His republican backers, claim all of these charges are just the result of corruption and conspiracies against trump, but please remember, those charges, many one charges represent the work of multiple grand juries, which are made up of every day americans. There are separate judges, prosecutors, and investigators, not the socalled deep state. No surprise, donald trump is continuing his relentless attacks on officials involved in these prosecutions. Judge whos overseeing the fuller has officially warned him about making inflammatory statements, but he is not stopping. Tonight, a texas woman is under arrest, for allegedly threatening to kill if trump does not get elected in 2024. Nbc news has learned, some Trump Supporters have posted online the supposed names and addresses of a grand jurors who indicted trump on monday. People who are simply doing their civic duty. Patriots. Earlier today, one former top official of the white house in his spoken out against trump since, offered this warning. We now have a Political Party that is mainstream that violence as unacceptable tactic in these studies show, the gop base is embracing it. Donald trump continues to blow that dog whistle, were talking about real threats of real people. You have to take it seriously. With that, lets get smarter with the help of our Leadoff Panel tonight. Senior Legal Affairs reporter Wall Street Journal reporter based in atlanta, and former u. S. Based attorney joyce vance who spent 25 years that a federal prosecutor. Cameron, i know you have interviewed fani willis, you know this, woman she has set a very aggressive timeline for this case. What should we take away from that . Well, it is not surprising that she did so. She has been very clear that she has been a Marshall Ford on this case, despite all of the annoyance around, it she is moving forward, moving forward quickly. Having said that, i think her timeline will be complicated by a question made today, and certainly going to object and be motions to delay. But, shes making it clear she is going to this is just days after the indictment shot, she is seeking to set a trial date. She is also, as you know, august 25th as the time when everybody has to show up to the courthouse, be booked, or they are going to be issued for the arrest. So moving forward. What can you tell us about the judge in georgia . Well, i just actually wrote a story about it. A very young man, 34 years, old just got on the bench, just got on the bench earlier this year. February this year. He is a former prosecutor. So we did not really he certainly has never handled a case like this since no one has. But, he is been described as a very balanced for professional, but this is going to be the ultimate test of a guy who just started on the job. Okay, joyce, im thinking about this date that fani willis wants in march for a trial. The fact that it is trump and 18 other defendants. What is this thing supposed to look like . Donald trump Standing Shoulder to shoulder with these people in one courtroom . So, i suspect by the time this case goes to trial, she will have lost some of those defendants. They will have either pled guilty street up, or they will have pled guilty and engaged in Cooperation Deals with her. But you know, prosecutors do these large cases, sometimes you have to reorganize the courtroom in little bit. You have to accommodate a defendant, their lawyer, perhaps a couple of lawyers and paralegal. So you will see long lines of tables in the courtroom, with defense teams. This can be condo sent in court as well, sometimes to hear a witness testify and prosecutors and judges are used to handling, it is maybe a bit less than an ideal situation, but donald trump will proceed to trial unless the judge orders otherwise with all of his codefendants. They remain in the case, and that will happen at some point in time, perhaps not on precisely the aggressive schedule that fani willis has asked for. When do you think it will . You know, it is hard to say, the only reason i make that comment is because, there will be such a barrage of fruit pretrial motions. We are seeing the beginning of it now with Mark Meadows Motion to remove the federal judge has set a really aggressive schedule. Hes holding a hearing in two weeks. In fact, he may be so fast that trump may perhaps change his mind about trying to remove the case to federal court. But that said, we will see these motions from other defendants. Jeff clark who is doj, very likely to make a removal motion. Trump himself. House these Motions Pileup and require some sort of a resolution, this may slow fani willis is desired scheduled all right, kyle, new, topic, one i have been laser be focused on all day. I mean, i actually read this 200 pager. Twitter and the doj, if you read the twitter filing, all 200 pages, you come away with the following. That this judge, judge howell, its an absolute powerhouse. She grilled twitter and the doj about dms, pleaded messages, as though she ran a tech company, not like shes a judge whos also overseeing, you know, insurrection cases multiple days a week. And what it appears is that donald trump was either sending or receiving a ton of dms, or both, and the doj was laser focused on getting all this information immediately. And what was even more stunning is that twitter work really, really hard and spent Tons Of Money Fighting to not give this information up. So, essentially fighting on Donald Trumps behalf. So the question is, kyle, why . I know your all over this. Why on earth would twitter go through such Great Lengths not to share this information with the government . Well, you mentioned beryl howell, she had an idea of the answer to that question, she raise it repeatedly in these transcripts that we were reading out. You know, look, jack smith got what he wanted eventually, but the fight and the judge kept saying for what possible region could you have to stand up for this particular person when youve never done this in the entire history of twitter, tried to stop the government, essentially, essentially they wanted to tell donald trump that the government got a Search Warrant for his account. And the judge said, why would you want this . And she even said, is it because your new ceo wants to cozy up to donald trump . Does elon musk have something to do with this . And twitter lawyer said no, thats not, it we just want to stand up for the Constitutional Rights of the country and our users. But the judge and the prosecutor said, well, how come youve never done that before in any other circumstances . Theres something about this particular user that this company at this time wants to protect. And what was their answer . Whats that . And what was their answer . There wasnt really one. It was just we protect our users and this is a unique user where there might be executive privilege issues, unlike any other user in our history. But the judge said why is that different than any proves that anyone else could raise, like marital privilege or some sort of religious privilege, why do you stand up for users in those privileges . And they really can distinguish. Kyle, how important was this information on the twitter account to jack smith case . Well, some of that we may have yet to learn when we see more details. But you know, we know in the indictment, they said donald trump sent ex tweet at x time. I think whether things he probably learned was which device did these tweets come from. Was it donald trump sending these tweets, versus an aid in a different part of the white house . And i think is important to know Donald Trumps mindset. Was he the one sending the specific tweets that we have written and talk so much about related to january 6th . And i think the fact that the indictment says, yes, donald trump sent this particular tweet suggests that they know that for certain based on the data they got from twitter. Joyce, these two direct messages, doesnt it seem out of character for donald trump . He is well known. He does not use email. He doesnt taxed. He doesnt like to sign his name. Very well known for no paper trail. Did donald trump fall into the trap that the rest of us do, which is sloppy texting . You know, its intriguing, because trump notoriously doesnt taxed. He knows not leave a paper trail. And trump as employees have articulated that he does not do that. Likely what happened here is it did not occur to him that there might come a time where the Justice Department would be able to access his account here and see what was going on behind the scenes on his twitter account. And as kyle says, this is so essential and this is something prosecutors do, for instance, when they access email accounts, you can look at draughts, you can look at interactions between people, in this case with trump, you can see if it was actually trump who logged in or someone else. You can determine that from geolocation data. E that froso, a lot of really fg evidence, information, that the former president left behind. And its likely simply because he failed to realize the government could ultimately access it. Kyle, help us understand how much the government wanted this information, what they were willing to find twitter day in and day out if they didnt get it. Well, the filing we all saw unsealed was an effort to hold twitter in contempt. That was another aspect of this. Judge howell was just so bothered by the fact they blew past two Court Ordered deadlines to shes holding them in contempt of the government urging. They ended up being fined about 350,000 for three days of violations, and part of that was the judge said, hey, elon musk is a billionaire, he just bought this company, and he can afford it. So, she find them 50,000 with a fine that was going to double every day. So, it was 50,000 the first, a 100,000 the next day, 200,030, and finally after that, they gave up all the data. 300,000 for what . I cannot wait to see. I hope we do what was in those messages. Cameron, lets talk about something more serious. There is unrest over a death threat against the judge and the federal election case. Right. Georgia grand jurors names and addresses have been posted, and those people could be in danger. Are people in atlanta talking about Security Concerns as this case moves forward . Well, the truth is, weve been talk about Security Concerns here for years now. And as you know, in preparation, the indictment that came down monday, we had lots of security around the Fulton County courthouse. They are putting up barricades. Their Police Presence was extreme. There was bomb sniffing dogs. And that is gonna be something that everyone is gonna be thinking about. Certainly, when this play when this trial takes place, in whatever manner it takes shape, theres gonna be intense security at the courthouse. And we have lots of concerns about that. District attorney willis as certainly made that a big issue for her when she let us all know that these were coming, these indictments were coming she definitely let everyone know that the sheriff needed to be on high alert because of Death Threats that everyone has been receiving. Theyve been receiving Death Threats. She certainly has received, in the sheriff has received them. We had numerous Death Threats during 2020. So, everyone is on high alert here, for sure. Joyce, lets talk about Rudy Giuliani. At one point, he was a very well respected mayor of new york city. He then took a turn, hungry for money, power, proximity to donald trump, and became one of his closest allies and confidence and advisers. And cnbc is now reporting while he did advise donald trump, trump never paid him. And now, what is Rudy Giuliani doing . Facing charges himself. Do you think that will increase the chances he could flip on trump . Well, trump doesnt seem to have learned the lesson of michael cohen, right, where he, instead of Holding Cohen close, let him slip further out and ultimately cohen did talk with authorities. But that was during the Trump Administration and the trump lead Justice Department, and that case was one and done, nothing came of it. This is a different situation. And many of these individuals who find themselves indicted alongside trump will have to make a very calculated decision about whether they want to spend years, potentially, in a georgia prison. I think for many of these people, and Rudy Giuliani knows a lot more about bad present conditions that many people do, that may become a compelling factor. And when you line that up with his inability to afford the kind of lawyers that all of us would probably want to have in this sort of a situation, he may be interested in pleading guilty. Whether or not prosecuted believe he has anything to offer them at this point is an entirely different calculation. All right, well, that might be rudys calculus. But joyce, is trumps calculus that, yes, rudy knows a lot, and in theory, could harm trump . But be honest, is there any prosecutor out there that would view Rudy Giuliani as a credible cooperating witness, given all the answers weve seen over the last few years . It would be tough to put Rudy Giuliani on the witness stand without a lot of kerrobert of material. But remember, this is someone who worked inside of the criminal Justice System for many years. He would be able to appreciate the situation that he is now in. And if anyone knows what he has to offer prosecutors, its giuliani. So, whether thats witness testimony, information that he could offer that they could corroborate, thats something that he would determined put forward with them. Trump certainly is not acting like someone who is concerned that giuliani will either flip, cooperate, or either have anything valuable if he does. He seems to really be paying him very little attention at this point in time. Wow, we have a lot to cover tonight, guys. The post reports, by tuesday afternoon after their story was published, x started to reverse the slowdown on some of those sites, dropping the delay times back to zero. Curious. So, lets discuss. Nbc Tech Correspondent jake ward is here. He wrote the book the loop, how technology is creating a World Without choices and how to fight back. Jake, i had have you want to discuss this. Elon musk says he is all about free speech. But it turns out he is all about free speech when its nights to him and about him, its hes more like a free speech occasional assist. It really is true, steph, we have come so far from the early days when he first walked into twitter and said he was going to make that place a bastion of saying whatever you want, you, no talking about replatforming the president because, you know, there should be any kind of special standards, all of that stuff. But here we are, we are fighting for that is absolutely relative to his personal preferences. According to the washington post, as you mentioned, as of tuesday, all sorts of t dot coal links, those are the length that you click when you go to twitter, are getting throttled for about five seconds. Which as you know, that is an unbearable amount of time. And thats four lengths to New York Times, that was linked to some of these rival provinces come up, like blue sky, which is supposed to be a friendly alternative to twitter. So, it turns out it is not just a matter of delivering things as fast as possible to users, the way that everyone else president in this industry. It seems to have been that the twitter, this platform, x, whatever were calling it now, really was trying to make it unbearable to go to the states that elon doesnt like. Could this new reporting hurt their business even more, right . Whats their biggest problem . Making money, advertisers. And the post points out the companies spend millions of millions of dollars to make sure their sights open as quickly as possible. Now that we learned that elon puts his finger on the scale or puts some sites at the back of the bus, what impact could this have . Well, i mean, its absolutely the case, right, that your site lives and dies by played, by latency, by how much time it takes those things to load. Whole teams, thousands of engineers, are devoted to that particular function at some of the biggest sites. Because that is the difference between someone sticking around to doing the thing you want them to, and going somewhere else. So, the fact that he may have done this simply out of spite, i mean, obviously have no idea why he wouldve done this. But the fact that it is absolutely something he spoken his displeasure about in the past makes a huge difference. Because if you wind up being the kind of advertising versus, you know, oh, im going to want to go back on this platform, you know, former nbc had a bad sales yaccarino was trying to explain to people, oh no, you can relax, we have it under control. This is a place you can really rely on for your brand to live on. I dont know how shes got to make that case, considering this guy maybe throttling some of the biggest and most popular sites in the world, steph. All right, we just spoke about it in our last segment, but ive got to ask you a different kind of slow walking. Twitter, slow walking, delaying, refusing to comply with a Search Warrant from jack smith earlier this year until they were forced to, a Search Warrant for content in Donald Trumps twitter account. You cover the sky every day. What do you think . Well, i think its so fascinating for so many reasons. I mean, first of all, you know, the i think that the opportunity that you have to not only look at, you know, which devices were posting on his account, which of course means you can establish a pattern of who the group is there, but the fact that there are also direct messages and direct messages and tweets that may have never been sent, were only considered and then deleted. I mean, you suddenly, as a prosecutor, have all sorts of things about if youre really going after rico statutes offenses there, he can really establish this pattern of mindset. I, mean it is one those things where ive always been a little nervous about sending dms on twitter. And try to get off as much as i possibly can. Oh man, to this feel like a lesson for all of us where you do communications. And then, this question of does even months seem to be sort of cozying up to the former president , the way that the judge suggested . I mean, i have to say, right, if you have depended on this kind of me lowered edge lowered slightly all right kind of environment to make yourself popular, which those are the folks hes most popular would, it definitely goes with the ammo that he is trying to push on twitter. It just feels an answer to the judges question, is he trying to cozy up. Those are those who have been watching it for a long time, feel like the answer is probably yes there. For those of us who are watching mosque, but what is musk saying, or musks camp, those allies, those homeboys who are always around him, you know, kind of speaking on his behalf, how are they rationalizing or explaining this . Well, you know, undoubtedly they would say, you know, theyre saying a couple of things. First of all, like, its the former president of the United States. He does deserve special consideration. And they would also, you know, undoubtedly fall back on the thing everyone talks about which is you need to protect your users, especially your most popular users, from subpoenas, from the courts. You know, you need to sort of hold them at bay as much as you can. It turns out in this case, twitter, to the tune of 350, 000, you know, lost their fight to do so and was called all sorts of names by this judge. You know, but its very much in keeping with this idea of we are eating them onto ourselves, we have to keep everybody at bay as much as we can. But we had with an organization that at the same time is capitulated to all sorts of censorship, you know from abroad, this is again, talking to this thing about free speech absolutist, the relativism of all of this is very very stark. Yes, you could make the case that were talking about a former president of the United States who deserves special consideration. But the other side of that coin is youre talking about the department of justice and a subpoena. That my deserves special consideration as well. Were gonna look what its done and whats ahead with our friend justin wolfers, also known as fed lasso, when the 11th hour continues. 11th hour continues. One year ago that, i signed the Inflation Reduction Act into law. And one of the most significant laws i everything has been enacted, taking on the Special Interest and winning, and winning. [applause] President Joe Biden marking one year since he signed the Inflation Reduction Act into law. But while the president celebrates what is in the law, he said on the Campaign Trail last week that he wishes he had not given it that name. So, lets talk about why. Justin wolfers, professor of economics and Public Policy at the University Of Michigan joins us. So, justin, inflation is lower today than it was a year ago. How much is the i. R. A. Responsible for that . Theres too way of telling that story, stephanie. One is you look at the graph of inflation that goes bump, bump, bump really high, and then suddenly ventilation production act passes, and suddenly, boom, it crashes back down to third of its previous level. That might be what youre hearing on the Campaign Trail. The truth though is President Biden is right, it should never have been called the Inflation Reduction Act. Its got a lot to do with our longer term fiscal sustainability, Huge Investment in the environment and the move to electrification of vehicles, for instance. In 1 million little ways it will affect your life and mine. But most experts agree that its had very little effect on inflation so far, and will likely have very little effect on inflation over the next few years. To your point, what this is is the government making investments, which hopefully will help us economically prosper in the long term. Are there places where the American People can see the fruits of this legislation helping their lives already, or is it too soon to tell . Well, its both. Look, my favorite week of the entire Trump Administration was infrastructure week well, youre in luck, there is 15 of them. Yeah. And so, what biden did is he showed when you understand legislative process, you can actually have infrastructure week, and you can actually make it work. The thing about this is when youre spending literally hundreds of billions of dollars trying to roll out new technologies, try to move manufacturing onshore, try to provide infrastructure that will support businesses and also rural communities, that takes time. And what you are actually seeing right now is, you know, the government passed legislation, then it moves through writing about flood regulations. Then it has to figure out how to spend the money. So, if youre looking closely at your local community, if you involve the local government, theyre probably right now applying for actually just hearing that theyve gotten funds as part of this. So, theres small Infrastructure Projects all around the country, from dredging canals to putting in new electric vehicle charging stations. And youre going to start to hear the news, not just that the money is being passed, but over the next few months he will start to see that becoming reality, with workers actually installing that stuff. But of course, the Infrastructure Law was separate from the Inflation Reduction Act, and what people might not realize, and you touched on it a moment ago, in this act, this is actually the federal governments biggest investment ever to fight climate change. But do you think offering billions in Tax Subsidies is the best way to do it, especially when you think about electric vehicles, we were going in that direction already. Let me give balance for you on that. No, i want an imbalance with you. Let me give you an imbalance for you that. No. [laughter] let me start with what the economics profession would remain recommend, and that includes me. Look, pollution is terrible. All our room all our environmental problems are some form of pollution. It turns out we know how to get people to stop doing stuff. If you tax something, people do less of it. So, we should tax people doing crappy stuff, including crappy stuff to the environment. Its in Economics 101 textbook, its in my freshman economics class, this is not a difficult economic problem. Its a difficult political problem, because theres a certain class on capitol hill who dont like any kind of tax, including a tax that prevent them doing all sorts of terrible things to the environment. So, if you cant get tax heights passed, taxing bad behavior, maybe what we ought to do instead is subsidize good behavior. And there are some really important things where if everyone else is doing it, i might do it to. And i think the best example of that is electric vehicles. Which is theres no point being the first person airtime to own an electric vehicle, because its not to plug it in and charge it. What you want to do is buy an electric vehicle when theres lots of places to plug it in. But youre not gonna create lots of places to plug it in unless lots of people have electric vehicles. So, theres a chicken and the egg problem. Its that chicken in the egg problem that this act tries to solve. And thats so, thats why it can be important for Big Government investors to spur a movement from one Hole Technology to a new cleaner and better technology. Zero republicans, zero, voted for this bill. But red states are sure benefiting from it. Do you think this thing is going to be the gops new obamacare . Will republicans want to kill it, but its too popular, theyve got to leave it as is . Well, rhetorically, of course, the new obamacare is bidenomics. Both were originally used as derisive terms for Government Programs that turned out to be programs that delivered widespread prosperity, jobs, reducing inequality, and so on. And so, youve seen just the same way barack obama took up the word obamacare, joe biden has taken up the word bidenomics, and hes trumpeting it, because hes seeing all sorts of terrific results. And youve seen those results, importantly, throughout the country, including parts of the country that are traditionally been left behind. So, while joe biden may not be popular, his policies and his economic outcomes are gonna be popular. And if the Fed Ends Up Cutting rates next year, that is certainly going to be a win for this administration as they get closer to the next election. Well, we know he loves to counter program. So, what if he decides to turn himself into Fulton County authorities on the very night of that big debate . Trump allies tell nbc news it would be a Wise Political Decision to pull focus from the candidates and put a dent in his support. Back with me tonight, Retired Marine Corps colonel amy mcgrath, she also ran for senate in kentucky gets minority leader mitch mcconnell, and to miller, contributor to the bulwark and former Communications Director for jeb bush. All right, tim, we keep hearing from trump world he may not need to do this debate, hes so much farther ahead, he doesnt need to lower him self and go shoulder to shoulder with anyone. Are we supposed to buy that . Or is it really that how on earth is a guy facing 91 separate charges going to get onstage and think he doesnt have to answer for that, or worse, if he doesnt have to answer for that because of everybody except Chris Christie just keeps batting their eyelashes at him . Yeah, i think its almost all of those terrible things that once, staff. I think he really probably is. Have you just take all the nonsense out of this, i think it probably is just true that donald trump is winning by so much in this primary, thats probably the right strategic move for him to not do this debate and weigh in there. Theres going to be 100 debates, and he can to a later one at a later date. So, im loath to give any advice to donald trump, so take it with a grain of salt, but i think in a different environment, look at joe biden for example, he wouldnt be willing to debate rfk zhu near and is vaccine denialism, hes up by 50 points, so i think that strategy is part of. It was also true what hes saying, if he puts himself up there, he has this extra layer of baggage joe biden wouldnt have, not the 91 layers of baggage, 91 indictments that you would have to defend himself with. And i think Chris Christie is proven on fox over the last few weeks and other places that he would be a pretty, i think, Skilled Debater versus trump on that issue. But i expect us to go what is in the leading, nbc reports is probably a better source on trump world let me, but first on the stuff of been doing, ive been talking to some mega folks, and it seems like the unanimous opinion in that group is that not only should he skipped this debate, but he should turn himself in in georgia on debate day, and that after, that hold a counter programming, some kind of rally or a tucker interview or something else, just totally dominate the day. And like, think about how world of a world we live in right now that the trump people think its a good strategy to have attention on Him Surrendering to fani willis. But were kind of in the upside down in the republican primary. So, maybe that is the best move. Do you agree with that, amy . Because donald trump, in the eyes of his supporters, is this big tough guy, that what does he do, he punches back. Is he really going to run away from a debate stage so we can go turn himself in . You know, i think that it could be he could obviously do that. I mean, look, his strategy is always to keep the spotlight on him, himself. So, he wants to own the news cycle. He wants to say he owns it. Out of all of the other candidates so they dont get anytime, so that people dont watch the debate or watch the postdebate coverage or any of that stuff. And so, you know, thats what he does best. And he doesnt need to debate, because just as tim said, hes way in the league right now. So, hes probably thinking i just dont need to even do this. But long term, is it going to hurt him . Yeah, all of this is going to hurt him, you know. Its not gonna hurt him maybe with his trump base, but i mean, were looking at 91 indictments, 91. I mean, theres a lot of independent voters out there, a lot of reasonable people that just arent vote for a president thats indicted 91 times. And georgia is a majorly important state come 2024. Do you agree with that . I absolutely agree that this hurts him in a General Election in georgia, for sure. And you know, im sure that hell try and turn all the focus on him in Fulton County as he can, if they make him to the mugshot, as they promised they would, im sure you will put it on tshirts and mugs and try to sell it. And i think that will probably help. I think the kushner theory of more presses good press is true in the republican primary, because it sucks all the oxygen out of the room for anyone else would want to emerge in this primary. But in a General Election, absolutely it hurts him. The suburban moms and dads, you know, the black voters, the young voters in georgia that turned out in 2020 and in the midterms for jon ossoff and raphael warnock, im like, theyre not going to be impressed by a donald trump mugshot he sure. This is not helping him with the georgia swing voters that he would need to win a General Election. Thats absolutely true. Its just that none of the guys running against him in the primary have figured out a way to make him heard with primary voters, and maybe a big part of that is that all the, except christie, are too scared to actually confront him on it. Amy, whats your take on mike pence finally taking a turn, for the first time saying the election was not stolen in georgia, say he was not in a position where he could do with donald trump wanted him to do . So, i just kind of feel like, you know, its kind of pathetic at this time. And the Republican Voters heckled him. Hes not light there. Hes not respected, hes certainly not respected on the left.
