It is amazing if you look back at that time, how many different people, not only in the administration but on capitol hill were citing Jonathan Gruber as an independent analye who wat economics professor. He was never titled, has a contract with hhs for 400,000. He was never titled, helped to actually write the law in both the house and senate version. He was never titled, advisor to president obama to get this piece of legislation across the finish line. He was all three of those things, and it was really a circular pep rally, not a circular firing squad. It was essentially a machine that kept on citing gruber as objective analysis and then, would take the residual benefit of saying this is the right piece of legislation. Stuart now, today, on competing network. Steven rattner, who is inside of the white house on frequent occasions in the early years of the administration, he said that, gruber, quote, he was the man. Literally he said. That he was at the very center of obamacare. This is democrat saying he was right there. He helped write obamacare. Now everybody else is running away from gruber. If you look at the statement that the president makes in australia, that it was some advisor who said something that he doesnt agree with, just some advisor, then you look at nancy pelosi saying, i dont even know him, it is really stunning. It is like in your face, stunning, just not true. And i think that, even for the people who watch media bias, and say, you know, all the time, that there is this disparity, this is even egregious on that level. The fact that it wasnt covered for days and days and days. Some networks only doing their first story today or yesterday on gruber. Stuart so where are we going with this thing . Seems to me that if obamacare is falling to pieces. Certainly chaotic at this moment. Riddled with this internal scandal from gruber. Does that just fire up the republicans to get out there and repeal this thing . It does, stuart. But you know, you just talked to the senator. They can do that. They can move it through. They can move through a piece with reconciliation. In other words 51 votes, not 60 needed. Can get to the president s desk. He is not going to accept it. He will not sign that. Stuart think of all the time this will take up in the new republican congress, dealing with obamacare, instead of dealing with some kind of tax reform, energy reform, which could get the country moving. I think that bret baier was on to something and was absolutely correct when he said this is probably the most effective weapon against obamacare in the present arsenal of democratic president and republican congress. And that is this case before the Supreme Court of the United States basically over whether or not the irs has the authority to grant subsidies and tax credits to people in certain economic categories. If the court decide the irs does not have that authority, i think most economists agree, perhaps even the good professor gruber would agree, that obamacare will collapse because it will be unsustainable. It will have profound effect on Insurance Company stocks, et cetera. Stuart thats a good point. This is based on an ambiguity in the statute. One wonders if that ambiguity was put in there by the same professor gruber in order to dupe those who were going to vote for the statute. Here is the ambiguity. The state says, that tax credit and the subsidies are only available in the states where the states have established exchanges. The Supreme Court said that the statute can not compel the states to establish exchanges. So only five of them did. In the other 45 states, the feds established the exchange. Question, is the tax credit lawful where the states have not established the exchange but it was established in their behalf . Stuart okay. But why would gruber sufficiently ambiguous . Stuart why would he put it in. Why would he put anything ambiguous in the statute . Stuart tell me why. In order to hide the true purpose and effect of the statute, which is redistribution of wealth. Stuart oh, to compel states to start their exchanges . Correct. Supreme court said congress cant compel unless congress pays for it. So congress ended up paying for it. Stuart have we any way of finding out who put in that ambiguity as you call it . I think when the Republican House puts the good professor gruber under oath in january, you could sell tickets. I think it does. There is now a general consensus among reporters who do this sort of thing about the lack of transparency of this administration. Stuart our own Melissa Francis relates a story, here on fox business about the direct suppression of news about obamacare. Do you have a similar example from your days say at cbs where news, which was not good for the president was deliberately suppressed . Well, specifically i can address healthcare. Gov or obamacare. I was originally assigned to cover it. They originally welcomed the stories digging into many controversies of the at some pound i described the light switch seemed to go off. There was incredible pushback from white house and surrogates from social media and bloggers and so on. After that, no matter how big the story was we found, my producer and i, how great the sources they didnt seem to want it. Listening to melissa talk, as i heard her on tv say the other day, it reminded me of, im speaking as harvardtrained economist about numbers here. Im not making pejorative judgment or political opinion. I felt that way with my reports. Those that didnt want them to tried to politicize them or motivations when in fact this was factual reporting often using Obama Administration sources and documents to expose some of the problems. Stuart biased isnt always in the telling of the story and twisting the story on the air. Bias can also be in the selection of what is a story and what is news. This bias inherent in every broadcast with that kind of thing. Im sure you found that too. Indeed. I mean i refer to as soft censorship. Over most of 20 years at cbs they welcomed a variety of stories. I had great bosses that did not insert kind of bias youre talking about. The last couple years, last few years at cbs i and some of my colleagues specifically noted that, that there were stories they just didnt seem to want the public to hear about if they go away if we din put them on the news. Stuart do you see any turning point here . Weve been learning about essentially the leftist bias of the establishment media for a long, long time. I thought that it had perhaps reached a peak, a turning point so to speak. We moved back to a better coverage of the news of the day. I think im wrong. I dont think there is any turning point at all. In fact it is getting worse. What do you say. I would argue there are further factors besides idealogical biases compete against gatekeepers. There is competing commercial, corporate biases. There is response to stay away things controversial in general unless everybody is covering them. Avoidance to highly organized pr and propaganda campaigns that push back against reporters and news outlets that go where the special interests and political interests dont want them to go. All those things combined together make thing more difficult. Stuart most astonishing story in your book in my opinion, youre looking at your computer and you can see material being erased by some outside third party as you are on your computer itself. But you dont know who did that, who hacked in and took your material away. You dont know who did that, do you . This was nine months after the first of three forensic exams which all revealed a highly sophisticated Remote Monitoring effort in my cbs laptop computer and my home apple desktop computer, nine months after this was revealed i was of course on a different computer at this point in time but i had learned through the three forensic exams people who intruded on computers have the capability to operate my computer remotely as if they were sitting in front of it. With that in mind, certainly when these things started happening thats what i thought of. My own experts theorize that was an effort on their part, whoever they are, to let me know they were there and watching, that they could do that. Sort of intimidation factor. Number 2, i would suggest it looks like the most important job to create in america is the jobs for senator Mary Landrieu because of 40,000 jobs that have been on the table that could be created through the Keystone Pipeline were not important to move forward until there was an election. From my perspective we should focus on the American People, not politicians when it comes to the Keystone Pipeline, moving it hundred 30,000 barrels of oil through the company that creates 40,000 jobs is something that is very positive. The president also start signing some leases for more jobs to be created in the Energy Sector where we could see another 1. 6 million jobs created if we were just have some cooperation from the administration. Stuart there are reports president obama will sign the executive order very soon that would grant amnesty to 5 million Illegal Immigrants but one thing he said that would be a threat to africanamericans, for a moment would you listen to what he said in his book in 2006, a will quote directly. Confidence is growing but it is not there yet. From my perspective confidence is really there tend to spend more, buy premium spirits and order larger stake and well see impact in traffic and spend. In some cases the ones that want the premium brand will so maintain the brand that they will drink or eat less. Stuart what youre looking for is an increase in the average check price.
