We begin with a win for Abortion Rights advocates that could have major implications for 2024. Voters in ohio overwhelmingly defeated a gopbacked Ballot Measure that would have made it all but impossible to enshrine Abortion Rights in the state constitution come november. Now, ohio was the seventh state to put Abortion Rights on the line. 14 months since the Supreme Court struck down roe v. Wade and the seventh to back Abortion Rights. Were talking a clean sweep. Nbcs ali vitali is in ohio for us, also joining us former democratic congresswoman from maryland, Donna Edwards and former republican congressman from florida, david jolly. Ali, walk us through last nights results and what it means for the upcoming vote in november on Abortion Rights there in ohio. Look, you and i were talking about this yesterday as a proxy battle over abortion access. Thats because what was in front of voters yesterday was about whether or not to change the rules to what it takes to amend the ohio constitution. Were seeing now 57 of voters here saying that they dont want to make it harder to change the constitution and in the minds of most of those voters, this was inextricably linked with that abortion amendment thats coming up on the ballot come november. That was also the case that it was linked for republicans who were clear about the fact that they thought that this was a way to make it harder to put Abortion Protections into the states constitution. Its important to look at that 57 number, which is how much this measure failed by. 57 still overwhelmingly resounding in terms of the results. It also speaks to the reason why in the first place republicans wanted to make the threshold 60 , even in a high turnout election like this one where millions of people voted despite it being in the middle of august, youre still only seeing 57 , which, again, is resounding and clear but underscores why republicans wanted to change the thresholds here in the first place. So congresswoman edwards, your reaction to this outcome, this clean sweep, seven states out of seven votes. I think what it shows is that abortion is still a powerful and motivating issue for voters that nothing has cooled since the dobbs decision, and that every time republicans try to do a frontal attack or an end run on Abortion Rights that people show up to vote, and they feel very strongly about this, and i suspect that the measure that is on the ballot in Ohio In November is going to pass securing Abortion Rights in the constitution in ohio, but i also believe that in the 2024 election that abortion will continue to be an animating issue for voters. Congressman jolly, what do you make of this republicanled effort to just introduce this measure in the first place, to try and make it harder for the Abortion Rights vote. This is a tool of republicanled legislatures across the country from ohio to florida and everywhere in between where they try to restrict voters ability to selfgovern. They raise the threshold to pass a constitutional amendment from 50 to 60 . They make the Signature Requirements harder, more expensive, more restrictive, and then they create legal mechanisms to kick off voterled initiatives. That was at the heart of this in ohio, and you cannot untether from the substance of this question coming out of dobbs of ohio voters trying to seek to enshrine Abortion Rights into the constitution now that ohio has this Heartbeat Legislation or law in place. It does speak as donna has suggested, to the crippling, if you will, of republicans position politically on this. Coming out of dobbs, republicans are out of step with the majority of voters. So ali, whats the white house saying about last nights decision . Reporter well, they are taking it to voters next november as david said because democrats are aware of the fact that this is an issue that wins for them at the ballot box, and the white house is seizing on that. In a statement overnight, President Biden saying that this result speaks volumes that ohioans showed up in an off year august election. The energy and motivating factor behind abortion as an issue be it indirect or direct on the ballot is still something thats very salient for voters here. I have to tell you, as someone who has covered reproductive access for the last ten years and also covers democratic and republican politics, in talking to republicans, especially those running for president this cycle, its clear this is a very sticky issue for them. Many of them are trying not to get bogged down in the details. Its because the party is aware of the fact that it is largely out of step in terms of wanting to add further restrictions when six in ten americans would tell you that they support Abortion Building Safe and legal in most cases. Thats why this is a political loser for them, and why were seeing states like this be part of a clean sweep post dobbs. Congressman jolly, it sure doesnt seem like the passion around thi issue Abortion Rights is going away. If anything this election seems to be pointing the other direction, that people are even more passionate. Do you believe that this is a precursor to 2024 . Do you see Abortion Rights being a key issue in the upcoming president ial election . I do, if as we expect democrats make it an issue. Because republicans, as ali said, dont want it to be an issue. Theyd rather talk about hunter biden than anything related to reproductive health. Coming out of dobbs, what we have learned, and we did not know this coming out of dobbs, after 50 years of America Being told youre prolife or prochoice, america woke up and said whether im prolife or prochoice, i know im proroe, and i know we want to enshrine the roe protections into laws. Voters, republicans, democrats, independents, prolife, prochoice said were overwhelmingly proroe. Republicans have that wrong going into next november. And women voters are such a huge part of the electorate. That is some factor in all of this. Congresswoman edwards, the ohio secretary of state, a republican whos running for senate noted that absentee and early for this special election in august of all times actually surpassed the 2022 primary election voting. And again, this is ohio, a red state. Is it at all surprising to you that this is the issue thats getting voters in ohio to turn out . And obviously not in the way republicans expected. Well, it is not surprising to me. And also what we note is the Crossover Effect on Abortion Rights, as david said, you have a Cross Section of independents, of democrats and of course of moderate republicans who are supporting Abortion Rights, and if is really animating the electorate in a very powerful way. I think democrats, frankly, would make a huge mistake by not talking about Abortion Rights and the need to protect those. And so i am guessing that going into november, we will see a surge in voters on this issue. It will be a thing that people will say that is what got me to the polls. We have more breaking news, this time out of hawaii where dangerous wildfires are burning on maui. Winds from a hurricane thats hundreds of miles off the coast fanning the massive flames, prompting widespread evacuations, Ravaging Thousands Of Acres and causing extensive Property Damage there. Much of hina that served as hawaiis Royal Capital in the early 1800s is believed to be troid. The fire so intense, rescuers are pulling people from the water, the only place they could hide from the surging flames. Maura barrett is tracking the fires with us. Also with us, meteorologist angie lassman. What are we learning about the evacuations and the efforts to contain the fires . Reporter the images are absolutely catastrophic. And remember, its still Early Morning hours, just after 4 00 a. M. In hawaii. Officials are describing the scene as rapidly evolving, but also describing extensive damage. Now, as you talk about the hurricane that pushed those 60 Miles Per Hour winds fanning those flames, thats also hampering Rescue Efforts because those Firefighting Helicopters that typically drop water from the sky to contain the fires arent able to fly. Theyre also not able to get an accurate depiction of how big the fire really is and which direction its spreading because the helicopters, usually a way they can get a good Vantage Point from there. And then on the ground firefighters are facing many literal roadblocks as trees are down. Theyre not able to get through the roads as they typically might be. The 911 service is down in west maui, so theres concern that people who need help with evacuations or with injuries arent getting reached. Hawaii electric has reported that 13,000 people right now are without power as there is this dual fire in west maui, which is where the very heavily populated tourist area. Then theres also another fire more inland in the mountainous regions. Theres a lot that the region is tackling right now. Maui has closed down several schools in the region, and theres obviously a lot of limited transportation, Emergency Warnings in place. Ill let angie talk about the weather predictions. But were hearing the latest from officials that it appears that the wind should be dying down, which is welcome news to these Rescue Efforts. Fingers crossed, what a scary situation. Angie, whats so crazy here, the National Weather service is telling us that its a powerful hurricane for a category 4 hurricane, with sustained winds of 130 Miles Per Hour, but its some 700 miles southwest of honolulu thats partly to blame for this fire. Thats so far away. Fill us in, what are you watching . Weve got a couple of things going on hear, right . A few ingredients that have led to the scenario were seeing. The first is were dealing with dry conditions. Hawaii prone to wildfires. We know this. It does have a fire season and the brush, the fuel for a fire is quite dry right now. We dont have a whole lot of rain in the forecast in the shortterm. Weve also got two areas of pressure. Weve got a High Pressure and a strong High Pressure thats sitting north of the islands, and as we look to the south, weve got that hurricane that you mentioned, hurricane dora. Yes, more than 500 miles away earlier in the day yesterday, more than 700 miles away now, and its going to continue to move away. When you have these two things kind of stacked on top of each oh in hawaii, sandwiched in between them. You get really strong winds. You get really strong Pressure Gradient that leads to system of those stronger swings that we saw coming out of the islands. 50, 60 Miles Per Hour, as high as 80 Miles Per Hour, we saw some reports. So no surprise that if you have the dry conditions and a fire starts, its going to spread rapidly. You heard that were also having issues fighting that fire because of how strong those winds are with helicopters for the firefighters. And now were talking about still dealing with this here, at least for the shortterm. Those two systems are going to start to move away in the next 24 hours. So the winds will die down. It doesnt look like were going to see a whole lot in the way of rain. At least not until we get to maybe saturday. And still by hawaiian standards, not much rain in the forecast. Its a pretty wet place. Over the next couple of days looks fairly try for the forecast. We see these right of Flag Warnings in effect. Strong trade winds, strong winds on top of that with those two systems nearby. Hopefully well start to see some improving conditions in the next couple of days. Welcome back. This morning Donald Trumps lawyers and the Special Counsels team have a new court date. The judge ordering both sides back to court this friday at 10 00 a. M. Eastern. Thats right, 10 00 a. M. Tune in to our show. Now, they can finally figure out the scope of a protective order in the Election Interference case. Jack smiths team is worried the expresident may try to publicly intimidate witnesses. While trump doesnt seem to care if hes placed under a protective order or not, as he made it Crystal Clear in his rally yesterday he plans to keep talking. Somehow thats not good for votes. Do you agree . When you say i cant talk, i will talk about it. I will. Theyre not taking away my First Amendment right. Joining us now is nbcs Vaughn Hillyard, nbc news justice and intelligence correspondent ken dilanian and msnbc legal analyst, lisa rubin. Trump himself doesnt have to appear, but what can we expect from this friday hearing . We know what were going to hear from the lawyers, which is a stark clash over this question of whether there should be a blanket protective order over the discovery. Trump wants to try this case in the media. They say theyre about to turn over a lot of sensitive documents to trump and his lawyers, and they dont want the former president to be revealing that stuff in social media. Particularly witness accounts or sensitive information. Donald trump and his lawyers say they should be allowed to talk about at least some of it. The big mystery is how the judge is going to deal with this issue. Shes already showed a bit of a lack of patience with the Trump Lawyers in her scheduling. They had said that friday was out for them. They had a scheduling conflict. She scheduled the hearing for friday anyway. There wasnt really an explanation for how that all shook out. She wants to move this thing along. A lot of people who know her well believe that she will make short work of this protective order thing. Really its a Standard Practice in criminal trials to have a blanket protective order over the discovery. The real showdown is going to come later if donald trump starts to cross the line in his attacks on prosecutors and judges to the extent that the judge wants to limit what he can say. You heard him say hes not prepared to listen to anybody who tells him he cant speak, ana. Thats right. And it is turning into a very busy week in terms of Court Appearances for trumps lawyers. They also have the thursday hearing involving the classified documents case, so backtoback court dates. Well be following both of them. But vaughn, we did play a little bit of what trump said at this event you were at yesterday in New Hampshire. Just at the top. You say this was the most defiant youve ever heard trump. It was a hot, packed gymnasium there, and it was clear that donald trump is going to do whatever he can to mobilize his Political Base behind him as these Court Proceedings move forward. For donald trump, the courtroom is a lonely place. Its him and his defense counsel. But outside he has the Opportunity Put Pressure on the justice system, the u. S. Justice system by having these millions of americans in communities around the country, he is going on the campaign trail, in just the last seven days he was in alabama, south carolina, yesterday in New Hampshire, hes going to iowa on saturday. For donald trump this is the opportunity to not only make the case that the charges against him are unfair, but the proceedings themselves are unfair. Take a listen to donald trump, part of his remarks yesterday. Im sorry, i wont be able to go to iowa today. I wont be able to go to New Hampshire today because im sitting in a courtroom on [ bleep ] because his attorney general [ cheers and applause ] charged me with something. After that statement, the thousands that were there started chanting that word in unison. For trump that is so much about getting them behind him as were looking at a long process ahead. Lisa, your reaction to these remarks from trump are. Do you think hes just trying to goad the judge in this case, say just watch me, youre going to try to put limitations on me. What do you think is going on . You know, one of my colleagues, ana, yesterday said to me, this is not a way to avoid the kind of blanket protective order that the Justice Department wants. I said thats exactly what trump wants. Trump actually wants to escalate this fight. He wants judge chutkin to impose a very stringent protective order because most americans dont understand what a protective order is for. And then he wants to mischaracterize the protective order and say that its somehow a restraint on his speech. He has the right at all times to talk about his opinions and feelings about having been indicted and no protective order will change that. What the protective order is meant to do is to protect the integrity of the governments case and investigations by protecting witnesses from harassment as ken noted earlier, to prevent the jury pool from being tainted, and perhaps most importantly, to allow the Justice Department to continue its investigation without other possible targets knowing everything that the Department Of Justice already knows about them. We see in the existing indictment there are six unindicted coconspirators who are unnamed. Many of us in the Legal Community believe those people could be subject to charges, and the Department Of Justice doesnt want those folks, much less all of trumps followers on social media understanding what their evidence is against those folks as well as former president trump. We know the Special Counsels investigation continues, so we could see additional indictments coming. I want to play some sound from trump voters in ohio and just get your thoughts on the other side. Lets listen. I think that theres definitely two sets of rules, and its unfortunate. I feel like all theyre doing is trying to get rid of him, and anything thats i cant believe anything they say, and whatever he did, again, i feel like he was fighting against a dirty establishment for my benefit. Hes swinging very high in the polls right now, so theyre likely trying to get him with whatever they can, if it may be phony. Ken, whats so striking to me is how successful trump has been in getting americans, whether its voters or even potential jurors to question the integrity and the credibility of the Judicial Branch and americas judicial system. What are your thoughts about what we just heard . Its just depressing to me as somebody who covers the Justice Department and the court system and no less than alberto gonzalez, the former Bush Administration attorney general came out with an oped yesterday also lamenting this fact, and saying that not only regular voters like that but prominent republicans and pundits are saying crazy things about the justice system, when they know its not true. And he led the Justice Department as a republican, and he was saying, look, there are career people inside that Justice Department. They dont care about politics. Theyre trying to pursue the rule of law, and one unfortunate fact about these federal trials is those voters will not have a chance to watch them on television, unless something changes. So they wont be able to hear the evidence for themselves. Theyre going to hear a characterization of it on whatever right wing media they consume, which is a tragedy. Theres also georgia, of course. We anticipate an Indictment Decision next week in that case. This case is also about Election Interference. So there is some overlap with the federal case, but talk to us about the differences in terms of how this case proceeds and the potential legal jeopardy for trump. You know, ana, we dont obviously know what the Fulton County District Attorney plans to charge next week if and when an indictment comes out, but those facts are largely going to be focused on efforts in georgia to overturn the election, and some of those facts will dovetail with those in the indictment right now. Theres a whole section in the existing federal indictment about those efforts in georgia. But there will be other things that come up in the georgia indictment likely as well that arent included, including efforts to tamper with voting machines, for example, or efforts on behalf of those close to trump to penetrate the Georgia Political Establishment and sort of talk in more micro detail about how that fake elector process worked in georgia, including their Surreptitiously Meeting in the capital, which is a requirement of any certificate of ascertainment thats submitted when you assemble electors together. So i think well see a lot more detail. A lot more focus on georgia, and then some names of people who are not yet household names and are specific to the georgia facts at issue. And we may actually see a lot more of the Court Proceedings because unlike the federal court, you know, stringent requirements typically are the standard without cameras in the courtroom state, this is a state case, that may allow more transparency here. There have now been several arrests in the river front melee in montgomery, alabama, that went viral. Three men now facing Assault Charges accused of attacking a Black Boat Captain. Nbc news correspondent sam brock has more on this brawl and the investigation. Sam. The legal fallout from that brawl in montgomery almost certainly is not over as Authorities Say they originally detained 13 people and fully expect to bring more charges. As for that video that is so difficult to watch, Authorities Say currently they do not have enough evidence to bring hate crime charges. Several days removed from a Brutal Dockside Brawl in montgomery, alabama, where this now viral video shows a group of white men attacking a single Black Boat Captain. Assault charges have been filed against three of the alleged aggressors. When it initially took place, the Police Department didnt have the luxury of the videos that we all have seen now. Now that we have more information, again, more charges are pending. Reporter the video certainly paints a vivid picture, after the initial altercation, members of the crew and Community Jumping in to defend the riverboats cocaptain damian picket. As you can see from this new footage, the fight quickly escalates. At one point a man even swinging a folding chair. In Police Custody this morning, richard roberts, two other men, alan todd and Zachary Shipman are expected to turn themselves in. All of them facing misdemeanor Assault Charges. None of the men have pleaded in the case yet, and nbc news hat not been able to reach them for comment. It definitely should never have even gotten physical to begin with. Reporter for witnesses who watched for a riverboat that was attempting to dock like leslie may horter, the 45 minutes the police say the captain spent asking the pontoon owners to move their boat was clearly in vain. Could you hear what these guys were shouting back . I could not hear what they were shouting back. The attitude they exude was the fact that youre not going to tell us what to do. We were here first. Theres no doubt they were notified. They knew they were being asked to move. They had ample opportunity to move their boat. Reporter when asked about possible use of racial epithets or names, the police chief said the evidence they have does not currently meet the fbi standard for a hate crime. There was a lot of obscene finger gestures and comments and innuendos made. Working with the local fbi, we did examine if there was enough to file Hate Crimes Charges on this case. Reporter its important to note that police are still soliciting videos from the public, and that witness we spoke to said the cocaptain looked awfully shaken up. Once they got off the boat he did appear to be okay. Weve reached out for comments and have not heard back. Sam brock, nbc news, back to you. Joining us now is montgomery mayor, steven reed. Thanks for taking the time. We heard sam say it. I know you have said the investigation is still ongoing. Do you expect more charges against more people . I think its possible. You know, certainly as we continue this investigation, were asking all witnesses and anyone that may have Additional Information to thats helped us so far get to this point where we could issue those warrants and see one person come in and another two who should be coming in before the end of the day. So i think anything is possible as this investigation continues. Were leaving no stone unturned. Were very intently looking at all facets of this case. We understand that fbi has a federal threshold of hate crimes that may differ from what many of us who have seen the video may think ourselves, but were going to look at this from a legal angle and move forward from there. I mean, watching the videos, so disturbing. You see this one guy whos just trying to do his job asking the pontoon boat to move, just be piled on, ganged up on at this moment, as you point out there are no hate crimes or racially based charges filed in the investigation. Do you think there should or could be . I think there certainly could be. Weve heard information that racial slurs and epithets were used. Were trying to follow up to, you know, confirm that, and if so, then well take a look at what our District Attorney as well as our fbi, our federal prosecutors tell us is the best path forward. You know, the main thing for us is to make sure that people understand this is not representative of montgomery. You know, the people that started this are not from the city. Those that were working on the area, those that were visiting or folks who were just looking to have a good time on a hot summer day, so we have to acknowledge this is an incident of isolation by a few bad actors and we have to treat it as such. You are the first black mayor of montgomery, just on a personal level, what has it meant to you to have this happen in your city . Well, you know, from my standpoint, understanding that the history being born and raised here, its a level of sensitivity to this that makes it a little bit different because we are home to so many civil rights organizations, and so many things that have happened here to move this country forward, to see Something Like this happen in our city is problematic. You know, from my standpoint, i look at this in terms of making sure justice is served and making sure those who initiated this are really to be held to blame for it, truly see their day in court and are held accountable for their actions. Thats really the biggest part of this, and its certainly, you know, disappointing, i think, from everyones view to see someone whos just doing their job get attacked for doing their job, and i think the next few days of our investigation will tell us if there was more to it than what we just saw in the video. Cleanup efforts are underway across massachusetts today after a series of storms swept through that state monday, and we now know there were at least two tornados that ripped along the coastline there, and thats just a snapshot of the wild weather thats continuing to affect millions of people across the country this week. Well, crews are certainly making a lot of progress right now trying to reopen highway 140. If you take a look behind me, you probably see a whole lot of activity right now. Its still unclear when this roadway will be back open. We know they are removing what appears to be one of the last power poles knocked down just a few minutes ago we saw one of the last stranded cars being driven away, but, ana, keep in mind, this storm blew through monday night, and these power poles, several of them crushed many of these cars that were driving along this highway, but incredibly, no one was hurt. Overnight, extreme weather stretching across the country, storms and reported tornados ripping through the midwest and east. One system bringing a frightening funnel cloud and baseballsized hail to colorado. The east coast recovering from several rounds of severe weather. The National Weather service also confirming two tornados touched down tuesday along the Massachusetts Coastline including an ef1 twister that was on the ground for more than three minutes. Its definitely nerve wracking, the typical sound of a freight train. Reporter in the boston area torrential downpours filled roads with water leading to emergency rescues. Firefighters saved a driver stuck under an overpass as flood waters kept rising rapidly. Residents in pennsylvania now cleaning up with thousands across the state still without power. I was in that second floor window right there. Reporter high winds sending this massive tree straight into this mans home. We had seconds to react. And many east coast residents also in recovery mode including in maryland after powerful Straight Line winds knocked down 30 power lines sending a row of poles and live wires crashing onto moving traffic. 33 people were trapped inside their cars including 14 children, all thankfully now safe. And this morning here in new york, stepped up patrols and precautions at new york beaches after the First Serious Shark Bite at a New York City Beach in 70 years put a woman in the hospital. Rockaway beach just reopened to swimmers, and nbcs Stephanie Gosk is joining us from there. Stephanie, are people actually going back in the water . Reporter you know, ana, they have trickled onto the beach, but listen, this is a beautiful picture perfect beach day, and this beach is still pretty much empty. Weve seen a few people go in the water. As you mentioned, theyve been out patrolling all morning long, drones and boats and helicopters, and they said they were ready to close the beach to swimmers and surfers, again, if they saw any activity. They clearly didnt see any activity. There are people on this beach who are apprehensive, although this is the first shark attack here in rockaway in over 70 years, there have been Shark Attacks this summer not that far away, five off of long island over the Fourth Of July weekend. So some of the people here are a little bit nervous about going in. I ran into a couple from tucson who said they might walk in a little bit, but otherwise what they saw here on the beach that day really spooked them. Heres what they had to say. What we saw unfold was the helicopter, the emergency vehicles from the Police Department and the Fire Department come racing down this boardwalk, and the helicopter hovering in that area there. Onlookers say that the 65yearold woman who was swimming that day went in just before 6 00 and was not over her head, that she went in up to about her shoulders that day, ana. Do we know how shes doing . Reporter yeah, we got a report from the hospital that shes in stable but still serious condition. She was in Critical Condition when they brought her in and a Senior Police official said she actually suffered Severe Damage to her left leg. So while the earlier incidents back in july around Fourth Of July were pretty minor in comparison, this was a pretty serious incident. Were glad to hear shes in stable condition. It sounds like shes got quite a long road to recovery, ana. Thanks for the update. She went to the hospital to have some tests done and was released soon after. Let me read you that full statement because of course, a spotlight has been on the senators health for some time now. Shes 90 years old. Senator feinstein briefly went to the hospital yesterday afternoon after a precaution after a minor fall in her home. All of her scans were clear, and she returned home. Lawmakers are on an extended recess. Again, after we saw there was questions swirling around fine steen even before she left after she was unable to answer certain questions properly, she didnt understand fully what was going on. Of course we also are monitoring the health of Leader Mcconnell as well. This all comes down to Senator Feinstein and her political future. She has said she will not end her term early. She does have plans to retire. There are three democrats in the running to succeed her potentially in california, but again, as Senator Feinstein continues to have these moments, we will of course pay very close attention to the age of lawmakers up here.
