National emergency to fund his border wall and congress is all but sure to take up an unprecedented measure to repeal it. Thats not what the president was fuming about. He was lashing out at Andrew Mccabe and Rod Rosenstein in a brand new book mccabe is corroborating reports that rosenstein discussed secret lly recording the president by wearing a wire and possibly trying to invoke the 25th amendment to remove them from office. Lets begin with the emergency that could become a crisis. Sarah westwood is in west palm beach. The white house knew that these fights were coming. Are they ready . Given that the president said i dont really need to do this . Reporter white house Officials Say the president is prepared to defend his National Emergency declaration from the expected legal and congressional challenges. This was always going to be the problem with trying to get money through executive action and not through congress. But already california and at least six other states are preparing lawsuits against the Trump Administration and the aclu among other groups also readying for a legal fight within the administration. Beyond the road blocks in the court over on capitol hill, House Democrats are planning to pursue the resolution of disapproval to try to stop the president from using his executive power in this way. That could gain traction in the senate where some republicans are uneasy with the president making this move. Steven miller said that the president could issue the first veto of his presidency if the resolution were to make it to his desk. If they pass a resolution of disapproval will the president veto that which will be the first veto . Obviously the president will protect his National Emergency declaration. Yes he will veto . He will protect his National Emergency declaration guaranteed. Reporter protests are being planned against the president s use of a National Emergency. These come amid uncertainty about just where the administration will be getting the roughly 6 billion trump was willing to unlock with the National Emergency declaration. With the looming battles in courts and congress we could see significant delays before the administration is actually able to access any of those federal funds. Sarah westwood, thanks for the update. So big picture, President Trump is declaring a National Emergency to move taxpayer dollars out of funding the congress has proved to another fund to build the wall. Remember, all of those times that he said mexico would pay for the wall . That brings me to this. What are you looking at . You are looking at the New York Times reminding us of all the times, listing them all in red there of the president vowing that mexico would pay. That list is lengthy. With me now, republican strategist for the rnc and former manager for Hillary Clintons president ial campaign. Good morning one and all. Doug, just really simply put, you say short term victories do not equate to long term success always. Is that what the president is looking at here . His base is obviously very excited about this. This is something that regardless of who is going to pay for it, i think we can agree that mexico is never going to pay for it, they want a wall where they want rhetoric to a wall. They are happy right now. Long term this is a problem for the president because he is going to see more and more republicans peel off. What im hearing so much on the hill is that the private hand wringing is becoming more and more public. More and more Republican House members and senators are willing to speak out. This is damaging for the country. As we have seen with president obamas declaration on immigration earlier, this sets a precedent. What President Trump has done sets a huge precedent. If you are a republican and you dont want to see the next democratic president assuming there will be one in two years or six years declare that on guns or on immigration or climate or whatever it may be, they now can look at trump and say donald trump did this, i can do this, too. Here is the sticking point. You have article one section 9 clause 7 of the constitution which says no money shall be drawn from the treasury but in consequence of appropriations giving congress the power of the purse. Then you have Steven Miller especially on all things immigration, you have the 1976 emergencies act. This is an argument over which overrides the other and where the chips fall. Here is the crux of the problem for donald trump. There is no National Emergency at the border. It is a big conjob from a very renowned conartist. Illegal crossings are at historical lows. Crime rates from undocumented immigrants are way lower than crime rates from native born. The drugs that are coming over, the vast majority are coming in at port of entries. This is not a National Emergency. The real National Emergency here for donald trump is that he is running for reelection in 2020 with low Favorability Ratings and not having made good yet on his Key Campaign Promise of 2016, building that great big wall and having mexico pay for it. Mexico is never going to pay for it. He cant get money from congress to build it. And he has very key conservative figures calling him weak. So his emergency is not one of National Emergency. It is a political National Emergency for him. So the question becomes, then, if you agree its a political emergency, what will congress do about it . Specifically, what will republicans in congress do about it . You heard the democrat chair of the House Intel Committee over the weekend saying this is going to be a moment of truth for my republican colleagues. Will they allow this to happen and allow congresss authority to be seeded to the president here on this . I wonder if you think they will act as in vote against the president on this one . You will see more of a vote against trump in the past. We will get to a veto proof majority . More republicans will peel off on this than they have on any trump initiatives before because they see this is a real loss of power for congress. I would say democrats and republicans under democratic president s and republican president s have seeded too much authority into the executive branch which is a longer obviously conversation but ultimately, poppy, we are always in this situation because of something that is not a terribly sexy political issue. That is called a working appropriations process. You mentioned it earlier. Dana bash put out i thought a really good package together on the new chair of the House Appropriations committee and the Ranking Member the first time in over 30 years that we have had women as a chair and Ranking Member of a committee. Whenever we have gotten into shut down politics or an issue like this its because we dont have a working appropriations process. Whether you agree with donald trump on this or not, if congress doesnt do his job, the executive fills that void and this is where Congress Needs to stand up. Lets take a moment and listen to Nick Mulvaney talking about what he calls an imperial presidency. An imperial presidency is dangerous for everyone. This is the premiere issue right now in washington d. C. I dont think we will get anything across the president s desk that will pass a veto but i think we should put it on his desk and let him know that the elected officials of congress object to him going around congress. Obviously we saw president obama take liberties when it comes to executive orders, et cetera. Different in this ones in terms of this is the first where we see the president ask for what he wants and not get what he wants and then declare a National Emergency here. What do you make of the comments then versus now . Obviously, the hypocrisy is tremendous. I agree with doug in that i think you will see some republicans sign on to this resolution of disapproval on the hill. This is not what the Republican Party is about, circumventing congress. They are about limited government. They are about controlling the appropriations and the purse. I think aside from some members voting for the resolution, you are going to have maybe some republicans who are considering primarying him thinking maybe this is the time for me to jump in. We already have bill weld who is doing an ex ploratory committee. I think this could be pushing some republicans to say enough. You are saying it makes it more likely. Do you agree that this will push further potential primary of the president . I think it could, but ultimately, as long as donald trump and this is the challenge for Congressional Republicans right now especially those who have tough reelections in the house and the senate, as long as donald trump is at 85 or 90 approval within the Republican Party, not only is he going to win the primary, but those republicans who are running for reelection have to be careful about the needle they are trying to thread politically in opposing trump and appealing to a broader swath of voters in a general election. President trump is slamming Andrew Mccabe as well as the Deputy Attorney general Rod Rosenstein. It is established as raging war against the u. S. Is there any world in which what andy mccabe says rosenstein talked about is treason s . Not at all. What they were doing when they were batting around options for how to deal with the president and what they were hearing from the president was on behalf of the United States saying that the for is the one acting in such a way as to raise kurn r concern concerns. There is no way. Lindsey graham wants to know more. He is a key ally of the president. He speaks out and disagrees with President Trump. He now has very powerful position heading the judiciary committee. He calls what andy mccabe laid out the conversations between him and rosenstein about possibly wearing a wire or invoking the 25th amendment, a bureaucratic coup. He wants to subpoena them to learn more. Do you agree with graham on it is with the subpoena here . There is not a lot of guidance or parameters around what congress is allowed to do with their oversight roles. Its not really for anyone else to say, i suppose. If they want to take a look at this, they certainly can. The issue is what they were doing it appears from what we heard from mccabe and others is they were kind of batting around options to deal with what they were seeing as a president who was taking a series of steps that caused them great concern. We know they opened the investigations into the president and all of that goes over to mueller who has been successful and productive investigation. They can look into this all they want. It kind of plays into their deep state theory that they have been kind of going with for a while now, to investigate the investigators and deep state against the president. There is significance that mccabe says contemporaneous memos with the president in the oval office are now in the hands of bob mueller. Its all about credibility. Anytime you say this happened and you are trying to judge the credibility of that person to see whether you believe that that is what happened, if they took notes at the time when they didnt have a reason that may have arisen later to make it up, that goes to their credibility. It makes it more likely that they are telling the truth. What bob mueller is doing with the information, i dont see he is doing much with it inso far that we know is in the memos. There may be more including things that might be classified that he is unable to share publically. That is stuff mueller may have an interest in. In terms of how much credibility the public should give and mueller will give to Andrew Mccabe , how significant is it that the department of justices Inspector General report found that he lied to investigators under oath about when asked if he was a source of this story given to the wall street journal. He told 60 minutes he was confused when he answered that. Does that raise credibility questions for you . Anytime you are trying to judge someones credibility and learn that they lied about something it definitely goes into it. The question is how do you judge credibility around what he is saying. Other people talked about their Decision Making processes or why they open the investigation, what they were thinking about at the time, what went into it. You cant really attack that so much. He gave good reasons for opening it and all of those reasons are things that are corroborated and wasnt making those things up. It was a fascinating interview. Thank you very much. Tonight is a big night for her. What message is she going to try to drive home . Reporter is certainly is a big night for her. She is trying to differentiate herself. Voters who are really interestinged interested in knowing more about her. She will be very personable having covered her and watching her with these audiences, very spontaneo spontaneous. She does not use a teleprompter or notes. She is very humorous and uses that. She is traveling with her daughter abigail and her husband, john. One of the thirfirst things shel talk about is how happy she is to be indoors out of the snow. She likes to talk about the rollout and use it to her advantage. It was one of the first questions i asked her when she announced, what makes her different . Im standing in the snow and blizzard. She talked about the Mississippi River as another metaphor running through the midwest as a connecter, as a bridge, if you will. That is something that she also will address. It is going to be a focus. She really is a story teller. This is really an introduction to the majority of the country that really doesnt know here and hasnt heard of her before and whether or not she can make some inroads for those folks. From beautiful snowy 2346. Important to note you consider yourself nonpartisan and obviously representing nonpartisan stuff here but do come from a republican conservative background just to note. What do voters in New Hampshire right now care most about . I know you guys have new polling. Yes, we did some polling last week and surprisingly there were some big things that showed up in the polling. 84 of democrats here in New Hampshire believe that the president will not win reelection. So when you asked them the second question that follows which is what do you care about in a candidate . What they care about is someone who agrees with their issues much more than say someone that is capable of defeating donald trump. So im not sure if the democrats here are sort of underestimating donald trump again. That can be a possibility. That kind of a question weighs in on how they are figuring their choices for president. Thats so interesting because that is counter to what cnns polling just a few weeks ago found. It found that what democratic voters are most interested in, you can see it surprised us a bit. It wasnt things like the new deal. It was 49 there, the candidate that has sort of the good chance to beat the president. Do you get a sense that New Hampshire is an anomaly on that front . No. I just think that a lot of democrats just do not like all donald trump for one reason or another. I think they probably say that this through is no way that this person is going to get reelected. I think they might have said the same thing on october of 2016. The point is as we see that there could be 30 different candidates running for president here in New Hampshire, who are they going to choose . How are they going to make that decision . A lot of them have similar positions. Are they going to be looking at somebody who can be on a debate stage with donald trump . Talking about a debate stage not necessarily a democrat but the appetite for a republican to challenge President Trump. You have former Massachusetts Governor bill weld considering this. Is there an appetite among voters there in New Hampshire, Republican Voters for someone to take on the president within his own party . Well, amongst republicans, about 75 , 77 are rock solid behind the president and would encourage him to run again. That is another way for a pollster to ask the question is whether or not you would support the president. Remember that independents can vote in the primary. If there is a hot independent primary will independents take a democratic ballot and compete in that field, if you will . Or are they likely to go and vote for someone like bill weld . I think the jury is out on that. He did announce the Exploratory Committee and was very well received. Well see whether or not the president has any cracks going forward, but the one thing about the president is he has had a lot of rock solid support amongst republicans straight on through all of the controversies, all the elections. He is rock solid in the Republican Party. Very quickly, very, very quickly because they are telling you to wrap. What about an independent . Is there an appetite for a serious independent candidate . Well, independents make up the largest voting block in New Hampshire, but i would say to take an independent campaign nationwide is so very difficult. We should mention, i did call up and try to get comment from the cook county States Attorneys Office and grand juries are supposed to be secret. So they have not commented. They have not said whether or not they said they couldnt confirm or deny whether or not there is an investigation into r. Kelly and the allegations about him having Sexual Activity with under aged girls. We have emailed with his attorney who has told us no one from Law Enforcement has contacted him or his client regarding any potential investigation. He is not aware of any grand jury being convened. I know you because youre a great reporter. You have learned about this. You have been able to see the tape. Can you give us a sense of what is on it . That gives us a lens into what the grand jury is looking at. I think what is important about this tape is that it could be potential evident that the States Attorneys Office uses in connection with any case that it may bring against r. Kelly. It is disturbing. I want to warn our viewers that details im about to explain are very disturbing. There is a man who is naked. He appears to be r. Kelly who comes into the frame. You can see him constantly adjusting the video, trying to position the video as if he is making a movie. You also hear a girl on the tape and see a girl on the tape. It is a vhs tape. She is using the word daddy repeatedly over and over and over again. She also refers to her genitalia at least six times as being 14 years old. And a couple of times the person who appears to be r. Kelly repeats that. He repeats the fact that she keeps saying that her genitalia is 14 years old. He repeats that. It is really disturbing stuff. As you know now, there is a grand jury that has convened according to our sources, poppy. Its important. Thank you for bringing it to us this morning. Ahead for us, millions of venezuelans have fled for their lives as the humanitarian crisis grows worse by the hour. The situation in the bordering countries is becoming more desperate. We will have a live report ahead. This afternoon, President Trump will speak about the growing crisis in venezuela as more than a million venezuelans have fled the country looking for any better situation making their way to colombia. Resource tlz have been severely strained particularly at the local hospital. With me is my colleague who joins me with more. Your reporting is so important because it is about the human tol that the venezuelan people are facing as a result of this. What can you tell us . Reporter its been the stories have been absolutely heart wrenching. We are hearing on both sides of the border. According to juan guaido as mean as 350,000 people inside venezuela are at the risk of dying because there is very little in terms of medication. In very basic terms, iv fluid and gauze tape. You are talking about antibiotics. You cant get your hands on this here. Only those with a lot of money within Nicolas Maduros circle. They are crossing the border and going to colombia. I met three individuals really at the brink of kpaupexhaustion because of this. Take a look. For most of her young life she has only known hunger. Now her body is feeling its imp pact, frail, irritable and in pain, she has been unable to keep food down. Her little tummy suffering from severe acute malnutrition from what was once the worlds richest oil nation just cant keep it in. She is one of thousands of venezuelan children leaving home with many being treated at this border hospital. I meet several women who have seen scarcity for months on end. What did you eat there . Very little. Rations. Reporter i go further down the hall and on a floor where pain and life go hand in hand i come facetoface with tragedy. She is telling me that her baby is dead, no heart beat, nothing, no life, she is telling me. Basically nine weeks. Her baby has died. Reporter this is the toll of the humanitarian crisis Nicolas Maduro denies. Death and despair are not just contained within these hospital walls. I travelled through and meet others desperate for help. He made the journey simply for survival. He says he is hiv positive and desperately needed antiviral drugs unavailable back home. As he gets a checkup, the doctor at the ngo tells me nine of his hiv patients died in 2018, all venezuelans. Getting here he has to sacrifice. I do my best to ask him if he ever had to sell sex to survive. Poppy, 3 million venezuelans left venezuela, one million going to colombia. All eyes will be on juan guaido to see whether he can get the aid into venezuela come saturday this 23rd of february. It is a tragedy. It is heartbreaking sitting on the side of that mothers bed, six months into her pregnancy losing her child. That is one of countless stories. What is the most significant thing that the u. S. And Trump Administration can do at this point to ease that suffering . I think it is really important that any kind of humanitarian assistance is coordinated with the u. N. Agencies already on the ground in venezuela. They are the ones with the most expertise and the ones that can assure that any aid that is brought in is being distributed in the way that is to scale with the very real and deep emergency. I think one of the important things about the people need to know is that maduro has not been helpful saying we are not beggars. We dont need this when the need is so clear. There is no way you will stand in the way of a people whose children are starving to death and families whose children are dying in hospitals. First, do you think that he is right . Is he able to get in regardless . You said making public demands may be the worst thing the administration can do right now. Why . Yeah. Well, i think it is very clear that the 23rd rr there is goelg to be mobilization in the border and people are going to cross over the border and bring it back into venezuela. I think its going to be really important that the opposition that is coordinating this is working again with u. N. And humanitarian actors that have a lot of experience already working in venezuela under the radar because they are the ones that are most qualified in insuring that aid is distributed according to need. And second of all, i think that its really important that the United States ensures that it is working as much as possible in a Multi Lateral way. This is not about the u. S. Versus maduro but the u. S. In partnership with a Large Coalition of latin american countries. Finally, jeffrey, when you look at the crisis, the humanitarian crisis, should the u. S. Priority be helping the venezuelan people or changing the leadership of venezuela or does the former require the latter . I think that its very clear that the root of the crisis right now in venezuela lies in the deep corruption and economic mismanagement we have seen in venezuela. Committee says documents reveal facebook overwrote the user privacy settings so they could transfer data to app developers. If this is true, its remarkable. What more did the committee find . This committee called facebook akin to a digital gangster where they act as though they are above and dont have to adhere to the law. There is much stricter data privacy laws and the committee is alleging that facebook knowingly and willingly violated some of the laws. They said part of how they discovered this is part of an 18month investigation. They also obtained internal emails. A few months ago there was a scandal for how the committee obtained the emails to get them from somebody who was in london at the time. They say these emails show that facebook was willing to override this data.
