Manafort. And speaking of flipping today, Ruby Red District in ohio may be the latest to elect a democrat in a special election. We will get to that in a moment. First lets go outside of the federal courthouse in alexandria, virginia, on the trial of Paul Manafort. Joe johns is here with an update. Good morning, joe. Rick gates back on the stand, taking questions from prosecutors, laying out the government case. They say it is illegal conduct that goes all the way from 2008 to 2015. Thats seven years. Meanwhile, in 2016, mr. Manafort took over as the Campaign Chairman for the trump campaign, rick gates was right there beside him as his deputy. So what did we learn so far . Among the most important testimony is his testimony that our Justice Correspondent Jessica Schneider is here, former u. S. Attorney greg bower joining me. And analyst xian wu. Lay out your representation previously of rick gates so its on the table. Right. We had represented rick from the time that he was indicted to just before he pled guilt et etetch guilty. The guilty plea and illegal operation i was not involved in. And everything i talk about is on the record. Nothing confidential or privileged. Understood. Building on that, what do you make of the prosecutions strategy of laying out the serious crimes that rick gates now admits to, just putting it out and not waiting for the cross and the defense to bring this out . Thats a good strategy. Its by the book. The prosecutions wants to put out any dirty laundry before it gets revealed as a surprise to them. This is the thing theyll normally want to do. Theyll want the cooperating witness, as well as any noncooperating witness to be up front with anything the prosecution wants to use against them. It theoretically will add credibility to gates testimony because hes willing to admit other things hes done wrong up front rather than being caught at it by the defense. Jessica, we heard yesterday a lot of color from inside of the courtroom that manafort was staring straight at rick gates. Some described it as staring with daggers the entire time. What can you tell us about that, how the jury might have responded . This was a noholdsbarred testimony. We only saw about 90 minutes yesterday. Were in for another three hours of direct examination. And thats exactly right. Paul manafort was really staring down rick gates as he was on the witness stand. Whats interesting to note, rick gates, we know, never looked at Paul Manafort. He avoided eye contact. He really treated this like he was just there to do his job, to tell the jury what he promised prosecutors he would. So who knows how the jurys reading into this. I mean, Paul Manaforts been sitting there silently throughout the trial that started just about a week ago. So who knows how the jurys reading into this. You know, rick gates is giving so much information here to the jury about exactly how this scheme played out with Paul Manafort, that he was an active part of. And also interesting here maybe, poppy, is what the jury isnt hearing because you know, rick gates has met with prosecutors 20 times already. Theyve agreed not to bring additional charges. Rick gates was an integral part of the operation with Paul Manafort and was also with the donald trump campaign. And there were a few contacts that have come out with russians during the campaign. And we know that rick are available in september and october of 2016. He had talked to constantin The latest news from around the world with hosts John Berman and Poppy Harlow. Gates for putting so much of that together. Assuming its not a crime to unwittingly hire at least alleged tax evaders and admit it on the part of gates, greg, does the president truly have nothing to fear other than bad optics . No. I think theres potentially a lot more than that. And all of that, of course, is in the background of the investigation. As you mentioned, its not something that this jury is going to hear about. Its not a focus of these particular charges in this trial. Its part of the background. Im assuming that the mueller team wants to get this narrow case out of the way. Then moving forward with rick gates and potentially Paul Manafort as a cooperating witness for further cases. Jessica, back to you in terms of what is expected today. You had t and how the cross will go. Year youre a lawyer, you know how this goes. They will lay out the bad illegal stuff that gates is admitting to doing. How do they cross him in the most effective way since they wont have the bombshells in the cross since theyre already out there . Thats right. That was an effective play by prosecutors. Of course, you want to get that potentially Bad Information out during the direct examination so you can control it, so the jury can hear it. So theyve already done that. Rick gates here admitting that, yes, he lied on credit card applications, on mortgage applications, and that he falsified some of the expense reports to then get the hundreds of thousands of dollars from Paul Manafort. What the defense is going to do here, theyre going to still hammer home on all of the lies that rick gates told. And the core argument, they told this to the jury during opening statements, they said, listen, were going to show you that rick gates embezzled millions of dollars from Paul Manafort. Again, something the prosecution has already touched on but that the defense will delve a lot more deeply into. Cross . I agree with shan. If the prosecution does its job, there will be nothing left for the jury to be surprised by. Nothing that the jury hasnt heard in terms of negative information about rick gates, his crimes and past lying, so i think what the defense is left with is nothing more than reiterating and getting mr. Gates to repeat over and over that he lied repeatedly, and in closing arguments, trying to emphasize to the jury that this is san admitted liar, that you this is an admitted liar, that you cannot believe him. If the prosecution does its job, and this is prosecution 101, the jury will not be surprised by anything they hear during the crossexamination. Thank you all very much. Reporter thats not exactly surprising given what the president tweeted this morning and just what a News Cycle It created because it was the most explicit acknowledgment that his son and russians from trump tower was about getting damaging information on Hillary Clinton and not about russian adoptions, as the president s son said in a statement that the president himself dictate initially. There are several other tweets, as well, that we know or are likely to the president s team. The one where he urged Attorney General Jeff Sessions to end the Mueller Investigation even though Jeff Sessions recused himself from this. And this comes amid the New York Times reporting that these tweets have become a focus for the special counsel, robert mueller, something that hes looking at, what the president has tweeted about Jeff Sessions, about james comey, and the like. Of course, the president can get this advice about tweeting. He can be told not to tweet about certain things because they believe its giving too much oxygen to a story like that. This is the president s twitter feed. Hes been advised by people in the past and previous lawyers not to tweet about things like that and has done so anyway. Well see if this is any different than that. Right. Its 10 17 in the morning, and there havent been any yet. Well see what happens. Kaitlan, Before You Go, the back and forth over whether or not the president is going to sit for the interview with muellers team, we know mueller wants to and at least is insisting now on asking some obstructionrelated questions, face to face with the president , so they can have followups. The president says he wants to do this. Lawyers dont want him to. Where are things now . Reporter the president s legal team is prepared to respond, a proposal that said they would limit the questions about Obstruction Of Justice but wanted to ask the questions to the president in person. That is not something the president s legal team wants. Instead they want to limit those questions that he asked the president to questions about collusion and events that occurred before President Trump was inaugurated. They are prepared to respond in the coming days. Of course, a word of caution here. Negotiations have been ongoing for eight months. They hit a wall after the fbi hit Michael Cohens home, office, and hotel. The president has been expressing interest, sources tell us, in sitting down for an interview with the special counsel as he did in the previous months. And ive watched some of the things that have happened in the past few months, and its a little scary. Im probably a lot like millions of americans where its not necessarily that you like the candidate of choice, but its who you dislike less. I think that during the president ial election, i believe thats how trump ended up in office. I think the race with balderson is the same way. Reporter kennedy says shes concerned about oconnors ties to Democratic Leader Nancy Pelosi who was seen unfavorably by a majority of americans according to a recent gallup poll. Oconnor waffled on whether he would support pelosi during a previous interview and attack ads keep tying him to the minority leader. Ive said time and time again that i would vote against nancy pelosi. We can need new we need new leadership in washington because what we see now is not working. Reporter do you think thats resonating with people on the fence, who are uncomfortable with yeah. I mean, people are focused on that stuff. Well try not to speak over each other too much. This is a safe republican district until now. The race is neck and neck, 43 , 44 in the latest polling. The president won the district by 11 points, double digits. Its one that republicans have held by at least 20 points since 2012. Outside republican, you know, donations were five times that of outside democratic donations. And yet it is so close. Is this a wakeup call for your part party . I think it highlights the importance of energy in any campaign. And in ohio, i think it highlights People Dont Vote in ohio just two years ago on june 7th of 2016, i won a special election to fill former speaker boehners open seat. And so that was the last special election for congress in ohio. Voter turnout was low. People arent used to voting in ohio in june or august. Its going to be more of a test of who can get out the vote. And those are generally the most active voters. So let me get your take on something that happened in the final hours. Ill play it for our viewers in case they missed it. This is last night, the republican candidate, Troy Balderson, said this my opponents from Franklin County. Franklin county has been challenging. We dont want somebody from Franklin County representing us. Writing off onethird of the electorate in the district you want to represent. Now this morning, he, you know, tried to clean it up and said i want to represent everyone. But do you think that could be a fatal error for him . Well, i dont know his district. I dont know the demographics of each of the counties there. But you know, ive always found that youre usually better off to multiply your allies instead of your adversaries. You know, i take from the comment that the majority of oconnors support is from Franklin County. So it wasnt about the county itself but the demographics of where oconnors support comes from. Good point. Multiply your allies, not adversaries. On tariffs, look, you have been very openly critical of the president s strategy here with tariffs. If people dont know, the district you represent, ohio 8, is a big agriculture district. You have gone as far as to say the approach with the tariffs from the white house, quote, will cause a recession. If they are not stopped, if they are not turned around. What have they done to the people you represent, and is President Trump to blame . I dont blame President Trump. Frankly, i was in manufacturing before i got elected to congress. And when the president talked about fixing our trade deals and making righting some of the wrongs out of the bad policy that got us into this massive Trade Deficit with china taking advantage of our technology, intellectual property theft, subsidies taken out of companies. You know, American Companies and American Workers having to compete against foreign countries, not just foreign competitors, i was energized, and so that toplevel mission, i couldnt be more enthusiastically supportive of. But i have been very concerned about Peter Navarros approach of applying uniform tariffs to steel because what thats done is it isnt imposed by retaliation from china or another country. Thats something that because of the way weve done it has big consequences for companies all across the country but particularly let me jump in here text in ohio 8 let me jump in here. You say i dont blame the president. You blame his, you know, one of his top trade advisers, peter and a half yo. The president is the peter navarro. The president is the one doing this. How can you not blame the president for a policy that you say will cause a recession if its not ended . Well, i think the strategy is big i look at it a little as military guy, a little bit like friendly fire. There is no such thing as friendly fire. We want to make sure we dont do things that hurt American Companies. The uniform tariffs are actively hurting companies. Weve got about 20,000 isnt that the president s companies waiting for exemption to the tariffs. At the end of the day, you know, everything that happens or fails to happen, the leader has to take ownership over. I believe that the president has been led down the strategy by peter and a half yo. And i do peter navarro. And i do believe that the president is seeing results. While the longterm play probably isnt this, i think the shortterm play is were going to cause a lot of intensity to bring everyone to the negotiating table. I think when you see the president really being strongly commit the to this path on tariffs, hes saying, look, come to the table sooner rather than later, and well all be better off for it. Its confusing, though, to me because you have proposed you want to tie the president s hands. On one hand you say its not the president s fault hes been led by the path of peter navarro. If we know anything about the president , he paints his own path. You proposed legislation that would tie the president s hand on tariffs. That would not let him unilaterally make moves like this, that would enforce that congress would have to approve of tariffs like this. Can you help explain that to me . Yeah. I think you misunderstand the legislation that i proposed. I i read it doesnt tie his hands. Its not retroactive. It doesnt undo anything hes done. In fact it leaves the president as the lead negotiator on trade. What it does is it adds permanence to whatever the president does. Its not just an Executive Action that can be undone by a successor. I it becomes permanent. I dont think i i misunderstood the legislation. I read through your proposal. Your proposal would, correct me if im wrong on this, but it would mandate that Going Forward congress would have to approve tariffs that the president wants to see placed. Correct . Well, not not in advance of the president implementing them. So the president could negotiate whatever he likes for them to stick. For them to stick. The president talked a lot about tariffs, for example. Yeah, to stick. So the president implemented some that took effect on july 6th. Everything about that would stay the same up until now until october 6th. If we intended that to be a longterm approach, by the 6th, congress would have to act if the bill became law. I think everyones rooting for a better negotiation ahead of october 6th. If not, the president could change it, could work with congress, and wed have a more cla collaborative approach. That would produce collaboration so if we were going to do uniform tariffs which i dont think we would do together, we would have a better approach to deal with the exemptions and there wouldnt be six people working on 20,000 exemptions, there would be a bigger staff or better plan. Uhhuh. All right. Let me ask you finally Before You Go about jim jordan. You have been supportive, should republicans maintain control of the house, supportive of your fellow member of the freedom caucus, jim jordan, in his bid to be house speaker. As you know, several wrestlers at osu have come forward and alleged, and jim jordan has vehemently denied that they have alleged that he knew about sexual abuse there previously by the team doctor when he was an assistants coach there. Do those an Assistant Coach there. Did those accusations concern you . Well, i think you take any accusations seriously. What i know of jim jordan, ive only known him about 2. 5 years, ive never known him to be a nonconfron nonconfrontational guy. Thats how i know him personally. I have a tremendous amount of respect for his character. Hes been a straight shooter with me every time ive interacted with him. Do you believe him over the accusers . Well, i do believe jims version. And i do hope that if the accusers have been on the receiving end of sexual abuse, whether at osu or anywhere else, that they get justice and the people that have done that are held accountable. My understanding in this case, the team doctor that is accused of doing anything to the wrestlers involved passed away in 2005. So im not sure what it willopene mean for them to get will mean for them to get resolution. I know theyre working with the Ohio State University to get that. This is a big day for gates. Theyll wrap up the direct. The crossexamination will begin. What has happened so far this morning . Yes, were an hour or so into his testimony. And really, rick gates going through some of the details, spelling out just how manafort made money, how the scheme worked. Kind of The Nitty Gritty details about how the ukrainians would put money into the accounts of manaforts accounts. That they used various accounts of their own that they created, the ukrainians have put some of the money into manaforts accounts. Its really the important part of the prosecutions case. Some of the more detailed information, perhaps mundane for some of us. But these are the important facts, how the prosecution say the scheme worked. How manafort made money. How he avoided paying some of the taxes, and how he hid some of this money. At one point, rick gates saying that manafort made about five Million Euros from the transactions and described how the campaign worked. How the ukrainians structured the deals, contracts, and how much they would pay manafort in terms of helping him with some of the political campaigns that he was working on. Elizabeth, look, she talks about one in nine moms suffering from Postpartum Depression or who they call the baby blues, or just having a really hard time after the birth of your child. How important is it for us to talk about this and know the facts . Poppy, its so important because i think part and parcel of how we women sometimes feel after childbirth is alone, right. When you feel alone, its really hard to heal. So to have Serena Williams, such an incredibly strong woman, say, hey, i felt this way, i think will mean something to new moms. The quote that you had from wilmington, i w from wimbled was at wimbledon watching as she said that that day. And tears came to my eyes. I thought what an incredible thing. This woman has gotten to the wimbledon finals, and here she is thanking other women and acknowledging other women and saying im doing this for the new moms. And for new moms to feel like they have someone like Serena Williams on their court, no pun intended, i think is incredibly powerful. I think it is. And you look at what she has gone through. I mean, she she had so much, had it so much tougher than i did. She had ana neardeath experien just giving birth. She does. That puts you at risk for Postpartum Depression, to have a traumatic birth. She has a bloodclotting disorder and was bedridden after the csection for six weeks. I think something thats important is that she talks about how she told the doctors, hey, i think this is going on. She told them, look for this, they didnt listen to her. I think it makes it a lot harder to recover when you feel like people arent listening to you. And she knew what she was talk could about. She was talking about. She was right. I think it makes it harder to recover when you feel like people havent been listening. Shes been so open about this. I mean, its not just this Instagram Post and not just what she said at wimbledon. She has this entire hbo series, being serena. Shes been open about it. I mean, elizabeth, as a mother of four for you, as a medical expert the way you are, are things changing . Is this a moment of real change where women and moms feel like they can confront this head on, be listened to, heard, and helped . I think it is. I think its important. I think there are limitations to this reveal. You know, Brooke Shields revealed her Postpartum Depression more than ten years ago. And have things gotten better, yes. But ill give you a sobering statistic from the centers for disease control, that nearly 60 of women with symptoms of Postpartum Depression dont get a diagnosis of Postpartum Depression. 60 . Once women get a diagnosis, 50 dont get treatment. Thats a real problem. 50 of women with this diagnosis dont get a treatment. Ill tell you, we are great in this country at screening for, say, diabetes. While the woman is pregnant. To make sure she and her baby get the care that they need. When you look at why this happened, i was shocked by it i mean, you look at youtube, for example, which he had 2. 4 million subscribers. His videos on youtube, watched 1. 5 billion times. Beforehand, all of these platforms had not pulled down something something, free speech. Why . It shows the companies are making decisions. Seemingly casual or very subjective way. There is no standard when it comes to what these tech giants are doing when theyre encountering hate speech and misinformation on their platforms. To be fair, this is a difficult situation for these giant companies. For the googles and the facebooks of the world. Sure. Hundreds of millions of users. But theyre being pressured to draw lines somewhere. Frankly, some of the pressure is coming from the media. Its coming from users who are asking, what are your policies . When someone is publishing hoaxes and lies and smears on your website, do you really want to be associated with that . And clearly now apple and youtube and facebook are saying, no, not in this case involving alex jones. But obviously the question is where else will they draw this line in the future . Yes, and why the decision now . Lets take a moment to listen to what facebook founder Mark Zuckerberg just a few weeks ago in mid july told Cara Swisher On her podcast about just this. Heres what he said the principles that on what we remove from the service are if its going to result in real harm, real physical harm, or if youre attacking individuals, then that content shouldnt be on the platform.
