i know both myself and fellow veterans are upset about it. >> you mentioned there are been reports at least three of the taliban five have been communicating with the old terror networks trying to get back on the battledfield. the obama administration insists all five are still in qatar, that the travel ban for themes has been extended. do you buy that and believe them? >> i don't know that we have full accountability of the five from the folks that i'm hearing from that are still working the issue, but again just because they're physically located in qatar doesn't mean they can't activate their old recruiting networks, fund-raising networks. this was essentially the taliban's war cabinet and to think they are essentially sitting on the beach and enjoying retirement is egregious and insult and always worth reminding everyone we still have 10 to 12,000 soldiers in afghanistan in harm's way because of the activities that these five and the rest of the taliban command chain. >> the other side of this argument look, he served time, tortured five years by the taliban, it's time served. >> sure. >> that's why no time in prison. what do you say to that? >> i think the defense is doing a good job of conflating two issues. on the one hand the charge, and that is desertion and misconduct in the face of the enemy and we need to see that charge place out. on the back end of sentencing whether he deserves a little less prison time because of what, you know, happened at the hands of the taliban my own personal view is he caused it, and, you know, the families of the fallen don't get their sons back at all. so i think there need to be a full measure of accountability here and i hope the army does the right thing. >> strong criticism but not from an outsider. somebody on the inside and knows a lot about this case. we appreciate those facts this morning. >> thanks so much. now these three inmates meanwhile escaped from alcatraz more than 350 years ago. now -- 50s years ago. now their families say they have proof they're still alive. it if you had the chance to clone your pet so they could live on forever would you? >> oh, yeah. what they do, they took a skin punch off my dog's -- the donor dog's hind leg and i sent it to massachusetts and they groots cells. from there they sent it to south korea and there when they got to south korea they took a dog's egg and sucked the dna out of the egg and took the dna of the skin and put it in there and gave an electric charge to it and tricked it into becoming an embryo and plant it back in the female. >> and then is this just put into an incubator? what do the taxpayers do about the cred ises that became phantom and do you ever get the money back? >> people are not getting the money back. taxpayers paid for all of these so-called green energy cars, and then they gave out all these tax breaks and now we recognize that this was a fraud and, in fact, not green at all. taxpayers are just out the money unfortunately. this is one of those wrongheaded policies where not only taxpayers lost money but the epa and its new regulation and the cost of those regulations have actually also impacted business to the extent that businesses are sitting on cash and not hiring and you have an economy that is stuck in the mud. >> talk about grabbing the reigns on policy somebody who has a big impact on economic policy is the speaker of the house and a lot wondering and you're going to get into itting your your show, paul ryan the guy or not. >> you could only speculate what he's going to say but i think he's got a lot of support in terms of this job. we're going to talk with congressman peter king and mimi walters what they feel are the most important skillsets to take this job and really importantly, who is going to bring the two sides or diet visions together. i think paul ryan can do it. >> this shakeup, though, has been rolling washington but has wall street paying attention, worried about a government shutdown. what's going to happen with the budget. how is wall street responding to the turmoil. >> so far not a major reaction in terms of markets and investors. people are recognizing there's a revolution going on in the republican party and maybe that's what they need. people are so angry that in many cases, the gop has gotten rolled over by the president's agenda and the president has an opportunity to push his agenda through aggressively while there is this uncertainty there. in terms of markets they're looking at an economy that is two steps forward, one step back. we will talk with ben bernanke this morning and even that conversation i have to tell you suggests to me he's fine with interest rates staying where they are and the federal reserve doesn't have to raise interest rates in 2015. why. because the economy is so fragile. and it all goes back to the regulatory environment, e pa, obama care, dodd/frank costing business too much money. >> major decisions coming, big impact on the economy and on that campaign that's playing out right now. we'll all be watching. >> the show starts in 12 minutes. >> i'll be there. >> thanks so much. as always. >> thank you. >> we've gotten a lesson in cpr and jaws of life. that's a tiny slice of the day in our first responders. up next we get put to the test to see how would we fare in an emergency situation?
