We have a relatively longer agenda tonight so i will limit Public Comment to two minutes. And we have a one item on the agenda that will be dropped for the time being, the Police Chiefs report on the fdrb will be moved to another date as im told we still need backup documentation that wasnt ready. So with that we are ready for the first item. Line item 1 adoption of minutes action for the meetings of september 11 and 19th, 2019. Hang on a minute. Yes . One thing i am going to ask to move the dpa directors 2018 annual report. Im going to ask to table that or calendar that for another session. I spoke with commissioners hamasaki and dejesus who are not here today but wanted to have an opportunity to discuss the report so im going to ask if my fellow commissioners will accommodate the request to move that to another day. Have you talked to how do you feel about it director henderson is that all right . Absolutely not im ready to go right now. [laughter]. Starting on page 1. [laughter] i take you dont have an issue with it . Im fine. They put a great report together and i think its worthy of a great discussion. Well, commissioner dejesus is out of commission for about three weeks im told so are you asking that to be put back until she returns. I think the first week in november shell be back. Next week we have a Commission Meeting and then we are dark. Ill ask to put it off either until then or are we all good . Thats fine. I know you are broken hearted. I was going to read every line of it. Its beautiful. Thank you. Its laminated, its very professional. A lot of questions have been raised throughout the past few months. That was another reason. Im sure well think of more. Thats why i dont want to give you time. [laughter] well table that until some time in november. With those changes we are ready for the first item. Line item 2 reports for the commission, discussion, chiefs report, presentation of the family code 6228quarterly report. Weekly crime trends, provide an overview of offenses occurring in San Francisco. Significant incidents, chiefs report will be limited to a brief description of the incidents. Discussion will be limited to determining whether to calendar any of the incidents the chief describes for future Commission Meetings. Provide a summary of planned activities and events occurring since the previous meeting including fleet week. This is include a brief overview of any unplanned events in San Francisco having an impact on Public Safety. Commission discussion on unplanned events the chief describes will be limited to determining whether to calendar it for a future meeting. Thank you. Good evening chief. Good evening, president hirsch, Vice President taylor, commissioners director, executive director henderson. I will start this weeks chief report with our Crime Statistics update. Overall part 1 crimes are down 8 percent and property crimes, ill start with property crimes they are down 8 percent as well. We continue to have fewer reported incidents in all categories im happy to report. Auto burglaries down year to date and compared to 2017 we are down 20 percent. Violent crimes are down 10 percent overall. And statistically our homicides are down 22 percent from year to date last year. We are at 29 homicides, year to date, compared to 37 this time last year. There were no homicides last week to report. And for the month of september and the month of august, we had 3 homicides in each month. Of the 29 cases this year, 18 of those cases cleared by arrest and one case is cleared by appearance. There are other cases from previous years that have been cleared so as of today we have an 81 percent homicide clearance rate for the year. Gun violence is also down im happy to report. Theres been a 12 percent decrease in gun violence over this time last year. Weve had 16 fatal shootings for the year and 94 victims of gun violence for the year. There were 75 shootings causing injuries resulting in 78 victims. When you look at a fiveyear trend for gun violence and homicides, we are as low as weve trended for the last five years as i just stated, 16, i believe year to date. 16 year to date. The closest year to that was last year when we had 19. Every other year has been in excess of 20 so thats good news we are down in our homicides with firearms and i think thats a combination of Community Support and the good work that the men and women of our organization both sworn and unsworn are doing to make this situation better. As far as a significant event this week, we have a few events coming up this week. Excuse me. Ill start with the reunion has been going well. Traffic has been a concern but as we continue to evolve in our traffic mitigation i think we will continue to get better there but its really been smooth, particularly considering the end of the giants season and there were several nights where we had simultaneous events at both venues and i think our folks along with npa did a good job of getting people in and out of mission bay during those nights. We have the warriors actually begin our preseason here in our city on october 5 against the lakers so thats going to be an exciting night. First basketball game at the arihanna. Who are youaarena. Who are you rooting for . [laughter] for the record. I like both teams. I do like both teams actually. I apologize. Given that the warriors are our team the warriors are going to win it. We also have concerts this week, we have concerts this week, the Jonas Brothers and the who, which are expected to be well attended as well. Other large incidents this week involve the castro street theater and hartley bluegrass which we will be if you fully deployed for. Its a free event to the public. We will be there in numbers and fully deployed. Fleet week begins next week which is always a great week in San Francisco. It begins monday october 7 and runs through monday, october 14. Weve been preparing for that for quite some time with the department of Emergency Management leading the charge. We are partnering with all the agencies in the city that have a stake in this including the fire department, the National Agency the National Park service the u. S. Navy and u. S. Military federal and state partners to make this a safe event for all. It will be very crowded as always. So we are asking the public to please allow extra travel time to get to your destination. When possible use public transportation. Muni has many routes servicing the water fronts to get you where you want to be. And remember if you are going to drive park smart take your valuables dont leave them in your vehicle. Dont be an easy target to be a victim of property crime. And finally if you see something please report it and say something. This month is Breast Cancer Awareness Month and i would like to thank the commission once again for approving our pink patches. Last year we were able to raise 25,000 for the bay area cancer connection. So again well be attempting to raise funds through donations to support Cancer Research and support the bay area cancer connections. You can visit our website at sf police. Presentation of family code 6224quarterly report. Im sorry, where are you now . Chiefs report. Yep. Oh, right. Okay. So we are back at the chiefs. Good evening. Trying to confuse me tonight. Commissioners chief scott executive director henderson i thought you guys forgot about me. Immy name is greg im the executive chief of the Administration Bureau here to provide you the First Quarter reporting of the departments efforts on family code 6228 the infant code report releases. You should have the may report and the june to august 31st 2019 report. Ill leave that one on the screen. Police commission created the working group that convened in january, february and march of 2019 and the working group consisted of taylor, hamasaki, members of the San Francisco Police Department, members of the department of public Accountability Consortium status of women legal aid and sf war. Since that time on average the department has received over about 41 requests for 62 family code releases between may and september of 2019. The majority of these reports were made in person at the Public Safety building on third street. The majority of requests being made under Domestic Violence reports. As you can see this for example in june, 3,413 requests for infant reports and of those, 36 of those requests in june were made under pursuant to family code 6228. 26 were made in person. 10 by email and none by mail or fax. And that of those 36 the department was able to comply with the fiveday turn around to comply with family code 6228. As you can see the Domestic Violence is the majority of the reports as you look across june, july and august but there are other reports that are also requested such as Sexual Assault. And there is a report in there. As you go through this same reporting period of june to august 31 of 2019, we notice the title says reasons for delay or denial. Denial is based on if a person comes to the Police Department and they are not authorized or qualified for 6228, the report is still processed but processed under the tendaytime frame so the person still gets the report but not within five days but within ten days. Can you explain that what that means not qualified . In order to qualify you need to be the victim, attorney representing the victim, authorized conservatorship. Theres a list of authorized members within family code 6228. And if the person requesting the report isnt one of those identified members or authorized members then we dont process the request under family code 6228 but we just revert back to the tenday we redact the report and provide the report within ten days. Just by way of background it might be helpful for those here tonight. So the purpose of this is to Domestic Violence victims, Sexual Assault victims elder Abuse Victims can get copies of the Police Reports documenting the incidents that they can then take those and get civil restraining orders against the person who attacked them. Thats why this is so important and thats why our working group met to facilitate the fast turn around of these reports. Okay. Thank you. Thank you, Vice President taylor. Thats very important. So just to clarify we dont decline or deny reports they just fall into a different turn around but as you can see most all the reports have been that qualified under 62228 have been responded to within the five days and many times its within the same day. And we started in may so we have up until august our september numbers about 3,841 requests for reports. Of those 54 qualified under 6228. So the next report in january when we will be able to provide the october, november, december reports and then fall into the sequence of the quarterly reporting. Okay. Thank you. Commissioner elias. What about me . I thought you were. I had a question. Okay. I took you off. So first of all i just wanted to commend you. The reason why the working group met was because there was concern that nesterDomestic Violence, they were not getting access to the Police Reports to get restraining orders and there were language barrier issues and lots of concerns that were brought to the table and i wish that Domestic Violence consortium and the other members of the community could be here today to look at these numbers. There is the groups will be meeting at city hall tonight in honor of Domestic Violence victims. So thats likely why they are not in here but i would be very happy to see that for each of the months reflected here, all of the reports the incident reports that were requested, those requests were fulfilled within five days so im very happy to see that and i want to commend you for that because we were all really concerned. So this is good. This is very good. Good. Nice. Thank you. That was the first question i had was what the status was because i remember we left off the working group had sort of fallen apart because they werent happy with some changes that were made with respect to the bulletin that was going to or how these requests were being processed so what is the status on that . Its still in litigation so theres a lot of things the processes that we cant discuss at this time. But rest assured the men and women of the San Francisco Police Department crime Information Service unit understand the gravity of these requests and make every attempt to provide the victims and their authorized representatives with the reports in the timely manner. When you say the requests are fulfilled within five days, is that the same thing as the person receiving the actual report or is that different meaning you process the request within five days but the actuality whats the actual time period for the person to get the physical report . Within five days. And the majority of time they get it back to them the same day they make the request. Okay. So all the issues that the groups were having when they came to us and said it was taking months for the sfpd to process that, it is now a fiveday turn around . Within the five days, yes. Okay. And when you i want to make sure i understood what you said earlier if i heard it right. You went to the page where it said denial or delay reasons for delay. Correct. And one of the things is if the person is not authorized. Now, are these given priority over other requests that are made for actual Police Reports . Yes. Director henderson. I just had a question a clarification. We talked about the agencies that release reports for the authorized representatives. Do they still need to show the id, their ids . Their own ids or on behalf of the clients they are representing. Did that get resolved . I know there was discussion about that or is that part of the litigation . Thats part of the litigation. Okay. Okay. Thank you very much. Next item, please. Line item 2b, dpa directors report on recent activities and announcements dpas report will be limited to a brief description of activities and announcements. Commission discussion will be limited to determining whether to calendar any of the issues raised for a future Commission Meeting and presentation of monthly statistical reports for may, june, july and august of 2019. Okay. So majority of my presentation was going to be on the report so i didnt put a lot of work into the rest of the stuff but let me give you an update on the numbers in terms of where we are. Right now we are at 568 open cases versus 500 which is where we were this time last year. Theres been a real increase, youll see when we go over the annual report of 30 percent from last year. And i think we are up 11 percent on top of that this year. So we are receiving a lot more complaints these days. In terms of cases closed we are at 469, which is surpassing the total volume from last year i think this time last year we were at 442 in terms of open cases we are at 408. This time last year we were at 253. So thats a high volume. In terms of cases sustained this year we are at 39 cases have been sustained this year versus this time last year at 34. We have 47 cases that are have gone beyond nine months which is our own internal track record of trying to resolve cases sooner and faster. The majority of those cases are told i dont have the exact number still because we are still tweaking our system to be able to pull those numbers out. In terms of cases mediated, we are at 27 cases have been mediated this year versus 14 this time last year. We have a number of outreach events. We took participated in a presentation with the community at the riley center on post incarceration. The 19th we were at the San Francisco District Attorneys Office, Public Safety at the city college. On the 21st we participated with the Mayors Office on their Coastal Cleanup and on the 26th we worked and participated in the department of aging and adult services, resource fair for public agencies. The audience today, i have with me my chief of staff sara hawkins senior investigator and our senior investigator i dont remember. Operations manager. All specific. In case of questions that would come up during the meeting. Thank you. I do have a question about the 47 that are beyond nine months. Without knowing the number, are you confident that the ones that are not being told by a statute will not expire through the 12year cut off . 12 month cut off. Yeah. Yes. Because thats critical. Its important that the statute not be blown so. Its really important to me. Right. So everything will be done to make sure that doesnt happen this commission is aware from day one. We have not had any since ive been in this position and it is my intention to make sure that we dont receive that we dont get any. Yes. It might be helpful at the next meeting or the meeting after that to let us know of the ones that are not told, whats happening, why is there a delay, why are they beyond the nine months, what kind of issues exist maybe theres something we need to focus on maybe there isnt. Commissioner elias. Thank you. The other thing i wanted to ask is its my understanding unfortunately i wasnt able to attend but your staff went to a training in detroit thats very beneficial and nationally recognized so i was hoping you would have your staff present on the training and materials they received throughout that training because from what i knew of the training, it was very informative and i think it would be beneficial for the other commissioners. I would love to present something. I mean the folks that are here went if you want to hear something now but i can prepare something. Give us a brief summary right now, i think that would be good for us. They are here, i wasnt there but it was our national they can tell you. Sara hawkins, chief of staff dpa. A group of us attended the National Association for civilian oversight of Law Enforcement conference. There were a number of tracks and sessions. So if you wanted to present in more detail, we are happy to do that. All the materials are also available in an app called guide book. So we can show you the agendas and offer to kind of share any materials on that. Oversight is different in every agency across the nation so some of the sessions where everybody just kind of sharing their stories. And San Francisco was far ahead of the game. So a lot of stuff that was talked about are things we are already involved in. Among those insightful sessions i attended were one on mediation one on the investigation of officerinvolved shooting, one on Law Enforcement perspectives about civilian oversight. So its kind of every topic that we deal with in a moderated conversation type of setting. So there were a lot of good takeaways that came from it. Im happy to put together some materials. On sunday commissioner hirsch and i attended the annual police and fire mass. And it was an honor to be there with the firefighters and Police Officers, the men and women who serve this city. There was an accident sermon given actually by heely about compassion and how our firefighters and Police Officers deal with the homeless and those in Mental Health crisis and a good talk given by lieutenant michael about the career of those who choose Law Enforcement and Fire Fighting and public service. So it was great. Commissioner mish and i along with the mayor and the supervisor so thank him for attending and the mayor and it was good there to be there to support our officers. Next item. Line item 4 discussion and possible action to adopt a resolution supporting the San Francisco reentry counsel criminal justice Racial Equity statement, discussion and possible action. Okay. Good evening. Good evening commissioners. And thank you, president hirsch and thank you so much, commissioner dejesus for understanding the work that we are doing with the reentry. As you know yesterday i was here as the mayor signed the Racial Equity, which was signed by all the supervisors signed onto it. In 2018 i was a member of the cohort of Government Alliance on Racial Equity. I was representing the Probation Department representing the District Attorneys Office as well as probation, we were in a session trying to create a criminal justice Racial Equity statement for the hr department. And it was then we came together and said, hey we all represent a component of the criminal Justice Department system and that we needed a shared language and definition of the Racial Equity work that we will be doing here in the city. The criminal justice Racial Equity statement im here to present to you. The criminal justice and Racial Equity, i dont know if you all read it. But ill go ahead and read it. It was adopted by the commission. So we started with the da commission. It was adopted september 12 2018. Then we went to the reentry where it was adopted september 25 2018. Then we went to the Community Corrections partnership. The executive committee and later the whole partnership endorsed it as well as the juvenile justice coordinating counsel. This is the last criminal justice body that we are presenting it to. The racial criminal justice Racial Equity statement says San Francisco Community Corrections partnership juvenile justice coordinating counsel reentry counsel, commission prioritizes Racial Equity so all people may thrive. San franciscos criminal Justice Policy bodies collectively acknowledge that communities of color have born the burden of inequitable social, viabilitial, criminal justice policies practice and investment, the government actions have caused deep Racial Disparities throughout San Francisco juvenile justice and criminal Justice System. We further recognize that Racial Equity is realized when race can no longer be used for the outcome. We commit to the elimination of Racial Disparities in criminal Justice Systems. So that is the statement. And that is the statement that we are looking today for you all to recognize and hopefully sign on. I have the ordinates that in december of next year, every department in the county will have to come up with their own Racial Equity statement. And the statement, we want it to be uniform among all criminal justice bodies. And weve actually been working on the statement and all the criminal justice bodies are in cohort for because of this statement right now tiffany sutton, i got her last name right, is representing the Police Department right. From this statement, it was also included in the district Attorneys Foundation grant. So we have a committee that meets with all criminal justice bodies to talk about Racial Equity in a criminal Justice System. We even have is that danielle is part of our cohort and she definitelily knows as well as the candidates and just to add the criminal justice Racial Equity statement is there for us to have a common definition of what we aspire for but each of the departments is responsible then to build out the work that we are doing. So after the plan is done, you have to reveal it to a legislative body. We are asking that all criminal justice bodies state it to the reentry counsels and all the counsels that have accepted this so we definitely know what is taken for us with the office of Racial Equity as well as our criminal justice bodies. Every single criminal justice body, i mean its like we go on a road trip trying to get everybody on the van. Spreading the love. Yes. This is the last stop. We knew we had to come correct to show you that we had everyone but the base player we looking for. Last but not least. Commissioner brookter. I hope my colleagues would adopt this. I want to say thank you for her perseverance and all the work shes done in our communities ive known her for some years now and just know that she is an advocate not just for communities but within the Justice System so i hope we are able to adopt this statement. I was here before with your special victims unit and i may have to come back another time or two. I want you to know the consequences ill maybe get to that next time. Having a function of special victims unit. And im going to say im hoping to have cooperation from your commission, from the supervisors to fix things. I was a long time activist. I worked with the committee to write all the protection for tenants. And people used to call me on the hill where i did land use the woman who saved knob hill. So i want to be the woman who prevents hundreds of people from becoming victims to the deranged nurse who got loose at this time as far as i know still at the jewish home and the administrator who could teach cardinals a thing or two about how to protect abusers. When we went up to sacramento to lobby for senate bill 338 about sops for investigations of this kind, i was asked to make a little sign if i wanted and my sign said sfpd protects abusers from victims. If you happen to read in the chronicle magazine that story about the woman who put the billboard up where she was victimized by the police. In that case she was a stripper raped in the strip club and she thought that had something to do with it. I would have thought that happened right here except she was in a different location but i was treated the same way. And it wasnt just even one bad investigator. It was that there was no response whatsoever when i called. There was no place to call within the Police Department. There needs to be and thats a suggestion im going to make, we can all learn something. My time is up now. Ill have to come back another time but i want you to know all about it. All right. Thank you. Any other Public Comment . Yes . My name is morris. There are three issues i want to discuss here. I have a solution to the homelessness problem. I could solve that real quick. And i want to see if i could have a conference where we could look at that, Global Warming and the green plan. Now, i want to talk about Police Safety and the chief might be interested in this. Car chases go on and i think the cars put a hole in the back and with a gun in case he comes with a gun to stop him. When the police was shot in texas magnetic here and here and you just put so you cant open the door. All right . And you get a helmet camera on the backsides so you can see everywhere, you know . These strategies will save us a lot of time and effort and embarrassment. I called a couple months ago the accelerator stopped. You can put it in neutral right . That would be solving the problem. Operating as if we really are not victims and we kind of aggressively solve these problems. So the homeless solution, i called the president but emailed him. He said that he was in june. But its september. And i said i guess he wants me to talk with me i want to do a conference. I want the European Union involved for the homelessness in europe also if we get the federal government and i got a solution. Thank you. Thank you. Any other Public Comment. How many minutes do i get . Two. I would like to use the overhead. Again im here concerning my son who was murdered august 14 2006. To this day still no one has come forth. And i was just wondering was there another way that we can solve these unsolved homicides. We were just at a meeting at Cornerstone Church yesterday. And david who is over the homicide detail now. And brown was mentioning, you know, that ive been fighting for my son for the last 14 years. And what more can they do for me. You know, i was happy to hear that. But im still asking what more can be done for unsolved homicides including myself. We talked about Mental Health, we talked about people suffering, we talked about a lot of things. And i also got up and i spoke in the Public Comment and said look even though its been 14 years for me, i still cry. I still suffer from trauma about my son being murdered. And we call trauma having to see my son murdered laying on the gurney lifeless, with no second chance. No possibility of nothing. No more. No children, no grandchildren. None of this i will ever have. So i do deserve accountability of them catching the perpetrators that murdered my son that maybe they can find a way instead of being told that no one is coming forth yet more should be done for us mothers. Ive been a public defender in San Francisco since 1999. Im currently director of Public Policy for the San Francisco Public Defenders Office. On behalf of our office and the communities we serve im respectfully asking the commission to agendize as soon as possible the Police Department and dpas response or lack thereof to the amended section 832. 7 of the penal code that went into effect january 1 of this year and holds that Serious Police misconduct is not confidential, yet nine months over nine months later, we have received responses from the Police Department on just 77 of the 2,200 excuse me 2,0030039 officers or 3. 2 percent from dpa that number is even lower. Weve had responses of just 68 of the 2339 offices or 2. 9. At this rate it will take 25 years for there to be compliance with this law. In the meantime, today is International Wrongful conviction day. And exoneration records if they teach us anything, they teach us that numerous human beings are sitting in jail and prison, arrested charged and even convicted based on Police Misconduct but unable to prove it. I have an example a very clear example that id like to give you. Which is the case of brandon simpson. He was choked and beaten by four Police Officers not far from here in 2015. He was charged. And thankfully when his case came on for hearing his public defender played a Surveillance Video and with the u. S. Attorney saw it. Your time is up now. Dismissed the case. Okay. Thank you. [off mic]. Thank you. All right. Next public speaker please. Good evening. Im an attorney with the Public Defenders Office. The u. S. Attorneys office in mr. Simpsons case when the video was revealed, moved to dismiss the case. And four and a half years later we have no public availability of any official action against either officer Nicholas Buckley and john fergus. In fact for gus states he has no misconduct record and none for buckley who testified in federal court and should be referred to the chief for discipline. To the innocent person currently facing charges to a friend or Family Member of that innocent person and to anyone who cares about human rights, this is an unacceptable situation. And this commission should act with urgency to remedy it, sending a clear message to the public and the police that San Francisco will not tolerate official lying or official violence. For those who have been exonerated based on Police Misconduct that their suffering was not in vain and to those who have not yet been that society cares. Ill read a few words from justice briars opinion in that case. He said listening to Police Officer in direct examination his testimony appeared to be straightforward convincing and entirely credible. His cross examination was similarly credible. But as we know, because there was video of the incident and the video was unequivocal in rebutting everything the Police Officer testified to and the court watched the video it left no doubt in the courts mind it was inconsistent and contradictory to the testimony given by the Police Officer. The worst thick in the world for any judge and any prosecutor and the conviction of an innocent person or the conviction of a person based on wrong testimony. It must be accepted by the citizens and population of any country. Thank you. Wrapping up, sb1421. Your time is up, sir. Thank you. Next speaker please. Just so the public is aware if there is materials they want to present to us they can bring them so for example an opinion is something you could bring copies to and put on the table for the public and for us commissioners to per review. Good evening commissioners. Today as my colleague mentioned its International Wrongful conviction day. A recent study found Police Misconduct was a factor in as many as 50 percent of Wrongful Convictions. We think San Francisco is different because of our progressive politics. That is wrong. We are suffering from the same problems. The Police Department has contributed to Wrongful Conviction right now. It is supposed to be against that misconduct and supposed to be fulfilling that promise. You know the statistics we have presented here before. The request of open reported posted after six months waits secret meetings and failure to disagree with the chief on punishment. An example of why dpa must hold them accountable of my last august officer was caught lying on the stand as testified to prosecute. They recognized the inconsistency in the evidence. The case was dismissed. The dpa took ten months to reach the same conclusion the judge made in an hour long hearing. The officer lied. Who knows how many other cases this officer testified in and how many times his word has put someone in jail or prison or how many innocent persons remain locked up. It remains tied up in procedure. This case should have been a priority for dpa and clearly it was not. I ask this commission to look into what dpa has done. Let me make a formal request to ensure dpa does its job. This commission was agendize the commitment to fill its mission so the public gets a better understanding of what they are spending the annual budget on. Thank you. Any other Public Comment . Its a lot of misconduct with the Police Officers. They are doing a lot of lying. Some of the things they are doing with me personally, if i didnt have people to back me up, i would be a real victim. So with dpa im talking to numerous of them, been doing it for nine months and its a great job i like what you guys got on your annual report today. I was happy to see all this because some of the things on there is really, really true. Im one of the persons that its been happening with the police. So thank you guys. Thank you.
