Sometimes people make that report because they were involved in a drug deal and got robbed and they didnt want to tell the true circumstances of why they were where they work or why they were in the situation they were in. This was a completely made up of event it seems. That is what the evidence seems to prove. And a total waste of resources. As well as undermining legitimate victims. You know, im afraid this can have a chilling event on real victims who will maybe not want to come forward for fear that they might not be believed, due to this credibility being taken away from this event. I think we had 20 homicides in january in chicago, and certainly the Chicago Police could have been spending time trying to find those people responsible and not wasting resources in this investigation. However, to their credit, i think mr. Smollett thought he could have made this report, and they wouldnt take it seriously. These detectives did exactly what they needed to do. They followed the truth, follow the evidence, and found out that this seems to be an elaborate hoax. Sandra two of them have released a statement saying that they will actively fight these charges. Finding video people dropping them off. All of the physical evidence. They have videotape of the brothers purchasing the rope and the bleach. They did that without adequate and appropriate levels of journalistic integrity and reporting. And that in and of itself is malicious. So i feel comfortable with either standard. Bill a couple more quick questions. I will play a little bit more of what we are picking up, as i am sure you are quite familiar. Retracting an apology, the story within ten days. If that is the case, does that make your lawsuit moot western mark well, i dont think that they can ever adequately retract because of this reputational damages . They can try, and they do have ten days to do that, but ultimately, the jury will decide whether the retraction is adequate, so they have a mountain of retraction to try to put forward. Bill so the measure of the retraction, that is what i am hearing from you. As i correct . Thats correct. If you destroy somebodys reputation on the front page, you cant go to the b section and put it on the back page and say were sorry. Bill so the archdiocese apologized. Do you drop the case against them or not . No. The diocese of covington squeezed a half apology halfway into a paragraph. That apology is not at all related or similar in size to the damage that their statement did. The diocese of covington statement was used nationally and internationally as a truthful statement, and the person who repeats that statement, they are both liable. Good morning, police say that he arranged to turn himself in at 5 00 local this morning with the presence of his attorneys, away from cameras. We are told it happened without incident. We are expecting to see Jussie Smolletts mug shot for the first time. Set to begin at any time. Police tell us that for now, Jussie Smollett is represented by at least three attorneys, including mark geragos. Throughout the beginning of the investigation, he initially cooperated, but then these two brothers give some type of testimony that dramatically altered the course of their investigation. Last saturday, the Police Superintendent submitted a request for a followup interview with Jussie Smollett. Our understanding is that he never responded to that followup interview request, so police took their case to a grand jury here in chicago, where they got the charge approved, and the ability to arrest Jussie Smollett. He turned himself in this morning. Any moment, we expect to hear from the Police Superintendent. We expect to get more details about the investigation, and Jussie Smolletts arrest. Bill we will be back with you in a moment here in chicago. Sandra for more on all of this, lets bring in judge andrew napolitano, judicial analyst. Good morning to you. What strikes you this morning as we learned that he turned himself in . Now we are about to get an update from the police. A couple of observations. I wonder if he really did this, and the evidence points this way, what he told his lawyers. They have put on the public face that he didnt do it, he didnt do it, but the truth is going to come out. They had an opportunity to negotiate a deal for him. In my view, a small window of time, about six or seven days ago, in which they could have negotiated some sort of plea without incarceration. It appears his lies, restated by the lawyers, causing the Chicago Police, you should hear how much money they spent on this. They spent a fortune. Person power and resources, they have close the window in which they can make a deal. The other interesting issue is, another prosecution which may happen, the federal government. A female that threatening letter to himself, by using the post office, he engaged in postal fraud. Thats 510 years in jail. Thats three times what he is facing for filing a false repor report. Bill thats the more serious matter. We will hear from police in a moment. Well, this afternoon, i think he will plead not guilty and be released either on his own recognizance or with a very small bill. I dont think he is a very delicate threat to society. They may ask them to surrender his passport just to be sure. Bill so this afternoon, a plea and posting bond. Correct. If there is bond. It could be a simple signature promised to return. It is hard for him to go anywhere without a meet without anybody knowing. Sandra we know that he did speak to police several times. He did speak to police. He also spoke and several interviews. He maintained his story throughout. Can those words be used against him . Yes, sandra. That is a very important question you have just asked. Each time he lied, its a separate and distinct offense. If prosecutors want to frame it that way. Filing the false report is an offense. Lying to them to back it up. The first time he met with them, the second offense, lying to them to back it up the second time he met with them. So sometimes they merge those into one charge. If they really want to get aggressive with him, they can file. They can approve several charges against him. That will span his exposure in jail, give police more negotiating latitude. Bill just characterizes for us. When you think about the National Attention brought to the case, the charge of racism and the politics brought into i it, does the judge way those factors . Given the amount of a national i hope not. It sickened me that the president was drawn into this, that the maga stuff was drawn into this. A lot of people said we are a racist society. This is an example of it. Bill you said you hope not not. I am asking does the judge have to consider some of those in the case now . Under the law, the judge sentence is the defendant and the crime and not the events around him. So i dont think the judge will take that into consideration. Sandra think about the amount of crimes of the city of chicago faces, the amount of resources that were taken away and poured into this investigation for a month, judge. That is a very legitimate argument for them pursuing him aggressively. Bill Daniel Linskey with us in washington. Boston marathon bomber, he was on the case. What do you expect when they start taking questions . I think we will see them lay out the case. They made a unique step of presenting it to a grand jury. It has been explained to people outside of the Law Enforcement practice. They have determined that it is enough to bring a charge. I think they will lay out the evidence and probably see the defense continue on where they are going to try and attack the credibility of the witnesses who have come forward and given statements contrary to mr. Smollett statement. At that is the defense that they can mount, depending on how much evidence they have, they may change that strategy later on and not go to trial, but i believe as they go to trial, they will try to undermine the credibility of any evidence that was brought in against end. Sandra there has been a lot of activity in this case, including some pretty lengthy Police Interviews we heard about involving the brothers. A search of the home, and they are released after officers cleared them. We know that at this point, the brothers words that could be used against him. Any evidence that they found in the house that this was premeditated on his part . So how will all of that be used . All of that evidence we brought him, if the brothers made incriminating statements that they were involved in this, and they did and falsely reported. They participated the allegations are that they participated in putting on this mock theater to make it look like this was an actual attack. That in and of itself may not be criminal. Once they allowed it, knowing that it became a false Police Report, if they had continued it, that is where they had similar criminal exposure. All of that evidence, they have implicated themselves, if there is physical evidence that relates to this attack, communications, planning preparation, that ties smollett to this, all of that will be entered into the trial process effectively and efficiently. Bill it was reported over the weekend, fox 32 in chicago do some great reporting. All of the locals have been the leader on the story from the very beginning. They reported that there was a receipt from ace hardware where they bought the rope to make the news. I think the other critical factor is the phone because it has been reported that he was reluctant to turn his phone over because he had contacts on there that he did not want to share, et cetera. I would imagine in the scenario that he has reached at this point, the phone is a big part of it. I would think so, and if the phone is tampered with, they have another charge. They have had to have gotten a warrant for that phone, especially because he is in custody. Sandra i wonder if we have a come of the statement that his legal team put out. Here is where they stand this morning. Like any other citizen, mr. Smollett enjoys the presumption of innocence, particularly when there has been an investigation like this one where information, both true and false, has been repeatedly leaked. Given these circumstances, we intend to conduct a thorough investigation and to mount an aggressive defense. Judge, how can you it is hard to say what it would be. I didnt do it, it somebody else. It could be temporary insanity, some sort of a mental block. He didnt know right from wrong. Very difficult offense to mount. I can tell you this, by hiring mark geragos, we all know mark geragos. This is one of the most successful, tenacious, on his feet criminal and expensive criminal defense lawyers on the country. Usually you dont hire him to work out a settlement. You hire him to persuade a jury you didnt do anything. Criminals. So we will wait to see on that one. Bill Daniel Linskey, what do you think is important here in a moment with regard to evidence and the developments that we have watched now . I think it will be important for the superintendent to lay out the evidence, so we get a sense of exactly what happened here. I also think it is important for the superintendent to communicate with victims who may be reluctant to come forward, who may not be sharing their sexuality with their family members. Victims of assault you may not want to come forward and make reports. We encourage legitimate victims to report to Law Enforcement, so that we can hold people accountable when these things are real. The big challenge here is the undermining that this event did to you legitimate victims in our country. Sandra very important point to make there. As we await this, should be starting any moment now. Chicago time, 5 30 this morning. There it is, judge. As we await this News Conference, the charge is Disorderly Conduct. Class four felony, lowest felony classification. What more can you tell us about what he is facing here . I dont know if he has any wires. I am going to guess he doesnt. If he did, i think they would have revealed that. So a firsttime offender facing a low level what is called an Illinois Class for felony. Ordinarily, would not be a candidate for incarceration. Sandra we just got a heads up that the police have entered the room. The Chicago Police department will start their News Conference here any moment now on Jussie Smollett. He surrendered at 6 30 a. M. Eastern time this morning. We now await an update from the police. Bill there was some reporting good morning everyone. Bill we will go into that next. As i look out into the crowd, i just wish that the families of gun violence in the city got this much attention. Because thats who really deserves the amount of attention that we have given to this particular incident. But this morning, i come to you not only is the superintendent of the Chicago Police department, but also as a black man who spent his entire life living in the city of chicago. I know the racial divide that exists here. I know how hard it has been for our city and our nation to come together. I also know the disparities, and i know the history. This announcement today recognizes that empire actor, Jussie Smollett, took advantage of the pain and anger of racism to promote his career. I am left hanging my head and asking why . Why would anyone, especially an africanamerican man, use the symbolism of a news, to make fae accusations . How could someone look at the hatred and suffering associated with that symbol, and see an opportunity to manipulate that symbol to further his own public profile . How can an individual who has been embraced by the city of chicago turn around and slap everyone in this city in the face by making these false charges . Bogus Police Reports cause real harm. They do harm to every legitimate victim who is in need of support by police and investigators as well as the citizens of the city. Chicago hosts one of the largest pride parades and the world, and we are proud of that. As a Police Department and also as a city. We do not, nor will we ever tolerate hate in our city, whether that hate is based on an individuals sexual orientation, race, or anything else. So im offended by whats happened, and im also angry. I love the city of chicago. And the Chicago Police department. But this publicity stunt was a scar that chicago did and earn and certainly didnt deserve. To make things worse, the accusations within this phony attack received National Attention for weeks. Celebrities, news commentators, and even president ial candidates weighed in on something that was choreographed by an actor. First, smollett attempted to gain a port by sending a false letter that relied on homophobic and political language. When that didnt work, smollett paid a 3500 to stage this attack and drag chicagos reputation through the mud in the process. Why . The stunt was orchestrated by smollett because he was dissatisfied with his salary. So he concocted a story about being attacked. Now our city has problems. We know that. We have problems that have affected people from all walks of life. And we know that. But to put the National Spotlight on chicago for something that is both egregious and untrue is simply shameful. I am also concerned about what this means moving forward for hate crimes. Now of course, the Chicago Police department will continue to investigate all reports of these types of events with the same amount of vigor that we did with this one. My concern is that hate crimes while not publicly be met with the level of skepticism that previously didnt happen. That said, smollett was treated as a victim throughout this investigation until we received evidence that let us in another direction. I couldnt be more proud of the detective work that went into this investigation. I couldnt be more proud of every investigator that played a part. The detective work that we saw in this case is indicative of the work that our detectives do every day in the city. This case in particular and involves hours video evidence, which when combined with old Fashion Police work, uncover the truth. These detectives deserve all the credit in the world, from carefully analyzing the lease, and the evidence for weeks. I would also like to think the fbi for their help in this investigation. The fbis partnership with cpd has been pivotal in this particular case. I only hope that the truth about what happened receives the same amount of attention that the hoax did. I continue to pray for this troubled young man, who resorted to both drastic and illegal tactics to gain attention. I will also continue to pray for our city, asking that we can move forward from this and begin to heal. Now i would like to call up the commander, who personally led to this patient and deliberate investigation, to walk everyone through how the Police Department arrived at this point. Good morning, everyone. I am the commander of the area central detective division. I am here to answer questions. Okay, the boss just corrected me. Please forgive me. I am supposed to go through the timeline of our investigation. Okay. [laughs] so, heres where we are. As you all know, the Early Morning of february 29th at 2 00 in the morning, Jussie Smollett reported that he was a victim oa hate crime. Detectives responded to the incident and interviewed him eventually at northwestern hospital, where he reported to us that the two offenders yelled racial and homophobic and political statements on him. And beat him, put noose around his neck, through bleach on him, and fled from the area. We learned at the time, that jussie was not hurt, other than some scratches, some bruises. No broken ribs or anything. We started out fullscale investigation into this hate crime, very serious crime anywhere. We quickly found two persons of interest on video that we believed were the likely offenders in this case. We initially put out a seeking to identify, and we got this out in a community alert. We then started searching the area for video cameras and witnesses that could help us with our investigation. During that time frame, we interviewed over 100 individuals in a canvas of the area, and a followup canvas as our investigation expended. We located approximately 35 of our Chicago Police pod cameras and the area, and in the areas that we determined these two persons of interest fled. We additionally found over 20 private sector cameras. And ive got to say that was super useful in this investigation. The city came together to investigate and help the police with this crime. It was because of these pod cameras, our investment into technology in the city of chicago, and the great assistance from the community and giving us those of a cameras, that allowed us to a really solid timeline of where our two persons of interest one. So in short, we are able to track them. Initially forward, so after the crime, we are able to see that they fled in a particular direction and eventually got into a cab. It are investigators located that cab, interview the cabdriver, got some video out of the cab. Followed that cab, using all of these surveillance cameras that are located throughout the city. The pod cameras, to an area up on the north side, where they abruptly stopped by cab, got out, and walked on foot. Again, the Community Came together to provide us with security footage from their private cameras. So at that point, we then started tracking these two persons of interest backwards. Backwards to where they came from. So we followed them walking around, and followed them back to where they had gotten out of the cab. We had to interview them, and we saw video. We continue to track that cab back to the point where the cab was tracked down by our two persons of interest in our rideshare car. We then followed up on the rideshare, and that was the lead that we needed in order to identify the two persons of interest. At that point, we had a real good timeline of where these two people went. We were able to put a name to both of these individuals. And it was at that time that we started looking at where they went, right after this event. We track them to going to Ohare Airport and it jumping on a flight to nigeria. Our investigation led us to determine that they had purchased a roundtrip ticket with them returning to chicago on the 13th. So approximately two weeks after the incident. So that gave us a couple of weeks to try to follow up on any Investigative Leads. Any Investigative Lead that would help us try to determine what happens in this incident. So while we were waiting for them to return, we executed we executed over 50 search warrants and subpoenas. Working with our partners in the States Attorneys Office. Phone records, social media records, and records on individuals to help us illuminate the likely facts that occurred in this event. So moving forward to the 13th, we had a team in place working with the fbi, customs, and our partners out at the airport. Airport police helped us tremendously. And we were able to locate and identify these two individuals, these two persons of interest, when they entered back into the country, and the country at customs. We took them into custody. We read them their rights, and they both initially asked for an attorney. They were brought to area central detective headquarters, so that we could process them. And it was at that time that they are attorney shut up. I think youve all seen her on the news the last couple of day days. And after speaking with these two people of interest, she sobbed up something smells fish fishy. She did not think that they were the offenders as reported. She worked with us very, very closely to get to the point where she came to me and said you really need to talk to these guys. Im going to allow them to give you a video interview with us present, and we are going to have you hear their story. They are not offenders. They are victims. It was at that time that this investigation started to spin in a completely new direction. Youve heard some of the statements that their lawyer, ms. Schmidt, has made, and it was at that time, that we took the information that these two individuals provided to us, and we substantiated the timeline and the details that they gave to us in this interview. We were able to substantiate those things. We worked very, very closely with the states attorneys offic office. We have been working very, very closely with the States Attorneys Office for over a week at that point. But it was that on the 15th, friday the 15th, after approximately 47 hours of them being in custody, and hours of them meeting with us and telling us their story and documenting their story, did we release them without charging. And i classified them no longer as suspects or persons of interest, and as witnesses. So as is typical with any investigation, one would typically lock these witnesses into a grand jury statement. Monday was a holiday, the 18th. Tuesday was the first day that we could attempt to do that. So we scheduled an appointment with the grand jury, working again very closely with the States Attorneys Office in this. And as you know, at the last minute, jussies lawyers called and said that they had evidence to postpone the grand jury, that they wanted to provide to us. It was at that time that they called us, and i met with them, with the team of our detectives. Essentially, they gave us no new information. So i reported that back to the States Attorneys Office. It was at that time that we locked in both of these witnesses to the grand jury. Im told they did an excellent job, and is on the States Attorneys Office approved charges against jussie for the class for Disorderly Conduct false Police Report. We met with jussies attorney, and we arranged for him to turn himself in. And as you all know, he turned himself in at 5 00 this morning in the First District in chicag chicago. Today, at 1 30, jussie will be going in front of the bond court judge. The bond Court Hearing will be heard at 26th and california. Again. He turned himself in this morning . It was uneventful. He showed up of course with his attorneys and a couple other individuals. Why take it to a grand jury . Because that is typically what we do. Valuable witnesses, we take them to the grand jury to lock their testimony end. You said that he sensed the false letter to himself. He was dissatisfied with his salary. Did you get that information from yes. A number of individuals. We served subpoenas and warrants of course on mr. Smollett. His manager, the phone records, the two people of interest that we had. We still have several subpoenas out there that we are waiting o on. You talked about the detectives and the amount of resources, manhours, and detectives working. Full resources from shooting and homicide investigations. Basically working on different teams. Things of that nature. We dont have the exact numbers yet, but any time a hate crime is reported in the city of chicago, it gets the same attention. This didnt get any special attention. You obviously pay more attention specifically. We give every hate crime the same amount of vigor. I said it from the very beginning. I have lived in the city of chicago my entire life. We just dont have any room for hatred in this city. For somebody to use it for personal gain is just shameful. What it does is take away their resources that we could be putting into other crimes. Could the brothers be implicated for sending the letter . We have yet to comment on that. Told the media how much jussie you know, jussie orchestrated the attack, and was there any evidence . Yeah, we have evidence. The check that he used to pay them. The 3500 was for the two of them in total. Was there an attack on the street, or where did it take place . No, it took place right there. So of course, it was staged. The brothers punched him a little bit. As far as we can talk, the scratches and bruising that you saw on his face was most likely selfinflicted. How did the detectives react when they found out about the motive . Let me reiterate again, you will heard me say consistently that we were treating smollett like a victim, and we did. Might have had some peculiarities with the case, as we do with most cases. So it wasnt until the 47th hour that it took a change. So we give him the benefit of the doubt up until that 47th hour. But when we discover the actual motive, quite frankly, it pissed everybody off. We have to invest valuable resources. When you all put things out there into the universe that is not actual facts, then it causes us to have to chase all that stuff down. Those are resources and time spent that we will never get back, that we can use for another investigation. Let me be clear about something. The shootings and homicides were not impacted at all by this particular investigation. We give the same amount of resources to every hate crime that is reported. Do they know where their cameras were . I think that they knew where one was, but they did not catch all of them. Unfortunately, that particular camera it wasnt , are they looking at smolletts manager . No, not at this time. He was on the phone, but whether or not he knew it was a ruse, we cannot say. Are you interviewing him . At some point, we will. How did you take that when people started talking negatively about the Police Department . It was upsetting. I want yall to realize this. So weve been working on this for about three weeks. We saw double shootings and homicides in that period of time, so we dont take away resources from Violent Crimes of that nature because this person is a celebrity. Again, you all give us a lot more attention than it probably deserves. The shooting victims, the families who are victims, give them the same amount of attention. This should not have garnered the attention that it did, but it did because it is a celebrit celebrity. If that was the case, why are they not being charge . Should they be charged . So, mr. So we need to put the case together. These things take time. This isnt tv. This is real life. So it takes time. There were a lot of leaks in that case. Who is to say that the leaks came from us . Just because they are leaks, it doesnt necessarily mean that it came from cpd. I heard particular things that were out that i knew. It doesnt mean that it came from the Police Department. Do you have Text Messages or other exchanges between the brothers and jussie . We have the phone records that clearly indicate that they talk to each other quite a bit before the incident, after the incident, and while they were out of the country. The brothers, you mean . The phone records. Yes. Yes. Made contact with the brothers right after the attack . Do you mean moments afterwards . Yeah, i just said. We know that they talked at least an hour or so before the attack, an hour or so after the attack it, and when they were out of the country. Any other people to stage the attack, or where the brothers the only ones . The first rise . We do not have any evidence to suggest that. Why did you say that the brothers may be victims in this . What did he mean by that . Speak about the brothers may be victims. Speak out where they coursed somehow or manipulated . How would you describe that . I think the fact that this was staged and that jussie hired these two guys to stage this for his benefit, and then spin this into a criminal investigation, put them in a really tough spot as well. To the point where now they were arrested for i hate crime, and only because of just the incredible work by the entire team, did we get to the point where we are able to get the truth from them, and now we are where we are today. Why did smollett hire these two brothers . He describes their relationship, how close they were. So one of the brothers worked on empire. So they had a relationship, and association. He probably knew that he needed somebody with some bulk. They had a previous relationship. That is probably why he chose them. He chose to do the interview on Good Morning America. I didnt see it. I didnt see the entire thing. I saw a couple of parts of it. To be quite honest, it is shameful. You know, it painted the city that we all love and work hard and in a negative connotation. You know, to insinuate and to stage a hate crime of that nature, when he knew as a celebrity it would get a lot of attention. Its just despicable. It makes you wonder whats going through someones mind to do Something Like that. So yeah, i saw a couple of parts of it. And i was angered by it, to be quite honest. The rideshare to the crime, like a regular yellow cab afterwards . The rideshare, it has your identity, did that help . That certainly helps. The account information really pinpointed who they were. Whos to say whether or not . Let me tell you this. These individuals standing behind me, the detectives in chicago, they are probably some of the best detectives in the country. So i have no doubt that they would have gotten to the bottom of this. Is that thats last call. When did you all figure out that something doesnt add up . Will, to be perfectly honest, from the very beginning, we had some questions about it. But as i said, we gave mr. Smollett the benefit of the doubt all the way up until that 47th hour of the 48 hours that we were holding those two. Because we just didnt have the total package of support that it was a folks. So when we said we are treating him like a victim, that was the truth because at the time, that is what he was. Anybody who reports a crime deserves the Chicago Police department to treat them like that until we have solid evidence to prove otherwise. Anything else that made them do this . Why they agreed to do it, and what they thought the outcome would be. They did it because of the financial aspect. Now whether or not they knew the whole thing would go the way that it did, i can tell you all with 100 certainty, the way that they carried this out, there was never a thought in their minds that we would be able to track them down. These detectives put an intense work. I cannot say how incredibly proud i am of them for the work that they put into it. That is just an example of the work that they do every day that just goes unreported because it doesnt get the Media Attention that this particular case got. It was financial gain. Did Good Morning America play any role . He identified to the two individuals were. He didnt know that we know. But yeah, he helped us out when he identified them. How did you identify the brothers . When did you realize their names and who they were . That was after the rideshare account. The one piece of evidence, that was not found, it is not on camera. That was the one piece. While, at the 47th hours when the two brothers decided, like the commander reiterated, with the help of their lawyer, they decided to confess to the entirety of what the plot was.
