jane: no saturated fat for you. jon: have yourself a great weekend. jane: "america live" is up next megyn: thanks, guys. got my red on, too. a very worthy cause. we begin this hour with breaking news. new weather warning here on "america live." i'm megyn kelly. batten down the hatches. brutal winter storm is on its way. some 31 million people saw none out in the paths of the monstrous system. expected to slam the east coast. travelers across the country will likely feel the effects. live pictures coming back from the nation's capital. they have all but shut the city down and sent just about everybody home. the fox team coverage. >> reporter: this is going to be one for the record books. the big snowstorms we have seen. 1922, 28 inches. that is 20 inches. we could be the second-biggest snowstorm if we, indeed, get 24 inches. we could get even more than that. we will have to watch this storm very carefully. look at this monster across the ohio river valley. 6-12 inches. heavy rain. this is the bull's-eye. d.c., baltimore, richmond, del mar peninsula where you could easily get 12-24 inches. in some cases higher amounts. when the warnings in effect for parts of new jersey as well as delaware. vocalized amounts of over 24 inches, blizzard conditions. this is going to be nasty. good thing this is happening on a weekend. it is going to shut the city of d.c. down. there is the breakdown. easily 24 inches. a lot of these areas are pushing for over 7 inches. megyn: when will it come, and when will it go? >> reporter: coming right now. an overnight event. we will see that to feed on the ground. megyn: icahn ago that it happens to be national weathercasters day. so your present is a huge, huge blizzard. >> reporter: when can i eat cake? megyn: not until tomorrow according to you. thank you. well, blizzard winters go into effect in parts of new jersey just hours from now. you can see the pictures. the storm is moving up. many other parts of the state will be under a winter storm warning. a fox affiliate is covering the storm from wildwood, new jersey. what are the big concerns there? >> reporter: i don't even know where to start, megyn. they have a ton of them. kelly@foxnews.com the account, it is. the get the big beach. this is the fourth saturday this season alone with the east coast beaches are about to get battered. deep snow is really putting a scare and almost everybody the biggest buzz is over beach and business erosion. the protective sand dunes, they have already been completely swept away. that has left oceanfront property super vulnerable to this coming super storm with high wind, high tide, and heavy snowfall expected to do heavy heart. i tell you, i grew up on the beaches here along the jersey coast. i worked in buffalo for gears. never in my life have i heard the word blizzard and beach in the same sentence. megyn: you already took a hit on the jersey shore. so it is not the best time. thanks so much for the update. we appreciate it. well, this storm is causing a major headache for anyone trying to fly to or from the east coast. airlines are already canceling hundreds of flights. do not go to the airport without calling first. some are letting you change your plans for free. trace gallagher following this piece of the story. you know it has got to be bad. trace: it is going to be bad. i want to show you what is already happening. canceled flights, changing fees. look at what is already happening. a lot of this note has not yet even begun to fly. u.s. airways canceling flights into washington d.c., philadelphia, all of the new york area. like at southwest airlines. already canceled all of their flights into baltimore, washington, and philadelphia for saturday. they will kind of play it by ear as far as sunday goes. midway airlines is also canceling flights. these are the airlines that are offering no fee travel changes. a motivational thing. they are saying if you don't need to travel this weekend we are going to help you out. change your ticket. we are not going to charge to. midwest, southwest, united airlines. i want to give you an idea of the scope of this thing. these are the airports involved. we are not showing you all of them because we just don't have the map. we are talking about 14 airports. these are the big ones. baltimore, washington international. hartsfield, which is one of the busiest airports in the country. and all we are talking about 14 big-time airports in this area of the storm. 8,000 flights coming and going every single day. 600,000 passengers, megyn, are going to be affected by this. like you said at the top, do not go to the airport unless you find out. even if you are flying out of san diego in to these places. megyn: it is actually a good thing this is happening on the weekend. no business travel, or at least less. you have to think about the people who planned weddings, a pretty saturday in february. maybe they thought they would get of the vote dustin. trace: this sunday is a disaster. sundays are a disaster when you have this kind of a backup. happens tomorrow. then you have got to get them home. those airlines can't get out until sunday. those eyes that were going to happen monday, now they are pushed back to tuesday. we are talking about a four day domino effect at these major airports. megyn: the better the well in advance of your flight. anti-semites. well, the number of people filing for unemployment benefits went down slightly in january. the jobless rate fell to 9.7% which is down from 10% the month before. unfortunately the overall number of unemployed in america is still sky high. last month 14.4 million people -- 14.8 million people were unemployed according to the bureau of labor statistics. well, fewer paychecks mean fewer taxes collected, as you know. they are learning that the hard way in harrisburg, pennsylvania. the city is facing $68 million in outstanding debt-payment. that is 4 million more than the entire operating budget. they are thinking of filing for bankruptcy. this is the capital of pennsylvania saying that it cannot pay its bills. a chapter nine bankruptcy filing does not mean folks at the close of their houses and get back out, but it does allow the city to renegotiate its contracts and restructure its debts. meantime there is a new apology from toyota's president today apologizing for massive recalls that have left a major dent in the company's reputation. comes as toyota reconsiders or considers, i should say, another round of recalls. outside a lexus dealership, prius and now lexus. is there a recall or no recall? >> reporter: recall or no recall. we don't know. they basically the thought is the previous, 270,000 of these hybrid vehicles may have problems with the brakes. customer complaints. more than a 100. a slight delay in the break mechanism. that certainly could be dangerous. the lexus hybrid has the same braking mechanism which was redesigned in the 2010 model. when the president spoke today he did not specify whether there be a new recall on either the pruis or on the lexus. we are outside the lexus dealership waiting for them to get word. toyota, although we have been talking about this because of the millions of cars, i will get to that in a minute. ford, too, has had their share of recall issues. they are looking at the brake systems into hybrids. the 2010 ford fusion and the mercury milan. those car buyers also need to keep an eye on those break mechanisms. megyn: wow. in the meantime toyota's president holding an emergency conference in japan. what he had to say? >> reporter: well, akio toyoda, everyone wanted to know when he would address this issue. the u.s. representative had. he hadn't. millions of cars were not so because of problems with rapid acceleration and an accelerater pedal that would get stuck. and floor mats. if you have them get them out of the car. don't put them back. the repairs are under way. many dealerships stay open 24/7 to get that done. he did not address the new recalls. other than apologizing . megyn: a solid report. thanks. >> reporter: take care. megyn: new reports on how the president's team decided on the new york terror trials. pete king on who was for this idea, who was against it, and what happens now with the mastermind behind 9/11. and brand-new information about the shark attack that killed this kite surfer. hear what the lifeguards actually shot when we return. >> we noticed the kite boarder has gone down in the water. a lot of blood in the water. you see some other sharks in the area. megyn: welcome back. new information about that rare, deadly shark attack off the florida coast. authorities now say that it appears 38-year-old stephen schaefer was bitten by just one shark while he was kite boarding in stuart, florida. witnesses say there where as many as three sharks in the water. a lifeguard who tried to rescue schaefer is now talking about what he saw. >> i took the rescue boat out. it was, the seas were pretty rough that day. i was probably about maybe 15 yards or 20 yards of him. he was telling me he had been bitten by a shark. i then kind of came around to the front. the kite, there is a lot of blood in the water. you see of the sharks in the area. megyn: this is the first deadly shark attack in florida in five years. tonight on the "o'reilly factor" at 8:00 p.m. eastern time they have an exclusive interview with that lifeguard. he will tell his story in full. well, new reports this afternoon of some ugly fighting within the obama administration. the "new yorker" reports that two of the president's closest advisers went toe to toe over a decision that has outraged many americans. white house chief of staff emanuel vehemently oppose the decision by eric holder to try self-confessed 9/11 mastermind laura silsby khalid shaikh mohaw york city federal court. emanuel did not want that. vowed eric holder would get the blame if that decision alienated some in congress. indeed it has. good afternoon. >> great to have you back. megyn: thanks so much. great to have you on. this is interesting. they don't normally show this political divide. but emanuel saw the storm that would accompany this decision. it looks like the obama administration and outside of emanuel did not because it decided to proceed with this. we all know what the consequences have been. where does the thing stand now? does khalid shaikh mohammed get tried in new york or doesn't he? >> reporter: i don't know for certain. the white house, anonymous sources say they directed the justice department to take the child out of manhattan. but you hear virtually nothing from the justice department. it is ironic. it was first announced back in november that the white house had nothing to do with it that it was entirely a justice department matter. now you have the white house putting pressure on. over the last few weeks on capitol hill, but i think an ideologue, eric holder, who has done a terrible job as attorney general, over the series of decisions that he has made, he has his own ideology. he is fixated on it. he has no political sense. think he is wrong legally and policy wise. he is also very much out of touch with the american people. one thing about the manual, i admire d mire his political skills. how this could be so unpopular. of course the backlash of the american people. megyn: he is supposed to have the president's back. he is supposed to make sure the president does not get embarrassed. he fought against this. including lindsay graham. to close gitmo. now, he foresaw it would upset graham. but let me ask you this. ultimately the decision here would not have rested with the president. can eric holder say we are going to do it in new york on a decision this big do you think without running that by the commander in chief? >> reporter: if he did then it is a dereliction of duty. this has far more than just legal consequences. extraordinary diplomatic consequences. has consequences all over the world. the president of the united states as commander in chief has to be in charge of this. this is part of the war against terrorism. if he did allow eric holder to make the decision is a dereliction by the president. if he didn't and obviously he has to step in. i just feel interrogators or assisting, i think the president is giving him far too much of a free hand. but it is the president's decision. he has got to make it. it is not for emanuel to say it is the wrong thing to do. now if they want to change it the president has to do it. you can't leave eric holder to determine our entire policy is. megyn: i have to ask you, sir. whenever we have somebody on the other side, they say there is nothing wrong with our criminal justice system. we can handle khalid shaikh mohammed and his compadres in our american justice system. this is much ado about nothing. your response. >> first of all, this is very, very important. we can convict him in federal court. this is the question of conviction. how we going to put terrorists into the criminal justice system which makes it much harder to get intelligence and information from them. i go back to the question of eric holder. osama bin laden is captured tomorrow on the battlefield is he going to be read his miranda rights? been awhile since the president has had a news conference. that may be part of the white house strategy. major garrett is live at the white house. major, it is not only been a long time since a full-court press conference, but the numbers of the white house reporters has diminished. the reporters don't get to ask as many questions. >> reporter: that is right, megyn. it has been since late july since we had a full-blown press conference with president obama. also since then the number of times we have had a chance to throw questions on a daily basis to the president in what are called pool sprays. reporters come into the see the president for a few moments. previous presidents were much more open to the taking questions than this president. he much prefers a more formal and controlled atmospheres. and a political science professor who spends a lot of time here at the white house calculates all the numbers on what president obama does in communication with the media as has previous presidents. she says there is a pattern that puts president obama more in control of this message. let's take a look. >> when you're dealing with a short question and answer session you are asked to comment on the topic of the day. you may not feel like doing this. you would prefer not to talk about it. that format is an interview. >> reporter: i can tell you, from myself and my colleagues at the white house the one goal we have every day is to drive the white house and the president of whatever they're prepared messages. no reporter wants to be a stenographer. you're limited in your ability to do that when you can ask the questions. since july of last year the president has really cut down access for us to do just that. megyn: even right now they have turned up the volume morning raising questions about the background of one of those missionaries. geraldo rivera just back from the island is not happy. the island is not happy. he joins me live right here. i've been done word that the capital would be closed for public ublic tours tomorrow. live outside of a safeway grocery store. >> reporter: i can tell you that the snow is falling, and it is sticking to reporters. but not yet the ground. not unexpected. the inner-city is always warmer than the outlying areas. 3-5 inches here. they are now saying somewhere in the neighborhood of 28 inches. if that happens it will be cataclysmic in washington, d.c. we are just simply not prepared for that. take a look at what is going on inside. we have some pictures to show you. the lines run from the front of the store all the way to the back of the store. it is absolutely crazy. it has been that way since last night. safeway is doing a great job of putting food on the shelves, but it is going off the shelves as soon as they hit it. what do you have? what do you have in your emergency supplies? >> oranges, soda, broccoli, popcorn. >> reporter: toilet paper? >> i already got that. >> reporter: is this just emergency supplies or super bowl. >> for super bowl. >> reporter: that is the thing. grocery stores are busy. they realize they wanted a chance to come back to the super bowl. we are buckling down here in washington d.c. getting ready for what could be one of the worst snowstorms ever on record. megyn: thank you so much. our vice president of news, bill salmon, just e-mailed me to say they are calling this the snow apocalypse. batton down the hatches. in the meantime on a different note there are growing questions over a group of american missionaries in haiti and controversy over how the cases being handled. ten americans are charged with abduction for trying to take 33 children to the dominican republic. the government says they did not have the right paperwork, the haitian government. the missionaries say never just trying to help these kids. geraldo rivera has been looking into this. he was just down in haiti and is with me now. hello. they say they were just trying to help these kids. they say they had permission. they say they had a local pastor who was paving the way for them. now the haitian government right up to the top says it's not true and was basically a case of kidnapping. >> i think the haitian government is behaving outrageously in this regard. i think that these were niave and, perhaps, misguided missionaries, but there is no doubt there aren legitimate christian missionaries. they did not have the appropriate paperwork. it seems to me they were motivated by all of the right reasons, compassion, the urgent need of these children. and for the haitian government to charge these people with kidnapping, this is a haitian government. remember, their jail collapsed during the earthquake. 4,000 convicted murderers, rapists, and armed robbers escaped the jail. this is a haitian government making no effort to apprehend fugitives. instead it has put the full weight of whatever remains of that corrupt and ineffective government against these ten people. it really truly is outrageous that they did not try to ascertain the truth before they put these people in prison. they sleep on a concrete floor and have very the communication with their people. megyn: let me take the other side. the critics are saying, they just went down there and took them. they just went into haiti and took 33 children without the permission of some of their parents because they aren't all orphans. these poor parents who are walking around already having to deal, they now have to deal with my child is gone because some do-gooder, somebody did the wrong thing to my child. >> i do not believe that there is any evidence to support the verb took. they went to a village, and then there definitely were surviving parents who were so desperate, so unable to provide food and shelter for their own children that they did surrender their own children to this group on the promise that they could retain communication with them after they went into the dominican republic where the group had already set up an orphanage. i tell you why i think they are very sincere. the leader of the church, the central valley baptist church in idaho, last weekend i was the one who told them that there were any allegations of child abduction or kidnapping against the group. here is pastor clint henry. >> you know a lot of the things i am hearing, the first time i have you heard anything like this. my understanding from our team when we had some limited to mitigation is munication is thae working with an orphanage and had been in contact with officials. in fact, when i talked with the team on friday night when they were at the border they indicated to me that they were told they just needed one more document, and that was the reason that i was told that they were going to be going back into port-au-prince. >> 380,000 haitian children who are either were legitimately orphaned or who have been abandoned by their families. many of them small, run by christian missions. i believe for the haitian government, the haitian government should release them right now on their own recognizance and sort this out. don't keep them on prison. megyn: is there anything, the reports of now come out, for lack of a better term, the ringleader, there are some questions about her debts. there were a trail of business. at least eight civil lawsuits. fourteen unpaid wage claims. a fraud lawsuit against her. not the most stellar record when it comes to the law. >> agreed. agreed. even her own lawyer, the lawyer for the group of ten separate laura from the other nine. there are no allegations against the other nine. half of them are men and women. remember silsby, her parents were missionaries. however troubled her own personal or financial life was, to transmogrify her foreclosure into evil intent to sell children is a leap monumental proportion. they've rank at the bottom of the list. a government that has been self-serving for decades. what they're doing reminds me of the iranian show trials. let these people have a legitimate hotel to stay in and food to eat. you sort it out. you will see who is an evildoer into is trying to do the right thing. megyn: i should say this woman was planning on going down there and helping orphans back in november. she had been trying to help these people. in any drop-sided cribs. that would make new york the 9th state in the union to do away with a product that can still be found in millions of american homes. jamie wilson is my guest now. i will go ahead and tell our viewers that i have one of these in my home right now. and i saw the reports that some babies had been hurt. but those early reports seemed to say it was a particular model and brand of drop sided cribs. now that the information is it is every drop sided crip? >> there have been 7 million cribs recalled. approximately 7 million since 2007. this is all different manufacturers. the reason being is the hardware continues to fail, the industry has not come up with a fix. >> how does it fail? i know when the children have died in these cribs. we thought that was just a particular model. but the problem was somehow their heads got lodged in-between the drop side and the mattress. there is an animation. is that just when you have a crib with faulty hardware? if the crib seems sturdy, do you need to worry? >> the problem is we don't know when it is sturdy or not sturdy. the hardware is breaking across the board from different manufacturers. when the hardware breaks it forms a dangerous gap between the mattress and the side of the crib and a baby can become trapped, suffocate, strangle. the crib should be the safest place in the home. >> you are supposed to feel like he's fine, you don't have to keep an eye on him, he's in his crib. but one of the things i was amazed to see is the crib safety standards have not been updated in this country since 1982. that's outrageous. who is watching this? >> there is a new rule being created. there will be a new federal standard created. they are working on a new federal standard and it's a top priority for them. megyn: for other moms and dads out there. the bottom line is i need to get rid of this crib, is that what you are saying? >> we recommend you don't use a drop-sided crib. this is across the board we see failures. megyn: is there a fix? if you take a drill and drill that side shut, does that work? >> it's not something we recommend. you need to look for a crib with stationary sides. megyn: i'm surprised to see that you are pushing to get it so if people have to return their drop-sided cribs, they can get refund or some sort of store credit. is that not the case now if you have a crib that's been recalled. you have to. >> it on the money? megyn: each recall is different. some places are giving you a store credit, some places may give you a refund, some places may give you a new crib. every single recall, 7 million cribs, everyone is handled differentli' to you look at the cpsc site and find out information about your crib, what the fix is and what they are offering. megyn: the practical matter. you buy the crib, you assemble the crib. it's a fun thing. my husband did it, i cheered him on. you are getting ready for your new baby. it costs a lot of money and it takes a lot of effort to put them together. parents are thinking it's a major hassle. how big is the risk. even one child is too many. but children die of a lot of things and you don't know what went into those particular incidents to cause them. how seriously do parents need on taking this. >> i don't think it's worth playing russian roulette when your child is sleeping. we have seen so many cribs fail and a substantial amount of deaths and incidents across the board. it's the one place you have to be able to leave the room for hours, for a whole night and leave your child there. so actually it is the one area where you need to be 100% safe. if you are not there, you can't be there. >> you think about it. you spend $400. you can spend that on a theater tickets in new york or some christmas that you celebrate. it's so worth it to replace a crib even if you do need to pay and dent get the exchange. that's what i'm going to be doing today after the show. what do you think? other mothers out there, health. megyn: new defendments in the investigation into dr. -- new developments today into the investigation into doctor conrad murray. his lawyers allege l.a.p.d. is trying to turn this case into a ridiculous show. what is the latest adam? >> the last couple days have been ridiculous trying to figure out what's going on. dr. murray's defense team say they came to town to negotiate his surrender and he would face charge of involuntary man slaughter. there have been hearings changed or cancelled. the latest is dr. murray was supposed to turn himself in this morning according to the defense team, there would be an arraignment in a courthouse near l.a.x. they say they have not gotten a phone call from the district attorney who made the deal with the defense team. they are planning on walking dr. murray into the courthouse and basically asking, are charges going to be filed, if so, let' get this done. we have yet to get any comment from the district attorney's office. but the defense team says they are going to walk in the door and fox will be there when it happens. megyn: that's procedural. what charges is this guy looking at. >> there have been a number of reports saying he was going to be arrested the next day. everybody does agree on one thing. charges he will likely face will be involuntary manslaughter charges. when you talk to the investigators helping from a federal level. they will tell you this case is extremely hard to fight. you will have medical experts on both sides who will be arguing for and against whether he should be prosecuted. then a jury of people with no medical background will have to wade through this and find him guilty. it's difficult to prosecute, but it's one that's apparently going to go forward. megyn: michael jackson we all >> it's bad news. the unemployment rate dropped by .3 of a percentage point. not a lot. that can only happen when the country continues to hemorrhage jobs in the tens of thousands. discouraged workers vacated the scene. couldn't find work and gave up. the number has grown 50% since president obama took office to over a million last month. why all that discouragement? because the jobless in this recession tend to stay u unemployed four times longer than in normal times. megyn: we may specialize in good news, but i'm looking for good news. do you have any silver lining for us? >> this is in the stayture of stats -- this is in the nature of statistics. the typical workweek has risen by an hour. the white house says the stimulus package is working. this morning president obama's top economist told stewart varney that her boss is supportive of small business he has announced a tax cut for small businesses going on other cuts we had for small businesses in the recovery act. a lending program that helps community banks lend more to small businesses. today he will have another lending increase through the small business administration. >> to put it all in perspective. just to tread water and keep up with population growth. american economy needs to add 125,000 jobs a month. i want to follow up on one thing i heard you report in the last hour. you referenced a geographical location known as the bourbon room. i would like to know more about that at some point. megyn: you have been in the bourbon room many times. who are you trying to kid? now that i think of it, i have photographic evidence to profit. >> i think we need to toss to break. megyn: james, thank you. well, hope you aren't trying to get away by flying this weekend, because airlines are not wasting any time. already canceling flights. along the east coast if you are flying you may not be going anywhere. with several airline hubs affected this could be getting a whole lot bigger. trace? carl cameron live in nashville, tennessee. this tea party is in full swing. what's happening today and tomorrow with the tea party movement? >> if you look over my shoulder here. there is a news conference happening behind me with one of the convention organizers. his name is mark skoda. he's one of the guys who created the memphis tea party group. he's outlining the proposed plan for the tea party movement across the country. they are laying out a plan to create political action committees, and various fundraising apparatus. they are also planning to impose on candidates who get elected a requirement to create a so-called tea party caucus in congress and they attend it, answer to it, and answer for their votes. anybody who doesn't adhere to the tea party line as well as the republican national committee platform could lose their support and their donations. so they are not making a third party, they make that clear. they are asking their candidates to support the national committee platform it's not a purity test. and beginning to put together apparatus nationally so these loose-knit groups across the country can rally behind some basic grounding principles. they are outlining it now, not as a mandate or requirement. this is not an organization that goes for those sorts of things. these are proposals for the folks who put together this first-ever convention. megyn: thanks so much. the tea party convention organizers will be proposing a series of what they call first principles. among them, fiscal responsibilities, upholding the constitution and national security. which principle if any do you think the obama administration needs to work on most. which of those do you think we need to make some progress on? political suicide. >> i don't think it's political suicide. but i have to tell you the thing that's so different from 1984 when the campaign was over to now to today, both as a society, but also how we treat candidates -- when i -- when the campaign was over i think maybe base was the first woman to be running nationally for a major party. i had to be careful about what i did even afterwards to make sure i was in no way putting down the office of vice president and taking advantage of where i was from. i did a pepsi commercial and was criticized roundly for doing it. i was on "saturday night live" and i said absolutely not base wasserified. people were -- i was terrified. people were watching to see how i would react afterwards. here we are 26 years later. it's fair game to do what you a want. that's fine. i think she should not be treated any differently from any guy because she is a woman, and she is taking advantage of where she is and taking advantage -- the other thing that's different is nobody suggested to me i should run for president. megyn: no one ever did? >> no. i never in my head hot i should. -- i never in my head thought i should meg ri you said -- megyn: you said it's sarah palin offering up red meat. but you said she meets to get substantive. she needs to and the questions about her experience and qualifications. do you think it's hard to take her seriously because she is a woman. >> not because she is a woman. i think because she hasn't had the experience. in our presidential primaries, i went through four people. i went through chris dodd because i knew him, i said i could support him, i could support joe biden. and i could support hillary clinton *. she was smart. and she is the one -- that was the -- i never considered barack obama because at that point i didn't think he had the experience. you get past that once you are in a position with him as a nominee and you figure who does he choose for vice president. that's the first serious decision a person has to make once they are a candidate. once joe biden is there, i'm fine, i know we'll be all right. the thing about it, sarah palin if she is serious about being a presidential candidate. she can do what she wants now. it's fun, it's exciting. but if she is going to be serious, she has got to learn the issues. that was the problem with her during -- the debate. i went back to the debate when this was going on. i had been invited to comment, and the two of us were talking about the debate. give went up there i tack a close look -- i took a close look at the debate. by was stunned how it was one issue after another. foreign policy -- megyn: on that point, you reference the debate and now you are chummy with bush 41. but take a look at this. >> let me help you with the difference between iran and the embassy in lebanon. iran we were held by a foreign government. in lebanon, you had a wanton terrorist action where the government opposed it. >> congresswoman ferraro? >> i almost recent vice president bush your patronizing attitude that you have to teach me about foreign policy. >> when i went up to maine, jamie asked me about, were you embarrassed he said, he's such a gentlemen. he said, well, you know, it was one of those things. and she said how do you feel? i said i have heard words, i was a prosecutor. he looked down and said i have a question to ask you. did you really think -- we had such a good laugh. megyn: does she need a moment like that? >> she does. megyn: it was a smackdown -- >> i don't think so. i got a call from joe biden before the debate. i said whatever you do don't put her down. but with something like this, it's not so much that, she has got to learn the issues. one of the things -- you have to look at it and say, in some ways it's fair. was john mccain fair to her because she didn't have the time. during the campaign all i get every morning was issues like this. she has got to start if she is serious. he has got to learn the issues. megyn: one way we'll be able to see if she knows the issues. >> i don't think anybody thought that was an actual sheep. her message is profound, that tom campbell is a sheep demon. we didn't know that. he's been in politics for years. no one knew this. megyn: i saw this ad, i thought, no, that's not real. that's actually her ad. >> it makes you think what whether other ads they were considering. no, the demon sheep one is better. they probably had a satanic panda. megyn: that may be next. they say they stand behind this ad but there will be more. look at it. more even scarier ads coming down the pike from carly fiorina. this is a legitimate candidate. this is not some fringe candidate. >> it looks like a man trying to pick up sheep. i'm going to put on a sheep costume and maybe i'll take a sheep home. it's per verse. i can't even pronounce her name correctly. now i know her. it was brilliant. megyn: it's gone viral. it's working getting attention. >> none of the sheep are going to vote. they don't have the thumbs. megyn: up next we have this guy, this aussie who is the news guy -- the guy in his office is on camera giving a report, and in the back is his colleague who is look at half naked pictures of a victoria's secret model. and what happens? >> his friend says, take that down, you are on tv. they are not dirty, they are just topless. but she is covered. but that doesn't matter. now this guy is telling him wash on tv. this guys -- what have you got on there? there you go. he's a global hero. it's in australia. the man's name was david keely. there is a rumor he will get fired. but the model says she'll sign a petition for the guy to keep his job. this is the best way to meet a supermodel. she now knows his name. megyn: i'll let them give you a laptop when you are sitting out here. these are not the sort of figures you are supposed to be looking at in a bank. >> this happens in every bank. it's unbelievable. the thing is, that was fairly harmless. but guys during lunch hour, they pass things around -- megyn: is he going to be disciplined? you better find it if you live in the mid atlantic states or the northeast. take a look at these pictures. snowstorm for the history books in some places measuring snow. not in inches but in feet. janice dean tracking the system in the fox extreme weather center. the numbers just keep going up. >> 20-30 inches. the national weather service is saying we have 20-30 inches for the d.c.-baltimore area. we have a massive storm across the ohio river valley. this all encompassing along the east coast. as we go through saturday, saturday night, this is out of here. what's left in its wake, 20-30 inches across d.c., dover close to 2 feet. the caveat is we could be dealing with wind gusts in excess of 45-50 miles per hour for an extended will the o -- fn extended length of time. i predict we'll have a baby boom nine months from now. megyn: what makes it a blizzard versus a bad snowstorm. >> winds in excess of 35 miles an hour for an extended will the of time, two to three hours. reduced visibility of a fourth per mile or less. megyn: i didn't even give you a heads up i was going to ask you that. very impressive. friend in washington are calling this snow-maggedon. 30 inches could fall in washington, d.c. and they are not equipped to handle that in the nation's capital. what's happening there? >> they are also saying snow-my goodness. it's more like what the snow looks like on the pavement. this is really the calm before the storm. you can see traffic moving at a good clip. people scurrying to get home. lots of people holding umbrellas. they are calling this a whopper snowstorm. 20-30 inches expected in the d.c. metro area. we have seen fights over shovels in stores. people trying to buy salt, and food. shelves are empty. the forecasters are calling this a big one. right now things seem pretty calm. but the heaviest bands are expected between 7 p.m. and 7:00 a.m. this will cause a lot of outages. so there is concern about that. state of emergency declared in d.c., maryland and virginia. the officials have the right to call out the national guard and assist emergency managers. but it is the calm before the storm. stay tuned because in a couple hours you won't see the pavement. hopefully you won't be seeing me standing out here either. that's the latest from d.c. back to you. megyn: we are going to get to this story. your ketchup is changing. who knew? >> under col law he has met all the element of the crime they charged. the fact that he used a deadly weapon, that he qualify for felony menacing which is not that difficult to prove. you just played a portion of the 911 call which is a prosecutor's dream. they will play that in front of a jury if they don't work out a negotiated plea deal. they will not be sympathetic to the real deal bad boy charlie sheen. his offenses date back to 1990 and include abuse and prior protective orders his previous wife filed against him me. megyn. he shot kelly preston in the arm, it was an accident. a student said he struck her in the back of the head after she refused to have sex with him. difficult niece richards alleged he attempted to hurt her. here we are now with this wife. >> that's coming into evidence. >> i don't think that will come into evidence. i don't. because it -- if this does go forward to trial web's not going to get on the stand to testify. all the prosecutors need to care about in this case is the credibility of his current wife. because that's what this case rests upon. if the facts went down the way she said, this is bad and he will probably see the inside of a jail cell. but if they didn't, what next? this is her word against his word. it's a celebrity case. it's always tough. megyn: the problem for the prosecution is as we so often see in domestic abuse cases is she is no longer cooperating. now she is having second thoughts. they want to be back together. if they can't get her to take the stand and he doesn't volunteer to testify, how do the police proopolice prove their c? >> i have got a handful where the witness was cooperative, the victim. the rest, they don't want to be there on the day of court for a variety of reason. they have an evidence-rich environment. they have eyewitnesses to the crime. they were at another couple's home when all this went down. they saw the knife, and that 911 tape literally she lays out. i'm afraid for my life. he had the knife up against my neck. the whole thing is there. the prosecutors won't have a hard time. in terms of the prior bad acts of charlie sheen. in domestic violence cases, it's highly probative. and it's helpful. megyn: even if you can't get that in, you have the court of public opinion. going back to research for the segment, i pulled up some of the emails he sent to denise richards during their ugly divorce. we put one together so you can get a feel for this guy's character. you are a sad jobless pig. he's a class accountant jury will love him he's not a class act. before you get to trial, you have a wife saying i don't want him to go to jail, maybe we shouldn't prosecute him and throw him in prison. maybe we take this opportunity to try to fix something -- that's what domestic violence court is all about. megyn: after he abused his girlfriend he went to counseling. see how well it worked out? >> i suspect drugs may play a part in this. we read a declaration by denise richards. in the middle of it, by the way, this when i got pregnant with my second child. if he's that terrible, why do you stay with him. >> that doesn't excuse it. >> it doesn't make sense. >> that won't make the case that charlie sheen is facing go away because denise richards is conflicted. the fact of the matter is he has a proven documented history of abuse and violence towards women and he shouldn't get a free pass. and they will nail him in colorado. mark my words. they filed a felony against him. megyn: this guy is on one of the most popular tv shows. he's the highest paid actor in television. if he goes to jail, this will get a lot of attention. thanks so much for being here. one final word for our viewers. it's time. he has crossed the legal time more times than i can count. how many women does he has to punch, hurt or threaten before he is put behind bars. i'm all for second chances. he has had his, then some. if convicted he should be sent to prison. period. coming up after this break, the thing about the ketchup and snow-magge -- on. the winter storm that's terrifying the d.c. bureau and beyond. :: fox news is on the job hunt. paul let watched her business evaporate in the recession and turned to her love of animals, starting a second career as a animals. animal care is big, big business in this country. a national pet owner survey showed there are 77 million dogs in the united states. that's huge. owners will spend $35 billion on their pets and $3.5 billion spent on services like grooming. molly line is live in massachusetts with the story. >> the economy goes to the dogs, so paula decided she would do the same, fulfilling her passion to become a dog train. they have two dogs but there are quite a few to help with the training. why did you decide to bring in a trainer?
