donald trump topping this new poll. jeb bush is second and scott walker is third. just outside the top third carly fiorina and rick santorum. bill: chris stirewalt is with us. you call this trump-nado and it's ripping through the republican field. >> every candidate except scott walker, they are all taking a beating. i guess would have to say marco rubio and john kasich are competing with jeb bush in a different lane. but everybody else has taken a beating. bill: how do you think that plays out then, chris? >> if you are jeb bush, your job is to be above it all. if donald trump attacks you you have to have something to say. for everybody else they have to make a decision. do you run and hide from the trump-nado, do you say you are fired, i don't like you or your hair. new polling suggests john kasich will be on the stage with trump and you know what he likes to do? fight, fight fight. that's one matchup i will be looking forward to seeing. bill: jeb bush garners 15 per are, he's the -- 15%. he's the only other republican with double digits. the better trump does the better for jeb bush. if things get crazy and donald trump looks like he's careening and will bring the establishment down i think chris christie does worse in one important metric which is we would never support. there is a third of the republican party who says we'll do anything but support donald trump. those are potential jeb bush voters. they could flee to him. bill: support for hillary clinton remains high despite sliding to its lowest yet. what do you see with her? >> what i see is joe biden the vice president of these united states of america licking his notable chops saying this is somebody i could beat. and i'm starting to think maybe he could. hillary clinton has all the money. she is up 26 points in iowa. she isg running ads against poor bernie sanders. i think joe binder has got to be thinking he can do this. bill: chris stirewalt from cleveland, ohio. heather: 14 of the 17 gop contenders taking part in a forum in new hampshire. molly, what are some of the highlights from last night? >> there were 14 candidate in this latest cattle call. there were even several senators that participated via satellite. one of the things candidates were asked about is planned parenthood. they agreed it should be defunded. the candidates didn't have a lot of opportunity to interact with one another but there were tough punches thrown like this one from senator behind say graham going after the clintons. >> i'm fluent in clinton speak. when bill clinton said he didn't have sex with that woman he did. when she says i'll tell you about bill in the pipeline she won't. when she says trust me, you have got all the emails you need, we haven't even scratched the surface. >> reporter: there was a follow-up segment where they were given 30 seconds to talk about who they were and who their platforms would be. >> what were some of the big issues they addressed? and why? this is not a political issue for americans this was at cover who are we? and what are we going allow. i thought george will's column says nobody is calling for the end of abortion rights, what we are saying this this particular procedure should not be aloud and if planned parenthood is going to par is fate the rest of america should not have to support sit with tax dollars. bill: george will said planned parenthood is barbaric. >> there is a new "wall street journal" nbc poll that has the clinton team pretty worried. her unfavorable numbers with white women and white married women have gone down dramatically. there are warning signs in this poll pushing her team to get out soon were than they would like. it's difficult to take tun favorable numbers and make them favorable. if you have listen to her in that video where she is saying there is a republican war on women. there is not enemy passion in her voice. she is just going through the motions. i think the democrats are look at this saying it's going to be a throng year to get her across the finish line. bill: you say it's difficult to reverse the numbers. it goes to honesty and trustworthiness? is that what you are suggesting. >> i learned every presidential election is about character and judgment. if you are not trusted and liked and you say things you maybe cheat or lie. all of that goes to our unfavorability. that's why you see some of her new ads saying this is who i am. this is my background. her mother is quite an amazing woman, but we are not voting for her mother. we are voting for hillary clinton. and it's interesting she still has to reseason produce herself to america. bill: once the impressions from created on behalf of the vote sister they are tbhaikd and hard to change. >> she'll are money and effort, but when you start looking at white married women you are thinking we have to win more white married women than romney did and if they are numbers are bad with them at this point they have might have an opening. bill: what did you have think from a communications standpoint how planned parenthood reacted? >> abysmal. sometimes a spokesperson, you can't change the facts. the facts are horrible. they get back on their feet when they go to a democratic-leaning p.r. firm and all after sudden you have things turn around and everyone on the liberal sidewalking in lock step including hillary clinton who changed her minds in a week. last week she is disturbed and called for a national investigation. this time she says there is a republican problem. bill: the manhunt ending for the ex-con accused of killing a police officer. why the suspect turned himself in. >> we have always been one step behind him. i think he thought it was in his best interests to turn himself in. and ones you never thought you'd make. we help connect where you are. to places you never thought you'd go. this, is why we travel. and why we continue to create new technology to connect you to the people and places that matter. bill: this mess shutting down traffic. no word on what caused that sinkhole in brooklyn. heather: a new survey shows obamacare remains deeply unpopular with obamacare. now joining us from our sister network, gerri willis. thank you for joining us. do these numbers surprise you? >> reporter: yes actually. would you think people happy with obamacare would be people getting the free healthcare. people are say they are not happy with this program. let me give a couple other numbers. 25% say they are confident they can get care when they need it. only 25%. that's shock. 16% financially confident they will be handle financial difficulties for healthcare down the pike. that's shocking, too because they are getting subsidies to pay for this. surprising the level of dissatisfaction but it tracks some national polls on obamacare nationally. last week in a rasmussen survey 53% said they do not like this program. heather: medicare-medicaid there are people more satisfied with that than obamacare. >> reporter: and you know how unhappy people are with medicare medicaid. i have to tell you one of the big drum beats in the background people are so upset about rising costs. the premiums people pay on obamacare are through the roof. and it pushed up costs for people generally who aren't on obamacare. if you get your healthcare through your employer your costs are increasing every year. heat require's a new system. are these structural problems that will last? >> reporter: remember how the website never worked? people 340 who wanted to sign up who couldn't sign up because they couldn't get on the website. so some of these things are embeded in this program. i think the satisfaction will continue. bill: a suspect accused of gunning down a college student while he sat defenseless inside his own car. heather: new white house regulations to combat climate change. is it an overreach for the administration. >> reporter: the president is going to destroy people in this country economically if he continues down this path of take our american energy away from us. bill: an arraignment in new jersey for a man on terror charge. brown telling police was retaliation for american actions in the middle east. rick leventhal is outside the courthouse. rick what's happening there now? >> reporter: ali mohammed brown is the first to be charged with terrorism under state law. as you mentioned he's charged with a fatal shooting of 19-year-old brendan templin. he just finished his freshman year at the university of richmond and was home for the summer. he admitted his crimes to investigators. he said he believes his actions were justified in retaliation for the u.s. government's actions in iraq, syria and afghanistan. he faces carjacking and weapons offenses. brendan tevlin's parents are in court for the arraignment. when authorities arrested him he told them he was even ghaingd jihad and his goal he said was to go to iraq or syria and try to kill people who were trying to kill muslims. a source close to the investigation told me he did in fact want to travel there. other investigations reveal brown may have gone to one of the first terrorist training cams in oregon and had ties to a disrupted terror cell. back on june 2014, authorities say brown shot two men execution style. a month earlier april 27 he's suspected of guns down another man just south of seattle. ali mohammed brown is also a registered sex offender. he was living in a makeshift camp in the wood. he unless court this morning and will be arraigned on those charges. bill: rick, thank you headlines when we get them. heather: a ringleader in the benghazi attack is challenging his detention. they are asking a judge to send him back to libya. they say his arrest there violated the u.s. constitution. did his detainment violate international law and the u.s. constitution? >> certainly not. he's lucky to be alive. he's believed to be the ringleader on the attack on the consulate in benghazi. we would have been entirely justified as we are in the war dense terror generally to have destroyed him and his band of terrorists. what the lawyers are complaining about here is that he was held on a navy ship for less than two weeks and interrogated boulevard he was raid miranda rights and put in jail in the united states. this is the obama administration's hybrid policy that try to the marry criminal law with the law of war. the lawyers are challenging the part of what obama's policy does under the law of war. what we should have done is interrogate him or 13 months at guantanamo bay not read him his require ran today rights and charged him with criminal offenses in the united states and kept him at gitmo until the war on taishor was over. heather: they took a 13 days to interrogate him. i read through this. it's 24 pages the complaint. they are specifically blaming president obama for those decisions. >> if you thought killing ambassador stevens and three americans in a pre-planned attack in libya is roughly the equivalent of knocking over the starbucks on the corner you might have a point. but this is war against the united states. during world war ii we didn't read miranda rights. but we did have the same procedure. it's not a criminal offense to be at war. it's part of what war means. therefore to try to insert criminal law procedures into a war is doomed to failure. >> i want to talk about the war with isis and libya's connection and the danger we would face if he were released. >> it's a risk for him and the inmates at guantanamo bay. if they are released they will go back and fight against the united states. this is taken idea -- an idea ideological opponent. isis is gaining supporters week by week. i think an acknowledgment of what we have done is legitimate under the paradigm of the law of war. what makes no sense is to try to treat this like some typical run-of-the-mill american criminal. heather: what was abu katalla's role in ousting qaddafi. >> we don't know much about the makeup of his specific terror group. but he's the only one arrested or detained by the united states. we sent a terrible lesson by the way we treated him. but that we treated him so leniently. the lesson to terrorists is if that's all you have to worry about from the united states, other americans are fair targets. heather: there are other questions why it took so long to arrest him as well. >> this is something that should have been quickly reacted to. but remember the timing. it was september 11 of 2012. two months before our presidential election and to do something we should have done. it would have contravened the president's narrative in that election if the war on terror was effectively over. we are paying the price for it again. if this motion is granted it will be the final insult. >> we appreciate you joining us. we'll see what happens with it. bill: we saw some severe weather in tampa. rescuers using boats to bring people to higher ground. >> it's a tragedy the flooding issues. we were expecting much more flooding. bill: the rain is not on the radar but the flooding is still there. better day today, we believe. heather: heart-stopping moments caught on video. take a look at this. whoa! , two cranes crashing down on to a row of homes leaving people trapped under the rubble. bill: republicans lining up to challenge president obama's cuts on power emissions. is the white house overreaching? >> the regulations that have already been put in place have squeezed the coal industry in west virginia, kentucky, indiana and til now. we are trying to slow global warming and every bit of evidence indicates this will be a minimal effect on global warming. we are only one part of the world. every week there is a new coal fire flannel built in china. how much good is going to be done. we are going to beggar our economy to achieve nothing for the goal the president claims. there will be a huge impact politically because people will see their you've tilt bills going up and they will have one man to hold responsible and he will be out of office before it time this regulation comes into effect. bill: let me move to the politics of that. governor chris christy was here yesterday. that's when we got news. this is his announcement. >> this is the overregulation of the obama administration. last year they have issue offed 81,000 pages of new regulation. this is the greatest regulating administration in the history of the united states. that's why the president is taking a victory lap for 2 per there are gdp growth. this is the worst recovery from a recession since world war ii. >> let's tonight this frame. this is from 2014, the energy information agency. the numbers have been changing since then because coal plants, some of them have been shifted to natural gas. this is the percentage of the electricity and these states generated by coal. in west virginia and kentucky, 9 other * and 80%. there are a lot of states in the country where a near majority of their energy comes from coal. if you have take coal out of the mix their you've tilt bills will be -- mix their utility bills will be higher. new mexico 60%. north carolina, pennsylvania. these are all battle ground states. the president is saying i want people in those states to pay higher utility bills and the utility company to the pay hundreds of millions to change from coal fire plants to something else or maybe hundreds of millions to create new power sources from renewables. there will be an enormous cost to the president and it will be politically difficult for his party to explain. tell some guy in a plant you are not going to get a pay raise and your company won't be able to compete. bill: how big of an issue could this be? heather: i'm heather childers in for martha mack. at the very first republican presidential debate two days away, and trump leading republican pack by a healthy margin. he is giving serious thought from advice from radio show host, hugh hewitt to close the door running as third party candidate. >> it just seems to me as long as we're treated with respect and treated fairly as a republican i want to do that i want to run as republican. that is the way we're going to win. when it comes to that i would say i i want to keep my options open but i could be convinced at certain point. >> i think you're putting a ceiling. >> working very well with the folks and we'll see what happens. >> my two cents are you put a sealing on yourself because a lot of people like me will never support anyone who dangles the opportunity out there for third party because it -- >> very interesting. i never heard it put so strongly. bill: jonah goldberg putting everything strongly. senior editor, national review, fox news contributor. >> good to be here. bill: is hugh hewitt right? >> absolutely right. i love hugh. he is a friend of mine. what i find so fascinating but trump never heard it put so strongly. this is well understood dynamic of third party politics going back in america 100 years. third party candidacies tend to destroy the party they're most closely aligned to. teddy roosevelt ruined republican's party chances when he ran as bull moose got woodrow wilson in 1912. ross perot was hurt bush. richard who is setter famous historian, third party movements are like bees, they have an effect when they sting and then they die. that donald trump has not thought about this more chosely. bill: third parties are like bees. once they sting they die. you take the l out of lover and it's over. what is your feeling on his position on that, trump? >> i think my views on donald as a candidate as nominee are pretty well-known. you have to take him seriously these days when he is doing this well in the polls but i think that, there is nothing wrong with the republican party requiring everybody to take a pledge saying that they won't run as third party candidate. that seems to me the minimal amount of party discipline that a party can impose. it is not binding to donald trump. he could refuse to abide by it whatever reason he concocts. it is a real threat. i don't think donald trump actually wants to do that. it would cost him a lot of money. he knows he would lose and would get hillary clinton or democratic nominee, whoever that is elected. bill: that is interesting too. it is probably smart to keep making that threat to keep party folks off your back. this is what we found. >> that is true. bill: this is what we found in our polling okay? 5:00 p.m. bill: 5:00 p.m. heather: we'll be watching. bill: cool. heather: in other news dangerous storms soaking the south. we have to tell you about this. heavy rain bringing massive flooding to parts of florida as people brace for even more rain today. the flooding forcing authorities to close major highways in the tampa area, snarling traffic and even delaying flights. people say the flooding happened so fast there was no time to react. search-and-rescue times had to help residents stranded by rising water. governor rick scott said the state is ready to whatever it can to help. >> no one should be driving in water. everybody should be careful around any flooding. >> flooding situations, with the flooding situations they're still dangerous. we don't want anybody to feel like the situation is totally over but it could have been a lot worse today. but the situation is still dangerous. heather: yep. don't drown, turn around. what they say. meteorologist maria molina live from the fox extreme weather center to give us details what is in store. hi heather. >> good to see you, hello to everybody at home. we're dealing a lots of flooding over parts of central florida. just past 48 hours, many areas have seen eight-inches of rainfall around locally higher amounts have been reported. that is just past 48 hours. for second half of july, many of these same areas saw well above average rainfall. the ground is saturated here in this part of florida. some reporting 20 inches of rain during the month of july. flood watches are still in effect including cities like tampa and spring hill. we expect to the situation to begin to improve out here in parts of florida. that is welcome news. we still think there will be more rain. showers and storms are forecast very widespread across the state of florida. this will be more typical summertime activity. there will be locally heavy amounts in terms of localized flash flooding. especially areas across city of tampa we're forecasting areas of rain coming up last two days. i want to take you to the northeast. out here we dealt with a lot of severe weather. storms rolled through. we're forecasting more storms to fire up as we head later on this afternoon, including cities like d.c. and parts of new england. parts of plains could see severe weather. there is a threat today for ears lated tornadoes and damaging winds. heather take you to the pacific. there is extreme weather here. we're watching tropical storm guillermo. it is forecast to say north of the hawaiian islands. that is good news. heather: busy day for you, maria. >> thank you. bill: get to this fox news alert. raging wildfires in bone-dry california. the biggest fire north of san francisco growing to almost 100 square miles. thousands under evacuation orders today. two dozen homes destroyed already. claudia cowan live at a base camp for firefighters near the scene in lakeport, california. >> reporter: bill this fire continues to vex firefighters here as it burns out of control into a sixth day. it has scorched 65,000-acres so far, an area roughly the same size as sacramento and is just 12% contained and the fire did jump a critical firebreak yesterday afternoon. take a look at the pushtures we took along highway 20, a main artery through town, when the hot winds kicked up at 1:00. happens every afternoon like clock work once invasion kicks in. it sparked new fires on north side of the highway and causing more evacuations. 3,000 fire crews are getting additional airport. two more national guard tankers arrived from colorado to drop water and retardant while ground crews are doing black lining, widening containment lines, setting smaller fires ahead of the main one. >> this will consume all the fuel ahead of the main fire. give it nothing left to burn and it will burn itself out. >> reporter: fortunately no one has been hurt but more than 13,000 people are under some kind of an evacuation order. keep in mind this is one of 21 active fires in the state from burning south near san bernardino to up here the oregon border. conditions in california just about as bone dry as they can be in the fourth year of drought. officials say many of the smaller lightning-sparked fires are out. that means personnel and equipment can be reassigned. bill, many of the crews will head here to california's biggest and active wildfire. the cause of the rocky fire remains under investigation. bill: important stuff. claudia cowan in california watching that for us. thanks. heather. heather: dangerous for the crews working out there. speaking of that, terrifying accident at a construction site caught on tape. >> she is increasingly vulnerable. she still is the favorite with the big money and big connection with the big dog, meaning bill on her side. the problem with her she is terrible candidate. she is not her husband out there. she is atrocious as retail politician. the other thing is longstanding perception that is growing that she is liar, she is dishonest and untrustworthy. with the democratic base, with the numbers seeing with bernie sanders self-avowed socialist picking up steam i think democratic base is saying hillary clinton is not far left enough for us therefore we'll support bernie sanders. but the other part says they're now looking at sanders, frankly maybe some others as less a vehicle to register their discontent with her and more viable alternatives to her. >> talk about that discontent, doug. >> sure. heather: we have another full screen we can show people. some other numbers. poll came in talked about the opinion of hillary clinton in general. only 15% positive, 22%, somewhat positive and 15% somewhat negative. 33% very negative, doug. >> here is what is going on. monica i think perhaps overstates the case but not by much. she is slipping, monica is right. and she just began a two million dollar ad buy in iowa and new hampshire because the polling from those two states which will have the first two primaries and caucuses, showed that hillary is even weaker there than she is nationally. heather: so she is worried? >> she is very worried. let's be very clear she is very worried. in a certain sense biden helps hillary until he hurts her. meaning if hillary is able to maintain 50% or there abouts support, she has come down biden will divide with sanders the anti-hillary vote which is substantial. but if hillary has more scandals or more challenges facing her canada sir, biden represents something that sanders isn't, and what that is, heather, a credible and viable alternative who could be the democratic nominee and ultimately could be elected president. heather: we spoke with dana perino last hour. she said something interesting. every election is about character and judgment. how can hillary clinton change the the opinion that people have in terms of her character? >> i don't think she can, actually. i don't think she can change the dynamic. it is very late in her political life to be reintroducing herself to the american people. we just saw she released an ad talking about being a mother and grandmother. that tells me their internal polling among female supporters is increasingly weak. otherwise she wouldn't be releasing this kind of ad. i think after what 25, nearly 30 years on the political scene people know who she is. she is a known quantity. the fact that she still believes she has to go out there to tell the american home who she is tells us -- >> i would have done something very differently monica. i would have talked about her positions on issues and what she will do for the people of america in terms of addressing inequity and unfairness, rather than trying to reintroduce yourself for about the 12th time. heather: throwing out the war on women in reference to people who opposed plan the parenthood. >> remember this is 2015. while that message worked in '08 and again in 2012, it sort of washed out at this point. hillary clinton is a known quantity. i don't think she can turn the poll numbers around. remember she was the prohibitive favorite was so long, a she had no alternatives. now shy does and field might be growing. democrats believed they owed it to her because of her husband's humiliations and barack obama who beat her in '08. now they're increasingly feeling they don't -- heather: ask her about alternatives to her specifically before we run out of time, please. joe biden. >> as i suggested biden if he gets in, given the good feeling that has been generated after the tragic death of his son, has put his numbers at a high point. the problem there are two credible alternatives, sanders and biden. i don't see sanders dropping out. he has a different world view. if you looked at poll number, heather, he is coming up. i don't see him deferring to the vice president. heather: who does president obama throw his support behind, biden or clinton, if it comes down to that. >> quick answer. heather: very quick. >> if you noticed biden has been omnipresent at obama's side. heather: monica? >> i whole a whole column last week in the "washington times." i think barack obama is moving against hillary clinton. i think there will be a criminal investigation of her handling of classified material. >> not now there has been. >> watching slowly and steadily taking her out and he will endorse joe biden. heather: we'll see what very interesting. exciting stuff. bill? >> reporter: bill, for the last several weeks in this trial almost all of the attention has been on the shooter james holmes, his childhood, his mental illness but today it shifts back to where it belongs, on the victims, especially 12 people who were killed and gunned down in the movie theater in aurora. we're expecting emotional day. 15 of the relatives of the people killed were expect todd testify. two of them are fathers. most of the victims were in their 20s, just about to launch their careers and start their families. one of those was 24-year-old, jessica gowie. she was as spiring sportscaster. her mother sandy phillips is in court every day wearing one of jessica's scarfs. >> i've always been against the death penalty. but hearing the testimony, hearing the witnesses, seeing the disregard for life, having no remorse, no compassion there are some people that should get the death sentence. >> reporter: the jury returns to court, bill, in about 90 minutes. bill: this phase will last how long, dan? >> reporter: we're expecting two to three days. then the jury will begin their third and final deliberations. this will be the deliberation that will finally answer the question will james holmes be put to death for his crimes or spend the rest of his life in prison. it has been a long road. more than three years since the shocking massacre. this jury was picked back in january. opening arguments were in april. it should all be over this week. bill? bill: dan springer, in colorado. thank you dan. 27 past. heather: senator rand paul lashing out against planned parenthood. >> this callous disregard expressed over wine and cheese should inflame and infuriate us all and we should stop once and for all any money going to plan the parenthood. heather: the senator putting out a new ad to before a bill to defund planned parenthood failed to advance. we'll find out where he stands now when which talk to the senator straight ahead. bill: accused gunman's manhunt stretched for days. when he said to the police when the suspect turned himself in. >> we have used literally ever resource we had available to us and there was intensive amount of pressure on him and, it was just a matter of time before he turned himself in. heather: a manhunt for the ex-con accused of murdering a memphis police officer is over after the suspect turns himself in. police say that tremaine wilbourn shot and killed officer sean bolton on saturday when the officer interrupt ad drug deal. jonathan serrie joins us live from atlanta with the update. jonathan, how did the suspect turn himself in? >> reporter: hi heather, just before 5:00 p.m. central time yesterday, memphis police were informed that tremaine wilbourn turned himself in at the local u.s. marshal's office in memphis. he was accompanied by a lawyer and interviewed by homicide investigators. during this process the memphis police director got a brief opportunity to speak with him. >> he wanted to make a point to say i want you to know one thing. i asked what was that? i want to know, i'm not a cold-blooded killer and two, i am not a coward. >> reporter: the police director referringring to the comments he made during a news conference during the manhunt which he described the fugitive as a coward. heather: so what happens next, jonathan? >> reporter: tremaine wilbourn is now officially charged with first-degree murder. he is being held on $9 million bond. he is scheduled to have a first appearance hearing in court wednesday morning. later that day, there will be a visitation ceremony in memory of the fallen officer, sean bolton's funeral and burial are scheduled for thursday afternoon. the police director said the arrest of the suspect and his death is first of a long series of steps in the healing process for the officer's family, the police department and the entire memphis community. heather. heather: maybe not a coward but now an inmate behind bars. thank you jonathan. >> reporter: indeed. >> as a pro-life doctor, rand paul cared for premature babies to save their sight. as a conservative leader, rand forcing a vote this week to end taxpayer funding of planned parenthood. standing for life from day one dr. rand paul. for president. bill: so that is a new ad for republican presidential candidate rand paul. kentucky senator pushing to defund planned parenthood even after senate lawmakers failed to pass the measure yesterday. senator paul is an ophthalmologist. wrote a book, taking a stand, moving beyond partisan politics to unite america. i talked to senator paul about the vote on planned parenthood and more. watch. senator rand paul, thank you for your time this morning. welcome back to "america's newsroom." now you go to a backup plan. what is it? >> well, i've always voted to defund planned parent hood and will continue to do so. i think the power of the purse is something we should use. in fact that is congressional prerogative. the problem we haven't really tried hard enough. i will keep pressing on. we'll try to attach it to appropriation bills. the thing is that it is the responsibility, it is not unusual for congress to give rules to the president how to spend money. that is what we're supposed to do. bill: would you shut down the government over this if it comes to that, come the fall? >> i think that is matter of perspective. i don't want to shut down the government but i want to give instructions to the president how to spend money not just on planned parenthood but a thousand different items. i still don't want to fund obamacare. i still don't want to fund the massive regulations he is putting forward. the choice is the president willing to shut down government. there is a lot of other complicated factors. we have to decide can we get anything out. senate? to get anything out of the senate requires six democrats to vote it. so far the democrats are stonewalling appropriations bill. the democrats want a showdown and may want a shutdown. they say oh the republicans did it. i don't want to shut down. i think democrats shutting down government if they're unwilling to accept a republican majorities instructions on how to spend the money. bill: talk about the vote yesterday. a few democrats voted with you. mark kirk out of illinois did not. did you expect that? >> you know i think there has always been a few republicans who don't side with us on this issue. i do think though it's a bigger issue than just abortion. this is about taxpayer funding of a gruesome procedure, not just any old abortion but a abortion of a fully formed baby where the baby is manipulated and turned around to harvest the baby's organs. i think it is particularly horrific. i think everybody should have voted against funding for this. i will continue to fight against this funding. there is no reason in the world we have to fund planned parenthood at all. everything they do is already done by another government agency, community health centers. we have 9,000 community health centers. there is no reason for one penny ever to go to planned parenthood. bill: harry reid talking about the republican absurd policies. >> they're not really listening. planned parenthood is huge lobby. it gives millions of dollars to democrats. it uses millions of dollars to fight against republicans. they're not objective. they're not telling you truth. the truth is women's health is taken care of by community health centers, by $5 billion. we doubled amount of money we put into women's health care through government. and so you know it is just an absurd argument to say that we needed plan the parenthood. only about abortion -- bill: your idea just to be clear, is to continue money but through different health centers, that accurate, that do not perform abortions, correct? >> right. the money always goes to community health centers. we give billions. we give i think about $5 billion to community health centers. that would continue. there are plenty avenues and areas for people to go for women's health care. most of the stuff planned parenthood they do, don't do anyway. they refer you to real doctor. refer you to community health center. mammograms are not really done there. exams are self-exams. if you want a doctor's exam, go to a doctor. really planned fainter hood is about abortion. now we find out it is about the grisly sale of baby organs. i think public is with us. there are some debate over various stages abortion and there are some proabortion people out there. when it gets to fully formed babies, 2/3 of american public don't agree with this. bill: hillary clinton talking about women's rights. that will be debate as we to forward. we'll see you in cleveland ohio. we've been asking viewers on facebook to file questions for the candidates. here is one out of arkansas. carl writes what will you do to protect religious liberty in america? [train horn] bill: literally dragging man out of path, only seconds before it comes barreling down the tracks. the man crashed his car. appeared to be intoxicated. in the end, nobody was injured. great police work. heather: student at texas christian university fighting back after he was suspended over a series of controversial tweets. 19-year-old harry vincent was punished the for slamming islam, calling baltimore rioters as criminals and derogatory term describing americas cans. he is says he being punished for exercise sighing free speech. personal freedom allows the student to speak about his opinion on the religion of islam and isis. personal freedom allowses the student to critique the actions of the president of the united states. leslie marshall syndicated radio talk show host. david webb, radio talk show host as well and lumpist for "the hill." both fox news contributors. >> good morning heather. >> good morning. heather: good morning. talk about this. is this infringement on his free speech. is that what this case boils down to, leslie? >> he has the right to say anything he wants and, he, the university, because it a private university also has the right to enforce their policies regarding conduct of a student and to make a decision to suspend him, kick him out do whatever they want. because this is social media, it is one of those more gray areas. but although he does have a first amendment right they're a private university and they can make policies as they have that he has to follow and they feel he has breached those. heather: david talk about what the student handbook actually says there because, there is a discrepancy. it talks about students and the right to free speech but another says discrimination and harrassment are incompatable with tcu's mission. >> the key there is it is a private university. this is not either/or, for him or against him. for harry vincent, whoever told you life was fair, they lied. for aggrieved 19-year-old in maryland, get over yourself. what we have are two 19-year-olds having a schoolyard pissing matchs frankly because of social medias goes off the schoolyard and off the campus quad out into the public. tcu has a contradiction but not really. they're private. they can choose and when it goes public, it goes viral, it maybe makes them look not way they want to be they're going to act and they did. i think definitely they think they went too far. on the other side of this i think they also need to stand up for their students a little bit more, not just to cave to the politically correct environment. there is lesson for both but a lesson for us watching, heather, there are other issues that need to be taken on. here we are talking about two 19-year-olds. we're in politically correct environment where that become as big story. with all due respect, this really isn't. the school is over the top. the students are over the top and kelsey get over yourselves. your offense is not protected by first amendment. it is okay to be offended under the constitution. heather: he said he wasn't being racist. those were political opinions. >> hood rat is not racist term by the way. it has been used by entire life, to refer to someone in the hood some way or other jokerringly or otherwise. it is not offensive. heather: used that in reference to the baltimore rioters. leslie, i want to talk about a this as bigger decision across the board. vincent decides to sue, which he say he may do first of all does he have grounds for that? second how could that affect other cases that come up like this. >> once again, because, you know this is online, this is that gray area. this won't get to court. he is not going to win in court. he doesn't stand a chance in court. this is not me. these are legal scholars who are saying this, basically that are looking at cases like this. when it comes down to it i, he wasn't talking about hood rats david with regard to racist remarks or discriminatory remarks. it was his remarks against a religion of more than 1.6 billion people and a remark that i will not say on national television with regard to mexicans. yes again he has the right to say it. you know, heather my mother said don't write anything down you don't want the rest of the world to see. >> that is good advice. >> the bible says the tongue is mightier than the sword. here is example. people lose jobs or don't get jobs because of what they post on social media. the world big brother is watching. heather: you would think people know that by now. we keep reporting these incidents, where repercussions what people write on social media. don't do it. we want to take a look what the school has to say about all this. they did issue a statement. here it is. texas christian university mission is to educate individuals to think and act as ethical leaders and responsible citizens in the global community. we are always disappointed when any member of our community fails to behave in a way that aligns with our mission. and, looking at that, david you can say that vincent, according to them and their opinion did not do that? >> look they're entitleed to their opinion as a private organization and to have a code of conduct just like a company has a code of conduct. they went too far you, however. this type of suspension, only going to classes off campus that is ridiculous. that is where they went too far. but then again in this politically correct environment where you're under attack and god forbid, while he has the right to say it, he says something as he sees it against islam or in some way, that is going to be magnified by the pc crowd out there. you know he we've gone beyond what should be just basically two kids on a schoolyard, 19 years old. you're not responsible in everything you do at 19. none of us were. i'm not excusing it but, come on. heather: listen to yourself, david. i was a little more responsible. leslie, david, thank you so much for joining us. we have to end it there. we appreciate it. >> thank you. bill: jenna lee is responsible. because she is here every day. >> i try to be. bill: what is going on kid?
