Yeah, ive been to Boyle Heights. I mean, people must have a good feeling for me. Did you talk to griffin or anybody yet . I didnt talk to anybody. Im in my house in Beverly Hills. Yeah. I mean, how could you think im a racist, knowing me all these years . How can you be in this business and be a racist . Do you think i tell the coach to get white players or to get the best player he can get . The best player he can get. I mean, you i dont expect anything from anybody, but i do from you. I mean it breaks my heart that Magic Johnson, you know, a guy i i guy i respect so much wouldnt stand up and say, well, lets get the facts. Lets get him and talk to him. Nobody tried. Nobody. Im here on Beverly Drive and sunset across from the Beverly Hills hotel, you know . I mean, i think theyre going to theyre probably trying to force you to sell. Thats the thing. They dont you cant force someone to sell property in america. Im a lawyer. Thats my opinion. No, im just saying, i think theyve got sean combs, diddy, hes the one thats really seeking about it him and oprah. Who . Diddy, sean combs, and oprah are the ones trying to well, we certainly have a lot to chew over here. We want to talk with this new recording. Our legal analyst is here, our own jason carroll. And in los angeles, Stephanie Elam is with us at this hour. Jason, i think weve got to start with you. First of all, what do we know about the recording, radaronline has it . Whos speaking . What do we know . There are a lot of unknowns. Clearly what we do know from the person who purports to be Donald Sterling on the tape, hes not a racist, he has a love for everybody. Its hard to understand that when you hear that in comparison to the other tapes that weve heard where he says dont bring black people to my games, specifically Magic Johnson. You hear him referring to Magic Johnson there. Also what i find is interesting is where he says i have a love for everybody. He says, how do you think what do you think, i could only hire white players, or did i go for the best players . But remember when elgin baylor, the former general manager of the clippers, when he filed that lawsuit against the clippers in 2009 . I pulled up the complaint here. He says he made it very clear that sterlings approach was to try to put out negative and quote, even false information about the africanamerican players. So clearly there is a big gap between what were hearing on this tape here today and from his alleged behavior in the past. Is there a definition of not being a racist that allows for not wanting someone to bring black people to a basketball game . I can answer that question. No. I dont think we need a legal expert for that, danny, but there is some other things in here that require expertise. Namely, he says he doesnt want to sell the team. This ownership issue is going to combine issues of trust law. Its going to combine issues of divorce law. Were going to have to determine whether or not under the nbas institution, this is even something that the nba can do. But even beyond that, thats only the beginning because if the property is held in trust now, a trust is just when you have one Person Holding property for another or other beneficiaries. And the reason you create it is that you want to shield that property in case, for example, the millionaire trust fund kid, who you dont trust to actually take care of the property. Well, he can get an income from it. We do the same thing in business all the time. These trusts are literally created just to protect assets, to protect property. And the question is going to come up, who has ownership of this trust . Who gets to run it . Who gets to dissolve it in and its not as simple as we dont like Donald Sterlings thoughts. Therefore, were taking a team away from him. Although it would appear that way in the nba constitution. Lets bring in Stephanie Elam in los angeles. Stephanie, youve been doing a great job covering this story for us from the jump. Its interesting, we know how people in los angeles feel about Donald Sterling. Do they share the same sentiments for his wife . Reporter thats exactly what weve been trying to find out. You take a look at what youve seen of the playoffs. We heard after this whole scandal broke, you saw that she put out actually, i should say that it came from doc rivers. Im hearing myself so im going to take my earpiece out. It came from doc rivers where he was saying that she asked if she could come to the game. She said it was okay. He said that he felt sorry for her in this situation. Shes been playing this role of saying hey, let me play the part that i need to so that i can then take over the team. We have spoken to her lawyers. Were working to get a statement out. But they are indicating that yes, she wants to take over the team. The other thing thats interesting about these new tapes that were hearing from radaronline is the issue that he talks about how he grew up in east l. A. And Boyle Heights, and so there has to be a good feeling out there about him. Theres a huge disconnect between the tape we heard before and this tape. And somehow he seems to believe because he grew up around people of different colors, that somehow means that theres no way he could be a racist, which obviously we know is not the case. He talks about being elected High School Class president , essentially saying i did well with the black vote, which for a guy in his 80s, it seems very, very odd to me. But and you all bring up excellent points here. This is all happening at the same time, and it may not be a coincidence. The nba trying to take his team away from him. Shelly sterling trying to get it. In this recording where he defends himself very publicly with what he thinks is his best argument youve got to question the timing of it. Exactly. Youve got to question the timing of this tapes release. What a lot of people are going to come away with, looking at this questioning, is this man delusional . I mean, i said it during the last hour, but it does remind me of those people who say look, some of my best friends are black. How could i possibly be a racist . In looking at the history but youre talking about timing. Go ahead, steph. Youre talking about timing here. This has been going on now for a couple of weeks. And we have not heard from him except for in this reported recording that were hearing from thats coming out from radaronline. We havent heard him say anything. And hes saying that hes upset that Magic Johnson hasnt come to him. What about the fact that he hasnt gone to somebody else and said, listen, is this me on the tape . Yes, i said this, but this is the context. Not that there could ever be the right kind of context, but we havent heard anything from him except for this surreptitious recording. Doesnt the timing of it i have to keep going back to the timing of it. Doesnt it seem like an awfully convenient way . Because the fact is, the man could grant an interview to anybody. He could talk to anybody. And clear the air. And clear the air if theres air to be cleared if he feels . I think one way of looking at it, its really sort of a sad effort. If it is says some sort of pr release or some calculated decision, it is sort of a sad glimpse into the way hes trying to fix the problem. I mean, theres so many other better ways from a Public Relations standpoint to address this problem. But just a rambling sort of tape about oh, no, no, i love people of all races. Isnt really taking steps. I dont think it really goes far in helping him retain ownership of his precious team. We want to talk more about the legal angles here. Can he keep this team . You think im a racist . You think i have anything in the world but love for everybody . You dont think that. You know im not a racist. I know i got the i mean, when i heard the i cant hear you. What about when i hear you know when i hear that tape, though . That tape i heard . I grew up in east l. A. East l. A. , youd die to get out of there. I got out of east l. A. Donald sterling once again talking about his campaign for class president high school apparently with the help of the black and hispanic vote. 65 years ago. A long, long time ago. Says hes not a racist. Also says on this tape that he does not plan to sell the team. And thats why i want to talk about danny cevallos, our legal analyst. Shelly sterling, the wife of Donald Sterling, according to the los angeles times, according to some other sources, now says she would like to be considered the owner of the team. She doesnt want the family trust to get rid of the l. A. Clippers. What legal right does she have . I know its in a family trust, but you know, has she really been active in owning and managing this team . Yeah, we are on new ground here because first a court will probably have to determine who, in fact, owns the clippers. And i think whats going to be critical is a statement that commissioner silver made early on, which is these actions we are taking are against Donald Sterling. Were not taking them against any other family members. Look for those words to come back. And someone has gotten in Shelly Sterlings ear. And wisely, she is now asserting herself as a good, viable candidate for ownership of the clippers. And because were on new ground, because the nba has sought to use a part of its constitution to oust an owner, when it really wasnt designed for this purpose, for throwing out an owner because of his private thoughts, theyre going to run into some legal problems. I dont think its going to be as easy as the nba believes its going to be. Now, danny, that brings up an interesting issue because if you look back at some of the reporting about shelly, she was involved in the brouhaha about the issues they were having many years ago, so she would be in the same category, would she not . Exactly. But now look at the business the nba has gotten itself into. Now instead of using a constitutional provision to oust an owner when theyre not making the payroll or theyre not doing correct business transactions, now the nba is inserting itself into the business of finding out all the bad things you may or may not have said over the last decades. And is that really from a Public Relations standpoint and a legal standpoint the kind of business the nba wants to be . But jason, youre reporting on this and other cnn reporting, the nba seems fairly committed to going down this road. The nba seems very confident about this. I think its likely that they have some support also from the players as well. You remember the players were asked about this last week. In fact, they were asked about what if Shelly Sterling were to be owner. And the players sort of dodged the question, basically saying they wouldnt want to be in the position of making that type of decision. But i have to tell you, you know, after hearing from people within, you know, from the nba, people who are familiar with the clippers, i think they want a clean slate. Oh, theyd love a clean slate. They dont want the sterling name associated and to add to further there is one thing here to point out. Theres one thing to point out and something people forgetting. The nba is a business. And so ultimately, what they cant have are sponsors dropping out as they were when this first reported, before there was reaction, thats money. They cant afford to not have the players on the court across the nba because then theres no games. Theres no sponsorships. Theres no fans. And if the fans drop out as well, who also bring a huge amount of revenue, thats another issue. And i think for a lot of fans here in los angeles and in other cities, if there is any sterling who is behind the ownership of this team, that is going to be a problem. I think the nba sees that, and i think they did this because it was perhaps the right thing to do after a racist rant. But also because at the end of the day, this is about dollars. And if they dont have people coming into those courts for those games, then theres no point. Its all about that bottom line. We do know it is about the bottom line to be sure. The idea of selling the team theres more than three, the idea of selling a team, well get to that in a second. Also the source of this tape because to me if theres one human being in america right now who knows a little bit about recorded conversations is Donald Sterling. Maybe. Theyed this could happen, and my accident the time is curious. Seems a little strange. Stephanie elam, the first question i want to ask you, Donald Sterling seems baffled by the fact that no one is standing up to defend him. Is he right, first of all . I dont think ive missed anyone standing up and saying Donald Sterlings a great guy, is not a racist. Yeah, whats interesting about this is even his own wife seems to not be going behind him. There was that one clip we saw when they came out of a restaurant and she seemed to defend him saying he wasnt a racist. Since then shes been sort of setting herself up to take over as owner. I would also like to point out that the sterlings seem to have an interesting marriage. Theyve been married for decades now. But it does seem to be very confusing how they interact because theyre still seen with each other. Hes still been seen with v. Stiviano. They still have these business dealings. And it almost seems that money is more important than marriage. And so it would almost make one wonder that while shelly is making all of this play to be the owner of the clippers, would that really mean that donald would be a part of it . Because they do have a lot of business dealings together. Shes been reporting herself as a coowner, putting out statements and so forth. So whats interesting here about how they are dealing with this whole thing is are they really behind the scenes planning how theyre going to attack this, and thats why shes been out there making statements and why hes been quiet. Okay. So well get to the v. Stiviano part in a second, steph, because thats a whole part we need to investigate and talk about as well. Theres another point i could not help but talk about is the fact that, you know, theyve both insisted that since the 80s, theyve been dedicated to bringing this city a championship. Hows that going . Second, this is a clipper fan speaking. Danny, ive got to talk to you about something. This idea and you hear it on the tape you cant force someone to sell property in america. The thab, we knnba, we know, ha to sign morality clauses over the past 20 or 30 years, so hes not in the right there at all, is he . Well, as with many legal answers, sort of. Lets start with the nba. Hes right that generally you cant force people to sell property, but there are so many exceptions. One of them is if you contract your rights. Thats what nba owners do. Hey, wed like to be part of this league. Well, no problem. But but the conditions are set forth in this document. And you give up certain rights, including the right to have a court look over decisions of commissioner silver. He is the final say, the final arbiter. So for a court to take interest in Donald Sterlings theory of the case, theyre going to have to overcome the provisions of that constitution. And the nba is going to fall back on that constitution and say, Donald Sterling contractually agreed to give up, to waive those rights. Absolutely. And have everything arbitrated within. Its a family affair. You know, Stephanie Elam used the phrase interesting marriage to describe the sterlings. I now hope that no one in the history ever describes my marriage as interesting. Interesting. Complex. Jason conspicuously odd coupling, thats all. That, too. Another one. Its a business relationship. Its a business relationship. Is that what people are saying . I think people look, a couple things. When it comes to their relationship, i think a lot of people and who are we to judge people who have been together for many, many years. Between two people. How they want to live their lives . Aside from that, Shelly Sterling cannot play both sides of it. She cannot play like shes on the side of but she is. The clippers, showing up at the games, at the same time showing up outside of a restaurant and defend her husband, Donald Sterling, and say that hes not a racist. Which is it . Okay. And then theres but thats what shes been doing. Earlier today saying theres the v. Factor. We havent even said v. Stivia o stivianos name. Extortion charges. According to the los angeles district attorneys office, they say theyre not commenting on these allegations that v. Stiviano tried to extort money from sterling in exchange for keeping quiet about these tapes. Could this be a behindthescenes effort to all of this . Her people say what this is whats going on is this is another effort to move attention away from Donald Sterling and move attention to v. Stiviano. They say the person who everyone should be focusing on is him, not her. You know, one group who doesnt want to hear this tape, among others . The l. A. Clippers. Great conversation to be had now. Monica lewinskys name is back in the news. A new article in vanity fair is out there for everybody to see and read. About ten years of reclusive silence on her part, officially broken. She says in the article shes trying to, quote, take back her narrative. But could it change the narrative also for Hillary Clintons political prospects . Monica lewinsky writes that her essay isnt about her and the clintons. She writes, their lives have moved on. I wish them no ill, and i fully understand that what has happened to me and the issue of my future do not matter to either of them. Let that sink in for a moment. Suzanne, people have been critical a little says bit of this essay from lewinsky, also those who praise it. This is a well thoughtout piece, and shes writing about more than just her and the clintons. She writes about society, to an extent. She says we may not have become a crueller society, although it sure feels as if we have, but the internet has seismically shifted the tone of our interactions. You covered her forever when this was breaking. Is it interesting to hear her b . I appreciated this article for a number of reasons because first of all she brings up the point about the internet and says thank god she was spared from facebook and twitter and how fast the news cycle is. It would have been harder in this day and age. I take you back 16 years ago, why did it even become a story in the first place . Were sitting in the white house, and we get a fax of the drudge report that comes across. John palmer and i at the time. We debated whether or not it was a story to begin with because you had paula jones, gennifer flowers. You didnt really even know if this was going to stick. The reason it did was because she was an intern. And we had a bet over steak dinner whether or not it would turn into anything. Well, fast forward, the house impeaches the president , and john palmer says you owe me a steak dinner. I mean, we were back in the day where it was not necessarily clear whether or not this was going to be something that anyone was interested in. The reason why . Because you had the independent counsel, the starr report, that made it a legitimate story. Now she has the opportunity to tell her own side, her own story, and not be a stereotype or a caricature the way she was made some 16 years ago. Yeah. And i think taking back her nrrative, i think, is resonating with some people. Its interesting, you know, i was thinking back, suzanne, 16 years ago doesnt really feel like that long ago, but in a way it was forever ago. An intern and a president. I want to read this other part that she writes. Quote, it was an authentic connection with emotional intimacy. Frequent visits, plans made, phone calls and gifts exchanged. She really wanted people to understand what she felt, it seems, of that relationship because i think there are people who felt she was taken advantage of or that she sought this out. If you read the starr report, i mean, this was a thing that was really like about three or four books the size of telephone books. You stacked them up one on top of the other. When we got that starr report 16 years ago, i sat there and i read through this thing. And we all tried to digest it as quickly as possible here. But it was a sad and pathetic story. I mean, it really was. And it was interdependent because you had had the emails, you had the phone calls, you had the recordings. You heard the president and Monica Lewinsky. And it seemed like it was a mutual dependent relationship. The both of them, the two of them. So you could understand why in a way as a young 20somethingyearold that she would think it was a mutual consensual relationship. It was sad to me that the president was very much engaged in this relationship, and thats what her takeaway was. Eric, the question is to what end now she wants to reclaim her narrative. Can she . Not really. I mean, look. Every scandal figure wants to be embraced as the truly multidimensional people that they really are. The fact is the rest of us have no interest in that type of complexity. We are interested in cast characters. So the idea of taking back your narrative is a wish. Its not a strategy. That said, she did Say Something in the article, and suzanne points this out correctly, that we are in this vicious climate where internet shaming and media cascades run away, and you cant get them back. So if you cant change your narrative, what you can do is embrace it. And one of the things that i think that she can do is because its dodge city out there with all of this this media cycle, i think that she can probably begin to do something in terms of the laws that are now being passed in this area. So to me, that would be her future. But shes not going to get people to unthink she was the woman in the Clinton Lewinsky scandal. It reminds me of when you apologize to somebody, you cant guarantee that theyre going to accept that apology, right . You might feel like you got something off the chest. You cant necessarily control how they react to it. Well, you know, its funny. I had this argument with my students at georgetowns business school. We were talking about Michael Milken who had the trouble in the late 1980s with junk bonds and fraud. Hes done some extraordinary things in the last 30 years. That have redeemed him in many respects. And one of my students said, but i havent forgotten that he was convicted of stockrelated fraud. So this idea that its like men in black that you could zap people and get them to unremember things is simply not going to happen. I think whats going to be interesting is what this does and doesnt mean for the Political Campaign that may be coming. Aha. And thank you for helping me with my tease, eric. The house of representatives are preparing to vote on a republican plan for a special panel regarding benghazi. Would investigate those 2012 attacks on the u. S. Consulate that claimed four american lives when clinton was secretary of state. Clinton is suggesting this is all about partisan politics. Despite all of the hearings, all of the information thats been provided, some choose not to be satisfied and choose to continue to move forward. Thats their choice. And the Monica Lewinsky essay. Is this a thorn in her side for Hillary Clinton that Monica Lewinsky has come out with this essay, or is it better to get this out of the way now . A thorn in her side for now. The question is will it last . Will it be a thorn in her side two years from now . I think it issue could stick around. Lewinsky is certainly worried about that. Shes terrified of a clinton run in 2016. She says that in the article. She knows all this will come back. So that means it will be coming back to hillary as well.
