This is a political exercise. All i am asking of humor is that we treat trump the same way we treated clinton. Senator mcconnell has come up with no good reason why the trial shouldnt have these witnesses or documents. Is a lot of name calling, a lot of partisanship. Lawyers say they are not ruling out impeaching the president again but that the decision depends on what lawmakers would learn from the former white house official. At the last several months, House Democrats have demanded don mcgann testify, the white house has been blocking that and it has been making its way through the courts and in a new filing monday, lawyers argued that his testimony is vital to congressional oversight. This is what the lawyers wrote. If mcganns testimony produced new evidence supporting the conclusion that President Trump committed impeachable offenses, the committee will proceed accordingly. Earlier this month, the judiciary chairman jerry nadler said impeachment was not a one off and not a punishment for bad behavior. Is also unclear what additional impeachment Articles Congress could consider in the future. Meanwhile, the stalemate over last weeks impeachment articles continuous. The house has not yet set impeachment to the senate. House speaker nancy closely says thats because democrats are unsure what kind of trial the senate will conduct and Senate Democrats have been speaking out quite a bit trying to pressure the majority of leaders to allow a new evidence and witnesses being introduced in the senate trial. Imagine a trial not having documents and witnesses. Its going to seem to most of the American People that it is a sham trial. A show trial. Not to get at the facts. They are separately looking for and add additional evidence in which they now say they could potentially bring in either a new article of impeachment or impeach the president all over again depending on what they would be able to get and thats the key theme. Depends on what evidence or documents they would be able to get. At the white house has not yet responded to Chuck Schumer directly or these new document requests for either documents or testimony from those omb officials. This is something Chuck Schumer would like to try and get out of the senate trial in the current impeachment, but that is something we are hearing from the senate. Molly what are the things we are watching right now is the request for the lawyer from the House Judiciary Committee seeking more information specifically regarding that would really like to see testimony from mcgann and he writes if the testimony produces new evidence supporting the conclusion that President Trump committed impeachable offenses that are not covered by the articles approved by the house, the committee will proceed accordingly, including if necessary by considering whether to recommend new articles of impeachment. So are we at a point right now with the American People as they watch all lot of us unfold can expect essentially a rolling impeachment process, potentially more articles of the more documents, more hearings that these two articles being sent to the senate is just the beginning if we even get to that point where it happens . It does raise the prospect that this could drag longer and of course we also know that nancy pelosi has not yet send the other two articles of impeachment over the senate yet so theres a lingering question of when she would do that and how that would affect how a senate trial and whether it would get done in january. At the same time, they havent decided on the rules and procedures that would govern their impeachment trial so we dont know if this is something that would last days, weeks, if its going to carry into february and because it is an election year, there is that question of politics and how this would affect the democratic president ial primary, voting in iowa and New Hampshire starts soon and there are several senators who could find themselves in washington during that time depending on how long this lasts. If you look at the independence and the swing states, voters are turning off to this impeachment, the poll numbers for impeachment have plummeted and since they impeachment inquiry was announced, the president s phone numbers on Approval Rating went up six points so this is tremendous polling for the president , i think going to run impeachment from when the Impeachment Vote occurred within 2448 hours so this is a good place for us as republicans. We met we heard him alluded to that and theres polling to back up what he is saying in the sense that in some of these states that bloomberg is talking about, the president is ahead by five or six or seven points when it comes to impeach or remove or not. This is one of the reasons why Michael Bloomberg might be a more competitive than some of the other individuals that are currently in the democratic field because he is a late entry, he hasnt necessarily been out there in debates talking about impeachment or removing the president like other members like cory booker for example who actually have to vote on impeachment in the United States senate so i actually think bloomberg has a unique opportunity and i do think his super tuesday approach has a smart one because he has the resources. Didnt work for either side of the aisle. We have so many people in their field right now, going to have two different victors i think between iowa and New Hampshire and Michael Bloomberg has enough Resources Available to him to be able to concentrate and get a lot of delegates out of the super tuesday. Leland lets get to the polling in terms of where things stand in iowa and you may be right about a split iowa and New Hampshire. I think this whole field of democrats is a disaster and when you talk about Michael Bloomberg, you cant by election. I understand he has a lot of money and spends a lot of monies. He is using democrat talking points. Leland he did buy the new york mayors race. With bloomberg, he is trying to take a moderate wing of the Democrat Party. I dont believe theres a moderate wing and the Democrat Party today. Furthermore, i dont think bloomberg is a moderate. About a week ago, there was a detention hearing where we did learn a lot about the statement so i question why this is happening at this point because this 13yearold is detained being held at first, they had to put forth evidence to probable cause. And we knew that he gave the statement, we know that he isnt not the killer, and we knew it was ultimately a robbery gone bad so now, they are limiting exposure. Why . I personally believe theres a 14yearold still out there that is not in custody yet. So if they limit it and they dont allow the 14yearold some critical information, it could be used so that police can interrogate and try to get some specifics from the 14yearold that is not in custody yet. Also, it could be because its a juvenile. They could agree that they want to limit the Media Exposure on this case because as a juvenile, a 13yearold and so there could be a couple of reasons. Molly in this case and others, you have could be reading these articles, so someone could be harboring an him and helping him so the idea would be you keep the statement away from those folks so they cant craft their own statement or say the exact same thing, the other kid was the one with a knife, that sort of thing. That 14yearold reportedly was going to turn himself in yesterday and jumped out of the car and police are looking for him they are. So there are a lot of different issues going on, we could also talk about whos going to be charged as an adult and can they be charged as an adult . The 13yearold cant because of his age but the line is 13 or 14. The 13yearold can. He is the stab or which we from the reports that hes the one that actually killed her, that would be the most reasonable person to address is an adult. Molly its really raise a lot of concerns here and said in a statement we are absolutely troubled by the fact that our client, the 13yearold in custody, was questioned and interrogated by police without an attorney present. We must ensure our clients Constitutional Rights are not violated. Weve seen a lot of cases that they try to get a statement thrown out, is that the strategy here . Thats always the first thing i look at is criminal defense cases, did the defendant give a statement . Juries love to convict on the defendant and when people going to be interrogated, they are advised of their miranda rights and when they wave and if its a good waiver, than the prosecutor could just press play. So certainly, the defense attorney could be looking at that but what i look at in that statement you just read as they are saying he should have had an attorney but thats not the legal standard. You dont need an attorney unless someone invokes. For the 13yearold, all the 13yearolds would have to have as a parent or guardian. And im also learning through reports that there was an uncle present. So if they were both were present during an interview and the miranda warnings were properly given and understand the rights, its going to be very difficult for a defense attorney to challenge the statement. Most of the primaries and the Democratic Party are closed, that is an open primary, she is going to get republicans likely voting for her and i think she took that stance and a more political way than necessarily from where she sees the president because she came out yesterday saying that she believed he was unfit for offi office. A new court filing argues democrats still need to hear from former white House Counsel don mcgann and that his testimony could provide evidence that could lead to new articles of impeachment. While democrats and republicans fight over how the senate will conduct its impeachment trial, President Trump appears to be focusing his anger at House Speaker nancy pelosi. Last week said holding off on sending to impeachment articles that were passed by the house over to the senate at least for right now. The thoughts on pelosis decision. He is doing a tremendous disservice to the country, and some people think that she doesnt know what shes doing. In speaking nancy pelosi saying of the house cannot usually impeachment managers until we know what sort of trial the senate will conduct. Meanwhile, lawyers for the House Judiciary Committee say they are not ruling out a second impeachment case to give the president. For several months now, House Democrats have demanded former white House Counsel don mcgann testify. The white house has been blocking that, the issues making its way through the court and then a filing monday, judiciary lawyers said depending on what they learn a future impeachment case against the president as possible. It certainly does, democrats have been wanting to hear from don mcgann, the former white House Counselor to the president , his lawyer for quite some time especially during the mueller report, factored as a central figure when the president was seeking to fire him, gave the order to don mcgann and actually refuse to carry that out so there are certainly questions and of course weve been wanting to hear from don mcgann for some time. Leland the president works best when he has a foil, he loves using nancy pelosi as a foil and she just gave him another couple of weeks to do it. First of all, she has no leverage. The speaker cannot order the senate to do anything procedurally or otherwise with regard to a trial. Leland does this move of trying to call mcgann give her more local room to pivot and say we need to see for is on the articles up . Of anything, its an indictment on the terrible job both committees of the house did in rushing to an Impeachment Vote. Why didnt they subpoena mcgann . We tried many times. You voted for impeachment, you decided you were going to get the president for obstruction of congress for using his constitutional protections of executive privilege. You guys missed the boat and giving the president every opportunity to defend himself. He decided not to. You know that. Leland reasonable people can agree or disagree but the facts remain the same at the House Committees chose not to litigate in the Court Subpoenas for mcgann or for Mick Mulvaney or even for john bolton. That was a political decision on democrats part, was it not . It absolutely was, the processor problem was that the timing it takes. Leland i appreciate the candor, it was a political decision. So youve already impeached him in the house, why come back again and say now that weve set impeachment up but we are not truly like how things are going to go on the senate, never going to to try to impeach him again . I dont categorize this as a plan b, this is a separate effort by the Judiciary Committee to still hear from don mcgann. This is separate from the two articles of impeachment that were passed by the house. Absolutely. This process hasnt gone away in the house trying to get testimony from don mcgann. That process is still playing out separate from the impeachment articles. Leland i will give you the last word on that. Mitch mcconnell said he doesnt care if he ever gets the articles of impeachment. You guys can sit on it all you want but the American People know whats playing out here and you cant hate a president out of office, youve got to elect him out of office and thats up to the people. We will give the last word to Stephanie Grisham and we will go ahead and get your reaction. It continues to be a crazy sham, it continues to be something i dont think any of us understand. The great thing about this whole thing is when nancy pelosi goes low, our poll numbers keep going high, so thats a fantastic thing. I think the people that are leading this crazy effort, nancy pelosi and schumer are going to go down in history as the people who weaponized impeachment and this is going to go on for years and years to come. Other president s can now get impeached over policy disputes. Leland the president said my poll numbers have never been higher and ive never raised more money for myself or the republicans, is this a gift to the republicans . It could be, they are raising a ton of money out of this process, no question but i think when it comes to constitutional questions and providing evidence, thats what needs to happen, we just saw the other day one email the day of that infamous call with the director from the oval office saying to stop these so clearly the evidence needs to come out and we need to see that fair process play out in the senate. Leland you have the last word on this, this from the wall street journal hearkening back to democrats electing bill clinton in 1992 and then how they dealt with impeachment. The headline is this, decades later, my fellow democrats treated mitt character counts. We mock evangelical christians who backed trump but we made the same mistake in 1992. Here is the editorial from the oped, we were foolish to put aside our concerns about his personal morality to further a political interest. As what voters have done in supporting mr. Trump. As we work to remove mr. Trump who has done so much to injure the presidency, we should have the character to admit that we were wrong about character. Democrats so lowered the bar, there wasnt any constitutional standard anymore. These arent high crimes or misdemeanors, these are grievances against the president and political grievances at that. Not criminal or transgressions of the constitution, they will rue the day they ever attempted this. We dont elect popes in america, these are people just like us, they have great character and they also have flaws. In every american stands in the same shoes as our president. At some time in their life. And thats a part of an elected official in a secular society. In leland i will pose that question to kevin, in the sense that if the president is not charged with a crime which so far he has not been by the house, been told he committed bad acts but no statute that he has alleged to have violated in the articles of impeachment, do you end up with any kind of fear that democrats have now lowered the bar for impeachment and will circle all the way back to the beginning of this segment and that is the reason to go after don mcgann for testimony . I dont think the democrats have lowered the bar, it was already lowered in 1999 when republicans impeach the president for lying about a personal indiscretion under oath. Of course, highly suspected for having committed the murder because there are so many other facts. She had a baby registry, she was faking that she was having a baby and she was actually in the Hospital Holding her hand while she was delivering the baby. It was really amazing, so i know have no other accomplices because thats often the case in situations like that, you can expect these charges are going to be upgraded to murder charges once they thought eyes and cross tees. Molly what is it say about it being in such close prospect oproximityto the suspect . There wasnt any kind of force being used, they took that vehicle, brought her in the vehicle, strangled her, look at your wounds like at her house and her home in the trunk is the body of a deceased person. Obviously very strong evidence which is the most important thing, they had that vehicle in the location of where she disappeared, thats a huge fact. Molly we are talking about this young mother, has a 6yearold son i know she has this infant daughter just a few weeks after giving birth, she is in a particularly vulnerable situation, physically still recovering and here we have the suspect is a close friend, so would that mean she might have been unawares of his potential plot . Not suspicious at all, someone youve known for so long. This is something theyre going to take into consideration when youre looking at the decision on whether she should be charged with murder because she was vulnerable, because there was a friendship that was there, she took advantage of her, plot of this were a significant period of time, these are all advocating factors that would lead towards higher charges and higher sentencing. Molly so that will be big. And also eliminates the defense for provocation or insanity because she clearly knew what she was doing because she did it for such a significant period of time and that goes against any legitimate defense psychiatrically so she is bad trouble with that in the case. Molly we are seeing them come forward literally suffering here but weve gotten word that the baby who appears to be back with the family, a question that we are going t to do a dna test. On the resiliency of murder victims and their other families, how they respond to this, obviously a huge thing but its really interesting in my career to see which families are able to overcome this and those that arent and go down a really dark place. Obviously a dark space right now, baby being brought back is great, interesting help during this Holiday Season they would be some peace and resolution somewhere down the line and hopefully the criminal Justice System will be able to offer some justice in this case.
