I dont know what was achieved over the last six plus hours. None of the Witnesses Today were fact witnesses. None were involved in the investigation into the alleged activities in the first place. Whats more, none of the witnesses testified today of direct knowledge of what republicans have been claiming about joe biden. Whether its smoke today, we got more smoke. Thats fox news host neal cavuto with the same assessment that came out of yesterdays Impeachment Hearing and came out hearings before, about the inquiry into hunter biden and how joe biden got so fabulously wealthy off his crack addict son. Yeah. Lots of luck, fellas. Okay. As House Republicans failed to produce evidence linking the president to his sons business dealings, were going to have a lot more from that hearing. On capitol hill, it may take a miracle to stop a Government Shutdown right now. Were going to have the latest on any lastditch efforts to fund the government before sundays deadline and were going to show you the big moments from President Bidens speech last night in arizona. He actually focused on the threats to our democracy. You know, that was the idea that was supposed to be such a loser in 2022. That so many people mocked him about. It wasnt. Democrats won. We have a lot to get to this morning including this, a panel has ruled that donald trump will go on trial for civil fraud on monday where his entire new York Real Estate portfolio could be at stake. Attorney general Letitia James she probably has hit his former president where it hurts more than any other legal action against him. You can see it in different mannerisms and reactions among the trump family. Yesterday five judges decided to lift a temporary stay on the start of the Nonjury Trial, put in place while they considered challenges by trumps legal team. The former president s attorneys claimed that some of the charges brought by new York Attorney general Letitia James fell outside the statute of limitations, an argument rejected yesterday. On tuesday, judge Arthur Engoron ruled that former president , his two oldest sons, and be his company itself, were liable of fraud. That means next weeks trial would be how much they pay, which could include aine of 250 million and the possible seizure of trumps new york properties. Yesterday, prosecutors informed the judge that they pn to call the former presidt and his sons to testify in addition to his Daughter Ivanka and former cfo Allen Weisselberg and trumps exattorney Michael Cohen. This is a dramatic turn of events in this week in terms of trumps legal issues, joe, and weve been talking all about whether or not joe biden needs to fight back an talk about the legal cases against donald trump. He made a pretty eloquent speech about democracy and went after the Maga Movement and well talk about that coming up. At the same time one could argue that you let the law play out, and boy is it it ever this week. You know whats fascinating, donny, everyone is focused on the criminal cases, of course, but weve known donald for a very long time, and you just get the sense that a lot of the criminal cases and possibility of incarceration is still an abstract concept to this guy, right. Theres nothing abstract about this. This is his life work, coming in from queens with a huge chip on his shoulder and doing everything he can to build a manhattan real estate empire. And the last few days, especially, with the appeal being rejected yesterday, show him that very soon, that New York Empire is going to be shut down, if things continue in this direction, an he may even be booted from his wall street location, from trump tower. Its being monitored. Yeah. Its being monitored. Its there are a lot of ways this could turn out, but it looks actually like this civil case may be whats hitting them the hardest right now. Great point. And despite him being president of the United States, everything has always been about money for donald. Still comes back to dollars. When people say why is he doing it . We always say follow the money. Its always about running for president , everything, yeah, he likes the attention, but the attention he thinks he can use to generate money. The real reason he ran for president was to get publicity for his business. This hits him in the gut and theres a good chance he will have to divest himself of his properties. He is a man and his Tall Buildings and big buildings and everything is about size. It means so much to him that in a very sick moment of any sick moments on september 11th, 2001, you know, as he was watching the towers go down, he goes, now i have the tallest building oh. That shows you how much those buildings mean to him. You know, there are two things that always meant things to him. The money and at stature with people like the people around this table in the media and people in new york city and l. A. And celebrities. Hes lost both. The money has shrunk and, of course, his standing with outside of tupelo, mississippi. He could not walk into a restaurant in new york city now. Both of those have been taken away. Your point is well taken. To a lot of people going to jail would be the scariest factor. To him the thing that is probably sitting with him right now is his big tall long buildings may be going away. Rev, youve known him for a long time. Would you agree . Absolutely agree. I think the criminal indictments is something that he can spar with, and he feels he may get away with. I think the civil case is an existential threat to him. This is who he is. And his family. And his whole family and his desire to show his dad who is gone that i told you i could be somebody. This takes away any inkling of him proving to dad that he could rise up. I was thinking just yesterday Riding Down Fifth Avenue, i have one grandchild, 4yearold grandson, marcus, one day i will be Riding Down Fifth Avenue with my grandson saying you know that building used to be called trump towers and tell a story. That is the thing that donald trump is scared about. He will be removed from the memory of the next generation because there will be nothing called trump if this civil case goes forward. I was going to say, its really, its already happened even in our time. You know, used to when i lived up in connecticut, i drove up the West Side Highway and as i left you would see seven, eight fwlgs a row, huge buildings, trump, trump, trump, trump, trump, trump. And there would be people that would pay a lot of money to slap his name on the side of the building. Coming into the city 17 and 18 one at a time they were taken down, up and down the highway. Now theyre talking about actually taking trump tower and other towers away from him. By the way, some idiot, idiot, said this is this happens in stalinist nations. This happens in nations where theres rule of law and stalinist nations you say this is a stalinist nation and they take you out back and shoot you. Here, we have a rule of law. And everybody, lets just for people that arent from manhattan that havent lived in manhattan, everybody for years, have known that donald trump has lied about his net worth, has lied about his buildings, has lied on his loans. This is this is no shock to anybody. If this is a stalinist nation, then stalin has been deaf, dumb and blind for like 40 years because this is not a surprise. When he was running in 16 i would say, dont do business with him. He lies and cheats and dont pay his bills. You hear that from everybody. And also, he exaggerates how much hes worth. You cant trust this guy in any business deal. Yeah. This is the trump thats always been. Right. When he was a celebrity Real Estate Developer before he got into politics, i told the story how he renumbered the floors in trump tower to claim they could be tall are than any building nearby. His Business Empire has shrunk. His name has been stripped off buildings throughout the city. He still has a number of golf courses but risks losing those including a few in New York State. Trump tower was his pride and joy, signature building, his home for decades and yes, he is beat up by the way. He only spend a few nights a year in trump tower. He lives at maralago and bedminster. We forget it now, but his First Campaign was about being americas ceo and a businessman. That has dissipated. Now this, so much of what he has done is still about making that money and driving that attention and now huge parts will be gone. Hes going to have to appear next week and stand trial and likely take the fifth. But he will have to appear that this is not surprising to anybody who has lived in new york, even people who voted for donald trump, not surprised by this. When he was selected to run The Apprentice and go around saying youre fired, youre fired, like, you know, im not saying this to be mean, i mean, this was in al the papers. People who ran businesses they laughed and mocked him. The fact that this guy was going to be some big business genius. Therapy laughing. Something he always resented. This is a guy that inherited the equivalent of 400 million from his father and lost it. Well, that attitude that many people in new york, especially people in business, had a 30year run. They laughed at him for over three decades for his supposed business acumen. Whats happening starting monday in new york raises the question, why didnt it begin sooner . Why didnt anyone in Public Office, in power, Public Office, over these 20 to 30 years in the past, why didnt they take we asked that question in real time. Weve asked that question. Its just i dont know if people remember, but i kept asking about Jeffrey Epstein on here. Yes. I would say, whats going on with Jeffrey Epstein . Why is this guy still Walking Around . I dont get it. The other aspect of it is, people will be delighted, many will be delighted when hes on trial beginning monday and say hes finally getting his. He might. We dont know what verdict or they rule, its a civil case we believe, we tonight know what will happen at the case. At the end of all of these federal cases whats going to be left, the damage that donald trump has already done to this country. Its deep and part of it is going to be lasting and irreparable. Thats what we have to figure out as a nation to figure out with that. Joe biden began last night. Well get to that in a second. But again, this is yet i wonder, i always thought if i had one count leveled against me, you know, the fed is coming after me and one count it would be hard to focus on anything than that. He has 91 counts. He has his Business Empire crumbling. Its hard to figure out how this guy who is 78, 77 or 78, hard to figure out how, you know, when i see him confusing 2016 with 2008 and confusing obama with clinton, i mean, i actually i can understand that. Im surprised the guy is even still walking with, you know, 40 years of lies catching up with him all at once. Yeah he. All the bluster and all the projection, theres a lot going on there in that mind of the man were looking at there. Weve talked to Defense Lawyers who some of them sympathic to donald trump said, i might be able to get you off nine counts, but 91, theres going to be something in there that sticks and so hes got to be very worried about that. Also point out on trumps real estate, as donny know, he doesnt really own most of those buildings in new york. He licensed his name. Other people build the buildings. He sells his name to stick on them. Thats a story for another day. Republicans in the house Running Interference for donald trump, the House Oversight Committee Held its first hearing yesterday in the republicanled Impeachment Inquiry into President Biden. Not a single witness called by republicans confirmed any evidence that President Biden has committed a crime. Im not here today to even suggest there was corruption, fraud or wrong doing. In fact, i do not believe that Current Evidence would support articles of impeachment. You mentioned in your oral testimony that you had written a commentary you would go to prison for what biden did. He would go to prison for what hunter biden did, suspect isnt that right . Thats exactly right. I was cutting down words thats an important word you left out. It is. None of the witnesses during six plus hours involved in the investigation into Hunter Bidens business dealings, they werent involved, they were not fact witnesses. They were analysts but they suggested more bank records are needed from President Biden and hunter biden to determine whether a crime may have been committed or worthy of impeachment. House Oversight Committee james comer has deemed his staff Essential Workers. That means if the government does shut down and looks like were headed that way, their work on the Impeachment Inquiry into President Biden will not be interrupted. Jackie alemany, your reporting on this hearing, walk us through a little bit of what we saw yesterday and then that detail at the end, which is the government looks like its going to shut down at midnight tomorrow night, but james comer is protecting his staff and the people we saw in the room yesterday. Yeah. It is sort of ironic yesterday this big hunk of red meat that Kevin Mccarthy threw at his house gop conference to try to placate and steer them away from a Government Shutdown is now going to be not only ineffective, but one of the only things that stays open and taxpayers will continue to pay for, despite nine months of investigative work that has borne no fruit whatsoever, no new evidence connecting joe biden to any of these allegations that a james comer made yesterday presented at all. Even by these handpicked gop witnesses who comer had assumed would vouch for this investigation. But you heard all of them say, sure, you can do you want to do an Impeachment Inquiry, there are enough questions you can open an inquiry but there are certainly not enough evidence, nothing that arises to High Crimes And Misdemeanors for the house gop conference to continue with any sort of impeachment articles. I have senior gop aides yesterday texting me mid hearing they were astounded at the way the hearing was playing out, that they couldnt believe that comer and his staff had actually called witnesses who they assumed would vouch for their narrative who instead did the opposite and said that comer lost control of the hearing, that he allowed democrats to sort of discredit and attack the witnesses as well, and poke holes in the arguments that they were making, and that the Media Narrative as well had just completely collapse aed. What is this about . Youre writing how this is an Impeachment Inquiry like none other. Usually do you come to the table with more than this . And you said that republicans even behind the scenes were a little surprised. What are they hoping to get out of this at this point, especially when we are days, hours away from a Government Shutdown, this seems like a political loser for them . These are excellent questions, mika, even house lawmakers, republican lawmakers v. People like ken buck who have been asking them quite loudly on our airwaves and really across the media. There is not a ton of buyin. Thats why Kevin Mccarthy did not hold an actual formal vote on the house floor to authorize the Impeachment Inquiry. You know, we dont talk enough about the context, but and i know we talk all the time about press dense here, but a slate of historians and constitutional experts i spoke to said there is absolutely no constitutional basis for this. Its what the framers had in mind when they envisioned the impeachment lever, the glass box being broken to help in a time of crisis to hold the president accountable to and this is not that. This is the first time we are trying to republicans are trying to impeach someone for the crimes of a president ial relative and actions that were taken by a president ial relative before joe biden was even in the oval office. My lord. Yeah. I mean it is its really incrediblep and weve been talking about for some time about how this has been the gang that couldnt shoot straight. Theyve been promising one thing after another. Nothing has happened. The fact that you would actually get people on that have actually been on Donald Trumps side through most of his presidency, you know, Constitutional Scholars who say, you got nothing here. You wonder the degree of incompetence that would have a chairman of any committee calling somebody who, again, is going to actually undermine your case. Well, heres a history of that chairman saying doesnt really have a whole lot there. Take a look. Have you found anything illegal while he was actually in office . Well, weve found a lot thats certainly unethical. Weve found a lot that should be illegal. Theres no evidence that joe biden did anything illegally. Well, if you look at the laptop and the emails between the president s son and his associates, they went to Great Lengths to hide joes involvement. Hold on a second, congressman. Did you just say that the whistleblower or the informant is now missing . Well, were hopeful that we can find the informant. Make it easy for us. What was the crime . The crime is Trading Policy for money. Which policy . Well, were going to get into that. Do you believe that this is now officially the Joe Biden Briberiry allegation and do you believe you will be able to prove that . Jim comer . I sure hope so. There are other republicans who are leery of coming to this proceeding but still want to see them go well, score political points and they thought yesterday was abject disaster. Those witnesses undercut theres nothing there. Theres nothing there. If there is something there, hold it till you got it and display it and prove it. Theyve got nothing. They know theyve got nothing so they keep humiliating themselves. This is why mccarthy didnt want to go to a vote because he knew he didnt have the votes. The speaker Hanging On By A Thread right now in terms of keeping that post, looming Government Shutdown looks like the republicans are more focused on this clown show, this nonsense, then trying to keep the lights on and Mccarthy May Face A Vacate vote in the coming days led by matt gaetz and this is not going to help. It makes the republicans look out of touch and white house staffers i did hear from yesterday, were chortling how this went down. Of course they were chortling. We dont say that in the south but thats a boston thing. They were chortling. Mike barnicle, what are they going to do . Why are they doing this . If mccarthy does have a No Confidence Vote so to speak, all that does is make republicans look like fools again its a repeat of what happened at the beginning of the session. The only person thats going to get 218 votes is going to be mccarthy. Okay. So youve been there. Youve actually been there. I have. You were a member of i caused a lot of chaos myself. I remember that. I remember all the chaos. Yes. Are we not talking about Impeachment Hearing, phony, fake, laugh out loud Impeachment Hearing, only because Kevin Mccarthy had to throw something to ten members of his own party to keep his job as speaker. Because maybe you can do a better job than me. No. You take it on your own terms. Mccarthy didnt do it. Nancy always did. And thats why mccarthy is suffering through this right now. Mccarthy is a this is going against the backdrop. We are a day away from 4 million government workers losing their jobs, tsa people not showing up, the military not getting paid. Our economy put at tremendous risk. Real, real devastation to Real Americans. And thelo show continues. That whats particularly galling at this moment in time. At this particular moment where Real Americans will be affected and this joke, this clown mobile, 18 clowns getting out of a volkswagen is going on. Yeah. Trumps record without sounding like left wing skulls at cnn or msnbc. Boom you know what is trying to me the other day when you and i were talking, you asked me when i ran for president. Yeah. And i thought about the debates, what was striking to me, and it deals with the brand of the Republican Party, back to the power of the branding of expert here, the guru. If the brand of the Republican Party has been damaged that could have been advanced at the debate, when bob menendez was indicted the other day, indicted, not convicted, indicted, democrats lined up and said he should leave the senate. Yeah. Not one republican candidate has said with four indictments that donald trump should step out of the race. If i was on the that stage i would have said, just like the democrats say when you are accused you should step aside, donald trump for the good of the party should step aside. Whether he did it or not. The fact that no one has even called on him to step aside, four indictments. Other than kristi. Four indictments and a civil case and you cant say what democrats are saying about bob menendez that is bad branding. Thats one of the things that the Wall Street Journal Editorial Page said hopefully the next debate the questions asked from the moderators will actually push them more on these issues because none of these questions including the incredible bombshell that dropped about him possibly being stripped of his businesses in new york, was even brought up. President Biden Yesterday called former President Trump and the Maga Movement a direct threat to American Democracy. The president spoke in tempe, arizona, to celebrate a Library Being built there in honor of the late republican senator, his old friend john mccain. Ive come to honor Mccain Library because its a home of a proud republican who put his country first. His democracy should guide all americans regardless of political affiliation. Theres something dangerous happening in america now. Theres an Extremist Movement that does not share the basic beliefs in our democracy. The Maga Movement. Not every republican, not even a majority of republicans adhere to the maga extremist ideology. I know it because ive been able to work with republicans my whole career. But theres no question todays Republican Party is driven and intimidated by maga republican extremists. Their Em Dreamist Agenda theyre pushing a notion that the defeated former president expressed in office and believes applies only to him. This is a dangerous notion. This president is above the law with no limits on power. Trump says the constitution gave him, quote, the right to do whatever he wants to dooz president , end of quote. Ive never heard a President Say that in gest. Im guided by the constitution or by comments of decency towards our fellow americans. Joe, yesterday was the beginning of an explicit case the president is going to make throughout the campaign about democracy. Talking about the economy, look at all weve done, historically low unemployment, et cetera, but also presenting the stakes to voters if donald trump is put back in the white house, heres whats going to happen. Its something a lot of people have been calling for and started yesterday. It did start yesterday. I thought it was effective. This is a message and ive got to say, im glad that when he talks about this, he talks specifically about maga republicans and says explicitly not all republicans. I know an awful lot of republicans very concerned about the fact that you have a president talking about assassinating the chairman of the Joint Chiefs Of Staff, talking about defunding the fbi, defunding the department of justice. Tearing at the very institutions that have made this country you know, what it is. That protected our rights and our freedoms. Lets bring in president emeritus of the council on Foreign Relations richard haass. Richard, i remember when joe biden started talking about democracy before the 22 election, so many pundits were laughing at him. Its too abstract. People will never understand this. Experts were saying you want to talk about something they can understand at the dinner table. Ended up a lot of people at the dinner table did understand the threat to democracy, and it actually moved like abortion which wasnt supposed to be a big issue if you looked at the polls beforehand, it ended up that womens right to choose and the preservation of the democracy were two Critical Issues for voters and still are, arent they . Absolutely. Theres not going to be a line on the ballot in 13 months that says democracy, but make no mistake about it, democracy is on the ballot. I think what the president needs to do is build on the speech which is a good speech and talk about say to americans you may disagree with me on this issue or that, but theres something larger at stake which is democracy. He has to do that. Remind people not just about the stakes, whats The Case For Democracy. He hinted at it and didnt develop that. Why does the Average American have a stake that American Democracy continues. He needs to remind us how democracy historically is delivered, how weve done well despite our current problems, and what happens to us if democracy in this country, if we become another hungary f we become an ill liberal democracy. He has a good case study when democracy fails, its called the shutdown. We cant deliver and how americans suffer. It does. It concerns our allies. The dysfunction. I will say in talking about the potency and the power of the democracy message, a lot of us were surprised, even though we were hopeful, we were surprised at how just about every top tiered candidate that was running as an election denier, they lost. They lost in arizona. They lost in pennsylvania. They lost in state after state across the United States. This is a powerful plenty of house will return to their seats. But those Senate Candidates lost. Secretary of state candidates counting the votes. Largely lost. The fourth in a series of speeches the president has given on this topic. President biden is one who likes to join proving political pundits wrong. Senior aides have said he is really glad this resonated last november and they think it will again. This is what hes saying Behind Closed Doors in recent weeks. Fund razors across the country and made this argument. Yesterday he took it to the public and also tied it with current events. He linked the maga extremism to the Government Shutdown. He linked maga extreme to the threats against the chairman which happened a few days before and used Donald Trumps name which he almost never does and made it clear as to what will be at stake this next time around. His favorite saying dont compare me to the all mighty compare me to the alternative, donald trump, and what that would mean fort country and look for a series of speeches like this in the next 15 months or so. Yesterday it was personal to the president because he was able to link it to the memory of his friend john mccain who he had been thinking about in vietnam and point to him as a republican who would stand up as a patriot over party. He was moved at hanoi at the plaque that they have in Central Hanoi By The Lake where john mccain dropped into, parachuted when his plane was shut down. Deeply moved by that. It continues with the speech yesterday as you were just talking about. The fundraisers hes had around the country, you hear anecdotically within the fundraisers he will talk off the record, obviously, because were not there, he will talk about the threat that hes speaking about yesterday as if its contagion. Its out there. Its infected the culture. He will talk about the culture more than about the politics, what has happened to our culture as a result of the denials, the denials of who is rightfully elected president of the United States. And richard, he will also talk about the fact that when he goes overseas as he just did to india and hanoi and other countries hes visited as president of the United States, within the first five months a leader of that country, whatever country he is in, will raise the prospect, fearfully, of whats going to happen next to you. Youre going to run for reelection. Whats going to the similarities were greater. They were almost operating within the 40 yard lines, and the fact that we have a party and a likely nominee in one of the end zone who is then if elected would introduce all sorts of changes, means our friends cant count on us. Look at the debate on ukraine. People dont know if in 13 months, the spigot gets turned off. The russians and others are waiting us out. I dont know, mike, that this ever happened to us in american history. In the meantime, how are we supposed to stand up and say democracy is important and the world . If we dont walk the walk, how can we talk the talk . The best way we promote democracy is by setting the example democracy works. If you are a democracy, you thrive politically, economically, culturally. We cant make that argument anymore. You know, rabbi, you and i have talked at Great Lengths both on and off the show about the irony, but also with the beautiful irony of the fact that Madisonian Democracy was saved in large part in 2020 by the very people who on the surface would think you have the least stake in saving Madisonian Democracy, the black women in atlanta, the black women in philadelphia, in milwaukee, all across the country in these swing states got in line, voted, made the difference in wisconsin. They made the difference in michigan, made the difference in philadelphia, made the difference literally made the difference in the State Of Georgia and i have been talking to a lot of pollsters over the last three, four, five days about all the polling thats come out, and they say its not the white voters right now that biden needs to be the most concerned about because they are fleeing donald trump in numbers high enough for joe biden to win. Not comfortably, but to win more comfortably than last time. The problem right now is he is not inspiring black voters. Hes not inspiring hispanics, people of color. Hes sitting at 50 with a lot of people just completely disconnected right new. Theyre not saying, hey. Were going to vote for donald trump. They just they dont have a buyin right now on joe biden. Why is that . I think that he began addressing that yesterday inadvertently because hes not made it clear that yes, there are still many things i aspire to achieve. Yes, there are roadblocks. I represent you getting there. He represents you never getting there. When he raisedd and speech to black women, black people, hispanics and others, he said, this guy is about autocracy. Hes about him and making the final decisions. Im about trying to keep our pursuit of a democratic state, and for that, it gives hope. My mother who was raised born and raised in the segregated Jim Crow South came to new york, married my father and had us. My mother never enjoyed what i did, but she would vote and participate hoping her children would have a better life. Right. And thats what joe bidens got to say. I know its not perfect. I know there are things that youre still dealing with you, but i represent what you hope for. He represents the end of that. Hell make the decisions and he and his group will decide on everything and hes not on your side. If you run with that, Ronald Reagan who i disagree with politically, and he gave us the hope and the shining light on the hill. This guy is about glitz and me, and the more biden runs on that, the more a lot of people will be energized in communities that are not energized because they cant see what is there, but they can see what they hope for. Some of the House Democrats on the Oversight Committee calling out republicans in their first hearing on the Impeachment Inquiry into President Biden. The sixhour hearing did not produce any evidence that the president committed any crimes connected to his sons business dealings. Nothing. Reverend i mean, they just havent, and willie, weve talked about this before. I mean, they have been so desperate to try to tie what hunter biden did with the president of the United States. They just havent been able to do it, and when you have everybodys Editorial Page turn to Jonathan Turley whos seemingly on Donald Trumps side year after year after year saying, theres nothing here, then again it is right now it seems to be all smoke and mirrors. Yeah. Jonathan turley was one of the four witnesses yesterday and they called him in because he was friendly to the case. They said, you have to open up an inquiry, but this is nothing for impeachment. Its been cheapened before our eyes right now, but it was about as serious as it could get. Were talking about potentially overturning the will of 81 Million People who voted for joe biden by impeaching him and removing him from office. This is a serious idea not being taken very seriously here, and contrasted to the Impeachment Hearings we heard, and this is just the inquiry. The Impeachment Hearings we heard under donald trump, those two and the january 6th committee, the bipartisan january 6th committee, the presentation of evidence by lawyers who made a case, and heres what we have, heres why we believe this president should be impeached. Theyre just throwing out questions at this point, and they have had years as we said. This started under the trump administration. Bill barr had his crack at it, and said theres not much here, and now here we are now two years into Joe Bidens Administration still just asking questions about impeachment. And mika, thats the important thing. Willie just brought up a great point. Donald trump had a Justice Department for four years. All of these people have been running around saying, oh, there are two different sets of justice. Why didnt they get hillary . Donald trump kept begging his Justice Department to go after Hillary Clinton, and they kept saying, nothing there. Mr. President , theres nothing there. The same thing with hunter biden. Theyre investigating hunter biden. Like weve said all along. If there is something there, okay. I cant wait to talk to mimi roke about it in a little bit, but this guy obviously went through a really tough time. Yeah. He struggled through it, but theyre coming up with charges against this guy that they couldnt charge 99. 9 of americans with. So again, if theres two tiers of justice, well, thats an argument republicans lose every time, but now to try to attach that weak argument to joe biden it has embarrassed them time and time again. Theres just no evidence of it. Theres no even remote inference of any evidence on it and yet theyve launched an Impeachment Inquiry and exposed themselves and put one witness after another witness after another witness on the stand thats only helped joe bidens cause. Yeah, to edit a line from succession, these are just not serious people at all. Well, they got some really bad news yesterday. The appeal that donald trump had hoped would go his way didnt go his way. The trial can start against him and his sons on monday, the civil trial, which could end as the judge has said and as other people have said, with all of Business Licenses being stripped, taken away, his Business Being shut down in New York State and even possibly trump tower, and his west chester property and his wall Street Property being seized from him. So mimi, i know again i want to be careful with what i ask you here because obviously youre an active prosecutor in west chester county. Well stay away from that side of it, but you look at what this judge has said. He hasnt left a lot to question. Theres not a lot of ambiguity there. It looks like were just going to be seeing a judge thats going to be deciding what the penalties will be. Is there a pretty good possibility that the Trump Organizations going to be shut down in New York State . I think so. I mean, this judge as you said has made clear what his view of the evidence is, which is, you know, as he said in his opinion the other day that the evidence of fraud is clear, period, and, in fact, sanction the lawyers from Making Arguments that they had made previously that were in his words just bad faith. Exactly. So he doesnt even think theyre good faith arguments and he cites stark examples about the valuation and the apartment in new york city and the Square Footage, and so really whats left for him to decide is the penalty. Now i think, you know, this judge i mean, trump of course, and his lawyers and his defenders are doing their thing of saying, this is a biased judge, but the judge didnt just come out and say, i dont like donald trump. He made very specific findings based on the evidence. When you overestimate the Square Footage in your residency, you live in by 19,000 square feet, i think its safe to say, well, ive said that about my 21thousandsquarefoot condo in florida. Wait a second. Its 2,000 square feet. You can say this is obvious fraud. It seems to me this is the judge, right . Thats going to decide whether the Business License is revoked, whether trump tower is taken away from him, whether the wall Street Property is taken away from him. It doesnt look good for trump, yes. He will have a right to appeal on all of this, all of the issues, but, you know, first of all, as you just mentioned the court of appeals just, you know, did not allow for a delay. Thats a good sign in terms of those who want the judges decision to be upheld, and again, it seems really rooted and based in the evidence and the facts. So thats going to be very hard to challenge and appeal. Right. You know, walter, we have all talked about how journalists broadcast news anchors, newspapers, they have not been able to keep up with which the speed donald trump spreads lies, puts out information thats disorienting. Its always been very hard to keep up with as the russians would call it sort of the fire hose of falsehoods. Mmhmm. We now find ourselves on the other side of this where were all drying off really quickly from the fire hose of falsehoods. It is really hard justice is being served up, but it seems to be served up at the same time. Its really hard to keep up with the 91 counts, the 4 indictments, the stealing of Nuclear Secrets, the obstruction of justice, the lying to the Justice Department and the fbi, the telling of the i. T. Person, you know, destroy the tapes. Are we good . You know, the judge in New York State saying, hey. The jury said it was sexual assault, but it was rape by any other definition, and now again, something weve all known in manhattan for a very long time, donald trump lies about his worth, and now its all colliding at the same time. Its kind of hard to keep up with it all and im being serious. This is sort of disorienting on the other side. You know, whats historically amazing at this time is with the fire hose, with the documents, and destroying the tapes and everything thats happened, week after week, the hose doesnt affect him among Republican Base voters. You know what, though . I think its starting to affect him. When he seems disoriented on the stage, yeah . Maybe so, but if the republicans nominate him they dont care. It is astonishing to me that it has seemed to help him almost. Walter, lets discuss this because, you know, you obviously youre from the deep south. Im from the deep south. You know a lot of people that voted for trump. You know a lot of people that are still with trump. Same here. Whats your best answer to why for people who have lived on the Upper West Side their entire life . God bless them, but whats your best explanation for why theyre still with donald trump . There are a lot of reasons, legitimate, for resentments in this country and it keeps getting stirred up, and i think we have to realize that people got left behind with when the economy expanded, that we decimated working class jobs. Even the border i think people in new york now are getting finally what people down south have felt about the border. Right. And about the Crime Problems in cities. Im not justifying all of this, but i mean, heavens. Its there are a lot of reasons to be upset at the old meritocratic elite. Its been looked down upon by the media, by hollywood, by elites on College Campuses and there has been a lot of that. The thing is though, how crazy, and ive always thought it was crazy, that their vehicle their vehicle to get back against manhattan elites is getting a guy who likes to think of himself as a manhattan elite who flies around in his own 757. I mean, what it comes down to though is, for a lot of these people donald trump hates the same people that they hate. And thats good enough for them. Yeah, and he fights for us is what you often hear, and youve heard it since 2015, 56. It was aspirational. Big businessman. Hes going to change the way business is done and pound the desk and get what he wants. That didnt happen when he was president , but hes viewed as a fighter and thats what you hear from people who stay with donald trump. Even when you present them with leading an attempted coup against the government, taking Nuclear Secrets with him back to his beach club. None of it breaks through anymore. As you say, its hard to keep up with all of this. Lets add one other case here. Were learning donald trump could be deposed in his 500 million lawsuit against Michael Cohen as soon as next week. Half a billion dollars. Back in april, trump sued his former lawyer alleging cohen spread falsehoods, violated Attorney Client privilege and unjustly enriched himself. Trumps lawyers argued the former president , quote, suffered vast reputational harm as a direct result of cohens breaches, end quote. During the hearing yesterday, the former president s attorneys requested trumps deposition be delayed due to his Upcoming Civil Fraud Trial in new york. Theres another hearing today that will determine if the deposition will take place next tuesday or be moved to the following week. So mimi, you can throw this onto the pile of the cases following donald trump. Hes initiated the lawsuit against Michael Cohen, but as he is deposed in this case, could what he says be used in some of the others . Absolutely. I mean, you know, if you are under oath anywhere, those are admissions, statements under oath of if its in a criminal case, a defendant, or in a civil case. They obviously could be used against him, and it just amazes me that this is the basis of a lawsuit. I mean, remember, there have been several judges in several different settings that have noted there was no Attorney Client privilege as to the statements that Michael Cohen has made against trump. Why . He wasnt even acting as these attorney in those incidences regarding Stormy Daniels and other things because he was acting as his fixer. Just because someone is lawyer, you dont have Attorney Client privilege. The fact hes risking this pretty just completely narrowless basis of a lawsuit, and possibly making statements under oath does not seem like a great strategy. I wouldnt be surprised if for some reason, it was canceled. If for some reason he decided not to do it, because whats there to gain . Im not being snarky, but you have got to prove reputational damage. Theres no way hes going to prove he had a good enough reputation to be damaged after four years of presidency. Michael cohen was just a very small part of that, and i want to ask you quickly lets circle back before we get to the clown show on impeachment. Lets circle back to the hunter biden case. We brought it up before. The charges have come down. Hunter biden obviously went through some rough times. Theyre now trying to attach joe biden to hunter, and its just not working at all, but these charges against hunter biden, i keep hearing that if his last name was not biden, they would have never been brought. I hear this by the way, from Conservative Jurists as well as liberal jurists. Theyre saying these are just charges they dont usually bring against people. Hes getting this because his last name is biden. I was a federal prosecutor in the Southern District of new york for over 17 years, and i dont recall ever seeing a charge on this basis, and we did a lot of gun cases. Now thats not dispositive, and, you know, theres something called selective prosecution claims that defendants make when they think they are being singled out, but, you know, it its not thats very high standard. I dont think thats the case, but, you know, hes had extra scrutiny on him because of who he is. Is that fair . Right. In a sort of justice, you know, sense, i dont personally think so, but, you know, i also understand the reasons for the extra Scrutiny Given who he is. Right. And the attempts to look impartial. I think thats what you said right there, the Justice Department is bending over backwards trying to look fair, and theyre using hunter biden to do that. I think that its probably trying to look too fair because in many ways, hunter biden i agree with this. Is being in my opinion, being singled out in a way that donald trump is trying to act like hes been singled out because donald trump is facing four cases and a civil case for things he did. Hunter biden did what he did, but does it raise to the level of where they are prosecuting him . The irony is something you said earlier this segment, is that joe biden and hunter biden has lived the life of the average person that the maga people are trying to appeal to, blue collar guys and a son that has trouble thats trying to make it, than donald trump who was born with hundreds of millions of dollars he inherited and never lived the life of the people hes trying to inspire that im your gladiator. The irony is that one really lived the life that the other one didnt. The question is can he translate that to those that are voting against him . Right, and mika, again, you look at the charges. They wouldnt have been put against hunter biden if his name wasnt biden most likely. If you look at numbers and play the percentages, you can also say, again, what a joke that theyre going after hunter biden for making 5, 6, 7 million jared. When you have again the trump family getting over 3 billion from interest, and they served inside the administration. Hunter biden never did. It seems, again is hypocritical. Theyre the Bobby Knights of the refs. They think if they throw chairs onto the gym floor, people will pay attention, and few look at the polls, its worked. I have jen palmieri, and before we get to the hearing on this hunter biden issue, the cruelty is the point here. I mean, i have always talked about during bidens last campaign the, i think, bad decision to, you know, cruelly go after the president s remaining son. We understand and we have said on this show time and time again if hunter did something, follow the law. Let the law play out, but politically, i dont get it. Its i dont think it resonates with people. I think that and its a sad deal because this is like when the biden family decided whether or not to run. Its so hard. The president cares so much about the family and all that, but i think the goal is just to muddy the waters. Right. They have done that. Its the same thing with the menendez case, right . Muddy the waters, and it may not seem like a big deal, but it can be corrosive when bidens argument is, like, foundationally about integrity, government working, upholding standards, the constitution for them to say everyones in on the grift. Yeah, trump is like that, but so was biden and thats the nature. Joe biden is providing the contrast. He did in his speech in arizona last night. As we said, the House Oversight Committee Held its first hearing yesterday in the republicanled Impeachment Inquiry into President Biden, and not a single witness called by republicans confirmed any evidence that President Biden has committed any crimes. Im not here today to even suggest that there was corruption, fraud, or any wrongdoing. In fact, i do not believe that the Current Evidence would support articles of impeachment. You mentioned in your oral testimony that you had written a commentary entitled, you would go to prison for what biden did. That was you would go to prison for what hunter biden did, right . Thats exactly right. I was cutting down words to stay within my five minutes. You realized you realized thats an important word though that you left out though, right . It is. I mean i dont know, jen. I mean i mean even on fox news, they come out of it going, i dont know what just happened there, and theyre making a mockery of our system ten times over. And this is what happens like when we talked about before, when maga come into and collides with reality in a courtroom or a hearing room like this where its faced with truth, this is, like, this is when it all falls a part, and, you know, this is, like, i remember when Hillary Clinton had to testify in front of the benghazi committee. It was part of the 11 hours the best 11 hours of the campaign because she was able to just knock everything down. Its, like, what did you think was going to happen when you put together this Impeachment Inquiry that was with no basis and facts and put together witnesses that couldnt make a case . Yeah. When you bring Jonathan Turley and jonathan says, you got nothing here, its bad, but it begs a bigger question about just the gross level of competence in the House Of Representatives. Yeah. Its a House Of Representatives, and of course, the big one is theyre not going to be able to keep the government open perhaps, and when Speaker Mccarthy when theres no leadership, you were there when gingrich was the speaker. Right. He may have sometimes charged in the wrong direction or went wild, but at least he was a leader who had the troops together. The fact that House Republicans not senate republicans, but House Republicans are bringing us to the brink of a shutdown and doing this show right. On impeachment, i cant believe thats not going to end up really decimating at state and local levels in the Republican Party. Its the contrast. Were talking about gingrich. I mean, the contrast between when we were there, we did have a Government Shutdown, and we found out quickly that never plays out well for republicans, but theres such an incredible difference between what happened then and whats happening now. This is for tiktok or for twitter or for some other social media deal because they have no end game here. I will remind people we balanced the budget for the first time in a generation. We balanced it four years in a row. We passed medicare reform, extended the life of medicare for seven years. We paid down the national debt. This is not a campaign commercial. Americans would take any one of these right now issues, but the republicans cant do anything. These House Republicans just keep making fools of themselves, and im with walter. At some point, this has to really have an impact on these House Members who are running in biden districts. Well, the republicans in the immortal words of butch cassidy, The Sun Dance Kid literally are making it up as they go along. We have been talking about this back and forth and we have a split screen. A political cultural split screen over the last 24 hours. On one side of the screen, you have the president of the United States speaking directly, succinctly, and clearly about the danger to democracy in phoenix, arizona. Mmhmm. Okay . On the other side of the split screen, you have a party that has devolved, not all of them as the president pointed out in phoenix, not all republicans, but the maga republicans have devolved into the party of retribution and revenge. Thats what the Impeachment Hearing is all about. You indicted our guy. Were going to try to indict your guy. Retribution and revenge. Thats the split screen politically, cultural were going to deal with for a long time. Joe, i just wanted to point out Newt Gingrichs name was invoked here. A couple of shutdowns. You were there in the 1990s. In the Washington Post, he was quoted saying, quote, i dont understand it. I think its nuts. I find it hard to understand what they want because they change constantly. Thats a big part of the problem. Newt gingrich talking about this republican house. Well, and, you know, rev, we paid politically for doing that, for shutting down the government, and newt paid for it, but we balanced the budget, and like i said, four years in a row that hasnt happened. When you look at these clowns and im just going to call them clowns in the house, this small subset of republicans in the house. These are people who claim to be the most conservative. These are the people, again, some of them starting with mark meadows that i pleaded with for four years. Be serious about fiscal restraint. Protect taxpayers money. This is why people like republicans, and instead they spent more money than any congress in the history of america, and so now suddenly theyre coming back saying, were here were the federal government and were here to help . Nobody believes them. Newt gingrich doesnt believe them. Nobody believes them. For gingrich to say that is something we ought to take real, real note of because when president obama was elected in 08 one of the first meetings he had early in his presidency is he had Newt Gingrich and i come to the white house for education. I got to know him. We did five states together, going to schools and all, and though Newt Gingrich had no real plan b as you said, he was everything i stood against, he was a smart man, and he had a vision of governing that he wanted to try to put in that i disagreed with. Kevin mccarthy is no Newt Gingrich. He has no vision. He has no plan. He has no tangible intellect that we can find. He was just a guy that wanted to be speaker, and now that he has the gavel, he doesnt know what to do with it. Its like a preacher that says, let me preach, reverend al. Let me preach, and he gets up and he opens the bible and he has nothing to say. No. I tell you what. I grew up in baptist church. He had those guys visit our church from time to time. Walter . You know, ive got a question here which may be a fantasy, but as this keeps going on, and the fever doesnt break, and you have shutdowns of government, now theyre going to try to vacate maybe next week Speaker Mccarthy and stuff. Right. Is there ever a possibility that at some point normal members of the House Of Representatives, democrats and republicans leave the fringes aside for a second and say, all right. Were going to get the Government Back going, or is it impossible for the republicans able to say, yes, well take some democratic votes . I think theyre going to have to do that at some point, and this could actually help the country if finally we say, all right. Were going to do things with at least an attempt at a bipartisan basis. You know, the problem with the craziest members, politically craziest members of the house gop is theyre ny lists. They dont want to do anything. Cant you marginalize them by taking democratic votes . You can, and mccarthy will say, ill do it with you or without you. Will he . I dont know if he has the courage to do it, but if he did, he would say, do that, and then go ahead and try to take me out and ill tell you what ill be doing. Ill just be sitting in the cloak room watching youve seen jim clyburn and even Hakeem Jeffries. They know my phone call. They can call Hakeem Jeffries and say, lets settle this. It would probably so infuriate the republican fringe. Youll never win them over anyway. Do it and dare them. Try to get 218 votes on somebody else. Im trying to save your majority. There was no way he was going to win that, and this is someone that cares about his image, and to lose a motion does not look good for him, and i will note he took the opportunity or well, you know, through his lawyers, to now butter up to the judge that he is going to be in front of, right . Weve seen time and time again, him attack judges who dont rule in his favor. Here hes saying, okay. Im going to be stuck in this court. Let me Start Talking about how fair and impartial i think this judge is. Right. So its an interesting dichotomy from how he usually attacks judges. Now its butter up, butter up until and unless that judge makes some ruling against him, and then itll be a biased judge, but that absolutely was i think the reason and the tactic. It is fascinating. Jeffrey, since this start, reacting to your magazine, i also wonder what you make of the fact that the context of all of this right now is that weve been through a Republican Debate that didnt address this, and Impeachment Hearings that addressed seemingly nothing, and it seems to me that these threats against general milley should be a full stop across the board. I agree with you wholeheartedly, and this surprising Donald Trumps attack on mark milley wasnt that surprising. Weve come to expect that sort of thing. What was surprising being totally honest with you is people in my profession treat it as normal. They ignored it. It is normal in the sense that this is what you would expect donald trump to do, but i think that is the lead story the next day. Imagine a former president of the United States accusing the current chairman of the joint chiefs of treason. That would be full stop, you know, lead story in every newspaper, every Television Broadcast in america. Lets talking about our profession because not just what he did. You dont just talk about the threat against milley, but also the other major headline was that he was found liable of massive fraud, the judge saying, no need for a trial even. Lets get right to damages. Those two headlines tell us about our industry right now and whats happening. Are we desensitized . Yes. Yes. We expect since we expect donald trump to do anything and everything in order to preserve his own power or aggrandize himself i mean, chris murphy can steal a pack of bubble gum from wawa. That chris murphy. Im not saying he did it, but in other words its based on expectations, right . We normalize to peoples level, and so weve normalized too much to Donald Trumps level. That was the warning about trump, that this authoritarian tendency is to desensitize a population to crimes, and to threats. Yes. And to cruelty. Its just him the whole thing is its just donald trump talking. Its not just donald trump talking. Its the incitement of violence against american officials, right . Yeah. Thats the part i dont get. How do you all deal with it . You seem to balance this pretty well at the atlantic, to manage, to maintain the, like, sense of newness, outrage about what he does. How do you think about how you treat him so that these things dont go unnoticed . First of all, it all has to be factbased and realitybased. This is based on reporting. If it is new and suggests something new, you highlight it and the other thing you have to do is consciously tell myself, im not normalizing this, and the way to do this is take a longer view and do what i just did, and thats imagine bill clinton, george w. Bush, Barack Obama Joe biden. Of course. Joe biden. Come on. The whole key is the imposition of selfrestraint, right . We have to talk teach other as if were not enemies. Donald trump has normalized that treating americans as enemies and the consequences of that are one of the consequences are Nancy Pelosis husband being attacked. Exactly. January 6th. Ill let you take it to the senator, but again, i feel like this is an important part of the conversation. We dont need to bash specific names or networks or entities, but jeffrey points out theres a job here that needs to be done not just in washington, but by members of media and people who call themselves journalists who i feel have lost sight of what is important and what should be covered. And what page is im looking. I cant find the biden speech anywhere in these papers. Joe biden gave a speech on democracy. Yeah. Fairly important. What page was it on . In the new york times, theres not even a tease box on page 1 to alert the reader to it. So we are i think a lot of americans believe were in a fight for democracy, and again, you just wonder whether two things that are going on, and senator, one of them is that we all have become numb to this, that its a fire hose of falsehoods, and its an idea. Im not comparing trump to adolf hitler, but youre talking about people that were talking about the rise of hitler and naziism, and they lied so much, and they started saying things like people that i talked to, i dont even follow the news anymore because you dont know whos telling the truth and you dont know whos lying. These are the same people that look at, you know, the Associated Press and put them in the same spot as a chinese religious cult that runs epic times in the United States. So they cant tell the difference, but theres also something very insidious too by the people that claim to be antitrump, but who are actually antiantitrump, and they look at joe biden and his student loan forgiveness and think, oh my god. Oh my god. This is just as bad as anything Donald Trumps ever done. How could we ever vote for a man who doesnt respect the constitution and Madisonian Democracy . They literally say that after january the 6th. They literally say that after he sets up a fraudulent scheme to steal millions and millions of votes in swing states, and that is part of the insidious lie being told by people in the media and by a lot of republicans. Well, listen, i think it is really important that joe biden hasnt become numb to this, and i get it. Im just as frustrated as everybody else that he gives a really important speech like this, and it gets buried, but he doesnt do this just once every month or so, right . He is talking regularly about the threat to democracy, and ultimately people pick up on that, right . That the president of the United States thinks that this is an existential threat, and remember, you know, when he gave that speech at the close of the 2022 midterms on democracy in if i would, i bet you there were pundits who came on this show and said, what a mistake. This is not the zeitgeist of the American Public right now who should be talking about abortion or should be talking about trump. He knew that the American Public have also not become completely numb to the threats against democracy, and so i have not given up on the ability of the American People to rise to the challenge here, and i think if you look at why democrats continue to sort of overperform in special election after special election, you know, part of that is abortion. Part of that is the specter of trump still on the scene, but i think a big piece of this is the American Public get it that the trump phenomenon has become a cult of personality in which the dear leader matters more than democracy, and that is really disgusting to a big swath of the middle of america. So if biden keeps on talking about this, i think there is reason to believe that enough americans are going to step up and respond. Yeah. Hear them. Senator, good morning. I want to ask you about the Current Business in front of the congress where you serve right now. You all in the Senate Passed well, you passed a motion yesterday to keep this continuing resolution to get the government funded, but its really in the hands of the house right now as you know. So we are tomorrow at midnight, that leaves us just a matter of hours before a Government Shutdown that Newt Gingrich is now calling nuts saying he doesnt get it. Is the government going to shut down tomorrow night . And if so, what does that mean . It certainly feels like the government is shutting down because the House Of Representatives has chose to shut it down. I do think its important to repeat what you said. We are on a path to pass a continued resolution. Thats what keeps the government open and operating with a huge bipartisan majority. Weve passed two procedural motions, each with about 75 vote. Senator mcconnell supports this continuing resolution. The Senate Looks Like were going to do our job, but the house is pretending like the government isnt shutting down. Theyre not even debating a measure like this this week. Theyre talking about impeaching the president and i think thats just because theres a big swath of House Republicans that control that constitution who want to burn the government down, and theyre actually supportive of a shutdown. This doesnt look good right now. Scale of one to ten, jen, how bad are things . Its just been on the 11 because we cant diminish how bad things are. This has been in the 11 category for a long time. Is this end game . Leader jeffries was at the atlantic festival yesterday talking about what are democrats responsibility here . What do you think you can do . How long do you think this is going to be . Where do you see it . If only we had somebody talking about the atlantic. Dont look at me. Well get to that. But, you know, what end game and also, like, democrats, and its almost like the burden is on democrats and thats a hassle, but the burden is on democrats because democrats believe in things working out and we want things to function. What do you see as end game . The bill that is right now moving through the senate is a compromise, right . Right. It includes only a slice of what ukraine needs, not enough disaster assistance. We try to respond to republican concerns. I think the path forward now is for the senate to pass this bill, put it on mccarthys desk. At first, i think mccarthy will not bring it up for a vote, but as time goes on, it will be very clear that that bill has a majority of the House Of Representatives. Right. And he will over time, be under withering pressure to bring that up. He probably will have to. Jonathan lemire, jump in. Reverend al sharpton, were talking about the speech the president made talking about the dangers of democracy. Were looking at capitol hill, about to be a Government Shutdown. The speaker barely hanging onto power. This seems to be plain as day examples one, two, and three for democrats next year saying that you can trust us. Were the competent. Were the grownups in the room. Polls dont reflect that yet, so what but voters as they pay more attention, theres a sense at least the white house believes that will start to sink in. Whats your assessment . Are those messages the competencies, the as, bs and cs and should that be their part . That should be part of their case and i think the senator is right when he says that they ought to keep going with that message because people that are outside of the vengeance side of america what donald trump is appealing to, needs to keep hearing that because they understand what shutdown means to their family. They understand were taking away democratic principles. People like me spend all our life fighting for Voting Rights and you go from a democracy to an autocracy and act like it doesnt matter. Sometimes it may be hitting on the new york times, but its not hitting on the ground to people in key battlegun states that feel a shutdown and feel their votes being taken from them with gerrymandering and other schemes, and i think joe biden is tapping the right message and he just needs to keep it up because its going to sink in with the people that really matter. Senator murphy, on the same theme, and in a few weeks its highly likely that a lot of people in this country and a lot of people in connecticut and elsewhere are going to be trying to, you know, find some money or a place to put their kids in day care. Child care could be at peril here. The child tax credit, unbelievably no longer exists. What happens how can people like you, democrats largely, push the message, this is what happens when people are elected to Public Office who dont know how to legislate and care nothing really about governing . And lets just think about how quickly that crisis is going to happen. Youre going to have a lot of families out there that are in private child care that are not going to be able to afford it in a few weeks, but starting on monday if the government shuts down, head start programs all across the country are going to start closing their doors. On monday, you will have parents showing up to their preschool program and their kids will have no place which has a Ripple Effect on the economy because those parents wont be able to bring. Theyre not bringing in income. Ultimately the Republican Party has become devoid of ideas. This is an idealist Republican Party that only cares every single day about owning democrats, right . On social media, and i think joe biden has an opportunity, rght, to explain how if you elect democrats, we make investing in regular average families the priority, and this is a message about responsible government, but its also a message about priorities and joe biden has both of those opportunities over the course of the next year and a half. Joe. And jeffrey, before we let you go, the top of the atlantic this morning, theres a really good story that sort of goes along with what we have been talking about as far as how the media not bashing the media here at all, but how the media needs to be sort of open to some of its blind spots, and still recognize when its being used by donald trump, and adams piece is trump didnt go to michigan to support autoworkers. Why did so many media report that he did . If you read about trump going to support autoworkers, and you find out he goes up there and hes talking to a lot of nonunion people and saying the Autoworkers Union is just wasting their time. Yep. Yeah. I mean, this is this goes along with this general theme that were talking about, and im not trying to bash the media. Theres no one media anyway. Obviously theres a million different institutions doing a million different things, but i would say and lets let me pivot it back just for a moment to this milley issue which i think the threat of violence against milley is one of the most important stories of the past week, and, you know, you saw some of the coverage, general milleys retiring today, his formal retirement service. A lot of it is polarizing or controversial chairman of joint chiefs or divisive chairman retiring after 44 years in the army, and its, like, these words we use these words to distance ourselves sometimes from the unadorned truth of the matters. Its, like, is he polarizing . Well, to paul gosar hes polarizing. To a small faction in the House Of Representatives, hes pole polarizing, but you have paul gosar and donald trump who think he committed treason and then you have john kelly and robert gates and the general saying he was a patriot who defended the constitution. So we do this stuff where we frame things because we think that the framing brings balance, but you have to also analyze, is there real balance here . Is paul gosars opinion equal to robert gates . And first of all lets step back and talk about republicans on the hill. You know, im sure youve gotten an earful. Ive gotten an earful from a lot of senate republicans. Theyre, like, dont throw us in with the freaks of the house. Thats what senators thats what the house of lords has always said. Thats what theyre saying about us when i was there. Thats your song. Dont throw us in with the freaks in the house. You could write that. There are on capitol hill, there are three parties. Theres the Democratic Party, the House Republicans and the senate republicans. If we were a european, you know, if we were a european parliamentary system, there would be three separate parties there, and then you go into the house, and republicans are going to defund ukraine. Republicans are this. No, they arent. Theyre 10, 15, 20 people. I understand its sort of a rising chorus starting to go up, but overwhelming majority of republicans even in the House Of Representatives agree with chairman mccaul which is, no. Were not going to do putins bidding here, but again, its sort of a laziness. Find the 5, 10 freaks in the back of the hall that want to get on tiktok and want to raise money and get them at the front of your story and dont talk to the other 180, 190 republicans there. Got it. I will say, isnt there a really serious possibility that this guy was an agent for egypt inside the United States senate while he was running the most Important Committee on Foreign Policy . Well, i will say this, and ive said this in other forums. I do think that the senate has to understand what egypt was doing, and what they thought they were getting out of this. We have about 235 million of my taxpayer money that is right now due to go to egypt, and i have recommended that the senate Foreign Relations committee hold that money. We have the power to do that, pending an understanding of exactly how involved the Egyptian Government was in this alleged scheme. I think thats a really important thing for us to understand. The focus right now is on senator menendez, but the focus also needs to be on egypt which is supposedly one of our closest allies in the middle east which by the way receives more direct u. S. A panel has ruled that donald trump will go on trial for civil fraud on monday where his entire new York Real Estate portfolio could be at stake. You know, attorney general Letitia James has probably hit this former president where its hurt with more legal action against him, and you can see it in different mannerisms and reactions among the trump family. Yesterday, five judges decided to lift a temporary stay on the start of the Nonjury Trial put in place while they considered challenges by trumps legal team. The former president s attorneys claimed that some of the charges brought by new York Attorney general Letitia James fell outside the statute of limitations, an argument rejected yesterday. On tuesday, judge arthur ruled that the former president , his two oldest sons and his company itself were liable of fraud. That means next weeks trial will simply be to determine how much they pay, damages in this case, which could include a fine of up to 250 million, and the possible seizure of trumps new york properties. Yesterday prosecutors informed the judge they planned to call the former president and his sons to testify in addition to his Daughter Ivanka and former Trump Organization cfo Allen Weisselberg, and trumps exattorney Michael Cohen. This is a dramatic turn of events in this week in terms of trumps legal issues, joe. Right. And we have been talking all about whether or not joe biden needs to fight back and talk about the legal cases against donald trump. He made a pretty eloquent speech about democracy and went after the Maga Movement and well talk about that coming up, but at the same time, one could argue that you let the law play out and boy, did it ever this week. You know whats so fascinating, donnie, is everybody has been focused on the criminal cases. Obvious, they have been focused on the criminal cases, but weve known donald for a very long time and you just get the sense that a lot of the criminal cases and the possibility of incarceration is still an abstract concept to this guy, right . Theres nothing abstract about this. This is his life work. This is a guy coming in from queens with a huge chip on his shoulder, him doing everything he can to build a manhattan real estate empire, and the last few days, especially with the appeal being rejected yesterday show him that very soon that New York Empire is going to be shut down if things continue in this direction, and he may even be booted from his wall street location, from trump tower. Its being monitored. From west chester. Its being monitored. There are a lot of ways this could turn out, but this civil case may be whats hitting him the hardest right now. Its a great point, and despite him being president of the United States, everythings always been about money for donald. Right. It still comes back to dollars. Whys he doing it . We always say, follow the money. Its always about running for president , yeah, he likes the attention, but the attention he thinks he can use to generate money. The real reason he ran for president was to just get publicity for his business, and look. This hits him in the gut, and hes going to have to divest himself of his properties and he is a man and his buildings and his Tall Buildings and his big buildings and everything is about size. It means so much to him that in a very sick moment of many sick moments on september 11, 2001, you know, as he was watching the twin towers go down, he goes, now i have the tallest building on wall street. Thats a lie, but again, that shows you in his fevered brain how much those buildings mean to him. You know, there are two things that always meant things to him, the money, and the stature with people like the people around this table in the media, and people in new york city, and people in l. A. Right. And celebrities, and hes lost both. The money has shrunk, and of course, his outstanding is different. He could not walk into a restaurant in new york city now. To a lot of people going to jail would probably be the scariest specter, but to him the thing that is really probably sitting with him right now is his big, tall, long buildings maybe going away. I think the criminal indictments are something that he can spar with and he feels he may get away with, but i think that the civil case is an existential threat to him. This is who he is. And his family. And his whole family, and his desire to show his dad whos gone that i told you i could be somebody. This takes away any inkling of him proving to dad that he could rise up. I was thinking just yesterday riding down 5th avenue, i have one grandchild, a 4yearold grandison, marcus al. One day, ill be on 5th avenue saying, you know, that building used to be called trump towers and telling him the story. Thats the thing donald trump is scared about. He will be removed from the memory of the next generation because there will be nothing called trump if this civil case goes forward. I was going to say, its really its already happened even in our time, you know, i used to when i lived up in connecticut, i would go up the West Side Highway, and as i left, you would see seven, eight buildings in a trump, huge buildings, trump, trump, trump, trump, trump and a lot of people would pay a lot of money to slap his name on the side of the building. A committee came in one at a time and they were taken down. They were taken down up and down the highway. Now theyre talking about actually taking trump tower and other towers away from him. By the way, some idiot said, oh, this happens in stalinist nations. To. This happens in nations where theres a rule of law and in stalinist nations, you would say its stalinist nation and they take you out back and they shoot you, and here we have a rule of law, and everybody, lets just for people who arent from manhattan that havent lived in manhattan. Everybody for years have known that donald trump has lied about his net worth, has lied about his buildings, has lied on his loans. This is no shock to anybody. If there is a stalinist nation, then stalinist has been deaf, dumb, and blind for, like, 40 years because this is not a surprise, you know, when he was running in 2016, people would say, dont do business with him. He lies, cheats and doesnt pay his bills. You would hear from that everybody, and he exaggerates how much hes worth and you cant trust him in a business deal. Thats who hes always been, before he got into politics. I told the story about how he renumbered the floors in trump tower just to claim it could be taller than any other building nearby. So this is who hes always been, but now he suffers some consequences and his Business Empire has already shrunk. To your point, his name has been stripped off of buildings throughout the city. He has a number of golf courses, but he stands risk of losing those here in New York State, and trump tower was his pride and joy. That was his signature building, his home for decades. No longer now by the way. Hes no longer in new york. He spends a few nights a year in trump tower. He lives at maralago and bedminster, but this city has been a huge part of his identity, but his campaign was about being americas ceo, a businessman. That has since dissipated and so much of what hes done is about making that money and driving that attention, and a huge part will be gone. Hes going to have to appear next week and stand trial, likely take the fifth, be hell have to appear. Again, this is not surprising to anyone whos lived in new york, and not surprised by this. When he was selected to run The Apprentice and go around saying, youre fired, youre fired, like, you know, im not saying this to be mean. This was in all the papers. People that ran businesses that yeah. They laughed about it. They mocked him. The fact that this guy was going to be some big business genius, you know, they were laughing and its something that he always resented, but, you know, theres a guy that inherited the equivalent of 400 million from his father and lost it. Well, that attitude that many people in new york, especially people in businesses in new york had, had a 30year run. Youre right. They laughed at him for over three decades for his business acumen. What started in new york, raises the question, why didnt it begin sooner . Why didnt anyone in Public Office and power, in Public Office over these 20 to 30 years in the past, why didnt they take him down . We asked that question in realtime. Weve asked that question. Ive got to say, im glad that when he talks about this, he talks specifically about maga republicans and says explicitly not all republicans because i know an awful lot of republicans very concerned about the fact that you have a president talking about assassinating the chairman of the Joint Chiefs Of Staff, talking about defunding the fbi, defunding the department of justice, tearing at the very institutions that have made this country, you know, what it is, that protected our rights and our freedoms. Its too abstract. People will never understand, and you want to talk about something they can understand at the dinner table. You may disagree with me on this issue or that, but theres something larger at stake here which is democracy, so i think he has to do that, and also remind people not just about the stakes, not just whats The Case For Democracy . He hinted at it and didnt really develop that. Why does the Average American have a stake that American Democracy continues . He needs to remind us how democracy historically is delivered, how weve done well despite our current progress, and what happens to us if democracy in this country, if we become another hungary, if we become an illiberal democracy, what a president could do, and he has a good case study, and its called the shutdown. It shows we cant deliver and how Average Americans really suffer. It concerns our allies, the dysfunction. I will say again, talking about the ptency and the power of the democracy message, a lot of us were surprised even though we were hopeful. A lot of us were surprised at how just about every top tier candidate that was running as an election denier, they lost. They lost in arizona. They lost in state in pennsylvania. They lost in state after state across the United States. This is a powerful message. Plenty of House Members will return to their seats, but those highprofile senate and governor candidates lost. Most importantly, Secretary Of State candidates lost. Largely lost. This is the fourth in a series of speeches the president has given on this topic. President biden is, you know, one who likes to join proving political pundits wrong and hes really glad this resonated and they think it will again. This is what theyre saying Behind Closed Doors and hes made this argument and yesterday he took it to the public and he also tied it in with current events. Its out there, and its infected the culture, and he would talk about the culture more about the politics, that what has happened to our culture as a result of the denials, the denials of whos rightfully elected president of the United States, and richard, he will also talk about the fact that when he goes overseas as he just did to india and hanoi and other country that is hes visited as president of the United States, within the first five minutes, a leader of that country, whatever country he is in will raise the prospect fearfully of whats going to happen next to you. Of course, its a legacy and a career that started with tragedy when on november 27th, 1978, San Francisco mayor George Moscone and harvey milk were shot and killed in San Francisco city hall. From there, obviously, her career moved forward and her passion obviously for gun safety really started out of tragedy. Claire mccaskill, former senator from missouri is on the phone with us. Senator mccaskill, tell us about senator feinstein. You know, joe, the memories just flood back. Theres a couple of things i think its really important to say about dianne as we mourn the passing of a giant in political history and such a trailblazer and mentor for thousands of women across this country and california. One of the things i think thats important to remember about her is, when i first came to washington as a senator, she was very kind, was a great mentor to me. But i watched which senators were being controlled by their staffs and which ones knew their stuff out staff. She was in that very small group of senators. She was not staff driven. She knew her stuff cold. Her preparation was the best. She would wade into complicated things and really understand them. Of course, the memory that i remember the most, people have no idea the pressure she was under before she gave that onehour speech on a black chapter in american history. That was the torture that we dealt out against the war on terrorism. She asked me to have a martini with her the night before. So we went to this restaurant. She was firm, she was determined, but she obviously was feeling the weight. She was getting pushed by the Intelligence Committee and the white house not to do it. She stood up that next day and gave one of the historic speeches given on the senate floor. I would ask everyone who wants to mourn her today to go online and watch that speech and see her command of the material and her commitment to america doing better. Thats all you need to know about who she was as a person and a senator. As a person, she was fun. We had a great back and forth about the San Francisco giants when they beat us in 2014. I had to bring her barbecue. She always had a smile on her face. She always had time for people that had just arrived at the senate. The senate will miss her, but this country will miss her. She is going to be seen as a giant for the rest of history. A giant in San Francisco politics, a giant in california politics and a giant american politics in the United States senate. As you said, she had it down cold. She, like Hillary Clinton, to women who never went to a Committee Hearing meeting without knowing more than just about everyone else around them, because they took their job extraordinarily seriously, were always prepared. Unfortunately the contrast is all too sharp with many that we see right now in american politics, who go on with a sound bite just to try to get on tiktok or raise a few dollars online. Claire, im so glad youre here with us talking about Dianne Feinstein. Its great scrolling but pictures through the years, because all too often some politicians are remembers for the last chapter of their life when theyre in decline. Dianne feinstein was in politics for so long and such a dominant figure that its not only the last chapter were talking about when she started to fade in public view. I do hope, as you said, people will go back and not have their memory of Dianne Feinstein framed by what she may or may not have said over the past six months or a year, but look at what she has said over an incredible 55 years of Public Service to this country. She had to fight through a thicket of really tough politics in california. I think people forget that when you have a state thats dominated by one party and she was in office at times when california was capable of electing republicans in statewide office. Within the Democratic Party for her to thrive and survive the way she did and her determination to take the job so seriously, she always knew that if she was more prepared, it would be easier. She took on the burden and did so many jobs in a way that california just embraced. They sensed her intelligence and her work ethic. If you look at the last few years of her life where i hope people see it as her incredible commitment to the job, it was to difficult for her to let go because she did take it so seriously and it did define her life. She loved her family and her and dick had a great partnership, but her unwillingness to leave didnt come from anything about her personal power or aggrandizement or i need attention. It was really that she felt so connected to the obligation she had to the people of california and this country. Looking at these pictures, we see also that she had no fear of spending time and working with members of the Republican Party, even members with whom she disagreed on so many issues. She was somebody who believed in bipartisanship and was constantly working for it. Nbc news chief washington correspondent Andrea Mitchell has a look back at senator feinsteins life and career. In congress she quickly made an impact, leading the charge for an assault weapons ban in 1994. She took on the cias waterboarding of prisoners, Holding Hearings into the bush administrations harsh interrogation techniques. In later years, senators faulted her participation in the Supreme Court nominations. This has been one of the best set of hearings i have participated in. Reporter through political and personal trials, her legacy as a trailblazer endured. Andrea, thank you so much for that look back on the remarkable life and career of Dianne Feinstein. Give us some of your memories of senator feinstein. I remember her going back to the assault weapon ban that was passed in 1994. A lot of people have taken credit for it, but up until fairly recently among democrats everyone knew and acknowledged that Dianne Feinstein pushed that because of mass murder at mcdonalds, of course the murder of harvey milk, which is what elevated her into leadership in politics. She was already in politics, but thats when she showed such leadership. Weve seen the pictures of her leaning over his body in San Francisco. She really was a force for the weapons ban and of course the sunset in 2004. It expired and they were never able to put it back together. She went up against the Intelligence Committee. John mccain, who of course was tortured during his imprisonment in vietnam, so that Bipartisan Coalition changed the whole dialogue over the way prisoners were being treated in abu ghraib. She led the judiciary committee. In recent years she was clearly failing and that was quite sad for her friends and admirers. She had moments of brightness and great charity, but also she was frail. Then of course her husband had lung cancer and had died and his loss really brought her down and then the shingles and all of the other disabilities. Its a complicated picture. There are some who said she shouldnt have run again when she did run for reelection. It raises the age issue, which is a big issue in the campaign. Again, weve got Doug Brinkley here. If youre writing a book on Dianne Feinstein, its a thick book filled with a remarkable life and this chapter where she was struggling sometimes with her memory may be one or two pages in that book. Thats why i say i hope people look at the totality of her career and also understand while california is an overwhelmingly democratic state, as she was rising politically, it was a state of richard nixon, of Ronald Reagan, of pete wilson, of arnold schwarzenegger. That was republican state, an independent state. Really if you look back at her career, she was always looking for bipartisan compromise. Thats what i remember her for, joe. She was a democrat. In california she allowed others to be more left of her, but she could do business with conservatives. When she won that special election in 1992, bill clinton became president. She worked with clinton and became a big promoter of saving the beauty of california. She really went full bore into saving the mohave desert. California never had anybody who loved the firefighters like she did. She won every National Park award known to humans because she weighed in at key moments starting in 93 to the end of her life. Shes a Climate Change warrior. Shes been trying to get california prepared for the drought and the fires. She was walking arm in arm with president george w. Bush at a disaster site. She appeared with thengovernor schwarzenegger reaching across the aisle working in a bipartisan fashion. She also was not afraid to defy Washington Group think. Speak to us about what an important part of her legacy will be. She and Lindsey Graham had an interesting friendship. He respected her. Also Kamala Harris was sort of a student of her, our Vice President today. She was kind of a pillar of the Democratic Party establishment. If you wanted to get Business Done on capitol hill, you go to our office. We have some senators that are show horses and others that are workhorses. She was a workhorse. She got a lot of things done. She was committed to combatting the war on terror but in a human and decent way. She never really had any bad words towards george w. Bush. They remained friends. Look at pictures of her and nancy pelosi together, two powerful women. Nancy pelosi didnt take a job unless she could get the job done. She didnt put a vote on the floor unless she knew it was going to turn out well for her and her party. You could say the same about Dianne Feinstein. What generals always said about Hillary Clinton, she was always the most prepared in any hearing. She knew more than just about anybody else on the committees, really remarkable those two women from california that had such an impact on the national stage. Jen palmieri, you actually were in the bay area during the assassination of harvey milk and saw Dianne Feinstein become a National Figure in that moment. My dad was stationed in the bay area when that happened. It was such a shocking thing. The mayor was assassinated, another member of the board of supervisors was assassinated. She takes over as interim mayor and runs quickly to be mayor. I think about the women in the bay area at the time, nancy pelosi, barbara boxer, Kamala Harris. She was growing up in oakland at that time too. All of us saw this woman break all of these barriers. To think Kamala Harris saw her as some kind of role model, like whats possible for women. Then i worked in the california delegation that she led as United States senator, went through a lot of work with her on Environmental Issues as doug laid out. During the obama administration, on the intelligence hearings and really tough, but very principled. The assault weapons ban, a leader there. Its a remarkable story line. I remember her campaign commercials, forged in tragedy, forged in steel. She took over as mayor because someone tragically died in office and she stayed with it for almost 50 years as a public official. You had an up close and personal look. You served with her. Tell us how exactly she got things done, which included at times reaching across the aisle. She was old school. Dianne feinstein was old school. By that i mean she was disgusted by the performance politics that have kind of taken over. I remember how antitwitter she was at the very beginning of twitter. I remember a caucus meeting when she spoke out and said i dont know why any of us are thinking this is the way to serve the people that we work for. It feels like to me that you could use your time when youre doing that for better use. She wasnt scolding everyone. She was reminding everyone that there were more important things to do than just selfpromotion. Thats the way she did her job. She was a bipartisan senator. She firmly believed that making friends across the aisle was part of the work, that if youre going to make lasting change and i think she would cite the assault weapons ban as an example. It didnt stick, partially because it was not bipartisan. She knew that if she was able to get bipartisan support for a way to solve a serious problem for america, it would stick. It wouldnt go away with the next election or the next change in power. She was also i would bet a dollar that she weighed in on the change to the dress code. She really believed in the dignity of the office, and she carried herself that way. She cared about her appearance, not because it was important, but because it reflected the dignity of the office. I bet you one reason that thing got changed back, i guarantee you she chewed on Chuck Schumer about changing the dress code, because that would have been anathema to her. Think about her career. Never a whiff of scandal. They went after her husband, but thats kind of like the sun coming up in the morning when youre in politics. But never was there any whisper of Dianne Feinstein doing anything inappropriate or untoward in her office. And she was kind. I think people need to remember when youre in that kind of body, theres so much ego, so much ambition. Theres a lot of intelligence. Theres a lot of manipulation. Many senators dont take the time to just be kind. She was very kind. She was always asking about my family. She remembered when i had a grandchild. She cared about other members. She was a tremendous colleague. This is really the passing of something important. I know there are still people there working toward the goals and ideals that she held, but theyre a little wobbly right now. We have senator gary peters with us from michigan. Reflect on the life of Dianne Feinstein, if you will. Im certainly very sad to hear this news. She was an incredible woman and an incredible senator. As ive heard already in the program talking about her as being a trailblazer, theres no question about that. She had incredible stature in the senate. I remember coming in as a freshman and one of the first people to make an effort to greet me was Dianne Feinstein. She was just so warm. When i would see her at other meetings or caucus meetings, especially in those early years, she would always want to know how i was doing, what i was working on. She just was a very special person. When you think about our caucus meetings too, i was always impressed by the fact that when she got up to make some comments, people paid attention. She was highly respected by all of my colleagues. It was because she did her homework, knew the issues and was always speaking from the heart. We had Claire Mccaskill talking about how things are a bit wobbly right now in washington, d. C. , obviously a lot of concern about the antidemocratic rhetoric and actions that have been taking place over the past several years. Yesterday joe biden went out to remember an old colleague of his, senator john mccain, and gave a fullthroated defense of American Democracy and pushed back against those who would undermine it. Im curious your thoughts about the president s speech and just how important it is that as we look back over the legacy of somebody who worked within this institution, this remarkable institution, because it has been and i believe it will continue. Talk about how important it is to look, to reflect on the lives of people like Dianne Feinstein, who gave their life for American Democracy. How important is it that we focus on the words of what joe biden said yesterday in arizona . Those are two very important things to reflect on at this moment. She did work in a bipartisan way. She was always looking to bring people together. She was, at least as i knew her, she was never someone to try to seek out the spotlight to get on cable tv or get media attention. She was more interested in how do we get this work done. She knew that folks have to come together. Right now, we have way too many folks who are more interested in causing controversy and getting clicks on social media as opposed to getting the work done. Dianne was focused on that. She believed Public Service was a noble profession and she stood up for everyday folks, to make sure they were heard in the process. Thats fundamental to our democracy. Our democracy is about bringing diverse interests together, understanding that we share a Common Objective to make this country stronger and make sure everyone has a voice. Unfortunately we have many folks in this town right now that are not interested in that. Theyre interested in chaos. Theyre interested in getting on television to become a celebrity. Dianne was not about celebrity. She was about working. As the senator and i were talking about joe biden in arizona yesterday talking about the fight for the future of American Democracy, heres some of what he said. Ive come to honor john mccain because he put our country first. The country should unite all americans regardless of political affiliation. Theres something dangerous happening in america right now. Theres an Extremist Movement who does not share the basic beliefs of our democracy, the Maga Movement. I know because ive been able to work with republicans my whole career. But theres no question that todays Republican Party is driven and intimidated by maga republican extremists. Their extreme agenda is carried out with fundamentally all of the institutions of American Democracy as we know it pushing the notion that the defeated former president pushed while in office and believes only applies to him. This is a dangerous notion. This president is above the law, no limits on power. Trump says the constitution gave him, quote, the right to do whatever he wants as president , end quote. Ive never heard a President Say that in jest. Not guided by the constitution, but by vengeance and vindictiveness. Quotes from the Maga Movement, quote, i am your retribution, slitting the throats of civil servants, replacing them with extreme political cronies. Maga claims support for Law Enforcement only to say, quote, we must destroy the fbi. Its not one person. Its a controlling element of the house Republican Party. Whitewash attacks of january 6th by calling the spearing and stomping of police, quote, a legitimate political discourse. Did you ever think youd hear leaders of the United States speak like that . Accusations against treason against a Major News Network because they dont like its coverage. I dont know what theyll say about fox if that becomes a problem. Think about it. I have overseen a change of responsibilities of the chairman of the Joint Chiefs Of Staff of the United States military. From one patriot mark milley to another general cq brown, both defining leaders of our time. Yet here is what you hear from maga extremists about the retiring patriot general honoring his oath to the constitution. Quote, hes a traitor, end quote. In times gone by, quote, the punishment would have been death, end of quote. This is the United States of america. This is the United States of america. Although i dont believe even a majority of republicans think that, the silence is deafening. Its an incredible speech that he gave if you look at the points being made. First of all, what president this century could deliver that message better, saying its not all republicans, its just a small portion of republicans than the president. And this is just a fact. Hes passed more Bipartisan Legislation with republicans than any president this century. Secondly, 50 years from now i know people will be looking back saying why werent politicians delivering that speech every day when you have somebody who is leading the Republican Party who talked about terminating the constitution, arresting democrats after hes elected, executing chairmen of the Joint Chiefs Of Staff, trying for treason News Networks that they disagree with and finally defunding the fbi. We have gotten numb to this. You just take the part where hes going to try a network for treason. You combine that statement with his promise to move the fccs powers away from the agency and into his office, and suddenly you have somebody who makes orban look like a champion of liberty. I thought it was one of his best speeches. I do believe he was moved by john mccain and wanted to honor mccains family and friends that were there. Its amazing how hardhitting the speech is about saving our democracy, but he does it in a bit of a whisper. If you really listen to it, its the exact right tone. You dont want to be going back at trump like this. He set the stage. That speech will be done in different iterations every couple of weeks everywhere with a new news bite. Doug, remember, before the 2022 election when democrats were supposed to get pounded by this massive red wave, he gave that speech and he did it with red lights on a building, everybody mocking him, saying what in the world is he talking about that for . People dont care. It ended up that swing voters and the people who decided who was going to be the next senator in pennsylvania and georgia and arizona, they actually did care. Just like this message will also break through, even if pundits are snoozing through it. Absolutely. Keep in mind it was a big week with the uaw. Being there in detroit showed the economic side ofbidenomics. And then donald trump going up and doing him a favor by saying, hey, theyre wasting their time picketing. Those two will be linked together in history in what was going on, the beginning of this pseudo impeachment trial thats like an empty vessel. Mehdi hasan is with us. A big piece of that is going to be this warning that our democracy is in danger, that the threat posed by trump did not evaporate in 2020. Its also a way for the president to address without addressing it, trumps legal problems. The trial happening next year during the heart of this campaign is the one that jack smith brought, the january 6th trial. Its a way for him to bring that up to sort of suggest to voters we cant go down that path again. He tried to overthrow our democracy. What was striking to you about what the president said . Striking that he did it. This stuff does cut through. Ive been waiting for a while, as have many people, for him to come back to this topic. Last year ahead of the midterms he did his big speech on democracy. That was lot of pressure from centrist democrats to say lets not talk too much about this stuff, lets stick to Kitchen Table issues as if. Saving our democracy doesnt save the entire Kitchen Table. Im glad the white house is returning to this topic. I hope biden continues to be as aggressive as he was yesterday where he talked about the deafening silence from republicans. He made the point the majority of republicans are not all maga, but theres a deafening silence on the part of all of the elected ones. Im glad biden brought up the threats against milley and the threats against nbc and msnbc. Im glad the president is speaking about this. You mentioned the trials. You said rightly so, hes staying out of it. It makes no sense that the democratic president ial candidate is not going to have to start pointing out to people, by the way, the guy im up against is on trial in four different jurisdictions. The other has 91 counts against him. Joe biden has to say that at some point. I dont know if claire is still with us, but we had a conversation about this topic and the tension. Does biden win everybody over by convining hes done a good job as president , or does he focus on trump and the threat to democracy . If you do that, that is likely to overshadow any argument youre making on just trying to do the normal job of president and help people in their normal lives. How do you think the white house should balance that . Its a great question. Its not a choice. You can do both. You can walk and chew gum. Ive never believed this argument that you cant look back and look forward. Most voters dont like talking about the past. They want to know what youre offering for the future. Already theres this argument about the economic legacy. Its frustrating that bidens economic message isnt cutting through yet. Hes putting out ads that he supports workers, et cetera. Thats all great. But ultimately we have a twoparty system. Youre chooing between two men to govern you next year. In all the focus groups that show people are not happy with biden, people say, well, okay, biden v trump, well, biden then. This has been the case for about two years now. I remember after Glenn Youngkin won in virginia, everybody said, oh my god, this is such bad news for democrats. You look at these voters. Theyve all moved away from biden. They all disagree with biden. The final question in all those polls are, do you regret your vote in 2020 since you think its such a mess in 2021. Every single voter in these focus groups say, no, im not going to vote for donald trump. I still havent found a voter that voted for donald trump in 2016, voted against him in 2020 but is going to vote for him in 2024 because they really like what he did on january 6th, they really like the fact that hes talking about assassinating or killing the chairman of the Joint Chiefs Of Staff. They arent out there. Again, people can bitch and moan in 2023. Ive seen this before. Ive even surprised myself at times. You go and look at the two names and youre like, no, i cant do that. Classic swing voter joe scarborough. There have been years even when i was a republican that i was so angry that i voted a straight democratic line. But voters go in and you study them. A lot of times you have to ask yourself, are they going to vote for donald trump post january 6th, post all of this madness . I dont see it happening. I agree. Its a very difficult debate. You mentioned James Carville and bedwetting. Hes been doing quite a lot of bedwetting from some of his recent interviews. You dont want to be complacent about donald trump. If he does win, its basically the end of American Democracy, in my view. I would be far more nervous if it was tim scott or nikki haley going up against joe biden. There wouldnt be such a stark choice. Republicans know hes going to cost them with young voters, women, minorities, et cetera. As you say, the person doesnt exist who voted against trump in 2020 but now think trump has comported himself in such a wonderful way over the last three years that he deserves another chance. You mentioned youngkin. Can we talk about how bereft the Republican Party is that theyre now talking about Glenn Youngkin to get in the race for donald trump to swat away just as he swatted away ron desantis . The possible Government Shutdown, the Impeachment Inquiry is all being done under the leadership of house Speaker Mccarthy. We know representative matt gaetz is going to file a motion to vacate to challenge mccarthys power. If not mccarthy, who . Is there any sense that if they do oust mccarthy, who could replace him . Theres been reports theyre considering someone like tom emer of minnesota. The matter remains that it doesnt really matter who is speaker, its clear that matt gaetz, Marjorie Taylor greene and Lauren Boebert are holding the power. They want whoever they put in that seat to make concessions to them. I think that would be incredibly difficult for anyone to do. Theres reports matt gaetz might want to run for governor in florida some day. Thats certainly motivating him to do things like oust mccarthy and really kind of reshaping the caucus in his image and trumps image rather than something thats beneficial for the party. I actually met her at the Democratic Convention in 1984 in San Francisco. She was the mayor. Thats also where i met n pelosi. She was one of two finalists to run with walter mondale. I think that should remind us how persistent feinstein had to be to succeed in politics. She ran twice for mayor and lost. She was thinking about leaving politics when she became mayor through assassination. She ran for governor in 1990 and lost and turned around and ran in 1992 and became one of four women elected to the u. S. Senate. Just to remind you how different times were then, at that point there had never been more than two women elected in the senate at the same time. Were not at parity now, but there are 24 or 25 women in the u. S. Senate at this point. Its fascinating. The first time you met her was in 1984 in San Francisco. Of course, republicans castigated the San Francisco democrats, described the party of the San Francisco democrats, who of course lost 49 states in 1984 to Ronald Reagan. But what a contrast Dianne Feinstein was with that sort of cartoonish, twodimensional view of the Democratic Party. She actually was a moderate. She was somebody who would work with republicans. She was somebody constantly looking for Bipartisan Legislation. She was not the stereotypical San Francisco liberal. She was more centrist, more pragmatic. She was hawkish on some issues. She had two overarching achievements in the u. S. Senate. One was the assault weapons ban in 1994. The second was leading the investigations into actions by our own intelligence agencies after 9 11 to uncover aspects of torture. That is a legacy that is not that you would say as a San Francisco liberal legacy. It shows a lot of muscular and independent and pragmatic and bipartisan approach to some of these issues. Tell us what you think well be seeing on the hill over the next two days as republicans try to figure out whether theyre going to shut down the government or let it keep functioning normally .
