That democrats will no doubt be seizing upon. This is going to be a rough battle up on capitol hill. White house legislator director mark short says they expect kavanaughs nomination by october 1st. Thats less than three month away. Judge catch has a lot of experience judge kavanaugh has a lot of experience, most of it in washington. Hes been on the d. C. Circuit court for the past 12 years. Before that, he worked for george w. Bush at the white house. Thats where millions of pieces of paper crossed kavanaughs desk while he was staff secretary for the president at some momentous times including september 11th and hurricane katrina. Theres really no doubt democrats will be seizing on all of that paper, all of that paper trail, and scrutinizing every word they can find. Now of course, President Trump, hes talked about it this morning. He is confident in his pick. But some questions were raised this morning just outside the white house with spokesman raj shah. The question included how Brett Kavanaugh was picked and what his role might be if he were to be confirmed at the Supreme Court if any russia investigation, related case, landed there. Take a listen. Did anybody in the white house assure Justice Kennedy that he his replacement would be Brett Kavanaugh if he retired . No. Would he recuse himself if any questions related to the Mueller Probe make it to the Supreme Court . Those are complex legal issues. Reporter so the white house dodging that direct question there. The question it came up because judge kavanaugh, he has written about the possibility of indicting sitting president s. And he suggested in a law review article that it should not be done. He wrote this in 2009. He said that the trial ofstating president would of a sitting president would cripple the federal government. Kavanaugh wrote the article a few years after he left the bush administration. He said his perspective had shifted after he served under george w. Bush, saying he had no appreciation for the demands of the presidency. And he did acknowledge that while the president was not above the law, he said that any investigation should wait until the president was out of office because, poppy, he said if there was an investigation, if there was an indictment, it would be far too disruptive. So of course that will be interesting, and that will be a point that democrats seize upon in these confirmation hearings. Pop . An important one. Thanks for the reporting this morning. Im joined by two people who know Brett Kavanaugh well. One of his law professors at yale and vouchs for him in a New York Times oped titled a liberals case for Brett Kavanaugh, and rebecca judged for him in 2010 and 2011. Nice to have you here. Lets listen to Majority Leader Mitch Mcconnell and get right back to you. The d. C. Circuit, judge kavanaugh possesses an impressive resume, an outstanding legal mind, and an exemplary judicial temperament. He served for 12 years on the most consequential circuit court. During that tenure hes proven to be one of the most thorough and thoughtful jurists in our country. Importantly, that record demonstrates an understanding of a judges proper role in our constitutional republic. Judge kavanaugh understands that in the United States of america judges are not, not, unelected super legislators whom we select for their personal views or policy preferences. A judges duty is to interpret the plain meaning of laws and constitution according to how they are written. Judges need to be unbiased. They need to treat all parties fairly. They need to approach every case with open ears and an open mind. Judges decisions must turn on the facts of each case and be based on the text that it is their job to interpret. By all accounts, judge kavanaugh is precisely that kind of judge. His resume, to put it simply, is topnotch. All right, quite a bit of praise there from senate Majority Leader Mitch Mcconnell about judge kavanaugh, calling him one of the most thoughtful and thorough justices in our country. Well keep an eye on this. Let me get to my guests who both know the judge well. Thank you for being here. And akiel, i read your oped in the times two minutes after it was published by the headline is startling a liberals case for judge kavanaugh. You say at the top, look, i was a big Hillary Clinton supporter. I was a big supporter of president obamas nominee for the seat that gorsuch got, ma r merrick garland, but you say kavanaugh is a superb pick, why . For the same reasons that judge garland would have been excellent. He is very well respected across the spectrum by lawyers, judges, scholars, the justices themselves. Youll hear from one of his clerks in a moment. He sends more clerks to the Supreme Court than anyone other than garland, and he sends them to justices across the political spectrum which suggests that the justices themselves across the spectrum respect him as do scholars. He is a scholar himself. I think hes very thoughtful and openminded. And i say this to my friends and fellow democrats, be careful what you wish for even if you were able to derail this. I think you get someone good, perhaps, but not as good as Brett Kavanaugh. But what do you say to those like, you know, legal experts who say theres no doubt that this pick hues the court more to the conservative bent . He clerked for kennedy but is not a kennedy who would necessarily be a hero of liberals on social issues. Well, i say to my friend steve ladic who was my student, again, be careful what you wish for because youre going to get someone if you were able to block someone openminded, smart, scholarly fair, be careful, you may get someone whos not as good along those dimensions. Not as expert in the constitution as is Brett Kavanaugh. So id say to my friend, steve ladic, you havent thought it through. Rebecca, ju you worked with judge kavanaugh. You say this is a red hearing, why . It is a red herring, why . It is a red herring. Reef roe v. Wade is being used to distract from the impeccable credentials judge kavanaugh has on the court. Part of those credentials include over a decade of wrestling precedent as a judge on the circuit. He would continue to do that faithfully and with an open mind and hearing the issues of eve everyone on the Supreme Court. As far as his support for women, his record belies and people like me are evidence of that. I am a young mother of three children under 3, and i attribute my vibrant career to judge kavanaugh. And there are dozens of female lawyers who can say the exact same thing. And so he has contributed to diversity and supported women in his profession more than any other similarly situated judge i can think of. Akiel, on roe v. Wade, a, do you agree with rebecca on that, that it is a red herring and being use today to distract . Because he has talked about it. He was asked about it by schumer in his 2006 confirmation hearing to the d. C. Circuit. He essentially said i would follow court precedent, but thats different when youre on a lower court than going to the Supreme Court. Frankly, how you think hes going to answer questions about roe v. Wade in his confirmation hearing. Youre right that the role of a lower court judge is different from a Supreme Court justice. Supreme Court Justices on occasion do need to modify precedent because the ultimate, the supreme law of the land, is the constitution itself. Brown vs. Board of education looked at the constitution and said it says equal, and that means we need to rethink plessy. I wrote in my oped i think its fair game to ask any candidate about his or her, any nominee, about his views, his or her views, and the candidates should ideally answer. Which, for example, neil gorsuch didnt, but nothing that a candidate says about her or his past writings or cases can be understood as a pledge or promise. Once youre on the court, if things look different to you, new arguments, new facts, then you have to be free to change your on monday. Thats what your mind. Thats what youve heard, he is going to keep an open minds, and i believe him. Is there anything that you know, rebecca, about him as a justice and a person that would make you think that he will actually answer these questions directly when asked during his confirmation hearing . As you know, the answers changed a lot since robert bjork, right, and the way that they choose to answer questions in their confirmation hearings, not exactly direct. Things have changed. Its unfortunate that confirmation hearings what they are today. I think the good thing about judge kavanaugh is that he has a record so he is not an unknown. Hes not someone that was appointed to the Supreme Court after only being a judge for a few months. Hes been on the second most Important Court in america for over a decade. So even if the confirmation hearings go the way they have been going recently, he has a record that america can look to, and that record has over 300 opinions in which judge kavanaugh has shown himself to be independent, thoughtful, openminded, fair, and willing to part ways with both his conservative and his liberal colleagues when that is what the law requires. All 12 boys and their soccer coach have been rescued from the flooded cave in thailand after 18 days in the dark. This operation, though, is not over yet. Four rescuers are still inside the cave. The thai navy s. E. A. L. S are asking for support as they try to work their way out. Cnn is live there and also at the hospital where these boys are recovering. Lets begin with our Senior International correspondent, ivan watson, who joins us from the cave. A remarkable day, a miraculous day, but still more work to do. Reporter still more work to do, but that said, i think there were an awful lot of tears of joy across the kingdom of thailand today. Just anecdotally what ive seen here from passersby, thai people who have said i was so happy i cried, upon hearing news that the stranded, the trapped soccer players and their coach, had all but rescued after more than two weeks deep inside the mountain, 2. 5 miles inside. There was a Facebook Post from the Royal Thai Navy s. E. A. L. S that came out saying, quote, were not sure if this is a miracle, science, or what. All 13 wild boars are now out of the cave. The wild boars, of course, the name of the Youth Soccer Team here in this corner of northern thailand. A team thats kind of become known in corners all around the world throughout this remarkable drama, this quite dangerous ordeal. But the thai navy s. E. A. L. S also pointed out that there are four rescuers that they still want to ensure that they get out safely. A doctor and three other thai navy s. E. A. L. S who went into the cave, all the way in, and stayed for more than a week there alongside the trapped boys, making sure that they stayed as healthy as possible. So as soon as we hear more about their condition when they have hopefully gotten out safely. Then well bring you that news. Recall that one thai navy s. E. A. L. Diver, a former, professional diver, died last week conducting these very dangerous operations, operations with razorsharp rocks that required the kids to wear wet suits to keep from suffering hypothermia as they were pulled out from deep beneath the mountain here. These are the last ambulances, take a look, that the boys were headed to the hospital in. Crowds are lining the route. You see them there look at the crowds cheering them on. These are the four final boys rescued, headed to the hospital. Thats where International Correspondent matt rivers is. Matt, what can you tell us about the health, the condition of these boys now . Reporter i can tell you that everyone here is pulling for these boys. That moment a couple of minutes ago when people were cheering as the ambulances came in, that was a remarkable moment to be a part of people coming out here to lend support to people theyve never met before. The last two ambulances that came by carrying the final child, the last member of that soccer team and the coach, they are inside. What we dont know is the conditions of boys 9, 10, 11, 12, and the coach. They are all inside, being treated in a special isolation ward, exactly as the eight members that were rescued before them were. What were hoping is that the conditions healthwise of the last couple of people that were rescued mirrors the conditions of the first eight. We know that theyre in pretty good shape. Yes, they came in with certain complications, five of the eight had lower body temperatures, two of the eight had lung infections, but they were treated immediately and responded well to that treatment. What were hoping to see for rest of the boys and the coach is that they respond to treatment, as well. Were hoping to hear soon from the hospital an update on the conditions. Until we do, i can tell you there is joy here in thailand at just the thought that these people are inside this hospital and not in that cave. Joy in thailand, indeed. That is startling to hear from the president. What a wait in brussels reporter it is a stunning statement, not surprising from President Trump. He seems to be saying that he feels more comfortable going into the meeting with russian president Vladimir Putin than he does coming on this a sum here where he is going to be vour surrounded by allies. Hes setting the tone, being incredibly combative on europe. This is what leaders hes meeting with are fearful of. That hes going to come and have a tense, divisive summit, and hes going to go finland and have a friendly time with Vladimir Putin, and they fear that that could lead to concessions like canceled military exercises or the scaling back of u. S. Troops here in europe. The president was asked if he thinks that putin was a friend or a faux, a friend or a faux. A competitor. I think that getting along with russia, getting along with china, with others, is a good thing. Reporter so you see there that very friendly language from the president there from someone who is the leader of a country that has meddled in the United States election, is accused of poisoning a former russian spy who was living in the uk, invading crimea, among other things, of course. And you see the language there, not combative at all. Now compare that to how he discussed nato. Nato has not treated us fairly, but i think well work something out. Were being taken advantage of by the european union. We lost 151 billion last year on trade, and on top of that, we spend at least 70 for nato. And frankly it helps them a lot more than it helps us. Reporter so there hes saying 70 . A few days ago he said 90 . The president doesnt always get the numbers right when he talks about nato. He is being incredibly defensive about the fact that he believes that nato is not worth its value. That they are ripping off the United States, saying that nato countries even though the United States is a nato country needs to pay more while the u. S. Should spend less. He is essentially spoiling for a fight when he lands here in brussels. It could well be a showdown. And he never mentions all of these key nato members stepped up their spending as a percent of their gdp after last years tense nato meeting. Kaitlan collins, let us know how it goes when he arrives. The president also praised when he was asked about theresa may, he said praising Boris Johnson, the foreign secretary, who just stepped down suddenly yesterday. Reporter a quick reference on nato. Now doubt theyll be trying to further formulate their plans on how to meet President Trumps criticism when they see him in brussels in the coming days. To that point, President Trump was asked whether theresa may should be in power. He said that was up to the people which is really sort of noncommittal and not really what youd want to or expect to hear. When asked about Boris Johnson, he said, well, Boris Johnsons been supportive of me, very nice to me. Perhaps ill give him, you know, perhaps ill see him, perhaps ill give him a call when im in the uk. Wow. That that for theresa may was not probably what she best wanted to hear. And explain why that is, david. Boris johnson has quite a history here when it comes to, as Christiane Amanpour put to me, being backstabbing. Yes, this is about Boris Johnson wanting to become the Prime Minister of england, undermining theresa may. And he sells the theory that brexit would be easy and britain would thrive. Its not easy. Many British Companies are warning about brexit having really negative inpacts on the british economy. But hes trump, like walking out, saying there is an easy answer. There is not an easy answer. No surprise that he praised Boris Johnson and was noncommittal on theresa may. Still stunning to see from an american president headed to the uk. What do you make of his read on Vladimir Putin this morning . I mean, saying its going to be easy . Republican senator orrin hatch told me that doesnt bother me, thats President Trump saying i can take him. I think its alarming. He talks about nato being unfair to the United States. You know, Vladimir Putin, he mentioned china, as well, is an enemy of democracy. Vladimir putin, you know, intervened in our election to support trump. But whether that was intentional or not, you know, they dont support independent courts in russia. There is no free press. Its a completely different approach to society than what our nato allies have. In terms of the cost the president said things like we dont need more judges on immigration. And by the way, the press is the enemy of the american people. Thats why this is so upside down. Again, i dont want to move from the basic point of these are our longest allies in europe that support democracy, the rule of law, and our values. Russia and putin does not, and we need to counter that as a country. When and how then if this is so dangerous, does the rubber meet the road, consequences for the president . The chairman of the Foreign Relations committee, bob corker, whos been critical of the president and not running for another term, told us, quote, im very uncomfortable with it, the destabilizing effect that it is having in the region is significant. Talking about the criticism of nato. When ask dodoes it materialize . Hes humiliating nato leaders. China is coming back with tariffs. Trump will squander the economy he has this growing economy, this trade war could derail the entire thing. A source tells cnn that those Migrant Children who have been separated from their families and in hhs custody are now being transferred over to i. C. E. Custody. This is significant because today is the deadline for the youngest of those children, those under 5 years old, to be reunited with their parents. Joining me is lindsay tsofsky, director of the immigrant defenders law center. And its nice to have you back. Thanks for joining me again. No problem. Thank you for having me. When you were with me a few weeks ago, we were talking about the 3yearold toddler that you represented in court being separated from their parents. Talking about today and now that we know that some of the these families are being reunited for the youngest kids today, what do you know about how exactly thats going to work . You know, this has been a secretive process in terms of how the government plans to reunite this slightly more than half of the 102 children who were under the age of 5. So that we havent received a lot of details on exactly how this is going to happen. But unfortunately, what were really concerned about is that nothing in this process thus far has been in a way that prioritized child welfare. We dont have a lot of confidence that the government is even going to do the reunifications in a way that will prioritize the safety and health of these families. Let me play for you what the White House Deputy press secretary, raj shah, said to my colleague, john berman, this morning on cnn, defending how the administration has been handling this especially when it comes to the safety of the children. One thing that were running up against is that we need to vet and ensure that the people claiming to be parents are actually parents. Weve had examples in the last administration, there was an Inspector General report in which children were given to people who came with them across the border illegally who were not their parents. These children were abused. These children were, you know, taken advantage of. Thats not a situation we can repeat. I mean, look, i think we can all agree the safety of the children is of the paramount importance. Is it more important as hes arguing than meeting the deadlines . Well, obviously the safety of the children is the most important thing. The process, separating children from their parents at the border, the way that it was done, the reckless disregard for the safety of these children during that process does not give us confidence that the government can now claim they cant meet these deadlines purely because of a concern for child welfare. So what were at this point really concerned about is that the level of resources that were put into taking these children from their parents should be put in now to reuniting them. The fact that the government could not reunite every single one of these children under the age 5 within the guidelines set by the court really makes us gravely concerned that they will not be able to do it for the thousands more over the age of 5 who remain separated from their parents today. Are you and your team representing any of these children under 5 that are part of this group of about 100 . We are representing children under the age of 5 who are in that group of 100. But we dont believe that any of the children that were representing will be part of in group of 54 who will be reunited. Why is that . What are the challenges that those you represent are facing in terms of getting to their parents quickly . Well, one of the challenges is that some of the parents have already been removed from the United States. So we believe up to 12 parents are already in their home countries, and the government doesnt necessarily know, they said in court yesterday they dont know where those parents are. So what we will call for is an immediate cessation of removing any further parents who have children here in the United States. Just this morning, well be representing a father who we believe is at imminent risk of deportation whose 5yearold son is being held in a separate facility in new york. So were concerned that even though the government knows this is problematic with these children under the age of 5, for children over the age of 5er that going age of 5, theyre going to perpetuate that with children as their parents are in detention shelters across the country. Were seeing the transfers of the youngest children are happening right now, is that right . Reporter thats right. So within the last hour or so, we were outside of a childrens a childrens care facility for imMigrant Children. We saw a white van pull up, and about five small children got into the van and drove away. The van came to this facility where we are now. This is an i. C. E. Facility. My colleague was at another facility, another childrens care facility, where he saw a similar scene. He says about a half a dozen kids getting into a van, backpacks were loaded into the back. He saw at least one adult carrying a large teddy bear which was also loaded into the car. The van was taken to this place. This is an i. C. E. They call it an enforcement and removal office. The only one in phoenix. Theyve also got taped up this police tape here. I asked an employee why it was there. He just said to keep people away from the building. Not sure exactly why. Now the big Unanswered Questions with the reunifications which is a source has confirmed is part of the courtmandated reunification process set to take place today for at least some of those kids who are under the age of 5, the big question is whether or not they will still be detained with their families or whether or not they will be deported or put into some separate sort of proceeding. But we know that at least some of the reunifications have started here in phoenix. Poppy . And also scott thank you for being here. Breaking news, former tramp National Security adviser Michael Flynn has just left a courtroom in d. C. Well have the latest next. More breaking news. Quite a busy morning. Moments ago, former trump National Security adviser Michael Flynn left a d. C. District court after what was supposed to be a routine sentencing hearing. It was his first appearance. First time were seeing him in public really since he admitted to lying to investigators in december. Lets go straight to evan perez, our justice correspondent. He was inside the court. This was all about the judge saying what is taking you so long to get him sentenced after, you know, after admitting to lying to investigators. What did muellers team say . Reporter thats right, poppy. You remember that flynn pleaded guilty to lying to the fbi in december. Six months later, the federal judge whos now overseeing the case simply brought everybody here, the prosecutors, the flynn team, to ask them whats taking so long. The answer came that he is still cooperating with the prosecutors from the the special counsel Robert Muellers office, and so the government is not ready yet for sentencing. Essentially while hes continuing to provide information, whatever cooperation hes providing. The government did not exactly say. But while that is still happening, the government wants to delay the sentencing. The judge expressed some concern because at this point the the lawyers, all the lawyers involved, had tried to do some procedural things that the judge said were not necessary now. It was a strain to the probation office. So what were looking at is another update in august when we may yet hear when mike flynn is going to be sentenced for lying to the fbi. He faces up to five years for pleading guilty to this. We dont expect that hes going to get nearly that much. But it looks like for at least the next couple of months during the summer, mike flynn is going to keep working with the fbi and special counsel mueller before he gets sentenced sometime later this summer. Okay. All right. Evan perez, appreciate the reporting from inside the courtroom. More breaking news miraculous news this morning. Every Single Person inside that cave in thailand has been rescued. We have learned moments ago that the team doctor and the three divers have also been rescued. They are safe. Ivan watson with more. What a day. Reporter this has been a great day to be a journalist here in northern thailand because the news has been so good. The commander of the thai cave breakfa rescue operation is speaking to journalists, giving a press conference 30, 40 yards from where im standing. Y h he has announced that the three thai navy s. E. A. L. Doctors and doctor who spent more than a week in the cave where the Thai Boys Soccer Team and their coach were trapped for more than two weeks, that they now, too, have also emerged to safety. That means all of the people, that means that the boys and their rescuers are now apparently out of harms way. He prefaced the press conference by saying i would like to announce some good news today. And this is good news. We dont know the exact health of everybody who has emerged today. Four boys, their coach, and these divers. The doctor who bravely stayed underground with them for so many days. Everybodys out, breathing fresh air now. Thank goodness for that. A new poll this morning shows the president s Approval Rating is down pretty low. 41 . This as the president also claims this morning he is the most popular republican in the history of the party. Lets get the facts. Cnn political commentator errol lewis is here. He did tweet this morning his approval is 90 . But this poll shows otherwise. Thats right. There are some polls, theyre old polls. When he says new poll, that was the part i found confusing. Old polls show that he is in the High Percentage range among republicans in his party, second only to ronald reagan. That was fairly early in his term, though. Nothing receipt comes anywhere near 90 nothing recent comes anywhere near 90 . Theres an interesting question about why he continually says things that we can easily tell are not true. That to me is more interesting. Sort of the trump politics of deception. This 41 is from a weekly gallup poll. It shows the rating of 56 has ticked up since the News Headlines were all about the Immigration Crisis at the bored and the separation of children from their parents. Right. His numbers what we call upside down, meaning the approval is substantially lower. For a politician, this is a sign of trouble, alarm. If the numbers are upside down, closer to an election theres a real problem. This time pardoning two cattle ranchers sentenced to five years in prison for causing a fire on public land. Sarah westwood with the story. This case got attention when it was heard. And i know at least the elder has served three years. What is this pardon about . Reporter obviously President Trump is not afraid toize his pardon authority. Afraid to use his pardon authority. Weve seen him to it in more controversial cases. The sentencing of these two oregon men to five years in prison for their involvement in causing the fire sparked outrage in the local community and ended up causing an armed standoff with federal officials in the area. That got a lot of attention obviously at the time. A judge had originally recommended that these two men, dwight and steven hammond, cattle ranchers in the area, receive a lighter sentence because of the way the community might react. They ended up getting sentenced to five years in prison. Dwight hammond has served three, is even has served four. Clearly President Trump not afraid to use this authority more liberally than predecessors at this point in his presidency.
