From post brexit trade talks with the eu if theres no progress byjune. Ten more days of difficult conditions are predicted for parts of yorkshire and the West Midlands hit by flooding. And this weekend, inter miami will take to the pitch for the first time. Well hear from co owner David Beckham. Its 5pm, our top story environmental campaigners are celebrating a notable victory after the court of appeal ruled unlawful the governments decision to give the go ahead to a third runway at Heathrow Airport. Thejudges said that ministers had not taken into account their International Climate change commitments. The government will not appeal, but Heathrow Airport has said it will challenge the judgment. Green campaigners have called on the government to cancel the project outright. But supporters of the runway say expansion is vital for britain to compete on the international stage. Our correspondent Roger Harrabin reports. Cheering. In the sleet and cold they massed outside the appeal court, hoping for a ruling that the government acted unlawfully by failing to take Climate Change into account when it approved the heathrow expansion. Thejudges ruling, when it came, was clear. The secretary of state acted unlawfully in failing to take into account the Paris Agreement on Climate Change when deciding to designate the Airports National policy statement in support of the expansion of Heathrow Airport. The government acted unlawfully. It triggered scenes ofjubilation outside. The government has been told its got to go away and think again. If they want to resurrect the project, they will have to do a full and proper appraisal against all the Climate Change impacts over the full lifetime of the project, and thats a pretty demanding assessment to do. I think its pretty unlikely that heathrow would scrape through that evaluation, but thats a matter for government. No more runways no runway expansion, nowhere, no way. But that hope may be premature. Since its opening in the 19505, heathrow has faced many setbacks to expansion, and normally it gets its own way in the end. We will be appealing to the Supreme Court. We think the Appeals Court got it wrong, however, at the same time, we will work with government on their review to make sure we can demonstrate that heathrow expansion is compatible with the paris accord on Climate Change. If the government does decide to reassess the third runway plan, itll have to show how expanding aviation, our most polluting form of transport, is compatible with meeting its own laws on cutting emissions. We have said we do want to see airport expansion but of course, critically, it has to match with our ambition, our commitment to be zero carbon by 2050. Those two things have to absolutely fit together. Theres no way we can tackle Climate Change allowing heathrow expansion to go ahead. I think this project is now dead. Borisjohnson, i think, knows that as well. This is a way in which Boris Johnson can get off the hook. Drop the thing now. Its not yet clear how the government will react to the ruling. The eyes of the world will be on this judgment because its ramifications are potentially huge. It suggests that, for every major Infrastructure Project planned by the government, there will have to be a clear demonstration that it fits with the governments own Climate Change laws. And that may often be a very difficult hurdle to cross. Roger harrabin, bbc news. In a moment well hear from vicki young in westminster and Charlotte Gallagher is in the village of harmondsworth, half of which would disappear under the third ru nway plans, but first theo leggett is at Heathrow Airport. The message from heathrow tonight that this is set back, but not defeat . Absolutely. The message from heathrow is really that this was a ruling on a technicality, that the bulk of the challenge against a third runway was actually thrown out by thejudges. And what the judges said was that the government had not taken full said was that the government had not ta ken full account of said was that the government had not taken full account of the Paris Agreement in its National Policy statement when they gave the approvalfor the third statement when they gave the approval for the third runway. At the same time heathrow is pursuing its own legal challenge, it wants to ta ke own legal challenge, it wants to take this issue to the Supreme Court and it is pick confident that once it gets there, it will actually win. And obviously it would be helpful to heathrow to have a full throated government backing, but that does not seem audible tonight . M government backing, but that does not seem audible tonight . It does seem rather lukewarm. The government itself has come out and said it wont appeal this ruling, and it hasnt said yet whether or not it will carry out a review of the National Policy statement and revise its own rationale for building of the extension to heathrow. The government doesnt seem to have gone into this wholeheartedly. But i was talking to the chief executive of heathrow earlier on today, and he said he reckons this is a winnable case, but it is a narrow point of law and that it should only delay the building of the third runway by six months or so. That said, when is him a hand on heart whether he felt the government was truly committed to the project, he dodged the question. Many thanks for that. Lets go to harmondsworth and speak with charlotte. They will be hoping this is wrong and that this is a nail in the coffin, if not the final one . They will indeed, because around half the homes in this village would have been bulldozed to make way for the third runway. And it is notjust homes of course, but a community that would have been destroyed essentially by these building works, the homes that would have been left would have been next to the runway. So all these planes taking off and landing at all hours of the day and some of the night. So there is relief but obviously people are feeling what happens next will this appeal be successful . Im joined now by one of the residents whose been affected by this. How did you feel when you heard the verdict this morning . What i felt was qualified elation. The government are now to make a decision as to whether or not this third runway will go ahead. We hope it doesnt go ahead, that it is quite elation. What has been like living in this village with the threat of the third runway . Your home wouldve been bulldozed, so what is that like . Runway . Your home wouldve been bulldozed, so what is that like . M means that i havent really been able to make modifications to the house that had been worthwhile because, i needed a new garage door for instance, which will cost me £12,000. I wont get that back if the houses bulldozed, so it wouldve beena the houses bulldozed, so it wouldve been a waste of money. One man said he felt worn down by the situation because its been going on for so long now . It has been going on for a very time. Even if the runway had been built in the 2000, wouldve it still affected this village substantially as far as Noise Pollution is concerned. Will you be salivating tonight, or is it too early . Probably a bit too early. We are glad people have taken the Environmental Issues into account, but it will be qualified. We want the government to say no third runway. And that is a feeling that ive heard from a lot of people here. One lady said the champagne would remain on ice until these plans were permanently grounded. Thank you very much for that, charlotte. It is interesting, i think part of the key through Expansion Team today is looking at the evidence, you might have been disappointed hearing the government will notjoin that appeal. Listening to the transport secretary asked several times over and overagain, secretary asked several times over and over again, does the government still back a third runway at heathrow . He did not answer that directly, but he did talk about supporting airport expansion more generally. The question is, should you read into that may be lukewarm response, the idea that the government is about to can the whole project . From senior sources have been speaking to, im not getting that impression. But they do have a problem because Boris Johnson, that impression. But they do have a problem because borisjohnson, the Prime Minister when he was london mayor, was very clear that he was against it, and set in very graphic terms that he would lie down in front of the bulldozers at heathrow to stop it going ahead. So quite tricky for him and the government to appeal against a decision. It risks him looking hypocritical to say he 110w him looking hypocritical to say he now wanted to go ahead. So it could well be that this reticence from the government is much more about that than about actually deciding to not go ahead with the project at all. But what they can do is to sit back to some extent, knowing heathrow will appeal the decision, see what the courts decide. This is back wholeheartedly by parliament a few yea rs wholeheartedly by parliament a few years ago so it can go ahead almost at arms length from the government. Two more patients have tested positive for coronavirus in england, bringing the number of cases across the uk to 15. They caught the virus while in italy and tenerife, and have been transferred to specialist nhs infection centres. The Royal Free Hospital in london, where one of two new patients with the coronavirus is being treated. They were infected with the virus while abroad in italy and tenerife. It brings the total number of cases here to 15. The Prime Minister insisted there was no need to panic. I think it is absolutely vital that people do feel reassured. The nhs is a fantastic service, weve made every possible preparation for any eventuality. If you are concerned about travelling abroad to an area thats affected, then the key thing is to look at the fco Foreign Office website for the advice. But across the channel, they are now expecting a crisis. The french president has visited a paris hospital where the second person there has died from the virus. The man, aged 60, had no known links to coronavirus hotspots, and the authorities are desperately trying to discover how he became infected. Translation we are facing a crisis, an epidemic that is coming. And some countries are already much more affected. We have to organise ourselves differently at each stage and face it as best we can. Italy has reported another increase in deaths today. The Authorities Say they have more than 400 infected people there, but scientists believe the true figure is likely to be nearer to 1,000. Further afield in iran, and other seven deaths have been reported in just 2a hours in a spread that appears to be accelerating. And the World Health Organisation has given this warning to countries across the globe. We are at a decisive point. This is your window of opportunity. If you act aggressively now, you can contain this virus. You can prevent people getting sick. You can save lives. Some new precautions are being put in place in saudi arabia, suspending access for foreign pilgrims to holy sites. But it is not clear whether the major hajj pilgrimage later this year will be affected. Injapan, the Prime Minister has called for all schools to close for several weeks from monday. And in the us in california, experts have said theyve seen the first case of unknown origin, suggesting the virus is spreading within the us. We are very, very ready for this, for anything. Whether its going to be a break out of larger proportions, or whether or not we are, you know, we are at that very low level. Scientists are working round the clock to understand this virus. There are concerns in china that some patients who have recovered are then testing positive for the coronavirus again. There is still much to know about how this infection will play out. Sophie hutchinson, bbc news. Well, a little earlier the Health Secretary matt hancock was asked about the Prime Ministers response to the coronavirus outbreak lets hear what he had to say. Well we have a very clear government system in government for how we are dealing with this crisis. I am updating cabinet, i obviously speak to the Prime Minister regularly on this question. And then, i am chairing a weekly cobra, which brings together the cross government response because many of the responses are outside of the department and i chair that weekly cross government cobra meeting. So we have the governance in place, we have a drumbeat of cobra meetings and meetings with the Prime Minister, and reporting into cabinet, which is how a government should function in order to deliver the very best decisions based on the science to keep people safe. Several uk employers have now started asking staff to work from home as a precaution against coronavirus. Workers who are ill are entitled to statutory sick pay, but the law says that if you stay away from work but arent sick, you may not get paid. So here to explain more about how the virus could affect you and your workplace is employment lawyer anne sammon. Thanks so much for coming on. Let us start with employers, what do they need to be careful of and what do they need to do in terms of duty of care . They need to make sure their employees are aware of the steps they need to take to keep themselves safe and other workers safe. What about these rules about if you tell someone not to come in or not . Employers have a range of discretion where they can say where you work from, in most cases. If an employer decides thats the best thing to do to protect its workforce, thats fine. The more tricky issue is to do around pay when someone cant come into the office and work. What do you do . Presumably you should pay them . If you as an employer are telling someone not to come into the building, you have an obligation to pay that person. It becomes more of a grey area when and individual decides to self isolate and has not been told by the employer that they cant come in. That is where the law is at the desk silent at the moment and that is where the risk people have of not getting paid. Lets look at the point of view from the employee, what do you need to think about . If you are an employee, you need to think about what you are doing to keep yourself safe and protect other people. You also need to think about information to disclose to the employer. If you been to one of the destinations on restricted companies, countries, you need to tell your employer youve done that. Some employees are talking about workplace riots, but some are in gay economyjobs where the they worry whether they will get paid at all gig economies, or whether they say they are not sick but theyve come from this destination. That is a problem because unfortunately they have no rights to pay even if they are sick with coronavirus, they have no right to pay at the moment. Even if they are self isolating without being sick . Absolutely, no right to pay. Is there anything people can do to protect themselves . Is there any assurance they can buy . There is insurance available on the market, but the problem is at this point in time if you are looking to purchase that, it would be at a high cost because of the risk of coronavirus. There is a certain place right now, but potentially if things got worse, then employers would have to look at going back to what they need to consider in terms of contingency planning, they might have to consider much more extensive efforts to get people to work from home . Absolutely. What weve been telling our clients as they need to start thinking about what steps they need to ta ke thinking about what steps they need to take so that they can work from home. Do they need laptops or logins . There are lots of sectors in the Labour Market working home. Huge potential headache. Its understood that one of the two new cases of coronavirus in the uk is linked to the closure of Burbage Primary School, in buxton in derbyshire. 0ur Health Correspondent Dominic Hughes joins us from there. What can you tell us . As you are saying, Burbage Primary School outside buxton has been closed all day. Parents received a message on a whatsapp group, about 350 pupils who attend this primary school, they receive that message late last night saying the school would be closed today and probably remain closed until monday morning, because it was going to undergo a deep clean. That is asa going to undergo a deep clean. That is as a result of one of the pupils here, their parents went on holiday to tenerife. The child did not go on holiday with the parents, as we understand, but the child did attend the school on monday and tuesday. They were capped off on wednesday, but when it became clear that the pa rent but when it became clear that the parent had tested positive for coronavirus, the school felt it was the right thing to do to close the school for a couple of days and undergo that deep clean. Then they would allow the pupils back on monday. They said they were not advised to do that by local Health Officials, they felt it was their own decision and it was the right thing to dojust own decision and it was the right thing to do just to make sure everybody was safe and secure it. Now we have spoken to one parent, matt barlow, who said he did have some anxieties. You know that the virus is going to travel. But this morning, we started to be a little concerned. You do think about, you know, the possibility of contracting the virus. My parents shouldve actually looked after our daughter this morning, but we decided not to to try and contain it to a certain degree. So the other development here from buxton today is that a local medical centre which is only a couple minutes drive away from where we are at the school has also been closed today while also undergoing a deep clea n. Today while also undergoing a deep clean. We assume that is because this person who fell ill attended that medical centre, so that too has been closed, but it will reopen tomorrow morning. But it shows how one case can develop in a small town like buxton and can have ramifications across the town, and weve seen those closures here today. Absolutely, dominic, thank you for bringing that to us. European and us stock markets have slumped heavily again, in reaction to the spread of coronavirus outside china. While the markets in shanghai and hong kong both closed higher, european markets are a sea of red with the ftse, as well as frankfurt, paris and milan, down by 3 or more in afternoon trading. The government says borisjohnson could walk away from eu trade talks if there is not a broad outline of a deal byjune. Ministers this morning published negotiating guidelines ahead of the first round of talks which begin on monday. The government wants a deal agreed by the end of the year. 0ur reality check correspondent, chris morris is here with me now. Where exactly does the government stand . Quite a key hour is upon us. What is the government want . At the moment it looks like we have all the ingredients of a row. This is like the uks negotiating position ago, now we have the eus one. Theres lots they can agree on but on some really key points, there are disagreements. 0ne really key points, there are disagreements. One of the key disagreements. One of the key disagreements is on competition for business. If you have no tariffs between the uk and the eu, how to ensure that one side doesnt get an unfair advantage over the other . It isa unfair advantage over the other . It is a level playing field. With the eu is saying, there are certain eu rules of the uk has to follow in order to ensure that level playing field. Weve heard before, and it has set out in detail, the uk simply is not prepared to accept that. Let us is not prepared to accept that. Let us have a listen to michael gove, who was speaking this morning in the house of commons. Geography is no reason to undermine democracy. To be clear, we will not be seeking to dynamically align with eu rules on eu term is governed by eu laws and eu institutions. The british people voted to take back control, to bring the power home, to have the rules governing this country made by those directly accountable to the people of this country and that is what we are delivering. So that is one big issue of disagreement. It really is quite fundamental because it is between the eus desire to protect the Single Market in the uks desire to reclaim sovereignty. But there are other areas of disagreement. 0ne reclaim sovereignty. But there are other areas of disagreement. One of them will be a difficult one, always emotional fisheries, a tiny part of the economy on both sides of the channel, but it means a lot. The eu is saying we want the same access we have now for our boats to your fishing waters and if they dont give that, they might not give access to their fish to sell the markets. The uk is not prepared to accept that. Would it involve the European Court of justice . Accept that. Would it involve the European Court ofjustice . The eu saysin European Court ofjustice . The eu says in certain circumstances yes, the uk says in all circumstances, no. Then Northern Ireland could still become an issue yet again. We thought it had been resolved with the withdrawal agreement, but different interpretations of what that agreement, which is legally binding mean, are emerging. We have had some response already from business to whats happening today, the cbi, confederation of british industry saying the most challenging areas will require flexibility from both sides. Flood hit communities are set to face further heavy rain and strong winds as a new storm is expected to make its way across the uk over the weekend. Another ten days of difficult conditions have been predicted for parts of wales, the midlands and Northern England. Phil mackie now reports from worcester. Phil . Not great news, another ten days of difficult conditions. We are all bracing ourselves for the next storm which is due tomorrow night into saturday morning with lots more rain. It depends very much where it falls, if it falls in the encouragement over the well skills, we could go for a repeat performance over the last two weeks with another surge coming down the river severn. It peaked here around lunchtime, it has gone down ever so slightly, but these have beaten the ones that we saw even in 2007. But it has been a story where more homes have been protected by defences that have been flooded in the 15 years since those record floods then. And today it has been a case ofjust carrying on where weve pretty much been for the last couple of weeks. The only severe Flood Warning still in place is ironbridge in shropshire, where the force of the river caused the temporary flood barriers to buckle, allowing water underneath. It still looks dramatic today, but its going down. Those railings were completely submerged yesterday. Its now critical, once we get to a certain level, we can get our team to look at the barrier, assess what damage has been done. We have got over 200 metres of barrier we can replace ready for the next weather front that could bring more rainfall through here. In shrewsbury, where they saw record levels earlier this week, the clear up has begun. The water has gone out now and itsjust a case of sanitising everything down, and getting everything in place. Once this is done, Everything Else is fully functional upstairs for us. So, yes, come on back into shrewsbury. But the peak is now moving south. Worcester is seeing the same record equalling levels it saw last week. Two years ago, they raised this road to make it flood proof, but the river level is so high they have had to close it to all traffic except for buses. Theres worcestershire county cricket club, that has been underwater for 60 days since the beginning of october. This is normally the busiest part of the city centre, and today its eerily quiet. The train arriving at Worcester Foregate street station shows the extent of flooding in the centre of the city. Although theyre used to it, businesses are having to cope with the fifth flood this winter. I have been here quite a few years, and to be fair this is the worst i have ever seen it. We are coping as best we can with it, but we have all our pumps working 2a hours a day, trying to keep the water down, and obviously hoping that as soon as it goes down well get straight back in, get it all cleaned out and bang, reopen again. The environment secretary is paying his first visit today since this flood began 12 days ago, amid growing criticism. People are telling me they would like someone like boris or George Eustice to come and visit the flooded areas, to smell the floodwater, to see the squalor and filth, to see the misery in their homes so that they can. They are feeling neglected right now, and they need a big boris cuddle. Its not just here in the West Midlands. More rain has caused flooding further north. The peak is still working its way down the river severn in worcestershire. Itll be at its highest later in the village of severn stoke, which has spent most of the past fortnight underwater. And that is the restaurant you saw in my package from the early side of the river, you can see the water being pumped out. They are hoping that assumes dust as soon as it goes down, they can get back in. Further along down the river is the cathedral and a place called the watergate there where they have marked Historic Heights of floods. They have two new signs commissions to go up after the water comes down. What we are waiting to see is how high they will go. Will they go higher than 1947 . The two absolute highest marks there are 1672 and 1770. It will be quite close to those as well. Not record you want to beat there. Thank you so much for the amazing pictures there, phil. As it does so, this will become storm jorge, bringing us some more damaging and severe gales as we had there saturday night into sunday. The other thing is they havent managed to put in the documentation. The necessary requirements to comply with Climate Change, so they should do both. They should rewrite the documents and get that in there. Are you as sanguine as weve heard from some quarters saying it was just a technicality, it will be fine . Its not a technicality. It will involve two swabs, one throat and one nasal. Once again, done without laura having to get out of the car at all. So the swabs are taken. They will then be safely packaged and taken off to be tested. Now laura, or whoever it is, is then free to go home, back into self isolation or to wherever they have been asked to go, while the test results are awaited. This facility is now going to be rolled out at other nhs sites right around the country. What happens in a mass outbreak . The nhs has detailed plans about a surge. All the cases at the moment are being sent to one of five specialist hospitals, but theres another 20 plus hospitals on standby to start taking patients if they see a rise in the numbers. They may have to cut back on some of the routine work and hip replacements to ensure that there is enough capacity and those hospitals to treat patients. But theres also a number of quite drastic powers available to the government if they wish to pursue. They could set up over 40 local resilience forums, that could in theory, start closing schools. They could curb public gatherings and stop people using public transport. Ministers and Health Officials also say people should not overreact. The Canary Islands minister of health has announced that 130 tourists will be able to leave a hotel which is in lockdown because of the coronavirus outbreak. Of about 700 guests staying in the hotel in tenerife, 130 arrived on monday and didnt come into contact with the four italian tourists who originally tested positive for the virus. Its not clear if any of those given permission to leave the hotel are from the uk. We can speak now to lara pennington, one of the guests under quarantine in the hotel. Whats your situation now . We feel we stand the pressures under the hotel from the authorities and feel that they now understand our needs in terms of remaining in our rooms. However, we still do not feel it is safe outside of our rooms and in the hotel itself. People are still Walking Around without masks. I would also question the efficacy of masks that are being worn and peoples capacity to hand wash in a way that will help to hand wash in a way that will help to contain the virus. Therefore, in my opinion, the strategy in place is still similar to that of the one that was used on the cruise ship which was deemed to be ineffective, and whilst me and my family are safely contained within our rooms, i cannot say the the same for the rest of the guests in the hotel.
