Hello, everyone, im kate bolduan. Robert mueller, you are on the clock, or thats what Rudy Guiliani would like you to think. President trumps legal team is telling the Special Counsel to wrapup the Russia Investigation within the next three weeks, or else. Or else what . That is not entirely clear. But this is part of the very latest round in the game of cat and mouse that has been playing out for months and months and months about the possibility of trump sitting down for an interview with the Special Counsel. Guiliani says its now muellers move with a deadline fast approaching. Kate Bolduan gives a fresh take on todays top stories. Their favor. So in summary, it should end, but if it doesnt, its good for them. Got it . So abby, we hear what Rudy Guiliani is saying and Rudy Guiliani is talking quite a lot about it. Are we likely to hear the president on any of this today . Reporter well, kate, it is not clear whether the president is ever going to tweet or, you know no one knows, whether its his lawyers or his aides. But i think what were seeing here with guiliani is an attempt to keep this story going. I mean, the guiliani just a few days ago was saying wrap this thing up. And now hes saying, even if it doesnt wrapup, maybe it will be good for us. Perhaps an acknowledgment that whats happening here is that the ball really is in muellers court. That they dont have control over the timing of this. But in their response to mueller, sent back this week, it didnt really bring us much closer to a resolution. But heres what guiliani and his team are saying about what they think the parameters ought to be for a sitdown interview with the president. They are okay with the prospect of an interview, but theyre saying any questions about Obstruction Of Justice should be limited in scope, and perhaps only answered on paper. Meanwhile, muellers team not at all interested in that. They have basically said they want to ask the president about collusion, about Obstruction Of Justice and about his associates contacts with russians. But the question about whether or not the president answers Obstruction Questions from mueller is all about the prospect of what guiliani is calling a perjury trap. Now, listen to him explain what hes worried about in the context of a perjury trap on hannity last night. The reality is, he doesnt need to ask a single question on obstruction. He has all of the answers. Theyre not going to change. The president is not going to change his testimony. So stop the nonsense. You are trying to trap him into perjury, because you dont have a a case. Reporter common sense might say that if you dont have anything to hide, if youre not going to lie, then you shouldnt be worried about a perjury trap. So its not really clear what exactly guiliani is saying there. But thats the crux of the issue right now. This is the center of the negotiations between the two camps and i dont know that were getting much closer to a resolution, kate. I feel like were never going to be any closer to a resolution until it just finally pops up out of nowhere. Because were just going to continue like this. Great to see you, abby. Thank you so much. Joining me now, to try to make sense of it, seth waxman, Criminal Defense Attorney and former federal prosecutor and cnn political analyst, mark preston. Mark, lets start with the politics of this. I feel like its more than the legal side of this at this point. No offense, seth. Because it does seem like more of a pr strategy right now than a legal one. What is Rudy Guiliani up to, mark . Hes doing a couple of things. One is, hes continuing to try to create an incredible amount of white noise around the situation, try to bring doubt into this investigation. If you heard him over and over again, saying, look, mueller has what do you think that means . What does that mean to you . I see this whole dance that weve been watching for months as kind of a sham. A sham on both sides. You know, donald trump does not want to be in the room with bob mueller and his investigators. This is like hes heading out to the playground to the fight and hes telling his friends to hold him back. But on the other side, bob mueller, in my opinion, doesnt want to be in that room right now, either. Federal prosecutors want to wait until the end of their investigation to question their subject, or target. Most importantly, they want to cumulate all of the evidence, including their key coopers tat. If mr. Manafort were to flip after this trial, if he were convicted, mr. Manafort could potentially walk mr. Mueller through his conversations with the president before, during and after that trump tower meeting. That is critical information for the prosecution to be in the room with the president and question him on. So, you know, i see this dance as going on, you know, through the election, through the end of never charge that person. Thats a perjury trap. Where theres no basis to ever bring a charge. Because theres immunization in that case. Here mueller has got this investigation. By all accounts, its legitimate. Rod rosenstein has said its legitimate. The best way to avoid a perjury trap or what mr. Guiliani is most concerned about and maybe the president , just dont lie. Its a good suggestion. Ill take it to heart. Another trump ally is speaking out about the Russia Investigation, but these remarks not intended to be made public. Its a secret recording of one of Donald Trumps biggest allies on capitol hill, congressman devin nunes, at a closeddoor fundraiser. And in the recording, nunes makes the case that it is their responsibility, republicans the republicans and the house of representatives, to act as the last line of defense to protect the president of the United States. Listen. So therein lies so its like your classic catch22 situation. Where i mean, were at a this what puts us in such a tough spot. Recessions wont cover mueller wont the president. Were the only one. Which is really the danger. Thats why thank you for saying that, by the way. I mean, we have to keep all these. We have to keep the majority. If we do not keep the majority, all of this goes away. Cnns manu raju is in washington with much more on this. Manu, as i listen to this, you on one hand, not surprising to hear devin nunes he doesnt want the president to be impeached. On the other hand, hes saying its congress job to protect the president rather than serve as a check on the executive branch, which is their job. No question about it. And its also congress job, in his view, House Republicans job to protect the president from the mueller investigation, which is actually what the democrats have been accusing nunes of doing for the past year. Ever since when he initially was running the Russia Investigation, he came across what he viewed was something as controversial. He went to the white house, briefed the president about what he viewed as a concern and some intelligence reports, and not even brief his own committee that prompted outrage from democrats. Questions about how he handled some of the classified intelligence, forcing him to temporarily step aside from running the Russia Investigation. Outside, he continued to wield power, squashed democratic efforts to bring forward witnesses to the committee, to issue subpoenas and the like. And, kate, this essentially these Public Private comments at this fundraiser feeding into the narrative that democrats have been pushing for some time that is all about nunes protecting the president as he investigates the investigators, the fbi and the justice department, rather than what russia did in 2016. And manu, there is much of more in this, as well. In this fundraiser that he talked about. Much time. You will have to drop everything and not confirm the new Supreme Court jouustice. Youre not getting from like i said publicly, rosenstein impeached. So i dont think youre going to get any argument from most of our colleagues. The question is, the timing of it right before the election. So the senate has to start the that the would have to start the senate would have to drop everything theyre doing and start to start with the impeachment of rosenstein, and then take the risk of not getting kavanaugh. So its a its not a matter of rosenstein. Its a matter of timing. Now, kate, there are not the votes in the house to impeach rod rosenstein. Certainly not the votes in the senate to convict him. But clearly, nunes has been pushing this line for some time, and kate also, ive asked both the Speakers Office and also cathy mcmorrisrogers, a member of the House Republican leadership, who nunes fundraiser was attending that fundraiser, if they agreed with nunes on these two points, i have not heard back yet. So well see if they align themselves with nunes, particularly about whether or not they believe the House Majority is necessary to protect trump from mueller, kate. Yeah, absolutely. Thats the message from republican congressman, chris collins, today as hes facing several charges of insider trading, offering what he says are his first and last public remarks about the charges against him. Collins says they are meritless, and his name will be cleared. The charges that have been levied against me are meritless. And i will mount a vigorous defense in court to clear my name. I look forward to being fully vindicated, and exonerated, ending any and all questions relating to my affiliation with an aide. But a 30page indictment from federal prosecutors suggests otherwise. All the while, collins made one thing very clear last night. Hes up for reelection in november, and hes staying on the ballot. Cnns Britaynn Gingras is here. Collins is not mincing any words about what he thinks about the case against him and what he thinks about his future. What else are you hearing . Are lets quickly highlight what he didnt say in that speech last night, hours after completing not guilty in front of a federal judge. We were talking about this earlier. The congressman and his wife went before cameras, but collins made no mention of his 25yearold son, cameron, who is also part of this indictment, accused of selling this drug stock before it was publicly announced the drug failed the Clinical Trial and hes facing serious jail time as well. Instead the congressmans statement sounded more like a campaign stump. Collins pushed his resume both before joining capitol hill and after. He also reaffirmed his passion for this australian company, took credit for keeping the company afloat with investments. Adding he hoped in the end this drug would cure ms and that was an accomplishment he said he wanted to achieve in life. Collins also pointed out that he didnt sell his shares of this stock, losing out on millions of dollars, when the stock tanked. And maybe this will be part of his defense strategy. Well have to see. But prosecutors say he couldnt sell them. One, because the australian stock market where he held shares had been halted. Which is a standard move as a drug company prepares to release information on Clinical Trials. And two, collins was also under investigation by the House Ethics Committee at the time. But as you saw, his speech, it was really a denial and a fight a vow to fight for his congressional seat come november. As far as the drug company is concerned, it called the indictment a private matter for collins, and said its fully cooperating with the s. E. C. With its investigation. Kate . Thanks. Really appreciate it. Joining me, cnn legal analyst and former federal prosecuto prosecutor. Its that when it became clear he had a big position in this company. A lot of money in this company. When it became clear that the hopes for this drug, this ms drug, were fell short, he didnt sell. And he took a huge loss for it. Does he have a point . It is certainly something that will resonate a bit with the jury. Jurors like to see who profited. When he was a prosecutor, i always love when the defendant was somebody who made a lot of money, because i could just tell the jury, follow the money, follow the money. And its very easy to see why somebody might take part in a criminal scheme. Here, though, the problem for him is that his son saved a lot of money. I think that he saved himself over half a Million Dollars worth of losses. As she just pointed out, he sold over 1. 4 million shares. And the indictment reads to me like there are some cooperators there. There are phone calls and Text Messages, and the contents of those phone calls are discussed in a vague way, not with quotes around some of the passages as if they were taped. So it seems to me like there are some people flipping against his son. And there could be much more to come, you would suggest . Absolutely. Hes up for reelection in november. Hes not stepping aside. You heard him very clearly last night. He is remaining on the ballot. You talk about what the impact things have on a jury. Does that have an impact on a jury . I also wonder about the to himming timing of how quickly this will move. I dont think anticipate anything there wont be a trial, unless he wants a trial before the midterm, which i doubt he would. There wont be a trial before the midterm. Hell be able to drag it out. And what we heard was a very carefully crafted statement, if i was representing him, i would have drafted. Im innocent, but im not delving into the facts. Im just going to tell you im innocent in kind of a broad way. He made no secret all along i mean, a lot of folks have talked about it. He talked about it himself on tv, he kind of like sold this stock to his colleagues or talked it up to his colleagues on capitol hill. Does that does that complicate things . Or could more lawmakers be facing scrutiny now . You know, its interesting. Some of them may be witnesses in a case like this. So thats where i would be concerned, if i if i represented one of those other congressman and they asked me, i would tell them, well, you may have to ultimately testify at this trial, which i doubt any of these congressmen would like to do. I will say, this shows part of the problem, and im sure viewers are wonder, how is this legal that you have a member of congress thats what lingers over all of this. Just kind of to put a point on it. Is that collins sits on the house energy and commerce committee. He also sits on the sub the health subcommittee, which has policymaking responsibilities over the pharmaceutical industry, exactly what youre talking about in this company. Absolutely. A lot of times, what ive told people many times, what might shock you is whats legal, not whats illegal. A lot of times, a federal prosecutor, i would be asked by people, why arent you investigating this or that, and i would have to explain to them, actually, that is legal to do. And it is legal for a member of congress to sit on the board of a private company. And here were seeing even one that he holds a huge policymaking position. Its unethical, but that is that is legal. Whats illegal is to provide material, nonpublic information, to someone so that they can trade on that information. And see if capitol hill makes any moves on the first point. The former, there are already laws in place. Insider trading, ill advised. Great to see you. Thank you so much. That Hurricane Maria could have killed many, many more people in puerto rico than the government has officially accounted for. The government releasing the report, saying 1,427 more people died in the aftermath of the hurricane than that same time period the year before. For perspective, the official death toll of the devastating hurricane in puerto rico is 64 people. Joining me right now, cnns layla santiago, who spearheaded the effort to get a full and real accounting of how many people really died. So this still isnt the official death toll. Why not . Reporter still not the official death toll, as you said. Today that official death toll remains at 64. So lets talk about what exactly this is. So heres it is. This is the draft of the report that went to Congress Last night, as puerto rico was asking for money in the Recovery Effort on the island after Hurricane Maria. And in it, it does say, the official death toll is 64. But then it also acknowledges this estimate of 1,427. 1,427 deaths. That was an increase when compared to past years. So even though the government is acknowledging, hey, look, the data is showing an increase of more than 1,000 people in the aftermath of Hurricane Maria, that death toll still stands at 64. Why . Well, i actually just got off the phone with officials from the government of puerto rico, and they are saying that they have no plans to change that death toll, 64, until the study they commissioned coming out of George Washington university is complete. But whats the problem with that . Weve seen delays with that study. The preliminary findings of that study were supposed to be out in may. That didnt happen. Then a recent release really only put out what the methodology of that is. So we really havent gotten firm numbers and causes for these deaths under that study. In the meantime, you know, that number, that death toll, is not changing. And why is that so important . Well, even though the government or the governor of puerto rico has acknowledged that the death toll is likely higher, in the meantime, families who have lost loved ones are still looking for closure, that acknowledgment. And even more important, as we are now in the Hurricane Season on the island of puerto rico, you know, if you dont understand the true death toll, if you dont understand who died, when, where and how, theres really no way to explore options in terms of preventing those deaths in the future. Yeah. Forget just the human the Human Decency side of this, of accounting for people who were killed in the aftermath of a hurricane. Judge ts ellis went on the record and told the jury he was wrong for an outburst yesterday. Saying, hes human. Shimon, it is not every day that a federal judge admits hes wrong from the bench. What is this about . No, its not. And a judge who continues to be so hard on prosecutors. This all stems from something that happened yesterday. The prosecution had a witness that they called, an irs expert, who happened to be sitting in the courtroom through the trial. When they called that witness and that witness said they had been sitting in the courtroom during the entire trial, the judge scolded the prosecutors, essentially for that, for allowing this witness to sit there through this Trial Listening to other witnesses testifying. And the prosecutor reminded the judge, it was his own permission. They asked him for permission to do so, and he allowed it. And so they went ahead and filed a motion with the court, requesting he apologize to them and to the jury. See, the issue, kate, this was all happening in front of the jury. And certainly their perception of what theyre seeing by the way the judge is reacting to this could affect their ultimate decision. And that is why the prosecutors wanted the judge this morning to apologize, which he did. This judge is quickly becoming the story in this case. It just continues to go after prosecutors, and just a reminder, this is the same judge who went off the Special Counsel in bringing this case, the idea perhaps he was only suggesting doing this to go after Paul Manafort to get him to cooperate. I just want to just do a quick summary of one of the transcripts. This isnt related to that witness, but what else the judge said. He said to the prosecutors, look at me when im talking to you. Im sorry, judge. I was. No you werent. The prosecutor, i dont want to get yelled at again by the court for having some facial expression when im not doing anything wrong but trying my case. It has been wild to follow this. At one point, kate, the judge said one of the prosecutors there had tears in his eyes. Good thing about these things, some of this is happening outside the presence of the jury. So that exchange happened outside the presence of the jury. So there really is no impact. But when it happens in front of the jury, there is always concern that somehow these interactions, these reactions by the judge, could sway their ultimate decision. All right. And were actually thinking of a sixth. And that would be the space force. Does that make sense . The space force, general. You probably havent even heard that. Im just telling you now. Well, right now, Vice President mike pence is talking about just that. The future of the u. S. Military in space, and the possibility of creating the first new branch of the military in 70 years. Heres mike pence. And thats precisely why were beginning the process of establishing space force as the sixth branch of our armed forces. Just as in the past, when we created the air force, establishing the space force is an idea whose time has come. The Space Environment has fundamentally changed in the last generation. What was once peaceful and uncontested is now crowded and adversarial. Today other nations are seeking to disrupt our spacebased systems and challenge american supremacy in space as never before. But not everyone thinks its such a great idea. More of a waste of time and money, including my next guest, deborah lee james, former secretary of the u. S. Air force, under president obama. Thanks for coming in. Thanks for having me, kate. You say the space force wont do anything more than make existing problems worse. Why . Well, im against having a separate entity, a sixth branch of the Military Space Force for a number of reasons. First of all, the spraace enterprise, though very important, is a mission that enables all other operations in the military. So we need more integration, not pulling it apart into a separate entity. Secondly, it would be a very, very small entity. Anywhere from 10 to 40,000 people, depending on how you count. So i fear it would get lost in the shuffle of the big bureaucracy of the pentagon. And third, the thrashing about that would come with such a huge reorganization, i believe and fear would actually set back the momentum that weve seen in the last few years toward improving the space enterprise. It does make me wonder, secretary a branch of the military hasnt been created in 70 years. What would it mean to go about right now creating a sixth branch of the military . Because mike pence said today, they want it established by congress by 2020. Right. Well, again, it would be a huge undertaking. A major, major reorganization. And it wouldnt address by itself any of the problems or issues that various people have put forth. For example, it wouldnt in and of itself provide more money. If more money is your issue, Congress Needs to appropriate more money. If war fighting is your issue, a separate Military Service does not do the war fight. That is what the Combatant Commands do. And by the way, the report today does call for a separate unified command for space. I think thats a very good part of the report. But the Military Service idea doesnt fix any of the challenges or the defense secretary james mattis this week said that military leaders, in his view, are in complete alignment with the president s concerns about protecting our assets in space, to contribute to our security, to our economy, and were going to have to address it as other countries show a capability to attack those assets. There was some question if he was on board before. If he wasnt on board with this before, it sounds like hes on board now. Do you think he is being straight forward . Well, i think secretary mattis and other top leaders in the pentagon who are already on record with saying that a separate service or a separate corps is not a good idea. I think theyre now stuck because whats happened in the intervening six months is that the president of the United States has simply said do it. That, by the way, took everyone by surprise. So theyre stuck, and they have to do something now to back up the president s words. I would also note being aligned with the concern is an interesting way of putting it. It is very different than being aligned with the solution that the president has put forth, and secretary mattis certainly did not say that. He did not. So quite a few mocked the president for bringing this up. I dont know if its just the name sounds kind of funny, if you will. I dont know. But is there a real concern in space . There seems it seems to be a huge issue to be concerned about. Or do yo u think this is more o a scifi fantasy . No, there are concerns. The entire military faces challenges. We face challenges All Around The World every day, and we mitigate through strategies and approaches that we take and budgetary infusions. So this challenge, make no mistake about it, the u. S. Space command and the forces that we have in the United States force base are the best in the world. Our assets are the best in the world. But what has happened lately is that other countries have been catching up with us in ways that are worrisome, which is why the pentagon for the last three, four years at least has been very focused on speeding up the acquisition process, putting more money towards space, elevating space within the command structure. All of these things are ongoing, and once again, i fear that a major reorganization would set us back in all of the momentum, and it would not solve any of the challenges that we are facing.
