The attacks coming moments after news broke that a federal judge in d. C. Denied it team trumps hope for three more days, to respond to the dojs request for protective order. The deadline remains monday, five pm, despite the push from trumps lawyers. The government is seeking a protective order to keep trump from publicly disclosing evidence gathered during the dust disappointments sprawling investigation. And to keep him from threatening potential witnesses. Special counsels office wants this all to have been quickly. In a new filing they say, quote, the government stands ready to press send on a discovery production. The defendant is standing in the way. And the request for protective order, the Special Counsels office cited this social media post from trump, reading, quote, if you go after me, im coming after you. The prosecutors argued to trumps rhetoric and possible use of grand jury transcripts could have a Chilling Effect on witnesses. This afternoon on msnbc, u. S. Delegate, stacey plaskett, who served as House Manager during trumps second impeachment, had this to say about the move from federal prosecutors. I think that this is jack smith and the prosecution is saying that they are not going to let him get away with intimidation. This is different than a gag order, which we keep the him from speaking at all in public. This is a protective order to protect witnesses, potential jurors, as well as the judge and those that are within the court room, and the transcript itself from being tampered with by donald trump. Of course, we cannot forget the backdrop of all of this. Donald trump remains the gop front runner for president. Once again, seeking to be the Head Of State of a government he tried to overturn in 2020. Im going to dive into all the legal questions in just a moment. We want to start in Columbia South carolina, where trump is expected to seek speak at a gop gala. Nbc news capitol correspondent, julie tsirkin, is there. Julie at how trump is responding to this latest ruling. We will see what the former president himself says as he takes the stage over my right shoulder. In less than an hour and a half from now. Last night i was at his event in alabama in montgomery when he spoke in front of a friendly cloud. I expect he will get the same southern charm, the same hospitality here. Because these are all his supporters. This is a state, south carolina, that in 2020 got rid of the republican primary to make it easier for the former president to consolidate votes. Now, when we look ahead to what happened today, and all of these revelations in this back and forth between the trump team and between the doj, Special Counsel jack smith, and the judge overseeing that case. It is clear that the trump team is trying to delay the possible potential movements that we already know our to come. His Second Court Appearance in just three weeks. But right, now this is over the evidence that jack smith, the Special Counsel, has agreed to share with trumps legal team. There is concern, you read that truth social post, at the top of the segment, that he is going to pressure potential witnesses in this case. That he is going to divulge sensitive details, sensitive material, that is shared in this Discovery Phase A you said it at the top there that the judge denied the motion by the trump team to try and extend that deadline. By three dates. They said that this is a tactic. With the defendant, quote, stonewalling, and trying to delay their investigation. It is all just a split screen. As the former president hit the Campaign Trail less than 24 hours after that first an initial arraignment on thursday, that first hearing in his third criminal indictment for his alleged role in subverting the 2020 election. So, i assume, and expect, that this back and forth between the trump team and the judge, in this case, will continue. Nbcs, julie tsirkin, with the former president tonight in south carolina. It Eugene Daniels is a Politico White House author, and hes also an nbc Jennifer Reuben washington jill, ive got to know what you make of todays Court Filings from trumps legal team and the judges very swift to weekend response. Its a very good sign. The judges in control. And not the former president or his lawyers. The treat was unwise, in saying it does nicely as i can, it is definitely viewed as a threat. And i dont know what he doesnt get about the original Magistrate Judge saying you cannot commit another crime while you are out on bail. Or you will be held in custody. You cannot threaten or intimidate witnesses, or you will be taken into custody. I dont know whether that will happen now, but hes getting very close to forcing the hand of the justice system. Yeah, jill, trump posting prior to this, that we were just talking about, if you go after me, im coming after you. The Special Counsel citing the post in request for this protective order. Theres the post you referenced, attacking mike pence. When you talk about him not taking it serious, not understanding it, we talk a lot about the ways in which he tests the guardrails. He pushes the limits. This is no, even for him, right . Not understanding that a court operates differently than other government functions. These are limits that are enforceable. The other limits that he has ignored have been a common rule of behavior for a president of the united states. These are not just rules of behavior that are accepted. These are enforced rules. They are written rules. And im not so worried about what hes saying, as what impact it will have on his followers. And im worried about his conduct. Remember, this indictment, this last indictment, for interference with the election, is not for his words. It is for what he did. The phone calls he made. And for the impact that his words had on his followers. In saying that its so awful, saying i will come after you, what does that mean . Remember on january 6th, hang mike pence. He went out and tweeted, if pence had done the right thing, we wouldnt be in the trouble we are in. Then the calls for hang mike pence the game letter. It is a very serious threat. The court system has to take it seriously. If holding him in custody is necessary, eric holder has already said that the bureau of prisons can handle jailing a former president who has secret Service Agents with him. And so, it is not something that is desired. I dont think anyone wants to see that happen. Certainly, we want to see a trial, and an outcome, before that is even considered. But, if he is endangering witnesses. He must be stopped. Jennifer, so much of what we hear from trumps legal team, whether its this First Amendment argument that they are pushing, whether its this it took you three and a half years to do this investigation, we should have three and a half years before we have to deal with this trial. It all feels to me more like a political argument than an actual legal argument. Because every lawyer that we talked to says, yeah, thats not a thing. The argument that they are making has no basis. And that is also what hes doing on truth social. The attacks against mike pence. What is the political calculus there . And if you are mike pence, who sort of has gone out the farthest now that he has gone out in talking about january 6th, what is the pushback . What do you do . Well, i think youre exactly right. Those silly arguments about the First Amendment which does not apply in this case, in fact, jack smith right up front in the indictment says he could have said anything he wanted. But it is what he did that got him here. Whatever donald trump says through his lawyers, or directly, out to the public, is meant to increase his sympathy factor, his claim to be a victim. That they are squelching my free speech. And theyre persecuting me. This was all to keep his base engaged, keep them sending money. Remember, hes running low on funds now, to defend himself. And these various criminal activities. So what he says there has very little to do with what arguments, if any, hes going to make in court. You dont see him making at argument in courts, at least not yet. That he should have three and a hears three and a half years to respond to the indictment. Thats not going to happen. I think what is significant is, the judge responded very quickly. And once you make it a admonition, once you tell the witness if you do x, we will put you back in incarceration. We will put you behind bars. You then have to be ready to act. That is what is so difficult. Judges, up until now, have been very nervous about putting him in jail. They dont want to appear to be political. They dont want to appear to be scratching his First Amendment rights. But i think he has met his match in this judge. And in the entire circuit. Whats interesting, a few of the judges, including the senior judge came to that arraignment, and sat in the back. That was a sign of what we are in this together. Dont mess with the judicial system. So, i would expect that the judges are going to come down hard on him. Its going to take several rounds of this before were even contemplating putting him behind bars. This is the first step. We are going to have round two and round three, and run for. As far as mike pence goes, i think he has no choice. Hes been out there already. And he said, listen, i have to defend myself. And say that donald trump did something that was wrong. , eugene, theres the calculus, the political calculus for the people that are running against donald trump. And then theres a political calculus for all of the republicans in the house, and the senate, who is following in his state. You have House Speaker Kevin Mccarthy, immediately defending trump this week. And not only defending trump, but repeating a lot of the and main arguments that trumps lawyers were making. I mean, what are you hearing from these lawmakers . We know trump himself says only needs is one more indictment, im just becoming more popular, its all working for me in my favor. Is that what you hear from republicans on the hill . Yeah. A lot of them are scared of the base. They are not scared of donald trump. People arent scared of a truth social post anymore, theyre scared of the tweets when he was president. Theyre not scared of him anymore. They are scared of his base. They have people like Kevin Mccarthy who talked to donald trump often. Right, he talks to him sometimes weekly, over, and, over and over again. Who knows that, and Donald Trump Tells his base, hey, i dont Like Mccarthy anymore. Youre going to start hearing that bubbling up. And maybe mccarthy isnt speaker anymore. So hes protecting his face, right. When you talk to folks behind closed doors, and they know that youre not gonna put their name to the words theyre saying, theyll tell you they are sick of it. Theyre sick of having to answer for donald trump. They wanted him gone before, but they are scared of the base. And saying that in public. They are worried for their families, and what that could mean. They are worried what it looks like to be disloyal to donald trump. January 6th changed the calculus for folks. They are already fearful about saying things about donald trump. But january 6th showed, and weve seen over and over again, that some of these folks that like donald trump are willing to go to dangerous lengths. That is something that these folks have been thinking about, the folks in congress are thinking about all the time. They have families. They themselves are all raise worried about whats going to happen. The thing that is happening what they dont want to happen to them. They also know, and are hopeful, that someone is going to take donald trump out on the debate stage. Or through this primary process. Because they themselves are too scared to do so. They are hoping that the stance in this campaign gets it together. And is able to take donald trump on the debate stage. That chris christie, for some reason, bubbles up and takes him on. But that has not been the case for donald trump. The he has been very fortunate, and specifically, because he has spent his entire political career, and really his entire public clearer. Even on the apprentice. Saying, the reason people are coming after me is because theyre coming after you. He is being much more explicit about that now, that the folks in washington d. C. , this warm that is here, i am the only thing standing between you and them. Once you say that, and you have all of these republicans parroting that for years, of course these folks are going to believe it. So why should they choose mike pence or ron desantis, or nikki haley, or tim scott . When the guy who made those promises, and his promise to continue that, is standing right there. Julie, youve been an advocate since you were a child advocating for better Labor Conditions for migrant farmworkers. You come from a long legacy of people who have done the same. How does that lived experience inform the way you are thinking about this election. Im really fortunate. I was raised in a movement of people who really gave their all to something bigger than themselves. Im an organizer by birth, and by training. I really come at this from the perspective of being able to bring a Broad Coalition together. We know that in 2020, what Senate President and biden and the Vice President Kamala Harris to the white house was a Broad Coalition of voters. And for us, its about really being able to reenergize that coalition, ensure that we are getting out, reaching voters where they are. Really talking about issues that are most important to them. And making sure that they know the choices before them right now in this election. Donald trump, the front runner for the gop nomination now faces a third indictment, this time, for election interference. How does your campaign to run against a thrice indicted, twice impeached, former president. We have a really focused campaign strategy. Were going to stick to that. For us, its about making sure that we are really talking to the American People about the issues that matter most. We know that these court cases will continue to move forward, and theyll take their course of action. But for us, again, its really making sure that we are talking to the voters about lowering Prescription Drug costs, lowering any costs. Really focusing most on what matters most to them right now. And continuing to again ensure that they understand the choice that is in front of them. And the clear contrast of the kind of you know again, extremism, that were seeing from trump, desantis, sort of the entire field. Versus what we are delivering, right now, for the American People. Really investing in our communities. Yet, it would seem that one of the challenges you face is that as much as President Biden has a strong record to run on, whether youre talking about job growth or about historic investments in american infrastructure, there is a disconnect between what he has been able to do, and what voters are giving him credit for. How do you close that gap . I think thats why we have a campaign right now. It is our job to make sure we are getting out and getting talking to voters. I think voters are really starting to feel the Economic Impacts that this administration has set forward. You know, the president has recently talked about it in the content next of bidenomics. We know thats led to, as you mentioned, historic job creation. A rise in wages. Increased Job Satisfaction amongst workers. New and emerging opportunities in the clean energy economy. All of these things are critically important for us to get out and to talk to voters about. And to really draw the connection that this is a result of the historic legislation, and really incredible work President Biden and Vice President harris have brought forward, and really delivered for the American People. There is new reporting out this week about a meeting earlier this summer between former president obama and President Biden. How do you plan to utilize former president obama in this campaign . Former president obama has been a tremendous champion, and really early on, were so excited to have his support. Weve already been able to list him in some grassroots fundraising efforts. Which have been, you know, really helping to ensure that we are bringing our Grassroots Community back into the fold. You have worked very intimately with Vice President harris over the course of years, she has been out on the trail already talking about ron desantis, and African American history in florida. Talking about basic bodily autonomy. What is the role you see her playing in this campaign . Her ability to meet the moment, as you mentioned, to be able to head to florida, and to confront what is an absolutely ridiculous claim from ron desantis, and those who are formulating the curriculum in florida, that somehow a brutal system of slavery had any redeeming qualities. Or the fact that she was able to, you know, head to iowa most recently, where we are seeing attacks on womens reproductive rights. Her ability to really meet the moment and make sure that, you know, these issues are front and center, is really, i think, going to be an Incredible Opportunity for our campaign. To ensure that her leadership continues to shine. Looking forward to the general election, your reporting this week, democrats concerned about an independent no labels president ial bid pressing elected officials to publicly denounce a potential third party candidate. Does the Biden Campaign support those efforts . You know, again, we are focused on just really building our campaign. And really building the kind of infrastructure that we know we need. From the fundraising apparatus, to the endorsements, to just this morning, we announced two new members of our fundraising team. Our grassroots fundraising director, and our finance directors. So we are going to really continue to focus on the issues that matter most to voters. And really continuing to communicate. And again, i think its been pretty evident by a lot of the reporting that weve seen on some of these other efforts, that they are just not transparent. And they are really not at the level. Lets go back to the coalition that you referenced earlier. Black, latino, aapi voters. Still support democrats, at incredibly high levels. And yet there has been talk of slippage, in part, because of the levels of support from that coalition that former president obama enjoyed during his presidency, during his elections. How are you thinking about that coalition, and is there anything different that you plan to do differently in this race, then in the last . We know that its going to take a lot to reach our voters. And our coalition of voters, whether were talking about our latino voters that we know over index online. They consume their news mostly on youtube. And have incredible Social Networks via whatsapp. Its really looking across all of those platforms, and figuring out where these coalitions are voters, where is it they are recreating, socializing, spending time. And how can we reach them where they are, and everywhere that they are. And thats going to be a really important part of our strategy. As well as, i think, in a post covid environment, really understanding ways in which voters want to engage with campaigns, and want to connect with campaigns, in making sure that we are really being thoughtful about reaching out to all of our coalition of voters. The judge has denied his team asked for more time to respond to the dojs requests for protective order. Earlier today, team trump asked for a threeday extension, but tonight the judge is saying no. Mondays five pm deadline stance adding to an already busy week for trumps legal three. Doj has still thursday to suggest a trial date. That, sameday maralago property manager Carlos De Oliveira will be arraigned in florida in the classified documents case. Joining me now, msnbc contributor and former water prosecutor cohost of the sistersinlaw podcast and author of the watergate girl. Jill, trump, walter nauta already under a protective order in the maralago case. What should we expect from trumps legal team on monday, given that today, as were speaking, he just landed in south carolina, and is proceeding with his 2024 election bid . Well, he can do anything he wants in connection with his election bid. Remember, the indictment, the election indictment, said he cant even lie to the public. He cannot act on it. So he can keep on lying. And he is, hes repeating all of his lies that got him indicted in the first place. And so, it may be like the e. Jean carroll case, where he got indicted she filed a second complaint against him for repeating them, and the damages will be higher. It also could be like what has happened to rudy giuliani. Where hes been conceding that he made defamatory statements, and so the judge is saying, why didnt you just concede the whole case . That may happen to him. But hes got a very busy schedule. I honestly cannot think of any defense that the lawyers can ask for for why they need extra time on something that is posing a Clear And Present Danger to witnesses, and not just to witnesses, to other people as well. He, donald trump, has threatened and talked very ill of jack smith, and of jack smiths wife. He has gone on and on, the lawyers are making ridiculous arguments, you mentioned the threeyear argument. We should have three years for discovery. Well, excuse me, jack smith was only appointed eight months ago. Thats all theyve had. So he doesnt need any more than that. And remember, the defense has the person who knows everything there is to know. They have the defendant, they are argument that they should be exempt from the speedy trial at and wait till after the election is so absurd. They are arguing, and i dont know how they do this with a straight face, they are saying, this Speedy Trial Act is only for the benefit of the defendant, so he can wave it. That is not true. The Speedy Trial Act is for the people who bring the case, for the prosecution. Which represents We The People of the united states. We who are the victims of his alleged conspiracy. We who were deprived of the right, or would have been if he succeeded, deprived of the right to have our votes counted. So, the Speedy Trial Act protects us when witness memories fade, when witnesses could die. You have to have a speedy trial for us, as well as for him. And so, when you go to what hes going to argue next week in front of the judge, i honestly cannot imagine that the judge isnt going to say, you lose. Hes going to get tired of losing. I hope. And stop this nonsense. Jill, the sheriff in Fulton County georgia says he hasnt ruled out fingerpointing, taking a mugshot of donald trump if the former president is in fact indicted there. Can you just talk us through briefly what has stopped other jurisdictions from doing the same thing . The jurisdiction so far have said we have plenty of pictures of him, we know what he looks like. His fingerprints are probably somewhere in the federal governments files, because of his security clearance. That would go with it. So, we dont really need it. There is no reason, even though you may not need it, because hes well recognized, for him to be treated differently than anyone else. And i also think that with the protections they are setting up, the indictment in georgias coming soon. And that it is definitely planned to be the last, so that it can be tried last. It will overlap with some of the evidence in the trial of the Election Case by jack smith. But its still important to go forward, because should he ever get someone in office who wants to pardon him, they need to have a state charge from which no federal official can pardon him. So i think it is important to try it. And its a different sovereign. Its not double jeopardy. It is a different law, and a different prosecution force. A different venue. So it should proceed. It is described in the indictment, it was fueled by lies. The latest indictment of donald trump could be the most dire for democracy. The Special Counsel charging trump with four criminal counts, including conspiracy to violate civil rights, meaning americans right to have their votes counted. Meanwhile, theres a renewed push to secure the Election Process in each state, to keep 2020 from happening again. Joining us, minnesota Secretary Of State, steve simon. Thank you so much for being with us. I think what is laid out in the indictment, as it relates to the fake electors, it can seem a little esoteric to folks, if you are not following along. How do you explain to voters in your state, the very real threat to democracy that existed in 2020, and the threat that still remains on the horizon . Well, as you imply, not everyone can read this 45page indictment. So what i say is that what somebody tried to do was hijack an election. I make a distinction, its very clear here. Im not talking about disagreement. Reasonable people, as the indictment says, can disagree, and say anything they want about the election of 2020, or any other election. People in america have the right to be wrong. But what is different here is that its not just speech or opinion, it is conduct. It is conduct to utilizing lies to hijack, to interfere with the process of ratifying a president ial election. That is the bottom line. We have processes, we have rules, i wont get into all the granular detail. But someone trying to interfere with all those rules. Again, okay to disagree. Go to court. Plead your case. But once the dust has settled on all the litigation, and we have electors representing the states, you cant just pretend that they are not the electors and go in and try to pull a fast one on the American People. That is basically what happened. As a Secretary Of State, how much of making sure that the 2024 election in your state is safe and secure feels as though it is within your purview, in your control . And how much of it feels like some of the stuff that is atmospheric, social Media Companies not being willing to really grapple with disinformation, sometimes not even being willing to uphold their own disinformation and Misinformation Policies . What is it you feel you can control, and what is it that keeps you up at night worrying about other people not doing what they need to do . While the name of the game, always, always, always, is partnerships. Our office cant do it. Alone we never could. We never can. We have to leverage partnerships with trusted voices. That is really what it comes down to. Finding trusted voices, in whatever community, to let people know that our elections are fundamentally fair, accurate, honest, and secure. So what ive done in minnesota s ive partnered with large employers and businesses. Ive partnered with professional sports teams. Ive partners with the faith community. They, very, often are trusted voices, or local governments. Maybe its not the Secretary Of State in a state. Maybe its someone at the county or city level, who people know as their friends or neighbors. But bit by bit, piece by piece, weve got to build that wall. And its a wall against disinformation. Now, im not naive, neither are your viewers. Theres probably a quarter of americans who are immune to any of those appeals, always. They just fundamentally have a different view of our election system. They cant think its rigged, or fixed, or stolen. About a quarter think the opposite. But the middle, about 40 , according to the most reliable polling that ive seen, they are gettable. Its not a light switch. Its not by narrowly. They might have a lot of faith and confidence in the elections in their area, but maybe they heard something from another state, or another study. Its up to us to let people know that, at least in minnesota, im quite confident in the last of the country, our elections are fundamentally accurate, safe, secure, and we can talk about the procedures. Some people say election candidate a to point candidate the. Thats not the case. But what we can say Going Forward is look, we test this stuff. We test the elections equipment. We checked the work after the election. A lot of people dont know that. I wouldnt blame them for not knowing. That its up to everyone who touches democracy, not just me, not just people in government. To let people know that weve thought of these things. There are a lot of checks, balances, and safeguards in the system. Thats not going to get everyone. By any means. But its a start. And particularly in a high stakes contest like one for president of the united states, and knowing what we know about what happened in 2020, we now have a roadmap, in terms of making people understand the election, the Election Process, as much as we can. And making sure they feel confidence in the election. So that we dont have donald trump or anyone else trying to do, what at least the indictment says he did in 2020. Angelo, if you watch, rightwing media, if that is what you can soon in any form, what is it that you believe happened this past week . You believe that the deep state, not just the extremists on the right, but the mainstream republicans now believe that, that this was sort of the next step in their plan to persecute donald trump. And not just donald trump, but then that they would then come after you next. Thats what you believe. It doesnt matter what part of rightwing media you watch. Its one of the few weeks weve had in a while where theres almost uniformity. Whether its fox news, talk radio, alex jones, theyre all saying the same thing. That is what you believe. You believe this was just another step in a big plot to come at you. I want to play just a little bit of what fox news viewers heard from their network this week. So that we can understand what it is that the base is processing. Take a look. Trump said nothing, and did nothing to trigger any criminal charge on january 6th. Any. His crime was believing and saying that the election was rigged. That is what they want to send him to jail for. The timing of this indictment was coordinated to take the heat off biden. Astonishingly, after these political war crimes have been perpetrated on him, donald trump is in the best position hes been in so far to win reelection. Can you believe that . At which point, hell have to pardon himself immediately, and dont you think for a second that hes not going to unleash hell on all of his political enemies. This is only the beginning of politicians putting other politicians, and their families, in prison. Im so sorry to ask our viewers to watch that. But i think its important. Because what you see at the end there is this mainstreaming of the idea of retribution. Thats it, revenge. That is sort of the fuel that is here. I think that democrats, im not in the politics world, but if youre in the politics world, i think they shouldnt discount the importance of a power as a motivating factor here. There wasnt judges Jesse Waters At fox news, that was a very big news this is, it this is why you have to get out there and vote. Donald trump is going to be your mechanism for revenge against all these people. And so, and that i think is a really powerful motivator. Theyre not just spinning all these lies and conspiracies. You heard about the damage of disinformation. Theyre also giving people a Call To Action. And the Call To Action isnt immediately violence. But theyre priming that pump as the ends justify the means. But their first Call To Action is to make sure that they are ready to vote, to rally around donald trump. And the election. Youve seen that play out right now. It is, ive been doing this for a while. This is a very scary moment right now. It doesnt feel like its boiling over. Its not. It is a roaring simmer. Just one more degree and the water is going to be everywhere , you look at the polling in some of those is borne out of recent reuters poll found that among republicans, 45 said they would not vote for trump if he were convicted of a felony crime by a jury. 52 wouldnt vote for him if he were in prison on election day. Your sense of how Republican Voters are actually looking at the legal processes against trump. They are looking at it as sketchy. If you notice, one, its part of a plan. Two, the ones that are on the margins, the skeptical ones, this is where the idea of the tax on the judges takes hold. That is poison that is being put into the system to start to move some of those more, i dont know if theyre moderate necessarily, but some of those republicans that are not entirely fully on board the trump chain right. Its basically saying, fine, if you dont believe all the other stuff, well, shes not experienced. By the way, she used to work with hunter biden. Which by the way, it is totally fabricated. Theyre making that up. That is a claim thats out there right now. You put that poison into the system, and lets not forget they have a delivery mechanism. Its not just the rightwing media. They have all these qanon figures, all these individuals that are spreading these ideas by word of mouth. Theyre just putting the poison into the system, and one by one plucking off the individuals on the margin. Because there are no antibodies in the system against this type of misinformation. This type of disinformation. The process that led up to january 6th is playing out very similarly right now in the rightwing media.
