Legislatures all over. So what do we know about this particular announcement and can you walk us through what georgias restrictions are that are being challenged . They have water for people in line, for how the voting operates, and im curious about whether or not they go after the punishments as mark said in the last hour. The sort of restrictions they have on county and state officials. They use this law to pun issue them for standing up for the States Election system. And it will be really telling here and how will they use this fight that is now in the courts . And it looks like this News Conference is going to start in just a moment. I want to bring in i apologize in advance if i have to interrupt to go to the Attorney General. What are you listening for today . What do you want to hear from the Attorney General e when he starts speaking . Im looking for bold, sweeping and an acknowledgment they understand this is unconstitutional. And i ham hoping that the doj response is equal in its intensity. Okay, we just got the two minute warn. Were talking about georgia right now. Theyre just one of several states that passed new voting laws in the wake of the november election, correct . Yeah, it was may 31st, and we see them stacking up. We know that texas is about to consider them, but if youre going to start as a federal entity, georgia is where you start. Georgia is the state that really put this fight in the headlines and i think it makes sense. They were speaking out strongly about this State Restriction early on. This is a clear choice. Also one of the most sweeping bills and i think it captured the nations attention into what state legislatures, usually controlled by republicans, can do to the voting access. Especially in a state that handed democrats majority. Everything is happening in georgia. Craig . Standby for me if you can. I want to bring in Rachael Pollus if i can. The former u. S. Attorney, a Law Preference at st. Louis university. Legally here what recourse does the doj have . The department of justice has sweeping powers under the civil war reconstruction amendments. 13th, 14th, and 15th amendments put into effect through the Voting Rights act of 1964. So if they feel like theyre disenfranchising them, since they set up an entire section to deal with Voting Rights issues, where i started my career at the department of justice, that they have lawyers, statutes, and they have power to begin federal lawsuits against violators. And we should point out here, and in minnesota, in minneapolis, again, were awaiting the sentencing of Derek Chauvin. We just found out moments ago that the judge in that case, judge cahill, has denied the defenses motion for a new trial. That motion denied by judge cahill. We have been told, yesterday, that the judge was going to dispose of a number of motions before the formal sentencing starting here at 1 30 local time, 2 30 eastern. Judge cahill just denied a new trial for Derek Chauvin. Merrick garland is walking out right now. The Attorney General set to announce this doj lawsuit against the State Of Georgia over the new voting restrictions. The associate Attorney General aanita gupta. I want to start by expressing my condolences for the community in surfside, florida. I know how difficult it is for the families who lost and for those waiting to hear. I express great gratitude for the First Responders and the others assisting in the ongoing rescue operation. I know the federal government is providing assistance to the state and local governments and we stand ready as things develop to provide more assistance fe it is required. The rights of all eligible citizens to vote are the central pillars of our democracy. Theyre the rights from which all other rights ultimately flow. Two weeks ago i spoke about our countrys history of expanding the right to vote. I noted that our progress on protecting Voting Rights, especially for Black Americans and people of color, has never been steady. Moments of Voting Rights expansion have often been met with counter efforts to curb the franchise. Among other things i express the concern about the dramatic rise in state legislative actions that will make it harder for millions of citizens to cast a vote that counts. I explained that the Justice Department is rededicating its resources and for protecting the law for all eligible voters. And i promise that were making new law thats seek to curb access and where we see violations of federal law we will act. In keeping that promise, today the department of justice is suing the State Of Georgia. Our complaint alleges that recent changes to georgias Election Laws were enacted to deny the right to vote due to peoples race and color in violation of section two of the Voting Rights act. Georgia experiences record turnouts in the 2020 Election Cycle. Approximately twothirds of eligible voters cast a ballot in the national election, just over the national average. This is cause for celebration. In March Of 2021 georgias legislation passed sp 202. Many of that laws provisions make it harder for people to vote. The complaint alleges that they enacted those restrictions with the purpose of denying or bridging the right to vote on account of race or color. I want to thank the staff of the Civil Rights Divisions voting section for their hard work on this matter, and for their every day efforts to protect americans Voting Rights. The critical nature of their work is the reason we are doubling the sections enforcement staff. This is the first of many steps. Thatall Law Enforcement votes are counted, and we are following the progress of legislative proposals under consideration in additional states. Where we believe the civil rights of americans have been violated we will not hesitate to act. We will use all existing provixs provisions of the Voting Rights act, to ensure that we protect every qualified american seeking to participate in our democracy. Under the supervision of the Attorney General, they are making sure states under federal law and best practices. Were in the process of developing guidance to ensure that post Election Audits comply with the law. And because the upcoming redistricting cycle may be the first sing 19 60 to preet, we will public new guidance to make clear the Voting Protections that apply to all jurisdictions as they redraw their electoral maps. These include maps used for congressional districts, state legislatures, county commissions, city councils, and more. Pursuant to president bidens executive order, were working to ensure access to Voter Registration for eligible individuals in federal custody and will assist other federal agencies in expanding Voter Registration opportunities as permitted by law. Finally as i noted two weeks ago, were seeing an increase in menacing and violent threats from the highest aministrators to volunteer poll workers. Today the Deputy Attorney general will highlight the prevalence of these threats, and instruct them to prioritize investigating these threats. Today we will also launch a task force including personnel from the criminal division, the Civil Rights Division, the National Security division, and the fbi to focus on these threats. We will promptly prosecute any violations of federal law. We are using every method at our disposal, but that is not enough. We urge congress to provide what is needed to protect the Voting Rights of every american. Eight years ago today the Supreme Court issued the decision, prior to that decision the Justice Department had an invaluable tool to protect voters from discrimination, section five of the Voting Rights act. Under that section any change with respect to voting in a jurisdiction could not be enforced unless it was first proved to the United States District Court that the proposed change did not deny or bridge the right to vote on account of race, color, or membership in a language minority. Using that tool they promoted over 175 proposed Election Laws across georgia from being implemented because they failed the statutory test. If georgia had still been covered by section five, it is likely that sp 202 would never have taken effect. We urge congress to restore this invaluable tool. I will now turn the podium over to Kristin Clark who will tell you more about our filing in the United States versus georgia. Thank you Attorney General garland. Two weeks ago you made clear that the department will spare no effort to protect Voting Rights in this country. As you and i have discussed on many occasions, we stand on the front lines of this work. While its the honor of a lifetime to leave the charge with upholding the civil rights laws, it is also a great responsibility. Today that responsibility requires that i announce the Division Found it necessary to file suit against the State Of Georgia. The Civil Rights Division did not arrive at this decision lightly. Its our job to follow the facts and the law. And our assessment demonstrates that goods recent Voting Rights law violates section two. I want to thank them for their tremendous efforts. I want to express our partnership and support. Today several provisions of sb 202 were passed with a discriminatory purpose. The Georgia Legislature passed a sb 202 through a rushed process. The version of the bill that passed on march 8th was three pages long. Days later it ballooned to nine pages in the house. These legislative actions occurred at a time when the black population continues to steadily increase. After a historic increase across the state particularly for Absentee Voting that black voters are now more likely to use than white voters. It challenges them with saying there was an intent to grant them equal access to the political process. The provisions that were challenging reduce access at each step pushing more black voters to have increased voting. It imposes additional obstacles. Like all of the provisions, the changes to Absentee Voting were not made in a vacuum. They come meetly after the Election Cycle. Sb 202 seeks to halt and reverse this process. First the law prohibits Election Officials as they did in 2020. The Law Irrationally shortens the period during which voters can request ballots and the period during which they can mail them out to voters. In the 2020 Election Cycle, a voter could request a ballot up to 180 days before the election. And up until the friday before the investigation. They moved it to a week. A critical time period close to election day where data shows that black voters are more likely than write voters to squ an absentee ballot. Churches, and advocacy groups that send follow up applications and have new and stringent Identification Requirements to obtain an absentee ballot. Were also challenging sb 202 that places restrictions on drop boxes. In the 2020 elections and the 2021 run off, the Election Board allowed voters to drop after absentee ballots. This was widely deployed. In the 2020 Election Cycle, the four most populous counties in the Metro Atlanta area provided over 100 drop Box Locations for voters. Under the bill that number is expected to drop to roughly 20. The drafters of sb 202 did not top their efforts at making it more difficult. They were more likely to wait in long lines. You have given those long lines churches have provided food and water to voters in line to make their wait more comfortable. This newsless pan was passed with unlawful discriminatory intent. Lastly, reducing the likelihood that provisional ballots will be counted. It is well documented that communities of color are frequented more, and because of the mobility and polling site closures and consolidations black voters are more likely to end up at the wrong precinct on election day. Sb 202 reduces the chance that those eligible voters will have their ballot counted. Section two of the Voting Rights act, a bedrock civil right statute, inhibits the bridges of the vote. As we allege today, sb 202 violates this federal law. It has been made clear that they will not stand by in the face of unlawful attempts to restrict access to the ballot. Todays fileen demonstrates the commitment to the charge. The Civil Rights Division stands ready to protect the constitutionally guaranteed Voting Rights of americans in georgia and where ever else the rights may be threatened in our country. You referred to the number that have passed laws, but most republican stating, are those under review by the department . Perhaps challenging them in the same way youre doing this. In the same way they issued a memo to the field. Can you say whether there is any idea how many threats are under investigation . Is this an effort to get ahead of the 2022 Election Cycle with regard to threats and Election Officials. On the first question, it is as i said, were looking at the laws passed before and the ones recently passed and as they are being passed. We will make that same kind of judgment that we made as we did with this one. When the process is completed, if we decide to make a filing well do so and well let you know, with respect to the second question were concerned both about deterring threats and about prosecuting past threats if they violate the law. I will give the Deputy Attorney general the ability to talk about it more. Citizens are fundamentally protecting our democracy and we have to protect them. That is why i issued the directives. It does two things, it launches a task force to make sure were bringing the full resources to protect Election Officials, if theyre appointed or not. They engage, you to prioritize them, and hold them accountable. One of the reasons for centralizing reporting is to make sure we fully understand the scope of these. There you it. The Attorney General announcing that the department of justice is now seeing what will like i will be their case siting specifically the changes to Absentee Voting, the ban on food and drinks being passed out. Joining me is the ceo of the new Georgia Voting action fund. And Rachael Pollus a former u. S. Attorney for the state of minnesota within what are your top take aways from what we just heard there . Im going to the section two. It could weaken what theyre trying to do. It could top them from doing section two, a denial, and you to show more of an impact to voters to sort of make this claim, so say it is disgrim tire. It is important they are using this to try to stop discriminatory state laws. But now it is it is making a case. I think it will be really important. It is heavily followed process. There is a lot of material to look at it. They are ground games in georgia, getting black voters to trust Absentee Voting. Typically we have seen them vote early and by mail. There is huge Education Campaigns and we saw massive changes to how they behave. Yeah, it was interesting to hear the Attorney General insist that civil rights would be violated if they were enacted. Also saying that that part part had not been cutted and then the laws would not have been passed. Rachael, he says the laws vie had late section two. How strong is their case . The section two is a very strong provision that was initially enacted to prevent Southern States from using ridiculous tests to prevent africanamerican from voting. Literacy tests, other things that have nothing to do with Voting Rights. So what i heard the Attorney General saying today is civil rights is very important to this administration and voting is fundamental. Theyre drawing a direct line from the Voter Turnout in 2020 and the laws passed by republican controlled states. So i think one of the most important things that we heard today is that this is just the first step. It is a federal lawsuit by the department of justice in every state. It is in the wake of the 2020 election. They are accusing georgia of patszing the laws, denied to deny black georgians access to the ballot. Are you hopeful this lawsuit will stop that . Yes, i am. I will expand that to include asianamericans as we. We saw historic levels of participation from those groups as well. So we look at the fact that 85 of Asian American voters voted with vote by mail and it seems like a solution that is narrowly tailored. I will also add that the comments about section five in place, that this would happen. It landed squarely with the particularly because today it is the 8th anniversary of the shelby versus holder decision. So while discriminatory impact is notoriously difficult to prove, they have given us a look to work with. So im encouraged. A big thanks to all of you the Attorney General is signaling that this may be just the beginning. So there is that Breaking News and were continuing to follow more. Shaq, let me start with you lets talk about the sentencing. A lot of daylight between what prosecution wants and what Defense Wants. The Defense Wants probation. Time served. Where are the two sides coming from . Prosecution wants 30 years in briz, so a big gab there. They stay is about 10. 5 to 15 years. Ghie higher than that guideline based on aggravating factors. Sorry about that car. The prosecution wants a sentence of about 30 years, and the reason why is aggravating factors that the judge agreed to, it is about four of the there was minors present, that he worked in concert with others. So the prosecution is hoping to get a sentence closer to 30 an 15. Then you have what defense is saying and what eric nelson and the defense team is saying for that reason why. Derek chauvin, because he is a Law Enforcement officer, they have a shorter life expectancy. They talk about his lack of criminal history. I want to quote it correctly so ill look down but they mentioned his being a product of a broken system as a reason theyre asking for a shorter sentence. The judge denying a new trial. They mentioned different factors. They accuse witnesses of not behaving appropriately. They denied that in a motion earlier today, craig. Okay, well come back to you in a moment. You know this more. The extenuating informations, based an all of these things, if you had to guess, where would you put his sentence . I would have said 20 to 20 years. I would describe that as being fairly defiant. What i mean by that is the judge has given us a little bit of a clue to what he thinks is important here. He said that chauvin abused his position. And he talked about the particular cruelty inflicted on george floyd. What judges look for is if a person as insight into their actions, if they would do something different, and if they express any remorse or empathy for the victim and there is none of that in this memo. And they said george floyd died a particularly slow death and he knew it was terrifying and he was begging, or saying this is a relatively quick death. They also say that Derek Chauvin did nothing wrong. He relied on his training and experience. And that if he knew he was committing a crime he would have stopped. When youre convicted they are saying im sorry, and showing insight into what is going on. So that was an opportunity for chauvin to demonstrate that he has some insight and that he is sorry about what happened to george floyd. He did not do that. That would have been a reason for judge cahill to give him a slight cut in theness. I think it is such a defiant memo. Victim impact statements. We expect three or four of those likely fr family members. There is some talk that we may hear from George Floyds daughter. What sort of impact do those statements have on the judges sentencing. Has the judge likely already made up his mind. I dont think they will have an impact on the sentence, but they will have an impact on him. I think anyone that watches the sentencing it will have an impact on them. This is their opportunity to tell the judge what the murder of george floyd, their loved one, meant to them and the way he died. I have experienced a lot of Victim Impact Statements and theyre very difficult and heartbreaking to listen to. So they will have an impact, but i think he probably already made up his mind about what sentencing he will announce. Thank you for all of your insight near minneapolis in the last year. Thats when a sentence will be handed down to former Minneapolis Police officer Derek Chauvin and todays hearing could set the tone for the upcoming trials of the other three officers involved. I am joined now by tara brown. Tara is George Floyds cousin. She is also director of the george floyd foundation. Tara, first of all, how are you and the other family members, how are you feeling ahead of the sentencing here set to start in a couple of hours . Well, to be quite honest, weve been anxiously awaiting this moment, feeling a little nervous and fully expect to have this be an emotional day for us. So just trying to prepare for all of these emotions that i know were going to be dealing with today. Has the family decided who is going to be delivering those impact statements yet . Yes. That has been decided. Okay. I wont ask you who is going to be speaking. Thats private, but i will ask you about the sentence because, as you know, the prosecution asks for Derek Chauvin to be sentenced for 30 years. What kind of sentence would you consider justice served . Well, the full justice we would obviously want is to have our george back, and thats not going to happen, so were just hoping that we want the maximum. We want the 30 years, if thats the max, thats what we want. And why do you think that the officer the former officer deserves the max . I think that he deserves the maximum because i think that, you know, what he did, the way that he murdered my cousin was deliberate, and in his position he should be held to a higher standard because hes supposed to be the one protecting, not the one who turns to the criminal and becomes a killer. So, obviously, i feel like he knew what he was doing. It was intentional and there were ample opportunities i mean, throughout that 9 minutes and 29 seconds, there were so many opportunities for him to change the course of what happened, and i just feel like he didnt try. There had been some talk that we could possibly hear from the former officer at todays sentencing. Legal experts dont think its going to happen because the likelihood of an appeal regardless of the sentence. Is that something you would even want . Would you want to hear from officer chauvin and would you be interested at all in what he has to say . Today, i probably i dont look forward to Hearing Anything from him. Probably months ago or when this all happened i would have expected for him to come out and, you know, say something. I would have interested in that. Today theres nothing he could say to change my position, how i feel about what happened, and i really dont expect to hear anything from him, and if i did its late in the game at this point. It would seem selfserving. It would feel like to me the only reason he would be making a comment or, you know, making a gesture to say anything to this family would be to save himself. Well, the sentencing, tera, would it bring the family any comfort . Any closure . Ooh. I dont know that its going to bring us closure. We have a long way to go in this healing process, but what i really hope for is that this sentencing will send a message to the Derek Chauvins of the world that this will not be tolerated and there will be consequences and accountability if you choose to do what derek has done.
