What that possibility is that we may hear from the Supreme Court by the end of the day. How it expects to proceed, whether they will take up the case or not. Now, texas and 18 other states are petitioning the Supreme Court to throw out the results of the election in pennsylvania, georgia, michigan and wisconsin. The attorney attorney general ken paxton arguing the actions of those states and expanding mass mailin balloting harmed texas voters. Listen here. My voters are now disenfranchised in a National Election where other states didnt follow state law. This case, these states had different rules in different counties favoring one candidate over another. We dont know now how credible those mailin ballots were. Paxton was here at the white house for lunch as were the attorneys general of ten other states that have joined texas in that case. It was not expected that the case would have been a topic of conversation today because this meeting was planned long before the Texas Attorney general filed that case. However, because there were all of those attorneys general were here today and the fact that the president joined the case, its likely that that was a big topic of conversation. The president appealing to the Supreme Court yesterday to allow him to join the campaign in a statement saying the president intervened because his rights as a candidate are affected by the states failure to follow election laws during the 2020 election. The attorneys general of alabama and louisiana were also here at the white house as Jeffery Martin and steve landry said about the case. Listen here. When you look at the constitution, you recognize there were states in which nonlegislative actions like governors, secretary of states or state courts basically modified election law in the midst of the game. All weve asked is for only legal ballots to be counted. Texas has a compelling argument why the constitution compels the court to be able to take this case moving forward. Were there to be able to support the fact that this needs to be considered. So what is paxton asking for . Hes asking the Supreme Court to block electors in pennsylvania, georgia, michigan and wisconsin from voting on monday. Thats the day when the electors gather together to determine who the next president of the United States will be. What paxton wants is for the Supreme Court to throw the issue back to the states and let the legislatures in those states decide. Should point out, the legislatures in all four states, the house and the senate are controlled by republicans. Its more than likely if it did go back to the states, they would seek trump electors as opposed to biden electors, which would be something. Bill Jonathan Turley is coming up. John roberts on the north lawn. Right now, an Fda Advisory Panel getting very close to voting on emergency use of the covid vaccine. That panel is in a break. They have about two hours to deliberate. What is your read on this hearing so far, doc . Bill, let me paint the scene for you. This is called the vaccine and related biological products advisory committee. Long name for a bunch of scientists. 23 who are outside the fda. Theyre vaccine scientists. One of you comes from your hometown, by the way. I interviewed three of them. Theyre excellent. Theyve been looking over the data on the Pfizer Vaccine for the last week. Pouring over it, detail by detail. And theyre going to make a recommendation today to the fda. Traditionally, bill, the fda follows that recommendation, which is why we all think we might see an emergency use authorization by the weekend. Now, often times this Panel Advises for full approval. Under these circumstances, its going to be an eua. Bill is off we go. I had a great conversation with the member of the health and hu map services. What he painted for me is the following. Theyre going to have 40 million doses by the end of december, which means 20 million americans will be vaccinated. He believes by june everyone that wants a vaccination will have one. He believes by june 30,000 americans will be sitting in baseball stadiums. Do you buy it . I think that that is on the docket. Thats certainly possible. By the way, i do think that the 20 Million People by the end of the year is a realistic number. Might be january, if i want to quibble. The first dose will be in december. Its a fairly extensive listing. So presumably this congressman made that disclosure and nobody figured out the person or persons he was in contact were spies. If i were advising republicans on the committee or others, i would want to know from the fbi did this congressman disclose every contact that he was supposed to disclose by law in order to get that clearance . They have already received a shipment of syringes needed for this. The hospital purchased special freezers for the vaccine. The Hospital Pharmacy is in the process of building out new pods specifically for administering these vaccines. The old flu vaccine pods no longer work. The Pfizer Vaccine must be distributed in two doses, three weeks apart. New york is giving the Pfizer Vaccine first to those most at risk. Nursing home residents, nursing home staff and high risk healthcare workers. These are emergency room workers, icu staff and Pulmonary Department staff. When the story broke, everybody held their breath. When it started to go to a tax case, there seemed to be some exhaling. You, however, have a very different take on that based on International Tax law. Explain why that could be more precarious. Yeah, its great to be with you always, bill. Look, the thing that people have to keep in mind, theres been a grand jury empanelled to look into his International Business activities. Theyve been working for a while. This is the first hint via hunter biden that theyre looking at financial transactions. They mentioned both issues related to taxes and issues potentially related to Money Laundering. What people have to keep in mind is, governments love to collect taxes. So we have tax treaties with countries around the world. What that means is, if you bring a case about somebody, the level of information sharing is higher than if you were investigating something to public corruption or some other crime. Theres a consensus that they want to minimize tax fraud. So by making this a tax fraud case at least initially, the prosecutors are going to gather up a whole lot more Financial Information from overseas than they would if they were leading with public corruption bill so in summary, the tax laws that are shared among various countries make it easier to share that information is what youre saying, correct . Thats right, bill. Bill so from the tax case, does it jump to a different part of the case . It does. Oftentimes in these instances they begin with the basics, which is paying taxes. The only line that they got al capone on tax fraud. Criminal activity occurs in clusters. I expect the prosecutors and this jury, grand jury, are going to collect this information, that theyre going to gather it, put together a timeline and Money Laundering and this fundamental question that has not been answered, what was hunter biden being paid for. He didnt have a skill set. He department bring capital to any investment deals. What was he being paid for. He was being paid because his father was Vice President and those Foreign Investors or governments were expecting something in return and getting something in return. Look, the reason that we have independent counsels or independent prosecutors is precisely because if you have a scenario like this, a president biden, for example, and he appoints the attorney general and the attorney looking at this case is being hired by those gentlemen, theyre not going to be able to do their job. Theyre going to look over their shoulders. You need and independent counsel and thats where i think this has to go and im hopeful that well get there before january 20th. Four battleground states have responded to a lawsuit filed by texas trying to overturn their election results. What should we expect from the u. S. Supreme court . Bring in fox news contributor, Jonathan Turley. Good day to you, professor. Ive seen some clips. They call it bogus claims on behalf of texas. They say the chance of this happening could be one in a quadrillion. What do you think the u. S. Supreme court does now that this has been reresponded to . Its highly unlikely to be successful. The problem is texas has more baggage than amtrak. A lot of problems the court will be concerned about. Many of the courses rejected these under what is called latches or timing. Why are you raising this now . Why didnt you come to court before the election or just before the Electoral College votes. You want us to negate the certification of a past election. We dont understand why you waited. Second, the Supreme Court defers to state courts and state Supreme Courts on their own laws. They have rejected these claims. The biggest problem is that sticker shock problem. The relief. Theyre asking to effectively negate the certification, and with it the results of the election of many. The justices are probably not inclined to do that. We saw what the pennsylvania case did. It was rejected 40 minutes after the last brief was filed without any dissent. In order for this to prevail, you need five justices, not four. Assuming that chief Justice Roberts wont want anything to do with it, you have to get all five conservatives to sign on. Thats a heavy burden. Bill and the clock is running. The states, texas and the other 17 are challenging the results in georgia, pennsylvania, wisconsin and michigan which would equate to 62 electoral vote. Before they appoint the Electoral College from that state, the electors, they want to kick it back to the state legislature and let them determine that. Thats what theyre asking for here. The case claims that the vote across these states was not uniform. That it varied from county to county. That seems to be the case, does it not . It does. I mean, the thing is this brief raises valid issues. There were illegal orders. There were votes that were not counted. There were errors. Theres great number of issues that we should be concern about going forward. The problem is still the disconnect between those legitimate concerns and the relief being sought. That theyre asking for the certification to be denied. I wrote a column a few weeks ago saying that this was the death star strategy. It takes a shot worthy of Luke Skywalker to blow this process up, to get it back to the state legislatures. Its just not likely to happen. Bill do you think bush v. Gore from 20 years ago is involved in this . There was not a uniform ballot across 67 counties in florida 20 years ago. I do think theres issues that are analogous. What is weird about bush v. Gore, the court didnt want that case to be cited as precedent outside of florida. I thought that was an outrageous part of the opinion. Theres legitimate issues here. We have to be fair to texas and these states. There are concerns about the lack of uniformity and some of these orders. The heavy reliance on mailin voting with changes at the last minute to these rules. Those are valid issues. 90 of republicans believe that this was an election that was not fairly conducted. But there remains the problem with the courts can do about it at this stage. The courts have been very critical over the lack of clear evidence of systemic problems but also the delay in coming to court and coming at this stage on the eve of the Electoral College.
