White house can prevail on the president , if you want a good, constructive final two years of your presidency, dont do this now. Martha plus president obamas nomination of loretta lynn much for the next attorney general is setting up possible confirmation showdown. Senator john thune saying dont even go there. I think it would be best interest of the country and congress to wait to do this next year under regular order, candy. Loretta lynn much will get fair. Martha byron york is here. Good morning martha. Martha president obama has to want to shore up a legacy for himself in the final two years for his presidency. Gop has to use their victory carefully, right . Especially on immigration you have to take both sides at their word on this. President obama is saying im going to do this and i think he will do it. Republicans say he will strongly oppose. How much stronger than they say this, playing with fire and red flags in front of bulls. Republicans are going to oppose this what will happen the president will go ahead and it will create a standoff. A multistage standoff in congress. The president may ultimately win it but he will be damaged in the process. Martha what about the numbers here. If cassidy wins in louisiana, republicans will have 54 seats in the senate. So, if the president plays hard ball, how does it work from there. Here is what you have to remember, an executive order does not have the force of law. At anytime congress can overturn an executive order. It can overturn part of an executive order and leave other parts standing, it can vote to stop funding for enforcement of any executive order. So congress has upper hand here only if it is united. It would take 60 votes to overturn the executive order. If republicans have 54 they would have to find six moderate democrats to go along with that might be possible depending how the executive order is done. The president still has veto power which is ultimately power. If he exercised he would be overturning the will of a supermajority of congress. That would put him in a tough political spot. Martha it certainly would. In terms of the gop and this reaction to this executive action is done, if it is expected to come on immigration, are there pitfalls for them on that position . I would look for the president to make this as hard as possible for republicans to include in the executive order some things republicans would actually like in some other context. There will be talk about making currently Illegal Immigrants pass a background test, perhaps pay fines, learn english, go to the back of the line. The president has spoken about that. That was in the gang of eight bill that passed senate with 14 republican votes. Look for the president to make it hard for the republicans to oppose the whole thing. Martha theyre back at at as of this morning. Well talk about the lore red at that lynch nomination later in the show. Loretta lynch. The president getting out of washington. He stopped in china on the first stop of a threecountry story. Ed henry is traveling with the president in beijing. With all that is going on at home what the purpose of this long trip now . Reporter eric, part of it is getting out of dodge. When you hear byron talk about what is waiting for the president back in washington when he returns from this eightday trip. He has a whole new dynamic. He is trying to talk up economic initiatives he thinks he can tout to American People. He announced expanded visa to china and bring more Business People and more tourists from china. Bolstering the american economy. Billions going there. He is talking up a specific trade deal. The bottom line any initiatives have to come back and he has to deal with the Republican Congress particularly with any trade deal, and angering them getting off on the wrong foot, by executive action on numb per one. And interview on face the nation it appears the president doesnt get happen in the election. Talking about how he has to do a better job selling his policies. It is the messaging. Republicans saying it is not the messaging, it is the policies themselves, bill. What is he saying about the release of two americans held in north korea . Reporter well he is obviously cheering the fact that kenneth bay and Matthew Todd Miller came back. They have gotten safely back home to california. He is happy about that but made clear there was no concessions made to the North Koreans. People wondering whether there was concessions given to the North Koreans on a nuclear deal. The president says no way at all. Interesting that the north korea seems when president is in china trying to steal headlines. North korean soldiers getting close to the dmz. Too close to the dmz. South korean troops fired 20 round of warning shots. The North Koreans retreated but gives you an idea how tense this region is, sean . Ed henry, 10 00 p. M. At night accompanying the president. Great to sigh. Were getting new details about kenneth behs return home. He reportedly asked for one thing when he got home, pizza. Thats what i would ask for. State Department Spokeswoman general saki will join us with some of the circumstances surrounding this release and timing of it as well. Well talk to her about that. Big announcement is set for today that would dramatically alter the scandal plagued Veterans Affairs administration. The new head of the va telling cbss 60 minutes, he will announce the agencys largest reorganization in history. Big news happening on the va front. Doug mckelway is live in washington with more. Doug, why has this taken so long . Reporter eric for the very simple reason firing people in the federal government is not like firing somebody in the private sector. It takes a long time. That is something that the new va secretary bob mcdonald is finding out the hard way. Whatever punitive action the va secretary demands in front of any one employee is put in front of a Administrative Law judge and disciplined employees have the right to appeal. So it takes time. We propose the action. The judge rules and the individual has a time to appeal. Thats why we have a lot of people on administrative leave. We moved them out. We dont want any harm to our veterans. Reporter mcdonald told 60 minutes after the administrative procedures hundreds 6 va employees may be let go. Doug, you also said the biggest problem is not getting rid of bad employees, that is unbelievable but hiring new ones . Reporter he did make reference to that fact. He said mcdonald made that clear the completion of factfinding trip to dozens of va facilities. He wants to hire 28 how new doctors and nurses. That is no small endeavor. Finding qualified and energy physicians and nurses who want to work for the va is very, very difficult. Macdonald is making that appeal to prospective employees pointing out all of the incompetence and criticism in the last several months, va is in the forefront of medicine in some specific areas such as in the treatment of traumatic brain injury and ptsd and use of prosthetic limbs. It will be a hard thing to hire all these people but there are bright spots within the va. Hopefully they can certainly clean it all up. It is far from about time. Doug, thank you so much. Reporter my pleasure. Martha fox news alert right now. A horrible plane crash in the bahamas. Police say a private learjet was apparently trying to come in for a landing near grand bahama that International Airport it struck a construction crain. Nine people were killed on board, including prominent evangelical pastor, miles monroe and his wife. Police are trying to determine what went who arely, horribly wrong. Martha, here we go again. There are new worries over the obama care website as enrollment season gets underway again. I. T. Folks are drawing up emergency plans and preparing for a potential meltdown. Martha one of the worlds most dangerous terrorists in the crosshairs. Did an airstrike hit leader of isis or not . Well tell you the latest on that. Next phase in the battle against radical islamic terrorists of isis. President obama announcing more troops will be heading to iraq. Kt mcfarland is here with more on that. We will provide them Close Air Support once theyre prepared to start going on the offense against isil. But what we will not be doing is having our troops do the fighting. En fees on savings acc . Thats right. Its just that im worried about you know hidden things. Ok, whys that . No hidden fees, from the bank where no branches equals great rates. Wouldnt it be great if hiring plumbers, shopping online is as easy as it gets. Carpenters and even piano tuners were just as simple . Thanks to angies list, now it is. Start shopping online from a list of toprated providers. Visit angieslist. Com today. Eric the nurse who became the center of a quarantine controversy in maine says she is leaving the state. Kaci hickox was ordered to stay indoors for 21 days. That is the incubation period for ebola, that after returning from working with ebola patients in africa. She refused and flaunted order by going on brazen bike ride with the boyfriend. The couple is planning to leave the state after the court order expired today, saying theyre disappointed the way they have been treated. Theyre going to Southern Maine for now. No word where they may eventually wind up. Martha so the pentagon is now skeptical about iraqi claims that the leader of isis was wounded. Baghdadi reportedly wounded in the Coalition Airstrike over the weekend. Now there is question on that. Meanwhile president obama is doubling down. Saying he ordered 1500 troops into iraq is quote, a new phase in the fight against the Islamic State. Rather than just try to halt isils momentum, were now in a position to start going off on offense. The airstrikes are effective in degrading isiss capabilities and slaughtering the advance they were making. Now what we need is Ground Troops, iraqi Ground Troops that can start pushing them back. Easily said. Easily done is another question. Kt mcfarland our Fox News National security analyst. Everybody would love the president to be right about that it that everything is going well. What do you make of our doubling of troop presence on the ground. Not combat troops he made very clear to 3,000 special advisors. Quote the former commandant of the marine corps, not a snowballs chance in hell this will work. This is sign of president who never learned lessons of vietnam, iraq, afghanistan, even libya. He will send in just enough forces we dont win and we dont fail but done it for political cover. Why . Because he doesnt know what else to do. He will send some forces in, see im doing something, succeeding it is great. When it fails he hasnt made a big commitment. He thinks he can weise el out of any political accountability. We look at the situation if we go in and do it or if we cant get out. To put incremental forces in, a prescription for disaster. If we couldnt stablize iraq with over 100,000 troops well not do it this way. If we couldnt train and equip the iraqi army with over 30 billion of expenditure were not going to do it now. Martha once again the president is going on his own guidance rather than listening to commanders on the ground. In iraq they wanted to have more troops on the browned in order to stablize iraq. Afghanistan, same story. Libya, which we involved in a partnership in, same story as you pointed out. It raises the question if youre not committed to winning, should we not have anyone on the ground there . Those people are very much at risk if there is not enough to back them up, are they not. Our own forces are at risk. We need to take a step back. Why do we care what is going on . What does it matter to america . Historically it has been oil, and terrorists and israel. We wanted their oil and didnt want their terrorists and didnt wanted to support israel. We dont need their oil anymore. We the United States, found, ability not only energy selfsufficient for ourself and Energy Source for the world. Who cares about middle east oil in that regard. Number two, tears rift, we now have the ability with data mining and big data to track people we think are suspected to have terrorists leanings and inclination. We have to take the Political Correctness handcuffs off. We can find those people. As for israel. They dont want military forces. Help and military aid they need to do the job themselves to protect their own integrity and their own survival. They dont want a president badmouthing them or badmouthing them with disparaging comments saying theyre finished, et cetera. Martha sound like youre making an argument for not being there . Im making an argument if were not committed to do it right way dont get involved in sort of incremental way because it wont succeed. What would succeed . United states pushing for Energy Independence on our own. Accelerating our own energy programs. Going to our own partners in the region, israel, egyptians, and moderate arabs saying how can we help you do the job . The president will end up doing, will cut a deal with iran within the next two months. Here is what the deal will look like. They will lift the sanctions. They will pretend to stop their nuclear program. Well pretend to believe them. Well get air support as the president talked about, iranian military, iranian leadership, iranian top general in iraq they will be the ground forces. Well end up being air force for iranians of the wait a minute, werent they just a direct and existential threat to the United States as Nuclear Power . Martha i can not even imagine. They will have that conversation. Martha i hope we dont but well see what happens. Albaghdadi, we talked about the beginning of this segment the fact there was word that weighs wounded. What do we know about that . We dont know a lot. The Iraqi Military claimed they either wounded him or killed him. They attacked the headquarters in mosul, a major city controlled by ice systems we dont have any independent confirmation. We may not have any independent confirmation. What we know about baghdadi, he is really clever. He is strategically important. He crafted isis out of the old embers of al qaeda in iraq. He formed a military. He has military and leadership group. He has bonn into regions. He is formidable enemy. He is personally charismatic. If we or our allies were working with can get rid of him that would be a terrific thing. He is carries mast tick as bin laden was. If we have wounded him he will lash out at america and americans or anybody else in the region. Hard to believe he gets worse because beheadings and are pretty bad. To corner baghdadi and injured one is more lethal. Martha brutal, vicious force in the region. We need to know were doing enough to stop it. Kt, good to see you as always. Eric. Eric after the tuesdays sweep the stakes are high for republicans. They take control of congress in january. What can we expect . Senator jim demint joins us live. Martha enrollment set to begin underway with obamacare. Will we see a repeat of last years problems with the website. The feds say the website is ready to go, folks. There are new reports that backup plans are being set up. Maybe that is a good idea. Well be right back. There is no doubt in implementing the Affordable Care act, a program of this significance, there will be some glitches. No doubt about it. There are things that well say, you know what . We should have thought about that earlier. Comfort keepers can provide a variety of Inhome Services for your aging loved ones. Well assess their needs and create a custom care plan that can change as their needs change. Eric millions of americans are prepared to sign up for Health Care Insurance during the open Enrollment Period on obamacare there are some new fears that the obamacare website, y yep, it could have another meltdown once again. The Obama Administration is assuring people the site will work. Reports are saying they have backup plans in place just in case that site crashes yet again. Like every new law, every new product rollout there will be some glitches in the signup process along the way that we will fix. Ive been saying this from the start. For example, we found out that there have been times this morning where the site has been running more slowly than it normally will. The reason is because more than one Million People visited governor governor before 7 00 in the morning. So will it work . Fox Business Networks Stuart Varney joins us. He is of course host of varney company. Stu, did they learn the lesson the first time or will people be frustrated yet again . The stakes are extremely high. If this Enrollment Period begins on saturday, by the way, if it document go well, republicans new congress, dominated by republicans eager to fix it or repeal it. Republicans dominate state governments this time around, also eager to fix obamacare. So it better go well. Here is the initial telltale signs. There have been, private memos released in the Washington Post which suggest that theyre taking precautions just in case there is another melt down. For example, last time around a lot of people got shunted off to the blue screens of death. The system was overloaded. So off you go to this blue screen. Nothing happens, very unsatisfactory. This time around, if the system is overloaded, you get shunted into managed waiting areas, not as bad as the blue screen of death but still the waiting areas. Eric are you going to know if youre in managed waiting area and blue screen of death and nothing will happen as you try to click on . It will be managed. You will be told youre on the wait, that little waiting room. There are still testing for security. Theyre still testing the Small Business application process. Eric okay. And, to keep the number of enrollees up, because remember they have to reenroll those people, if there were questions about the subsidy you got last time around, doesnt matter, youre reenrolled automatically. Got to get numbers up. Eric a, sound really complicated. B, what if you sit in the waiting room, you know what it is like to be on the phone when the music is going, you could be on there forever. Are they starting on saturday. Will they have operators standing by or not in until 9 00 in the morning on monday . They put a public face of optimism on this next rollout starting saturday but privately there is a great deal of concern and to keep the information flow to the public under control, insurers, they have had to sign a pledge saying were not going to say anything. So the full information eric not going to say anything. Not going to get out there. A nondisclosure form had to be signed by all the insurers. Thats a big deal. Eric were told rates are going up. Hey, guess what, it happened after the election. How about that. Rates for young people, key to this whole problem, theyre going up more than for anybody else. Eric man, oh, man, stu thank you very much. For your insight. Youre welcome, eric. Eric watch stu on the fox business network. He has his own business show. If you dont know where to find fox business network. Log on to fox business. Com channel finder and find out where stu is. Thanks, eric. Martha why we can expect in the new congress. Our next guest congress may be at its most dangerous. Eric look at scene stealing moment at the seahawks game. It involved the teams mascot. They got expert advise, special discounts, new technologies. Like smart pick ups. Theyll only show up when you print a label and its automatic. We save time and money. Time . Money . Time and money. Martha were back with this fox news alert. At least 48 students were killed in a suicide bombing at a school in nigeria. It happened in the northeast part of that country. Witnesses say that the bomber disguised himself as a student and blew himself up in the middle of an assembly. Police are saying that the attack looks like the work of boko haram. At the scene several people were seen throwing stones at responding soldiers apparently angry the military is not doing enough to stop that terror group. Incoming republican senators wasting no time laying out their plans to tackle some of the key issues facing our country next year. Two fresh face notice gop caucus in january, tell Fox News Sunday what they think needs to happen when republicans take control of the senate. Way i want to move forward is score some small victories, bipartisan with the president , showing and demonstrating to that disaffected majority of americans out there that we can begin to solve the problems. Such as . Two years from now if republicans dont prove we can govern with maturity and govern with competence, well see same kinds of results two years from now, except a wave going back the different direction. Eric someone who has been there, president of the Heritage Foundation and former republican senator from south carolina. Senator, good to see you this morning. First of all we just heard the new senator from West Virginia say small victories, potentially are possible. Do you think that is possible to score small victories, bipartisan victories with this president . Well we hope so, eric. He hasnt indicated with many so of the things he is going to do on his own maybe he doesnt want to do that but but the new senator capito is right, particularly on issues like energy where we could take some small steps, keystone pipeline, reducing regulations on coal which would certainly affect her area, move the country towards Energy Leadership in the world, those are the kind of things that are big ideas but we could take a number of small steps to move us in the right direction. Eric the American People dont want small steps. They want action. Here you have a president who largely has been saying it is my way or the highway, who wont compromise. You talk about immigration, he will put that through no matter what congress says. How does the Republican Senate react to that . Well, it really will, as someone who said be like throwing a hand grenade in the middle of congress as theyre trying to come up with an agenda, pass a spending bill, work on big issues like Energy Independence or more opportunity in education to solve the problems of the country. If the president creates another problem, then im not sure where well, where it will end up, but i think republicans and responsible members of the house and senate need to move ahead as if the president might work with them at this point. Eric the president was a senator of course, before he was elected. He was a state senator . Springfield. What do you think he learned . When youre in the senate, in a legislative body you have to learn to Work Together even with people who are members opposite party across the aisle. What lessons did he not learn from that experience . I think the president is an ideologue. He has this vision of america that is very different from mine and a lot of other americans. I came into the senate at the same time that barack obama did but he almost immediately began working to run for president. Did very little in the senate. So showed very little interest in working with people even when he was in the senate. So i dont know to expect of him. I hoped after this election he would do as others like bill clinton did and look for ways to actually accomplish something but his attitude so far, based on the meeting last friday and the conversations with members who were there, it doesnt appear that he is listening. It appears he is still talking. Eric what was he like and has he changed . Well, oneonone, he was, you know, decent person it seemed but very aloof. I think from other members of the senate, and particularly now he seems very arrogant as he approaches his job. Eric now some would say he is sticking to his principles. That he has his beliefs but and that is what he was elected because in his famous words once, you know, i won. How about that reaction. Well the president takes an oath of office to faithfully execute the laws. It is not his job to create the laws. When he says, if congress doesnt act i will, that is against his oath of office, it is against the constitution. He is supposed to faithfully execute the laws that are passed by congress. He needs to work with them to pass some laws that will move our country in the right direction, not create them on his own. Eric an finally do you think that we will have some bipartisan action or these small steps eventually . Or do you think after a few months it will be more of the same . Well, we can hope. I think at love republicans are coming in with the energy to move the country in the right direction, to work with anyone who will take the country in the right direction. Lets hope at this point with that new energy coming into the house and senate will move the president in the right direction. Eric senator jim demint, they have the scaffolding up on the capitol, hope when it comes down they can get something done but new year will tell us. Thank you for joining us. Thank you, eric. All right. So did you watch some football this weekend . It was actionpacked sunday for football fans. Did you see the Green Bay Packers . Oh, my goodness, greta must have been very happy on this day, amazing game, blowout against the chicago bears. Aaron rogers tieing a record, making six touchdown passes in the first half. They crushed their rivals 5514. I think no one cares but the jets won. They broke their eightgame losing streak. That was a good day for michael vick. He set an nfl record. First quarterback to run for 6,000 yards. A Baltimore Ravens cheerleader fell during a stunt. It looked like a catastrophe. The hospital says she is doing just fine. How about this moment that caught a lot of attention. Seattle seahawks, gets to fly around in the stands. Very excited to be landing on someones head. He took it in stride. Waited until he moved off his head and petted the little mascot hawk, has a run of the place. If youre the hawk you can do what you want. Martha looks like a nice plan to place to land on the mans head. Good weekend for sports fan. Eric free at last after being held prisoner in north korea. I said thank you for all your support and prayer and your love. That has really been encouraging for me and for others who are in the same shoes. Eric theyre out, theyre safe, theyre back home on u. S. Soil. Well have the latest on the release of the two americans by north korea, happening cloak and dagger style. Wait until you hear how all of this went down. Martha what a great moment on the tarmac. Ready for takeoff. A car goes airborne and apparently slammed into the side of this house. Well tell you what happened there. Well be right back with more. Total shock. I mean, this is not something you see every day. But, we at first thought perhaps the tree had fallen. Eric well a car goes airborne before crashing into a house. Take a look at this. Delaware police say the driver lost control of the car hitting three vehicles and flipped into midair. Then slammed into the second floor of a home that was converted from a barn. Well the driver was taken to the hospital and thankfully only ended up with minor injuries. Folks were inside the home at the time but happened to be in a different room. She thought we had a thunderstorm when she heard the crash. Lucky, lucky, yes. Overwhelmed. This is not how i planned to start my week. Police are investigating but neighbors say drivers regularly ignore the speed limit there. Been this amazing blessing to see so many people being involved, getting me released the last three years and mentioning for the thousands of people who have been praying for me as well. Martha very emotional understandably. Kenneth bae back in the United States half after being held captive bit North Koreans. He was one of two americans the other being Matthew Miller, held by pongyang. He was escorted home by james clapper, director of National Intelligence who played a vital role in securing their freedom. Great hug on the tarmac and emotional time for the family. How did this come about . Why now . Why did north korea let them go . General saki is the state Department Jen Psaki is the state Department Spokeswoman. Great moment for the families. Hi martha. Absolutely. Martha what was the linchpin here here . Why now . Why did this happen . I dont think any of us are in the position to explain why north korea did this now. Weve been using every diplomatic lever at our disposal since kenneth bae has been detained and past few months where Matthew Miller has been detained. Weve been working through china and every channel we have. Were thrilled theyre back home with their families during the holiday season. Martha tell me what may have been these levers. We have very tough sanctions against north korea. A lot of people are wondering if some of those may have been lifted. In the past weve seen north korea do things to gain favor when they need aid, when they need food aid. Is any of that in the works . Absolutely not. There is no quid pro quo here. There are no question that there was a great deal of International Pressure for north korea to release these two american citizens but were not going to allow north korea or the regime to change the subject. We have very serious concerns about their human rights record. We have very serious concerns about their Nuclear Ambitions and we absolutely did not put anything on the table along those lines. Martha but you know, they must want something, right . I mean there is some discussion that they want to be viewed more favorably by china, and this is a move to help strengthen their relationship with china as well. You know, just in terms of the dynamic out there, what do you believe . What do you think theyre up to . Well there is certainly no question they want that but their human rights record is abysmal and one of the worst in the International Community. China knows. That the United States knows that. The International Commune knows that. These two individuals were detained. Weve been asking for them to be released on humanitarian ground for some time now. What they got was a, high level visit after u. S. Official and what we got was two american citizens who been detained for far too long in north korea. Well take that. Martha in terms of the big picture and countries that were working on building closer relationships with or trying to negotiate them to back off or eliminate their Nuclear Weapons aspirations as north korea and iran, why the focus on those countries at this moment rather than perhaps rebuilding some damaged relationships that are out there with turkey, fingerprints, or with israel, countries that might be extremely helpful to us in isis or in these other venues . Why not go to them first to rebuild, strengthen those relationships . Well, martha, we can walk and chew multiple piece of gum at the same time. At the secretary as you may know is on his way to china. The president is there right now. We have an incredibly strong relationship with israel. Do we have ups and downs in our relationship . Absolutely we do but we dont look at this as the opening of a relationship with north korea. This is about bringing two american citizens home and it relates to iran which we feel is completely separate issue, our goal is preventing iran from acquiring a nuclear weapon. That will make the United States safer. That will make israel safer. That will make the International Community safer. Youre right, were working on many different fronts at the same time. Thats what we have to do as diplomats. Martha what would you say are the countries that are the priority in terms of repairing relationships during the president s last two years . What is his priority in that regard . Well look, we can look at, there are a ink a of priorities. One well continue to build on asia rebalance. That has been priority since the beginning of the administration. The p is in china. He is going to burma. He is going to australia. Were working on addressing a threat of isil. That is part of it but also keeping the American People safe. Were working with that as well. Were working with our European Countries with our European Countries on ttip that brings jobs to the United States. There are a lot of fronts were working on at the same time. It is about keeping the country safe, it is about growing our economy and keeping america engaged in the world. We have never been more engaged than we are today, martha. Brought up isis. Lets talk a little bit about that. Sure. Martha there were reports yesterday that abu bakir albaghdadi was wounded. What can you tell us about that strike, that effort to take him out . Well our department of defense and intelligence officials are looking into those reports certainly. I dont have anything to confirm for you at this point in time. As you know, weve been working every single day to take on the threat of isil and the threat it poses to the United States. That this certainly falls into that. We dont have anything to confirm at this point in time. Martha jen talk kirks thank you very much. Good to talk with you, martha. Food to be here. Martha you bet. Eric have you seen this video . The man kicking stray katco and it was all caught on tape. The disturbing footage went viral. It is now sparking a legal showdown. So do you think that katco attacker should go to jail many . 24 7 its just im a little reluctant to try new things. Whats wrong with trying new things . Feel that in your muscles . Yeah. I do. Try a new way to bank, where no branches equals great rates. Why do i cook for the to share with family to carry on traditions to come together, even when were apart in stuffing, mashed potatoes, gravy, and more, swanson® makes holiday dishes delicious im just looking over the company bills. Up . Is that what we pay for internet . Yup. Dsl is about 90 bucks a month. Thats funny, for that price with comcast business, i think you get like 50 megabits. Wow thats fast. Martha the va secretary, Robert Mcdonald is speaking at an event right now for the Washington Post. We did hear over the weekend in an interview he did on 60 minutes we should expect a real complete overhaul of the Veterans Health administration and hospitals and were going to be listening to this. Well let you know if, you know, some of the developments in his plan come out of this speech that he is making right now. As we get those details well bring them straight to you. Eric have you seen this video . It is really disgusting. Its a viral video and now turned into a real life legal drama. Take a look. The prosecutors say the man in that video, andre robertson, posted that individual hoe himself kicking stray cat. The cats name is king. Robinson pled not guilty. You saw him walking into court in brooklyn. Petting the cat, look, bang. Animal activists say he get jail time for that act. Laura engle is outside the New York State Supreme Court in brooklyn with the very latest on the case. Laura, how much time could he get if indeed he is convicted . Reporter hi, eric, he could get one year in prison if found guilty. Animal rights activists say it is fitting punishment for the violent kicking. If this was human kicking another human it most likely was a plea deal. We show you the tape. We to the got him walking into court. Andre robertson arriving in the court few moments ago. He did not respond tour questions. This is the portion of the video that led to a animal cruelty charge against robinson who pleaded not guilty. The 22yearold coaxed the kitty who has been name king, over to him before he launched him and sent him flying 20 feet over a fence. The gray cat with white paws, cartwheeling in the air, paw over paw before he land in the bushes. After that video went viral animal activities pushed for legal action in the case and present in his court demanding punishment n new york city the Police Department took over responsibility for animal abuse complaints in january and created an animal cruelty investigation squad. Local prosecutor is pursuing it and takes any animal abuse case seriously. Other states around the u. S. Are ramping up prosecution for animal abuse. Just this september the fbi will reporting crimes of animal cruelty separate offenses so Law Enforcement agencies can help prosecute these better. Eric laura, was king injured . Is severely hurt . How is he doing today . Reporter you know he is said to be doing okay. He was a little injured. He was located and trapped and shortly adopted by a new york City Resident who read about his story in the local paper. King did suffer tissue injuries and bruising. He is back to playing and exploring the safety of his new owners apartment who works at home according to aspca. His new owner says he is tough guy. And that he expects how he came out ordeal. This is supposed to be the official start of the trial. This trial has been postponed four times. We have a producer inside. Well let you know what happens. Eric king deserves a good home. He is a tough guy. He is from brooklyn. Reporter yes. Martha he has nine lives. I hope he has more to go. Interesting argument people tend to get more outraged of about mistreatment of animals which is completely justified than the mistreatment of human beings at time. That is interesting argument. Eric that is disgusting. Owner of a stray cat who got shot little bb, some kid shot him. Didnt know that until we took him to the vet. Martha he is at the sean home. A happy kitty. Reports of isis terror group was injured in a round of Coalition Airstrikes in iraq. What really happened there. Were still getting to the bottom of it. Well bring you the latest. Eric it has been 25 years since the fall of the berlin wall. The moment that freed an enslaved people. But up next, why Mikhail Gorbachev who headed the soviet union at time is warning that we could be in the midst of another cold war. Take control of your retirement today martha airstrikes in iraq reportedly injuring the head of isis and potentially killing one of his aides as well. The terrorist leader was critically wounded near mosul, but pentagon officials have not issued confirmation of that. Were working on it right now. We welcome everybody pack to hour two of americas newsroom, im martha maccallum. Eric im eric shawn in for bill hemmer this morning. Ten Armored Vehicles were destroyed that was targeting that possible gathering of isis leaders, but the fate of the founder of the Islamic State, well, thats still unclear. The pentagon is skeptical, they say, of iraqi reports that albaghdadi was wounded. Meanwhile, the u. S. Is stepping up pressure against the radical islamist terrorists who are talkin so much territory taken so much territory so far. We have Fox News Team coverage on the decision to double the number of troops in iraq and Catherine Herridge on albaghdadi. Martha lets get started. Good morning, catherine. Reporter thank you, martha. U. S. Officials are citing the fallout of these airstrikes near mosul close to the syrian border, targeting the leadership of isis, a counterterrorism source tells fox news there was a spike in chatter after the strikes from social media accounts linked to known isis members and followers. The messages said the leader of isis, albaghdadi, had been killed or injured. Some accounts alleged it was simply a rumor designed by the u. S. To force albaghdadi to make a proof of life and reveal more information about his location. The bottom lewin, according to a line, according to a counterterrorism source this morning, is followers on the web are ultimately confused about the leaders fate, and many of these accounts have gone dark because theyre seeking more clarity before they make more pronouncements about his status. Martha all right. So these reports are coming from iraqis, and we dont know yet whether or not any of it is credible, right . Reporter well, social media has been driving this story, and some accounts are directly linked to the Iraqi Government or deemed friendly to the Iraqi Government. And they have been providing the most details about the village involved as well as the number of injured and those killed. We have one account here as an example that goes as far as to claim that one of the isis leaders senior deputies was killed. U. S. Officials have not offered specifics on the targets, nor the effectiveness of the strikes. In one release stating, quote this strike demonstrates the pressure we continue to place on the isis terrorist network and the groups increasingly limited freedom to maneuver, communicate and command and control. And weve also had confirmation again this morning that the target was the leadership of this group. But, again, its not clear whether they were able to get albaghdadi or whether he was injured or missed entirely, martha. Martha all right. More to come. Catherine, thank you very much. Reporter youre welcome. Eric meanwhile, the president says the u. S. Is entering a new phase in our fight against isis. 1500 more troops will be going to iraq. The pentagon says their role will be to train and support the Iraqi Military. National security correspondent Jennifer Griffin has more on that live at the pentagon. So, jennifer, does this mean that any of our troops potentially could be in any sort of combat roles . Reporter no, eric, not according to pentagon officials who i have spoken to or to the commander in chief himself. What it signals is a new phase. First of all, lets be clear, isil is a threat not only to iraq, but also the region and, ultimately, over the long term could be a threat to the United States. Reporter the u. S. Strategy until now has been to carry out airstrikes averaging about five targets a day according to the releases provided by u. S. Central command. There are currently 1400 u. S. Troops on the ground. The white house announcement on friday will more than double that number. The additional 1500 u. S. Troops will be trainers and advisers. The pentagon explained that they will need 5. 6 billion for more training. The u. S. Spent tens of billions of dollars to train the iraqi forces before leaving in 2011. Two of the training bases, were told, will be expeditionary in nature according to defense officials, eric. Eric and, jennifer, why now . Why are they announcing the doubling of troops that just happens to be, guess what . A few days after the midterm elections . Why didnt they announce this before . Reporter well, a good question. Both the white house and the pentagon officially are denying that the political call p daughter had anything to do with the timing calendar had anything to do with timing of the announcement. Its being done now, quite frankly, because the iraqis have reached they have demonstrated the willingness and the skill to go after isil. So theyve reached aoint where they need additional help and guidance, particularly in areas like barn. Reporter like anbar. In an unusual move, the president invited the Top Commander to have lunch with top congressional leaders on friday to explain the strategy, a sign that the Administration Knows it is going to need a lot of support on capitol hill to fund the next phase of this strategy. Eric jennifer, at the pentagon as always, thank you so much. Martha . Martha on the home front, president obama defending his policies as he wrestles with the fallout from the midterm election, the president taking the blame for stunning democratic losses, essentially telling Bob Schieffer over the weekend what weve got here is a failure to communicate. I think that one thing that i do need to constantly remind myself and my team of is its not enough just to build a better mousetrap. People dont automatically come beating to your door. Weve got to sell it, weve got to reach out to the other side and, where possible, per persuade. Martha brit hume joins us now with his reaction to that statement over the weekend. Brit, good morning. Good to have you here. Good morning, martha. Martha the president says theyre not good at getting their message across to the American People. Well, he did say after taking two or three days of pounding in the media for not accepting responsibility for it that he was, as the head of the party, ultimately accountable, and that was, i think, in most peoples eyes a step in the right direction. What id say about his observation is people always say we just didnt sell it well enough. Either i or the candidates out there simply didnt make the argument effectively, and thats why we lost. The problem is, martha, i think its a failure to recognize that what i think people are objecting to by their votes in this midterm was that it wasnt so much that they have dug down into the details of the Obama Policies and decided they dont like them. Some people have done that perhaps. What they dont like is what they see as the results. And the results for too many people have not been enough to make them want to enforce this party and its endorse this party and its candidates. We all know the unemployment rates a little, more than a little misleading because so many people have dropped out of the work force and are, therefore, not counted in it. There are too many people out of work. And those that are working find that their wages are stagnant which makes life harder and harder for them. Theres no sense they have real upward mobility. They cant make an extra dollar. So these are the kinds of conditions that weigh very heavily on any incumbent president and on any incumbent party. And its not the policies per se, its the perceived results of the policies. Martha and simple dissatisfaction that was registered really, you know, across the board. Yeah. How do you tell somebody whos out of work or isnt making a decent dollar that things really are good . You just dont get it. Martha that they just dont understand the policy clearly enough. Exactly. Martha so now the question becomes, what now . They met at the white house on friday with congressional leaders and, you know, this is supposed to be the beginning of a new future, ostensibly, and there was a moment that was reported by both the wall street journal and ap where joe biden apparently brought up, you know, well, why dont we ask the republicans, prime mr. Presidenf they need more time to form late their formulate their best take on the immigration issue, and apparently the president shot him a cold stare across the room, and that shot that down. What does that tell us . If youre a republican negotiating with barack obama or entering into the early phases of a negotiation with him, you have to remember a couple of things. One is hes not particularly good at getting a yes from both sides. He doesnt seem to get very clearly what the other side needs and understand its political situation which you kind of have to do to have an effective negotiation. A lot of them are doubtful about his intentions, whether he really negotiates in good faith. And theres been suspicion in some conservative circles and among republicans that the president is more interested in setting traps for them than he is in making a deal with them. So they look at his intention, which was expressed apparently with some firmness in this lunch meeting to go ahead and issue an executive order liberalizing our immigration policies in the way he wants, to the extent he thinks the law will allow him to do. The problem with that is if that happens and youre trying to write an immigration bill, youve got to sell it to conservatives in both bodies, both house and senate. And if they believe the president is prepared to ignore the law or take it to its outer limit, they will not believe that hes prepared to enforce it fully when it comes to immigration. And, therefore, no matter what Immigration Enforcement provisions, border enforcement provisions you write into the law, they wont believe them. Itll never be enough. And, of course, the one suspects then that that may be what the president wants. If no immigration bill passes and all we have is a temporary executive order, which is all it can be, the belief among democrats and in the white house may be, well, good, that sets us up better for 2016. Martha yeah. Great points. Brit, thank you very much. Good to see you. You too. Eric a stunning and some would say offensive and insulting revelations from one of the architects of obamacare. He said the administration had to deceive thats right deceive the American People. Basically, lie to us or the Affordable Care act, he says, would never have become law. Plus, well have this planes up there. Sounded like stuff was exploding. And pretty much cars was, like, wrecked. March a march two men commit a brave act to pull a trapped Police Officer from a car wreck. Eric and the leader of the soviet union has a chilling warning to the u. S. Been 25 yeas since the fall of the before lin wall and the end of communist grip on millions, but he says we are on the brink of another cold war. Mr. Gorbachev, open this gate. That cruiser burst into flames after colliding with a pickup truck in they have philadelphia. Even as those flames threatened everybody inside, the two young men managed to pull the dazed driver out of that pickup truck are. We pulled the cop to the side, and we pulled the cop to the side, he was like, yeah, im okay, thank you, guys. We pulled the passenger out, he had minor injuries. Kind of didnt really move. Eric get this, one of the rescuers was a 17yearold volunteer firefighter. Thankfully, both the Police Officer and the truck driver, theyre going to be okay. Martha well, the fall of the berlin wall 25 years ago a key event, of course, in the collapse of the soviet union, leading to the end of the cold war. Former soviet leader Mikhail Gorbachev is saying global tensions are pushing us to yet another cold war. Translator blood shedd in europe and the middle east against the backdrop of the dialogue between the major powers is of enormous concern. The world is on the brink of a nuclear war, some are even saying that it has already begun. Martha general jack keane is chairman of the institute for the study of war and a fox news military analyst. General, good morning. Welcome. Good morning. Martha what do you think about gorbachevs comments there . He think hes largely correct. I mean, were in the beginning stages of something that seems all too familiar to us that goes back to postworld war ii and if 40 years and for the 40 years, the tensions we had between the west and the east. It has to do with, certainly, putins desire to create a new russia at the expense of the United States and Eastern Europe. And i think we contributed to some of the rise of this, martha. I mean, the hubris and celebration of defeating the soviet union, as we like to express it in article and opeds after 1991, meanwhile, the russian people who are very proud were listening to this, and now somebody is appealing to their nationalistic pride. Putin enjoys over 80 popularity rating in russia despite some of the difficult challenges the people are living with. Martha yeah. Its an interesting comparison to what happened in germany after world war i, that they were left in such an economically disadvantaged position that it allowed hitler to rise up because he gave them National Pride. Yeah. Its a striking similarity, circumstances are a little different, but the fact is its very much the same. You know, we sanctioned germany for the horror of world war i, so much so that it gave rise to nationalistic pride, to hitler and naziism. And putin has made public statements about the collapse of the soviet union, catastrophic event, you know, of the 20th century. You know, the russian people are suffering. The economys in the tank, they have some of the highest hiv and cardiorespiratory and alcohol problems in the world and, frankly, their mortality rates for an industrialized state, theres only one that exceeds its, and thats south africa. Theyre more like a third world country, frankly. The people are suffering, but putin appeals to their pride of the sense of russia returning to greatness. Martha and all the while putin becomes even more aggressive in ukraine. There are more reports this rning aout that aggression and it escalating while so much of our focus is on isis. Hes continued to move forward in that venue. So what do you do, becomes the question. I mean, you cant suddenly, you know, sort of reach out to putin and, you know, kind of take away that negative feeling that existed after the cold war that has been called triumphalism. I disagree with Mikhail Gorbachev later on in that speech, he thinks we should pull back on the sanctions with russia, we should engage them more. I think thats absolute foolishness. Putin sees the United States disengaging, he sees the weakness of europe, and hes taking advantage of that. He sees it as an opportunity, and the fact of the matter is our sanctions, i dont believe, are tough enough. I think hell continue to move until we stand up to him, and thats whats needed here. Martha i mean, the end of the cold war came about because of a very firm policy. It was a combination of outreach and firm policy that allowed, you know, the wall to come down, it allowed gorbachev to be part of that process, ultimately, right . Yeah. We had a policy and a strategy that transcended democratic and republican president s. It was contain the soviet union, do not let them advance, and eventually this system will collapse inward. And that proved to be the case. It was a very good strategy. We had to be firm and stand up to them, to be sure, and i think the same thing is needed now as putin is considering expanding into Eastern Europe and challenging nato. Martha just got a report that there was just a passing moment, i guess, of interaction between putin and obama at apec, so itll be an interesting process as we watch that relationship move forward. General, thank you very much. Good to see you, as always. Good seeing you, martha. Erik eric well, if you havent had time yet to unpack your coa you better. Gonna be a serious arctic blast on the way in the lower 48, and, you know, its only november. What can we expect coming next . Martha and led zeppelin together again . Not so fast, folks. Rock and follow rock and roll fans hear what robert plant thought of the idea. Wait until you hear what he did. So i can reach ally bank 24 7, but there are no branches . 24 7 its just im a little reluctant to try new things. Whats wrong with trying new things . Feel that in your muscles . Yeah. I do. Try a new way to bank, where no branches equals great rates. Up to 27 more brush movements. Patented Sonic Technology with get healthier gums in two weeks. Innovation and you Philips Sonicare save when you give Philips Sonicare this holiday season. Martha not every day you get to hear that on americas newsroom, suffice it to say led zeppelin will not be getting back together anytime soon. The story goes that lead singer robert plant was working on a deal for the band to get together and tour, but he ripped up an 800 million contract. Wow. I think, you know, that makes beyonce blush. [laughter] billionaire Sir Richard Branson was willing to fund the tour. The ore band members were onboard, but without plant, theres no deal for a led zip lin tour. It is one of led zeppelin tour. They broke up way back in 1980 which will make a lot of people out there feel old. Eric 800 million in well do it for 8 million. [laughter] martha somehow, i dont think people would show up for us. Eric you never know. [laughter] well, bundle up. Youve heard about this, its going to get chilly and much colder than normal. It is winterer, after all. But a blast of arctic air is set to descend on the lower 48. Maria molina, how cold will it be . Oh, boy, its going to be well below average. Were talking temperatures up to 40 degrees colder than whats normal for this time of the year across parts of the lower 48, and its already starting across parts of the Northern Plains and also into the northern rockies. We have a winter storm underway, wasnt weather warnings in effect across montana, the dakotas and across portions of the great lakes. Throughout the day and also into tonight, and some areas could be looking at more than potentially a foot of snow, and the wind is also going to be a concern. Were looking at gusts potentially over 20 or even 30 Miles Per Hour so, of course, producing whiteout conditions on the roadways, thats going to be a big concern. Now, temperatures behind the storm system, thats going to be another issue and probably a bigger story for a larger part of the country. Heres the temperatures coming up as we head into tonight and also into tomorrow morning. In rapid city youre going to be looking at temperatures that are below zero. Not even below freezing, below zero. Tuesday night into wednesday morning, that cold air continues to spread westward, southward and even eastward, and wednesday night cold temperatures reaching parts of the east coast, new york city hovering right around the freezing mark, in cleveland in the 20s, Single Digits in minneapolis. High temperatures look a little better, 30 in minneapolis for today, but the cold air is spreading. Heres the temperatures over the next few days. By thursday, in the 40s all the way down to the city of dallas. Eric all right. Time to cover the garden and make sure the pets are in. Yep. Eric maria, thank you. Martha a former obamacare adviser slamming the intelligence of the American People in this. Listen for yourself. Lack of transparency is a huge political advantage. And, basically, you know, call it the stupidity of the American Voter or whatever, but basically, that was really critical to getting this thing to pass. Martha well take a look at his comments. Eric and former president george w. Bush is opening up not just about his decision to invade iraq, but his father facing the same thing in 1991. Dad understood this better than anybody, when you Say Something as president , you better mean it. Words mean something. Martha pack to that fox back to that fox news alert, dozens of teenage students are dead after an apparent suicide bombing at a school in the nigerian city of pottaskam. A man disguised in a School Uniform walked into an assembly and set off a blast. Chief correspondent Jonathan Hunt following this developing story for us. What do we know about this so farsome. Reporter well, martha, it appears to have happened just as the school day was beginning and, clearly, was an attack designed to cause the absolute maximum number of deaths and casualties. The suicide bomber, as you mentioned, dressed as a student walked into a hall where all of the students had gathered for morning assembly, then detonated the explosives. He was apparently carrying them in his backpack. The latest figures were getting are 48 killed and dozens more injured. Hospital workers say many of the injuries are critical, there will be many amputations. As you can imagine, the parents of these kids ran to that school to try to find their children. They got there, apparently, around the same time as the nigerian army, and the parents then turned their anger on the army, pelting them with stones. Theyre furious that the nigerian authorities have not been doing more to stop this kind of ongoing attack. Weve seen many of these, of course, recently in nigeria, martha. Martha this group has gripped so many people with fear, and theyre the same group that kidnapped hundreds of school gulls. Reporter yeah. This is boko haram were talking about here, and who can forget those pictures of the more than 200 schoolgirls who were kidnapped back in april. They are still in the hands of boko haram. There have been some optimism expressed by nigerian officials that they could do a deal to get them back. It hasnt happened, and now boko harams leader claims the girls have converted to islam, are memorizing the quran and have been married off. And boko haram has released this video recently. We cant authenticate it independently, but they say it shows their fighters being cheered as they move into some of the towns and villages that they have taken control of in northeastern nigeria as they try to impose, martha, a very strict islam you can state. Marsha . Martha jonathan, thank you very much. Reporter sure. Eric the second open enrollment for obamacare kicks off this week, and this time around the administration promising that the federal web site will this time run smoothly. But as signups begin, there is some stunning new video now emerging that shows one of the architects of the law Jonathan Gruber whos an mit professor actually admitting that a lack of transparency was critical to passing obamacare. Take a look at this video that is surfacing now even though its from october of last year. This bill was written in a tortured way to make sure cbo did not score the mandate taxes. If they do, the bill dies, okay . So its written to do that. In terms of riskrated subsidies, you had a law which said Healthy People are going to pay in and sick people get money, it would not have passed, okay . People, transparency lack of transparencys a huge political advantage, and, basically, you know, call it the stupidity of the American Voter or whatever, but basically, that was really, really critical to getting this thing to pass. Eric what . Katie pavlich is the news editor for town hall. Com, mary ann marsh, welcome both. Katie, so were stupid. They lied, and if america really knew the truth about obamacare, it never would have passed. Is that, essentially, what he is well, that is, essentially, what he is saying. You have to keep in mind that the American People have known the truth about obamacare since it passed. Obamacare has never been a popular piece of legislation. Harry reid, when it passed in 2010, had to rewrite senate rules to push it through. And, look, he talks very specifically about torture, you know, specifically going around Congress Even to avoid the cbo scoring the bill as a tax. They lied to the American People, said it wasnt a tax, and then in front of the Supreme Court argued it was a tax so it would pass and get the votes that it needed. Every single thing about obamacare from its passing until now has been a lie. You can go down the lie. The president saying you can keep your plan if you want to, he promised your plans not going to change, youre going to have more access to doctors, not less, thats a lie. Seven out of ten doctors are retiring as a result of obamacare, access to care has been limited despite the president saying its going to be expanded. Everything about obamacares been a lie up to this point, and theyre finally admitting it, and the American People arent stupid, by the way. They knew exactly what it was going to be like, and although mr. Gruber wants to say lack of transparency is politically expedient short term, its not long term, and thats why we saw a bloodbath with democrats last week. Eric mary ann, is he saying were stupid and they lied completely . That seem to be what his words are. How does he get out of this . I think the American Voters are a lot smarter than an mit professor whos dumb enough so so to say that. [laughter] heres the facts, republicans are going to try to repeal it with all republican votes. So they have the votes to repeal it, but president obamas going to veto it. Thats why theyre already putting pressure on the new majority leader, mitch mcconnell, the republican, to try to do that by reconciliation where they only need 51 votes. So you have the aca passed with all democratic votes, youll see it repealed by all republican votes, and thats where were going to end up. Eric mary ann, excuse me more interruptioning, but it passed with this guy saying they pulled the wool over our eyes, they made fools out of the Supreme Court, they knew if they wrote it as a tax, it wouldnt get passed. They knew these are his own words. In terms of Healthy People, sick people getting money, it would not have passed. So thats why it passed, so this guy is totally lying to us. Heres the good news, Jonathan Gruber is neither the president of the United States, nor a member of congress. [laughter] what is going to worse, he wrote it. The voters hold on, katie. The fact here is democrats were voting for the Affordable Care act no matter what period, end of sentence. Republicans are going to vote to repeal it, and the Supreme Court is reviewing it, period, end of sentence. The fact is going back to what brit hume said earlier in this hour, even though people care more about the economy and getting people back to work, were going to spend months and months and months now on the Affordable Care act. So be it. Eric the worse news is gruber was one of the architects of obamacare thats the thing. He is not an elected official, he didnt get a vote from the American People, and the bottom line is hes admitting what we already knew, and thats the administration as a whole and, by the way, this is throughout the obama Obama Administration, they lie about a lot of things, but specifically about obamacare. And the idea that its only going to be republicans repealing parts of obamacare, theres bipartisan support to repeal the medical device tax which is killing jobs and innovation, a lot of things that both would agree on eric what happens with obamacare now, quickly, especially in light of these unbelievable comments . Katie . Is. Mitch mcconnell has already said, look, were going to put some things on the the table that democrats and republicans agree on. I just mentioned the medical device tax. The Obama Administration has, in fact, done things to delay parts of the bill. The individual mandate, the employer mandate are highly unpopular, so this isnt just going to be republicans taking back obamacare, this is going to be eric should going around congress and doing it. Eric should he apologize . He should absolutely apologize, but hes not going to. Hes been m. I. A. Eric mary ann, last word. First of all, grubers here in massachusetts, and hes the architect of romneycare as well, so hes right over the bridge here, number one. Number two, mitch mcconnell, its not going to be enough to do a piecemeal repeal. The republicans who just got elected to Congress Wont let mcconnell get away with that, theyre going to tell him to repeal it through reconciliation so they only need 51 votes mary hed harry reid set it up that way. Eric well have to see what the professor has to say. Hes at mit, right across the river. There you go. Martha former president george w. Bush talking about his decision to invade iraq where his father chose not to more than a decade earlier. It is all in president bushs new book, 41 a portrait of my father, and it is about their unique and loving relationship. On cbss face the nation, the conversation turned to Saddam Hussein and how 9 11 changed everything. I guess i was just responding to kind of the gossip that tends to work around the political circles that, clearly, he had only one thing in mind, and that was to finish the job his father did. Because my dad decided not to go into baghdad after routing Saddam Hussein out of kuwait. And the reason why is that wasnt the mission he stated. And so i went in there as a result of a very changed environment because of september 11th. Martha and then after american troops pulled Saddam Hussein out of that spider hole, he apparently told interrogators that he didnt think president bush would follow through on his ultimatum. You know, when he was captured, i was told that the fbi agent that talk talked to he said i just didnt believe bush. And its hard for me to believe he didnt believe me. Uhhuh. Wed given an ultimatum to the taliban and delivered. I make the point in the book, of course and dad understood this better than anybody, that when you Say Something as president , you better mean it. Words mean something. Martha president bush dud some things that were controversial during his presidency, but he always said he believed he would be judged by history and he felt he could look in the mirror and accept what he had done because he felt it was in the best interests of the American People. Looks like a really interesting interview and book. Eric especiallyy to hear what Saddam Hussein said about president bush. Absolutely. Well, president obama is now named, as you may know, u. S. Attorney loretta lunch to replace eric holder. But what do we know about his choice to head the Justice Department . What the president does in two months is very consequential for the next two years. She is going to have to specifically come to the hill, talk about trying to get better relations between the departments and the hill and specifically answer questions about the executive amnesty. Is it legal, is it constitutional . Martha well, it seems like theyre everywhere these days, the United States post office says it has been hacked, the information of nearly half a million employees has been compromised including Social Security numbers. The Washington Post is reporting that the Chinese Government hackers are suspected in this breach. We should mention that president obama just arrived in china today for an economic summit. Well see if there is any reaction to this news that the u. S. Post office is now just the latest victim of chinese hackers, according to these reports. Eric well, president obama choosing Loretta Lynch for the Eastern District here in new york, brook lip, queens and long island, as his next choice for attorney general as the lame duck session in congress returns. Republicans, though, not happy about that, and some of them wonder could this with could this be all politics . Richard fowler and scotty hughes. She served under two president s, president clinton and obama. Harvard, shes a veteran prosecutor, some say shes a safe choice. Definitely a safe choice, very well qualified. In fact, i think shes probably more qualified than eric holder. [laughter] but the question is, is that president obama did her no help by appointing her literally four days after he got shellacked by the gop. That first raises a lot of concerns, and then people start looking into her which is theres not much to look into except for a very good, even record when it comes to who she prosecuted, but we dont know much else about her, like where she stands politically outside of a couple sound bites she might have given in the past. Eric well, richard, wont that come out in potential confirmation hearings . Definitely, eric, and thats why we have them to given with. Lets be very clear about the timeline. Eric holder said he would be leaving in december, so this should not be a surprise to any member of the United States senate. We knew that eric holder was leaving, we knew the president was going to pick a replacement, we knew it was going to happen in this timeline. This is something we already knew. So you think he just woke up on saturday morning and thought, hmm, im going to wait a second. I think the president s been looking through a short list of picks, he happened to pick her this weekend, but we already knew, once again, that eric holder was leaving at the end of this year. If he did not pick before then, we would have an attorney generals position that is unfilled which nobody wants. I guarantee if the president had this planned, then he probably, if you didnt worry about her and the influence she would have on the elections, he would have announced her a week ago or two weeks ago. That was the whole thing, he waited until after the elections, and i think he really hopes these confirmations happen during his lame duck session because he knows its going to be tougher but heres the thing, though, it shouldnt be tougher. She has a stellar record, shes an awesome prosecutor, shes fair, shes even. Theres nothing wrong with her as an attorney general, so this should be a very easy confirmation whether democrats or republicans are in control. Eric shes had some astounding cases, the poor haitian immigrant who was abused in a new York City Police precinct that led to a long life sentence to one of those convicted. But what is she going to do as attorney general . Youve got the irs investigation. Is she going to come clean about that . Youve got fast and furious and all these other controversies. Listen, im not going to debate, she does have a tell lahr record. But shes seen as an outsider to the obama clan which can be good per se, but why is he just now bringing her in . And they think, and this is kind of what obamas hoping for, is because she hasnt been attached to things like fast and furious, she hasnt made comments on the irs targeting or any of the other issues this president continues to face, that maybe she wont necessarily be questioned and just say, you know what . I wasnt there, i wasnt a part of it. Eric but if shes such a good prosecutor, sorry to interrupt, if shes so stellar, is she going to go after that stuff . Thats the question that president obama is hoping she can say, you know what . She wasnt a part of it, its a new day in the Obama Administration. But wait a second. I think its very unfair to label her and throw all these things on her that have nothing to do with her. That was the previous attorney general. This is a new attorney general with a fresh start. I moon, i dont understand why i mean, i dont understand why were making this about eric holders because shes going to have to percent eric holder prosecute eric holder. Thats crazy. This is about Loretta Lynchs record and whether or not she can be a good chief Law Enforcement officer for the United States. And we agree on that point. Weve already agreed on it eric richard . Lets have a speedy confirmation here. Eric richard, last word. Do you think she will objectively as a fair prosecutor she has been here in new york city actually look at the evidence and potentially prosecute anyone at the irs for that targeting scandal or any of these other scandals that have afflicted the administration . She has to hook at the record first. Knowing her record, i guarantee shell look at the facts and make a determination from there. Eric all right. Well see as soon as the confirmations start. You know those questions will be asked by the senators. Thank you, eric. Martha jon scott, lets find out whats happening at the top of the hour on howre howre. Pizza is a vegetable, so our government said that. [laughter] our original project is we air drop pizzas in afghanistan, we deliver to them. Weve delivered over a million slices. We have the guinness book world record of biggest pizza delivery and party of 30,000. That was a few years ago i was on your show. Now we are here a few years later with pizza parties at v. A. Hospitals, and were calling it adopt a v. A. For our veterans. And this time we want to achieve, our goal is 50 veteran hospitals, one in each state, with our ultimate goal being 250 veteran hospitals. We know we can do this. I announced on the fourth of july we need a national company, and Little Caesars gave us a call and said we want to help. So were very blessed. We think we can do them all here very soon. See what happens. Matha thats great. Go ahead. Go ahead. Our other mission is this time on veterans day is Operation American flag challenge. And it occurred to me a few months ago about our National Pride is pretty low, and i remember 9 11, all the flags that were flying. And i was trying to figure out what was going on, and people were scared. They were proud, but they were scared. And we need our National Pride back. And what better way than turning to our veterans who would give anything and everything for this country, past and present . So thats our goal, and we want to set aguinness world record of flags hanging on houses. Im asking everybody, every house, every building, hang a flag in honor of this. You can go to our web site, pizzas for patriots. Com, and you can certify that you hung a flag. You can tell us you did it. Martha were going to help you with that. Well put something out on twitter, and everybody can respond about their flags hanging outside their house. Itits a great idea, and i know you get a fantastic response from people when they get that nice, warm slice of people. When youre not at home, when it comes to food. Thank you so much. Great to have you and well keep breaking the world record all the time, and whoever doesnt hang a flag, if you see a neighbor, you go over there and tell them Sergeant Evans wants them to do 100 pushups for patriots.
