The government insists its not necessary or appropriate for the European Court ofjustice to have directjurisdiction over the uk after brexit. A paper setting out proposals for resolving trade disputes after britain leaves the eu is being published in an hours time, but the question of how future agreements between the uk and the eu will be enforced is proving contentious. The European Commission wants the court in luxembourg to guarantee the rights of eu citizens in the uk after brexit and to oversee the Withdrawal Agreement. But theresa may has said ending european control over british courts is a red line. Ministers say they want a special partnership with the eu, but it is neither necessary nor appropriate for the ecj to police it. Thejustice minister dominic raab said that both the uk and its partners in europe would be keeping a close eye on what the other is doing. Britain is leaving the eu, we are taking back control of our laws, that means ending the jurisdiction of the European Court ofjustice, we have been Crystal Clear about that. At the same time, we do want to forge a positive, new partnership with our eu friends. One of the ways you protect and nurture that friendship is making sure you have a sensible mechanism to resolve international disputes, most likely some form of arbitration, and that is the way we can make sure our trade, security and other areas of cooperation with European Partners will go from strength to strength. This resolution between the uk and eu is only one aspect of a potential future role for the European Court ofjustice. What future role for the European Court of justice. What about future role for the European Court ofjustice. What about all of those other various areas of the ec], underpinned within the eu, will they not still have influencing directly . We are ending the jurisdiction of the European Court in dealing with dispute at international level. We think that it should do what it says on the tin, but of course, precisely because we are taking back democratic control over our laws, they will diverging but time and both laws or want to keep an eye on what the other is doing, so we can manage and prevent disputes getting out of hand. That is how our friendship will go from strength to strength as we leave the eu. Adam fleming joins us now. Well, for a lot of commentators in the newspapers today, it is evidence of some kind of softening in the uk governments position, a climb down, if you like. I wonder if the government thought that the word direct confused the matter and it looks like they were offering less than promised. We will see when this document is published in less than an hour. Adam, thank you. Adam fleming in luxembourg there. So how important is the European Court of justice and what exactly does it do . Chris morris from our Reality Check Team has been looking in more detail at the role of the ecj. If youre talking about the resolution of legal disputes in the European Union, then this place is the final say. The European Court ofjustice, based in luxembourg. Its the eus highest legal authority. Now, it should not be confused, its important to note that this is a Different Court to the European Court of human rights, a separate institution based in strasbourg, which is not part of the European Union. And its the court of human rights, not the court ofjustice, that has often upset british politicians by making it harder, for example, to deport terror suspects. So what does the ecj do . Well, it insures that eu institutions like the commission and the eu Member States are complying with european law. It allows Member States to challenge eu legislation if they think it somehow breaks the rules. And it interprets eu law at the request of National Courts. In other words, it interprets and enforces that much everything the eu does, including the rules of the single market. And that makes it absolutely critical to the Brexit Process. Especially after the Tory Party Conference last year, when the new Prime Minister said this. Were not leaving only to return to the jurisdiction of the European Court of justice. That is not going to happen. At that point, vague promises during the Referendum Campaign to take back control of our laws suddenly became a very specific promise to end the jurisdiction of the ecj in the uk. It became the government red line. Now, the trouble with that is that all the end regulations that make the eu take are overseen by the European Court. So if the uk decides that after brexit it wants to stay in the European Air Safety Agency or the european arrest warrant, the european medicines agency, or a long list of other agencies, that regular grace aspect of our lives, it will have to accept that the ecj will still have influence over uk first. That is why the government are now calling for an end to the direct jurisdiction of the ecj, which implies an acceptance that they will have to follow many of its judgments indirectly. If we want to create the deep and special partnership with eu that ministers talk about. And the governments new paper examines a number of precidents, one of which has been discussed recently is the court watched governs the recall the relationship that non eu countries, iceland, norway, lichtenstein, have with eu single market. This court is independent, but in practice, it follows ecj ruling extremely closely. The eu could probably accept something similarfor the uk, but some brexiteers might not. Would you assess for us, firstly, how important the inclusion of the word di rect important the inclusion of the word direct as in direct constitution is. It looks like there is a shift in approach, as the government increasingly realises the importance of the court ofjustice, and how central it is for the ofjustice, and how central it is forthe uk, if ofjustice, and how central it is for the uk, if it wanted to continue staying in the medicine Schaub Agency or the european arrest warrant. We need to be subject to the jurisdiction warrant. We need to be subject to thejurisdiction of warrant. We need to be subject to the jurisdiction of the ecj and it will be interesting, looking out what we have just heard, whether the uk countenance of becoming a member of the efta court, which ovens the norway arrangement, or another port likes the efta court. But if there was a completely new model, albeit based on an existing model, presumably that would take a long time to setup . Absolutely, and for that reason it may be that the uk will concede that during the transition period, most people think there will be a transition period, that perhaps the uk is subject to the jurisdiction not of the ecj that perhaps the uk is subject to thejurisdiction not of the ecj but of the efta court, in order to enable the concept of government to say that we have satisfied theresa mays breadline and are no longer subject to the jurisdiction of the ecj. But we know that the eu sees a role for the ecj after brexit, specifically in guaranteeing the rights of eu citizens in the uk, how is that squared with the uk government . There is a dialogue of the death going on, for eu citizens, based in the uk, enjoying eu rights, they should be subject to the rights of the European Court ofjustice but then on the other hand, surely we will give them rights but they are british rights and should be subject to the british courts . Now, the british courts are well known for independent thinking and will not slavishly follow any government line they must comply and ensure that british law is enforced. That is what the European Union is worried about. It may be that ten years down the line, the uk changes its law and says eu citizens do not enjoy special status and therefore, the eu wa nts special status and therefore, the eu wants eu citizens in the uk and of course british citizens in the eu to carry on enjoying rights under eu law, enforced by the European Commission and European Court of justice. But, this could last for the best part of 100 years. It will last for the lifetime of the youngest person born in and around brexit day. For the uk, that is absolutely unacceptable. That is fascinating. Thank you very much. Princes william and harry have described their bewilderment when they encountered grieving crowds, on the day of their mothers funeral. Speaking to a bbc documentary marking 20 years since the death of Princess Diana they say walking behind her coffin had been a Family Decision. Heres our royal correspondent nicholas witchell. It was the week when a nation mourned, and the monarchy faced sharp criticism. At its heart were two boys, william and harry, then aged 15 and 12, grieving for the loss of their mother, but required by their royal position to appear in public and help assuage the publics sense of loss. In the bbc documentary, william and harry speak of the numbness and confusion they felt when they were told that their mother was dead. And in harrys case it is clear there is still anger at the french photographers who were pursuing dianas speeding car in the moments before the crash in the alma tunnel, in paris. I think one of the hardest things to come to terms with is the fact that the people who chased her into the tunnel were the same people who were taking photographs of her while she was dying in the back seat of the car. William and i know that. We have been told that from people that know that it was the case. She had quite a severe head injury, but she was still very much alive on the back seat. Those people who caused the accident, instead of helping, were taking photographs of her dying on the back seat. And then those photographs made their way back to news desks. William and harry were in balmoral when they heard the news in paris. They speak in support of their grandmother for her efforts to shield them and for their father. He tried to do his best for us, says harry. When they moved from balmoral to london, they encountered grieving crowds. And its clear that they found the experience bewildering, with so many people sobbing and wanting to touch them. Of the decision to walk behind their mothers coffin, both say it was a collective Family Decision and both say they felt a strong sense of duty even then. When you have something so traumatic as the death of your mother when you are 15, as, very sadly, many people have experienced, and no one wants to experience, it leaves you, you know, it will make or break you, and i wouldnt let it break me. I wanted her to be proud of the person i would become. I didnt want her worried, or her legacy to be that william or harry were completely and utterly devastated by it. And all of her hard work, love and energy she put into us when we were younger would go to waste. They were children coping with their own grief and the attention of a grieving nation, and who kept going to honour their mothers memory. Im joined now by our royal correspondent sarah campbell. So, sarah, other documentaries have been shown in the run up to the anniversary of dianas death. What will this one tell us that we havent already heard . Palace officials have said that this is the first and last time that the princes will speak in such great detail about the seven day period for her death until the funeral. That is what makes this one stand up. Stand out. They were in balmoral with the queen when diana died and william said that when he was told, he was completely numb and disorientated, he was dizzy. Harry referred to how their father helped both boys through it. Its important because in the build up to this we had not really heard about the role of Prince Charles but harry is clear, he said one of the most difficult things for a parent to do is to tell children that the other pa rent is to tell children that the other parent has died and Prince Charles was there for us, one of the two left and try to do his best to make sure that we were protected and looked after. At the time you will remember that there was a lot of bad feeling towards the queen over the decision to stay in balmoral, rather than coming straight back to london. On this, Prince William was clear that this was the right decision for them, the boys. He spoke of how their grandmother had tried to protect them, she took all of the newspapers away so they could not read the news. He said that thankfully, we had the privacy to mourn. We had no idea the reaction to her death would be so cute. We also said that the queen felt torn between being a grandmother of william and harry and, in her queen role. It is insight into the queens ta ke role. It is insight into the queens take on this. Other key contributors to the documentary, we had lady sarah mccorquodale, Princess Dianas eldest sister. She said that the queen did the right thing in those circumstances, tony blair said that the queen was resistant to anything that seemed false, more like a Public Relations event. Of course, these two young boys, these young princes, they had to deal with the publics grief as well and they speak on that . Yes, and they paint quite disturbing picture as to what it must have been like for them. Let us it must have been like for them. Let us not forget that Prince William was 15 and harry was only 12 years old. When they came down to london, meeting the crowds outside of kensington palace, he said that it was peculiar, unusual. He spoke of the wailing and crying and sobbing, the wailing and crying and sobbing, the breaking down. Harry said that they were in a state of shock, people were grabbing at them. He does not blame people for that but it was shocking for these two boys. Speaking of walking behind their mothers then, a lot has been said about whether they should have been put through that ordeal and they both interestingly say that it was a collective, Family Decision. Theresa may, this has just come in, has visited a factory in gilbert this morning, she was asked there about the governments position on the European Court of justice. Lets have a listen. What is absolutely clear, i made it clear in my speech and have make clear ever since, that when we leave the eu, we will be leaving the jurisdiction of the ecj. What we will be able to do is make our own laws and parliament will make our laws. Britishjudges will laws and parliament will make our laws. British judges will interpret those laws and it will be the British Supreme Court that will be the ultimate arbiter of those laws. We will take back control of our laws. And can you give a specific example of how this new arrangement will be working in terms of settling disputes . What we have today done is issue a paper which shows a number of ways where it will be possible to resolve disputes. What businesses wa nt to resolve disputes. What businesses want to know is that in future relationships, if a dispute arises, however will be how it will be possible to resolve it. We will put in place arrangements to ensure businesses have the confidence of knowing that they can continue to trade across the European Union. And if we end up with a version of the trade Association Courts resolving post brexit disputes, isnt it another version of what we have with jurisdiction in britain . There are a number of ways where it will be possible to deal with this kind of resolution in future, we want to show that we have thought about what it might be, and we will go into negotiations with the European Commission, to discuss what is the best way forward. What i am clear on is that we will be ending the jurisdiction of the European Court ofjustice in the uk. We will be making our laws and parliament will make our laws, british judges will interpret those laws, and from the British Supreme Court, we will be the arbiter of those laws. And a quick question on the Grenfell Tower, you met last night with some residents to discuss concerns, what solutions have you come up with to allay those concerns . Specifically regarding tenant management accommodation . It was a dignified and respectful meeting last night, obviously people had concerns that they were racing and i was pleased i was able to tell them, the Tenant Management Organisation is one of theissues Management Organisation is one of the issues that tenants have been concerned about. I could tell them that that organisation would no longer have responsibility for the lancaster longer have responsibility for the la ncaster west longer have responsibility for the lancaster west estate housing estate, that was met. People were pleased to hear that. And we were able to hear on specific issues that individuals had at the meeting. I have since spoken to the leader of the council, to raise the issues with her that were raised with me at the meeting. What i want to ensure is that the granville united residents and others locally are given the support that they need when felt united residents are given the support they need on this which has affected their lives. And what are you doing to make sure they get that money . We ensured at the beginning of this that a lump sum was available to individuals who had been affected. Other sums of money have since been made available to people. One of the issues which came out last night was about the charitable money which had been donated and ensuring that the system is working properly, to get it through to people and the Charities Commission and others have been involved in ensuring that is happening. Police in birmingham say that they have obtained what they called Landmark Court injunctions to break up Landmark Court injunctions to break up two criminal gang suspected of involvement in gun and drugs offences. Legal orders have been issued that restrict members movements and who they can mix with. We can now speak to our correspondent phil mackie who is outside West Midlands Police Headquarters in birmingham. Tell us about that background that led to Police Taking this court this course of action, and how easy did they think it would be to enforce these injunctions . This all began in 2015, when there was an upsurge in gun violence in and around birmingham. It is thought to bea around birmingham. It is thought to be a dispute between two rival gangs, the burger bar boys and johnson crew, and notorious gangs in this part of the world. They have been a problem in this city for the best pa rt been a problem in this city for the best part of 30 years. It led the West Midlands police and Birmingham City council to seek out these gang injunctions which became law in 2011, amended in 2014 to become tougher. They have pioneered their use in the city and today i was with Police Officers knocking on doors and handing over these injunctions to let family members know that these individuals, as you say, will have severe restrictions placed upon their movements. And people they associate with. In terms of how difficult they are to get, thats the problem. They were introduced a while back, originally by the Labour Government in 2009 and became law in 2011. It takes a long time of evidence gathering and a lot of Court Hearings to get to the point where they are able to issue these gang injunctions today. The plan isnt really. I do not think they are optimistic of turning these individuals away from gang crime but simply serving notice on them. Marking their cards to say, we know who you are and what you are doing. Effectively trying to disrupt gang activity. Interim orders were last year granted, and since then a large number of people have gone to prison. Fewer injunctions were issued to those in jail today, and thatis issued to those in jail today, and that is quite unusual. It is thought to be the first time that has happened as it will stop individuals mixing with other gang members in prison. We know it is a big problem inside of the prison population. The transport secretary, Chris Grayling says politicians in the north of england should find the solutions to regional transport problems, not Central Government. On the Withdrawal Agreement, how much influence will be ecj have on that never mind what happens post brexit than the actual Withdrawal Agreement . This is where theres a stand off, the proposals are seeing first of all of their disputes about the Withdrawal Agreement to negotiating committee which may be politicians and bureaucrats and whatever, diplomats sorting things out but the party could ultimately refer issues to the ecj. The uk has made pretty clear that doesnt regard things like eu Citizens Rights as enforceable through the ecj saying they can be enforced through the uk courts and the uk will observe the Withdrawal Agreement as it does all its other International Agreements. That is one point of dispute at the moment. We may end up with some other mechanism being proposed, something possibly ecj judges and Supreme Courtjudges come of it is people have been suggesting we could use an off the shelf solution that is available already which is a thing cold the efta court which some countries use as a way of monitoring the agreement. It is very corrugated and there are various institutional mechanisms. The important thing is to decide what the principles and design in the institutions to meet those principles and see what you can reach common ground. I think efta looks on the ecj as an adviser the court, so there would still be a line of influences of that was the model . I think the ecj is always going to be influential in interpreting law derived from the eu. If you look at the withdrawal bill that the government has published about how our courts interpret eu will have left, the icing they should have regard to further decisions by the ecj is sought is one thing seeing what the reasoning as an another thing saying ecj judgment stick direct effect of uk law which is seen as infringing on parliamentary solitary and people have objected to. Those are quite different. The efta court is designed to oversee an agreement whereby those economic area countries have signed up to observe eu rules. One of the questions for the future partnership is what actually is the relationship between the uk and the eu rules as they develop. Do they say they will still be observed or not . We dont know that, that is another part of the agreement that we havent seen. Let mejust put agreement that we havent seen. Let me just put the should not be any decisions by any new tribunal on the uk. That is the case it is a matter of detail not principle. That is an interesting point . Boss of wpp, sir martin sorrell, says that the firm has been hit by a digital disruption. The government insists its not necessary or appropriate for the European Court ofjustice to have directjurisdiction over the uk after brexit. A paper setting out proposals for resolving trade disputes after britain leaves the eu has been published time, but the question of how future agreements between the uk and the eu will be enforced is proving contentious. The European Commission wants the court in luxembourg to guarantee the rights of eu citizens in the uk after brexit and to oversee the Withdrawal Agreement. But theresa may has said ending european control over british courts is a red line. Ministers say they want a special partnership with the eu, but it is neither necessary nor appropriate for the ecj to police it. Within the last hour, the Prime Minister theresa may has outlined her thoughts on the future relationship between the uk and the European Court of justice. When we leave the European Union will will be leaving the jurisdiction of the European Court ofjustice. We will be able to make our own laws, parliament will make our own laws, parliament will make our laws. Britishjudges our own laws, parliament will make our laws. British judges will interpret those laws and it will be the British Supreme Court that will be the ultimate arbiter of those laws. We will take back control of our laws. Can you give a specific example of this new arrangement, and how it would work in terms of settling disputes . What we have today done is issue a paper which shows a number of ways where it will be possible to resolve disputes. Businesses will want to know in the future relationship, if a dispute arises, how will it be possible to resolve that . We are clear we will not have the jurisdiction of the European Court of justice not have the jurisdiction of the European Court ofjustice and will put in place arrangements to show that businesses have the confidence of knowing they can continue to trade across the European Union. Our Political Correspondent iain watson has been following developments from westminster this morning. Now that the paper has been published, what more can you tell us about the substance of it . This is the paper published moments ago. Effectively looking at the role of the ecj, after brexit. Quite clearly, what the government says it is doing is ending the direct jurisdiction of the ecj, they are clear about what it means, so decisions taken by the European Court ofjustice no longer automatically apply in britain and the court would have no right to strike out british Domestic Legislation as it does at the moment. The document makes it clear that the ecj may be having quite a bit of influence, depending on the kind of trade agreement that may strike the European Union in future. The government does not settle on a particular new mechanism or court for sorting out these disputes, if a new agreement is reached. Instead it comes up new agreement is reached. Instead it comes up with a range of precedence. Partly political, it points out that in each of existing cases, the ecj does not have a direct role in policing those agreements. Equally, they also suggest that if bits of these agreements could be looked at, they want to open a discussion with European Partners and, for example, you may not have heard of this and im no expert, but the moldova eu agreement would give the ecj the absolute right to interpret European Union legislation and would bind any dispute panel with that interpretation. There would still be a continued role for the ecj and whether government is clear in this document is that the ecj should have no say over enforcing the rows of eu residents living in the united kingdom. For a reaction to this, residents living in the united kingdom. Fora reaction to this, i am joined byjoe redmond, who is in for brexit and then well be joined by chuka umunna from the labour party, hoping for britain to remain in the eu. Ending direct jurisdiction of the ecj is something that you are in favour but with these future scenarios, there could still be a big influence . these future scenarios, there could still be a big influence . I do not ee, still be a big influence . I do not agree, the paper does not say that but it clearly says that once we leave in march 2019 or earlier, the ecj leave in march 2019 or earlier, the sq will leave in march 2019 or earlier, the ecj will no longer have jurisdiction in the uk but it will have jurisdiction over british People Living on the continent under european law. It goes on to say that if, for example, we have a trade agreement, we are offering them a Generous Free trade agreement and the most obvious model for resolving any disputes and that is to accept the World Trade Organisation disputes procedure, they have a procedure and an appeal procedure, and the eu accepts that portrayed with non eu countries at the moment. We would be willing to accept that if we get one for the eu. And chuka umunna, you were involved in this paper, there appears to be a role, if you are an Arbitration Panel sorting out to dispute, we cannot, that Arbitration Panel, cannot insist on its interpretation of eu law . I think there is something to be said for that. What i do ask of people to go back to is that promised that was made to you, when you voted to leave the eu. You were basically told european judges will no longer have influence on uk law which is wrong. Clearly, in this paper, it forces at least an account being taken of the European Court of justice in some of those scenarios which is materially different to what you were sold in the eu referendum. It points to a wider story over the summer, that so many of these stories, like the £150 million extra per week that would go into Public Services if we left the eu, they are impossible to deliver. If you pay a divorce bill for us to leave the eu, but want access to the single market, that seems to be the Government Policy Committee cannot bring that £350 million extra per week for our bring that £350 million extra per weekfor our nhs bring that £350 million extra per week for our nhs that people were promised. That eu referendum, where john and i were arguing, was a thing on hypotheticals but now we are beginning to have the hard facts which illustrate the brexit terms and the terms on which it was sold to your viewers are impossible to deliver. This is not true, this is for some foolish, these assertions. They are facts . They are not, this paper, like ones before it, there is no legal obligation for a divorce bill at all. I am strongly of the view that there should be no divorce payments. We will pay our contributions to the date of leaving, as the League Campaign always said we would and should, and this government is going to do that but on this paper it is clear that the ecjsjurisdiction, it ends the day that we leave the eu. It has a numberof day that we leave the eu. It has a number of models in there which help other people. In their different circumstances. But that is not going to be the british model. As i say, and trade, the british model is likely to be that we would accept World Trade Organisation jurisdiction as the eu does for dealing with other independent countries around the world. That is what we have been. That is what we would be doing if there was a no deal scenario. In terms of a deal scenario, why wouldnt we use the world trade. Why wouldnt we use the World Trade Organisation to resolve disputes under it . It would need registering at the World Trade Organisation, they are the superior body to the eu and rightly so, we are a member, the eu is a member. But this is not all that complicated, the wto rules exist. He wants us tojump off a complicated, the wto rules exist. He wants us to jump off a cliff and be governed by those rules. Dont lie about it. I do not buy the long and short of it, in this paper you were told at the referendum there would be no influence, no power and no account ta ken of be no influence, no power and no account taken of the decisions of europeanjudges. This account taken of the decisions of european judges. This paper flies account taken of the decisions of europeanjudges. This paper flies in the face of it and that is the hard fa ct. The face of it and that is the hard fact. Forgive me a moment before labours position, are you saying that influence, whether people were mis sold it or not, is it a good influence . Is it right the ecj should have a influence . Is that your position . Or do you wish that the Government Cut all ties with the ecj . | the Government Cut all ties with the ecj . I do the Government Cut all ties with the ecj . I do not want that, you need compromise. If you look at the European Nuclear agency, they govern the transportation of Nuclear Materials but they have an impact on Cancer Research and the use of medical isotopes, we are being yanked out of that because of theresa mays red line on the European Court of Justice Theresa mays red line on the European Court ofjustice having an influence and that relates to that agency. I do not think we should have that red line, if it is going to detrimentally affect the viewers cancer treatments, it is not sensible to me. There is give and ta ke sensible to me. There is give and take in this situation, and that is why i do not think there should be a red line. We could do these things perfectly well for ourselves as an independent country and will collaborate with the eu where they wish it and agree to it, it is best to have these International Agreements policed under International Law as there are bodies and procedures which do that which are independent. You cannot have a court of one country policing the decisions of another country. The document suggests that will end . Yes, of course. The debate continues. But how we go about brexit still proves hugely controversial and perhaps this relationship with the ecj is one of the most controversial issues of all. I am keeping an eye on the twitter feed of the eu chief negotiator, Michel Barnier, he has been active this week on twitter, and members of the European Parliament will have a say on the final deal as well. The big Sticking Point that they will have at the moment is, you are absolutely right. What you identified. The eu side saying that they want the final guarantor of the rights of eu citizens in the uk after brexit to be the European Court ofjustice after brexit to be the European Court of justice and after brexit to be the European Court ofjustice and today the uk has said, absolutely no way. As you put it, that will be a Sticking Point and we will see how big a Sticking Point it is next week, down the road in brussels. David davis and Michel Barnier will sit down for the next round of official brexit talks and one of the top items on this agenda is the rights of citizens and how they are guaranteed on both sides of the equation. In terms of looking farther forward to the governance, as they call it, of the governance, as they call it, of the overall deal, there are potentially areas for compromise here. What Michel Barnier said in his equivalent of the paper that he published months ago, is the idea that there should be a joint committee made up of people from the eu and the uk, with an independent chair who would meet to thrash out issues of disagreement, related to the final brexit deal. The committee would try and find a solution. If it could not do that, it would then refer it to the ecj. You can see one pa rt refer it to the ecj. You can see one part that the uk could agree to, followed up by a part that the uk could not agree to. The ecj being the final arbiter. We would have to wait and see how the talks there progress and the uk government agrees that at the end of this, the end product will be the end product ofa end product will be the end product of a negotiation between them and the eu side. Furthermore, they are only negotiating three elements of the withdrawal deal. The actual brexit deal which will get the uk out of the eu. The future trade deal is not on the table from the eu perspective yet but very soon, the leaders of the 27 remaining eu countries will have to Start Talking about their outline, their red lines, and their ideas, and their wish list for a future trade deal. Pa rt wish list for a future trade deal. Part of that will be what sort of dispute mechanism will be put in place. Over the next few months, we will all be keeping an eye on what eu leaders say about what kind of dispute mechanism they envisage in future. And briefly, if you would, looking more broadly at any precedent for relationships the eu has with other non eu countries in terms of the jurisdiction of courts and so one, what can that give us . What future model, vis a vis the uk, what may that with the uk look like . The first thing to say on that is what the uk has been doing in all of the so called future partnership papers. Finding examples where the eu lips with a bit of ambiguity or a case that the uk may have. To make it, in other words, as easy as possible for the eu side to say that we can sign up to something that looks like that because it has already been accepted in another case. The paper goes through a whole load of lists, including obscure ones like the Moldova Association agreement that iain watson referred to. Last night, i was looking at the eu to. Last night, i was looking at the eu canada trade deal which would go into force this year, it is 1600 pages long. When you do control and fon your pages long. When you do control and f on your keyboard, and you search for the European Court ofjustice, there is not a single mention of it in 1600 pages. In other words, canada is not subject to direct jurisdiction of the ecj but because canada is going to be trading inside of the eu, it will have to stick to rulings of the ecj in europe, if you get my point. So, a lot to think about and bearing in get my point. So, a lot to think aboutand bearing in mind we get my point. So, a lot to think about and bearing in mind we are still at the start of the article 50 and Brexit Process so we will be looking at this in more detailfor a lot longer adam, i think you are right. Speaking to a bbc documentary marking 20 years since the death of Princess Diana they say walking behind her coffin had been a Family Decision. Heres our royal correspondent nicholas witchell. It was the week when a nation mourned, and the monarchy faced sharp criticism. At its heart were two boys, william and harry, then aged 15 and 12, grieving for the loss of their mother, but required by their royal position to appear in public and help assuage the publics sense of loss. In the bbc documentary, william and harry speak of the numbness and confusion they felt when they were told that their mother was dead. And in harrys case it is clear there is still anger at the french photographers who were pursuing dianas speeding car in the moments before the crash in the alma tunnel, in paris. I think one of the hardest things to come to terms with is the fact that the people who chased her into the tunnel were the same people who were taking photographs of her while she was dying in the back seat of the car. William and i know that. We have been told that from people that know that it was the case. She had quite a severe head injury, but she was still very much alive on the back seat. Those people who caused the accident, instead of helping, were taking photographs of her dying on the back seat. And then those photographs made their way back to news desks. William and harry were in balmoral when they heard the news in paris. They speak in support of their grandmother for her efforts to shield them and for their father. He tried to do his best for us, says harry. When they moved from balmoral to london, they encountered grieving crowds. And its clear that they found the experience bewildering, with so many people sobbing and wanting to touch them. Of the decision to walk behind their mothers coffin, both say it was a collective Family Decision and both say they felt a strong sense of duty even then. When you have something so traumatic as the death of your mother when you are 15, as, very sadly, many people have experienced, and no one wants to experience, it leaves you, you know, it will make or break you, and i wouldnt let it break me. I wanted her to be proud of the person i would become. I didnt want her worried, or her legacy to be that william or harry were completely and utterly devastated by it. And all of her hard work, love and energy she put into us when we were younger would go to waste. Police in birmingham say theyve obtained what they call Landmark Court injunctions to break up two criminal gangs suspected of involvement in gun and drugs offences. Legal orders have been issued that restrict members movements, and who they can mix with. We looked at the background to the case and the complications surrounding the implementation of these injunctions. This all began in 2015, when there was an upsurge in gun violence. It was thought to be a dispute between two rival gangs, the burger bar boys and johnson crew, very well known, notorious gangs in this part of the world. They have been a problem in this city for the best part of 30 years. That led the West Midlands police and Birmingham City council to seek out these gang injunctions which became law in 2011, they were amended in 2014 to become tougher. They have already pioneered their use in this city. And so they were effectively served today. I was out with Police Officers who were knocking on doors, handing over these injunctions, just to let people know, or their family members know, that these individuals, as you say, will have severe restrictions placed on their movements and the people they associate with. In terms of how difficult they are to get, well, i think thats the problem. They were introduced some time back, originally by the Labour Government in 2009, they became law in 2011. But very few have ever been issued. It takes a long time of evidence gathering and a lot of Court Hearings to get to the point where they were able to issue these gang injunctions today. The plan isnt really. I dont think they are optimistic of turning these individuals away from gang crime, theyre simply serving notice on them. Marking their cards, really, to say, we know who you are and what you are up to. Effectively trying to disrupt their gang activity. Interim orders were granted last year, and since then, a large number of people have gone to prison. So these full injunctions were issued to those individuals injail today, and that is quite unusual. It is thought to be the first time that has happened because it will stop those individuals mixing with other gang members in prison, and we know that is a big problem inside the prison population. Transport secretary Chris Grayling says politicians in the north of england should find the solutions to its regional transport problems. Not Central Government. Writing in the Yorkshire Post, he said that the success of northern transport depends on the north itself. The article comes as Northern Leaders are meeting in leeds, calling for more money and commitment from Central Government to help them improve transport links in the region. Severalfamilies had to leave their homes, and there were more than 400 999 calls. Flights to and from city of derry airport have been cancelled and in two village, bridges collapsed. Our ireland correspondent chris page joins us now from belfast. This is mainly affecting the north west of ireland, more people affected, coming in from the coastguard . Last night, there were the worst thunderstorms we have had here for some time. A torrential downpour across Northern Ireland. To give you an idea of how intense that was, it was two thirds of the amount of rain we would expect for the month of august, that amount fell in 89 month of august, that amount fell in 8 9 hours. That was worse in the west of Northern Ireland, in londonderry and tyrone, and including derry city itself, roads turned into rivers. Firefighters rescued more than 90 people who were trapped in cars or in their houses. The coastguard were also involved, and they rescued more than 30 people. At one point, helicopters we re people. A busy night for emergency services, latest figures released to say that they received more than 400 999 calls, and at one point, the 999 number was receiving a call every 45 seconds. What is unclear and pretty controversial is what follows that in terms of the Withdrawal Agreement and the trading relationship between the uk and the eu. How is that going to be policed . How are disputes under that agreement going to be resolved . Will it bea agreement going to be resolved . Will it be a case that we no longer have the directjurisdiction of the ecj is it still has a very big influence, . Were under its jurisdiction in all but name. The government are throwing out in this papera government are throwing out in this paper a number of different scenarios for dealing with disputes all of which they say will not involve the directjurisdiction of the European Court ofjustice but if you look at them closely, some of them might involve a high degree of influence which will annoy some. Our social Affairs Correspondent alison holt has this exclusive interview. Rotherham in South Yorkshire is a town trying to emerge from the darkest of times. Its exactly three years since a report concluded that, over a decade, more than 1400 children were sexually exploited whilst the council and police looked the other way. Jayne senior was a key whistle blower who helped expose the scale of the abuse. Last august, after complaints by a number of abuse survivors, Rotherham Council put her under investigation. Speaking about it for the first time, she says its taken a huge toll. Here we are, nearly three years on, and i feel more vilified than some of the perpetrators in rotherham. That is how you feel at the moment, you feel vilified . Absolutely, yeah. Shes accused of making money from media appearances and sharing information inappropriately. But she only received details of the actual allegations last week after the bbc contacted the council. It devastates me. I do not receive money for doing interviews. I dont and have not done this for money. Somebody told them that i was earning a significant amount of money well, im not. Former detective Michael Fowler is on the Management Committee of the charity where jayne senior works. We have policies and procedures to deal with allegations. Theyve deliberately bypassed those, even when weve asked them to stop. It just seems as though, you know, they want to attackjaynes character and discredit the work shes done. As a whistle blower . As a whistle blower. In response, Rotherham Council says it has a duty to robustly and fairly consider complaints and that its appointed independent investigators. It also says it cant comment further. There have been some significant successes in the town, with major abusers being jailed, but there are also families who say its still a struggle to get the help they need. This is when she were only a few months old. Gemma roberts was first exploited whilst in a council run childrens home. Her foster parents claim, as an adult, plagued by the same abusers, it was still difficult for her to get police help. The perpetrators that had got gemma on drugs, lent her money, manipulating her, were coming to the door, threatening with guns. Police didnt come on two occasions, they came on one. She felt, like i felt, that she wasnt listened to. In february of this year, gemma died of a morphine overdose. Shed been waiting three weeks for the police to take her statement about being gang raped by her abusers. They were still there from the care system, still there until she died at 35, and they are still there now, out on the streets. South Yorkshire Police say they dont have details of the specific incidents and that they will work with her family. But gemmas death is a tragic reminder of the importance of learning from the past. Critics from fifty two countries were asked to list their ten favourite comedies, and the results were then combined. So what came in at number one .
