We begin with new developments in georgia, where security is tightening around the Fulton County courthouse as State Officials raise concerns about the potential for violence. Two new subpoena suggests the fani Willis Grand Jury will meet in the next couple of days. Indictments related to attempts to overturn 2020 Election Results are widely expected there this week. One Georgia State official said today, trumps rhetoric around his investigations and indictments could trigger violence. Obviously, at this point, you never know whats going to happen. In my biggest concern is that somebody will be at this point, and do something super. It is not gonna be an organized thing, its not going to be a bunch of conspirators together. One, probably mentally unstable individual, who is going to be radicalized through this process. Thats my biggest concern. Also new today, the cnn report that georgia investigators are in possession of Text Messages and emails directly connecting members of Donald Trumps legal team to the early january 2021 Voting System breach in the county. Nbc news has not entirely confirmed this report, nor reviewed the Text Messages, with trump is on the Campaign Trail at the Iowa State Fair. Speaking, out questions on the new protective, ordered a potential indictment in georgia, and whether he would take a plea deal. And this one from Vaughn Hillyard on the 2020 election. President trump, did you intend to overturn the 2020 election . You know the answer. A live report from georgia. Also new today, mike pence Encouraging Congress to investigate president biden. A new reaction to the appointment of a Special Counsel in the investigation of his son, hunter biden. The white house is not commenting publicly on the Special Counsel investigation, but staying laser focused on bidens economic wins. The proof is in the plane. All signs point to the grand jury reconvene on tuesday. What are you hearing on the ground there . Thats right. The big question here in Fulton County is, did donald trump and his associates break any laws when they were pressuring georgia officials to overturn the 2020 election . We know of a number of things related to that question. One of them is that perfect phone call as donald trump calls it. The perfect phone call where he asked for 11,000 votes to be found. We also know there were various visits by his associates, including Rudy Giuliani and mark meadows. To the state, during that time period. Why do we think its going to be this . Why why are we all here in Fulton County . Theres two reasons for that. One, the security that youre seeing on the screen right now, and right behind me. There are various levels of barrier set up around the courthouse. Clearly that means the Courthouse Officials of Fulton County Sheriffs Office believe something is going to happen this week. There was also dozens of members of the media here, theyre getting set and ready. The other part of this is what we know is going to happen inside the courthouse on tuesday, that is two interviews with the grand jury. One of the most with george and independent journalist to observe somethings happening during this time as a realest of the fake electors. The other was with former lieutenant governor, jeff dunton, who is associated with a lot of the conversations that were happening between white house officials and what was happening here on the ground in georgia. Here is what dave sterling, the ceo of the georgia secretary of states office. Heres what he had to say but the investigation this morning this morning on nbc. One of the things we learned and reporting on this is that he requested there be two independent audits and verifications by outside groups, and both of these, he paid 600,000 for both. They said that there was no, fraud he lost the state. Weve been saying this over and over again. We counted the ballots three times. He lost the state. They continue to say he didnt lose it. Its just creating a lot of tension, a lot of chaos, its completely unnecessary. So we dont know exact on time maine as to what is going to happen this week, but weve been through this a couple times with grand jurys. We have a sense of whats going to happen. We have a sense that there is going to be some level of presentation that the d. A. s office gives to the grand jurys, and then there is going to be a vote, eventually, between those 23 members of the grand jury, and from there, as sealed incitement would follow. Alex. Okay, thank you so much for leading us off. Were going to go from there right msnbc legal analyst, lisa rubin. She was in the courtroom on friday for the protective order here in. Joining me in studio, danny sub, all criminal Trial Attorney at nbc news, Intimate Specie legal analyst. Thank you to both of you. Ladies first. What do you make of this new report from cnn, that claims of george investigators have evidence of a breach in Learning Systems and the county involved a Top Down Pushed by trumps team, now nbc news, we want to repeat, has not yet confirmed this, has not seen the text or emails, how do you interpret Top Down Push . I think thats alex, what were going to see is sort of the Connective Tissue that might be missing from this indictment. That is to say that there was an effort being made at the top. We see that in the federal indictment. A number of People Associated with trump, in particular, his legal advisors, trying to execute a number of different overlapping conspiracies to turn the election for him. What we are going to see if we can confirm this, its some of those same people, attorneys who are trumps Unindicted Coconspirators, now working with people on the ground in georgia to try to make those things come to fruition. Whether its by penetrating voting machines, or perpetrating the fake electors scheme, those Unindicted Coconspirators, those attorneys, and others working in their direction, trying to make this happen for trump, in particular, in georgia. This is the one place left, as we approach january 6th, that they still thought they had maybe, the tiniest shot of Making Something happen. Do you think that georgia is the potentially biggest threat to Donald Trumps liberty . Do you get a sense that, the governor cant pardon, him right . If he were to be convicted, does he serve time behind bars . First, no. The biggest threat to Donald Trumps, and im glad to use that, word liberty, because thats a very specific word. The biggest threat to his liberty is still the first two federal cases. In the maralago documents case, the second is the most recent indictment in d. C. The simple reason for that is, statistics. Every federal case ends in a conviction. Now, third, we dont know exactly if or what hes going to be charged with in georgia. Whatever that may be, you assume there is an indictment, i put that a third. Then it just in fourth, way distant fourth, is the new york criminal case against trump. That is putting federal criminal cases ahead a state cases, because if youre pulling the odds as a criminal defendants, you have a much worse chance in Federal Court than you do in state court. Okay, thank you for that. Our colleague, sean hillyard, asked donald trump if he would take a plea there. Lets take a listen. Is there any chance you take a plea deal . We did nothing wrong. We will never take a plea. Thats a wiseguy question. Mr. Wiseguy. We dont take plea deals because i did nothing wrong. Its called Election Interference. So you are out that friday hearing on the protective order, or does anything that he said in iowa about these restrictions . I dont think so. Yet. I think that one of the things thats very interesting about his social media posts since friday is that he appears to no longer be talking about people who could be witnesses in this federal case. Instead, hes focusing his ire on someone who you couldnt say is a witness in these federal proceedings. Namely, joe biden. Trying to tether joe biden to the work of the Special Counsels office, erroneous lee, i might add, the whole purpose of appointing a Special Counsel was to give the justice department, and the Biden Administration, the necessary distance in order to ensure that the administration of justice here was is an impartial as it could be. No, i dont think hes there yet. That having been said, if donald trump is Running Afoul of anything, here its not going to be the protective order, its his conditions of release. This necessitate that he not tamper with the jury pool or intimidate witnesses. Hes going to go right up to the line. Its possible that he crosses that, but i dont think hes done so yet. Okay. Lets take a timeline with you, danny. Overall big picture. Doj has requested a january 2nd trial day in the Election Fraud case, right . Prosecutors say the case will take 4 to 6 weeks. Trumps lawyers have said that it has taken three and a half years to investigate asking why do we make it equal, then the doj replies, not only is this impossible, its disingenuous. Adding the expected turnovers substantially all evidence before the end of this month. So when the trial had a chance to rattle on a date, with you represented jonnel trump, whats a day, a reasonable dates that you would ask for . Both sides can ask for the respective trial dates are wrong, and both are right. The government is trying to have a tight timeline. It makes sense, strategically, cases in Federal Court move quickly. This is no ordinary case. None of these ordinary cases in Federal Court. And trumps defense Attorney Says that they investigated this for two and a half here, as we should get two and a half years. I hope that that was hyperbole. Surely he knows that in Federal Court, youre not going to get two and a half years to investigate a case for the defense. It doesnt work that way in Federal Court, even if donald trump is the defendant. You might get two and a half years in state, but that would not be the intent of the court. It would be because the docket is too crowded, and you cant. Exactly, by the, way of going back to the Southern State case, they have that to deal with. They have backlog. That is to the benefit a defendant. You can have that in Federal Court. If i were, i think, if i were to pick a reasonable number, even for this case, it would lean more towards what the defenses, salk maybe something in may of last year. This is really key. If i say that may would be a reasonable trial date for either these federal indictments, who still say is not Going Forward on that case. Just because a plane the odds. There are too many things that could crop up that are unexpected. For example, there was a superseding indictment of the documents case. No one saw that coming. I. C. E. Assume the government saw that coming. No one else had any idea that was coming up. Thats going to add time. It took one of the codependence in the maralago case a month just to his arraignment because he couldnt find a florida lawyer. That gives you an example. There are unexpected things that happen along the way to trial. Could a case go forward . For example, the one scheduled in may, it might. Whatever date they pick, everyone has to realize that unexpected things happen. Even those states, once the trial jet set them, they are not likely to go forward in a case that the defendant like this, the most significant criminal defense in american history. So she says that is not going to happen on her watch, many of the things that have happened, and weve gained since the 63 march, are now under attack. Affirmative action being one of the primary issues. So she was very passionate. And very inclusive. Saying, all americans need to stand up to these issues. She was handed a couple of prominent, but almost impossible tasks to address the surge of migrants at the border, and of course, standing up to Voting Rights challenges. Fourth issues that divided congress, do you think she perceives that her portfolio was built on almost unsolvable issues . I think when she perceived is that her portfolio was built on some of the priorities that this administration had, and that they had that if anyone could tackle them, she could. And i think she has become a very driving force for this administration, out there in the i mean, shes been all over the place. When we had Governor Desantis try and get it out black history and lgbtq rights, as well as women, it was Kamala Harris [inaudible] situation in tennessee, undermining elected officials in the state legislature, human rights [inaudible] the problem of black cops Killing A Black young man for what appears to many of us, no reason, huge attendance at the funeral. I think shes been the one they have the confidence she can take on the tough fights. Which brings me to the question, regardless what happens in 2024, to think that they are raising her up to be a potential air apparent . You think her candidacy would depend on, potentially, who the gop nominee would be . I dont think they are thinking that far ahead. From all of the meetings ive had, on and off the record, they are dealing with their daytoday commitments and they are dealing with 24. I havent heard anyone mention 28 at all, other than maybe some republicans feel that [inaudible] let me ask you one question here, as you look back on the March On Washington 60 years ago. And now, are faced with images of that brawl in montgomery, alabama, a city that holds important prominence in the civil rights movement. What goes to your mind . In the last 60 years, we are fighting for rights that [inaudible] and then to see these people, this man doing his job, being assaulted. But there was some that stood up for him, and fought back, in the city that the montgomery bus boycotts started, with dr. King [inaudible] it showed me that, just like people came to the rescue of that man getting attacked, we are going to have to come to the rescue of the rights being taken away. Fani willis will present her case before a grand jury. Trump, making a shortstop at the Iowa State Fair on saturday, not showing any signs of legal headaches. We have never seen love and enthusiasm some of the people where we stopped, and we stopped in 2020, we stopped in 2016. This blows it away. We set a record for people today. And you are very special. Joining me now is nbcs ali vitale at the Iowa State Fair in des moines, and Washington Post reporter and msnbc reporter ali most of the candidates have now come and gone from the state fair, but certainly were still parsing through their appearances here, especially because this was a real moment for them to get in front oh i love voters, always a critical stop on the election circuit for president ial contenders. But of course, it comes ahead of that first debate, which, too many, is really the starting bell of this primary season. Many of the candidates that ive spoken to over the course of the last few days saying that thats their chance to really make their impression on the widest swath of republican voters, who are tuning in at one time. The big question, of course, is whether or not they are going to be sharing the stage with the man who is leading top of the pack, and has been since the beginning of this year, and that would, of course, the former President Donald Trump. Heres chris christie, one of his Chief Antagonist and rivals, talking about that strange dynamic heading into the first debate. Watch. I would not be the least bit surprised if sometime around sunday or monday of next week, he signs the pledge, and he shows up on the stage on wednesday. He might not also. But i would not be the last bit surprised if he did. This is about donald trump keeping the intention on donald trump, and hes doing pretty well. Because in the first question this morning, we were talking about him. Look, the reality here, to, alex, is there is upside, as trump has talked about, which is that for other candidates who attack him, the michael of several points, but he could have a lot more to lose. On the other hand, as i was talking to other candidates, they are trying to make it seem, in the words of former South Carolina governor nikki haley, like maybe he is scared to get on the debate stage and defend his record. Trying to goad him into getting up there, because of course, in exchange with donald trump would be the boost that most of these candidates think they need. So jacqui, Special Counsel jack smith has proposed a january 2nd start date for trumps trial on charges of attempting to overturn his 2020 Election Loss. Does that seem realistic to you what do you expect these trials and theyre scheduling to look like in the midst of a campaign to take the white house . I think we can confidently say that the January 6th Trial is going to take priority above all of the other trials that have been scheduled so far that trump is going to have to be attending to next year, while hes also juggling this campaign responsibility. But its unclear whether january is january, 2024, is going to be a exact judge Tanya Chutkan has until august 28th to put forward their Counter Proposal of what they would like. We can imagine they are going to be that this trial should be delayed until after the election, for some of the same reasons they previously argued in classified documents case, for example, where they said they interfered with the political process, and that trump was sort of owed the freedoms some rights and not having to have these time commitments to deal with that jack smiths argument has been this trial and what is at stake here is tantamount to voters decision for this upcoming election and that is the interest of the american public, for the trial to be held earlier. I think that we can probably expect the judge to come down somewhere sort of in the middle, since january 8th specifically extremely far away. Ali, i know that you covered trump during his 2016 campaign, and also the 2020 campaign and the aftermath. Did the Scene You Saw in iowa feel, yesterday, more like 2016 trump than 2020 trump . And did he show even a hint of these indictments hanging over him . You know what . This wasnt 2016 or 2020, when jacqui and i were both embeds because it was no helicopter here with us. But he is doing the same levels of defiance that hes always shown. I mean, weve covered him now for almost a decade, which is stunning. I dont think ive heard him, ever, say im sorry, or i was wrong. Its just not a part of his vocabulary. And so then, look at the ways that he is clearly certified in the face of three indictments, now its likely to be for, it really does track with the playbook that works for him. There are enough voters out who are either willing to look past this, or think that it is just something that is hammed up by trumps opponents. They dont engage with the substance of, it in fact, some of them even to believe that when trump is changs right. Of course, its not, he lost the 2020 election. But even the fact that hes willing to play so cute with our colleague, who was the yesterday, asking him if his goal as the president was to overturn the election, and trumps response is, you know the answer to that. Thats clearly not saying no. And it would be very easy to say no. Again, this is the trump weve always seen. No signs hes changing anytime soon. Jacqui, in the Election Interference case, you reported on the six Unindicted Coconspirators a grand cherry still hearing from. Did is that the case . Does this mean there could be charges filed against any of those coconspirators soon . That is a really good question law [inaudible] where theyre going to be seeing any superseding indictments. I think is something we are all going to be watching closely, what jack smith actually has in store for the Unindicted Coconspirators, and whether or not this could be a Pressure Campaign to get them to cooperate with the investigation, maybe and in the case that they dont, he has sort of, this hanging over their heads, to potentially land and indictment. But as you mentioned there, there are six of them. Rudy giuliani, we now, is one of them, john eastman, sydney powell, Ken Cheeseborough and jeffrey clark, the six coconspirators we have not been able to confirm yet. So, rumors about who that might be have circulated. Its someone who jack smith and prosecutors referred to as a political consultant. You paid to go on tv, or you are not without having to pay it. Donald trump has more earned media around the world than anybody right now, including all the other candidates. So, look, his 50 points in the republican poll standings, probably will stick for a while. Alencia, how might democrats then interpret that scene we were showing . And when you see that in iowa, is there a concern surrounding trumps liability as a general candidate . Despite his indictments . And you would think a conviction or to would change anything . Look, i think weve already seen that. Unfortunately, the people who are very much trump supporters, support him no matter what. This indictments, whatever the charges come. Unfortunately, i think he will see his base grow. But when it comes to a general election, im glad you asked that question. Theres so many voters. Especially general election voters, republican voters, who actually want to move past donald trump talk about the issues. They are tired of the indictments, tired of the tired of what he is doing. And so, it will be interesting in the general election, as we talk about to see how democrats are able to push on those issues that matter to the American People, and voting, abortion, criminal justice, the economy. All of these issues. It all this press that david mentioned, that trump is getting, none of it is about how he is going to fix the economy, or how hes going to help the American People have the policies they need in order to stay afloat in this country. Over legal fees, and right before he took office, he had to settle over trump university. Donald trump does settle, it just has to work at his timing. Thats not to say he will take a plea deal at this point, but in the future, as these things wrapped up, and how things look, you just never know. But donald trump is dominating, theres no doubt about it. You look at the fund raising numbers, he may be have spent 40 million on legal fees, but he has the money to spend. Because it is not just the big lie with donald trump, its the big rift. The plea deal issue, david. How about georgia . Might he take a plea deal there . Because, if he were to be convicted, he could not pardon himself. Is that one place he might do it . Again, but for his vanities, right . Who knows. We will see. The big thing for him, i think, is right now, if you have a 30point lead, even with all the indictments, he just dont need another risk. So thats why any of the trials he wants to punt until next summer, is there a scenario in which he can take a plea deal and georgia, if that trial out of the way, get that off the map . Perhaps so. I still think we are talking about somebody with such enormous vanities that he would never consider that. He expects his lawyers, Whatever Brown sees on, nine, ten or, 11, why lawyers that hes handled. One last quick question to you, susan, on a different topic, being abortion. The overturning of roe v. Wade. Do you view that as nothing short of a disaster for republicans . Because you saw it fire up that base, probably inspired the voters to cast ballots for democrats, and in some cases, states may vote for more liberal abortion policies than roe v. Wade, we saw in ohio, they tend to try to make it more difficult to codify that into its state constitution, yeah, that failed. Republicans should be really scared. As a matter of, fact i would go as far as to say abortion is the only thing standing in the way of Mitch Mcconnell becoming majority leader. The senate map is very advantageous to republicans.
