This is Breaking News across america tonight. It is a gripping moment, the former Minnesota Police officer, Derek Chauvin, sentenced for the murder of george floyd. 270 months, 270. Thats ten years in addition to the presumptive sentence of 150 months. This is based on your abusive position of trust and authority and the particular cruelty shown to george floyd. Pay the surcharge of 78 from prison wages, you are prohibited to possess firearms the remainer of your life. Across the United States this is a moment of Political Legal and personal significance for so many. We have the reaction here as chauvin learns his fate walking out for the sense of 22. 5 years. The judge explains that he based his decision on many legal factor that includes under state law. The heart ache and pain of the family, the facts and no time public pressure. The technical potential maximum sentences was 40 years. The prosecution asked for 30 which is considered high according to legal precedent. Chauvins defense, well, they stunned many legal observers by making a request that have no legal bases, probation after the guilty verdict. It is tough but important stuff. If you watch the trial, we covered it. This is not easy to watch. Our Justice System when it works, says it is not supposed to be easy. It was part of justice. Part of punishment, the factor for it. Floyds family given those emotional victimsimpact statements. The murder of george floyd traumatized us. Our heartbreaks go beyond far beyond any number of tears we can cry. We seek maximum penalty. We dont want to see no more slaps on the wrists. We have been through that already. My family and i have been given the life sentence. Well never be able to get our george back. Hell never be able to attend giannas wedding or magical moment of her life. If you could say anything to your daddy right now, what would it be . It would be i miss you and i love you. I miss you and i love you. There is not much more anyone can add when you deal with this kind of situation, a preventable and fully avoidable murder, a death, a tragedy. And so those statements come into the record, thats part of the justice today. Everyone in america pays attention and understands the rarity of a case like this of an officer being convicted and sentenced to in a major way for killing one or killing a black america. On chauvins side, the convicted murder, we have not heard from him. We didnt hear from him in the trial or public forums. We now today do hear from him. This is part of the process, too. Again, whether you want to hear from him or not. Thats a personal choice. Legally this is also part of the process because even the defendant or convict has rights. He gave his own statements. You can judge it for yourself. It was cryptic or odd reference. At this time i am not able to give a full statement at this time. Briefly, i want to give my condolences to floyds family. There is going to be some other information in the future that would be of interest and i hope things will give you some peace of mind. Thank you. As a factual matter, it is not entirely clear what information that would be or how it would bring peace of mind. It is always possible there are other information out there. The time to bring forward most exculpatory information, here is what Keith Ellison said after the sentencing. Like the conviction of Derek Chauvin two months ago, todays sentence is not justice but it is another moment of reaccountability of justice. We have special coverage tonight. Much coverage of this important day. Well be joined by neal. He played a legal role as a Special Prosecutor in this case. Neal joins me shortly. We begin with Melissa Marie and mr. Cobb. I want to welcome both of you, professor, i am going to go to you second on the law because jalani, while this is a legal matter and we can get into all of that. I would like to begin the coverage with you, here on the beat, we have been covering these kinds of cases since our show launched. They rarely end like this. Thats right. Anyone watching oh, what do we take from this antidote, it is still as i am shown of before we get to the law. What do you take from this and what context can you give us on this rarity in court today . So, i mean first off, i am not equipped to respond to the statements George Floyds daughter made. The gravity and the scale of what she lost is not apparent to her yet because there are so many years and moments and so many opportunities that she would have had to spend time with her father or moments that wont happen. I dont think any of us can respond what it means. I think that in terms of this case, she was sentenced to 22. 5 years. One of the things people were looking at is whether hell have more time was muhammad noor. He was the only Police Officer held accountable in the midst of this highly questionable suspect, shootings that taken place between minneapolis or twins city area Police Officers and unarmed africanamerican and so there is that dynamic. People saw that he got a decade longer than muhammad north gotten. The other thing about this and i have been saying since the beginning that it took protests in 350 American Cities and dozens of countries around the world, it took the United States to be embarrassed to galvanize enough public sentiment to ensure this will be the outcome. This is as signal of some sort of sea chain, it is rear view mirror stick that the case is so atypical. With the Police Coming down of the prosecution is highly uncommon. It affected Good Cop Bad Cop scenario playing out of the course of the trial. It is so a typical thats hard to see this has a broader significance to what happens in americans jurisprudence. It seems like jelani has the evidence on his side to look at this case where the people are involved. Amaranth, until we see why they are changed . They saw it to argue that Derek Chauvin, they came out on the side by himself ochlt as jelanai suggests, the broader question and protests over the summer was the broader of the policing and a Minority Community as a whole. Whether that question will be surfaced is going to come up in the trial of the three by standing officers. That speaks to the broader question of police culture. Whether you see something you are going to say something. I think thats exactly right. This is more work to be done and this trial made it clear. And jelani. You talked about the daughter, wefr a little bit more about the daughter. It is not easy to watch. The way the system works of certain individuals, many defendants in general in typical context and inmates, but the dehumanization of blackness in our Justice System is a deep thick. Suddenly we start getting information from the state and other things to dehumanized or degrade that person. And so it is actually striking to be me legally that there is a forum for the family to speak. We saw it at the trial that was with the jury and thats round one. Both the state does have a decent rule here that provides us to remember the human being that was lost. So this is just about half a minute and i am going to play it for your reaction from today. What do you miss most about your daddy . We, my daddy used to help me brush my teeth. Aw. Do you miss him help you brush your teeth. If you can say anything to your daughter right now, what would it be . It would be i miss you or i love you. Jelani, it compounds the grief because shes a Spitting Image of her father. We are hearing this staple from this adorable little southern accent and shes talking in an articulate way and it is heart wrenching. It focuses and narrows down the scope of all these things we are talking about. We can talk about Criminal Justice or what happened or toxicology. Shes the fundamental question and issue at the heart of this and what she had lost. Lastly, the idea that what chauvin did, did not represent the bigger truth. The fact that he remained in that department for 19 years. Someone could have intervened and spare this little girl. Melissa, final thought . I think one thing is important to know is that we are seeing the use of victims in a way that benefits minorities and families. There is a lot of politics and in cleed my Racial Justice group from worried overtime that these statements can be used to exacerbate. We are seeing this perhaps the the feedback that hes a black defendant. They are working in tandum. Important day, professor murray and mr. Cobb. Walk us through your view as a participant here. I think you started with melissa and jelani at exactly in the right place. It is rare to have a day like this. It was 13 mopt ago today that george floyd was murdered. The fact that these cases was brought historic. The fact that charges including murder is historic. Officers after officers testified how lounge this was, i think the case and the verdict does send a message today that no one is above the law. It is a welcome change. I dont have to words to describe how important i think this is. I think jelani captured it so well and that humanity and empathy is hoep apart of what we can take as a pro protect as what we need to do as a society. I know you work on this case, i imagine some of those reasons and it is broader than that. I didnt want to get your reacc reacc reaction. We didnt hear from him as a child. Their is what chauvin said briefly. There will be some information in the future thald be of interest and i hope things will give you some peace of mind. Do you have any idea . Yes. I have some speculations and ideas but they are just speculation. When you saw in the proceeding today, we for 30 years and even though shes convicted of Second Degree murder. He gave those statement is, we was sentenced to 22. 5 years. Many are asking, are you happy as prosecute rs. Sentences are never about if someone is happy with it. It is about the flush application of the law. One of the longest that a Police Officers ever received for using deadly force. It is far above the minnesotas sentencing guidelines. What he missed by that, we have to see. Yeah, understood there. I think the final point you made is a legal one. We started with some of the heart of this. As you say, people could debate what they think the outcome could be, thats american dialogue. This is government what it would be. As we discuss with the other experts in tbd, in the way we work in america. Another attorney and jet kelton will be on with rachel at 9 00 p. M. Coming up. This is a rapid escalation. Although we had a lot of clues leading up to this. The report referred to cfo, weisselberg, who we have have been covering. This is in connection with Fringe Benefits. Thats not all. The time and nbc is reporting this. Trumps legal team confirming they did meet with the Da Prosecutor and the trumps lawyers. Trump organization denied any wrongdoing. This does not come out of thin air. There is been signs that we have been reporting on right here on the beat. They were just waiting at the clock. Prosecutors looking at all sorts of ways to squeeze including indicting potentially the entire company. We reported right here on the beat that indicting the entire company is in the das tool box. Prosecutors are scrutinizing and probing the Trump Organization the same way they have mafia organization. You can go further and try to indicts the trump org or indicted staff. Given the policy or all his administration, the Trump Organization even if donald trump himself is not ever indicted. There are another way that prosecutors can indict the entire trump org there you have it. We are showing you the reporting because sometimes what seems familiar been reported out as a legal path. Given all the issues of unprecedented prospect of indicting a former president , this could be a middle ground. What we were telling you about in early june and last week with cy vance and dan alonso, is what about to happen. If they won, well, that could bankrupt the entire Trump Organization. Donald trump is the entire organization. It could bankrupt him in a deeper way. To indict trumps org. There are guidelines. The das office has this internal memo that we told you. It lays out how prosecutors decide whether to indict a whole company. The 11yearold memo was written by the former Chief Assistant Da under cy vance, ed alonso. He joins us on this big day of this big news when we are back in 60 seconds. En we are back in 60 seconds. Upbeat Pop Music in background throughout dont you just love the look on the kids faces. Yea, that look of pure terror. No, no, the smile. And that second right before the first tear comes. What . pizza on a bagelwe can all agree with that. Do you want a hug . While this may sound familiar because we reported it and you were ahead of it there last week. It was an advancement when nbc and the New York Times report that the officer you used to work in had literally told the Trump Organization to expect these charges. It is a major advancement. It is not a debate tonight which suggests bad news for trump. I want to read briefly from the trumps lawyer statement which says, quote, they could not get weisselberg to cooperate and tell them what they wanted to hear so thats why they are Going Forward with these charges. Dan, also a confirmation that they have Going Forward with charges. What does it mean to indict the entire trump org. . I find this credible and the Defense Lawyer confirmed it. It is not change theyre going to indict the entire organization that you alluded to. The Operating Company that paid these Fringe Benefits. Thats not so strange they would do that. It is directed by weisselberg whos under the law. And so these crimes were committed if it was about the Fringe Benefits by weisselberg allegedly and also that would be then on behalf of the organization because the organization would be not withholding the right amount of tax and they would be creating records that are incorrect, at least according to what the da is likely to allege. Based on that, it is not surprising that they would indict one or more trumps corporation. Have you spoken to anyone about this case this year . Other than most general terms in terms of mary you hard they are working . No. General terms, have any relay to you they would look at the theory of indicting the whole company . No, thats something they would look at in any major case. As you mention there are factors and those factors in this case play completely against the Trump Organization that they didnt cooperate or selfreport or etc. So what i am getting at dan, not super strange but consider a heavy weight tactic. As you point out we still have to wait and see what they do because they could go for pardon and subsidiaies and thats how trump gotten out. You dont claim any intel and our reporting here on the beat which was based on you and other Source Materials that we have. You said you can see this happening. I am curious before i bring in tristan to walk us through how you see it happening and how do you square that from the defense of trumps lawyer today look like an over reach which quote on quote of benefits. I dont know how strong it is. What i do know of whats reported by you guys and the time and the others. By the way, not the most severe charge in the world obviously, it is different to charge taxable fringe benefited verses millions of dollars of just not paying taxes or embezzlement or Something Like that. With that said, if you are committing a tax fraud, it is not just the state of new york thats being defrauded, it is the irs. There are created theories that the da could bring into play like false Business Records or false filings. It is a case of some moment. I would not call it the case of the century. I want to caution that because indicting more than one entities, it does not mean the whole Trump Organization is going to go down. Obviously, they can defend it. It is not like a bank. It is not like you are going to lose a license or something. They do have some collateral. You see them surviving depending on how it is structured even in they lost. Tristan, your view and above . We brought the case against the Trump Organization when we did our civil prosecution of trump university. From the civil side, this is something that happens all the time. You are going to hit one of the holding companies. Thats what Trump Organization is, it is a holding company. It holds the individual property in the interests of trumps businesses and so this is not as completely unprecedented thing for the trumps people to say it is overreaches, thats a bunch of hogwash. Let me press you tristan. They cant think of a Court Level Indictment on just benefits. The benefits thing which makes this slightly different than a lot of other cases. The big point that needs to be made here is this is round one. The first inning or whatever Sports Metaphor you want to use, this is just the beginning. This is not the main event, not event close to the main event. Theyll be bringing i believe a surgically driven case here. They know they can win and get indictments on Trump Organization probably on a number of individuals. I think weisselberg is the main target. Tristan, let me press you on that. Some people hearing you say 1st inning would think, really . Donald trumps legal problems are now in the 1st inning . To a lot of people who are following this, there has been a lot of innings of trumps soho investigation by the das office. The mueller investigation, the georgia investigation, thenda and federal courts and sdny. The show is not long enough to get into all the problems. I didnt get into indictments of stone, bannon or manafort. I give you a chance to expand and rebut. I would like to rebut that. It is 1st inning of this phase of going after the Trump Organization and trump and his employees on the taxes. The Tax Fraud Issue and the bank fraud issue. This is the first round of that piece. If we are talking about the whole grand sweep of Different Things that trump gotten himself into. We are in the 344th round. Okay. Sorry, it is not the 1st inning but there are obviously calling someone bluff on this because they have been investigaing much weighter issues. Theyre charging him with whatever they have and thats provable. Thats without prejudice. It is going to be around for at least six months and well cobit continue to hear it. I am supposed to fit in a break. The question that hangs over that is, if they have other things they are holding back or when is it time to call everyones bluffing and putting the cards on the table. Dan and tristan. Give it to us straight, how did you hear the news today q the Trump Organization or part of it could be indicted as soon as next week . I was working on my computer and i had the tv on and i looked up on msnbc of course. I looked up and i saw the headline. Oh my god. Start making phone calls. It is interesting. You guys have had legal scraps when you work there. But, have you ever seen a day like today for Trump Organization. This is not whats going to happen or is it oh another threat . The trumps lawyers are confirming the da told them get ready for charges. Yeah, trump is probably hes completely worked up on this, without a doubt in terms of his liability and possibility of getting indicted himself and having his Companies Going under in ways. Of course the lawyers come back and say barbara, you know how lawyers are. I do. Yeah, it is major and it does sound different than before. Walk us through what this company does next. We have seen all Donald Trumps fight as a president , where he had a lot of people defending him. What does he do now with his back against the wall where hes camped out in florida and talking up another run and etc. Well, they dont know what they are being charged for. None of us know. You think it has to do with the money that he owed or the gifts unreported income. Theyre being prepared the fight that. Theyre going to fight it with some of the things that are legal and theyre going to claim that memos are being thrown out of the bus. Thats a possibility. This is complicated. I love your previous guests and some i have seen on msnbc. It is hard to understand. They are going after alan and i think is a very good way to get to trump. I am surprised that alan has not caved in by now. He must be very, very afraid of donald. I think they were meeting and talking things out one way or another. I think donald has gotten him convinced not to talk right now. Yeah, well, you make great point. You are giving us the facts and knowing these characters and the Washington Post reported on recent times where alan and donald were in the trump Tower Building at the same time. They have what we call, you know, Situational Analysis and as a previous guest said, this is tremendous pressure on weisselberg. The bluff is up. Hes going to be in this process if the reporting is correct, if these charges come next week. Barbara, thank you as always. I am going to fit in a break and turn into another big story.
