Its a felony for which the fbi, not the d. O. J. , because senior d. O. J. Management was taken out of picture by the attorney general because of her staged meeting with mrs. Clintons husband, the fbi decided not to prosecute. Another story, because he was grilled, the fbi director for four hours by the House Judiciary Committee over that decision. Liz you mentioned general David Petraeus sharing confidential information with his biographer and forced to resign in disgrace. Ed snowden wanted for treason overseas, also people in the military have been in trouble for this. I still dont understand, what are we missing here . Were missing the content of her communications with general petraeus which belongs to the government. So by deleting it, she destroyed Government Property. Another potential crime for which she will not be indicted. Liz so this is all caught up in the decision not to indict, right . Covered by that . Im sure director comey is aware of these even though it wasnt discussed publicly. You mentioned james comey, grilled in the hot seat, number of clinton staffers granted immunity in the private email scandal. Take a listen. You were granting, handing out like candy, according to some, immunity. What concerns me director is when you have five immunity agreements and no prosecution. When you are allowing witnesses who happen to be lawyers, who happening to targets to sit in on an interview, that is not the fbi that i used to work with. I dont think anybody was given transactional immunity. Really . You gave immunity from destruction to both of those attorneys, not just turning the documents over, specifically destruction. When i was at the department of justice, your award for lying was 18,000 charge or potential obstruction of justice charge, it wasnt immunity. Depends where youre going with the investigation. Low level guy and trying to move up in the chain, you might think about it differently. You lied to an fbi agent, you dont think thats important . Liz five of clintons closest aides granted immunity in the email case by the department of justice, not the fbi. Republican members of the house say they did want serious answers. Judge, i thought you would get Something Back in return for immunity. Department of justice isnt getting anything in return for immunity . Little basics, nobody got immunity. Nobody. They got promises not to be prosecuted. Only a judge can sign an order of immunity, thats when a grand jury is waiting to hear testimony or trial judge waiting to hear testimony. Neither is the case here. Ordinarily you would give immunity or promise not to prosecute in return for substantial evidence to help you prosecute. In this case, there was no prosecution, and the decision not to prosecute was made from the beginning of the investigation, not at the end, because if they were going to prosecute mrs. Clinton or conduct a real investigation instead of a shabby one, they would have had a grand jury there to issue subpoenas. No grand jury, no subpoenas. No search warrant, no d. O. J. Supervision, entirely in the hands of fbi which has been told by the west wing exonerate her, dont prosecute her. Liz this deal with the five, does this Mean Congress cant investigate them or any other investigate body cant probe these five individuals . It does not. It means only that the evidence that they surrendered, in the case of cheryl mills, the contents of her laptop cannot be used against them in any prosecution, doesnt mean theyre immune from prosecution, it means that whatever they surrendered in return for the promise not to prosecute cant be used against them.
