taken them, so they're now four years behind spacex. i think now that they have gotten this flight off, i agree with derrick, this was a critical mission not just for nasa, but for boeing to demonstrate, to give them confidence to demonstrate they have the capability to do this. we're far from complete. we have got to get off the centar, do some tests on the cst 100 over the next day and tomorrow hopefully we'll have a perfect docking, spend eight days on the international space station and then undock and come home. the ultimate test is how does the spacecraft handle the intense heat and pressure of re-entry, and then as the landing out in the desert, does it go the way we want it to go. only once they have touched down out in the desert ten days from now or eight days from now will we be able to take our breath and say we had a successful flight. >> such a good point as we watch these live images and they continue their mission, their journey into space at this very moment. general charles boldon and derrick pitts, thank you, gentlemen, for being our eyes and ears and helping us understand what we're witnessing right now. history being made for nasa, for boeing, and for the entire space community. we'll continue to watch these images. jose diaz-balart will pick up our breaking news coverage right now. jose, can't help but be in awe. >> yeah, unbelievable. good morning. it is 11:00 a.m. eastern, 8:00 a.m. pacific, i'm jose diaz-balart. we begin the hour with breaking news and just wonderful to hear exactly as expected. right now, two astronauts are racing towards space and the international space center on board nasa's starliner capsule. this is a crucial test of the first ever crude flight of this new spacecraft by boeing. it is nasa's third attempt to launch a capsule after two previous delays including an aborted launch last saturday. joining us, tom costello and jose hernandez, former astronaut for nasa, both dear friends i admire. tom, take us through what is happening right now. >> let me just tell you, we're watching very closely the upper corner of your screen there, that gives you the elapsed time so far in the mission and the next critical milestone that we're going to be watching very closely is 12 minutes into flight and you're going to hear capcom call out meco, main engine cutoff. once we have meco, main engine cutoff, it is assumed at that point that the crew is safely into orbit, so we'll be watching that as they accelerate to 17,000 miles per hour. 1.5 million pounds of thrust coming off the launchpad this morning and it all did go beautifully as you heard as they burned on the core engine there a mix of purified kerosene and liquid oxygen. and then they go into the upper stage, which is going to be a critical part. you're going to hear separation, moving to the upper stage of the rocket where they burn liquid hydrogen and oxygen. again, accelerating, hitting that as fast as they can, they need to rendezvous with the international space station. this is all calculated, down to the millisecond. we watch 11 minutes and 09 seconds of elapsed time, waiting to hit the 12-minute mark because we want to listen for meco, main engine cutoff. i might make the point very quickly that sunita williams, the pilot, commander butch wilmore is also on board, but sunny, sunita, calls this capsule calypso in a nod to jacques cousteau, the famous french explorer. that's what they're trying to do, explore the heavens as they race toward the international space station. and if you don't mind, i'll make the point, 15 seconds away from meco, that main engine cutoff point that signifies they're safely in orbit, but it appears that they are approaching that very, very well. and here we go, we'll listen closely to mission control. >> nominal meco starliner. >> nominal is the term that it went well. >> main engine cutoff. we got good energy, meaning good velocity for continuing to orbit and good plane meaning starliner's trajectory is aligned with the international space station for rendezvous tomorrow. >> and with that, butch and sunny will return to orbit and they're both individually experienced pilots. >> perfect. that's what we wanted to hear. the next landmark, jose, or the next milestone will occur at exactly 15 minutes into flight, that's when starliner, the spaceship separates completely from the booster rocket you see right there. but this is going exactly as they had hoped, exactly as planned and they will rendezvous with the space station in about 24 1/2 hours from now. >> that's unbelievable. this is something we're just kind of talking about, just think of what this entails and just how much technology and also just, you know, jose, i'm thinking, much of this launch includes the actual astronauts participating in it. what is it like for you, what do you think back when you think back of these moments that right now these two astronauts are going through? >> well, it is very exciting. including to the point where you get on the ship and you find out you're not going to launch. that happened to us. we scrubbed our launch a couple of times and that's normal because nasa takes safety very serious and for us the third time was the charm, and here, after years of delays, boeing finally delivered to nasa the starliner and i have two of my colleagues up in space and i know they're all giddy, but they have a lot of work to do between now and talking to the international space station. in our case, we had to prepare for external tank separation, they're going to separate from the engine and then we had to activate life support systems and then check our navigation and make sure we were on track to actually talk to the international space station. >> and, tom, so the -- every single step of this is critical. but there are some steps that are really of major concern. it seems, tom, as though this meco was the last really important one of the initial part of this mission. >> it is critical. we're coming up on the next one, in about ten seconds here. it is going to be separation. so you're going to see the crewliner spaceship separating from the booster and that's a critical step. starliner is now on its way and will be firing its own rocket to get its own engine i should say to get it all the way -- separation. >> that's incredible. that's incredible. >> perfect. >> what are you thinking as you hear these communications? >> i'm thinking, man, i wish i was up there. that's what i'm thinking. i'm being honest with you. but i'm so happy for sunny williams and butch wilmore, two good friends, i trained with, i flew jets with butch and was a c squared, we prep the vehicles, the shuttles before every launch and we ingress the crew before they launch before it was my turn to fly. i know these guys very well and they're excited to get to the international space station. and then what is going to be very interesting is how they come back home. they're going to come back with a capsule, parachute, land in the desert, and i'll be curious to see what kind of forces they encounter as they come in and they land. that's going to be very exciting. that's the only thing different from my mission is that we landed like an airplane, glider, if you will, and they're coming down in a capsule with some parachutes and lots of delays, but, you know, nasa takes safety very serious, and so does boeing and i commend them for not succumbing to public pressure of just getting it out in order for the sake of getting it out. and they did it the right way. and i applaud them. >> can i make the point, nasa has hired boeing for six of these missions to the space station. they're five years behind schedule. make no mistake about it, spacex has eaten boeing's lunch. boeing is well behind schedule, well behind spacex, but they have a contract for six more flights to the space station. and why is this flight important? it is a test flight. there are only two astronauts on board, instead of a normal contingent of three to four to five, whatever they decide to do in the future. they're going to try to demonstrate that they can manually fly this spaceship, that will be butch wilmore's assignment. they want to make sure they can manually fly it, not just on computer auto pilot and want to demonstrate and test the solar arrays, this will allow for powering the sparliner spaceship. i want to make the point, starliner is the spaceship at the top of the rocket and underneath that rocket is the atlas 5. one of the most successful rockets in the history of the entire space program dating back all the way to the 1960s. so, what's new is that spaceship on the top, as it is on its way to the space station. >> and, tom, real quickly, what happens to the rest of that rocket as it separates and you see all the things that happen before. all the different parts, what happens to them? >> so, let me explain using where i am as an example. this spot along the border between san diego and tijuana is where they gather migrants before they're detained and processed. yesterday we saw 70 or so people crossing the border at this point from multiple countries. today, a much smaller group, a single group of eight people all of them from ecuador, waiting on the other side of the fence to get picked up by the border patrol. i spoke to a number of these guys this morning, monday of them were aware that this executive action had taken place. they learned about it this morning, from me and other reporters here on the scene. now, the fact that they are here tells you the way this is being talked about in washington as a shutting down or a sealing of the border is not exactly accurate. migrants can still set foot on american soil, they have to be an hended, and processed through removal proceedings. crucially because this executive action does not include any kind of new agreement with mexico to accept summary expulsions back into mexico without due process, it is likely that the immediate impact of this will be somewhat attenuated. if there is a substantial drop, it is probably not because of the executive action itself. it is probably because often migrant smugglers on that side of the fence in mexico, when there are big policy changes on the border, big crackdowns, they take a wait and see approach. this is what happened after title 42. they take a step back, don't send any migrants across the border as they try to figure out the way the new policy is going to work out. if we see a substantial drop in the numbers, it is likely due to that and will take some time, weeks, maybe months, to realize to understand exactly what the actual concrete practical effects of this executive action are. which is also dependent on whether or not it gets stopped in court. jose? >> david, so many -- i want to stay with you for a bit, because, you know, just you being there and showing us what the reality is on the ground is extraordinary. i'm wondering, cartels will always find a way to make more money and to exploit human beings even more depending on how they see the fluidity going. it is not going to stop. so, david, and where you have been has seen an increase in the number of people crossing in. used to be through texas. now through california and through arizona. but i'm wondering, what do the folks that you speak with, those ecuadorian eight people that you spoke with, what do they tell you about why they decided to do this and do you think that either mpp, under trump or title 42 or this new executive action, is that going to deter anyone? >> reporter: that is the million dollar question, jose. i think we have seen over the years as you said that crackdowns often what they do is they push migrants deeper on the ground and further into the hands of cartels. i've spoken to a number of u.s. law enforcement officials recently who told me that the cartels are becoming much more directly involved in migrant smuggling. now they're getting directly involved in the business because it has gotten more lucrative and also becoming more violent. now, the ecuadorians i spoke to this morning, they all left ecuador because of the rapidly worsening, very severe security crisis in that country, gangs are becoming increasingly powerful, a lot of them are people who are small business owners, taxi drivers, things like that, getting extorted on a daily basis, receiving threats to their families, the kinds of stories we have been hearing for a long time. the question of whether crackdowns on the border deter people has over the years actually a pretty clear answer. and the answer is generally speaking no. that bears out in the data. there are often temporary effects on the numbers, we see numbers go down for various reasons and usually historically what we have seen is they always climb back up. the record numbers we're seeing now are part of a longer trend that predates the biden administration, even though it peaked under his watch. >> david noriega, thank you very much. appreciate it. i want to turn to the el paso mayor. it is also a pleasure to see you. i really thank you for your time. you were invited to the white house for this announcement. we talked for years about the impact of the humanitarian crisis on your city, for example. why do you support this? >> jose, it is -- if you remember, you and i have been out on the street, you have done interviews with me in el paso, on the street, when we had 2,000, 2500, 3,000 a people a day coming into el paso. so it is really important that we continue to make sure that we can provide a safe entry into our community and by doing this, it allows them to go through the cvp 1 application and when they come in, they'll be able to go to work immediately. that's one thing we have been working very hard with secretary mayorkas and the administration to allow people to go to work without a bipartisan agreement. they don't have any funding to get additional judges. we need additional judges. they'll be sitting there not working for five years, not being able to have a hearing for five years. so, this really helps the asylum seekers go through a process that they could do illegal entry. the border patrol was -- had to go rescue four people from the desert. we found people that unfortunately have not made it. people have been coming on the trains and losing their lives. this is something that is going to help. without a bipartisan agreement, the immigration process and program will continue to be broken. we need -- this helps us to continue to help the asylum seekers and also our number one priority is safety for our community and our visitors. >> that reality you talk about, mayor, if they come into this country, they have really no real clear path to getting a work permit until today. going forward. and we're talking about millions of people that have that and face that reality. this is what mayor -- eagle pass mayor who was not invited to the the white house told the texas tribune. if he, the president, could have done this all along, why didn't he do this last year when our city got slammed? they closed the bridge. businesses were hurt. our first responders were struggling. why now? i'm wondering, i know you have faced very difficult circumstances in your city and you have tackled it in the best way you know how to. and you're absolutely right, i can't, you know, i think back of the many times you have actually been to the area, you've gone into juarez to talk to officials. why do you think this executive action is important now and why not to ask what salinas asked, why now and why not back then? >> this is only the beginning. this is only a step forward. but why now, because we have been trying for years, didn't just start yesterday. we have been trying for years to get a bipartisan congress and agreement to move forward and still without that, we still don't have a clear path of how we're going to go. but it is something that we have continued to try. we asked for the federal government to be able to give us proper funding, to be able to -- it is not on the back of the local taxpayer, but back in november of 2022, we were spending between 200 and $300,000 a day to have transportation to help the asylum seekers. that's something that we have been working really hard for many years and it is not that we just started talking about it now. it has been for a long time. and, again, we still need to move forward with a bipartisan agreement, so, that's four months ago, got turned down, recently got turned down, and why now? because it is never too late to start. and we need to continue to move forward to not only protect our asylum seekers, but to help other communities around the united states. the governor of new york -- the governor of new mexico was there, the city manager from nogales was there. there was a big group of people, really there in support of this, because we know the impact that is done to our community. and we look at the safety as we're talking about now, the safety of people coming in, they get exploited, the children -- the sex trafficking, there is so many things that have been happening, this really, when you go to the cvp 1 application will really help and control the legal entry into our community, it is something very important. it is not why now. it is we need to continue to do what we're doing today. the president, secretary mayorkas has been a big supporter of making sure that our community and communities like el paso have the resources to be able to do the job of the federal government, and that's something that is really important. el paso and many border cities aare really doing the job of the federal government and without a bipartisan agreement we will not have the proper funding that we need to move forward and continue to make sure that not only our community, but our asylum seekers continue to be safe. >> mayor, always a pleasure to see you, i thank you for being with us this morning. appreciate your time. >> thank you, i appreciate it. i want to bring in lee alert of the aclu. the aclu sued trump over something very similar, though much more widespread. his executive orders on immigration. you now say you're going to sue the biden administration over this action. why? >> we are. we sued, as you said, under trump for a similar policy and i think the administration left us no choice. we think this is patently illegal and i think the biden administration is acknowledging they're on shaky legal ground. we will sue. i want to stress some of the points the mayor made and in your earlier reporting. i think you know and you've been covering this issue for so long that these kinds of policies are not going to deter desperate people from coming. with what he need to do is have a balanced approach. there is two things we can do. one is we can put more resources on the border, more asylum officers, immigration judges, to screen people. families who are coming here are not trying to evade law enforcement. they're coming over the border, they're sitting down and waiting to be screened for asylum. so, we need more asylum officers, not more enforcement. the other thing i think we need is more legal pathways. i don't know a single economist now who says we don't need more workers and more immigrant workers. so let's create legal pathways. and by what i mean by a balanced approach is right now i think if you ask the american people we know that they say immigration is important to them, but if you said to them, well, a family is being persecuted and may be in grave danger because of their religion, they come and they want to seek refuge in this country, should we at least screen them if they're being persecuted based on their religious beliefs? most people would say yes. this current law does not even screen people for asylum if they enter in the wrong place. people don't always know where to enter and the cartels don't allow them to enter at proper places. there is not enough spots to apply at a port of entry and it takes months. so, let's have a balanced approach, we speed up the screening, we have a streamlined process. >> lee, lee -- let me ask you, lee, it isn't a banning of asylum. this executive action is not banning asylum. but it is the responsibility of the federal government and of the executive to define and execute what immigration policy is and is not in the united states. i'm wondering, lee, you know, it seems as though failure from washington means that the ones who were determining and executing immigration policy are the cartels. and you see that all this means it is further exploitation of human beings, men, women and children. so where does that responsibility lie, lee, and who is responsible for acting on immigration? >> reporter: well, jose, we have arrived what the say very significant but also very sensitive moment for the hunter biden trial here as the lead prosecutor for the government has called to the witness stand in the last five minutes kathleen buhle, hunter biden's ex-wife. she is important for the government's case as they try to continue to establish the fact pattern for the most important detail in this case. was hunter biden still actively abusing drugs when he purchased a firearm in mid-october of 2018. we have seen the prosecution lay out a mountain of evidence in the form of data from his laptop, text messages, photos, even his own voice from his audio book in describing the addiction to try to demonstrate he was in fact abusing drugs when he purchased that gun, which is against the law. we also saw this morning the defendant -- the defense attorney abbe lowell trying to do everything he can to insert some reasonable doubt. he was cross-examiing the fbi special agent, asking her to specify the exact dates of various pieces of evidence most of which were well before the october 8th, 2018 purchase date. that's critical because they're trying to show that he may have been abusing drugs prior to that date, that's not in doubt. they maintain some of the purchases, some of the significant cash withdrawals were about purchasing alcohol, which would not be illegal. i talked about this as a sensitive moment for the family. the first lady yet again for the third day in a row is here, present, sitting behind her son, we have seen a show of support from other friends and family members. we talked about that in the context of the first lady as the mother of the defendant, but she is also the grandmother of this family here who are now going to be hearing about their mother and their father testifying -- mother testifying against the father in the case that could see him put in jail. this is all part of why the family and the president, so many close to the president are concerned about the effect this trial could have. >> joyce what are you watching out for today during this ex-wife testimony and what the fbi agent talked about? >> right, so i think mike is dead on the money here when he says that hunter biden's lawyer abbe lowell has been trying to inject reasonable doubt into the minds of jurors. that's always the defense lawyer's job. we talked about that a lot, looking at manhattan and the trial of donald trump. and defense lawyers are looking very often for one or two jurors who will hang up the jury, who will refuse to convict. so, this issue of whether or not hunter biden was an active user, active addict when he purchased the firearm is very important. it will interplay into the mens rea, the state of mind he had to have when he bought the gun, knowing at that moment in time that he was an addict. but the government has as mike says a mountain of evidence on either end of that transaction. prior months, subsequent months, and they'll try to use the testimony of his ex-wife to establish that he was addicted when he purchased the gun. we already have seen abbe lowell, hunter biden's lawyer, trying to push back a little bit, focusing on the point in time where they separated. so, all of this plays out as a very delicate dance in the courtroom. >> and, joyce, the prosecution played portions of hunter biden's memoir, which he narrated himself. here is some of what they heard. >> by now, i possessed a new superpower, the ability to find crack in any town at any time no matter how unfamiliar the terrain. i had no plan beyond the moment to moment demands of a crack pipe. >> how does the jury -- a jury receive this and what is its relevance? >> yeah, it is very interesting evidence from the government's point of view. it is probative on this issue of biden knowing that he was addicted and as such was a person who was prohibited from purchasing a firearm. again, the defense will use this to portray hunter biden as sympathetic. as someone who lacked the requisite knowledge of what he was doing at the point in time when he purchased the firearm, how it lands with the jury is something we won't know until they complete their deliberations. >> mike memoli, thank you very much. joyce, if you would, stay with us for another story we're also following, just moments ago, manhattan d.a. alvin bragg's office filed their opposition to a request by donald trump's legal team to have a gag order lifted in the criminal hush money case. on tuesday, trump attorney todd blanche said basis for the gag order no longer exists and now that the trial is over. so, joyce, what are the odds that judge revokes this gag order and what does alvin bragg's position weigh in on that decision? >> reporter: the objective in schumer's words is simple, to codify protections and access to contraceptives. anything that prevents pregnancy. we are talking birth control pills, iuds, condoms. listen to how senator schumer presented it as he kicked off the senate floor today. >> this is a simple bill and a simple vote. if you believe all women deserve to have contraception, then you should vote for this bill. that's all there is to it. >> reporter: that might be what schumer says is the only thing to it. certainly, most democrats that i speak to agree. of course, this is one of those issues that will likely break down along partisan lines. we will see that vote later this afternoon. of course, this is really meant to be a messaging vote. it's something elizabeth warren said was meant to show where republicans are on this issue, which is not related to the larger debate around abortion care. this specifically relates to preventing pregnancy through other mechanisms. >> ali vitali, thank you. it's good to see you. i don't have the time right now, but i know you were in madrid. i want to talk to you about that later. >> we can talk taylor swift all day, my friend. >> it's good to see you. with us to talk about the other part of it, paula ramos and matthew dowd, chief strategist for the 2004 bush/cheney campaign. it's completely one of the main issues on people's minds. how much do you think that is going to be what they keep in mind when they go vote in november? >> huge. think about the discussions that you were having yesterday around immigration and how perhaps the issue of immigration could be president biden's weakest point. here we have reproductive justice, which will mobilize justice. it's not this foreign issue. it's not based on perception. it's not based on other folks. it's based on people's body autonomy. over six states have supported abortion rights at the ballot. we have talked about the fact that latinos list abortion as one of the top issues. what's happening right now is that at least one in five american voters are scared that this right to contraception, a fundamental right to privacy, that that right can suddenly be taken away. it will absolutely mobilize people and perhaps outweigh the negatives that this immigration issue has caused. >> matthew, talking with paola, the issue of abortion has been put on the ballot in many states for november. how significant will this be? >> i think i agree. it's going to be very significant, because ever since the dobbs decision, in every single election that's been had, whether it's the midterms, the presidential or in special elections, it's been an important factor in what the turnout has been and what the results have been in this. i would also add in this, a lot of people try to classify this as a women's issue. women are particularly owe fent -- offended by taking away women's freedoms. it's also a men's issue. this is an issue that broadly affects the electorate. you need to motivate democratic voters, which is profoundly important for. two, independent voters who overwhelmingly are worried about this reproductive freedom. the other part is you can wrap the abortion issue and reproductive freedom into a broader issue of preserving democracy and your own freedoms, whatever those freedoms happen to be. >> yeah. paola, let's talk about the issue. this comes the same day that president biden rolled out his executive action on immigration. on first day of his administration, the president stopped construction of trump's border wall, rolled back so many other of trump executive actions. what do you make of this new executive action? >> i think you said it right now, it's so remarkable to think about how we got here. this is a president that before he started his administration said he wanted to reinstate the united states as a safe haven for migrants and asylum seekers. he is the same president that said it was inhumane. he started his first days talking about comprehensive immigration reform, how to end mass deportation. here we are almost four years later with a president contemplating -- not even contemplating, that is willing and ready to shut down the border. the idea of those four words, shut down the border, that language is too close to trump. it's simply too close to trump. that is why to me it's a remarkable moment, to take a step back and understand how did we get and is it worth it? >> matthew, the fact is that this executive action will no doubt play a part in mitigating in many ways the republicans' criticism of the president. let's talk about some of that criticism. he is getting it from both parties. here is some of what people have had to say. >> why did you wait until now if you were serious about doing it? the simple answer is, he's not serious about securing the border. >> too little, too late. mr. president, joe biden, this is too little, this is too late. >> it is extremely disappointing that this white house would choose to double down on the previous administration's harmful and flawed immigration policies. >> matthew, there are up sides politically for president biden on this issue. >> well, you know, this is an issue that we needed to solve for 30 years, comprehensive immigration is important in this. everybody who is rational in this knows that needs to happen. joe biden knows it needs to happen. he keeps running into a brick wall. i find it hypocriical and ridiculous of republicans to criticize the president when the president tried to pass bipartisan immigration reform and a border bill. they stopped it. it's akin of somebody is -- your house is on fire and president biden says, let's get together and put the house out and the republicans cut off the water supply and say, why aren't you putting the fire out? that's what's so hypocriical about this. joe biden doesn't feel like in his campaign that this will be an advantage for him. i think he wants to neutralize a big advantage that donald trump has on this issue. i think he is as frustrated as all of us, as many people. he wanted to do it through legislation. but because of republicans, he felt his only step in an issue that's important to americans, to at least do something. >> i keep thinking about the extraordinary reporting that you have done for so many years. i think of the people that you met when you covered and you did a story and the women that have been exploited and just the things that people have gone through and continue to go through just to look for the opportunity to be in the united states. i'm thinking, what -- where are those people represented and spoken about?
