Finding and the general plan. It is true, though, the intent of the finding was to get to a point where we are having a better geographic spread of these uses throughout the city. The finding itself does cover a lot of topic areas. It kind of should be split into multiple findings. The truth is when we look geographically at the city, the eastern neighborhoods, particularly the mission are overconcentrated. So while we do find that theres particular location and where its locating is not exacerbating an overconcentration on a microlevel, we need to address in the finding that at a macrolevel the city does have a concentration in the eastern neighborhoods. So it is a bit of a finding. Is that overconcentration reason to turn it down . Or is that a statistic you would use for additional regulation Going Forward . Its a policy the city is tr. I believe the City Controllers Office is going to be releasing a report soon that will go a little bit deeper into this. The finding itself only says the planning which i guess commission should consider the geographic distribution of the uses in the city. Its not prescriptive on how you should respond to that. The business doing business as redemption. The project includes interior alterations to the ground floor and no work on the second floor which is occupied by a professional service use. The project site is located at the intersection of 19th street and is a twostory industrial building. A request for discretionary review was on july 25, 2019 by kevin of the cultural action network. That discretionary review application which includes his concerns and proposed alternative it is is attached in your staff report packet as well as a response from the discretionary review response from the project sponsor. To date the permit has received eight letters of support for the project as well as a letter of opposition to the project in support of the dr. The departments recommendation is for the approval of the project as the proposed arcade, general entertainment use and restaurant use are principally permitted within the umu zoning district. Okay. So i have asked to recuse myself from this item when you continued it, because it was a lastminute request, and i didnt want to be the person we had such few commissioners. But i need to disclose that the requester and i work together. I do not feel like that relationship will in any way influence my fair hearing of this item or my vote. So im going to participate. Im a San Francisco native born and raised in the Mission District. I filed a discretionary review for 3252 19th street for a multitude of reasons. The first reason is joey the cat has been illegally using the space for over five years. The timeline dates the amount of time that he has actually used his space unpermitted for private event tech parties even after notice of enforcement in 2018. So he was the timeline shows he had a meeting in 2014 to actually have a meeting to change the use and then he withdrew the meeting. After that point in time, he was given a notice of enforcement in 2018, july 26 from the Planning Department to knock it off, stop it, you are not allowed to host private event parties here. At which point in time hes had multiple events stating he is the host of private event parties including an alcohol permit he requested from abc to have a private event party. So that was in march 2019 of this year. So this is not im a small little Business Owner, he has been breaking code even after he was told no knock it off, multiple times for the last five years. That is not a goodfaith actor. If you look at where the review below, in the multiple, you see he requested one alcohol permit afterwards but the yelp reviews showcase he has been hosting private event parties further along down the way and including having a chance to throw a private event party with children involved. So you talk about this being a familyfriendly space but hes had alcohol around all of that and we dont know how many parties hes had. So i would ask the commission to ask joey how many onrecord, how many parties hes had with alcohol and after the notice of enforcement. That would be my first request. Second being i want to shift the narrative very quickly, no one is going i work with High School Use on a daytoday basis and i think having a Family Friendly arcade place is awesome. If you look at the pictures, that is not what the use is being used for. Its hosted for private event tech parties that are for uber, lyft, airbnb and the average rental is 25 00. If he is able to get approved with a license that would restrict the hours of operation where he would be able to have alcohol. Thats not a familyfriendly space. We dont need another mission bowl where monday through friday you are not allowed to have children in the space. And its great you brought like ive seen the pictures of nuns and having these folks come in and they are going to bring the kids. I want a Family Friendly space. I dont want another bar. We have 389 alcohol permits in the Mission District. A special use district is being ignored and within the process of changing and fixing the loophole right now. So i would urge the condition to take that into consideration. And regardless if you approve this i would ask that you limit the hours of operation to make sure this is not a night life destination coming in because of the fact that this comes in i want to see hes turned time and time again that he has been asking for alcohol permits without it. I dont think hes responsible enough as an owner to have an alcohol permit if hes going to be hosting private event parties. What is the impact going to be when it cops to traffic . You need 24 7 access for pg e around those areas as well as the Fire Department across the street. So we dont know about the actual traffic impacts and i think a study should be put in place with that. So, yeah. Also urban mixed use and the current use is actually for production distribution. So hes asking for change in use to entertainment. But pdr is our most valuable space we are losing at a rapid rate and we need to preserve that. Not to mention he had illegal signage for joey the cat and the auto body shop was still on there. He removed the signage when the discretionary review was put in place. This is within 500 feet of an Elementary School and 600 feet within a high school for john on connell high school. We are talking about proximity to schools. We dont need our young people walking by that and seeing these negative images unless that space is going to be solely for a familyfriendly event. So no one is asking to shut down that place. I want to make that clear. But we dont want corporate event parties like the one he hosted in march illegally. And so not to mention i want to bring up the fact that ive heard this is going to clean up the sidewalk and this is going to make everything safer. Someone was shot on this block. Thats something we need to keep in mind. I dont think having an increased Police Presence come on 19th street is going to be good for black and brown communities, especially for the homeless folks that are there time and time again. So i think that shows theres a lot of lack of understanding of the Police Encounters with black and brown communities in this community as a whole. So im really worried about those because of the high increase of calls that are going to be coming in with that. So, yeah, i think that all of that are really strong reasons on why we need to come into play and uphold the dr review but the restaurant is being up held right now currently. And we are working in process of closing that loophole through the map 2020 process. I would urge the commission to take this into mind. Im available for questions. Can you hand those papers . Yes. Kids are such a great because. But im all for it if you want to do kids. But lets get the alcohol and shut it down at 9 00 so it really is a kidfriendly place as opposed to using kids to have a really big party place. The academy of art, now we have this place. Is that what people do is they run around and open up illegal places and then the city says no and they keep going and finally they decide, okay, im going to legalize this and the city says okay. You cant do it. You need to lets respect the umu and the fact that its a pdr space that something we need to keep in the mission. And lets please deny this. And that is my society right there. In 1984 i moved in on 20th and shotwell. Im on 20th and bryant now. The 2500 a night corporate rental fee, thats my neighborhood. So i support what marie is saying. If this is going to have pictures of nuns bowls and kids frolicking then lets make a familyfriendly place. Lets not make it like urban bowl which has hours kids cant go there because they are serving booze, lets see it as a family place that will be a good place for gaming and to keep kids occupied, similarly to what mission rec is. Its a safe place and doesnt serve drinks. So this whole pictures ive been showing you which i will turn in though i thought i sent it to you by email. There are game machines there but its a bar. And using the loophole of bonified restaurant which we are changing now in map 2020 because of the loopholes, we were talking about the oversaturation of alcohol in the neighborhood. This is less than 600 feet from the schools. Theres also an Elementary School at the Church Within a couple of meters away. And theres 250 a day fine. Have they paid it . Because theres evidence online and at the abc that theyve been partying since theyve been told by the Planning Department not to. So id like to see them fined and i dont want to see this bad actor being rewarded in the same way that you just denied merging a two unit into one because its rewarding. I dont want to reward joey to keep going. And i dont trust him that its going to be really a restaurant with alcohol on the side. I think its going to be a restaurant as an excuse to serve alcohol. I parked in front of this place nearby. I go to odc which is kidfriendly about 700 feet away. I want to remind you they have taken over the st. Charles school and so now we have two schools that are very close to this. Its been illegally operating with alcohol as an event site for a good four years. I should also mention my kids used to take dance classes up there in the same facility. And its a long time ago. And its been a school but its not a kidfriendly site now. Evidence of his using it as an event space, in march 12, 2019 a permit was received and then granted for activity on march 22, 2019 with an alcohol license. And yelp shows at least three other events that have taken place since the order was written by this Planning Department for him to sort of cease and desist this activity. Joey the cat should be renamed joey the liar. Im sorry. He has not been playing straight with the city. And we know very well on a statewide basis that restaurants, bonified restaurants are an excuse to turn things into bars. And we oppose this. I would be glad to give you the Public Disclosure records i just received from abc for the six permits that were pulled in the last six years of activities. Some of them within the time period where he should be fined on a daily basis. Please do not approve this. If i could find my notes, i would wrap up. I mean 24 7 access is needed by pg e across the street where theres often homeless encampments on the street between 18th and 19th, and 24hour access is needed by the Fire Department. They live half a block away from the site. These are longterm mission residents. You see the people are sitting here. We have the next door neighbor thats going to keep speake to you. People on the block are going to speak to you. This is not a person who we should impugn his character here. So thats one item. This is not pdr. This is urban mixed use. For your code, urban mixed use is something that came out of a tenyear process that i was involved in. Director ram was involved with. The commissioners at the time, commissioner moore was involved with. This is to be a buffer, and its written in code here. Between pdr and residential. And one of the things thats expressly permitted is nighttime entertainment, arcades are permitted. Restaurant is principally permitted. Yes, he began operating in that manner before he got his permits. He got a notice of enforcement in july of last year. Within 21 days he had hired me, hired architects and these architects. And you can see from the date on the building application, augus. So weve been going through the permitting process since then. Made an excellent all of this what you cant see on the left, you have the rollup doors, it was an Automotive Repair shop that was purchased vacant. If you look at the one on the right, you can see the rollup doors being taken out. These are the plans you have in your packet associated with the building application. Theres going to be complete transparency. People are going to be able to see whats going on inside that has arizona they walk down the street as they walk down the street. Currently hes operating legally. He has a temporary use permit by the Zoning Administrator of the city and county of San Francisco. The Fire Department has vetted it. The department of Public Health has vetted it. And he is currently operating legally while he is waiting for hopefully your affirmative decision here to let him continue with his Building Permit. With that, joey is going to speak to you about how the restaurant will be fully integrated with the arcade and what youve been hearing is a mischaracterization. Hello, hello. So an arcade is not economically feasible without food and beverage. Thats just a fact, otherwise arcades would exist. I operate arcade games in 17 locations. Thats my business. I repair arcade machines. Thats how got into this business, by operating a competitive ski ball business. Ski ball is my life. If we cant open an arcade without food and beverage, we are not going to open an arcade of my so if they say no arcade, no alcohol, okay, you get nothing and the building stays closed. The point about how alcohol impacts the neighborhood, steve fox, the owner of urban putt will speak to that because he has a space very similar that is Family Friendly that has alcohol, food and beverage. As you can see on the floor plan, im adding an entire kitchen facility and integrating food throughout the space. You can eat upstairs in the mizzein themezzanine. You can have a beverage while you are having ski ball. This is not a facade to pop food in. This is going to be a place to eat, drink and play. And thats what you hear the neighbors want to hear. So we are going to have regular hours similar to urban putt. The restaurant is code complia compliant. And thats how you can create family fun and Community Spaces in this neighborhood that i live in and have lived in for 11 years. On the topic displacement, when we moved in here, the owner of the building had sold it completely vacant to us. There was no displacement. I was running my arcade repair shop. We are the ownerrers of the adjacent building, located at 19th street. I would like to provide some information regarding the building in question, located at 3252 19th street. Mr. Joey did not displace blue collar or any workers when he and his family purchased their building. The previous Property Owner attempted to rent his property once he retired from the Automotive Repair industry. Unfortunately, it turned out badly as those renters were also growing cannabis illegally and the upstairs portion of the building caught on fire, threatening the janitorial building. After that, he decided to retire and completely retire completely and sold the vacant building to joey and family. Since then, he has run a business repairing and renting arcade machines and hosting the occasional special event. There have been four generations of native san franciscans which include my family and friends that have enjoyed these games during my childrens birthday parties at joey the cat. We all grew up in the neighborhood and most of us still live in the neighborhood or close by. We are not in the hightech industry. We are Blue Collar Workers ourselves. And have even invited the st. Charles church to play the games with us. Joey the cat is fun for both adults and children and more we have at any given time, go in on a sunday morning and youll see everything from toddlers to people my age there, and they are indeed playing mini golf, ski ball, basketball and they are eating, because its a full service restaurant, and they are drinking either alcoholic beverages if they choose to and of course theres nonalcoholic beverages. We have kids until 8 00. And we have many of them. So im going to talk a little bit about the economics of the situation. And i can tell you very clearly there would be, no, you are ban putt if we didnt have a restaurant and a bar. We only charge 12 for miniature golf. We have a full Maintenance Team that has to come in every morning to do work on it. It would not be financially feasible for us to have that. So, in fact, having food, and it is a full service restaurant, which is important. I have two kids. And they are there quite a lot. Ive lived in San Francisco, it will be 30 years next year. I live in vernal heights so i know about this. I can also speak to the issue of crowding and uber and everything else. You know, once you check the records, weve had no literally no complaints about this, no police incidents, nothing like this, no alcoholrelated incidents that have come up in the five and a half years that we have been in business. We do have a door person. We dont think of them as a bouncer because its meant to be friendlier than that. But we have door people that are there every evening. And that actually also really helps in keeping everything safe and neat and making sure there are no incidents. I approached joey about three years ago to start an art program in his arcade to help use his walls as canvass and create a system for a few artists in the neighborhood to get together and paint some murals. Thats just part of the reason im here though. A few years later we were in a bind and a friend of mine had two daughters and one was sick and we needed to have a fundraiser. There were very few places that could aaccommodate and he lent his space to us. The point is not the sob story. The point is that he gave me and my wife and my friends a Community Center that we needed at the time. And when he mentioned this project about a year ago when this first started dreaming about this, he mentioned in the plans there a mezzanine which is like a second story that would be created in this which hopefully would contain some of my games, miniature games i make. They are 40 percent size. [off mic] they are literally childsized games. [laughter] so i make those games. And ive lived in the mission when i first moved here at 21st and florida. I lived in the upper hayes the last ten years. Theres an arcade in the upper haight which again echoing the economic concerns is both a print shop, they make screen print tshirts which is how they support the arcade. I work there on the weekends and if i had to encourage you to go there any day, its full of kids playing my games, specifically parents showing their kids the games and the kids being approachable for the kids as well. Im a blue collar worker. I repair arcade games. I need clients like joey to be able to live in the city. So i would encourage you to approve this request. Thank you very much. Thank you. We are here sharing the board walk experience that really cant be achieved any other way than playing arcade games. Im also a member of the Mission Merchants association and thats how i found out about this project. I feel like theres a lot of obvious tension in the Mission District over gentrification and tech use use coming in and having a blast. And to be honest, it pisses me off when i see crappy behavior by people that arent from here and whatnot but i think blaming joey for that and having him be the punching bag for that kind of anger isnt quite fair. I dont feel its fair to characterize this as its going to be strictly a techy hangout. I think we know that techies live in San Francisco and people with money live in San Francisco. But theres nothing about this that has that nasty smell of money. It just doesnt. This is a place that i would if i could afford to have a kid, i would bring a kid to hang out there and play ski ball or whatever. But this doesnt have an elitist stink to it. And i know theres some people that have a drive and i respect what they are protecting. But i think that maybe this particular project should maybe get a little more slack and think about someone as trying to open an honest, independent, hardworking, workingclass business and i know theres been some past and i dont know about that but i know his plan sounds good, and i back it. I think independent business is what San Francisco needs, i think its what the Mission District needs and providing jobs, kids, sounds good to me. I back it. So thats it. Thank you. I also have been in the neighborhood probably somewhat longer than mr. Ortiz has been on the planet. I was the president of the Mission Merchants association back in the 90s when there was a lot of discord about the tech boom back then. And it seems silly, not really realistic to continue to vilify the industry that drives the economy of our city today. In terms of all the Different Reasons why folks are brought up that we shouldnt have alcohol on the block, i can tell you that they all, every person that opposes every project that ive listened to kind of uses the same stuff and hides behind the same stuff. I can tell you having lived on the block for quite some time that the only places where the hookers arent hanging out and the pimps arent hanging out are in front of the bar over there on the corner of shotwell and 20th. Thats the only spot. So having more nighttime activity that doesnt revolve around the sex trade would be fantastic. Having opened a dozen or so different businesses, all over the city, i can tell you that alcohol makes things viable. Its not always a bad thing. In fact usually its a great thing. Its very, very difficult to make a business go without the help of alcohol sales. Im trying to yeah, i mean all the different things, the no alcohol, the closing at 9 00. These are folks that have never operated a business. They just dont care. They are naysayers, and thats not what San Francisco is about. Ive been here 40 years. Ive heard a lot of this stuff. It could be several months until you get permits. Weve made a system that is difficult for anyone without connections, basically anyone who cant organize 20 people to come out to a hearing to open a new business. And thats not a healthy city. I think that direct discretionary reviews should only be used for extraordinary and extreme circumstances. And it seems a lot of things have not met up to this standard, and this case certainly is one of them. Joey has been here for 11 years. He has gone through the permitting process. Its not an easy task. It takes about 86 days according to a census report, about 26 hours of processing permits. He has dotted his is acrossed his ts and added a couple of objectionford commas and at this point hes faced a roadblock. I think about my mother who has always wanted to open a business and how if she was in this position, you know, she doesnt have the best grasp of english. She didnt come to this country with a lot of resources and connections. If she was in this position without this host of great supporters and host of people who know her, she wouldnt be able to defend herself. I dont think she would have a chance of succeeding through a dr. I think that is broken. I think joey is doing great things for the neighborhood. I really think that you should accept this dr and set a standard that drs arent supposed to be used for something frivolous but extreme situations that haunt the neighborhood. Thank you. Thank you. And that probably sounds pretty bad, but its actually even worse because all of the business all the cities underneath that were in mexico. We are the absolute worst city in the United States and canada to run a business today. And this kind of process is a huge part of that where anyone can come up to the works of a project for any or no reason whatsoever, causing a Business Owner to have to pay rent for months potentially for a business that they cant operate. They have to go and tell their investors they have no idea when they are going to be able to get a return on their investment. Maybe a Big Corporation can afford this. In fact most Big Corporations can, because they can use revenues from other locations. But small Business Owners, they dont really have that option. It creates a fundamentally unjust and unfair system for Small Businesses who just dont have those kinds of advantages. Obviously we cant really solve that process here today. But you can help us by swiftly rejecting drs that are in places where the businesses already principally permitted. As a conclusion, im another small Business Owner. Ive lived here 15 years. Dr requester, you get a twominute rebuttal. Can reasonableness consistency start my can we restart my time . So im hearing a lot of things. So he brought this property for 1. 5 million in 2014. This is not your mom and pop local im just trying to make a buck and have my business survives. He comes from a very wealthy family. This is not about an arcade using alcohol. This is about changing use so we can sell control. The mission has the highest number of alcoholrelated arrests and ambulance rides in the city. We are taking the cost in the neighborhood. These private events are 25 00 an event. Joey refused to continue the discussions after the fact that alcohol was a nonnegotiable which is right away had we knew that all his intent was. So i would ask when not against the ski ball repair shop or ski ball is familyfriendly space but we would ask for a Community Benefits agreement that gets up held unlike urban putt which has not been up held because they are not following that agreement. The whole point of having Community Benefit agreements is to make sure this is being mitigated and are having effects to make sure our folks cocome in and use these spaces. Since the private event parties are 2,500 an event that you limit the event to five a month. So that way hes recouping a little bit of that. We dont need a private event destination spot where its going to be private events all the time and no families are going to be allowed to be in there at this point in time. I would ask the commission to look at shotwell as a whole because theres a lot of conversion thats happening from pdr into Tech Office Space so thats a big concern, because we are talking about whats legally allowed and thats correct. When he says multiple opportunities, he backtracked to no we cant have alcohol and now hes trying to tell me hours to open my business. Hes using data of how much a private event cost when this wasnt open to the public. [off mic] you are out of order. My pricing is thats what was happening in the past so we are nonprofit events. Hes not hiring those. Thats a mischaracterization im only going to cater to techies. You saw steve walk up here and say a ton of different kinds of people all have events in his space and enjoy his space and enjoy food and beverage. So we bought this building because we know that it could be a public arcade and public restaurant that could provide Community Benefit. And i think that is the reason we bought it, for 1. 5 million, the price doesnt matter. This is part of a dream to open an arcade to the public. And a space that we could stay in because an arcade without alcohol and food and beverage, they dont exist. So i urge you to reject this dr, because i want to open this business to the public i want to put transparency on the building. I want this to be a public space. For those of you that dont like dr i give you two pieces of advice. One, get six members of the board of supervisors to put a Charter Amendment on our ballot that repeals the right to do dr on our business and tax code or get the signatures yourself to put the thing on the ballot because im tired of hearing about why San Francisco is so bad. Do something about it. Secondly, mr. Joey, can i ask you a question . Can you come up, please . So, these other locations you have, are they repair and arcade . Repair and restaurant . What are they . They are restaurants, bars,. So theres a brewery, street food, places that have my machines in them. We dont have enough time to go into the whole side of my business but i restore arcade games, i put them in bars and repair them because they break when kids use them. Later graduated to the cliff house arcade. There was a couple of them on Market Street as well if i wanted to really take in the train ride downtown. But i dont think this is businesses that bad. I really dont. Im recalling commissioner ben from the Entertainment Commission just came out with an article saying its almost impossible to open any businesses here in thi in this. So bear with me. Yes, it is important to protect pdr space. Actually think this is a great pdr use space. We have had multiple conversations about how hard it is to even when we have protected pdr space, keep and fill pdr space and this feels like a next generation pdr space thats there. And it feels like the intent of that. And it is principally permitted use. What im hearing when i hear the concerns of the dr requester and Community Members that spoke out against this business is really wanting a space that if its going to exist there is open to the community, that really respects and responds to the needs of the community. One of those issues is thinking about how this benefits the community, how can it be an open and welcoming space to all people who live in the mission and the city, understanding the neighborhood context, understanding maybe you do a Community Night or discounted rentals for local nonprofits. Wanting to see a plan in place that shows that you understand those needs and are really open to responding to those. I think also so much stuff was brought up about alcohol in the mission and the fact that that community is actually working to put together policy around the fact that the community is rialing from an oversatchuation of alcohol. So if there is going to be alcohol here in this business, what can you do to put a plan into place . Maybe you give a phone number contact to Community Members who can call you if patrons are coming out of joey the cat and being disruptive. What is your plan to not call the place police but find a way to mitigate the impact of the business. And how can you work with the surrounding
