A judge in the interference case denied a request from trumps legal team for an extension on the deadline to respond after prosecutors asked for a protective order. This is acute the former president from disclosing evidence and other case information. The trump team has until five pm monday to respond. Joining me now, jordan reuben, writer for msnbc. Com. Coming through. Jordan, let me start with you on this one. Does this really show the judge is not going to comply when it comes to what looks to be the trump teams Delay Tactics . I think thats right. Its certainly, we couldnt have gotten a quicker hands in this. This is on top of her already signaling that she wants to know, sooner rather than later, what the respective size of the trial dates. Are we are going to get really quick clues about how the judge is handling this. We already had one, even unexpectedly, over the weekends. This is for knocking down trumps attempt to delay, responded to a motion for a in order. Talk me through, jordan, if you will, one Order Protection would really mean. We know its going to keep trump from disclosing some of the evidence of change in the trial, but will it keep him from making these kinds of threatening posts that we have been seen and this time, what were used to see him for the former president. Not necessarily. Its important to remember that this order of protection motion, they didnt make a gets on the post. We had to get an Order Protection. Now this is an order, a motion i should say, that they were already going to make to try to prevent trump from disclosing sensitive information, grand jury information, witness information. It just so happens that this threat that he made happen to be a good supporting evidence that the Special Counsel included in extra reason why trump needs this protective order. The government is successful here, trump wont be allowed to disclose sensitive information, grand jury information, because this is all dependence, this is all related to the timeline too. They are ready to hand over discovery to the defense, but were not comfortable doing that until this protective order is in place. Thats what the government is trying to accomplish here. Jordan, reuben thank you for joining us. Barb, lets get into more of this. Trumps attorney, john laura, will be making the rounds a lot to say the least listen to, show especially this morning. I had a fairly Tense Exchange with her own chuck todd. Lets take a listen to that. It was specifically about, of course, a former Vice President s role in all of this. Mentioned, i believe, over 100 times in the 45page indictment. Lets listen, then well talk. He said the president asked them to violate the constitution. He said the president asked him to violate the constitution which is another way of saying that he asked him to write the law. He never said, no, thats wrong, thats wrong. A technical violation of the constitution is not a violation of criminal law. Thats just plain wrong. Barb, what you make of that . Thats just plain wrong. What he just said. Importantly, this is all going to be in a court of law where the judge will instruct a jury on the law, and the parties will hear the actual evidence. Whats charged here is the conspiracy to prop the United States of obstruction of an official proceeding, deprivation of rights. To the extent that he was pressuring mike pence to violate those laws, to violate our fundamental democracy, the lawful transfer of president ial power, its absolutely illegal. This is all in offensive campaign to convince the electorate, but what will happen in court will be very different from what were hearing come out of jungles mouth. Its interesting because theyre also kind of doubling down on this idea, and this is something that i think many of us expect, at this idea of a tenth, right . What theyre jacket as the atteion, the evidence to prove this. It seems like this is mounting and the case. The former president of the United States actually believe that this election was stolen the actions that he carried out leading up to and on january six were because that he believes that this election was stolen. He said it again today on the sunday shows this morning. Does this even matter . Does that, is that even a defense . No, yasmin. It feels like a matter of fact, and a matter of. Law as a matter of fact, this indictment throughout all the ways, every which way to sunday, that donald trump absolutely knew he had lost the election. Everyone told him that, he failed and all of his legal challenges. It feels as a matteroffact, but as you say, it also feels as a matter of law. Even if you think that the ends justify the means, if the means are illegal, it is still a crime. I cannot temper with a witness, and ask them to lie, just because i believe im innocent of the underlying crime. The Witness Tampering is still illegal. Similarly, if donald trump is not using lawful means to challenge what he believes is an unfair election, he had legal means to do that. Whats alleged in this indictment is that he used illegal means. I want to draw a little on this case that we heard from laurel as well, referring to what happened with kennedy back in 1960 in the state of hawaii, right . That was a Court Ordered recount. Theyre kind of pointing to that and saying, listen, look at what kennedy did in 1860. There was a recount in place, they had electors in line, ready to go. Then subsequently, lets just say, after the Court Ordered recounts, before the recount they said nixon was declared the winner at the time. Then subsequently after the recount, it was in fact kennedy who pulled through in the state of hawaii. Im confused as to how there are equating that with what they try to pull off when it came to this elector scheme. Yasmin, this is just a classic case of whataboutism. Just throw it out there, say that the other side was corrupt, therefore you can hold donald trump accountable. Number, when it doesnt matter what has happened in the past. Lots of people get away with filing the law, it does mean you get to violate the. Law the next time you pulled over by a police officer, its not going to work. Regardless of, that its different, but i think that if they just throw it out, there most members of the public are not going to focus on the minutiae, and on the details. They just say, kennedy, hawaii, something, something, something. See, we win. It is all about throwing enough information out there, and then again, one of the real pieces of corruption and the putin regime, another authoritarian regimes, is not to convince you that this candidate is honest. Its to convince you that everybody else is dishonest. If everyone else is dishonest, and everyones corrupt, then this suffers along with and telegraphy. Six people were killed in a series of mass shootings. The first occurred around one a. M. A northwest washington, an area known for its nightlife. Officers found three men with gunshot wounds, two are pronounced at on the scene. The third was taken to the hospital with lifethreatening injuries. About two hours later, another man was taken to the hospital after being shot in a separate incidents. Yeah, yasmin, we are seeing major flooding in juneau after the Mendenhall River crested overnight at a Record Setting 14. 9 feet. That is nearly three feet higher than the previous record set. You showed that dramatic video of that Home Collapsing into the river. Officials say there are several homes and trees that have just floated away because of those rushing waters. All of this started on saturday. This flooding began. This happened because of a major release from the Suicide Basin in juneau. We actually have a time lapse where you can see how quickly that water began to go down over the past several days, as it was flooding into the river. And the good news is that now that water is starting to recede, and also officials there have not yet reported any deaths. It may be possible that so far everyone is safe and sound. But of course, there is a lot of structural damage that they are dealing with there. They are not Out Of The Woods just yet, even as that water is receding there is still the risk of erosion. We could see more homes destroyed and more structures destroyed as things continue to settle there in juneau. Talk more about this glacier. Fairly wellknown, i should say, the tourists. Appreciate it, my friend. That other grand jury, right, was only tasked with investigating Election Interference by trump and his allies. The current grandeur he could hand out this indictment we are possibly waiting on. How seriously do you take the idea that fani willis, the Fulton County d. A. , could seek multiple indictments here, even with the jacks mitt only getting an indictment against trump himself . Yeah, so, theres actually technically to granaries that have been seated. The reason why is the public doesnt need to know which one of those grand juries issues indictments that we are going to see rolling out in the next week or two. I anticipate and my sources have indicated its going to be more than one indictment. Why . Well, you saw jack smith, he did one indictment with one defendant, and that being former President Donald Trump with six unindicted coconspirators. It doesnt mean that they will get two weeks later, on doesnt mean theyre face their own indictments, but in this instance, fani willis can do the same type of strategic calculus. Should i just knew donald trump, donald trump and multiple codefendants . The pace, the speed, the timing, the efficiency of the case, that could be part of the analysis for her. It could also be, i am going to present everything i have to these grand juries and then i am going to allow that grand jury to issue its recommendations. Now, remember, its a true bill that gets returned. That original special grand jury set, here is a report, heres our recommendations. But this grand jury now, yasmin, itll issue a true bill, meaning itll say this is the indictment and the charges we believe are reaching the standard that needs to be met to get them. Talk about these possible rico charges. A lot more broad than weve been seeing in jack smiths indictment. Georgia has a fascinating rico statute. Its a racketeering statute. You often hear it spoken in the terms of mobs, right . The idea that these mob groups are doing racketeering. In this instance, in georgia, in order to prove a rico interstate statue, the Trump Campaign was a criminal enterprise that pursued a pattern of racketeering activity. In georgia, the statute allows for 40 Predicate Acts. Meaning these are at least two acts, two crimes that had to be proven that the defendant committed. They can be done for the violation of state laws or federal laws. What is also interesting in georgia, yasmin, is that solicitation, in the attacks, normally those doses dont count for and this instance we know that special grand jury and that fani willis has been investigating things that run the gamut from Computer Trespass to false statements. There is definitely Predicate Acts that exist fani willis could pursue. She told the reporters that shes read the federal indictment. She was asked if she had read it. Nothing about that federal indictment that she read actually supplies her would stop her from moving forward with what she actually sees as charges that are incoming. I want to play for you what else she told reporters on thursday. Are you coordinating with the Special Counsels office at all . Im not going to comment on the investigation at this time. How much overlap is there between what you are planning to do and what is in the Special Counsels investigation or indictment . Obviously, we are concentrating on georgia and things that impacted georgia. Does it affect what you are planning to do . No. Its interesting, right . Shed been asked in the past whether or not she was in communication with the Special Counsel, especially when it came to the timing. At one point she said, even if she stood next to jack smith, shes not sure jack smith would recognize her and vice versa. Do you buy that, that there is no communication happening between the Fulton County d. A. , jack smith, alvin bragg, so on and so forth . As we, know yasmin, in the georgia episode with the fake electors scheme took up five pages of jacksons recent third indictment of donald trump. I do believe that it is very feasible that there hasnt been a massive information or evidence share between funny wallaces office and i think you dont want to feed into the narrative on Donald Trumps side that there is been some huge conspiracy between the deep state entities of the federal government and the state governments, right . And the prosecuting agencies, theyve been coordinating to have this huge conspiracy against them. Frankly, fani willis has a very narrow line of just what happened in her jurisdiction. Its clearly more about these explicit threats that are being made essentially saying as i just mentioned, if youre coming after me, im going after you. That could mean a lot of different things. But this is not necessarily new when it comes to donald trump and what he is being attacked hes gone after the manhattan d. A. As well and given similar warnings during that initial hearing as well. What is your reaction to the framing from his defense team . Yasmin, i think its a lot of nonsense. The fact of the matter is, protective orders have frequently occurred in criminal prosecutions. In fact, one of the proposals that the government sent to trumps attorneys was a protective order that came out of washington, d. C. One of the same courts trump will be where his trial will take place. This is nothing unusual. Certainly in the context of trump where you posted that truth tweet, whatever its called, that he made an ostensible threat. The fact of the matter, is he has attacked jack smith and his family, specifically, hes gone after the judge this morning, talking about her. He has gone after hes mentioned alvin bragg. The fact is he has gone after judges, prosecutors, and even mike pence going after witnesses. In the context when you have somebody who is not only saying specific things about all of these people but doing it in a way where some of the supporters lets not forget, somebody who attacked the fbi field offices in cincinnati. The explosive devices and send it to what were viewed as opponents of trump. Someone who took it into his own hands after seeing trump talk about it and track down brock obamas home in washington, d. C. There are a fringe elements of his followers who are ready to listen to the statements and see them as a call to violent action. That is the issue here. You have been targeted by the former president directly. Weve obviously seen, as weve seen the targets being jack smith and alvin bragg, Fulton County d. A. Fani willis as well with an impending indictment coming out of that. How do you navigate that . It is certainly difficult. Look, there is a direct correlation from the times where former President Trump would either tweet about me or mentioned me in some speech and the resultant response. Whether or hate, mail mailings, occasionally people showing up. So it does matter. When he says things like this, people do things. That is why it is important. Im struck by the fact that every time we see jacks mitt on television, he is accompanied by a protective detail. One of the things that was most striking in director wrays recent testimony to congress was the fbi has created an entire new unit that never existed before to track threats to fbi personnel. So again, that is the environment we are living in. Certainly, as somebody who personally has experienced, it whos experienced my family being targeted by trump, that is something that is always there in the back of your mind. I am certain it is not going to stop jack smith, fani willis, alvin bragg, or any of the judges assigned to these matters from doing their job. But it certainly is there in the back of their mind. Certainly something im sure they are thinking about every morning and every night, whether they are at home or on their way to work. Again, its important to know, this protective order that was asked for by the prosecution, by the Special Counsel was about revealing the possible revealing of the Discovery Material Being handed over to the defense team. Not necessarily even the threats being made to jack smith and others on the team, along with, you know, things that have been set by the former president of the United States. Let me ask you one more thing, peter, before i let you go. You are engaged in ongoing Wrongful Termination lawsuit against the former president over your dismissal from the fbi five years ago. There is a chance you could be in a courtroom with the former president , he could in fact testify in that case. What do you think the chair chances are that the former president of the United States testifies in this january six trial . I think it is going to be interesting. I think president , trump in the context of his indictment for the january six activities will talk a big game about wanting to tell the truth and share his side of the story. But i suspect when push comes to shove, he will do just like you did with Special Counsel mueller and so many other folks. He will shy away and be scared of testifying. Look, there is very little legal upside for former President Trump testifying at trial. Some of the defenses, the people around him are claiming he will have to take the stand if he wants to do it. But i cant envision a scenario where any of his attorneys is going to council him to get up there on the stand. With President Trump, hes a wildcard. Former President Trump, i dont know what he is going to do. Should he take the stand or it would be a disaster for him. Peter, thank you sir. Appreciate it. The biden president ial campaign, meantime, is just about the last place you will hear anyone talking publicly at length about Donald Trumps troubles. That includes Biden Campaign manager Chavez Rodriguez who sat down with an exclusive interview with Alicia Menendez on last nights american voices. For us, its about making sure that we are really talking to the American People about the issues that matter most. We know that these court cases will continue to move forward and they will take their course of action. But for us, again, its really making sure that we are talking to voters about lowering Prescription Drug costs, energy costs, really focused on what matters most to them right now. What is next for his campaign and the strategy here, really, as hes looking at campaigning against someone who will be three times, possibly four times indicted and maybe going to trial during that time . Yeah, yasmin, this is definitely an unprecedented situation that we are seeing play out, not just again in 2020, but also four years later now expected in 2024. And what is so interesting about this is if you ask the biden team, the campaign, whether they are concerned about, as you mentioned, those lagging poll numbers, slower fundraising totals, concerns about the president s age, they will tell you that they believe that they should keep operating along the status quo. They believe that at some point the tides will more sharply turn in their favor. You heard the 2024 Campaign Manager julie Chavez Rodriguez lay out there why she thinks this. She believes that they have to keep doing what they are doing, talking about and not necessarily the most exciting or enticing issues for voters. These are issues they see has non partisan issues that they think affect all americans and all americans can relate to because they think that is what is going to help them win in 2024 in the long term. Issues like manufacturing, inflation, infrastructure. So aspect to continue seeing the president continue this vow of silence that hes actually directed his aides and staffers keep for a couple reasons. Politically, hes the one who appears hes trying to weigh in after some political benefit. But then also have other folks in the Democratic Political ecosystem, congressional representatives, the dnc, governors who are on board with a biden to make that case against donald trump so that you really drive home to the American People what is at stake here. But overall, the economy seems to be doing pretty well and faring pretty well, especially considering the predictions that were being made way back when as to where we would be right now. Biden also has the luxury of running like a general election candidate because he doesnt have very strong primary opposition. But the fact that you are anywhere in that range of only being three points ahead, that and the other numbers you pointed out should be a big red flag.
