released by hamas, after a last minute agreement to extend the truce by one day with the clock running out to renew the deal. could this latest attack, could it complicate future deals down the line? in a moment, i'm going to speak to former secretary of defense, leon panetta. and moments from now, secretary blinken expected to speak after a whirlwind day of diplomacy in israel and the west bank, as idf tanks wait near the israeli-gaza border. i want to begin on the ground, with breaking news with nbc's david noriega. good to talk to you. we have new information about the man whose story we shared with folks ten minutes or so ago. what more can you tell us? >>. >> hi, yeah, so liat stzilli was the u.s. citizen released with the agreement we have been all been following for the last week or so. when we saw liat released yesterday, we were all under the impression that her husband aviv was being held captive. however, we heard earlier today that there was information that he had been killed on october 7th and we just received confirmation of that fact from the family who received that information from the israeli authorities. so this is a family that was in kibbutz nir oz in the south of israel. it was believed that, again, it was believed that liat and aviv had been kidnapped and held separately. the family was informed today that aviv was, in fact, murdered. this is the way that the information has worked throughout this conflict. we know everyone operates under one impression about the whereabouts of individual people and suddenly it changes at the hardest and most vulnerable moment. >> very devtang for that family. let's talk about two of the other hostages that were released. the names being released today as well. lk to me more about what we know of them. >> yeah, so there have been two hostages released so far today, 40-year-old amit susanna and mia schem. she was kidnapped at the nova music festival. we actually -- nbc news spoke with her mother karen schem in advance of her release, before we knew she was going to be released. we never know who is going to be released until the moment they are released. this is what karen schem had to say looking forward to the eventual reunion of her daughter. >> i don't think i will speak, i will just hold her and hug her. i won't ask questions, that's for sure. and i just want to hold her. >> reporter: these are two hostages out of an expected ten that we are waiting to see released tonight. as you pointed out, the cease fire has been extended day by day. we are aware that there are diplomatic efforts to extend the cease fire for an additional two days, allowing for the release of an additional 20 hostages. we do not have confirmation that that extension has actually taken place. that is the main thing we're going to be paying attention to here on the ground in the hours to come. >> and there we were sharing the video after we played that sound, david, of the family finally embracing once again, a mother and daughter reunion. david noriega for us, thank you so much. i appreciate it. i want to bring in allie raffa from the white house. secretary blinken, allie, is expected to speak in a couple of minutes. israel, west bank today, he is said the pause in fighting has produced some results. we also just heard from john kirby at the white house press briefing as well. what is the white house's plan here to possibly get an extension on the cease fire, and a release of more hostages? >> yeah, yasmin, admiral john kirby joining the ongoing white house press briefing saying at this point it's still unclear whether more hostages will be released by hamas after the two israelis that we saw released earlier today, saying that there is still hope that one american woman who is among the eight americans being held inside gaza will be released today. she, like the two other americans that we have seen released since sunday, meeting those terms of release under this cease fire deal. here's kirby talking about the difficulty of achieving the extension of the cease fire. >> i know one of the first questions i'm going to get is what are the chances of an extension, i can't tell you that right now. we're working on it literally by the hour to see if we can get the seventh day turned into an eighth and ninth and tenth and beyond. >> reporter: white house officials, including kirby, saying their challenge is not knowing the exact location and conditions of all of these hostages, also saying they are unable to confirm whether hamas is holding all of them, saying it's possible other terrorist groups within gaza are holding these hostages. kirby saying on the briefing that the onus is on hamas to identify the hostages to get them to safety during the cease fire deal. it's complicating the efforts to extend the cease fire. administration officials are hoping by extending this, this not only allows for the release of more americans but simply more categories of hostages to be released. more men, more men and women in the military. more potential humanitarian aid to be allowed to flow into gaza. so kirby, other administration officials stressing to us at this point that those efforts are still ongoing, those efforts are still tirelessly being tried on the ground for us. >> i want to bring in former secretary of defense and ex-cia director, leon panetta, thank you for joining us, sir. appreciate it. i want to talk about the multiple things going on. you have this shooting at a bus stop in jerusalem, all of that happening while ongoing negotiations are happening, being shepherded by qatar for an extension of the cease fire, and an exchange of hostages. what is the likelihood we'll see an extension, seeing how things are flaring up overseas. >> there's no question, the closer we get to the deadline and the more incidents that take place with hamas that it gets much toucher to try to extend the deadline. obviously i'm sure there's a lot of efforts to try to provide that extension, to get additional hostages. but the problem is that with hamas conducting these raids and attacks, it's going to make it much more difficult on israel to try to agree to any further extension. so i think it's going to be difficult. >> so john kirby in this press briefing just said, as you mentioned, that prime minister benjamin netanyahu, will, in fact, resume this war, and the u.s. will, in fact, support it. there is no question about that. and the secretary of state, tony blinken, has reiterated that as well. he also said the united states will not support a move to the south where they believe leaders of hamas are hiding out, unless israel can account for civilian life. can you talk about what you think that may mean and how it is that the united states can feel sure that israel will avoid yet another mass casualty in southern gaza. >> obviously if the war continues now, there's a lot of questions about how it will be conducted, and, you know, the issue is going to be whether israel goes back to basically bombing southern gaza, and, you know, costing a lot of additional palestinian lives or whether it will be a more targeted approach. i think the united states is urging israel to take a more targeted approach. i happen to agree with that. i think a more targeted approach where you identify hamas targets and then go after those targets, similar to the kind of counter terrorism efforts that the united states conducted against al qaeda. i think that makes a lot of sense here. it can limit the amount of civilian casualties that take place. in addition to that, i think they do have to continue to provide humanitarian aid to those that have been impacted. so if israel can agree to a more targeted approach, going after hamas, going after their leadership as they should, and at the same time, being able to provide humanitarian aid. i think that's probably the best course for israel to take. we'll have to see. they're the ones who will make the ultimate decision here. >> what would a more targeted approach look like? i know you gave some examples, if you could talk more about that, and do you trust prime minister benjamin netanyahu to take that targeted approach? he's in the mindset to take that targeted approach. >> well, i think he's got to give it consideration. i think he is. i think the more targeted approach is very similar to what we did going after al qaeda, which is to basically use intelligence, use the best sources possible to identify where hamas's leadership is located. and then using special forces techniques, be able to go after those particular targets. it worked pretty effectively for us in undermining al qaeda's leadership. i think that israel can hopefully use some of the same tactics. now, it's not going to be as easy. there are a lot of tunnels in southern gaza that have to be dealt with. there's a lot of places where hamas can hide and where the hostages can be placed. it's going to be a lot more difficult. i think it does depend on a process of getting good intelligence now. getting the kind of intelligence you absolutely need in order to identify targets rather than just bombing the hell out of the place. >> leon panetta, thank you for now. i'm going to ask you to stay with us, if you will, we have more for you coming up. one of the most influential and controversial figures in the history of american policy dies at 100 years of age. a look back at henry kissinger's life and legacy in just 60 seconds. in just 60 seconds. (vo) make the switch. it's your business. it's your verizon. my frequent heartburn had me taking antacid after antacid all day long but with prilosec otc just one pill a day blocks heartburn for a full 24 hours. for one and done heartburn relief, prilosec otc. one pill a day, 24 hours, zero heartburn. now to the passing of a monumental figure in american diplomacy. former secretary of state henry kissinger died at the age of 100. we're going to talk to leon panetta, andrea mitchell is here with a look back at henry kissinger's life and legacy. >> henry kissinger is being remembered as a towering figure in american diplomacy. >> i think we made further patrol prog. >> brilliant and controversial, the former secretary of state reshaped foreign policy under presidents nixon and ford. with nixon, he helped ease tensions with the soviet union and conducted secret negotiations with china, spearheading nixon's historic trip to china in 1972. he also negotiated an end to the vietnam war but declared success prematurely, just days before the 1972 election. >> we believe that peace is at hand. >> those negotiations won him the nobel peace prize, but kissinger had legions of critics. some calling him a war criminal for bombing cambodia and prolonging the vietnam war. born in germany in 1923, kissinger's jewish family fled the nazis in 1938. he attended public schools in new york city, returned to germany with the u.s. army in world war ii and later earned a ph.d. at harvard where he became a professor, attracting the attention of president nixon, kissinger first became his national security adviser, then secretary of state. the only person to ever hold both jobs at the same time. >> there is no country in the world where it is conceivable that a man of my origins could be standing here next to the president of the united states. >> there's no real disconnect in the sense that the white house is speaking with one voice when they say that their support of israel is unequivocal. if lawmakers were weighing just the idea of funding for israel, they might have an easier go of it. to ryan's great point, they're not. the white house linked this series of sweeping funding proposals, money for israel, money for ukraine, money for taiwan in the indo-pacific, and also money for the southern border. and the thinking was by linking all of it, you increase the chances that all of those policy proposals, funding proposals passed. they thought they could dangle money, the wrinkle there is that now republicans are saying they not only want the money, they also want changes to immigration laws, and that is a nonstarter for democrats. so this is a real fraught issue, and as is so often the case with congress, there is a timing dynamic here, too. you've only got really about two weeks in december for lawmakers to get this all together and done. >> geoff often likes to tee me up. ryan, pick up on that, if you will, and talk about the time ing of all of this. we have been talking about aid to ukraine and israel, israel, since the october 7th attack, what is the timing of all of this? >> reporter: there isn't a specific deadline. i did quite a bit of reporting before the thanksgiving break. basically all the players involved told me that the only way the package gets done at least in the form and fashion that the white house is looking to get it done is if they get it done before the christmas break, in large part because when they return from that holiday break, they're going to be met with another funding deadline. we could be talking about a government shutdown again, and if you're trying to take an already complex negotiation over the supplemental package, and then include it in a long-term global, more wholesome spending package, that's going to make it that much more difficult to get over the finish line. while there isn't a specific deadline, there's a sense of urgency that essentially the slate is clean. they don't have to worry about the government shutting down between now and christmas. the issue is they're far apart when it comes to an agreement. >> john kirby didn't want to elaborate on the ongoing conversations the president has been having with prime minister benjamin netanyahu, but from your reporting, what can you tell us about the diplomatic talks that have been had, considering the fact they say we will support israel no matter what, when they resume the war, however, they must account for civilian life, to go after hamas. how do they walk that line? how are they walking that line? >> you know, it's interesting. the administration officials have said that they have been very clear with israel that they should guard against any sort of military offensive in southern gaza without having a plan to limit the impact on civilians, and the civilians suffering. and this goes back to the question that you started with at the top of this segment about placing conditions on funding for israel. the democrats who have argued against it make the point that the administration is already engaging with israel on this issue of how do you limit the impact on civilians, and the thinking is that if any of this money, any of the funding or support does come with conditions, then you lessen the leverage that the president has when he is having at times these fraught conversations with prime minister benjamin netanyahu, yasmin. >> geoff bennett, thank you, ryan nobles, thank you as well. coming up next, one of the representatives leading the push to get congressman george santos out of congress joins me. we'll be right back. we'll be right back. who's winning? >> i do. there's no question that we deserve to expel george santos. both republicans and democrats are going to come together and do the right thing. what we first forced the first expulsion votes, republicans wanted to do the ethics report. the report is out. it's damming, we have heard from delegates across the country, this is very serious criminal activity. you can have a bipartisan vote tomorrow, and it's honestly on all of us to ensure we expel him and restore integrity to the house. >> you said it, the ethics report is out. republicans wanted the report out. his conduct is now out. what do you say to the folks wanting to keep him? >> it would be crazy and insane to keep george santos in the congress. he has stolen essentially campaign funds for his personal use, for makeup, botox, trips around the country. he has lied on all of his forms. he has turned his back on the constitution and the oath he took as a member of congress. if you can't expel a member of congress for what he has done, why do we even have expulsion proceedings. i remind my colleagues of one more thing. he still faces multiple counts in a court of law, and will likely end up in prison for what he has done, which is separate from this process that we're going through right now, and so we should expel him, and quite frankly, he should resign, and focus on the trial he has ahead. >> what do you say to speaker mike johnson who says he's concerned about this vote, and it could set a dangerous precedent? >> i think the speaker should do the right thing, and vote not just to expel george santos but encourage members to do so as well. he's someone who values, he has talked about his own morals and what he believes is right and wrong. this is a moment right now to focus on truth and justice and doing the right thing. this is a fraudster, a liar, a conman, has no business being in congress. and i believe most of the republicans i have talked to, they want him out of congress. they just need to be honest about it, be public and cast the vote to expel him. we're working hard to get the votes there, and quite frankly, if republicans somehow saved santos for a third time, that's going to say a lot about the modern republican party today. >> amidst this press conference that happened earlier today from george santos and all that he said, he also said he's going to introduce this resolution to expel congressman jamal bowman for pulling the fire alarm in one of the house office buildings, what's your reaction? >> ridiculous. listen, he is, at this point, pretty delusional about what's happening. i don't know that he is taking this process seriously. he's going to be filing expulsion resolutions, talked about filing multiple ethics violations today. at the ethics office against his own colleagues. he's going it pull all sorts of stunts between now and the vote tomorrow. i expect nothing less. this is someone who has tried to turn this into a media opportunity. we are ready to do the right thing, the serious thing, and that's expel him, and part of that is restoration of some of the integrity of this house of this institution, and so i've told my colleagues that we need to do the right thing, and i think the majority of them will. >> what do you say to folks that are watching, americans at home, looking to get their bills paid, looking to have a happy holiday, wondering if the economy is going to stay on track, hoping their keep their jobs, and then they're watching this all go down, and saying this is just infighting, once again, and they're avoiding doing the work for the american people. >> well, first, i agree with them. i think we should be focused on that work. we should be focused on prices and making sure we bring health care for the american people. we're focused on the debt around student loans. what we don't want to do is spend all of our time having to deal with all the lies, fabrications, and mistruths of george santos. he is someone who gets and has access to the important work we're doing to classified information. he's voting on issues of war and peace. this person is a complete fabrication he has created for himself, and we have to do the right thing and expel him while also doing the people's work. >> i want to talk about the immigration bill. democrats presented republicans with an offerover border policy, i believe, provisions they would be able to support in hopes of unlocking this supplemental funding bill including aid for ukraine. what do you make of this? >> look, i think it's a huge mistake to link funding for ukraine, israel, taiwan, whatever the final package looks like to a draconian border policy. i stand with so many of my colleagues who believe there should be separate bills and votes. we're happy to have a discussion and debate about immigration, about the border, doing the right thing to people seeking asylum in the country. we should not gamble and play politics with the important work and debate we've got to have around our national security interests. we don't have an official proposal yet but we'll look at it seriously. there needs to be separate votes, and we should focus on the national security issues and immigration separately. >> congressman robert garcia, thank you, sir. >> thank you. a migrant surge leaving federal and state officials struggling to find the best path forward. the real struggles young migrant children are now facing. that's ahead. ow facing. that's ahead so now, do you have a driver's license? motion to subpoena passed with 11 democratic votes. no other senators voted because republicans walked out during the vote. before the vote, senate judiciary committee ranking member, republican lindsey graham had some, quote pointed words for democratic chair, dick durbin. >> i don't buy anything you just said. let's just be real blunt and direct. this is garbage. the subpoenas are never going to see the light of day. i don't know who's driving the train on your side, but you're driving the committee off into a ditch. so this is a joke. a complete joke. >> lindsey graham saying this is a complete joke. sahil kapur joining us now on capitol hill. walk us through more of what we heard in the heated hearing. >> reporter: things got a little bit dramatic. the senate judiciary committee, the democrats on the panel voted to authorize subpoenas for these two men. there is harlan crow, a republican mega donor who has financed trips for justice thomas. and leonard leo who coordinated travel between justice alito. democrats say the two men have been stone walling their investigation for months. democrats say this is about restoring confidence in the supreme court. they accuse these men of using their wealth to gain secret access to the justices and get them to do their bidding. republicans have a very different view of. they say this is simply democrats having sour grapes over the fact that the court is now more conservative than they want it to be. one of the republicans on the panel, john cornyn accused democrats of destroying the senate judiciary committee, and lindsey graham got more heated than what you played. let's show more about where he thinks the subpoenas are going. >> we'll play this game for a while, nothing will happen, the subpoenas never get issued. the bill never gets voted on. but, it's important enough to destroy the committee. >> reporter: now, the vote was 11-0 because republicans walked out right before it happened. what lindsey graham is talking about that democrats can issue the subpoena on their own, but it will take 60 votes to enforce on the floor, and republicans, he made clear, are going to filibuster any attempt to enforce it. we have statements from leonard leo and harlan crow defiant about leo saying, quote, i will not cooperate with this unlawful campaign of political retribution. harlan crow calling this an invalid subpoena, an unlawful and partisan investigation. they know they have the support of republicans to essentially ignore what democrats are asking of them. >> sahil kapur for us. thank you. from here, we want to stay at the capitol. i believe now the debate is beginning on whether to expel george santos. the clerk is currently reading the resolution, let's listen in. >> violations of federal law and the rules of the house, related to unfiled 2021 and 2023 financial disclosure statements. representative santos failed to meet his duty of candor with respect to the isc's investigation whereas on may 10th, 2023, representative santos was charged in federal court in the eastern district of new york with wire fraud in connection with a fraudulent political contribution scheme. unlawful monetary transactions in connection with the wire fraud allegations, theft of public money in connection with his alleged receipt of unemployment benefits, fraudulent application for and receipt of unemployment benefits, and false statements in connection with his 2020 and 2022 house of representatives financial disclosure statements. whereas nancy marks who served as treasurer to representative santos's campaign pleaded guilty to conspiracy to commit wire fraud, falsifying records and identity theft in connection with the santos campaign. whereas a superseding indictment was filed on october 10th, 2023, charging representative santos with additional violations related to his 2022 campaign, including allegations of falsifying reports, in connection with a $500,000 personal loan that was never made, falsifying the names of contributors to his campaign. engaging in aggravated identity theft and access to vice fraud, and enriching himself through a fraudulent contribution scheme. where sam, who served as a fundraiser to representative santos' campaign, pleaded guilty to a federal wire fraud after associated for the purpose of soliciting funds, whereas the isc that was established to review the allegations against representative santos adopted a report of his findings, and submitted the report to the full committee, whereas the committee on ethics of the house unanimously voted to adopt the isc report based upon the invest providing substantial evidence that representative santos, one, knowingly caused his campaign committee to file false or incomplete reports with the federal election commission, used campaign funds for personal purposes. engaged in fraudulent conduct with red stone strategies llc, enas it relates to his financial disclosure statements. two was a knowing and active participant in the wrong doing, and three, was given an opportunity pursuant to committee rule 17b to submit a signed written statement responding to the allegations raised in complaint filed by his fellow members but did not do so, where the isc, one, requested that representative santos provided all information. two, representative santos voluntarily testify but he did not so do, and three, provided representative santos the opportunity pursuant to committee rule 19b3 to provide a statement under oath but he did not do so. a member of the united states house of representatives, representative santos must be held accountable to the highest standard of conduct in order to safeguard the public's faith in this institution. whereas the constitution of the united states charges the house with policing the behavior of its own members and the house should take action against representative santos commiserate with his violations of federal law and the rules of the house. and whereas given his egregious violations, representative george santos is not fit to serve as a member of the united states house of representatives, now therefore it be resolved that pursuant to article i, section 5, clause 2, george santos be and hereby is expelled from the united states house of representatives. >> the resolution qualifies pursuant to clause 2 of rule 9, the gentleman from new york mr. dees, will each have 30 minutes. >> thank you, mr. speaker, we are here this afternoon at a point that none of us wanted to ever be at. but the ethics committee of the house of representatives has filed their report which revealed a complex web of illegal activities that involved representative george santos's campaign. his personal and business finances. santos tried to exploit every aspect of his candidacy for personal financial gain. records subpoenaed by the committee on ethics show that congressman santos stole from his campaign by deceiving donors and to providing contributions that were actually payments for his personal benefit. santos also reported fictitious loans to his political committees to induce donors and party committees to contribute more to his campaign. keeping the elaborate scheme moving forward. george santos is a liar. in fact, he's admitted to many of them who has used his position of public trust to personally benefit himself from day 1. santos now faces 23 criminal charges in connection with his long list of misdeeds. we have already seen two former santos staffers including his former treasurer plead guilty to federal charges in connection with santos's corrupt campaign, despite blaming others, including his former treasurer for the numerous campaign violations, all signs point towards mr. santos that he knowingly and actively participated in a widespread misconduct of his campaign. in fact, the ethics committee report records demonstrate this to a t. george santos has continuously said that he has not received his due process. i asked my colleagues, if we do not take the ethics committee and their results seriously, then why even have the committee in the first place. through the isc investigation, santos has been awarded due process, and has been provided ample opportunity to be heard during both the investigation by the house committee on ethics and throughout the expulsion process. even after being offered multiple opportunities to present his side of the story, mr. santos refused to engage with the ethics committee in good faith and refused to cooperate with those tasked with leading the investigation. the isc report notes that he failed to submit a written response to the allegations. failed to provide numerous documents requested, refused to testify voluntarily, and failed to provide a statement under oath. santos also informed the committee that if he was subpoenaed, he would plead the fifth. we continually hear that the expulsion of congressman santos would set a new precedent, and mr. speaker, it would. and to my colleagues that have said that it would start a new precedent, to those that are here with us in this institution, in this great chamber today, that are arguing about precedent, i simply ask you this, the american people expect us to do the right thing. the american people are watching for us to do the right thing. and if we have an opportunity in this great institution to start a new precedent, one that means we hold members of the house of representatives to a higher standard, well, ladies and gentlemen, i'm pretty confident that the american people would applaud that. i'm pretty confident that the american people expect that. and i hope that tomorrow in this great chamber, we set that precedent, mr. speaker. we set a precedent that we as members of america's oldest institution are held to a higher standard. mr. speaker, with that, i reserve the balance of my time. >> gentleman reserves. gentleman from new york, mr. santos is recognized. >> thank you, mr. speaker. every member expelled in the history of this institution has been convicted of crimes or confederate turncoats guilty of treason, neither of those apply to me, but here we are. on what basis must precedent be changed for me, an american citizen, dually elected, elected to represent the third district of new york, i have been convicted of no crimes, mr. speaker. my loyalty to this country that gave me life, liberty and the pursuit of happiness is true and unquestionable. i stand here today debating for the second time, in less than a month for the same exact reasons that were brought up last time, the difference is that one can say i have been indicted once more by the findings of the ethics committee, a process that by the admission of the chair himself was not complete and conclusive because they didn't want to put more time into it. as if this committee runs on a schedule that quite frankly is in a rush. when some members have been under investigation for over five years. some leave while still under investigation, mr. chair. so i am not trying to be arrogant or spiteful or, you know, disrespectful of the committee, but i'm curious to know what is the schedule of the ethics committee? why rush this to deliver a predetermined outcome sought out by some members of our conference? or some members of this body? this is what it looks like to me. it is a predetermined necessity for some members in this body to engage in this smear campaign to destroy me. i will not stand by quietly. they want me out of this body, the people of the third district of new york sent me here. if they want me out, they're going to have to silence those people and take the hard vote. with that, i reserve. >> gentleman reserves, gentleman from new york is recognized. >> mr. speaker, i'm not sure how a predetermined outcome happens from a committee reviewing 170,000 pages of documents. numerous subpoenas, weeks and
