Commissioners, office of Small Business staff, sfgovtv i have a powerpoint for today. There are five applications for businesses to be included on the legacy business registry. The applications were reviewed by me for completion and submitted on january 11th for review. The Historic Preservation commission heard the applications on february 7th and made positive recommendations for each applicant there is a staff report, draft resolution, application, case report in the Planning Department staff and resolution from the Historic Preservation commission. There are copies on the table for the public. Item 3a. Babb bilon Screen Printing shop specializing in bulk production. Founded by steve patent in 1980 he started in 19676 as a small 1976 in his garage. In the 1980s it was located in a store front at 21st andval epsia valencia. It is 63 buckston street today with one large 10 color automatic press, three, six color Manual Presses and sing l1 color press. It is owned by Michael Lynch since 1999. Item 3b. The organization known as the lash is nonprofit arts and Performance Base founded in 1984 by art students from the San Francisco state university. The lab is a catalyst for artistic experimentation. Along with year around multidisciplinenary programs. The lab commissions three art projects per year. They seek out extraordinary artists who are underrepresented as a result of gender, class, race, sex orgy graffiti. O other mal mal the lab relocated on 16th street in the Mission District in 1995. Item 3c. The mind full body opened in april 1994 with Movement Classes and offerings that were reflective internal and medtative. The goal was to be an urban healing resort, a place of refuge, a kind and welcoming place to find meaningful community. The mind full body was a bit ahead of its Time Offering yoga before it became mainstream. In addition to yoga including post and premarital with baby. It features massage and accupunturand meditation and 200 hour yoga training program. It is not 30 years old but due to displacement due to significant rent increase. Item 3d is an irish public that opened in 1975 in the richmond street. It features irish music every tuesday and sunday evening. The business hosts events put on by the irish crossroads festival, a city wide event celebrating Irish Literature and culture and music. It features music styles reflective of the neighborhood including bluegrass. Item 3e. Is slims, a live music nightclub opened in 1988. When slims first opened the musical acts were r and b and blues. Currently it offers all types of music including hiphop and folk catering to a large rarity of tastes. It is an active member of the 11th street hosting benefits and catering to community outreach. Slims hosts High School Proms and serves as venue for local bands. It consists of 17 individuals in a corporate structure. All five businesses received a positive recommendation from the histor rick preservation commission. After reviewing the recommendations from the Historic Preservation commission the staff finds the businesses qualify for list on the legacy business registry. There are five, not four it says on the powerpoint. Five draft resolutions, one for each applicants. Note a motion in support of the businesses should be in favor of the resolutions. In the resolutions, please pay close attention to the core physical traditions that define the business. Once approved by the Small Business commission they must maintain the traditions to remain on the legacy business registry, for babylon burning Screen Printing. We have been open for 24 years, which was the begin of when Wellness Centers opened in San Francisco. We are a Neighborhood Community minded studio offering massage and yoga. While the current tread is working out we have always taught yoga connected to the roots and more internally oriented for calming the mind and staying focused and present. We are located in a beautiful old 1920s building with natural light, and it is a really old San Francisco style space. People tell meal that all of the time. Our lease expires. My landlord proposed 6,000 a month rent increase which we cannot afford. I am trying to negotiate that and trying to get the tools to keep going. For me, i have worked at the mindful body 17years. It is a refuge, community. Everyone knows each others name. You can be yourself. We have worked to be welcoming and inclusive for everyone. We specialize in supporting expecting parents and have a big program for seniors. We provide services for dealing with stress, maintaining health, healing and preventing injuries and for dealing with sitting in the office all day on the computer. In the 17years i worked at the studio and been a Yoga Instructor San Francisco has changed and people become busier. I would like to offer a place that supports people creating balance in their lives. We have 60 employees and 15,000 clients. I am hoping that we can keep going and offering that Wellness Center to San Francisco. Thank you. Next speaker. Come on up. I am mike lynch, the owner of babylon burning Screen Printing. My family wanted to come today to make me extra nervous. Dont be nervous. Richard did such a great job. I want to thank richard, such a big help for helping us with putting this altogether. We dont want to dwell on the past. We have a big history. We have been doing this a long time. I want to thank the commissioners and the Historical Preservation for listening and being aware there is Small Businesses struggling. This is the second time i have spoke. I can hear, including my own voice is shaky. That is the way it feels now as a Small Business in San Francisco. It is shaky. I dont know if next year the landlord will raise the rent or kick us out. I dont know if the beautiful brick building is right beside the San Francisco tennis club which is coming down. Are we next . It is a beautiful brick building. That is the way it feels as a Small Business in San Francisco. I have San Francisco natives that work for me. I get to do as a Small Business i get to pay them well, and pay for all their insurance so the business is doing good. Again, are we going to be around next year . To have this hearing, to have this commission and having people hear us is really great. It is really a positive step. I hope it turns into a trend. You need to use the smaller businesses to keep it going. As i said before, the other hearing that we had, two of the five people today i printed for them. It is cool to see that inter meshing of the stories. To speak about the lab. We are internationally renowned, and yet we are also fully aware of our economic disadvantage in San Francisco. We are one of last remaining alternative arts bases here. We are electrified bipolar rised cents. One current is serious about making the organization succeed. As a new model for funding artists. The other is less tied to systematic thinking. Recently over 40,000 artists and volunteers have come together t ensure the labs future in the city. The 34 year existence has depended on the sense of family. The Community Ownership that blurs boundaries between work and place and exhaustion and exhilaration. The power of this collective effort continues to astound me. As one of the last remaining arts organizations left in San Francisco. The aim is to provide artists and audiences with the time and space to experiment. Our artists represent the depth and diversity of the dwindling works class. They make the city playful. They expand our perception with what is possible. We provide 25,000 per year and Health Benefits and financial and legal counseling. We want the artigses artists to be inspired. This is done where the lab is housed. The San Francisco labor temple. Why the residents have sought advocacy, healthcare, fair wages and Creative Energy afforded by having leisure time. Sadly, i could leave you today only to find out we have been evicted. Our landlord is seeking to sell the labor temple to the highest bidder. Good afternoon, president adams, commissioners and staff, richard kurylo. I am presenting the Quarterly Report for october through december 2017. Including statistics, nominations received, Business Assistance services, business types, major accomplishments, Business Assistance grant. The major upcoming activities there. Are copies in your bidders and on the table for members of the audience. In october through december we received 12 legacy nominations. 17 applications and 750 in application fees which are 50 per applicant. The Historic Preservation commission reviewed 8 application. The Small Business commission reviewed 8 applications and listed all 8 businesses on the legacy business registry. Since the Program Began there have been 20 200 nominations. 750 in applications received. 120 were review and 119 businesses were listed on the registry. Nominations received in october through december were for legal referral panel. Babylon screen prints. Motor lodge. Eddies cafe. Little joes pizza, mindful body. The bakery. Pioneer and San Francisco market corporation. Many have been legacy businesses. I have a quick question. You go back to the last slide. Some of these have not come up yet. They are still in process . In processor just been nominated and havent provided us with an application. Okay, thank you. Sometimes the supervisors nominate the businesses and we reach out to see if they are interested in applying. Thank you. For Business Assistance services the legacy provided Technical Assistance to 24 unduplicated clients, 110 hours of difficulties this fiscal year. Since the program launched it has served 53 unique clients and provided 464 hours of consulting. Legacy businesses have access to all training workshops offered through the San Francisco Small Business Development Center or spdc at no cost. Topics include marketing, financial management, quick books, access to capital and technology. Spdc partnered with business blocks, a San Francisco Small Business company to provide free seats in the main street Marketing Online course which has a retail value of 750. In this course the businesses learn marketing strategy, master on and offline Marketing Tactics to reach new customers and create a marketing plan for their specific needs. For 119 legacy businesses on the registry as of december 31st, 81. 5 were for profit businesses versus nonprofit organizations. This represented a slight increase of 1. 7 from the Previous Report in august. For the city as a whole it is estimated 94. 3 of the citys establishments are for profits. 97. 4 are nonprofit. There were 20 applications to the fpc. It included all 20 on the registry. Acknowledged the 100th business on the registry, submitted 12 Business Applications to the hpc, completed contract negotiations with the Creative Group for marketing and branding. Created a web page indicated which businesses are compliant with the city and county of San Francisco. Notified legacy businesses of the availability of the Online Marketing Training Course courtesy of the Small Business Development Center and began issuing regular press releases. For the accident Assistance Grant there was an application rate of 64. 9 with 72 of 111 eligible businesses applying. We are finalizing the numbers. To date there are an average of 16. 79ftes per applicants, average grant payment of 8 600. Total grant payments are to be over 623,000. The top five proposed use of funds for the Business Assistance grant are 38. 4 for improvements. 25. 9 for rent. 12. 9 for facade. 10. 2 for marketing and promotion. 7. 3 for equipment and technology. Since the rent stabilization grant was issued one year ago, we have processed and paid 12 grants to landlords averaging one per month. The average Square Footage is over 3200 square feet, and the average grant is 14,771. There have been numerous press articles about legacy businesses since september. Including sanchez as 100th business and the passing of gus stan nuss who owned the produce. Passing of steven par from odd ball films had several articles, and new legacy businesses including el rio, clips and tomasis all had press articles. They resulted from the press releases in november. Press in december including closure of brainwash and passing of mayor lee and businesses added to the registry. Lastly there was an article about d a lounge added to the ledge see and dance brigade purchasing a new building for the new home. Major up coming activities for january include 10 applications to the spc from january through march. Working with the Creative Group on marketing. Completing payment of applications for fiscal year 1718. Creating online application for Business Grant for 1819. Finalizing rules for the legacy registry, creating an annual reapplication process for rent stabilization and annual report for 1718. Thank you. This concludes my presentation. The presenter is rh rhean auginaldo. Welcome. I have a powerpoint presentation. It is so clear now. All right. Good afternoon, commissioners. Thank you for the opportunity to present to you today. My name is rhea august innal do, assistant case manager for the office of Small Business. In addition to staffing the Business Assistance counter, i help the Office Support business programs. I support rick with the Legacy Business Program and the Accessible Business Entrance Program to create and implement outreach and Education Program. The purpose of this presentation today is to give you a background, overview of what the program is, and our goals in terms of outreach in education for the program. Please note our office is in the early stages of outreach for the program. We are still developing materials, we are still actively reach you go out to stakeholders, including business organizations. Given the first date to compliance is may 23rd, 2018, we wanted to make sure you understand where things stand with the program and our goals going forward. A bit of background about the Accessible Business Entrance Program. Ordinance 5116 was develop in part from a white paper by the office of Small Business that was drafted september 23rds of 2013 about significant accessibility issues faced by San Francisco Small Businesses. The paper outlined recommendations at federal, state and local levels to advance accessibility and protect Small Businesses. Supervisor pain worked with our office in partnership with the Planning Department, department of building inspection, San Francisco public works and the Mayors Office on disability to develop this legislation, and the mandatory Disability Access improvemenimprovements, the offe was introduced in july of 2015. Passed by the board of supervisors, april 12, 2016. Signed by may or ed leo april 22, 2016. What is the program . The Accessible Business Entrance Program is the official name of the ram. It requires Property Owners and buildings with places of public accommodation to make primary entrances and entrance routes into the building accessible to people with disabilities. As a Building Code addition, the program is directed by the department of building inspection in consultation with the Planning Department for Historic Preservation, San Francisco public works for sidewalk modifications, the Access Appeals Commission for unreasonable hardship and technical and feasibility requests. The office of Small Business for outreach and education and resources to Small Businesses and the Mayors Office on disability for experience in accessibility standards. Compliance for the ordinance is required for places with public accommodation. All buildings with public accommodation fall into one of four categories. Ranging from fully accessible, to having Major Barriers to entree. I will in the next couple of slides go over in the compliance categories, steps and schedule. There are four exemptions to the programming. Buildings built on or after 2002, owned by religious organizations and private clubs and buildings that do not have public accommodation. Here is a list of the 12 categories in title three of the federal ada as places of public accommodation. It include restaurants, bars, retail stores, drycleaners, grocery stores, hotels, daycare centers, gas stations and hair salons. For Property Owners who are unshower whether their unsure whether their business is a place of public accommodation the department of building inspection has a form and they can submit that form to dbi or call the department of justice hot line for assistance to derm whether or not their acciden g is a place of public accommodation. Property owners are responsible for completing the steps to achieve compliance. Quickly. First derm eligibility, what that is to deter min if it is a place of public accommodation or meets one of the four exemptions. If the building is exempt, no further action an required. Not execs. Exempt go to temperatur step. Consult with a Design Professional. Licensed architect or engineer to survey the entryway of the property. Step three is to complete and Submit Department of Building Inspections category compliance checklist by the deadline that i will go over in the next slide. This compliance checklist must be filled out in consultation with a certified access specialist our Design Professional. Four. In the third step for categories two, three, four. The Design Professional will propose barrier mediation if the building is not category one, which is completely compliant. Step four there is a two step process. Step pour is to file the application for required Building Permits by the specific dead line and to obtain the Building Permits by a specific deadline. Keep in mind accessibility is Building Code related so these Building Permit applications are forbearier removal, making sure the entryway is compliant and consulting with the appropriate agencies to ensure that the work that needs did you is in compliance with planning codes, Historic Preservation, public works, sidewalk modifications which is more information on that is on department of Building Inspections website. Important to note here, too, we do have a list of certified access specialists. In that step two, consulting with a certified access specialist there is a data base our office created as resource for profit owners looking for inspectors to serve San Francisco. Now here is the compliance schedule and categories. All buildings with places of public accommodation fall into one of four categories listed here. Ranging from fully accessible to having Major Barriers to entree. Quickly going over these. Category one. Compliance. No steps or barriers to the entryway. Category two. No steps but minor barriers. A minor barrier could include narrow doorways or door handles that require gripping our turning of the wrist. Step three or category three, the entryway has one step. Category four, then industry way has more than one step and other Major Barriers. Based on which category compliance the the falls under, they with need to su submit the checklist by that date. Those in compliance would have to submit the checklist by may 23, 2018 to the department of building inspection. Inspection. Our objectives at the office of Small Business. Given that the ordinance impacts a wide swap of Small Businesses. Our aim is to provide obligations for compliance. I wont go over all of these. I want too highlight a few we are focused on. First, educating businesses and Property Owners about their obligations for compliance. Educating business and Property Owners about legal and financial obligations that could be triggered in the leases by the Accessible Business Entrance Program. Thithis is an important be given the interesting overlay with state and federal access quilt laws. It is important to note the way the ordinance was written it is not meant to change the relationship between the tenant and Property Owner or affect any existing leases. Our office wanted to get ahead of that to make sure we understand thelem implications and provide resources about the steps going forward. Then the last one here that i will highlight provide access to legal prep sensation and assistance to Business Owners in need of that assistance. A bit more about our outreach materials as well as target audiences that we are looking to provide education to. We are working with the inter agency group, department of building, planning, public works and the Mayors Office on disability to host workshops to businesses and Property Owners. We have actively identified organizations and steak holders to present to. Our office beyond the compliant steps and taking the lead more so on mapping the legal implications. Around the overlay of the Accessible Business Entrance Program with state and federal accessibility laws. We will conduct outreach through email blasts, both inhouse through our office and distributing information out to our partners, business organizations, chambers to share with their business members. We are also putting together materials, informational handouts and handouts on the legal rights and responsibilities of Property Owner versus tenant. Talking points how to communicate with the landlord around accessibility obligations and identifying leal and tax researches for businesses that could be available for them to cover this. To cover accessibility obligations. Also listed are target audigen audigenss, organization audiences we are reaching out to. The merchants association, San Francisco economic development, development, golden gate business association, Golden Gate Restaurant Association and the San Francisco chamber of commerce. So with that one last piece that i do want to bring up in regard to our outreach. We find that it is very important in the messaging of the ordinance and the director can expand upon this. It is important to message around the civil rights component of this ordinance. It is our intention to highlight that through the ordinance. The city is taking a stand ensuring the rights of those with disabilities are upheld. It is seen as compliance litigation. We aim to tie our messaging to making sure individuals with disabilities that their civil rights are upheld. That will conclude my presentation. I am happy to answer any questions you may have. Thanks for the presentation. Question about the timeline when the outreach and all of that is going to start. What the timeline of outreach is going to start. Our timeline we are now reaching out to business organizations. We are putting together materials and we are slated to do presentations midmarch, mid to end of march for the workshop. Ra the certified professionals do they have to be privately higher or is the city supporting through those individuals as well . For the certified access specialists if you are referring to that step two where the Property Owner needs to consult with the cast. That would be done between the Property Owner and the certified access specialists on their own. We do have at our office some guidance that we have put together, resources on how profit owners and businesses can identify a cast to work with. The certified access specialists arestert certified through the state. It is important to note our city has unique guidelines around the Building Code. When they are searching for and doing research to find an access specialist there is certain criteria they will look for. Commissioner aretes. I wonder there will be any increase in funds sabl availablo the program the city currently has. I will answer that question. We currently we do have there were some cash infusion to subsidize the inspections for Small Businesses. There is some of that funding left. We both oawd and i made the decision to retain that funding for Small Businesses so Property Owners would not be able to access that. Property corners would not be able Property Owners with not be able to get the inspection. We will promote the Property Owner is responsible for the checklist and dealing with the remediation. There is the inside of the business that there are many businesses that have not done the inspection to insure the inside of the business. Meets accessibility standards. If not what do they need to do . Welatin that to encourage the inspection for the inside of their business. Does that make sense . That makes sense. Most leases have anything with ada on the lease. Is that correct . From the citys perspective, and this was the law was designed this way, under the federal law, both the Property Owner and the business has a legal obligation. With the ordinance designs with dbi can only in terms of dealing with any building improvements. They can only work with the Property Owner. They cant work with the tent. They can only mandate it. We were going to help provide Legal Assistance. We do anticipate there will be Property Owners that say we want you to meet this obligation. There will be some probably Legal Assistance that Small Businesses need to have to meet this. Again, because of that legal obligation of the Property Owner at the federal level, should they push on the responsibility to the temperaturenant. The ten tenant. The tenant may not be able to afford the level of degree of accessibility remediation as the Property Owner could. We want to make sure Property Owners understand if they meet that direction what kind of position they could be putting themselves in as well. Good again this is a self rights element. When our office came to understand the difficulty of navigating dbi, Historic Preservation and public works and remediating the entryways. It is a opening. We are not doing our best to uphold individual civil rights with individuals with disability civil rights and making the entryways accessible. I think we are a city that promotes and are proud of the self rights that we promote. The messaging that i am hoping that we as a city do is to our Property Owners. We really want you to take pride in upholding the civil rights by you taking care of the entryway. This ordinance is designed to have the three departments work together. There will be times especially when we deal with the staff or properties that are on hills and things of that sort, it may take both public works and altering the entryway a bit so that it makes that collaboration easier for the Property Owner to engage with the three agencies. Thank you. Commissioner riley. Why are the buildings built on 2002 or after except . My understanding is that the buildings that were built on or after 2002, the entryways are already in compliance.
