This is probably going to be the most revealing part, mob ea of this entire report. As far as we know none of that has been presented to a grand jury. So the department of justice, the attorneygeneral have more liberty to put more information out there about thattings have. Were going to get a wound into the investigations going on in the white house. People like don mcgahn. And a lot of concern about what he may have said to the special counsels office. Hes said to have spent more than 30 hours with them. So were going to get a window inside some of the conversations that the president was having with people in the white house about firing people, what the thinking was and that is where i think thats going to be most important for us and that this part of the investigation the devils going to be in the details. Its also the innerworkings of this white house. The president and the administration, some people may call it callous entry, buts some people are going to get a window into that. The report will reveal that mueller decided he could not come to a conclusion on obstruction of justice because it was difficult to determine intent. But it will offer detail blow by blowoff his alleged conduct, and other episodes at the center of muellers inquiry they added. What can questions does that raise for you, sir . Theres the question off intent. Thats the nature of making a decision about prosecution is you think about whether you can prove intent. The big elephant in the room is theres a question whether you can charge a sitting president anyway. Are we going to find out mueller was getting close to that . The problem that i see with where we are and whats happening now is were not doing things by the book. A long time in this investigation, as its rolled out, weve heard about department policy, now theres a policy not to threat grand jury rule. But there are other policies theyve bun saying they want to follow to keep this on track. Now barrs broken and were going to have a press conference and they can help prepare spin on it. Thats not normal. We dont have subjkt of an investigation so that they can decide after the fact. And starts to saddle up like other plauses in the world. Jennifer, we still dont know and do it. Was that supposed to be left up to congress . The recent reporting made it sound luke he did dicided there wasnt enough evidence but i think we need to know more before determining that. We should learn mortomorrow, especially if the redactions are light. We did hear last week at barrs testimony that mueller did not say in the report that he wanted to leave it to congress. I think well learn more about that tomorrow. Barr has been protecting the president every step of the way, including not revealing to us what muellers thing was so hopefully thats one of the things well find out tomorrow, 11 00 a. M. Or whatever it is. Hes not releasing the report until after the press conference. Its 9 30. Hours after his own press conference. I mean how does that make any sense, honestly . Ive been to many press conferences and what they do is give you the indictment so you can read through, decide whats umportant and questions you want to have. Its really weird theyre doing it this way and it leads avr within to believe terrirr trueing to control the narrative here. Why is he holding a press conference . He wants to talk about the processes, the thinking behind the redaction, the report, thoughts. Hes also expected to read a statement explaining some of his actions. They dont do that after . Right. You would think he would if you goier out what the news is. What you need to dive into. What more do we need ask the reporters are going to be in that room. We have very experienced reporters that are going to eboo unthat room. They know what questions to ask. But the idea youre going to do this before the report comes out is really strange and if you look at anyone whos been at the department of justice, its really strange you would do it this way. It only leads everyone to believe theyre trying to control the narrative. Thats exactly what hes trying to do. It looks bad. There are a lot of things you have to wonder. We all wanted to have faith in the new attorney general. Obviously there were a lot of concerns about jeff sessions. It should be concerning for all. Listen. This is a new era. Lets give him the been if the of the doubt. Thats exactly what theyre doing right in front of our faces. And we should stop pretending maybe ea theres a question about it. Because last week barr testified on capitol hill by saying he wanted to wait until the report was out before he discussed it. Im not going to say anything more about it until the report is out and everyone has a chance to look at it. So im not going to discuss it any further until its out. Im not going to discuss the conitanco contents of the report. Its going to be out next week and im not going to get into the detalls of the process until the plane is on the ground. Hes holding a press conference before the eare port is out. Thats what whos trying to do. Hes trying to shape the narrative and looks like theyre trying to cover up sthung. This whole thing stinks. We heard about color coding and he explains those. Theres nothing more to say unless they have changed something from last week. Otherwise all hes going to be doing is repeating what he said last week. Instead of whats in the report which obviously is ready for release. Theres nothing about this that smells right. If he actually michael, if he actually cared about answering questions about the report and aing this for the people in the back. The people who still have some idea maybe hes doing it because off this. He wants to answer questions about the report, wouldnt he hold a press conference after the report several hours or maybe the next day . Ua well, yeah, absolutely. Its like asking for a book report before you read the book. The problem when you have members of your own Team Investigating other members is you have this idea that its not a neutral investigation, that its not objective. Ill say this. The department has a long history of remaining neutral and being an honorable institution. Ive stood in the white house when president obama specifically said youre not my lawyer. Youre not here to protect me. Can you repeat that again. His comment was you are not my law ier. Youre herer to protect the United States. Youre not there do my bidding and thats whats been lost and i think theyre great people who work for the department of Media Relations office and the press office but barr is getting bad advice because hes tarnishing what has been built over decades and that is the independence of the department of justice. And thats the fear going forerward. And so this idea of were go having to a circuses of let me spin it out i spin it is sill a. And the idea there are two different versions, maybe im more conservative than mr. Barr. And i think Congress Works for me. They ought to be able to see the report and i ought to be able to see the report. I realize there are seals. I get that. But by and large the report belongs to the American People. And we ought to know that before being led down a path. The American People pay congress a salary, as well as William Barrs salary. The other thing that has come to mind for me is he took so much criticism by the Current Department of justice, because he held that press conference where he talked about all the things Hillary Clinton did wrong and email server investigation. The thing is this is the attorney general and he has a right to do it. Will they go into steps similar to jamed comey . And he took a lot of heat for talking about derogatory information that violated the department of justice guidelines. How does he deal with that . Paurpt apparently weve learned that hes had multiple conversations with the white house about it and now he schedules the press conference so he can spin the story before it comes out. I dont were having this press Conferences Tomorrow we only learned about because the president said hes having a press conference. I dont know whos idea it was. The motivation seems clear were go doing they want to get out in front of the story just as they did in the report which he put out his summary can which he hoped would guide the discussion going forward. So now the full report is ready. Now theyre going to try one more time to guide the way the discussion goes. Got to cancel his press conference. Show some report for American People and congress. And then if he wants to answer questions about it, absolutely we should be able to. Several different powerful committees asking him to cancel the press conference and let the American People read it, congress, pres read it and then later, if he wants to, fine. All weve been doing almost a month is speculating what were going to see. Whats so interesting in the reporting is the reference to the fact that theyve reached their decision. And it means perhaps theyre not going to be interpreted that way. Thats one of the things very smart man. And when i read the first report and he said its complete and total exoneration, it says they didnt establish people in the Trump Campaign conspired. Right . And then said it didnt exonerate him. And said this is a complete exoneration. You are supposed to get a less redacted report. That just comout today in court. I read that are port, chairman nadler read that report. None of us got the message that were getting a less redacted report. I hope its true. Its clear theyre doing this to start spinning the story. I think a lot of americans would like to know that. How much are we going to see on possible collusion because there might be so much Sensitive National security information involved . I think you will see less on the collusion part than the ubb instruction of of justice part. Whats really important is what actually happened and i think was there a giant conspiracy by the Trump Administration . Maybe not. We know that from muellersings have. And then theres the cover up by trump about what the meeting was about. Nt and to the meeting, the fbi briefed the Trump Campaign about attempts by the russians to get into their campaign and muddy up the democratic process. At no stage during this entire couple month period do the trump people say you know what . We actually were approached by them. We met withthem. And there may not be the intent. They lied about a meeting that thaw were willing to have to get dirt by a foreign entity about an about the election and the other candidates. And we know about Paul Manafort and business associate with russians, right . Remember that . Jeffrey, barr said that mueller found that campaign didnt conspire or coordinate with russia. Actual what he said is that the investigation did not establish that mmbers of the Trump Campaign conspured orrer coordinated with its election interference activities. I lived through a real potential constitutional crisis at the time of the saturday night massacre in watergate when the president was going to defy a court order. Er for thats what i define as a constitutional crisis. I think you have to go back to Andrew Jackson and it was the weight of Public Opinion that caused the president to back off. But a constitutional crisis would be if the president says to the court im going to defy your order. Thats when the three branchs of government not the two, the three. I do think this matter is going to be decided by the courts. Because congressman nadler said he has that subpoena ready to go. And theyre demanding an unredacted version. Terrirr not going to get it. Im wondering if were at a Tipping Point. And what you thing of the president pushing the limits of executive power in the administration if he tries to with hold this report. He did. Are we at Tipping Point, you think . I am not sure if Tipping Point is right. Theres continuities toric uginize and in the modern era, really post fdr we see president s consistently pushing outwards on the boundaries of power. I think whats really at stake is what do we learn from the report and more generally when are we going to see meaningful leadership on the threat that it clearly establishes that russia intervenes in the russia in 2016 and constitutes a threat moving forward as well. Newly released Text Messages in the is Jussie Smollett case, quick refresher, late february, smollett was arrested after he falsely reported a hate crime against him in chicago. The States Attorneys Office abruptly dropped the charges. Youly released Text Messages between fox and a top assistant show she still communicated with her staff about all of it. Joining me, a former states attorney. The texts between fox and assistant states attorney. Im recused by when people accused us of overcharging cases, 16 counts on a class 4. Washed up celeb who lied to cops, 16 counts. Just because we can charge something doesnt mean we should. Shes talking about the disparity between the charges given, we think, between smollett and r. Kelly. Given fox recused herself, were the texts appropriate . Texts were not appropriate. No question there. And she knew they werent appropriate, why she began by saying so ive recused myself, but let me tell you what i think about the charging decision you made, and then as you know she went on to even suggest an outcome that she thought was appropriate in the smollett case. Explain to our audience why only a partial record was released . The freedom of information act, the news media requested all of the Text Messages, surrounding kim foxs involvement to figure out why the case was dropped. So there was a dump of about 3,000 Text Messages and emails yesterday, whats interesting is not so much what the news media and what we in the public got in terms of the Text Messages you referred to. Whats actually most interesting are the set of Text Messages between kim fox and her first deputy that we did not get, that the office is wisconsthholding. If shes recused there shouldnt be any Text Messages between her and her assistant about the Jussie Smollett case. The office is not turning the Text Messages over. With will be able to see them eventually . Its unclear whether well be able to see them. The im sure the news media will be challenging those. And im sure the investigation thats being done by the Inspector General would want to look at those, but its fairly clear, given what they told us about those texts when they withheld them that theyre clearly texts about the Jussie Smollett case between kim fox and her First Assistant. And in certain of those texts which took place on the day the charges were dropped the office, the explanation they gave for not giving over those Text Messages was they were involved the deliberative process. In other words, the office is essentially conceding that she and the First Assistant were talking strategy about the Jussie Smollett case, a case where the next day when she was interviewed she claimed to have absolutely no conversations about the case with anyone in her office. Do you think somethings its really disturbing. Do you think something is fishy here . Because people are calling for her to step down, they think because of her handling, what do you think, should she . I dont have an opinion as to whether she should step down. I think she was elected. But i do think she ran on a platform of transparency, a platform of integrity. And whats going on now in terms of what the public is being told and the deceptions and the withholding of documents and the secrecy and the different explanations it undermines the reason she was elected and it undermines confidence in the Justice System in cook county which has suffered enough over the last four years, and really doesnt need whats going on now.
