President zelensky in early september. I want to get straight to cnn Congressional Correspondent manu raju on capitol hill, and manu, i know you have some news to tell us about. Go for it. Reporter yeah, thats right. The democrats in the house are now signalling theyre on a fast track on their impeachment probe. There are a number of new steps theyve taken that show President Trump could be impeached by the end of the year, in just a matter of weeks. Youve seen these steps taken in a few different ways. One, the move to public hearings next week. Two, house intelligence chairman adam schiff made clear in a letter to his republican counterparts today that they were not going to bring back all the witnesses in closed door depositions to come for public hearings, and also two actions that could delay potentially prolonged court battles. One, they withdrew a subpoena for a top official, a National Security council official who used to work there, charles kupperman, because they were concerned that could drag out in court. And also today the decision not to subpoena the former National Security adviser john bolton, because boltons attorney informed the committee that if he got a subpoena, they would fight that in court, and the Committee Said they were not going to get dragged into a long term of roropeadope that cou drag out the impeachment for months. A decision could come next week, it could carry to the week after. Then we head into thanksgiving week. At that point that where a report is drafted by the Intelligence Committee telling their recommendations and their findings of the probe. At that point the House Judiciary Committee would take up the proceedings from there. The judiciary proceedings could take one to two weeks, they could have a public hearing, and they could then move to vote on articles of impeachment in the committee to kick it up to the full house to take it to the week before christmas. That would essentially also be in line with the timeline of president bill clinton who was impeached in late december, in 1998, 31 years later. Its still unclear, it could still evolve, its fluid. Nancy pelosi shared her thinking with colleagues. They said it could change, but at the moment these steps that have been taken show that this new phase of this investigation is taking shape, it could happen rapidly, and the president could be third in history getting impeached in a matter of weeks. And as far as the testimony that you mentioned, republicans are able to request their own witnesses. Not sure theyre actually going to get it because it would require a full Committee Vote, but who do we expect them to request . Well, jim jordan, the Top Republican in the House Oversight committee, made clear this morning that they plan to being the whistleblower to come and testify publicly. They have a deadline until saturday to make that request. They have been demanding for some time for the whistleblower to come forward, to identify himself or herself, align himself with the president to out the whistleblower. We dont think the democrats will agree with that. They will decide ultimately who to bring forward. But there are three witnesses they have scheduled for next week. We have probably no more than two weeks of public hearings at the moment, although that could certainly change, and well see what adam schiff ultimately agrees to in allowing which public witnesses to come forward, dana. Today the Vice President was asked about this. Lets listen to what he said. When those rumors came out a few years ago, i dismissed them then. I never heard any discussion in my entire tenure as Vice President about the 25th amendment. And why would i . I have to tell you, the very notion of this anonymous who wrote an editorial and now its reported theyve written a book is just appalling to me. If theres someone in our administration or serving in our administration that doesnt support this president , doesnt support his agenda, they should do the honorable thing and resign. Cnn anchor jake tapper joins us now with more. Nice to see you. You have been talking to sources about this. What are you hearing . First of all, we should note that what is in the excerpt is not actually what the Vice President is rebutting there. It doesnt say that Vice President pence discussed the 25th amendment. What i was told by a source close to the publishing of this book is that the huffington post, who first broke the story last night, that his reporting is accurate. That said, according to this anonymous, former trump official, said they did a tally of which officials might sign off on the 25th amendment to get rid of President Trump. Quote, according to anonymous, there was no doubt in their minds that that senior officials would support invoking the 25th amendment if the majority of the cabinet signed off on it. Now, it never came to Vice President pence, so when he says he never discussed it, thats entirely possible but not at all inconsistent with in excerpt. They would assume he would sign off on it but it was never brought to him. It became clear to the constitution it didnt actually have a path for what happens if a president or Vice President dies, resigns or becomes inka pa incapacitated by any kind of illness or injury. That happened to woodrow wilson. He had a debilitating illness and the first lady, basically, took over. Whats interesting about this, this is not the first time this has been discussed. Individuals in the administration talking about the 25th amendment when it comes to President Trumps, i guess, mental health. I dont know whats in the minds of these individuals who discussed it. But you might remember the New York Times reported, and james stewart, the reporter, also reported in his book deep state that there were discussions in the department of justice by then attorney general Rod Rosenstein and others about whether or not the 25th amendment would be invoked and whether or not then chief of staff kelly or jeff sessions, then the attorney general, and others would go along with it. Rosenstein has said the stories are not true, but in any case, this is not the first time weve heard a similar story. People at high levels of the Trump Administration discussing the 25th amendment, and it all seems to have been around the same period of time which is when President Trump had james comey, then the fbi director, fired and then mueller was appointed and President Trump had a period of time where a lot of his aides even thought that his behavior was rather unhinged. Cnn reporting this hour that the start of public hearings next week starts a timeline that could lead to a christmas impeachment. With us to talk about that, former doj prosecutor marino, attorney Kevin Carroll and kylie atwood, reporter. You worked on the hill. You understand how this works. What does it tell you . It depends how many witnesses they choose to call on testimony, if theyll have a lot of rebuttal witnesses for the president. And also if they want to cut their holiday short. You know lawmakers. They want to get back home from the district. Its doable but its a tight schedule. Kylie, i know youre in touch with the sources who are wouldbe witnesses in the testimony. What are you hearing about this and how much of a spotlight this is . I think its important to recognize that the three people that are providing open testimony next week are all Career Foreign Service officers, right . So these are folks that are connected to the state department and they are also key witnesses because they kind of speak to one another. You have the top u. S. Diplomat, bill taylor whofls in ukrairs w. He gives the version of events that happened over the summer. And then you have the washington version of events. They kind of mirror each other, they fill out what the other one doesnt know. And then we have Marie Yavonovitch who was forced out. I think its important to understand they are officials and theyre coming out to provide testimony. Those are the witnesses that the democrats who are in charge have officially called. We know thats going to happen. The rules of the road are such that republicans can say, wait, we want our own witnesses. It has to be a full Committee Vote which means its doubtful theyll actually be successful. Jim jordan, the congressman involved in this, says they could call the whistleblower. Is there any chance that they could be successful . They could try, but youre really playing with fire here. In the corporate world, there are laws like sar baines auxley who provides protection for whistleblowers. Do government whistleblowers have those same protections as corporate whistleblowers . You have protection with retaliation. You dont have protection against getting subpoenaed, so they could try this. But i think theyre really playing with fire because the perception could be that theyre outing this person not just because this person has knowledge but as a retaliation saying, were going to make an example of him or her or anybody else who tries the same thing. And senator graham said whistleblowers are not guaranteed anonymity, theyre just guaranteed to not get fired. Anonymity would be a criminal element of the Environmental Protection act. Even if theyre provided analytical acts of the cia, you would still be limited to foreign travel. You would be subjecting the family to possible violence here in the u. S. Since this is a possible red herring even talking about the whistleblower, because the whistleblower was the initial source of this, right . But were way beyond that, right, kylie . Right. The whole argument that he or she made has been proven or at least discussed in actual depositions by the people he or she was apparently talking about, right . Yeah, so the whistleblower provided the outline for what weve seen, but now were seeing the essay theyve actually written, right . Were seeing these folks who are the characters fill in the details, give us more details that the whistleblower didnt even know about because that person wasnt as intimately involved as the folks that we have now heard testimony under oath from. So we are really beyond the point of the whistleblower being a key player here just because we know a lot more now than we did then. Well, its easy politically, and if you were on the hill, im guessing youre nodding your head to put the blame on a nameless, faceless person rather than deal with the facts. Com as House Democrats sprint ahead with their impeachment inquiry, republicans are testing out potential Defense Strategies in plain sight. Cnn correspondent tom foreman is here, and tom, its remarkable, were watching republicans in realtime throwing spaghetti at the wall to see what sticks. Thats exactly true. Look at some of the things weve heard. Early on we heard this was a perfect call. There was nothing wrong with it. The whistleblower was wrong about what he said about it. Thats been proven not to be the case. It doesnt seem so perfect with all weve heard about it. No quid pro quo, there was no one thing for something else. The evidence says thats not really the case, then theres the joker defense, that the president was just fooling around about some of the things he said. Now weve heard, well, the whistleblower is a partisan. No evidence of that. This is basically the work of a spy and this is all hearsay, that people are just making it up. We have people who were on the call who knew about it fir firsthand. Its not all made up. Now we hear its all a secret process. There are democrats and republicans involved and has been from the beginning, now its moving into a public phase. There is nothing secret about it. Just opinions . No. These are facts. People are saying what they saw, what they knew. Then we have this latest range thats come up lately. The idea that this is not impeachable in part because the Trump White House has an incoherent policy. They effectively dont know what theyre doing with ukraine. Listen to what senator Lindsey Graham said. What i can tell you about the trump policy toward the ukraine, it was incoherent. It depends on who you talk to. They seem to be incapable of forming a quid pro quo. Thats just an amazing claim, but dana, heres the only thing people really have to remember. I dont care if youre for trump or against him. Look at all the things the republicans have said, and what you dont see here are clearances inclea clear answers in a broadway to two main questions. Is it legal for a president to ask a political foe, bribing him for it, and what are those key questions . Youre right. Joining me now is democratic congressman Jerry Connelly who sits on the House Oversight committee. Your suggestion is that the Trump Administration is just too inept to bribe a foreign leader. Its extraordinary. The only thing missing in Lindsey Grahams defense is an insanity plea. Which actually might work better than an incompetence plea. One is just struck with the complete collapse of even the pretense of a defense of the president s behavior. And i dont think that serves him well in the face of an impeachment inquiry and likely articles of impeachment to be voted on by the house. Lets look at something that rudy giuliani, the president s personal lawyer, tweeted in the last 24 hours. He tweeted that the ukranian investigation was done solely as a defense attorney to defend my client against false charges that kept changing as one after another was disproven. So what hes saying is the request that he was making of ukraine were to advance his client, the president s, personal interests. Whats your reaction . Well, i mean, giuliani is all over the place and is himself in legal jeopardy. He is apparently the subject of a federal investigation, and two of his cronies have been indicted for crimes. So i hardly think giuliani is the dispositive source for enlightening us. True, but what does that tell you about what hes saying, explicitly he was trying to demand the president s interest while dealing with government officials and directed to deal with government officials by the president . I take that as an admission that he was furthering the purpose of the original phone call between President Trump and president zelensky which was to extort othe ukranian president o give him political dirt on a prospective political opponent in exchange for military aid that was held and a prospective visit between the two president s that was highly desirable by the new president of ukraine. Congressman connelly, i want to talk about what manu raju just reported, that you and the democrats have signalled youre fasttracking the impeachment proceedings, avoiding a court battle, limiting public hearings and that the impeachment could be done in the house as soon as this month. Is that a strategy that you support . I certainly support expediting the process. I dont think it needs to be dragged out. I think we have the facts and the basic narrative in front of us and have for quite some time. And we need to remember, this is preceded by a very extensive report and investigation by Robert Mueller. Public hearings with respect to Robert Mueller, including his own testimony as well as other public hearings related to these issues. Its not like this is being done on, you know, the cheap and dirty. This is a twoyear process thats being culminated in the articles of impeachment the judiciary will draw thats interesting, you just talked about the mueller investigation. Will that be part of the articles of impeachment . I certainly hope so. I dont believe we can proceed without addressing obstruction of justice, which was very carefully documented and described by Robert Mueller in his report. So are other members of the leadership are the democratic leadership, in total, are they on board with the notion of not limiting it to ukraine but expanding it to also include Robert Muellers report . I dont know that. I think that will be part of our deliberative process. Theyre not wrong in putting a pre eminence on ukraine because that narrative is quite understandable and is in front of us. But i believe obstruction has to be addressed or we risk setting up a negative precedent that obstruction somehow is okay if its the president of the United States. And i dont think we want that precedent. I want to ask quickly before i let you go a 2020 question. The president ial race is likely to be won and lost in the countrys suburbs. You represent a suburban district. Do you think it would hurt you and your fellow democrats to have a nominee who supports medicare for all . I think if were going to have a nominee who supports medicare for all, its going to have to be very carefully outlined. I think medicare for all, a lot of it has been a Bumper Sticker of slowing agans as opposed to careful details. Would Elizabeth Warrens plan fly in the suburbs . I still think more details are necessary. There are a lot of experts who believe that she underestimated the cost. Do you . We need to explore that. Look, i do. I think there are 160, 180 million americans with private insurance who like it, and i think democrats threaten that insurance at their own peril. We are on a winning streak. I was in the senate at the time of the clinton impeachment, and that was the big issue. Who do you call . Do you have witnesses . Do you have them crossexamined . How much authority to give to the other side to call witnesses, because if you call joe and hunter biden, theyre going to call donald trump. Do you have the president come down to the floor . We wanted bill clinton, the House Republicans wanted bill clinton to come testify on the senate floor, and his counsel said, no, were not doing it. For those who dont know the history of Rick Santorum as i do since i first met you, covering you during that time, you had sort of recently beenie tloek eo the senate so you still had some ties to the senate in the house, and you negotiated between the senate and the house. I was considered the house broker because the Senate Democrats wanted to have a vote and be done. They wanted to, in a sense, call this political charade that the House Republicans were involved in just that and they wanted it ended. There are calls now for Senate Republicans to do the same thing. There are. By a lot of republicans. By a lot of republicans saying this is a political charade. The House Republicans as much as certainly it was political to go after bill clinton knew they had a chance and bill clinton had a chance. Not so much here. Republicans are saying, lets just shut this off. Others are saying, as you heard here with biden, no, we want a full trial, we want to expose this for the charade that it is. The democrats Chuck Schumer and the democrats are going to be caught because a lot of them would love to see a fullblown trial, but at the same time, theres peril to that. Spending all this time on it, having the administration have their day in court to crossexamine these witnesses could be a bad day for us. What do you think the possibility is that he would get called and have to go and testify in his own impeachment trial . Bill clinton had to testify in his own impeachment trial but he did so with a videotape. They were able to interview him that he was not going to submit himself before the congress and testify. I suspect if they do a trial or some version of a trial, the president is going to have to put some things on the record. So thats the rub between the republicans saying, we just want to ignore this, do we want to do an abbreviated trial or a fullblown trial . I also covered you extensively when you were the chief communicator of the republicans, you were the chair in the conference there. Looking at the 50 different types of defense today, as i said before, throwing spaghetti on the wall and seeing what sticks, is that a good strategy . By the way, all of it is not the actual substance of what weve heard. No, i think part of the problem is as much as we think weve heard a lot about the ukraine situation, we still dont know a lot. The white house is telling republicans, look, give us an opportunity to crossexamine all these witnesses and their stories are going to fall apart. This is not what everyone is suggesting it is. So i think republicans are doing just what you said. Everybody is sort of doing whatever they can to hold off the horde until a more definitive story comes out, because right now they really dont have one. And do you think there is quid pro quo . We love our diversity and if she doesnt like it, i think these from virginia, im not sure, she can move out of virginia. We dont want that talk in our state.
