Yeah, when we were growing up, it was watch out for the cars on the street, and for the new kids it will be watch out for the drones in the sky. Thats the Good Samaritan of the day. Drones might be coming to a neighborhood near you. The federal Aviation Administration approved six drones to ramp up testing. In places like hawaii they are being used to collect crop data and gather vital environmental information through photography. Some worry that all of the excitement is drowning out calls of caution especially on the privacy and surveillance front. At least 30 states have pushed for drone restrictions, but to what extent to domestic drones need to be rained now, joining us is president and ceo for the association for unmanned Vehicle Systems international, the executive director of the American Civil Liberties union in hawaii, and a faculty member at the university of hawaiis Flight Training program. Ray, hawaii is no stranger to drone testing, and the new authorization means there will be more of it. But why now . Why are we seeing this interest in this big ramp up . I am not certain that ray can hear me. So mike, im going to direct that question to you. Why is there this sudden interest from coasttocoast in ramping up Drone Technology and these testing sites . Well, what has happened is Unmanned Aircraft systems are very good as a Delivery System and a Situational Awareness system. Any expension of eyes and ears, this allows them to do it in a much more effective, efficient and safe way. Lets get a word definition out of the way. Is there a preferred reference and why . The word drone has a negative connotation. But if you say an Unmanned Aircraft system, the key word is system. A thing that flies, a communication link, a ground station, but most important it has a human being, and is responsible and should be held accountable if anything goes wrong with the particular aircraft. Van any sa are you concerned that the development of these systems and military systems are linked . We have many concerns, and hawaii in particular is at a pivotal moment. Were at the beginning of an important conversation, and it is at this time, before we rush to experience the benefits of Unmanned Aerial Vehicles, and no one questions that there are many benefits to experience for hawaii, but there is no system of checks and balances in place, so now is the time to create and build thoets protection and safeguards for privacy, so hawaii and other states can enjoy the benefits. What safeguards are you looking at . Well, theres no policy in place right now. And all everyone can talk about are the benefits. And to be sure there are benefits when were talking about locating missing hikers, theres no question that there are benefits, but also lacking at the same time, and we cannot minimize the dangers and potential abuses when you have an Unmanned Aerial Vehicle that has the capability for example to carry facial recognition software, monitoring devices so that phone conversations can be picked up. The government has no policy, which is why it is important for states that are considering the use of such technology to have a wide and robust public debate so that we as a community can be aware of what were trading off, and theres no need to trade off our privacy and enjoy these benefits. A lot of people are saying aledged economic boom from Drone Technology, but does it come at the cost of our privacy . I dont think it does. I think there needs to be regulatory put in place that would govern this. And that is one of the things that is lacking, and i concur with that. But this an industry that wants to be regulated. They want the jobs and economic benefit that comes from utilizing this technology. So i think the key is going to be transparency. So anybody that uses this technology, one has to register it, and have a chip in it that says this belongs to va any sa or lisa i would like my own drone by the way. That way you could be held accountable for it. I would follow you along with it. Wonderful. We are talking about these testing sites that are existing now in at least six states. What is going on there, and where is the information going . Is it available to the public . For any unmanned system, safety is paramount. It is always come down to safety. And this is one of the things that we dont know. How much of a risk acceptance are we willing to take. I can tell you for a vehicle what the Risk Assessment is. So you accept that technology and the risk that it brings. We dont know what the acceptance is for a uas. How do you strike balance . What is important to remember is that not all of the stakeholders are present yet or their voices have been heard during this debate. Hawaii perhaps compared to many other states has a privacy provision in our state constitution. States are free to increase the level of protection for its people. In fact our state constitution when our founders were creating a separate Crystal Clear protection of privacy, it was against how the police could use wiretapping. Flash forward now to 2014, and again, every community is entitled to have a rebows debate about what data is going to be collected, who gets to use the technology, how long is the data going to be held, and are we now moving towards becoming more of a surveillance society, where days byly the government gets to troll and fish and look at the activities of mostly lawabiding folks in order to find the guilty few . I think when it comes down to you asking the ordinary person on the street and say hey, just open your front door and let the government surveil whatever they want or follow you around to all of your activities, do your appoints, to your doctor, where you are hanging out with friends i get that, van but were also talking about a budding commercial industry where a lot of these would be run by private corporations. Do you have those same concerns . Sure. These are universal concerns shared by the military, commercial and the private sector and private individuals. And what has been lacking in many communities is public input. And in the rush to experience this brood range of what all of us agree there are tremendous benefits to experience. What is lacking is safeguards. And we have an opportunity now before full implementation begins occurring to put those protection Privacy Protections now at the front end so that many communities can experience the benefits of this technology. Zach has a balanced approach. He says protections are important, but need to be weighed. And every community should be involved in a robust debate about this. Certainly in hawaii the aclu team here on the ground anticipates that we would also be able to bend the ear of our constructional delegation, so that any federal policies will take in to account hawaiis unique status as an island state in addition to addressing the universal concerns shared by many other states. Mike you con teb that people should be more concerned about their privacy. As was highlighted it is all about the storage, dissimilar nation, and collection of data. How you collect it is not that important. Whether you collect it from a cell phone, a computer, at a bank or something that is flying either manned or unmanned. Its still the collection of information that you are concerned about. So thats the debate we should have. Theres lots of fears as drones are becoming more normalized. And i want to go to you with this. Is there a problem with us normalizing drones . Well, i am always an optimist in that when you ask anyone are they willing to give up their right to privacy in order to enjoy some benefit, that most people will pause and give it real thought about what they are sacrificing. In this case we have an opportunity to put these safeguards in place now. At the beginning, and allow communities Privacy Protection so that the benefits can be enjoyed. So aclus intent on making our case before lawmakers, were confident as people become more aware of the risks and benefits that Government Policies will reflect a clear system that can protect personal privacy, a fundy mental right to many people. Are you afraid that this will hinder development. The technology is growing faster than the regulation. And faster than for example, the privacy issues, we need to deal with those up front. But i dont think it will hinder, its just a matter of actually marrying both of them to make sure that were doing our technology and our research in concert with preserving privacy issues. Depending on who you ask everyones reaction is different. I know folks in your circle are pretty excited. What are your colleagues the most excited about . For us in hawaii, its the precision agriculture. Its the perfect tool for us, because its not like iowa or kansas where the fields are very large. The fields are very small. And we have viruses, for example the banana virus, where even a helicopter cannot get into these fields, because they are way too small. So using a drone is the perfect tool for us to do research on agriculture with drops and management of invase if species. Vern just tweeted in that there needs to be a balance between regulation and innovation. And we have a great video comment from eddy. Im in favorite of a pilot certification process. Im also in favor of basic certification process. A competent operator with proper insurance should be enough to address any safety or Privacy Concerns. What should be the appropriate regulation for your industry . First of all let me say that the prediction is within the first ten years 80 of all uas operations will be for precipitation agriculture. And here is a circumstance that we have that if you anticipate what is going to happen in the world, they predict right now we have 7. 1 billion people in the world. Providing food and having precision agriculture will be a huge deal as we go forward. But as far as what we need to do so if you just went after the lowhanging fruit precision agriculture would be a market area where you could use this technology today. You understand in the fields where the people are, and you dont have a Privacy Concern because pineapples dont mind that you watch them. Ray is laughing, so i guess he agrees, and this would be an ideal situation. And if you had some insurance, and you could say make sure the pilot is qualified. The system is airworthy. You have an operational assessment a Safety Assessment that says i have a 20 by 20 field and theres no people in it, and i know where all of the power lines are, i could fly this thing 50 feet above the crop and not have an incident. And some way to identify the platform. And the last one would be all of the data has go to the faa. So someone has to collect all of this information. So if you are going to fly it commercially, you have to give the altitude, wind conditions just like a plain. Just like a plane. And that goes to the faa to be able to deal with regulatory issues. Processed it immediately. And gave it to their their planning departments, local municipalities, go, so that they could use it for their rebuilding efforts. And have they found it useful . What has been the reaction to it . They found it very useful. And also i came to found out there is an actual very ablebodied group of people that are working with drones, a company i have been working with over the past two tours here in the philippines. Were working on a smaller, expended class of drones, where we can deploy them readily and quickly. So you are out there, collecting presumably tara bites of information. How do you transmit that amount of data . Thats a good question. And a big bottleneck in a problem we have been trying to solve. You have to take these mosaics put them in the resolution, and get them into the cloud seamlessly. But were having to actually hand deliver it. That really hasnt been worked out. Thats one of our biggest bottlenecks. A lot of community feedback. All right. Mike im going to go to you with this. Were talking about the youth and the next generation. We were growing up the childhood books had storks dlifing babies. So maybe for kids nowadays it will be drones delivering babies. What should we be looking out for . Charles knows how to do search and rescue better than anybody else. What he needs is an extension of his eyes and ears that allow him to do it in a more efficient way. So you need these professionals that men and women that put their life at risk to protect us, and this allows them to do it more effectively and efficiently and in a much safer way. If you flew one of these before the disaster happens, and now you have the imagery, then one of the hardest things is you cant locate 32rd street because there is no 32nd street.
