The president appears to be referring to the Court Settlement requiring children to be released from parents within 20 days opini. Its not clear if he was. He seems to be ignoring this does not have to lead to family separation. The president calls it inevitable. It hasnt been good and the American People dont like the idea that were separating families. We never really intended to do that. If your smuggling a child then were going to prosecute you. At the facility, Melania Trump toured today, the manager said his children are able to talk to the parents for ten minutes, twice a week. Has she been able to talk to her daughter . You know that was one of the astounding things about this conversation with this woman because despite what the administration has said and cindy was describing how they were watching television when President Trump signed that executive order and all of these women many this facility started cheering and crying and thinking that things were going to change. They would be able to talk to their children but that was not the case. Take a listen. Now cindy shared that phone number that immigration gave her with us. During our interview we tried that number twice. Heres what he heard on the other end of the line take a listen. This woman said shes not the om one. Most of the women she knows in this mass ifr ive facility have been able to communicate with their children. She said she had a message for the first lady. What did she say . I was doing the interview with her when the news broke about melania landing in the rio grande valley. I asked about the first ladys visit. Here is what she said. This little girls aunt and she says that she actually was able to talk to the little girl and the 6yearold she said is very worried about her mother, asking her aunt if her mother had eaten. If she was still in detention. If her mother had her detention hearings and process this with me. This little girl, her wish about leaving detention is she hopes to take a shower at her aunts house according to her aunt. She wants to buy and eat as much cereal as she can. I appreciate the report. Thank you. Children taken from their parents are now spending their nights not just apart from them but several Thousands Miles apart. 700 here in new york state. New yorks governor visited one such facility. He joins us now from albany. The facility that you toured, what were you able to see and find out about the kids there . The first its a hodgepodge to use a word. I think what happened is when they started the zero tolerance policy, april 7th, that triggered once they decided to arrest the parents, that triggered the problem of where do you put the children because the current law says you cant detain the children. Hhs then has been in this scramble ever since sending children all over the country as we well know. We have a very large system in new york so we wound up with many of the children. Basically, today, the young people we spoke to, theyre traumatized. They are in limbo. They showed up at the border with their parent. They were excited they were going to america. Running from ms13, guatemalan running from a dangerous condition. They get to the border and are separated from their parent immediately. They are shipped to state theyve never heard of. They cant speak the language. Your point about contacting the parents is very different. It depends where the parent is and what Detention Center. We have one young person who has been there for several months. Only spoke to parent once. They are traumatized. Many of them have psychological issues. They have anxiety. They have depression. Many of them are on psychotropic drugs and under the care of a psychiatrist. They dont know whats next. They dont know whats going on. Are they seeking asylum . Are they going to be sent back . Much of this started in april, may as soon as the zero tolerance policy went into effect. This is either gross government incompetence unparalleled or its the most disgusting political display weve ever seen. Its one or the other. This was either the debacle. In any event, for me, you have 2300, 2500, who even knows what the number is. I tried to get hhs, health and human services, to tell us how many children were in the state today so i can provide help. They wont tell me. I dont know that they even know. In any event you have 2500, 2700 young people being used as political pawns, traumatized. This is a trauma that can last them a lifetime. Its really that kind of traumatic situation. What i dont understand is when general kelly was head of homeland security, he was publicly raising this idea of separating families when he was running it. You would think if they were talking about it back then, at the very least they would have had a lot of time to figure out the where kids would go to figure it out and it wouldnt be to use your words such a hodgepodge. Did the workers at the facility seem to have guidance as to what was actually going to happen next or how these kids would be reunited or what the next step was . No. They had no idea. Anderson, its what you said. April 7th they put in the zero tolerance policy. Were arresting everyone. Were tough. Were strong. Strong borders. The law says you cant detain children. That triggers the children having to be sent somewhere else. Be president does the executive order yesterday. The headline is president reverses himself. He didnt reverse himself. The executive order is a sham. Aer a reversal is a 180. This is a 360. He wounded up where he started. The Obama Administration tried to renegotiate flores and they couldnt. Today they say were going to set up camps for 20,000 family detenti detention. You cant do that either under the flores decision. None of it makes sense. None of it follows the law. I think what this is really about is making a robust political statement. Were strong on the border. We an infestation and the children are the pawns in this national debacle. Its not going away soon. More on the governor spoke of because theres no overestimating how wrenching it is for these kids. We remember the fear of being separate frd a paren separatea parent. The governor was talking about the trauma the kids are going through. Theres the trauma in the many unknowns of when and how they will actually be able to be reunited with their parents. Its one thing to be separated, its another thing to not know what the future holds. Absolutely. The kids that can tell you they are traumatized are telling you this. Were seeing anxiety. The kids i seen are the really little ones. Some are preverbal. All they know that one foundational relationship in their life has been taken away from them. They either externalize their behaviors. They become aggressive, skrcryi screaming or they internalize them and become withdrawn. They talk about the first two to three first years of life as the most important, the immediate span of time. If you have kids preverbal, you have little children that age being separated from their parents theres no telling what that does to a kid for the rest of their life just in terms of their own development. Absolutely. The brain develops most rapidly between birth and three years of age. Thats when we want positive experiences and positive relationships to build that brain architecture correctly. Whats happening with these kids is that the trauma is causing something we refer to as toxic stress where they are fight or flight hormones are staying high in their system. That keeps them on red alert all the time and disrupts their brain development, disrupts their ability to speak, to gross motor, fine motor movements, to develop relationships from here on out. The fact the president s executive order is allowing for the families to be reunited but may be held together indefinitely or if they dont alter this flores settlement within 20 days, they could be separated again. After the president s executive order the question we have is now what. When are these families going to be reunited. When are the children going to be reunited with the parent that loves them and where are they going to be kept . Are we going to have them in place where they are retraumatized again . Wheres the action now that this executive order has been declared . Can you describe about what you saw or heard. Are care givers able to touch them, to console them . What i saw was in one of the tender care shelters and it was a very homey environment. There were appropriate books and toys and blankets and things there for the children to keep them clean and fed but when you walked into the toddler room which should be a den of activity and noise. You had several very quiet little toddlers who were just looking at you frightened. One little girl who was sobbing. The workers in room pr. They werent allowed to hold her or touch her. This child was really in a great deal of pain. The rest of us felt so hopeless because we knew she needed her mother. We couldnt give that to her. I guess the reason theyre not allowed to touch a toddler or an infant is for to prevent any kind of abuse. At the same time, the idea of a child not getting any kind of affection is its kind of stunning. Its sad. I dont know what or where or why this policy exists but i saw this in action happening the day i visited. Just ahead, the message that wasnt a message until it was. Lets pick through the other possible ways of interpreted this jacket. Either tone deaf or trolling not at the news media or perhaps a combination of all three. I think its a combination of all three is the more likely of those scenarios. Then theres just what we dont know which is obviously a lot. What we do know is this was no question intended to send a message. The irony of this is that the message was had a code thats been so hard to crack that even the staff in the west wing and i guess the east wing, the first lady staff have had mixed messages about what the coded message on her jacket could be. It would be comical if it werent about the first lady completely stepping on the message that was supposed to be the one of day, her going down and being the only person at the senior level from the Trump Administration to see first hand what is happening with some of the children. No it wasnt one of the most, the tender age facilities but it was and is one where there are children who are in need. Illegal immigrants brought over. Most of them came over unakpaned but some of them about handful of them were sprited from their parents. The one other point i want to make is that just by way of knowing this was a big deal inside the west wing among the president and his staff, Melania Trump when she came back wearing that jacket again knowing this was a big thing. Whats interesting is in her spokesperson initial statement in there wads no message, the last line was something along the lines of i hope you dont make this a story about what shes wearing implying how stupid it would be for the media to focus on what shes wearing. Shes wearing a giant sign that says i dont care, do you. Going on a mission that is supposed to show how she cares and then the president takes the time, the most important person on the planet to craft a tweet coming up with some belabored explanation. Thats what he spent time doing today. Exactly. Its the basic notion that her spokeswoman initially said its just a jacket. Theres no message and then her husband, the president sends a tweet which is just absolutely not believable in the least saying that she was trying to say that to the fake news media. Im not so sure that this is a ma Marie Antoinette moment. With Melania Trump because she does use her wardrobe so often to send messages, not as blatent this that written on the back of the jacket or the big white hat or the whiteout fit around the me too movement. Emails obtained by cnn seem to say otherwise. What exactly do these emails reveal . Where are they from . Its confusion is the picture that emerges. Ty copeland obtained these from inside customs and Border Protection agency. They were told to suspend referring adults, people who showed up with their kids and were caught crossing the border. There war suppoere supposed to sending those people to the Justice Department for prosecution. Neutering the policy the Administration Says was still enforced. However, we are now learning there are additional emails going around saying perhaps one parent and then there were no parents that would be sent. It looks like inside the customs and Border Protection agency, yesterday and today, theres been some confusion over whether or not one parent or two parents or no parents were to be sent over to the Justice Department for prosecution. Thats counter to what the Justice Department told reporters just today. They said the no tolerance policy is still in force. They said to prosecute adults who cross our border illegally instead of claiming asylum at the border. The customs and Border Protection agency said the Border Patrol will continue to refer to prosecution adults who cross the border illegally. In practice, it looks like the guidance thats being put out to field offices is dont refer people to the Justice Department for prosecution if they are caught crossing the border with their children. All right. Thanks very much. All this is adding up to out rage from some lawmakers. I spoke with jeff merkley who toured a Detention Center in texas. Are you clear to whats happening with family rey reunifications and a policy on the border . The president has not laid out a strategy for reuniting the more than 2300 kids separated from their parents and replacing one policy for future families. That is the family separation policy that offlicts kids which is handcuffs for all. Dont just put the parents in jail. Put them all in jail. Is there any indication they are all on the same page, communicating well . Theres a lot of evidence they are not communicating well. After we heard the administrator of children and family come out last night and say that no one is grandfathered then we heard a bit of a walk back of that. Theres chaos right now. What im looking for is a Clear Strategy to quit hurting children and quit using them, the pain of children as a strategy of deterrance. Thats immoral and so far the president doesnt get that. It also seems if the Trump Administration doesnt get favorable ruling in federal court that allows them to detain Families Together for more than 20 day, which is the current limit that kids can be in custody that they could go back to separating families again, 20 days from now. Thats right. Heres the thing. What the president is proposing is equivalent of internment camps during world war i, rii w locked up japanese american Families Together. That was a dark spot in our history. Creating internment camps for those seeking asylums. I hope the court doesnt grant it. They shouldnt grant it because the original decision was about doing whats right for the health of the children and here is a president wanting to overturn a strategy that supposed to be good for children with one that isnt good for children. As we mentioned before, attorney general sessions said the add Administration Never intended to separate families. That contradicts what he said that they would be separated and they talked about it as a deterrent as part of the policy. Do you understand the contradiction . Absolutely. Everything we read about the discussions that were held with the chief of staff, with the secretary of homeland security, with Jeff Sessions, it was all about how do we deter people from coming to america and how d do we inflict this cay yohaos o family to deter them from coming here. For him to say that wasnt the intention is absurd. Its the argument he made and he made it publicly. The president questioned whether republican led house should bother to pass immigration bill. It would need democratic support to overcome a filibuster in the senate. He says republicans in the house arent in agreement on the immigration bill which is why they postponed the vote until tomorrow. Is there any bill you can see passing the house and the senate at this point . Its hard for me to imagine. Lets turn the clock back to 2013. The democrats and republicans got together. Four and four, a group of eight. They forged bill which was security at the border which is what the president wants now. It visa for hightech security. Lets restore a structure of law and treat people with dignity and decency. That passed overwhelmingly in the senate. It has a super majority. The speaker of the house wouldnt put it on the floor of the house. Theres a foundation we can turn to. Anderson, thanks for having me on. Experience shows, my own experience shows, that perceived changes in Immigration Enforcement policy do have a reaction. At best, they have a short term affect on illegal my graigratio. So long as the underlying conditions continue to exist, illegal migration will continue to exist. Thats what the 2014 experience, my three years as secretary showed and so we looked at doing a number of different things. We embraced a number of different things. Some of which i freely admit were controversial. The one thing we would not do is separate children from their parents when they got to the border. Attorney general sessions say they never intended to separate kids. Its the opposite of what he said last month. This administration did talk about this as a deterrent. It doesnt seem like this administration can get their story straight much less this policy. Well, anderson, i have to say that a sure sign of the weakness of a policy, lack of confidence in a policy is when you cant simply get your story straight to explain what you are doing and why. President trump has said that images in detention affect everyone and the images of children in the ob aama administration was worse and its a double standard. Does he have a point . Very clearly, illegal my gra migration is a fraction of what it yuds edused to be. You saw images from 2014, 2015, 2016, women and children in Border Patrol facilities after their apprehension. Theres no denying that. I saw them in person myself on the numerous trips i made to south texas to address this problem. The president is also been critical of the legal proses when releasing someone or family saying its not realistic to expect them to return to court for a date that could take many months or even longer. Im wondering what your reaction to that is. Last night he spoke to the former acting i. C. E. Director who said that could be addressed by using things like ankle bracelets, monitoring like that. Its cheaper and has been effective in the past. Without a doubt this is a problem. Migrants not returning to court when they are released. A number of deportation orders are issued in absentia. Its one of the things we try to do when we had the families coming in is to expand family detention. Even with the expanded detention, a number of migrants are still released. We need to do a better job of making informed decisions about who is a risk of flight and who is not. This is a real issue and we cannot have a system of catch and release. We are a sovereign nation. We have to secure or borders, and so we just simply cannot have a situation where people are apprehended, released, they dont return to court and they know theyre able to do that. Thats effectively undermining your own Boarder Security efforts. Whats the solution . Youre saying detaining Families Together, more judges so this is processed quicker . Plainly, we need more immigration judges. I hope that congress will continue to fund more immigration judges. Were about 350 now. The lack log among those are enormous. It goes back years. The president said theres thousands of them and thats not the answer. 350 is the number. I know were trying to get up to somewhere in the fives. I think theres a lot more needed. Again, this is something politicians in washington dont do very well. We need to make the longer Term Investment in addressing the underlying push factors. Its basic human nature to flee a burning building and take your family with you. That what were dealing with in guatemala, honduras and el value va dor. The push factors are enormous. What makes it unconstitutional, though, in your opinion . Sure. Thanks so much for having me on, anderson. I appreciate it. Theres two buckets of claims here, which we often have as we have challenged the administration 27 times in court. Statutory claims. Its our view that the administration is violating federal law. When someone seeks asylum and comes to port of entry at the United States, what we want them to do, what were getting report ons is that United States officials are saying to folks, no, were full, and sending them away. That does not follow our asylum laws or federal laws. Due process, equal protection are important. Executive orders signed yesterday does not grandfather in the more than 2,000 kids that have already been separated from their parents. Federal law, constitutional law says theres a very strong desire to have families intact. The government cannot separate a family unless they have a compelling interest. We dont think its close to being shown in the situation here. You intended to file the suit before yesterdays executive order, correct . Thats correct. We were set to go for thursday. Executive order came out yesterday. So we did stop to take a close look at that executive order, to reevaluate our case and make sure we still thought we had a strong case. We do feel that way. Well adjust our claim in a little bit. Do you agree, jeff, has the government violated the law . I should be more than skeptical of the attorney general who proved me wrong about the travel ban but i am skeptical because the president has extremely broad powers when it comes to the issues of immigration and individuals who are not legally in the country have fewer rights at the border. All of us know that when you cross the border, you could be searched, you can have search and seizure, which people cant do within the United States. And i think the policy may be unwise. It may be cruel. It may be wrong. But is it unlawful for the president to approach to pursue this policy . Im skeptical. Attorney general ferguson, do you see any similarities between the executive order of the travel ban and this one, how little preparation has gone into them before how they were signed and rolled out . You both raised good points. Jeff pointed out correctly that the president has broad powers. The clear point here, though, is that authority is not unlimited. The president still has to follow the constitution. To your point, anderson, yes, there are parallels to a hastily drawnup executive order this one is reminiscent of that first travel ban. Lastly ill say yes, i filed 27 lawsuits against this administration. Nine courts have reached decisions in those cases, 90. Not one federal judge has ruled against the state of washington on the merits yet. I do not plan for this case to be the first.
