One of the things that i think the school board needs to do is to try to find out why the students arent attending, signing up for the online sessions or appending classes where they are in person. This is something i think that the School Districts need to pay more attention to to find out what the problem is. Pete francis, here is the Alabama State superintendent when asked about these 5,000 no show students. Said its a very difficult year instructionally, that doesnt even touch the surface on the issues we will have with these 5,000 students who are not in school and we dont know where they are. I have every expectation once covid19 ends all of those students will come back. But, if you dont have a laptop and you dont have wifi you are not able to access the classroom right now. All of these kids presumably didnt go to private school. Although they could have. What kind of setback is a year out of school if thats what were looking at . Well it, definitely will be a setback. But i think the school boards, you know, all across the state and the state could have done a better job to locate these students and find out exactly what the problem is. And the state, you know, has the resources or could put more resources in to getting the wifi and getting to these students and having them be able to attend because its going to put them behind in all the classes that are behind. The state needs especially the School Districts need to do a better job. In our particular case, take back. We handled an issue in montgomery where they wanted to raise taxes to for money for the schools. Our take was before we raise these taxes, why not lets do an audit and find out what they are spending per students and find out where the money is going. And they had a public hearing, which was right in the middle of the pandemic, which was very lightly attended because it was in the midst of the pandemic and pushed it through anyway. Instead of, you know, pushing higher taxes and so forth. The School District should have taken more time to find out why these students arent attending and what resources do we need to give them to make this happen . So its difficult for them to draw on resources for other parts of the country. But hospitalizations are low and not the only part of the story. We dont really get figures about discharges. We dont get figures about recoveries of patients. Here here in new york im not able to give you data on nyu, but i can say we are discharging many people, theyre Getting Better and returning to full life and full recovery. So, its not as grim as we may imagine. Though the gatherings at thanksgiving are probably going to see a rise in hospitalizations and maybe even a rise in deaths a few weeks after thanksgiving because of these gatherings. Having said that, the fatal rate if you look at how many people are positive for the infection and how many people pass away its less than 1 0. 84 . Its much, much lower than it was because we have better techniques. My major concern is really for healthcare workers who are experiencing burn out. Who are exhausted. There has been some concern by individuals about potential side effects of the vaccine. Thats pretty normal response as you are going to inject something in your body what can i expect it to do to me. Obviously every body will respond differently. What do you sty people who have concerns about this . The vaccines sparks as far as we know have been very well tolerated there been studies performed in london giving people much higher than normal therapeutic range of the vaccine. We know what it does to healthy volunteers. The true data on vaccine until 20 to 30 Million People have been vaccinated and followed for over year most of the time side effects is actuality local. Yesterday, in the Third Circuit in pennsylvania, the trump Legal Campaign lost their fight for an appeal of a pennsylvania ruling. But they plan to appeal that ruling to the Supreme Court. In fact, jenna ellis, part of President Trumps legal team, tweeted the following. Rudy giuliani and me on Third Circuits opinion. The activist judicial machinery in pennsylvania continues to cover up the allegations of massive fraud. We are very thankful to have had the opportunity to present proof and the fact that the Pennsylvania State legislature onto the Supreme Court. Pete, that case would most likely make its way to Justice Samuel alet to who then would make a decision whether those cases would be heard by the Supreme Court. This is the president s legal challenges. I know you have another one you want to focus on. Only other angle we should highlight pete and jedediah is there is also the efforts to talk to state legislators about how they will appoint electors to the electoral challenge there is a legislative and legal fight going on at the same time. Pete in a moment we will get to the way back machine and remind you the way some on the left looked at elector in 2016. Getting up to the Supreme Court. Ultimately the appointment of the electors and certifying the election in mid december and whether or not the Supreme Court crimes. In will, you mentioned it. This is one case in pennsylvania appealed why the trump team. The other brought by state legislators and candidates that challenges whether or not act 77. A bill passed in october of 2019, whether its constitutional under the pennsylvania constitution. Because it changed entirely the way that you do mailin ballot. In pennsylvania it used to have to be in person or a very specific reason for absentee balloting. And it said you have to amend the constitution in pennsylvania if you wants to change that. They never amended the constitution. They just passed the law. So, if you talk to lawyers and read the actual argument and the constitution, its clear they are going to win that case. Or they should win it on the merits. In fact, last night, there was a decision, it was passed along to the pennsylvania Supreme Court saying they have a robust case. See if that get to the Supreme Court as well. Certification. Ultimately, if you are the trump team and saying hey, we dont like the way signatures were egg northward. We dont think there were many safeguards on mailin balloting that is evidence for you to continue to make a challenge. Where it lands with the Supreme Court, who knows. But ultimately, it seems it will get its hearing and day in court, jed. Jedediah yeah, that first case you, just a moat on that. Jenna ellis tweet we had put it up earlier talking about how it was an activist court. I dont know how much that holds unjust because the individual who wrote the opinion was actually a trump appointed judge and the panel that actually weighed in on of it judges. They were all g. O. P. Appointed judges. I dont know how well that holds up. And it was quite blistering. Calling an election unfair. Requires specific allegations and proof we have neither here and there is no clear evidence of massive absentee ballot fraud or forgery. They went on and on. I think that is a setback especially when you look at the Supreme Court and how they may evaluate Something Like this, obviously you have to take into account something that was written this way obviously by, like i said, a trump appointed judge. It remains to be seen what they will say about it. Obviously we will keep you posted with respect to what goes on with that. This was a blistering opinion in my opinion. And, will, you mentioned, also, the electors in this debate about electors and what their roles should be. And rite now you have a lot of folks on the left and many on the right, my sufficiently include you had, coming out and saying i dont think that would be a path to take right now. Think it would potentially circumvent the will of the people. Others feel differently. However, chris hayes has a tweet out from 2016 thats rather interesting. Take a look at what he had to say back then. Fun fact, states decide how to apportion their electors. They could give them all to say whichever one won the majority of counties. So there he is seeming to endorse the process. I surmise that he would feel a little bit differently this time around. So i think, if nothing else, what we have learned in 2020 is that there is a value in consistency. There is value in people who feel consistently about things like gatherings during covid19 who feel consistently about things like the Electoral College and the role they should play. And there has been a lot of people who have been exposed as the being politically motivated one way or another. It worked for me this time around this time it wont let me flip my opinion on it. That seems to be a perfect example of that right there from chris hayes ought least i have think. So. Will as we approach december is there should be a healthy debate state legislators appointing electors from President Trump if the vote went another way. Whether or not thats in pennsylvania, michigan or arizona. But it is hard not to Pay Attention to the fact that hypocrisy from 2016 to 2020 is so stark. Whether or not that is accusations of an election that has been illegitimate with russian interference. Whether or not that is in 2016 as an msnbc host argues its okay for state legislators to appoint electors against the will of the people in 2020 it amounts to insurrection to, georgia, gubernatorial races where Stacey Abrams full of fraud now as clean as it can be. Hypocrisy runs rampant through this entire conversation. Pete remember in 2016 concerted effort to flip electors away from donald trump to Hillary Clinton. Cheered by the left. His inauguration was boycott. If you actually look at the affidavit that was dismissed by those judges, jed, you mentioned there are plenty of affidavits and examples of actual fraud that is acknowledged. Whether its big enough to flip the state is another question. What i dont like watch something people retweeting articles from other reporters that said there is no massive fraud after reporters did no digging they accept it as is without doing any digging considering how much digging was done around the russian collusion hoax. They are echoing each other without actually doing the hard work only ones out there attempting to do the hard work are the Trump Legal Team who they ignore and automatically dismiss there is no evidence of fraud after they never looked for fraud. The whole thing feels circular and hip kill considering the way when you look at the tweet like that from chris hayes reminds us listen they would have done whatever they could have done and had the media to echo it but thats the world we live in. There is another topic we have got this morning as well. And its immigration which has come to the forefront a little bit more after some stats came in over what happened between november 18th and november 23rd. Look at the number of unaccompanied minors. Thats children, coming across the border between november 18th and the 23rd. Thats right before thanksgiving. And that is a serious spike. And consequential. A lot of people tying the connection to should there be if there is a Biden Administration, certainly their policies will be much different. And he in an interview on tuesday talked about the first priorities is reversing the immigration policies President Trump has enacted. Watch. Im going to make a commitment i will send an immigration bill to the United States astronaut with a pathway to citizenship for over 11 million undocumented people in america. Jedediah yeah, remains to be seen whether he will do that and what the reception will be like. I dont know, honestly, where the public would stand on an issue like that. But i do think that there needs to be a bigger conversation. You know, we talk about pathway to citizenship because thats the mainstream conversation that happened of happens all the time. What goes on with these sanctuary cities is so appalling. And i know we had mark morgan on earlier to talk about that. Somebody really needs to be in a leadership position of challenging joe biden on those issues of what many of these cities get away with around the country of these individuals who get come here illegally. They are repeat offenders when it comes to crime. They are not handed over to federal officials. And they constantly inflict crime on society and on individuals over and over again. Thats a problem i focus on. Its unfathomable to me that these sanctuary cities are able to function as theyre. He should face questions on that on day one. Kinder conversation that a lot of people get on board with this is something that plagues me and really he should not have a hard time condemning. You will be protected from deportation and then once here, you are going to be provided significant rewards like free healthcare and amnesty. Will President Trump legal team taking post election battle to the Supreme Court after a federal Appeals Panel in pennsylvania dismissed their lawsuit over alleged voter fraud. Jedediah this comes as republican lawmakers in the state introduce a resolution intending to dispute elections results. Pete here to discuss Fox News Contributor and George Washington University Law professor Jonathan Turley. Professor, thank you so much for being here. A lot going on in pennsylvania. So you have got the ruling that is now going to be appealed. You have the legislature pushing back and trying to regain some of its power. Then have you this act 77 additional lawsuit that looks like it has some footing and may move onto the next level as well. Break it down. Where are we . Well, much of it is not going the way the president had hopes. The case going before the court Supreme Court rulely is unlikely to change the outcome. They are unlikely to prevail. I think they are less likely because of these overheated statements by the trump counsel. You cant insult your way to victory. It is, i thought it was really substantively and strategically ill considered at best for them to be making these statements. It is outrageous to call these judges activists. You know, the judge that wrote that opinion is a trump appointee and a republican and respected judge, a former law professor. The District Court judge is a republican, a Federalist Society member. These people are trying to do their job. And i do think that they are doing a good job. I mean, i over all, they are doing what James Madison expected them to do to be deattached and dependent and thoughtful. I was very critical of that statement by trumps counsel. Now, having said that as you note, there are other issues going through the courts including this act 77 issue. The reason i like the act 77 lawsuit quite frankly is that it has legal team affirm. Its solid ground either a constitutional violation or its not. We can deal with that frankly, at this point, judges are looking for those types of solid traditional arguments. The Third Circuit blasted the Trump Campaign and said that the one of the first things they said to the court was that they are not alleging fraud. So there was this disconnect between what the trump team was saying outside the court and what it was saying in the court. Will jonathan, i would love to return to the condemnation of the words coming out of Trump Legal Team. I spoke to you last night you had similar condemnation for president obamas former speech writer ben rhodes when it came to criticizing the court as being, quote, political when they struck down new yorks laws limiting gatherings in churches and synagogues here in new york. You clearly do not like politicians or their surrogates criticizing the politicization of the court. But i really want to ask you as a followup you said strategically you think it is bad as well. Why . You think that will hurt the trump teams case in front of Justice Alito or others at the Supreme Court . I think it does. I mean, its you know, its like being on the subway. No one is going to sit next to you if you are raving. And that tweet was really beyond the pale. It was attacking these judges judges look at that undermining the credibility of the trump team. I feel the same way about the democrats. The democrats are also attacking judges, a decision goes against them on the new york pandemic order and then cuomo comes out and accusing them of basically being a bunch of ideological shills. And rhodes says they are not even a legitimate court. This is the type of thing that undermines our judicial system. The Supreme Court is legitimate. Thats why everyone is going to follow its owrdz. Yeah, you know, jonathan, the point that you bring up that hits home the most for me is the distinction between what is being said in court and what something said oftentimes on the president s twitter feed and what is being said in press conferences because when you Say Something in court you have to show evidence or there is an accountability issue that then you are held accountable for that so thats a great point that you bring up. Jedediah i dont like my politicians telling voters why they did or didnt vote for a candidate because frankly they dont know and its also incredibly condescending. Whats your reaction to the comments that you saw president obama make right there . You are right with condescension. This is one. Most dismissive things obama has ever said. And he has said quite a few things like this. I think its interesting. People like obama who claim the loudest that they are the healers and uniters are sometimes the most divisive figures in American Public life and exhibit a is really former president obama. He really infantilizes hispanics here you hispanics would vote the right way if you could get over your chris faith. We are largely catholic and evangelical and propelling more prolife life than other americans. Thats the only correct thing he said guilty as charged that we take life issues seriously. The rest of it is pure dribble. For example, president obama says that we voted for President Trump because we agree with him on gay marriage. President trump is progay marriage. Is that what he means and by the way president obama, when he was elected to office was adamantly against gay marriage. So, it really just drips with hypocrisy for president obama to talk this way to hispanics. Also, as you mentioned in the intro, i believe the primary issue, the life issue is critical. I think the primary issue driving hispanics to the America First agenda and to President Trump is the economy. For example, we are the most entrepreneurial demographic in america by a long shot. This president has been magnificent for entrepreneurs and startups hispanics quite smartly made a multidimensional decision to rally to President Trump life issues. Economy, border security. Propolice, a variety of issues all of which latinos really care about in this country. Jedediah yeah, you know, that comment that former president obama made is not smart politically either. I mean if you are trying to reengage a community that clearly has. I mean, President Trump made gains with the Hispanic Community no question particularly in places like florida. Right. Jedediah if you are trying to as a leader in the Democratic Party get those gains back you dont start by insulting that community. How do you think hispanic americans that heard that comment are feeling with respect to it as they look forward, to you know, a next election coming up, midterm elections and whatnot . I think a lot of hispanics traditionally voted democratic realize they have been abandoned by the Democratic Party as it lurches left ward and left as political orphans. She talked about the numbers and said they arent as grim as they have seen. Certainly hospitalizations are increasing in the south and the west of the yats and a lot of the rural states where we didnt see very much in the beginning. Very different to our experience in new york. This is now involving most of the nation hospitalizations alone are not the whole story. We dont get information about discharges and recovery of patients. Discharging many people and returning to full life and recovery. Its not as grim as we may imagine. The fatality rate, if you look at how many people are positive for the infection and how many people have passed away its less than 1 , 0. 84 . Trumps Campaign Legal team is taking its fight to the Supreme Court after a federal Appeals Panel in pennsylvania dismisses their lawsuit over alleged voter fraud. This as state republicans introduce a resolution disputing the results. Kevin corke joins us live from washington with more on the courts ruling. Kevin . The Trump Campaign says there is up mistakeable evidence there was violation of both state and federal law during the pennsylvania election in 2020. But after this latest setback, at least in the courts. They will have to now take that argument to the u. S. Supreme court. Let me share what the judges had to say after this latest setback in pennsylvania. They say free Fair Elections are the lifeblood of our democracy charges of unfairness are serious. But, calling an election unfair does not make it so. Charges require specific allegations and then proof we have neither here. Meanwhile Pennsylvania Republican lawmakers are introduced a resolution intending to dispute the Election Results. It reads in part, recognizes substantial irregularities and improprieties associated with mailin balloting, precanvassing and canvassing during the november 3rd, 2020 election. This from jenna ellis on twitter. She is an attorney for the Trump Campaign. She says the activist machinery in pennsylvania continues to cover up the allegations of massive fraud. The case going before the court Supreme Court is really unlikely to change the outcome. Unlikely to prevail. I think they are less likely because of these overheated statements by the trump counsel. You cant insult your way to victory. There are other issues going through the courts, including this act 77 issue. The reason i like the act 77 lawsuit quite frankly is because it has legal tier affirma solid ground either a constitutional violation or its not. We can deal with that frankly at this point judges are looking for those types of solid traditional arguments. Jedediah i think he makes a great point about the statements that may happen on twitter that statement by jenna ellis about activist judges. They werent activist they were g. O. P. Judges. The one who wrote the opinion was appointed by President Trump. I think you have sown that pattern a little bit. I think the administration would be best served to go to court to take their issues to court to have their legal team in court. Make the case as best as they can for whatever they think actually happened in these instances. If they get tossed out. They get tossed out. The way this is playing out on social media. A lot of what is being played out on social media is untrue oftentimes not untrue but helpful to them in their own effort to make theist cases in court. Thats something they should really consider. I know they are trying to win a Public Opinion battle here, too. If you are really looking for results, those results can only happen in a court of law. They are not going to happen among us. More funding for the paycheck protection program, driving, funding towards these Small Businesses. The Restaurant Industry has been especially hit hard. They are not the only business. But restaurants had been hit hard. Especially when you add on the state and local restrictions. When you have you will a bill de blasio in new york city where at a whim they will close down Small Businesses and they dont really measure the impacts on whether or not a business can survive their restrictions. I believe that the government has a responsibility. If you are going to shut down a business that was doing well before you shut them down, you have a responsibility to make sure that they are still alive on the other side. Pete absolutely. Lee, i have got to get your take on this too. Four weeks from the election. Seven u. S. House races that have not yet been called or finalized. The republican candidates in all seven races are leading their democrat opponents. Your race is one of them. You are up 61 . Have you got 61 of the vote. But only 77 of precincts reporting. How can that be a month later . This is true. There are still about 60,000 ballots left to be counted. Here we are about to enter the month of december. My lead is about 60,000 votes. My opponent would have to get about 98 of what is remaining. Thats not going to happen. If i was a democrat, this race would have been called on Election Night. But im a republican. So im sure there are some folks who like to flip the results here. Listen, there are some things in new york that i think should be done elsewhere like where we have the ballot verification process. I as a candidate, can have people closely observe the opening of ballots. Where i saw that people were voting after the october 9th Voter Registration date, we can then get those ballots thrown out. But on the flip side of things, here we are several weeks later, you have multiple new york race that still have not been called. And there are flaws in the system when that is the case especially when you take a Campaign Like mine. You know where you are up by over 60,000 votes on Election Night and here you are a month later still up by 60,000 votes and the race still has not been called called. Pete the ballots not been counted because of challenges or they havent counted them yet . They havent counted them yet. So in new york, when you vote in person, that vote counts but if had you already voted by absentee obviously that should not not counted and not be able to vote twice. In new york you have to wait at least a week before you start counting because they want to throw out all those absentee ballots for the people who voted in person. In Suffolk County east end of long island they started counting on november 16th with the second and third congressional districts. Remember both of them were highly contested as well. And then they work their way east. On top of it Suffolk County board of elections had some positive tests for coronavirus, which shut down counting and then you had thanksgiving. Ballot counting will resume on monday and hopefully at some point this upcoming week this race will finally be over. Pete what a mess. Representative lee zeldin, appreciate your time. Good morning, jedediah, thank you for having me. The standardized tests sometimes i think get a bad wrap. Play a vital roll. Measure of Student Learning which is really critical for parents to understand how their schools and systems are doing. For teachers to understand that the scale of the achievement gap or the scale of the challenges we face. And honestly for policymakers to understand, particularly right now in the middle of this nationwide school shutdown. To understand the scope of the problem that were going to face when things go back to normal. Jedediah yeah, i mean, i dont understand how we are supposed to assess whats gone on with students throughout the course of this. We know that many students have unfortunately fallen behind. But if we cant use this testing as usually happens, and how are we supposed to tell whats happening in these schools and these communities right now . Its going to be really hard. To say i think thats the challenge. What worries me is that now that these national tests. We know already in the spring during the shutdown state tests were canceled which made sense. We are in the middle of the crisis. We are now nine months into it. Some assessments have found ways to adapt and found creative ways to assess students. College admissions, High School Admissions those tests are happening. I think it demonstrates that we can do this. We can find Creative Work arounds. Now that uncomfortable tests are being canceled. I think what were worried about is next we will see state test test test testing canceled. Then we will go a full two years without any independent measurement of you who students are doing. And when we know that students are suffering, when they know that thousands of students are not even showing up to online classes. When we know in new york city alone some 60,000 students dont even have devices to be able to engage in distance learning. We know that the impact and the fallout is going to be massive. So we need to have objective measures of Student Learning. Jedediah you know im not a big lover of standard advertise dyed testing there is no barometer. I want to ask you about stats coming outs of alabama. 5,000 alabama students were no shows this year by no shows i mean not only for in Person Learning but virtual learning. Hundreds of teachers could lose their jobs as a result of this. Talk about the impact of this and were you surprised to see these numbers . I think we werent surprised unfortunately. We were disappointed. In the spring we saw districts lost thousands of students during the school shutdown. So im not surprised that we have struggled to get them all back. And i think we know this is going to continue to happen. Which is why we need to make it a priority to find safe ways to bring students back it to bring as many students back as we can. Some schools have been able to do. This Catholic Schools around the country have been open now for an entire quarter for about 13 or 14 weeks. We need to find ways for Public Schools to do the same thing. Jedediah yeah. A lot of these Public School students, unfortunately are going to be very, very far behind and we will have to figure out a way to catch these students up. Watch this. A hash browns, a little salt and pepper, mix that up real nice. Now, one tablespoon of butter. Two stable spoons of oil and let it melt. Cook that on high heat for 10 minutes. Pop that in the oven for 15. In a clean bowl, mix six eggs. One cup half and half. Two cups delicious she darr cheese. Stir that all together. Out of the oven, lets add the ham. The president would argue she was talking about hard hit blue states but i should tell you this. In a meeting with democratic lawmakers, the leadership were talking about Chuck Schumer and nancy pelosi, the president elect presumptive president elect joe biden asked the president to get the work donald passed before he takes office on january 20 assuming he take office then, guys . Well there are Police Chiefs and sheriffs and Law Enforcement officers neglecting to follow those mandates. Pete spoke to some of them a little bit earlier, sheriffs and Police Chiefs across this country on these heavy handed lockdown mandates and their desire not to enforce these rules. Theyre not going to defund the police and maybe some of the big cities theyll talk about it. Its not going anywhere. I talked to sheriffs all over the country and chiefs of police and people in politics. Its not going to go anywhere. They dont call us and talk to us, they dictate from the top of the ladder and they look down and we get no communications. They meet with the governors and what hes going to do with these executive orders hes got to say guys how can we enforce this. We dont see people as black and white, we see victims accused suspects and witnesses and we have to do better. My community and business is well aware that were not going to come intrude upon your thanksgiving gathering or your small party youre having at your restaurant. These are people who have been struggling. These are people who need a holiday who want to just spend time with their family. Theyre just not going to do that right now and they are coming out and saying that and i think at a time like this when weve had so many conversations about police and community and the importance of that relationship in many areas being healed and people feeling like the police represent them and rebuilding a sense of trust between police and community i think this is part of that and theyre just having compassion and empathy for what many people in the own community have gone through and saying yes we care about safety, but were not going to knock upon doors and make sure people are lowering their masks between bites of food. I think one of the big things missing about this though, they dont talk about it much in the film is j. D. Vance, his story what really turned his life around from what i can gather and interviews from him is the fact he joined the marine s. Well i dont think that particular area is misrepresented or that appalachia is a very specific spot and there are pockets of america that are like that for sure. I think maybe it feels like to people that here are some major hollywood stars trying to dumb it down and look countryhick redneck kind of a thing for it to show people these are what trump voters look like and if thats what they are doing obviously people should be upset i dont know if thats the case. I think its supposed to be a family drama about this family thats very, you know, messed up , just to put it mildly, and how this kid grew up so i dont know that thats the case but its certainly not indicative of the trump voter if thats what they are trying to say. Is there optimism, pessimism, what does the campaign feel about the prospects of their legal battle . Theres optimism, there will be a petition filed with the Supreme Court. It will be up to the Supreme Court whether to grant sertiori, but two Significant Developments happen one late last night and i heard you guys mention this earlier. Theres a separate court case with representative mike kelly in pennsylvania and he actually is likely to succeed on the merits of that case in pennsylvania, alleging that the whole mailin system was unconstitutional and he was deemed likely to succeed on the merit so that will be going up to the Supreme Court there in pennsylvania, so two cases going on in the state of pennsylvania and many more across the country jedediah kayleigh i want to ask you about that ruling because as we look forward to the Supreme Court, were all curious as to how the Supreme Court would receive Something Like this , and you know, if you look at the ruling, this is from a trumpappointed judge obviously we know that wrote the opinion, its pretty tough. It says charges require specific allegations and then proof, we have neither here, calling an election unfair does not make it so. Theres no clear evidence of massive absentee ballot fraud or forgery and tis is something that has come up repeatedly in conversation that what is being alleged on twitter is not being alleged in court and cannot be proven in court via evidence so what do you expect . First of all will that change and secondly, how do you expect the Supreme Court will receive this given how this particular judge wrote this opinion and what they perceive to have been presented or not presented in court . Yeah, jed i think the Third Circuit court judge misunderstood the argument because look, its an equal protection argument, the one weve been making in court and it says that if you were in the seven blue counties in pennsylvania, you were given an extraordinary opportunity to fix your mail in ballot, tourer your ballot but if you were in the other 60 mainly republican counties you didnt get that privilege and thats an equal protection violation and we have a right to ask these questions and we have presented affidavits and there are declarations made as well, so there is evidence there and its important for the Supreme Court, we feel, to take a look at this but i do want to highlight one under reported case and its whats happening in into nevada pretty extraordinary but we were given the opportunity to start investigating into the discovery phase and the moment the Trump Campaign was granted the ability to depots witnesses, the moment that that happened you had the democrats bring out their swat team, 10 lawyers from perk ins c ooey, the fusion gps firm that did the dossier trying to stop our ability to simply ask questions and theres a reason democrats dont want to get into the investigatory stage of litigation because theyre afraid they will uncover the fraud that has been alleged but we have a right to ask questions and were thankful to that judge in nevada for allowing that to proceed. Pete very interesting and also very clear that the Trump Legal Team plans to continue to fight and is optimistic as youve said i want to go back to pennsylvania though for a moment another part of what could go up to the Supreme Court is the idea that republicans were not allowed to observe the 682000 votes in many parts of pennsylvania and the ruling says that well democrats didnt either but what about if workers , a lot of the workers especially in the big cities, hired by democrats, controlled by democrats, if you cant observe it, how can you know it was above dashboard . You think an argument like that gets more resonance at a higher court . Absolutely i think thats a very key point pete because its also an equal protection argument. If you have republican observers that arent able to observe these ballots that are a football field away and one of the best pieces of analysis ive seen of this election is a piece by j. B. Sherkin is he points out all of these statistical anomalies that somehow joe biden underperformed Hillary Clinton in every major metro say four, those four being milwaukee, philadelphia, atlanta, and detroit. If youre noticing something in common its that those are the four key metros and swing states one of which, as you just noted, was philadelphia where observers were kept a football field away.
