The pier 740 master plan which eventually led to historic core, it resulted in those buildings being rehabilitated and rfp that resulted in brookfield taking over the waterfront site as our partner on that location and the next slide, built on to that process in 2013. Our planning and Environment Group developed a crane cove park plan. You can see here its very similar to what ultimately has been delivered on site which is very exciting. And the kneass building was not addressed with use it might serve. Building 49 was. Its in the center of the slide. We opened it would be used for water recreation and bicycle parking on site so were not sure if we need additional as well as a site and next slide. Please. There are eight goals that apply to the southern waterfront and weve pulled out throw in particular that we think really speaks to what might go i go ine buildings. Number two listed in the staff report has to do withens hancements water recreation and enhancement to the blue green way and doing something that enhances sort of the public experience and the various public locations they can visit and the southern waterfront and number throw was implementing pier 70 projects which includes the deliver row of parks and other public realm improvements that the public can enjoy and number eight was relating to Community Partnerships and Community Benefits for the southern waterfront and delivering more Community Benefits. Next slide, please. They set out the acceptable uses for each of the facilities. You can see here that building 49 was anticipated to have water recreational boating, to relate to the parks and open space to have accessory and other sorts of short interim uses and maritime industry, retail, general office, Community Facilities as well as interim uses. Thats the whole framework of what we have to work with in terms of previous Planning Efforts and our current draft waterfront plans. A successful rfp will support our Strategic Plan. Were evolving the waterfront anand engaging working with our Community Members to speak to their needs and we need to have projects that are equitable and accessible and attractive to a very Diverse Group of people who live, work, use, or visit our recreational assets. We need money to bring up with they can be used up and creating stability in the sport of our financial side and maintaining the harbor funds and ourselves as an organization. Next slide, please. So, were proposing to do an rfp on these sites. In order to do water recreation retail and food and beverage we need an rfp in order to do the competitive process required for retail leasing. Were proposing that we use the process thats in the waterfront plan. You may recall the general process is informational at at Port Commission to discuss the particular big values for this area and what are Community Values and minimum qualifications and what not that we want to see if an rfp and we go out to the community that those with them and come back to the Port Commission. So were proposing to use that same process which ill note in a subsequent slide in a little bit more detail. We do a process respond propose to one or both buildings and so both of the buildings and this is the just primarily theyre close to one another and we can do a and we think theres an opportunity that we may be able to get one tenant for both buildings and were very opening to having different tenants in the building and one is in a Poor Condition and it would require a lot of capital to bring it up to the useable condition. The other would needles capital potentially. Theres an opportunity to meet potential tenants in both of those categories. In terms of the minimum goals, what we are stating and were going to add on to that as we go through the process with you and the community, we think at the very least we need at least one food and beverage location. It could be very casual and want to serve the needs of park goers for sure. We also need to have one personal watercraft rental storage and sales facility and some sort of ann an aquatic cen. We want to see a Community Development or communityserving youth. A tenant that will provide a lot of co benefits for being on the park. Eyes on the park and bringing members of the community and into the facility and community the elsewhere and we this is the minimum goals of from the community and what other goals there should be. And the co benefits economic benefits so the desired economic and theyre seeking through this rfp process is First Investment in these buildings and the preliminary cost estimates of how much it would cost to rehab both of these buildings is 10 to 15 million and depending on the uses. Theres quite a range because theres the opportunity to add a seismic retro fit to building 49 which is on this slide and if one did that that would cost more money but would result in more occupancy in the building which you could dense fie uses inside of the building. To give you a little bit of perspective thats 500 to 700 per building square foot and its expensive and kneass is more of building 49 in terms of per square foot cost. The second key benefit wed like is a tenant who will be responsible for maintaining watch over the Public Restrooms in building 49 delivered by our engineering group. This is a really port arent maintenance responsibility that we think having tenant on site to do this would be a real benefit for us and would really help in operations of the park and the third goal is through participation at revenues or upside revenues, rental payments to the harbor fund. To pay for the use of those sites. So i talked earlier about what the draft waterfront plan anticipates in terms of an rfp process and what we did for the pier 48, 40 and 33 and 330. They were to come to the Port Commission with the beginning outlines of the rfp. We then went to the Southern Advisory Committee and at that time the swag in order to directly ask those groups to advise on the Community Values and diversity equity and inclusion goals for the rfps, we want an additional step for these two buildings because they are situated in this very public location. This great new park weve just delivered and its getting a lot of use. So were also proposing to outreach to youth oriented groups, elder groups, other at risk populations and communityserving organizations who may wish to occupy the kneass building to enhance our understooding of what we can deliver through this rfp that would be welcome and valued by the community. Next slide, please. So thats the end of the presentation. Our anticipated schedule, if you all direct, is to take this sort of a presentation, focus on the subarea goals and trying to get input on Community Values for the two buildings. Two are Southern Advisory Committee and we identify other groups so we can interface with virtually to also introduce them to the site and get their input in terms of Community Values. Were really excited to work on these buildings. Theyre small in comparison to the other rfps weve done but we think they can deliver that sort of other parts of the crane cove experience that people are now getting to enjoy as a park is open. I had the pleasure about a week ago to tour the park with randy and david duepray and it was a sight to be seen. It was incredible. Im so impressed with this project and how much it has to over. The South East End of our waterfront inside highly recommended part of the process for bidders to get maybe a more diverse pool of applicants to activate these buildings in the neighborhood its that we offer a site tour with davids commentary about the history of the parks about how intentional we were on design from ship build to the history of the waterfront and also maybe include the promotional videos that i saw featuring supervisor walton on president brandon and mayor breed. I think those bring a richness to the experience that could be beneficial for anyone bidding on the project and to make sure we can have the usual suspect thats can activate these buildings so i wanted to offer those few thoughts and i look forward to you bringing back a more polished set, a recommendation after the Community Process for the rfp and im excited to get these buildings activated. Thank you. Thank you for the reports. I think it was well positioned and i think the sensitivities of the project have been outlined and i echo commissioner gilmans conversation. I will go next week and i was looking forward and would suggest that a tour of the building is much as you can see them from the outside be included and i think that it sounds like i should ask for david buepray was my tour guide. I look forward to seeing how it herbs witmeshes with the neighb. In addition to the aquatics and the retail, do we see any of the Building Space used for office at all . I know what you want to see, but what else could we see putting in these buildings and since one of the buildings doesnt have a lot of public trust restrictions, so if you could comment a little bit more on that. Definitely, thank you, commissioner. We anticipate there will likely need to be at least some ancillary office use. The kneass building that is already built out, just to make the project financially feasible we think we will need the kick of those revenues in order to get that building to cross the feasibility threshold. So we do anticipate that that one would have some office space but were definitely open to any financial receivable projects that needs that acceptable use table that i showed. I also want to mention in addition to retail and aquatics were looking for a communityserving entity to take over we anticipate parts of the kneass building or it could be a greater part of building 49 to kind of have members of the public come and use the building and then have that kind of spill over effect into using the park. I actually have not seen the interior of these building and i dont know what shape they are to be able to see them. It looked like they have high ceilings and so there could be some interesting uses if you think about it and given that were all sensitive about internal space and how much air and ventilation and open space areas give the environment that were living in today it could be some creativity applied to whoever looks at these buildings in terms of the uses of the buildings. In addition to what you are looking for. I dont know if im correct assuming they have high ceilings. Building 49 has high ceilings and the kneass building is twostoreys and i wouldnt say theyre particularly high. They can definitely have the ventilation through i guess terrier air flow. There is no restriction. They overlook the park, correct . Is there going to be any restrictions if they want to open up the walls to have bigger windows or open doors into the park space . Go ahead question. I was just thinking that when we talked about ventilation. Ill be sure to consult with mark and others to make sure this secretary standards are met on the buildings and how many openings they could create if there are no openings there now. I hope that in this case, that would be an amenity to whoever is in the building to have a view on the park and from the use that uche given off they have calls closed so if you want to know, you can open up some of the walls there and both for light, ventilation and as well as view. I think you should check that out before you set up the rfp so whoever sets it out, knows that information in advance if there are any restrictions if there is one is Historic Preservations and one is already listed and the other could be listed. Ok. So rebeca. Which called we have committed to doing designs that are consistent with secretary standards and the kneass building has roll up doors and are on east face of the building and either roll up or barn like doors that could be redesigned to engage with the park in a more active way. That would be a very attractive part of the building if they are able to leap right out into the park area its right when the spark in its final phase which is great and weve been working forward to a long time and hopefully whatever i can say is the building in the coming weeks. Great. This is the phenomenal job its just so beautiful he is so knowledgeable and informative about all the history at the park and it is just a beautiful park so thank you involved to the creation and then this solicitation is exciting. I think we have covered most of the points for i for inclusion. Im happy were going out on a listening tour to and i hope we put an emphasis on communityserving uses. Because its has to be anna traction for families to bring tears to Community Groups and for residents from dogpatch, bayview, the entire city and to make it a draw because its such a beautiful destination so, i hope whatever were looking for is really focusing on serving those Community Needs in the park. So thank you general i ca gener. Can you give us a brief presentation of your timeline . Thank you for the comment and the question. I agree going to the park is really making me so proud to work at the port. I bet a lot people felt like that. We wanted on the southern advisory agenda in november. Were working with mark to see whether or not we can catch them in november. And if were able to we would come back to you in november if its a little bit late we would have to go to the december meeting so the issuance so were opening we can issue this calender year is it regardless of whether or not we hit the november or december Commission Meeting and so we issue the rfp and it goes through couple months review period before we bring a selection to you all so well be clear on the next staff report what were proposing in terms of the Selection Process and very interested in speaking with you more if there are things we should write now with this rfp or different terms we should take at this point to make sure that process is really smooth. I was told there was a meeting on october 21st. With all the other groups that you are reaching out to, do you think you are going to be able to do that by december . We hope so. Were really focused on talking about the Community Values and were hoping we can have that targeted conversation and bring back along in terms of issuesance of the rfp and the site tour is a wonderful idea for introducing a respondents to the building. So it will be out for maybe two months typically we leave the rfps out for six, eight, 10 weeks. Ok. Im just hoping that we can get the most Community Input that we can prior to coming back to us with a solicitation propose a im hoping that the Advisory Committee we also meet with these other organizations and get as much input as possible so that when we do print out the rfp everyone is on the same team. Good point and good advice. Hopefully this will go out early to mid next year. We will take our time and make sure we do all that work. Ok. Thank you. Next item, please. Clerk item 12a request approval of the operations agreement with dhl global forward granting dhh authority to operate its brisbane location drive site for a term of five years with one option to extend for four years and outlining conditions for the usage driven site this is resolution number 2047. Good afternoon, commissioners. Good afternoon, executive director forbes. Bran den from the maritime division. Here to request approval for a Foreign Trade zone operations agreement with dhl global forwarding. Next slide, please. I want to start with some background on the program. The relationship with the port of San Francisco as a grantee. Both pieces have interesting parts to it. So first the Foreign Trade zone program was established to the Foreign Trade zone act in 1934 as a tool to stimulate International Trade by providing incentives to u. S. Firms to keep jogs and economic activity, domestic here in the United States. A Foreign Trade zone or ftz, is a designated area that is considered to be outside of u. S. Commerce allowing for some benefits and cost savings around duties and tariffs for the private entities that get activation. Program is administered through the Foreign Trade zone board by grantees like the port of San Francisco. The ftz board and u. S. Customs are responsible for compliance and oversight of Foreign Trade zone operations which pa laws the grantees like the port to offer this public utility to all those that have been vet and approved by those two Government Agencies. Next slide, please. The port of San Francisco ha a long history of participation in the Foreign Trade zone program. The port was given grantee status as Foreign Trade zone number 3 in 1948 when it was the third essential tee to enter the program we only came after new york and new orleans. The Port Operations originated on port property within our very own historic finger pierce. Before it a apartment requestedd adapted to the changing times and it created when is known as the alternative site framework which allows for private companies to activate their own ftz sub zones on their own properties through the local grantee if theyre within the Grantee Service area. The port service area includes San Francisco and six additional bay area counties. The port currently has six ftz operators all of which are in one of the surrounding counties and thats one of the interesting pieces of the program is we have not six active Foreign Trade zones under the Foreign Trade zone number 3 but none of them are actually in San Francisco. Each operator pays the port an annual fee to cover the ports administrative costs. This fee is really meant to just cover administrative work done by the port as grantee and this public utility is accessible to all types of businesses. The port has no oversight responsibility on the actual Foreign Trade zone operations and is asked to treat it as a public utility. I would like to bring attention to the picture on this slide biff move forward. Which is an interesting glimpse of the past and present day. I have to give a photo credit to San Francisco pd marine unit who took this picture of pier 45 shed d from the water for me last week. For those who condition se canns a finger pier from the water and from the crop in large letters, its stated letters that state Foreign Trade zone number three and its an interesting piece of the history of Foreign Trade zone in San Francisco and if that with the live Foreign Trade zone and that was to participate in the Foreign Trade zone operations so nice piece of history on the water at one of our piers. Next slide, please. The applicant for Foreign Trade zone activate is dhl global 40. Which one of the words Largest Global companies with 380,000 employees across 220 countries. Interesting through this process, finding out that dhl founded in San Francisco in 1969. Dh will had a plied through the Foreign Trade zone number three grantee status to activate a brings bain warehouse location, brisbane, california, which is within our service area and they are very experienced Foreign Trade zone operator as an organization and they are 19 active Foreign Trade zone locations across the United States and it made the application process which started back in april very smooth from their end because theyre so experienced. And both the Foreign Trade zone board and u. S. Customs have approved for activation which is pending being approved by the Port Commission. Next slide, please. In closing the ports Foreign Trade zone is within the scope of the port Strategic Plan by sustained Economic Vitality in the region providing a public utility that supports local industry. Dhl brisbane location is within the port service area and they have received approval from the two bodies of oversight. Staff recommends approving the operation with the dhl allowing them to activate their facility as a Foreign Trade zone. Next slide. That concludes my presentation and im available for any questions. Its the day that our kids get back to the Serious Business of play, and so im thrilled to be here with our mayor, supervisor safai and our director of Public Health, and Many Community leaders and wonderful people to celebrate the reopening of playgrounds all across the city starting right now. We are here at mersed heights, so were not just opening up the gates to playgrounds but were also cutting ribbons on five amazing playgrounds that have just been waiting for children that have been renovated through the lets play s. F. Initiative, which is is an incredible partnership between the recreation and the Park Department and the Parks Alliance, San Francisco voters who support park bonds, and through lets play s. F. Were actually transforming 13 playgrounds that have been loved to death across our city and to creative places that spark imagination, connection, and Healthy Bodies and minds. So without further adieu it is my great pleasure to introduce our parks championinchief who has been a great nudge to make this happen. Thank you, mayor. Thank you. And thank you, phil, and thank you to all of the families in San Francisco for your understanding and your patience as we deal with a very, very challenging time, one that none of us could have ever predicted. And im so excited to be here at mersed heights because i know how hard this community worked to get this park to be a priority. For so many years i see mary harris over there shaking her head hard. For so many years, and a lot of the people in this community, they have been fighting to make sure that this part of town receives the support and the attention that it deserves. There are families here and there are generations of kids growing up in this neighborhood and in this community. And they deserved the opportunity to make sure that we rebuild the library, which your supervisor is pushing for. That we rebuild the parks and all of the other amenities that make life so great in San Francisco. And here we are, because ill tell you, supervisor, not too long ago i know that we came here, and we cut the ribbon or we broke the ground and this happened really fast. This is pretty amazing. And, you know, to make a park like this to happen, and it is absolutely beautiful it is so amazing. And i am so happy that today finally kids will be able to play in playgrounds all over San Francisco. This is amazing. And ill tell you that the reason why im so happy, because it is hard for children right now. You know, our private schools have opened and our Public Schools havent. Kids are not in school and theyre in front of a screen on a regular basis. And that is not good for them. We know that its not good for them. Its why i have been putting, of course, as much pressure as i can on the public to do our part to wear our masks and to wash our hands and to socially distance ourselves, and as much as we want to be around each other we have to make sacrifices for our children. So that they can go back to school, so they can play in playgrounds, so they can have a wellrounded life, because just imagine this is hard on us as adults. Just imagine how much harder it is on kids. How tough it is, and how we are seeing even now even though were providing devices and internet and other resources to kids, the achievement gap is still growing wide. So we have a lot of work to do. And thats why today is so amazing. And its so exciting. Because its not just that were opening up all of these playgrounds, we have renovated a number of playgrounds in San Francisco, and so kids are going to have an opportunity to just enjoy something new and exciting in the city. I am excited and im grateful to you, phil, and im grateful to the Parks Alliance and the lets play initiative and all of the friends of mersed heights, you will hear from some Community Members here today, because this work happened because of this community. This work happened because you had an incredible leader in supervisor safai. So with strong leadership, with Strong Community support, with collaboration and with years wait decades of advocacy, you have made something incredible happen for the kids of this community, for the kids who are part of this learning hub, who are hoping that this press conference is over as quick as possible so they can come and play in this playground. In fact, it wont bother me if they play on the playground during this conference, just let them have a good time. Because thats where we are now. And what this also does is that it gives us hope. It gives us hope that the time that weve spent in isolation, the time that we have spent, you know, doing what we needed to do during this pandemic, we know that theres a light at the end of the tunnel. We know that good things can happen if we all do our part. And so i really, really, really want to thank all of you so much for being here, so much for continuing to support our parks and the bonds that the voters have always voted to support because thats how this happens. And it is amazing, and its a beautiful day, and, supervisor, you should be so proud of what you have been able to accomplish for this community, unlike never before, and we are so grateful for your strong advocacy and leadership. And, ladies and gentlemen, i want to introduce the district 11 supervisor, supervisor safai. [applause] thank you, madam mayor. This day is super special. Ill just say that. When i first started working in this community, the mantra was, why are we always treated like the forgotten part of San Francisco . Why are we not getting our fair share . Why are the working people why are the hardworking people that get up and make this city run every day treated like this . And if you saw this playground, if you saw this fence, right, phil, it looked like a prison yard fence. It looked like something that you would never want to bring your family to. The same at mersed excuse me, allischalmers that is open today. And they used to ride by that to say look at how awful this park is, will you please give us money, because down the street was daily city and it was shining. But i can say with full confidence that this Community Fought hard, this community advocated and never gave up. I want to give a special shoutout to renard menro, working here tirelessly on a Little Island by himself, using every little resource he has, going into his own pockets often, to make sure that this community had something. I want to thank miss wilma gardner, she couldnt join us today and she lives right across the street there and said i want to see this park rebuilt before i die. Thats what she told me when i met her years ago. And im sorry that she couldnt be here today. Theres a lot of people that couldnt actually physically be here, but all of their blood, sweat and tears went into this. I want to thank Phil Ginsburg and his staff. They have made a commitment to ensuring that the neighborhoods that have the most children, like ours, under the age of 18 get their fair share. And all of their hardworking staff. And i want to especially thank miss mayor, madam, london breed, because every single thing now dont get jealous of the supervisors every single thing that i have brought to her to talk about this community she has said, yes. When we asked her for a new library, she said, yes. When we asked her for a new job center, she funded that and we opened that up a year ago to this day. When we said three years ago not recently but three years ago when we said that the African American community is hurting she said, asha, you dont need to tell me, i know. And i said were investing in this, and she said, yes. So this is one big step forward and i want to thank all of the people that have been involved in this, and all of the people that have dedicated themselves to this, and to all of the children and families that will enjoy this for many, many years to come. This is a new day in district 11, thank you very much. [applause] thank you, supervisor safai. The mayor and the supervisor, you know, eloquently articulated the importance of this moment. Playgrounds are happy, theyre joyous, but for children and their development and their social and Emotional Development and their ability to problem solve and the ability to take risks and the ability to share and to collaborate, this is really serious stuff to get kids back on our playgrounds again. I think that the mayor said it, that kids have taken it on the chin a little bit during this pandemic, lets be honest. And im grateful to the mayor and to supervisor safai and the community for screaming out on behalf of our children. We have to now do the right thing. Playgrounds are open. We need to keep our kids safe and our families safe. So, please yes, there are rules and there are capacity limits. There are we are supposed to continue to social distance and continue to wear a mask, right . Do not eat and drink in these spaces. Lets all do the right things so that our children and San Francisco families can be healthy. So the last point they want to make before bringing up our next speaker yes, thank you, mayor. Okay, do not if you are a parent, when you bring your kid to a playground, do not do this pay attention. No cellphone. Pay attention to where your kids are and how theyre engaging on these spaces. Again, the goal here is only to allow our kids to have the freedom to play and to do it in a healthy way. One last point which is that this should be a reminder as both the mayor and supervisor safai mentioned about the importance of investing in our parks. San francisco has the best park system in the United States of america. It is 150 years old. But we have to continue to invest in it, continue to nurture in it so we no longer have fences that look like jails and playgrounds that arent deserving of the children who use them. So i want to thank all San Francisco voters for supporting the 2012 clean and safe neighborhoods park fund, without which we would not be here today. Our most important partner in all of this are our friends at the department of Public Health who have as a tough a job as anybody right now in trying to figure out how to allow us to safely resume some sense of normalcy. And i am incredibly grateful to dr. Colfax and dr. Aragon and their team for working with us and truly understanding the importance and the urgency of opening up playgrounds. So dr. Colfax, the mic is yours. Well, thank you, director ginsburg, and really to acknowledge our gratitude to mayor breed, supervisors safai, director su, and mr. Robert ellis for their leadership in this work. You know that theres been so many challenging days during this pandemic. And so many sad days. And this is such a day of gratitude and beauty. Look out it here, and look at the kids playing. This is a Pivotal Moment as we Work Together to slow the spread of covid and realize that our children must go back to doing the things that we know that are important for their health and their familys health and the communities health. The reopening of the playgrounds is an opportunity to get our kids back something that we havent done since march, march. Incredible. We at the Health Department are so happy to be here as we have worked to get San Francisco to this place. To back to where kids can get in an environment where they can thrive, starting with school programs, Community Hubs, and elementary schools, stepbystep, and now playgrounds. We have made tremendous progress as a city. And we know that the sacrifice and the dedications of our families and our communities have made the contributions that have succeeded in slowing the spread of covid19 virus. And i thank you. We thank you. And we want all of our children all of our children to continue to enjoy the reopening of activities. And so parents, we need your help in ensuring that we open playgrounds as safely as possible. When visiting playgrounds, please be sure that your family follows the health and safety rules for playground visitors. Prepare your family for less children and for socially distanced fun. And i wouldnt be doing my job, you know what comes next, if i wouldnt remind people to, please, wear a face covering. They are required for all playground visitors, aged 2 and over. Please limit your stay to 30 minutes when other households are present, so that other people can also enjoy the playground. And, please, practice that good hygiene. And although playgrounds are outdoors, we still want to be cautious. We need everyones help in sustaining our gain and the progress that we have made. So lets have fun today. So were now going to hear from two important Community Members that have fought for children and for families in this neighborhood. Our first speaker, renard monroe, the executive director of youth first. Youve been amazing. Thank you for your partnership in our Community Hub program. I want to acknowledge executive director, dr. Mariea su, my partner in crime and all things kids and families. But, menard, you are running a Model Program and youre doing it for kids who really need the support. And were so grateful to you for your help in keeping these spaces safe and clean. Please come up and say a few words. [applause] good afternoon. This is a bittersweet moment for us as a community, because there are some people before menard who really put in some hard work to make sure that we have this space for the children and our community. And i need to acknowledge a few people who didnt make it to see this day. Our neighbor, she lived right there, her name was karen mccoy. [applause] she fought and she fought and she had phils number on speed dial trying to get this place renovated. She didnt make it to see it, she passed away and im thankful for her and her daughter, they both passed away. They fought for this park and im appreciative of that. And delores, who is also a resident fought for this park. And mary harris and al harris, okay, a lot of people put in wilma gardner, a lot of people have been fighting to make sure that this Community Gets what it needs. Im just happy to be part of the process and im thankful for today and im thankful for our mayor to allocate the funds and Phil Ginsburg, hes been awesome. Its been awesome. And i appreciate you. He comes out the first day they put this together and went down the slide with the kids and impressed the kids. Its just one of those things where San Francisco is supposed to be about community. And these type of events are so important, especially in a times that were living in and the covid19. I definitely want to thank our supervisor safai. [applause] for all of his hard work and pushing for our district to make sure that we can have spaces like this. Also i want to thank our community as a whole, first and foremost. Our residents right here, up and down the street. Using this park every day, and were so happy to have it back open, to have our kids back playing safely and in an environment, and something to be proud of. Im proud of our district. Im proud of where were going. Okay, we have organizations and c. B. O. S who are really making a push for this district to get the resources allocated here. And all of the things that we are doing just to make sure that the Community Gets what it needs and to make sure that children have a future. So, thank you. [applause] thank you, renard. Community Action Organization and a member of the friends of mersed heights playground, and to say a few words about the power of community when it comes to getting things done. And i want to thank our mayor breed for all of her dedication, all of her dedication to the city. And not only she is smart, but shes pretty. So thats a good thing. Like i say, i want to thank phil definitely if you stand here and you look around you can see the transformation of this park and the future is still bright. I have been on di dixie street r the last 50 years and i have seen the park deteriorate and now its like a Phoenix Rising from the sun. So you see that its bringing a whole new atmosphere to the community. Not only for the children, but also for the adults and for everybody in the community and the city. And im certainly glad to be a part of it and i want to apologize not apologize, but i want to give my regrets to miss james, the well documented partner was unable to be here today. Report on overall field operations, including greater alarm fires, emergency medical services, bureau of Fire Prevention and investigation, Homeland Security, and airport division. President covington good morning, chief nicholson. [inaudible]. As we know last week, october 7, its hard to believe its been a week, we lost a brother, a member of our Fire Department, jason cortez. So apologies to you that i am not my usual upbeat self today, but it is a somber time for us, as you know, we are also the department is, you know, mourning, grieving, in disbelief, and we are in the midst of arranging a Funeral Service and Memorial Service for our brother, and we are also in the midst of reaching out and helping the family and reaching out to our members who are the most impacted by this. [inaudible] it was an accident, and theres still more a little more to be done in terms of investigatory stuff and follow up, but from our initial investigation, that is what we have found. You know, and im really proud of this department and of everyone in it who has just kept moving forward and showing up to work and doing their job because they understand the importance of their work. And i also, unfortunately, have seen you know, this isnt the job that make suggest. Ive been here for our command staff, as many people can attest to. Right now, loike i said, we ar figuring out all the details for the services in the midst of the covid restrictions and restrictions that we have with the Current Health orders in the city. So, you know, its going to look different, the services, than services have in the past, and its going to be much smaller. And were not sure how many folks from outside of the family will actually be able to attend, so were working on that with the families, and we are working on prioritizing people within the department who are most directly impacted, those who were there with him today, those who were there with jason on wednesday, and those who prepared him in the aftermath, as well as, you know, he was a member of station 49 for eight years, and so he has a lot of history there, as well as being in the suppression side for five years. You know, i can say that Everything Else in my report today can wait for another two weeks, as we are focused on jasons wife, patty, sons jackson and grayson, his feathr bill, and stepmother nellie, his brothers at station 49 and members of station 7 who jumped right in there to assist with the horrific accident. And i just want to give a shout out, as well, to everyone who has stepped up to help logistics wise. They have stepped up big time to really start organizing and working with the union and some other scity agencies to get stuff done, as well as some folks on the funeral committee. Pat rabbit, ian christian, and jim oconnell, as well as local 7 798. Floyd rollins went out and picked up the family that day without hesitation. Got patty and the kids, and i know were all grateful for that. So like i said, the rest of my report does not can wait. It just doesnt seem that you know, that necessary right now. And so im sorry to bring down the whole meeting, but this is reality for us right now, and were just pulling together to get through this. So with that, i will conclude my report for today. President covington thank you very much, chief nicholson, and thank you for mentioning all of the people who are banding together to you know, to make sure that a member of the department and is given due respect and honor, and that everyone is taking care of the family. Ive also asked chief wyrsch to read the letter that was sent out from station 3. Chief wyrsch . May i just add one thing, president covington . Yes. Chief [inaudible] at the airport really stepped up and met the family met the family at the airport with the officers there, and he escorted them up to [inaudible] and literally escorted them all over town with the utmost respect. So thanks to him, and thanks to chief wong for handling all of the emotional plans at station 49. President covington yes. I also want to thank everybody everyone in the department who went to s. F. General right away to give a good salute on the way to the examiners office, so thank you, everybody, for being who you are. Chief wyrsch, are you deputy chief wyrsch madam president , id like to do that at the end of my report out of emotion, if thats okay. President covington that would be fine. Good morning, president covington, Vice President feinstein, commissioners, chief nicholson, this is my Operations Report for the month of september. [inaudible] are you seeing the whole screen or parts of screen . President covington whole screen. All right. Wonderful. The fire we had was at 173 shipley. This was chief reubensteins fire. 100 wood structure. It was an exposed roof and threestory lot line. With heavy smoke and fire, 3 was called immediately. When chief reubenstein arrived, he called another alarm for another station, and we called another station eventually, as well. Very aggressive, very proud of all the companies working. We also had 16 [inaudible] alarms during the month of september. I want to give a shoutout to everybody involved in the mutual aid. I wont get into the details because i know that chief velo has been [inaudible] and my hats off to everybody who worked so hard to backfill in the city. We also had two day rescues and cliff rescues in the city. There was a rescue at 30 otis, and similar recommending several companies, several individuals for citation involving someone who was trapped on a 300 feet crane, skyscraper crane, and the amount of effort and safety that was done, again, the [inaudible] we all recognize this day. Weve been telling people about it. Weve had a lot of rescues with cars over cliffs during the month. Al also, we celebrated september 11, remembrance day, a little different, something that we hope will never happen again. The divisional chief, chief fong, is here if you have any questions of him. We did a mutual aid to st st. Helena hospital. Again, my hat kazz off to the the hats off to the division. [inaudible] e. M. S. Has been a priority and functioning with the highest of [inaudible] the p. I. O. Report, id just like to give a shout out to Jonathan Baxter. Lieutenant baxter has been doing an incredible amount of interviews, keeping the public informed, and i want to thank him for that. He also i know this has been a concern the past months, but the Coastal Safety outreach, weve had some events, but were handing out information there. Fire marshall decoscio, he did a report through the fire marshal program, but he and his team have been working extremely hard to get this city open to businesses, open by having street closures, slow streets, were trying to figure out parklets, even though its not under our jurisdiction, to make sure that any excess be granted [inaudible] be taken care of, so thank you, fire marshal decoscio. The airPort Commission, f. D. C. Johnson has been working very hard over there. Always good to see them supporting the o. E. S. Firefighters, future firefighters coming into s. F. O. , and wonderful, them helping the family. The third [inaudible] again, Homeland Security [inaudible] and stepping in some big shoes and doing a great job. And josh smith has been helping her. All of our friends Michael Cochran is in rehab, as you know, but the phone is never far from him. We send our prayers. Art cisneros as instrumental in the [inaudible] and continuing with the help of that transition. We have our two new search k9s, cassie and jack, send over from Homeland Security. Id like to read a letter that station 3 has written. Members of the sffd, we wanted to take a moment to thank all of you who have been there for us as we deal with the loss of our brother, jason cortez. Those of you that showed up at sfgh, lined the procession to the medical examiners office, stepping in to fill in for regular members so they could go home and process what happened that day, and local 798, who had been exceedingly supportive, all of the space stations who had volunteered to cook for free, down to all of the individual members who have reached out to the station, and to the three members individually, we thank you for your sentiments, support, and effort. As we all know, theres more to come, and patty, jackson, grayson, bill, nellie, sonia, and greg will need support from all of us going forward. So please keep jasons family in your thoughts and prayers, and we thank you all for being there for us in this incredible trying time. Sincerely, captain cordero. Its amazing how close and tight they are, and [inaudible] every single day with reaching out to those involved, and staying together as a family, spending an incredible amount of time together. Its very important for everyone in the city to know how the members of the department pull together in times like this because it is a family. Deputy chief wyrsch absolutely. President covington so thank you. Are there any Public Comment [inaudible] when you do conduct these investigations, and we get the findings, are we, the commission, ever apprised of that or is there any accounting for the investigations that are done at different fires . Yes, once they finish the report, if theres any fire report that the commission is interested in or a company would like to see, we can forward that for you. Last time, i mentioned something about fires at homeless places, and i heard there was. Is there an increase when you decide theres arson going on or, yeah, is it intentional or is it an accident; if anything is changing . Deputy chief wyrsch so because of the encampment fires right now, we require the arson team to go out and inspect every single one, make sure it isnt foul play. A lot of the times, its cooking or those types of activities, so were extremely busy. Were trying to streamline report writing from them because any time they have to write an arson report, its extremely timeconsuming. Were trying to streamline that. That being said, in the past, we never reported that because they were uncommon. Now that we have one, an officer is called out with arson, as well. The fact that were tracking a whole lot better, but also, all of those are thoroughly investigated. Thank you. And then, i had other questions, but i guess they would be should i ask decoscio on it or later on . Deputy chief wyrsch sure, decoscio is on the line. On [inaudible] there was a reference to a speaker ordinance, and the line was blank. And then, there was that one, and i can ask you about the other two. Deputy chief wyrsch no, i know hes on here. No, i see him. Yes, good morning, chief. Can i ask where youre referencing . It was on page 25, where im looking at right now. Deputy chief wyrsch dan, that would be under your inspections completed in september 2020, three lines down, under sprinkler ordinance. Yes. What you have here is a list of all the inspections that we conduct, and theres a code for each inspection. When inspectors go out and conduct an inspection, they enter a code, and thats how we track the data. Sprinkler ordinance, its mostly to do with s. R. O. S. Its nothing new with the sprinkler ordinance. Yeah. It was back in 2000 or something. The other question i have is 2007, fire alarms open and closed. I probably should have asked this report, but there was in the report something about false fire alarms, something about how many times the Fire Department has to respond to them, alarms that are false, and obviously, in concerns with the budget and trying to address things like this, and then, it said open and closed, and what is that . Yes. Those are complaints that we receive, and if theres merit to it, we issue a violation on it until the condition is corrected. Theres a number of ways you can close its a complaint, and how we address the complaint. If its open, its ongoing, and if its closed, its been addressed. It can be a violation onsite or an administrative violation, which goes down to a hearing. So false aremalarms, what cs those . Most alarms dont issue and go into evacuation falsely where theyre not intended to. So most often, devices perform as they should, a Smoke Detector or heat detector, etc. It could be due to cooking, could be due to steam, etc. Its a false alarm that is not necessarily associated with a fire, but the fire alarm responded most of the time as it should, so i think we should clarify that. After three, if we have a system thats were repeatedly responding to our building, after the third one, we start charging the owner for that until we conduct a correct the condition. Sometimes, it may be new devices, etc. Theres a whole course of action that we can take, but after the third time, we start charging. Okay. And the last question, i have is all around the city, theres outdoor eating facilities all over the city, and after what happened in san jose, there was no eating permit. I assume every time you go to one of those to make sure that its up to whatever code it has to follow, thats because permits were taken out on those . Thats correct. So we work side by side with d. P. W. On this. They share the information on the permits they have issued, approximately 700 to date. We have the inspectors go out and inspect their commercial areas and take note of any items that need to be corrected. We have a running spreadsheet that we share with d. P. W. Twice a week, tuesdays and thursdays, with companies that we have inspected with violations that need to be corrected. So if there was a complaint, it would go i would lets say that someone went out there, and i lets say myself was saying, i wonder if they pulled the permit . Who would you check if there was a permit pulled out . So d. P. W. Is the lead agency on the permit, so they would have a list of all of the permits. I would like to add, when we do a survey, our District Supervisors have intimate knowledge of our districts, so if we find one, we notify d. P. W. Okay. President covington thank you, commissioner gonzales. I think well go to commissioner cleaveland. Commissioner cleaveland thank you, president covington. I was very shocked and saddened by the loss of jason cortez. This tragedy brings to mind how important each of our members of the Fire Department are to each other as well as to the department at large, so i just wanted to personally express my condolences to his family and to the personnel involved in this horrific accident and wish them a speedy recovery from this tragedy as best i can. I had a quick question, a couple of quick questions for our fire marshal. You mentioned a junior fire marshal program, and i just wanted to get a little more detail on just what that meant and whos involved. And the arson report that commissioner rodriguez brought up, i, too, have brought this up in the past, and once theyre available, that they can be presented to the Fire Commission so we can keep track of human arson incidents are happening track of how many arson incidents are happening. We never know whats happening with these fires in terms of the final result, so id like these shared with the Fire Commission on a regular basis. And my last question is what are the fees for these parklets . Is it based upon each parking space, and if so, what is the amount that restaurants and others are charged to utilize those public spaces . Chief decoscio . Yes, commissioner. Just unmuting here. Ill do this in reverse order, and if i leave something out, let me know. The fees, we, the Fire Department do not collect fees. This is something thats issued by d. P. W. We do, however, track our time and keep a list of hours that we spend on shared space, slow streets, etc. , everything to do with the covid Emergency Response to cities in its handling, so we do track all of them, but we do not charge. Commissioner cleaveland do you charge that expense back to d. P. W. . We do not. We do not. Commissioner cleaveland do you have any idea do you have any idea excuse me . Do you have any idea, chief decoscio, what td. P. W. Is charging for these Parking Spaces . I do not. Commissioner cleaveland okay. Please continue. Okay. The next question was. Arson, oh, arson investigation. We cannot once the arson investigation is complete and the report is completed, thats public information, so anybody can request that information. We have not had active reports where we issue a report to the commission on our findings, but we can do that. We are very active on our submission. Sometimes, we run into challenges where its an open investigation and issues where it could compromise the investigation. So can we try not to do that a have it out in public where its an open investigation. Happy to have private conversations, though, on an open investigation that is not ripe for public consumption, and so whatever direction the commission would like to go, were fine with that. Commissioner cleaveland would there be an easy way for you to share public reports that are a matter of Public Record . Is there an easy way for you to share those final reports with the commission and an easy adjustable format that you wouldnt have to put a lot of time into . We could. We could. It depends on how much detail youre looking for in those reports. Commissioner cleaveland go ahead. No, go ahead. Commissioner cleaveland its just in those reports, id love to hear what the causes are. Are these arsons . Are these random acts . Are they coordinated arsons . So just whats the impact on us from a cost standpoint, and things of that nature, and is it a big issue or is it a little issue . So i guess thats what im really trying to establish here. So arson, definition of that for Fire Investigation is basically its a fire that is purposely lit in a place where you should not light a fire. So as far as what was your intent to destroy we determine was it lit in a place that should not have been lit, and that would be categorized as incendiary. There has been an increase in homeless fires. We used to track them. We used to track them in special offsite fires. We created a separate category to track them, and therefore, if you look at past reports to current reports, it shows a dramatic increase, but again, those used to be lumped in with special outside fires. Weve looked at the causes of those fires, and if you look at the percentage of, like, incendiary fires, weve had more fires, and the rate of those that can be identified ad incendiary has been relatively consistent. So i dont know if that helps you in any way, but we can provide more details if you like. Commissioner cleaveland well, i think its important that if you discover that a fires been deliberately said, i guess that information gets shared with the Police Department or with the district attorneys office, and so the people that are responsible, they can be identified or prosecuted. I understand that most of the homeless fires are probably totally unexpected or whatever, that they werent done on purpose. But in cases of where fires are deliberately set, if we can identify a person or persons who did that, they should be prosecuted. So my question is, how do you do that, and do you pass that onto the d. A. S office, etc. You are correct. We are part of the Police Department. If we find that fire to be incendiary, they open up their own investigation and present that to the d. A. They create as much information as possible, share it with the d. A. D. A. , its up to them to take the next step if it warrants further action. Commissioner cleaveland do you know if we have any current arson cases pending at the d. A. S office . I do not have those numbers. I do not. I know the numbers basically with the p. D. , what files they have open, what cases they have open, but actually, cases with the d. A. , i can look into that for you. Commissioner cleaveland appreciate that. And last thing was the junior fire marshals program. John baxter, our p. I. O. , is involved in that, so he can speak to more detail of that. Commissioner cleaveland so this is a program that goes outside of your program. Absolutely. Commissioner cleaveland it goes to the general public and its kind of how to get involved in your department with a fire marshal. It sounds like a great program, and it would be nice for you to share those details with us at a future date. Thank you so much. Commissioner cleaveland these are all my questions. President covington thank you, commissioner cleaveland. Chief of the department nicholson . Thank you, president covington. If i just may, commissioner cleaveland, mark corso, who is our money guru, does apply for 75 reimbursement of all covid activity that we perform. It doesnt mean that we get reimbursed, but we apply for that. And in terms of what our fire [inaudible] is thinking about with shared spaces and the like, you know, initially, when things shutdown, you know, the fire marshal had left sections to do, etc. , but now, their work has ramped up even more because of shared spaces and all these types of things. So he and his crew are working overtime to get this stuff done. Theyre working at 150 , and also, we need to be mindful that we all need to get to the city right now and support all businesses. The city is waiving some of those fees because Small Businesses are really hurting, and we want them to get back on their feet for the benefit of these folks, the community, the city, the general fund, and all of that. So the shared spaces, i believe, permits are free until december 31, and we are working, as fire marshal decoscio said, with the ones with the [inaudible]. That means that the Fire Department has to step up, as well, and do a little extra work. So thank you, president covington. President covington thank you, chief. Lets see. I will go to commissioner nakajo. Commissioner nakajo thank you, madam president. I, as well as the other commissioners, wanted to send my deepest condolences to jason cortez family, to the members of station three, and the membership of the department. [inaudible] i have a couple of questions for you, chief wyrsch, and then, i have a question for chief tong and, again, fire marshal decascio. First question, lieutenant baxter won an award. Can you share that with us and with the public . Deputy chief wyrsch unfortunately, i dont have that with me, but i will make sure that you get a copy. I apologize. I should have included that in there, as well. Hes doing phenomenal work nonstop, around the clock. I speak with him many times a day. Hes been working tirelessly to keep the public informed and still continues to work on the programs that hes involved in. I should have included that, but i will make sure that gets included in the next report. Commissioner nakajo thank you very much, chief wyrsch. I usually look for it in the materials when i am present pr but thats the [inaudible] administratively, as well. My question next is to chief tong on her report, referencing page 17. Chief tong, you on . Yes. Good morning, commissioners. Commissioner nakajo on page 17, in the action of challenges, it talks about finding appropriate spaces [inaudible] with cognitive impairment, psychiatric illness is becoming difficult. It talks about the fact that hearing progress has slowed for conservatorship. In many cases, theyre being continued until 2021. My concern is [inaudible] backlog and few openings for placement and admissions is reserved for only the most acute and highrisk client. My question is with this backlog and few openings, how does that affect our services out of e. M. S. 6 or our paramedic core in terms of trying to deal with clients and cases out there in the field . Thank you, commissioner nakajo. [inaudible] chief andy tong of e. M. S. Chief simon pang i think will be able to answer that better next month in his report of e. M. S. 6. But they continue to go out and deal with the clientele that they are aware of. They just have to work with them that much harder, try to get them with the kinds of services, whether its placement in a safe site, you know, so that they can be better watched, you know, or if they refuse, then they just have to make additional contacts with them as much as they can. I think its been a challenge for, you know, just not only during covid, but also because those sites that people can, you know, be at or in terms of them being able to access the right kinds of Services Makes it much more difficult for them, and they just have to have more contact with these folks to make sure that they stay safe and they are getting the services that they can provide. Commissioner nakajo okay. Thank you very much, chief tong. My second question is [inaudible] at the bottom of the page, it talks about transports to, and i just wanted to get a verification of information that sometimes, according to this chart [inaudible] its 96 . [inaudible] bernal campus at 12. 72 , and the third was 8. 72. Is there a reason for st. Francis memorial to have that high of a commitment is there a reason for that to be so high to st. Francis and then to Mission Bernal . Generally, its the location of the patient. A lot of the more frequent users tend to be in the tenderloin area or the mission, so thats generally where theyll go if they dont have a hospital preference. They aju theyll just go to the closest facility. Commissioner nakajo okay. And is that the same in Bernal Heights or the mission . Thats correct. Commissioner nakajo okay. I didnt want to assume anything in the mission, with st. Francis being the closest facility. Thank you, chief tong. My next question would be for chief decascio. Thank you, chief, for all of your work. Part of this was answered by chief nicholson [inaudible] when it comes to parklets or shared space that the permits have to come out of d. P. W. And theres a whole set of regulations with that. Chief nicholson gave the answers that i thought there was a limitation to the certificates or permit, and the permits are currently being run until december 31. And then, theres a 25 ability of restaurants to take in some clients. Theres been some talk, even in my community, that those who build the parklets or shared space are talking about maintaining it through the winter, which is a whole different set of problems because of the Winter Weather and the rain. Some folks now are concerned with putting more money in the shared space parklet because of the longer period of time, and theyre talking about maintaining those parklets and outside shared space as they try to maintain their volume in the restaurant. I just want a comment from you, chief fire marshal, that have you heard the same things in terms of these shared space parklets going beyond the Expiration Date of december 31 and going farther beyond that . How does that affect our department . I know were in a shared state with the city. I know theres a wish that they want to maintain these park lets [inaudibl parklets. Could you give me a number of that, chief . I dont want to speculate. Yes, commissioner nakajo, thank you for that question. So the numbers that weve received from d. P. W. , the lead agency, and just so were all on the same page on this, d. P. W. Is the lead agency because these structures are out in the public rightofway. If it was on private property, d. P. W. Would not be the lead agency. So typically, on the sidewalk, its d. P. W. Anything in the middle of the street would be up to the parking spots. Its m. T. A. So we have identified approximately 700 permits issued by d. P. W. As far as this program evolving to more of a permanent status, i think well, two things. Number one, we have to ensure that we will have reasonable access to the building, to the structures, and a lot of these the ones were having problems with that we have identified ad urgent are those where its questionable where were going to have fees of access to ground ladder operations. So that is our focus right now. As far as this program evolving, i think the biggest concern would be are they expanding the structures . Are they putting roofs on them . Whats the height of them . Are they stringing them side by side the whole length of a block . These are things we havent really seen yet, and wed like to see you know, meet with d. P. W. And better understand, f if theyre going to expand the program, what kind of things looking forward as theyre building up these parking lots to a greater extent. Originally, the shared Spaces Program was intended for barricades, chairs, tables, and its evolved to platforms and vertical, and as you know, the winter is coming upon us. Thats all aour radar. Were having discussions, and our concern is Fire Department access. We will not compromise in our opinion or be allowed to sit by where we dont have access. It is on the radar with the expect of if the program is expanded, what does that look like and how [inaudible] does this program get, but right now, i dont have that. Commissioner nakajo thank you very much for that information, fire marshal. Again, ive seen varieties. Ive seen folks i dont know where they get them, but theyve used the Police Barricades barricade metals as a separation. They dont look very attract ti ti attractive, but some folks have done that. And then, i know in my area of town, japantown, the bureaucratic system is very tough. Ive seen folks use loading dock platforms, wood platforms, that theyve conducted and created and painted, but ive seen more fancy parklet shared space, now with their creations, and now, ive seen heater lamps, as well. And again, my question was i know we all want to support Small Businesses, but i want to make sure that [inaudible] thank you very much, fire marshal, chief decascio, and president covington. Zb. Commissioner nakajo, i can answer that. [inaudible] in social media, so ill read a short brief. Lieutenant Jonathan Baxter has served as Communication Affairs and Media Relations officer since 2016 and grew his position to a renowned facility [inaudible] he created surf and tsunami education Warning Program for the citys popular beaches. Baxter developed a Law Enforcement response to fires when he started the [inaudible] and in 2019, outreach efforts [inaudible]. I just wanted to take one moment, and i know we all feel the same way to different degrees, but just to express my personal heartfelt condolences to the cortez family. Its got to be the Worst Nightmare that any family can possibly imagine or deal with. Their lives will never be the same. I know those close to him will never be the same, and the department will never be the same. And, you know, i appreciate all the effort that is going in to honor him for his service and commemorate him in the appropriate and safeway, so just extend my deepest sympathies. I sort of feel a little bit, as you expressed, chief nicholson, i have my packet of material with its red tabs on it. And i do hate to let chief wyrsch offline [inaudible] maybe youll know the answer. Maybe you wont. Well see. Itll be a test, but i wanted to really, i thank commissioner nakajo. Im trying to find you on my stream here, but thank you. I had the exact same one issue that i dont want to postpone with the same issue you just brought up about the conservatorships, and im looking for chief tong. There you go. Theres chief tong. Knowing a little bit about the conservatorship proceedings from the probate division, i this is seeming a little bit backwards to me. It is in fact true, its a civil proceeding, and they have been pushed way into 2021. But just as, lets say, Domestic Violence restraining orders or those kinds of things have been moving ahead the whole time and have been dealt with timely, you know, we have in this city such stringent requirements, its shocking to me that anybody qualified but so much must be expended upon a single individual before the Public Guardian or Family Member or whomever is allowed to file. But it just seems contrary to my logic that with backed that, with backed up cases, there are more cases coming into the system. Im not asking you to address that now, but if you can, for our next meeting or if simon pang has any im not sure who would have the information. That may be something that the department would like to take a position on in terms of, you know, getting these folks the help they need. You know, to be conserved is you know, really, its for the sickest of the sick and those who need the most help, and id love to see us be as proactive as possible in terms of moving the cases along if theres anything we can do. So id make that request for the next meeting or when youre able to fulfill that request. Absolutely, Vice President. Well get on that. And we have robert lopez. President covington good morning. My name is robert lopez. Good morning to madam president covington. I met you years ago. I dont know if you remember me. President covington yes. Also, the commissioners, command staff [inaudible] c. D. 2 wyrsch, c. D. 3 [inaudible] its exactly a week ago firefighter cortez had the accident at 1007. I dont know why i landed on that, but i thought i should be sensitive. First time addressing the fire commissi commission. A little nervous, so please bear with me. Mariano elias, our president , could not present today. Hes in a class. I work at 911, and i did receive the call for jason when it first came in. It was partisan in the units, the response, so when i just im a little sensitive right now. Los bomberos formed in 1980. It was to have more inclusion for the latino and hispanic members in fact Fire Department. Our organization is based on recruitment, promotion, and detention. We have approximately 100 paying members. We work closely with chief baraca. During covid, its kind of difficult. Were doing at least a class that was spear headed years ago by now Homeland Security a. D. C. Erica [inaudible] she actually started that, and c. D. 3 at the time, velo assisted that with us, to. In the listos class, its like nert. Were doing this online now, and its something new. Took a class actually taught a class two weeks ago online. Its totally different than being there present. What we do is we help the Latino Hispanic Community to assist the Fire Department in any natural disasters. Earthquakes, fires, any floods, and its simple, what we do. We teach simple first aid. We also teach them how to turnoff the gas, use fire extinguishers, mitigate hazards, and we help them in emergency preparedness, how to set themselves up three to fife days if they cant get any help. The class has been successful thanks to erica [inaudible]. She came to us, los bomberos, and we took it over with that. We teach the class because we love helping the community. I grew up in the inner mission, and i speak fluent spanish, and so do a lot of other members, too. We also assist in bilanguaingu translation. We have an introduction class that teaches fire science to kids, and also, our members are talking to Unified School District for scholarships. We train with equipment that w was we go to nicaragua and train with equipment that was donated to the community. We assist in career day and helped toy program. We have a latin santa, and every year, we go to schools or whatever jill assists with. We have a latin santa, and hopefully, we can do that this year. I think it would be something that the kids would enjoy. In short, we all have a in short, were Just Alliance between the Fire Department and Spanish Speaking community. Thats what we do, at the end. I wanted to, before you tuturn over to the other commissioners, ask you to talk about the kind of assistance that youve received from the department as a whole, particularly with regards to the outreach of the los bomberos in nicaragua. What we do is we take turnouts, chain saws, anything that they can give us, we ship to nicaragua and assist. Without them, we wouldnt have this nicaragua trip. We had recognition from nicaragua and other trips. Nicara nicaragua, i was born in nicaragua. Its one of the poorest nations in central america, lower. Besides equipment, we take clothes and help the community. Its a camaraderie when youre a firefighter. When you go to another country. They look at you as youre brothers. It doesnt matter and sisters. So its you know, we have a relationship thats like no other. We actually helped with we had people come up from mexico. We have a storage shelter, and we donate to them. Without them, yeah, our nicaragua trip would not be possible. President covington thank you for adding that. I will go to my fellow commissioners, beginning with commissioner rodriguez. Commissioner rodriguez thank you. So congratulations on los bomberos. I was born here. I am a first generation, but my father was born in texas, and my mother was born in puerto rico. Growing up, every latin i saw on t. V. Was a bandit. To see groups and like you said, its important to note that anybody is invited to join, but its nice to see where young adults or young kids can see programs that they can identify with for their future, so i wanted to commend you on that. They said something there about recruitment. Let me back up one more step first. I was in the trades for 37 years, and we used to go to job fairs, to high schools, to colleges to show them what we had to offer, so a lot of times when kids were getting out of school, they would have different avenues, and they could see by example that they could something that they could go into. So when you say recruitment, does that include that or is that recruitment in your department . Well, recruitment in the department, we try to educate people who want to be firefighters, what we do in general. A lot of times, we do it through the carnivale and chief roberts. My first merit badge as a boy scout was a firefighter merit badge, and that was station 7 in 1983. I went back. So i ended up [inaudible] in college sorry about that. I dont know whats going on. I apologize here. Going to college, when i i didnt know what i was doing. I wish i would have been with the Fire Department before i was 30, but going to my question, kids want to join the Fire Department. I have been part of writing volunteers who assist us, and packaging of the Fire Department that goes to nicaragua, and i will well, many of us do, and i have wrote several letters of recommendation, trying to get a Fire Department. So we recruit through the Fire Department, through chief barraca, and through the Mission High School program because many kids dont know they have another avenue, that they can join the Fire Department. Los listos has offered me opportunities, parents say, for my son or daughter. How can they join . So i give them information, and i sit with them, and i meet them personally. I tell them what they have to do right out of programs, e. M. T. , programs that they have to have, t. M. T. Mariano does the same. I know the Vice President left a message with us, the same. So we all get together and try to get more latino, hispanic firefighters in the department. So this is why we started it, essentially, to assist with the community. I hope i answered your questions. Commissioner rodriguez no, you did very well. Thank you for helping the community and thank you for the work that you do. President covington thank you, commissioner rodriguez. I think its one of the oldest firefighter groups, created in 1980, and its certainly been one of the most effective. Really, a model group, so i just wanted to commend you and every group of the los bomberos. Keep up the good work. What youre doing is representing the department and the city on an international basis in the best possible light. Thank you for the hours and the volunteering that you put into the program. Thank you [inaudible] this is something thats near and dear to our hearts. Were trying to get youth off the streets, and it makes me feel that we have to give back to the community, and this is a perfect way to assist. [inaudible] and didnt have much direction, particularly not through any fault of my mother, but my father passed away when i was very, very young, but enforcement, being a role model, and now being a senior, i know the gaps between myself and my generational [inaudible] so what i describe as the youngbloods, men and women that are coming up, and how much they need to know our history and our traditions. So i just wanted to thank you for that. I also am saddened because i know that you had a spanish class that folks were sponsoring. I know that that instructor was, i believe, laid off or dismissed from that program, so thats the reason that spanish class is no longer existing. Is that correct, lieutenant lopez . Yes, its no longer active. We tried to continue it, but [inaudible]. Commissioner nakajo i understand, and we had the pleasure of meeting that instructor, and how dynamic he was, as well. A person of color, speaking a secondary language. I know how important it is for our memory kberz bers to go ou community. If you had the ability to speak mandarin or spanish or tagalog, how important it is to give members of the community the relief that that help is there. So i applaud you for your effort. Please continue your work to be associated with the department and also with your work with los bomberos. Congratulations to your membership, and thank you. Thank you. One thing that just becomes more and more clear, i am, too, a native san franciscan is our Department Needs to look like our community and be part of our communities. And toward that in, showing young people what their work could be like and what their life could be like and stressing the importance of the work is really an important function. I dont know how you get all of this equipment around down to nicaragua, but i commend you for it, and i did not know the department was donating the equipment. Ive learned a lot there today. And, you know, my hat is off to the department for doing that, and los bomberos for the work that theyre doing, seeking the diversity at this time. Again, im sorry for your loss, and know that were, to the extent whatever commissioners can do, you know, were were here to support you and the organization and the members of your organization. I appreciate that, and im sure that the members of the department and los bomberos really appreciate your being here and sharing a lot of the good things that people in the department do and that our member who passed away last week was an active member of los bomberos . Yes. President covington so it is fitting for you to be here. We we i mean, we donated a big chunk to the cause, you know, moneywise. Were trying to assist the family in any way that we can. Actually, when it hit happen, it hit hard at 1007, when i started speaking. Im sorry. President covington no apology needed for that. I was at 911 when the call came in. I contacted c. D. 1, chief nicholson, immediately when it happened, and then, of course, the rest is just history. So it hits us hard, but itll hit us hard with any firefighter, god forbid, that it happens. Im listening to the first Commission Meeting first time, and what it entails. Now i know, you know, and thank you for having me. Im not a i like to talk one by one person. Public speaking person is not what i do, but its the best that i can do. President covington well i wanted to echo what everyone else said about the organization. Its very important for people to share your story. You know, you didnt come into the department until you were 30. So a lot of people may think that oh, you know, you have to be fresh out of high school or fresh out of college to be considered for the department, so youre a good example, a very good example of all of the things that are possible in the world. You know, that there are so many paths that people can take to be successful in their lives, to be selfsufficient in their lives, to be admired in their careers. So people can look to you and say oh, okay. I can see light. So thank you. And the listos class, youre trying to do that remotely . Yes, we are doing that remotely. President covington one of the great things about the listos class is the food . Well, one of the great things about the community is they bring their food own. President covington thats what i know. We have a big meal, and it looks like its back at the fire house. There are Specialty Food because not only do we have people from nicaragua, latin america, mexico, but other places. It makes it fun, and it grows. There are not just firefighters, but there are others that joined us. You know, we had 50 people [inaudible] and were teaching the class. Of course we dont have the food, but at things progress, you know, next year, hopefully, get better and bigger. I always take a negative with a positive, so some negative comes, out of bad comes good, right . So were having 50 people in this class now. Can you imagine, another 56 . Our class is usually only 15 to 20, maybe. This gets around, this zoom that were taking, were doing, next year, everybody is going to know about these classes, and the classes are going to be much bigger. President covington wonderful. Yeah. These zoom classes could reach out to so many people, and eventually, itll reach out back to us next year by now were having classes in person. So well have probably, hopefully, an auditorium of people teaching. We teach it at the d. O. C. The department assists us with everything. Id like to thank a. D. C. Erica [inaudible] she spearheaded this years ago. C. D. 3 velo at that time was chief of training, and he played a big role. [inaudible] losing you. President covington okay. And even when we go back to whatever the new normal will be, the Classes Online would still be helpful because a lot of people with small children are able to attend from home. And of course roberto brings his heart to every presentation that he makes, and i gave him the highest praise for his teaching style and for his connection with the Community Members as he participates himself in those programs, so thank you for the opportunity to speak about it. Mark corso to present on the next item, which is a grant from fem onto purchase four replacement mini pumpers. This is [inaudible] what are mini pumpers . Refer to the deputies for more detailed explanation, but in general, theyre a smaller firefighter apparatus, smaller than a fire engine, more like the chassis of a pick up truck with equipment on there used to access smaller areas that a truck or engine may not be easily accessible to, like a wildfire sponsor areas in the city that we do not have access to. We have four, but they are quite old, so we were allocated funding from fema to do so. We are very fortunate that we are allocated this funding. Happy to answer any questions. Theres a small matching requirement that we will be absorbing in our budget. Im happy to answer any questions, but before i do that, i know theres been requests of for our new grant writer, shilo, to be present at the meetings. So im going to give her an opportunity to introduce herself. I want to thank president covington. She sat on our Interview Panel last fall in december, november of last year. We were able to hire shilo. She started in january of this year, and then, everything got flipped upside down with covid, obviously. But shes been a great asset to the department. Shes done a great job since shes been here. Obviously, the fundraising grants, those programs themselves have shifted dramatically through covid. I think a lot of the dynamic of the industry has changed quite a bit, but weve been very successful recently on some grants, and shes continuing to look at exploring, you know, Funding Sources that we really havent kind of tried to attempt in the past. So shes been a great assess and will continue to do work. But i wanted to give her a few minutes to introduce herself and answer any questions that the commission may have. Shilo . Thank you, mr. Corso. My name is shilo caho. Mark, i think, gave a great introduction. I have nothing more to say about myself im just kidding. Im very appreciative to have the opportunity to join the department, and as mark said, i started in january. Ive been learning about the department, about the [inaudible] diverse work that the programs and services that are provided to the community of San Francisco. As a native san franciscan, i dont think i was completely aware of all the Wonderful Services and programs that are provided, so im extremely appreciative of the work thats being done and also the opportunity to be here to support that work in any way that i can. In my time that ive been here, which has been very short, i have just been working under marks wonderful direct and guidance to really maintain the current docket of public funding that has already been established, to maintain that and strengthen that, and also to develop new relationships with communities, family, and corporate communications, and strengthen or expand any relationships that may have been cultivated in the past. But really trying to establish relationships with the department and not with specific people so that those relationships can continue throughout the future for the department. That grant money is usually there, but if you dont go after it, you dont get it, right . Exactly. This is something on the very cutting edge of electrical technology, Energy Storage and our goal to get rid of Carbon Emissions and slow down the deterioration of our environment with greenhouse gases. Its taking valencia garden apartments, tying in a large amount of Energy Storage battery devices that will tie in with the existing solar panels that cover most of the entire property. So more often than not, obviously the solar panels are going to be collecting sun throughout the day, but typically, if you dont have anywhere for the energy to go, its not used or goes back into the grid. The sun will be harnessed and stored in the battery devices. I have to say that the project sponsor has gone above and beyond working with the community, working with the trades to make sure this is a hugely successful and safe project for all of those in the neighborhood and city. I sent the commission an email for general Public Comment on monday and the point of that email was the two sets of photos that i sent, one from 2015 and one from 2020, shows why section 317 b2b and 2c which are the demo calcs in the code should be adjusted by the commission. These two examples are not unique to the problem. The 2015 photo is used in the 2016 staff training manual, but theyre two different noe valley projects. The intent of the three subsections of 317 is not to have more hearings. But to preserve housing. To allow reasonable alterations or expansions, bedroom or two, larger kitchen with a deck. Not to be a project that is demo, or de facto demo. The way to preserve housing is to preserve it and the rationale to adjust the demo calcs is to make them more true to the intent, more in line with the intent, by adjusting them. Because preserving housing, existing housing, is preserving more Affordable Housing. As first proposed in 2007, the calcs were more stringent. The ability to adjust the calcs allows the commission to do a fix if they were uneffective in reducing alterations. And the fact that there was a project in 2020 that looks just like a project from the 2016 training manual, and frankly, even more of that 2020 project has been demoed since i sent you the photos on monday. I was up there this morning looking at it. Shows why the commission should use their planning code powers and adjust. Since i have more time ill add this. The 2020 project, which im going to assume is a spec project, had a udu that was in the web ads and was touted as a discreet unit. There was a breezeway to the rear of the building, but the udu was not approved. And the 2015 project which was a speculative project, also had a breezeway that could have allowed for another unit behind the garage. Plus, now you dont have the garage requirement. The project would result in a total of 4 dwelling units in the building. In order to proceed, the Commission Must grant conditional use authorization to allow the dwelling unit in the ground floor. And to grant a modification to the required ground floor commercial use requirements under planning code section 145. 4. The department has received one letter in opposition stating that they feel that this is not suitable as a residence and should be returned to active commercial use at this location. The project sponsor has conducted outreach to the cultural District Organization and has stated they have their support. Further, for your information, the project is located within 300 feet of a place of entertainment and is subject to review under chapter 116 of the administrative code. Entertainment Commission Staff says a hearing is not required, but noise conditions will apply and is included in the conditions of this c. U. The Department Finds that the project is on balance consistent with the area plan and objectives and policies of the general plan. Also, it results although it results in a loss of commercial space, it has been occupied by a residential tenant for at least a decade. And allowing the legalization will add housing to the city housing stock. The Department Also finds the project to be necessary, desirable and compatible and not to be detrimental to persons or adjacent properties in the vicinity. Commissioners, i have two corrections to the staff report and the draft motion. On page 9, at the end of the general plan findings, on the third line, it reads although the project would remove a small scale retail use, the overall condition of the mixed use Zoning District would be affected by this conversion and it should read would not be affected by this conversion. On page 10, a correction to the planning code section 101, findings under f for seismic and safety in an earthquake, the first line should be struck because there is no structural or seismic upgrades at this time, although the proposed change of use will not impact the propertys ability to withstand an earthquake. Theyre descendants of the original owner of this property. This is a family ownership. The property manager who is with me today and available is a member of the family as well, though not one of the owners. She knows this property inside and out, everyone in the building, knows everyone in the immediate neighborhood. This building and others nearby have had the same residents and businesses for many years and as ive come to learn, is its own micro community. Turning to the facts of our application, as ms. Durandet described, the property is located in the 24th Mission Neighborhood commercial transit Zoning District. Planning code section 249. 59b provides that the quattro is intended to preserve the character of the latino cultural district. The application before you seeks to legalize a long time residential use. Therefore it would preserve the prevailing nature. Section 3 provides for the c. U. To be approved, the proposed use must be necessary, desirable for and compatible with the neighborhood or community. Well show how this is the case. The subject building, as you can see, two stories with a mix of residential and commercial uses. You see the subject unit outlined and then turning the lower photo shows the bryant street facade. There are three rent controlled units upstairs that have been occupied for over 15 years. The space next to the subject unit had a tenant with his own Small Business in the space who was there for over 50 years, until he recently passed. This will be a fully commercial unit and was found by the Planning Department to not qualify as an unauthorized dwelling unit. The bathroom and kitchen will be removed. The subject unit is approximately 850 square feet. This has been used in residential for many decades, perhaps since the buildings original construction. The Property Owner had no idea that a conditional use was required for this residential use. That was a change in the code, not a change in the use. They had no way of knowing about. This is commonplace in the city. The existing tenants of this unit are a family that have been displaced because of this process, but intend to move back in. Before this family moved into the unit in 2013, another family with one child lived there for ten years before that. They moved to another property managed by these same people. We know that sprinkling will be required to legalize the unit which will be an important upgrade to the unit and the building. The rent will not be increased when the tenants return. The father is the manager of the Small Convenience store shown at the corner, also located in the building. They have three children. At times theyve taken in two nephews of theirs who lost their father and his sister in the Mission District fire 12 years ago. We know there have been complaints filed concerning this property. Were happy to answer any questions you have about them. This is a large and older property, so things come up. I can tell you that they are most of the time found to have no merit or were just an oversight that is easily abated. At no time has the Property Owner or manager ever done anything intentionally unlawful at this property. Theyre responsive. Id like to conclude by addressing the 303 findings. This ground residential unit is necessary and desirable for the neighborhood because small affordable family occupied units are rare and highly desired and this allows the current occupants to remain in their home. It is appropriate given the control. This is an immigrant family with a residential and Business Opportunity that the city has made clear as a matter of policy it very much wants to promote. You have before you a request to are conditional use authorization to permit the demolition of the existing 2story singlefamily dwelling and the constucks of a new 4story building and a 40x height and bulk district. Its located at the rear of the lot with only 7 feet separating it and it is set back 83 feet from the front lot line. The ground floor of existing building measuring approximately 784 square feet was previously used as a child care facility. The project sponsor has indicated that the child care facility is no longer in operation when the previous owner purchased the property in 2008 and the ground floor has since been used as Storage Space with no connection between the two floors. The proposed new building includes the fivebedroom unit on the upper three floors measuring 5287 square feet. And a twobedroom unit on the ground floor measuring approximately 1,266 square feet. The project includes 1,191 square feet of private open space in the rear yard for the lower unit and 550 square feet of private open space on second and third floor roof tear aiszings terraces for the upper unit. The project proposes the removal of a privately owned tree at the front of the property for which a tree removal permit from the Department Public works has not yet issued. Commissioners, since the publication of the staff report, the department has received one letter in support of proposed project. The department has found that the project is on balance consistent with the directives and policies of the plan. Although the project results in the demolition of an older unit, it does propose increase in the dwelling units which will maximize the density on the site. The Department Also finds that the project to be necessary, desirable and compatible with the surrounding neighborhoods and not detrimental to those in the community. First, ill read a letter from the owners who cannot be in the room with me because theyre out of town right now. Dear commissioners, my wife marina and i bought the cottage at 1868 greenwich back in september, 2008. Im an engineer living in the bay area is very important for myself and business. I have two sons and motherinlaw. For the time being, my wife is taking care of my motherinlaw in los angeles. Im traveling on a weekly basis between San Francisco and los angeles. This creates a lot of pressure for all of us. Obviously, a small twobedroom house is not appropriate to move my family permanently to San Francisco. Thats why we prefer to have a new house to accommodate us. As part of it, we would like to have one separate unit on the ground floor for renting. So you can see here on the first page, the existing site plan where you can see the the existing cottage in the back. Greenwich street on the right side of the drawing. When they purchased 1868 with the intent of building a larger home, first advised them to retain the existing cottage which is located in the required setback. But after discussing the project with the Planning Department, we realized that we would have to keep a 35foot open space between the existing cottage and the new structure in the front of the lot. Which would result in a very weird open space between the two. The open space between the adjacent east and west fourstory property walls, the existing cottage and possible fourstory building in the front, did not seem like a good solution. It quickly became evident that the best solution would be to demolish the existing cottage to bring the property back to planning code requirements and build a new building which would improve the space and be a Better Solutions for all adjacent neighbors. They can confirm that the existing cottage did not have any historical value and we proceeded with the design of a new fourstory 36 quai des orfevres a larger fivebedroom unit for their family. Next slide. So we worked with the Planning Department and the neighbors and did our best to address concerns. We hope you will support this project and grant us conditional use to demolish the existing cottage in order to allow us to build a new twounit building according to the planning code. I spent ten years as a principal of june jordan high school, where we spent a strong track record of positive outcomes of black and latinx students and students with special needs. Ive led campaigns to get people released from i. C. E. Detention and help families facing eviction. If we Work Together, this crisis actually gives us the opportunity to strengthen our Public Schools and make them the center piece of a San Francisco that truly reflects the progressive values this city stands for. I am a public schoolteacher in east oakland. I love being a teacher and fighting every day to make sure my students progress toward their goals. My perspective as a teacher is important because it allows me to understand how to balance the needs of students, teachers, and family. This is something that i believe the school board needs more of. Historically, our School District has struggled to be the best version of itself. We continue to see achievement gaps between rich and poor, and between our white students and students of color. The emergence of the coronavirus pandemic has exacerbated these gaps and made solutions more crucial. Tax laws are important, but they wont address the issues that our struggling families are facing in realtime right now. Our most vulnerable families need things like equitable access to the internet, meals, and our teachers need Innovative Solutions and training making schools work. I want our students to feel value, to have a high quality education and leave our schools with confidence. Our School District is in a massive crisis. We face a budget shortfall and we are trying to educate students in the middle of a pandemic, and our systems at every level havent been set up to support families. The reality is that even before the pandemic, our schools havent worked for the record lots much our students. We need to elect leaders who can lead through this crisis and address these issues. I will lead with urgency and compassion, with integrity and commitment. I have revenue ideas that are innovative and will ensure that we are spending our money on items that have the most impact on students.
