Concerned about mr. Trumps phone call with the ukraine president. And he was so concerned about that and other things that he witnessed he twice reported his concerns to his superiors. Vindman says he reported it out of a, quote, sense of duty. In his Opening Statement that has been obtained by cnn, vindman says i did not think it was proper to demand a Foreign Government investigate a foreign citizen and i was worried about the implications for the u. S. Governments support of ukraine. As investigators hear from vindman and four other witnesses this week, Democratic Leaders now planning to hold a vote on the impeachment inquiry thursday. The vote will force lawmakers to go on the record supporting or opposing the investigation. And will lay out the rules for the next phase taking the probe public. The speakers move shuts down a key gop talking point that the inquiry is not legitimate because there never had been a formal vote. We are already seeing, though, some of the president s republican allies trying to discredit todays witness. Colonel vindman who we will note was awarded a purple heart and is an active member of the u. S. Military. Listen to what congressman sean duffy said right here on new day moments ago. Mr. Vindman, hes an adviser to the president. He is a former ukrainian. He wants to make sure taxpayer money goes in military aid im sorry. Why does it matter where he was born . Hear me saying y does it matter where he was born . He moved to the United States when he was 3 years old with his family. Hes been in the military for 20 years. Awarded the purple heart. Active duty member. Sean duffy didnt know whether colonel vindman put america first. You are starting to hear it more than just from sean duffy. Joining us, joe lockhart, abby phillip and jeffrey toobin, cnn chief legal analyst. And i do want to start with colonel vindman, what he is going to say today. And let me just read you part of what he will testify to. This is part of his Opening Statement. I was so concerned by the call, i did not think it was proper to demand a foreign invest investigate a u. S. Citizen and i was worried about the implications for the u. S. Governments support of ukraine. He was so outraged, even before the issue of quid pro quo arose. The simple act, he thought, of the president asking president zelensky of ukraine to investigate an american citizen, the political rival of the president , was so outrageous to vindman that he thought that needed to be reported up the chain of command. And this was even before the issue of, well, was american aid conditioned on this . It just shows how outrageous this was, to him, and i think many others. And so unambiguous. It wasnt tope interpretation. He was so clear on what he was hearing that it raised all of these alarm bells. Heres another piece from his Opening Statement that is interesting. In the spring of 2019, i became aware of outside influencers promoting a false narrative of ukraine inconsistent with the consensus view of the interagency. This narrative was harmful to the u. S. Government policy. While my interagency colleagues were becoming optimistic, this alternative narrative undermined u. S. Government efforts to expand cooperation with ukraine. Its interesting, abby, because he was on the call. Not hearsay. He was on the call. He was concerned about it and starting to see things around him that he was quite concerned about. See things he clearly believed were contrary to u. S. Foreign policy. And this is important because what we heard in the last hour was an attempt to imply that vindman could not possibly have u. S. Interests in mind because maybe he wasnt born in the United States or perhaps he had some preference for ukraine. But the fact of the matter is it is the United States governments policy that the u. S. Support ukraine in their fight against russia. Thats a bipartisan consensus, and thats what vindman is saying there. And if President Trump who runs the federal government wants to change that policy, he could do that with his own government. He did not. He used Rudy Giuliani and in vindmans view, used giuliani to push a view about ukraine that was political in nature. That vindman believed would undermine a biparss support, not just for aid but ukraine in general. The facts are important here. And its really important to note that President Trump could have done this a normal way. He could have used the government he runs he wanted to change the policy, and he did not do that. Ive learned from counselor toobin the phrase consciousness of guilt. When someone reports something up the chain a normal white house would look and say, thats not what the president meant and lets clear that up. But what they did was the opposite. They tried to move it. They moved the transcript to a secret server. The white house lawyers, rather than going in and saying this is running contrary to policy or something abnormal here, sought to cover this up which tells you that they knew what they were doing was wrong and they continued to do it anyway. If you were doing a real investigation, you would talk to a lot more people in the white house. But the white house has said no one is allowed to talk. And vindman is risking his career by coming in and talking not withstanding the instructions of the white House Counsel pat cipollone. Well see if others come forward in light of vindmans testimony. Risking his career. Given what former congressman duffy and other allies of the president are saying right now, hes really laying it all on the line. His choice to testify is extraordinary considering hes active duty military. Considering the attacks. The unfounded attacks that he just opened himself up to. And, you know, again, the story gets so interesting and complicated. He has an identical twin brother who was also a Lieutenant Colonel in the military and also working in the white house at this moment. So if this is some sort of ukrainian plot, it has a double barreled effort. I mean thank you for suggesting that. This fox news insanity and with all due respect to our new contributor, former congressman duffy,s in insanity and antium grant bigotry reflected in casting aspersions on vinman. He was saying hes of irish descent and may feel some affinity to ireland. Hes just spelling it out. I appreciate sean duffys candor of how he sees all of this because we are hearing it on fox tv and elsewhere and well be hearing it all day. Its worth noting, though, when you walk into the white house, most of the staff there are not the people close to the president. So im not surprised the president is saying, i dont know this guy. He should know this guy if ukraine is important to him. Hes his point person. But most of these people either are detailed from the pentagon or the cia. National security council. Or are there. It doesnt matter who the president is. And their loyalty is to the government and to the country, not to any individual politician who happens to get elected. But their job depends on the president wanting them there because he can get rid of him and it is an act of courage to come forward like this. I will say, it does seem to put some additional pressure on some of the people who have been, you know, heming and hawing about whether theyll go before Congress Like Charles Cupperman who yesterday pushed this to the courts. Here is someone who is currently working in the white house and made a determination that he is able to testify under subpoena. It really calls into question whether there whether the conflict for Charles Cupperman is he cant or simply doesnt want to because hes not willing to risk, perhaps, his reputation in the same way that Alexander Vindman has. He can walk in there today and testify. He is choosing this legal stalling tactic and well see how long it works. I want to play were talking about how republicans are justifying or dodging in some cases or choosing to comment on whats going on. I want you to watch manu raju, our senior congressional correspondent, confront a republican from nevada about some of the facts, the substance of this investigation so far and watch this incredible dance. The white house transcript that was released that had President Trump asking president zelensky to open an investigation into the bidens. Do you know if theyve even got plans to call the whistleblower . Youre not answering my questions about the i disagree with your conclusion. Its a conclusion, not a my english teacher says you have a conclusion. If you want to interview yourself, go right ahead. Why dont you want to answer the question. Is it okay for the president its not a question. Why dont you want to do an interview instead of interviewing yourself . The president asked on the white house lawn will you answer my question . I guess thats the answer. If you dont want to interview me, then interview yourself. I havent heard logic like that since second grade. I am fluent in english. I have no idea what he was talking about. There wasnt an answer in there and a mass avoidance of answering. One of the interesting things about the vote the congress is going to take on thursday is that, you know, one of the claims that republicans have made is that there hasnt been a vote authorizing this inquiry thats been a big process argument. One of the well see once this vote its going to pass with some we dont know exactly how much, but certainly nancy pelosi is going to win this vote. And the question of, will that prompt more republicans to Start Talking about the merits of the case against the president as opposed to the process. No, youve already heard it. Now theyll impugn vindmans character. You heard what he led with which is, wheres the whistleblower. I dont think ive heard from the whistleblower yet. Theyre casting about because as we heard, about the fact pattern is a tough one. They might need to talk to the president about that because President Trump wants to talk about the substance. He still thinks this call is perfect. He still is talking about how the transcript of the call vindicates him which pretty much no republican is willing to say at this point. So theyll come up against a problem here. The president wants his defenders to be more staunch in defending the substance of the call. They are clearly, based on that clip, not willing to do that. Last word, joe. Now that the champagne has opened listen, i think that pelosi has handled this masterfully. She held off this vote. The vote isnt hard for democrats. The vulnerable democrats. Theyve already said theyre for opening an impeachment. The ads are going to run against them. Im sure they probably already started. But she allowed the republicans to walk out and make all of these process arguments that shes now said im giving you a vote to give you exactly what you asked for and youll vote against it. So i think its much more about getting to a place where republicans will say, yeah, he did it. Nothing wrong with it. I agree with the president. Well see what changes today. And i think that he corroborates the testimony that weve heard from bill taylor and fiona hill. So this is going to be very important testimony to be taken today on capitol hill. What youre starting to hear from some republicans, and we just had former congressman sean duffy of wisconsin on 20 minutes ago, as well as in some right wing media, they are beginning to cast doubt on colonel vindman. Despite the fact hes a purple heart recipient and all the credentials you lay out. He was born in ukraine but emigrated here when he was 3 years old. Theyre starting to say that perhaps he cant be trusted. Your thoughts . My thoughts are simple. Here we have a clear example of the republicans who have no excuse for the conduct of the president and who sees mounting evidence of truly a betrayal of our democracy. And so theyre approaching two tracks. One is to focus on process as we saw with the political stunt from last week storming the scif and then going in and eating pizza there. And now they are trying to assassinate the character of a purple heart winner. You know, and weve seen this playbook before from this administration. Obstruct, stonewall, and if that doesnt work, when people put their country over their own selfinterest, then you go after them and you try and attack them as immigrants. Unfortunately, this is not a new tact of this administration or the complicit republicans. Theyre also some of the republicans are also saying the vote that nancy pelosi has now scheduled for this thursday, the first vote on impeachment, is democrats caving to republican pressure. Let me play it for you what senator john kennedy said yesterday about how this is clearly gop pressure and it doesnt really matter anyway. Listen to this moment. The cow is out of the barn. You know, the republicans continue to flounder about, looking for something that they can do to distract the American People from the truth that is emerging here. So what we have here is what weve always said. We are going to let the facts dictate the timeline and the process. And this resolution that were taking up this week is a signal that we are moving from the private interviewing that is a process that was held up by the courts as recently as friday. Republicans know that. Moving to public hearings. And it is important that we have this resolution to set out how the evidence goes from the Intelligence Committee to the judicial committee. A more public viewing of these transcripts and live witness testimony moving from a confidential, highly secure setting to one that is public. That is all that is happening here. The republicans know it. But again, when you cannot say there have not been abuses of power, when the evidence is mounting daily against this president and what hes done, the betrayal of his oath of office. Are people heeding the evacuation orders . They really are. You know, its really become a call to action for citizens in california as we have seen not just the past, you know, couple of years but really the past ten years with these mega fires at the public has become a partner. Were seeing people leave early, and it really has an impact, one, life safety and, two, to get our resources in there to protect their property. Can you give us some context of what youre seeing right now compared to other years, compared to other fire seasons there . Well, what were seeing is really youve heard the term, it really is explosive fire growth. So when we talk a traditional, the front of the fire, the head of the fire, that no longer exists with these type of weather conditions. We get what we call ember casts where an ember can be thrown over a mile ahead of the main fire which unfortunately we saw a lot november tof in the devasp fire. Then that head catches up and it becomes that mega fire. Tactics and strategies change minute by minute, hour by hour depending on weather conditions. This is not the new normal. An active duty member of the military will testify today apparently that he was very concerned by what he heard of President Trumps pressure on the president of ukraine to investigate joe biden. Weve heard in response from allies of the president , including former republican members of Congress Today questioning the its truly despicable. Any time weve had a Service Member that is serving and then have a war hero such as the gentleman were speaking about and for someone to trash them because they disagree or basically they think that theyre protecting is just wrong. Its just not who we are and its not how i was raised in west virginia. We dont do that. We honor our veterans and give them all the services that we can and all the accolades basically for putting themselves in harm way. This person has a legitimate concern. Thats why theyre going through an inquiry. Thats why theyre going to go to a vote. And theyre going to find out what the articles would be if they have enough evidence to go forward. Then well be given to the senate and look at the evidence. But trashing people before they should be cooperating to get the facts out so either this can be put to rest or theres merit to it. One of the things hes going to say in his Opening Statement concerns Rudy Giulianis role in controlling Foreign Policy in ukraine. Let me read you part of this testimony. There should not be a surrogate for the executive, for the president or the administration or anybody else. Its not a part of the state department or administration or executive branch of government speak with authority fop go over there as a political hack or basically a lobbyist trying to make money and has made money and has a history of making an awful lot of money with the connections and representing one side or the other is absolutely wrong. And people have to say, how do we handle this . How do we talk to this person knowing hes representing a certain extent to the executive branch and the president and now hes trying to create policy, too. Its very confusing. Its wrong. Should not be done, and i think what giuliani was doing was hurting the country, not helping us. Do you think he could be in any kind of criminal jeopardy . Im going to make sure theres an inquiry done on that also. I would like to find out so we stop this type of behavior. And countries know exactly what our policy and from our state department and speaking with authority from the president to the executive branch and congress support. And right now we dont have that. So theres not a clear message. So, yes, he should be looked into. You are a potential juror in a senate trial, if the president is impeached in the house. So one of your colleagues, lindsey graham, has put forward a motion sort of condemning the house process. You havent signed on to that, but what is your view of the house process . The house process, the constitution is clear. It gives the house the responsibility of the impeachment process. And i have looked back and through history, i had my staff look back, john, and we have seen through the nixon impeachment process and through the clinton impeachment process that basically theres a time period when they gather the information through the inquiries and then basically they move forward or they dont move forward. In both cases, they move forward. Its about three or four months lapse between the two. Now that i have seen Speaker Pelosi is going to hold a vote, that basically says that its moving in a process that weve done before. So i would say that lindsey, if he believes that hes pushed that and accelerated that, then, so be it, thats what they believe. On the other hand, i believe the process was going to work. Ive always said there would be a vote on whether theres going to be an impeachment inquiry. Well have to see the articles of impeachment, what they think they have evidence to charge the president for impeachment and articles, then its going to come to the senate. Well evaluate those evidence and see if it warrants what theyve given us. You have been working very hard over the last few weeks, months, frankly, to protect pensions, largely of Union Members, having to do with bankruptcy issues. Talk about the legislation youre putting forth today . All pensions, anybody that pays into a pension.
