Attorney, Rudy Giuliani, speaking just moments ago to chris cuomo on new day. Heres the issue that i really feel strongly about with this informant, if there is one. First of all, i dont know for sure, nor does the president , if there really was one. Reports in the New York Times and the Washington Post said there was in fact a top fbi source whom the president and others in congress right now and beyond are clamoring to out while calling the entire investigation illegitimate. It was a remarkable cnn interview, it lasted about 45 minutes. Giuliani also said there has been substantial progress towards an agreement with bob mueller, the special counsel, and his team and the president on sitting down for an interview and, giuliani said, the scope of that interview has been significantly narrowed. A lot to unpack. Lets go to abby phillip at the white house. Also with us, shimon in washington. Abby, set the stage for us. Reporter good morning, poppy. The president engaged in this conversation about the confidential informant increasingly in the last day or so in part because theres been a push in his outside al lies, particularly in the house of representatives, to raise this with the fbi, seeking more information about this potential informant. Now, the president tweeted yesterday that he believed that this would be bigger than watergate, but his attorney this morning, as you just mentioned, said that they dont know for sure whether there is an informant. But if he did, giuliani says he believes this informant would have cleared the president. Take a listen. I believe if there was an embedded person, that person cleared us because the fbi cleared us. I wonder what the heck is the legitimacy of the Mueller Investigation in the first place. The fbi came to the conclusion there was no evidence of collusion with russia, ending of case. Reporter of course thats not quite accurate. The special counsel continues to investigate that central question of whether there was collusion between Trump Campaign associates and the russians. But at the same time, the Washington Post is reporting that the president s allies see this issue of the informant as key to their efforts to undermine the special counsel by calling into question the legitimacy of the investigation, which was aided in part by some information, by some kind of informant. Of course we dont know whether or not that person was inside the campaign as the president is alleging in his tweets or outside of the campaign. Of course the president himself on this day after the oneyear anniversary of the Mueller Probe is doing as much as he can to also raise questions about whether or not the special counsel investigation is legal, poppy. Abby, stay with us. Shimon, this is clearly their strategy. This is from the president to giuliani allout war on their own department of justice. You have giuliani telling the Washington Post in a piece this morning, the prior government did it but the present government for some reason, i cant figure it out, is covering it up, talking about this alleged informant. What are you hearing from your sources . You know, the idea that theres some coverup regarding this informant is pretty ridiculous quite honestly. Ive been talking to some people at the fbi about this issue because it has been before congress, before devin nunes. There is a lot of concern in revealing who this informant is, what his work or her work and what exactly this person did. We dont know. Look, informants are treated with such sensitivity at the fbi, especially on a counterintelligence investigation. This could be a source from russia, this could be a source from any other from the uk, it could be a source working with other governments. There is always an enormous amount of concern. Information like this is not usual low shared with anyone except people in the highest levels of the fbi, the cia, intelligence officials. And that is why the fbi and the department of justice are fighting with devin nunes over releasing who this person is. Look at what devin nunes has done with other situations in this case, certainly with other memos, with other information that has come to them. They do not need this informants information out there. They do not need the fbi, that is, they do not need this informant to be in any way politicized. And we dont know what information quite frankly this informant was providing. This informant could have been providing information on the russians or others that may have been trying to collude with the campaign. Look, there is an enormous investigation that bob mueller has undertaken in terms of what the russians here were doing, and that is still a very active investigation and they are looking to bring charges against russians for hacking, for some of the money that perhaps was being given to straw donors in the u. S. This is what this informant could also be providing. We just dont know enough details. For folks to be out there like giuliani and certainly the president somehow making these kind of assumptions about the informant is extremely, extremely dangerous. That is why really the department of justice, why the fbi is so opposed to releasing any information about this informant. They also know full well that muellers team is not going to come out and comment on this either way, so they can put all this out there and not have any response from, you know, doj, fbi or muellers team on it. Shimon, thank you for the reporting. Abby, thank you very much. Lets digest all of this with my panel, julie hirschfield, matt lewis and asha. Asha, as the lawyer on this panel, theres a lot to get to here including the scope which giuliani says is narrowed if they do this interview with the president , but this is a clear shift in legal strategy and a clear pitting of james comeys honesty against the president s honesty. Lets listen to Rudy Giuliani talking about comey this morning. Wednesday night we received a communication from them. Now, we did go through like five letters. We didnt get a response. Then they sent us a response. I cant go into detail, but narrowing the subjects for questioning down to about two. You get a big liar like comey, a big liar like mccabe in the fbi, a guy with a conflict of interest from day one on the hillary investigation, which is why hes lying to cover his ass, of course you get that. You get bad people in the fbi. All right. So asha, what do you make of that, that this is clearly their strategy . Well, this is always the defense strategy. If the facts and the law arent on your side, go after the prosecutors and the police and discredit the actual basis of the investigation. You know, they can try to discredit comey, but hes not the only witness here. We tend to think of this as he said she said between the president and comey, but there are a lot of actions both before and after the conversations that they both had that could point the way to providing evidence of obstruction. On that point of obstruction, guys, lets roll that sound if we can pull it up, Rudy Giuliani talking about whether or not he believes the president can obstruct justice, if we can play that. You dont think a president can obstruct justice . He can, but in the case of firing a subordinate whos going to be replaced by somebody else on an acting basis immediately but its why you fired them, corrupt intent, part of the legal analysis. It doesnt matter if in fact it cant result in anything. Significant, matt lewis, to you, that giuliani said that this morning . I mean i think that giuliani is correct in the sense that its really hard to prove that intent. It would be very hard to prove that the president is trying to obstruct justice when he fires somebody. Now, theres actually a bill that would allow, say, like Robert Mueller, for example, to appeal if he wasnt fired for good cause. Thats not going to go anywhere. I think that giuliani is obviously playing a very bad hand right here and hes spinning and all that, but i think on the merits on this one, he actually has a point. Very difficult to prove that a president is obstructing when he does he is in the hierarchy and has the ability to fire people. Julia, as someone who covers the white house, what do you make of the fact that Rudy Giuliani has laid out so much more here than anyone on the president s legal team up until now has laid out . The fact that he divulged this information. And guys, you just heard it. Lets play it again so people can hear exactly what giuliani said about the narrowed scope of a possible sitdown with the president and bob muellers team. We have all been reporting, my colleagues have been reporting about sort of the behindthescenes backandforth between the president s lawyers and muellers team about whether an interview with take place and under what circumstances and what the scope would be. But the fact that he has gone on cable tv and laid out, you know, exactly how many letters they sent to muellers team and exactly how many areas now the special counsel is willing to consider questioning the president about is extraordinary really. I think what it shows you is that they know that theyre getting pretty close to a Decision Point here both for the president and what the special counsel is going to do in response to whatever the president decides. He wants to create a narrative here, that theyre trying to cooperate, that theres a backandforth, that theyre being reasonable, but at the same time that the special counsel is sort of trying to go beyond his scope, trying to go beyond where he should be, that theyre trying to narrow him down and hes trying to reach out and also, obviously, to discredit the fbi and other investigators who have been looking into these questions. Did you hear, julie, what i heard in that interview, that he seems to be ramping up the attack on christopher wray, the president s own appointee who heads the fbi . Absolutely. I mean this is just part of a pattern by giuliani and by the president himself and people around him to discredit a lot of highranking officials at the fbi and sow seeds of doubt about whether theyre carrying out their Law Enforcement mandate or whether theyre a bunch of biased and politically motivated people with an agenda. I mean you heard him talk about how these are bad guys. He talked about comey and mccabe, and how mccabe had a conflict of interest. There is a real strategy here i think to try to discredit the people who are investigating this matter as much as possible. Its probably for the reasons that asha cited earlier, they know they have a difficult case here an theyre trying to undercut the folks who are coming at them on it. Asha, is attorney Rudy Giuliani, not politician Rudy Giuliani, legally, is he helping his client, the president . I dont think he has done anything that helps his client. He divulges too much information. He states facts that have not yet been out that harm his client, like the payments that were made. I think maybe he thinks hes getting out in front, but what hes actually doing is creating more of a case. He might be divulging, you know, conversations that should be protected by privilege where hes quoting the president directly. Which then, by the way, eraces that privilege. It doesnt necessarily erase it because the privilege is held by the client, but it does hes quoting this person and now mueller has something to ask the president about. You know, i think that with regard to this interview, the twotopic thing doesnt mean anything. That are two topics that the fbi wants to ask trump about, obstruction and collusion. And they can come up with some list or whatever, but once they get into that interview, it will go on for hours, they will ask him followup questions and they will not be able to control the scope of that. Matt lousewis, what do you think . Do you think giuliani, the politician, is being successful here, though, in terms of at least muddying the waters . Absolutely. Look, i agree, the more they talk, the more legal jeopardy they get in. But in terms of the politics, i think its very clear that they are trying to muddy the waters. I think theyre doing it. Look, this is really in the eye of the beholder, okay . On one hand, you may see this as a perfectly rational thing for the Intelligence Community to do. In fact, you may call this person a confidential informant. That sounds perfectly fine, right . But what if its a spy . What if the government doesnt like donald trump, and what if they embedded a spy in his campaign to try to entrap him or his subordinates as a part of a deep state coup . Now, that may sound crazy, but those are two very different ways of dating what may be the same thing. And if a lot of Donald Trumps base buys that argument that this is nefarious and malicious, then the political problem is solved. You cant impeach and hes probably going to skate at least for a while. And the words from the president this morning, in one of his tweets, quoting fox news seaying apparently the doj put spy in the Trump Campaign. The president says that on twitter and then giuliani goes on tv and says we dont even know if there is an informant. But the choice of the use of the word spy also really matters, as you just mentioned. Thank you, guys, very, very much. Theres a lot to get to this morning. All we hear at this point are reports of an active shooter at this high school. Is that right . Reporter thats right. Those reports coming in about 30 minutes ago. Theres an active shooter at Santa Fe High School. That is directly between downtown houston and galveston, texas. Officials at the School District confirming this morning that an incident occurred at a high school involving an active shooter. Thats what theyre describing it as. The district has initiated a lockdown right now. Authorities there at the Santa Fe School district saying that they will send out information as soon as it becomes available. As you may imagine, this happened not too long ago, a very fluid situation thats taking place right now at the Santa Fe School district. We do not know yet if there were any reported injuries. We do not know yet if a suspect or suspects are in custody. This is all information that were trying to track down. But again, this information very preliminary right now. Authorities at that texas School District confirming reports of an active shooter about 30 minutes ago at the Santa Fe High School located just outside of houston, poppy. Actively digging for more information. As soon as theres any more information, well pass it along to you. All right, polo, ill let you make those calls. Lets go to tom fuentes, our senior Law Enforcement analyst and formerly with the fbi and knows far too much about these horrific events. Tom, its 8 20 in the morning there and these reports started coming in about half an hour ago so that would be at the beginning of the school day, about 7 50 a. M. Local time. This is a high school of about 1,400 students, grades 9 through 12. All we know is an active shooter. What would be going on in these early moments . Well, poppy, the first thing is to determine if they really have an active shooter. You have so much chaos in the beginning of these events and sometimes all the way through it. In the very beginning theres a lot of false information that goes out, theres a lot of confusion. Is there a shooter or isnt there a shooter. Is there is a shooter, is he or she still on campus and posing a danger to others, or has fled the area and maybe other areas in town should be locked down as well. So thats the first thing. Are there injured people inside that school that need medical attention. Has anybody been wounded or seriously injured or even killed by a shooter, if there is a shooter. So theres a great deal of necessity on the part of the authorities to try to protect everybody on that school campus. At the same time get to the bottom of what exactly they have. Do they really have a shooter. Is there a danger still being posed to members of the community and people at that school. We do know, tom, that the district has initiated a lockdown. Now, that seems to happen early on, even when theyre not certain about a shooting as a precautionary measure, correct . Yes. Part of the reason too is that, you know, they would like the students that are there to take cover, get under desks, do what they can to try to shelter themselves, and also to try to avoid the massive confusion of having 1,400 students come pouring out of the exits while the police come in and try to figure out if the shooter, if there was one, is one of the people exiting the building. It just makes it that much harder to determine who the good guys are, who the bad guys are. All of the important initial readings that the police have to take. Tom fuentes, thank you for that. Also this morning, Rudy Giuliani is on the attack, sitting down with our chris cuomo for a long interview, going after the fbi and the justice department. Listen to this. And explain to me why they even need an interview with the president if it isnt try to trap him into perjury. You get bad people in the fbi, mostly good people. You get bad people in justice. You get bad people in both parties. Yes, we get bad people. Its my job to flush them out. It is a witch hunt. Maybe he doesnt want to get involved, maybe he wants to look like hes independent. Maybe hes right . How about that . Hes wrong. I know more about the case than he does. Lets discuss this with Joaquin Castro from mexico. Congressman, thank you for being here. Before we get to this, our thoughts are with the people of texas. This is not your district, but are you hearing anything about this report of an active shooter at the Santa Fe High School . Poppy, i havent, as ive been standing here preparing for the interview, i was told about what was happening. Of course we dont know all the details yet, but this is another example of gun violence in schools and its a shame that the United States congress where im standing now has done nothing to protect our students. We will let you know as soon as we have more information as well, congressman. As i wait for that, i want you to weigh in on some of these other topics. Im not sure if you heard the whole interview with chris cuomo and Rudy Giuliani this morning, but there were some significant headlines. One thing that became very clear from the interview, the attacks on james comey, is that this seems to be the strategy, to pit the honesty of james comey against the honesty of the president if he does sit down for an interview with muellers team. Wise strategy . I dont think so. The president is probably the person in washington whos told the most falsehoods and lies over the last few years, more than anybody else. So i dont think you can put the president s honesty against just about anybodys honesty, because the other person wins. But i do agree that what Rudy Giuliani is trying to do is not really win the argument or even be right or correct, hes just trying to muddy the waters politically. And its not just Rudy Giuliani, but its also other trump friends and associates who are trying to accomplish the same thing for the president. Listen, though, to what Rudy Giuliani said about the honesty of the president. He said it over and over again, that the president is not going to lie when he sits down with bob mueller. Lets listen to giuliani on that. It is not true that a perjury trap is just when youre not telling the truth. A perjury trap is when you get somebody to lie about what youre telling the truth. The president would testify tomorrow if it was about the truth. The truth is, he had nothing to do with russia. I was on that campaign. He didnt talk to russians, he had nothing to do with russians. Why wont he just sit down and say that . Because youve got people that are going to ask him questions about what did you say to him, what did you say to him, and youve got comey coming forward who will lie. He also went on to say, look, the president is not going to lie, lets get that straight. He sees the mueller teams interview request as a perjury trap for the president. He points to judge ellis comments, a federal judge a few weeks ago said to the prosecutor on muellers team in the manafort case essentially, look, youre just going after manafort to get the president. What do you make of giulianis argument . Well, the first thing is that President Trump, donald trump, owes the American People to sit down with Robert Mueller and answer questions about this investigation into the russian interference in the 2016 election. He should do that. And now i know that just in every other case, theres often a negotiation about the scope of whats going to be asked, so i think thats fair. But most of all, he needs to sit down with Robert Mueller and answer questions. The Washington Post is reporting, as youve read this morning, im sure, that its not only the president , its the president s allies in congress, its the president s allies on the outside that are stepping up their efforts significantly. And you see it in the president s tweets, to out this fbi confidential informant. The president chooses to use the word spy to describe this person, even though this is routine in a counterintelligence investigation. This is from the early days of the russia investigation during the election. So you on the Intel Committee have said our investigation wasnt a real investigation, this was a kindergarten investigation, we didnt get the information we needed. As you know, what the president wants, what devin nunes wants, is for the scope memo to be released that would lay out the people, the issues underlying the Mueller Probe. I assume you dont agree with that, but my question is wouldnt getting that provide more information to your committee . Do you support that effort in any way . Look, ive supported this process being as transparent as possible. So the more information that will help the committee, the better. So you support the release of that scope memo, at least your committee, just to be clear . Well, i support receiving information thats important to the committees work, but also bear in mind its not going to put somebodys life in jeopardy. Thats been one of the questions here, one of the issues, whether the information thats being asked about is going to put some individuals life in jeopardy, so thats a whole other consideration. But i would also ask, as donald trump as Rudy Giuliani are asking and devin nunes, pushing for transparency, that they release every single transcript of the witnesses that came in front of our committee and testified so that the American People can read through them themselves or the summaries and make their own decisions about what they think this campaign was up to. As we got from the Senate Judiciary Committee Earlier this week. Congressman, i have to let you go because we do have more breaking news on this School Shooting in your home state. We are hoping for the best and have to get to more information in just a moment. Again, reports of an active shooter in a high school in texas, in santa fe, texas, about an hour southeast of houston. Reports of an active shooter there. Santa fe is about an hour southeast of houston, about 30 minutes from galveston. We know that the city manager, the deputy city manager for galveston, dan buckley, says the galveston police, the fire department, all responding. Atf is responding as well. Polo sandoval is following this story. As we look at these images of Santa Fe High School, about 1,400 students there, what have you learned . Poppy, this happening not long after the start of first period earlier this morning at Santa Fe High School. We are getting some of our first pictures right now. An aerial view from our affiliates coming in of the situation that is happening right now at Santa Fe High School just between houston and galveston, texas. Reports of an active shooter coming in as classes were Getting Started earlier this morning. We are also getting some of our first witness accounts, including one young lady who spoke to one of our texas affiliates saying that, quote, a gunperson walked into the classroom that she was in and then began shooting. This witness claiming that she saw at least one of her female classmates get injured, being shot in the leg, and also describing the weapon as something resembling a shotgun. Then this eyene neswitness desc the moments that followed that were quite chaotic and the witness ran away from the scene. Again, this is just one witness account coming in of a situation unfolding right now. A lot of officials are responding to the scene right now, including federal authorities, atf now involved in this, but these are pictures, poppy, that we have seen quite a bit here. These children, these students getting their day started now being evacuated from their classrooms after reports of shots fired. Some of the neighboring School Districts also shifting into protective mode, including dickinson isd, which is not far from santa fe isd. Let me read you a tweet that they posted a little while ago as the situation involves dickinson isd. We are currently in protective mode as a precaution because of reports of a shooting at Santa Fe High School. Doors are locked and personnel are stationed at outer doors to let people in and out. No students outside of building. Field trips are postponed until we get off protective mode. Again, this is at dickinson isd, not far from this very active situation. Important to point out, poppy, it is midmay right now and classes slowly coming to a close for many students, whether its final exams or even some of the celebrations that are scheduled ahead of graduation. So this is certainly a critical moment for many of these young men and women who were showing up to school, but still looking into reports of an active shooter situation unfolding just outside of houston, texas, poppy. Joseph, were getting an account of a parent of a student who just escaped this school. Kim sullivan speaking to us as the parent of a 17yearold senior at Santa Fe High School. She says her daughter called her, said there was a School Shooting just within the hour. Her daughter says they were told to run, so they ran to the shell gas station across the street from the school. Her daughter told her a lot of children confused right now. Were looking at these images that we see far too often in this country. Kids just trying to go to school, having to evacuate after an active shooter. On the phone with me is angie martinez, the mother of a child in this school. Angie, can you hear me . Yes, maam. Is your child okay . Thank god, yes, she is. What can you tell me . How old is your daughter and what did she tell you about what happened . My daughter is 14. Shes in santa fe junior high school. She told me that she called saying that there was a fire drill and they were outside and then she heard gunshots and theres an active shooter. So i told her, i said run, baby. I said run and hide. I said, you know, get out of here. I said get out of there. I said run and ill go get you, wherever you go to. Go to the gas station. Theres a gas station catty corner to the school. Its okay. Me and your dad are on our way. I said just run. And she ran. Angie, any parent can understand your anguish right now. Im so glad your daughter is okay. Have you been able to pick her up yet . Are you on your way to go get her . Yeah. We got there as soon as we could. We got stuck in traffic. My husband got out of the car and ran towards the gas station. He got to the gas station and there were tons of other children from the School Waiting to be picked up from their parents and there was also School Officials there waiting with the children at the exxon gas station. Of course they seen kids running and so the first issue is safety, of course. So have you been able to see her or is she with your husband . Yes. My husband i was on the phone with her on Facebook Live video the whole time. She told me that there was officials that said there was kids that were shot up in the classroom. You know, everything is on lockdown. The traffic was at a stand still, but my husband took off running to where she was at. They were able to let him take her with him and get back to the car and we finally got out of that traffic and made it home safely. Is your daughter with you right now . We just spoke with the martinez family. Their 14yearold daughter just ran out of this school, escaping the shooting, described the shots fired that she heard. She is okay. Everyone she knows is okay. New this morning, weve learned about the Royal Wedding, that Meghan Markle will walk herself down most of the aisle before exchanging vows with prince harry less than 22 hours from now. Thats a first for a British Royal bride. Markles father unable to attend her big day because of health problems. Prince charles will escort me n Meghan Markle in the chapel partway down the aisle. Meghan markle has shattered so many precedents already just by marrying into this royal family, but heres another one. Shes going to walk unaided from the nave to the quire of the chapel, that first stretch of the walk down the aisle. Then shell be met by Prince Charles, harrys father, the rest of the way. Thats typically a male role model or a father which is giving away the bride, which is quite an oldfashioned concept in itself. But of course Prince Charles is from the family that shes marrying into. But the fact that she is walking half the way by herself is something that many people are excited to harry about here in windsor. They like the fact that shes a femini feminist, shes a career woman, shes independent and she stands on her own two feet so thats a nice compromise. Then we have the traditionalists who are happy that Prince Charles is involved too and sees this as the ultimate stamp of approval, as if we needed one, that the royal family already to welcome Meghan Markle with open arms and become one of them. A while back prince harry referred to his family as the family meghan never had in an interview. Now that many seems to have a whole new deeper meaning, as weve seen all this family drama unravel in the media over the last weeks and certainly over the last few days. So the fact that Prince Charles is going to be the one walking her down the aisle just underscores that too. This is her new family. It is indeed. I wish i was there. You wrote about this and youve said that Meghan Markle is rewriting the princess story. She really is. Yes, she is rewriting the princess story. So much of princess culture is about a beautiful girl in a sparkly dress who waits for her prince. Meghan is completely different. Shes a selfmade woman, just as bianca was saying, stands on her own two feet, a career woman whos worth somewhere in the vicinity of 10 million by herself. She wasnt waiting for any prince and they met on a blind date and fell in love in a whirlwind. You know, ever since prince harry has been born, people talked of who he was going to marry. Magazine articles, newspaper articles, and they were always the same type of girl. It was a british aristocrat, a sort of young girl with not much of a job and a castle or two and these girls were always white. Harry has married well, he is about to marry someone completely about feminism, about the racism she suffered in life and the Entertainment Industry and she really is just as bianca was saying even by walking herself up the aisle, even in the wedding, modernizing the royal family. Big and exciting changes yet to come. It is a big statement, certainly, a statement without words, but with action, in such an important moment in the history of womens rights and the me too movement, et cetera. It is remarkable. I wonder, when you bring up those girls that everyone expected harry to marry, how do you think Meghan Markle has changed prince harry . I think Meghan Markle has changed prince harry so much. Prince harry, hes been a party boy, been unfortunate stories, having too much fun in las vegas, but hes now become this mature, sensible man, determined to make the world a better place, devoted to trying to improve the world and meghan is perfect for that. They said in their engagement interview, we are a team, we want to be a team, we want to Work Together to improve things, to make the world better place to work, equality to help young people. Shes the perfect team member for him. And shes really going to spur him on to bigger and better things. There have been lots of number twos in the past who havent been able to find a role, princess margaret, the queens sister, harry has a role now and hell have a bigger more impactful role in before william becomes king than william does. It is really exciting to see what theyre going to do next. Theyre asking for they dont need pots and pans. Theyre asking for gifts for charitable donations. Particularly to womens causes. Yes, theyre asking for charitable donations to be given to various causes. In that sense, it really seems very apt that meghan is going to walk herself most of the way up the aisle and charles will not take her to the final steps, not going to hand her over as we have seen before, shes going to hand herself over. And i think this could be the end of how in britain so often we see brides being handed over by their fathers when they are modern women. Once you get closer to where we are, the sound you hear, in addition to the explosion in the background, is the sound of burning brush and from time to time, youll see what some of these trees catch on fire, just because of this molten lava. And then let me take you over this way, poppy, show them down there, this is the fissure we have been watching for, this is the fifth night now. It is just consistently pouring lava out of the ground. Looks like a neverending sparkler. And then from time to time you will hear these big massive explosions. You can hear that one right now.
