It is tuesday, december 10th, im yasmin vossoughian, amin had an important family matter that kept him from making his flight back in time but he is on a red eye, as we speak. And will be back in the anchor chair tomorrow. We begin after weeks of hearings and countless hours of witness testimony, today democrats are expected to announce articles of impeachment against President Trump. Five sources familiar with the discussions telling nbc news democrats will bring two articles against the president , abuse of power, and obstruction of congress. Speaker Nancy Pelosis office announced last week that leaders of the house committees involved in the impeachment probe will hold a News Conference at 9 00 a. M. , this morning, to announce the next steps in the inquiry. Two people familiar with the matter are telling the Washington Post that under the current plan, the Judiciary Committee will vote on the articles on thursday setting up a floor vote for next week. Now to the findings of the Justice Department Inspector Generals report that debunked the conspiracy theories involving the fbi investigation into his 2016 campaign. The president called the investigation a witch hunt but the Inspector Generals Office says no evidence was found that improper bias or improper motivation influenced the bureaus decision. The president claimed the fbi spied on his campaign but the Inspector General found no evidence that the bureau tried to place anybody in the campaign, or treat anyone from the campaign, or try to get someone to report on the campaign. And the president claims the investigation was based on the steele dossier and the fbi officials who opened the investigation did not become aware of Christopher Steeles reporting until weeks later, concluding that it had no role in opening this probe. The Inspector General did take issue though with the way agents and prosecutors went about monitoring then Trump Campaign adviser carter page, whom they felt russia was trying to recruit. The report identified quote at least 17 significant inaccuracies or omissions in fisa Application Force a warrant. The Mueller Investigation has resulted in convictions for six of the president s socials as you can see here including a campaign chair, cochairman, and National Security adviser. And as we expected, the attorney general is disputing the findings of his departments investigation. Bill barr released a statement that reads in part, this, the Inspector Generals report now makes clear that the fbi launched an intrusive investigation of a u. S. President ial campaign on the thinnest of suspicions that, in my view, were insufficient to justify the steps taken. And in a stunning move, john durham, the federal prosecutor, barr handpicked to essentially run a trump approved version of the same investigation, also released a statement, in the midst of the investigation, and an investigation that has not yet wrapped completely unprecedented, he wrote this, and i quote, based on the evidence collected to date, and while our investigation is ongoing, last month we advised the Inspector General that we do not agree with some of the reports conclusions as to predication and how the fbi case was opened. In his first interview since the horowitz report became public, former fbi director jim comey spoke with Msnbcs Nicolle Wallace and argued that after years of smears by the president , the report found nothing. It was all made up. Two years of sitting silently at the fbi while youre lied about, and finally the truth is out. It was lies. There was no treason. There was no conspiracy. There was no tapping of trumps wires. There was no putting informants in the campaign. It was all nonsense. As the Mueller Report was reaching its conclusion, there was a lot of pointing to horowitz on conservative media, which i like to keep an eye on, and he was held up as, you know, dont look at the Mueller Report, the one i really want to see is the horowitz report. If durham doesnt come up with the kinds of conclusions that theyre looking for, what do you think happens next . I dont know. I mean with the horowitz report, theyre not only moving the goal post, theyre moving the stadium and now focus on durham and when that doesnt produce what they want, they will focus on something else. It wont end until he is out of office and he needs to burn the fbi down because the rule of law is the opposite of what he stands for. And he was booked to appear on fox and friends this morning but the network canceled him and comey suggests it is because of the horowitz report. Comeys representatives reached out to appear on the show but he was quote not booked and was never confirmed to appear. And President Trump claims vindication, despite the fact that no political bias by the fbi was uncovered in the Inspector Generals report. The details of the report are far worse than anything i would have even imagined. What they were doing and what they would have done, if i didnt make a certain move, a certain move that was a very important move, because it would have been even worse, if thats possible. And they might have been able to succeed. Trump also attempted to advance his narrative ahead of the upcoming report by prosecutor john durham who as we mentioned was hand picked by attorney general barr to lead a separate investigation into the russia probe. Im looking forward to the Durham Report which is coming out in the not too distant future. Better known information, which is this information, plus, plus, plus. And it is an incredible thing that happened and we are lucky we caught him. I am going to put this down as one of the great achievements. The official white house statement mixed the words saying the American People should be outraged and terrified by this abuse of power. Vice president pence echoed that sentiment saying this what took place here ashould never happen again to any president or any administration in the future and those responsible should be held accountable. Meanwhile republican lawmakers jumped to President Trumps defense, offering out similar information in the d. O. J. Inspector generals report. If that doesnt bother you, you hate trump way too much. That should bother every american. If i were mr. Carter page, i would hire me a lawyer. And i would sue the hell out of the united states. This is a sad day. This is a dangerous set of circumstances. I dont know how anybody can conclude there was no political bias here. This is not a good day for the fbi. Hopefully it is a good day for america, if weve learned from this. Theres more than enough evidence in this report that would suggest a Major Overhaul in terms of policies and procedures. Joining me here on the set, msnbc analyst Danny Cevallos and also with us in washington, nbc news correspondent Julia Ainsley. What do you think of the democrats hitting President Trump with two articles of impeachment, abuse of power and obstruction of congress . Abuse of power is no surprise. It is the lesserincluded offense. The easiest case to make out, it does not require a crime at least in a criminal statute. And all you really need to show is that President Trump abused his official power, with some bad motive. And for, among all of the articles of impeachment, it has to be the easiest to make out. So these two at least are no real surprise. Julia, lets talk about this Inspector General report. Once again, you have a document, a report, that both republicans and democrats are coming to very different conclusions on. Unsurprisingly, as we have with the pluler report, as we had the phone call with president zelensky. What do you think moving forward the republicans will be seizing on within this Inspector General watchdog report and also the same for democrats here . Well, youve seen it already, and you just played it in the soundbite, but republicans are really seizing on the carter page fisa. It is true, there were a number of mistakes made that the Inspector General said they were incomplete, the fisa application, they were given to judges, in order to start surveillance on carter page, and that they relied too heavily on the steel dossier, thats information provided by christopher steel, a former British Intelligence officer that got into what the russians may have had over President Trump in terms of blackmail. A lot of those, a lot of the information in that report was uncorroborated. And he says that the people who are serving out this fisa applications did not press steele on his political affiliations and how he was getting funding from democrats. However, the steele dossier does not prompt the opening of the investigation. That was what Michael Horowitz was asked to look at. What prompted the opening of the investigation was a tip from a foreign government. That government being australia. That was a perfectly legitimate reason to open this investigation. It says they were authorized to do. So so while the carter page fisa, do presents a problem, and the Inspector General even said he wants to have a further review of how the fisa application process works in this country when it comes to surveilling americans, he said the overall decision to open the investigation did rely upon good sourcing and the fbi didnt even have the steele dossier at the time they made that decision, which i think that time line really lays it out. But republicans are going to be seizing on the mistakes made in the dossier, while democrats are looking at the overall conclusion that there was no bias in the decision to open. Danny, what does this mean in the grand scheme of things . How is this going to affect President Trump and this ongoing impeachment probe, especially considering the fact that at 9 00 a. M. , there will this be announcement made about the articles of impeachment . There is something for everyone to complain about in this Inspector Generals report. On the one hand, it debunks the idea there was no political conspiracy to undermine President Trumps 2016 campaign. But, on the other hand, it does detail the serious errors and inaccuracies and omissions, and the reason i cant stress this enough, the reason this is important, as we take a step back, and beyond President Trump, is that this fisa process, a lot of these intelligence processes, with these courts, are highly onesided. Theyre very different than the criminal process in that a search warrant there eventually can be challenged by a defendant in open court. Thats not the case here with a lot of these courts like the fisa court. And because it is so onesided and because an investigation may never become public, the fact that there are this many inaccuracies and errors in the course of an investigation does warrant review, because this is something that our citizens completely entrust to people and to a process that were never a part of. So it is important. Do you think that a report like this could actually change the system, especially when it comes to these fisa applications, considering what came out of this Inspector General report . Yes, but it is a balancing test. There is a reason for the secrecy, because these are such sensitive matters of National Security, and arguably interNational Security, because fisa courts deal with investigations home and abroad, so it is going to be a really difficult balancing test, because we as americans dont want inaccuracies in any warrant applications of any kind. Julia, is this report definitive, or does it beg more questions than it answers . I think it actually did answer a lot more questions than i was expecting. We now have the answer to the way this process worked. We know how the fbi communicated with the Justice Department in the early days of this investigation. What, the questions that are still unanswered is what john durham will do next. He is of course the u. S. Attorney that barr has to look into, this exact same question, that it has become a criminal probe, which means there is something he has uncovered that he thinks could potentially come down to a criminal prosecution. As we saw from that statement yesterday. John durham and the attorney general disagreed with the conclusions of this report. And they think that decision to open the investigation was not authorized. So those are the questions that i still have. And i feel as if that statement from john durham which was so completely unprecedented, was in fact, made to delegitimize this Inspector General report, and legitimize the report that durham is pursuing. It is. It was so shocking. I mean the reporters in the pressroom were all scratching their heads when that came out because the only time you would see a prosecutor come out and show his cards in terms of what he has in an Ongoing Investigation is if there is an interest of National Security, theres a real threat, and it needs to be addressed, and so they would go out and tell you some information they have. But for him to be drawing a conclusion on what does not appear to be a National Security matter at this point in the investigation was shocking. Danny cevallos, julia, thank you to you both. President trumps personal attorney Rudy Giuliani said yesterday that he expects to complete a report detailing his findings from his recent trip to ukraine by the end of this week. Watch this. I was going to do an outline of it and try to present it at the convenience of the republicans in congress, and the attorney general at the end of this week. I should probably have it ready on wednesday or thursday. I dont know exactly when it will be made public. But it should be ready by then. So according to the hill, during giulianis visit to kyiv and budapest last week he spent several days interviewing current and former ukrainian officials in an attempt to gather damaging information about trumps political rivals including former Vice President joe biden. The hill also notes that giuliani met with a former ukrainian diplomat. He spread the unsubstantiated theory that ukraine meddled in the 2016 election. And fbi director chris wray told news that there is no evidence that conspiracy theory, that ukraine, not russia, interfered in the 2016 election. Did the government of ukraine directly interfere in the 2016 election on the scale that the russian dis . We have no information that indicates the ukraine interfered with the 2016 president ial election. So wray went on it say that russia presents the most significant threat in regards to the upcoming 2020 election. His comments come a day after senator ted cruz told nbc news that he believed ukraine meddled in the election. Do you believe ukraine meddled in the American Election in 2016 . I do. And i think theres considerable evidence. You do . You do . Let me point out again, that the immediate is playing, a question you have asked a number of people you have said to the senator sort of aghast do you believe that ukraine and not russia interfered in the election. Look, on the evidence, russia clearly interfered in our election. But here is the game the media is playing, because russia interfered, the media pretends nobody else did. Ukraine blatantly interfered in our election. By the way, there is no evidence to suggest the fact that ukraine interfered in our 2016 election. Lets take a turn now, and get a check on your weather. President trump is expected to meet with Russian Foreign minister Sergei Lavrov at the white house today as there is an investigation into withholding military aid to ukraine. Secretary of state mike pompeo is also expected to attend the meeting to quote discuss the state of the bilateral relationship. Lavrov first met with trump back in 2017, a day after the president had fired former fbi director jim comey who was leading the investigation into possible collusion between Trumps Campaign associates, and russian officials. Today marks another historic day in washington. Want to set the scene for you. At 9 00 a. M. , House Democrats expected to hold a News Conference, to announce articles of impeachment, against the president of the united states. Five sources familiar with the discussion telling nbc news democrats will bring two charges. Abuse of power. And obstruction of congress. Two people familiar with the matter telling the Washington Post, that under the current plan, the Judiciary Committee would vote on articles on thursday. Setting up a floor vote for next week. As the New York Times points out, we got a hint of the charges democrats might avoid during yesterdays house Judiciary Committee hearing, democrats did not use the term rivalry. And they did not discuss potential obstruction of justice in the mueller probe. All of this comes as washington continues to digest the 434page i. G. Report that found the fbi was justified in opening the 2016 trump russia investigation. One more thing for you. The president meets with russias foreign minister at the white house today. Sergei lavrov. We will be watching that as well. It is going to be a major day ahead. Back with me on the set msnbc legal analyst Danny Cevallos. Yesterdays hearing before the Judiciary Committee was a bit of a Closing Argument for both sides. Give me your major takeaways so far from what you heard. Major takeaways are summarizing what we heard from actual fact witnesses. And the democrats position is that President Trump twice requested, two different investigations, from the ukrainian president , and the republicans charge is essentially that, what we heard before, that this is hearsay, there is no proof here of a quid pro quo, there is no proof of a request, a law of the evidence here is insufficient to warrant impeachment articles. And thats really what we have been hearing from both sides. I want to take a listen to some of what we heard yesterday and have you weigh in. Who sent Rudy Giuliani to ukraine to smear joe biden . President trump. Who fired the anticorruption ambassador in ukraine, Marie Yovanovitch . President trump. Who told ambassador sondland and ambassador volker to work with Rudy Giuliani on ukraine . President trump. Who told Vice President pence to not go to president zelenskys inauguration . President trump. Who ordered his own chief of staff, mick mulvaney, to withhold Critical Military assistance for ukraine . President trump. Who asked president zelensky for a favor . President trump. Who personally asked president zelensky to investigate his political rival joe biden. President trump. So as it relates to President Trump is, he an incidental party or a central player in this scheme. President trump is the central player in this scheme. I insist on my, unless you are willing to immediately schedule a minority hearing date. That is not a proper point of order in todays hearing. That is not a proper point of order in todays hearing. The obligation. Not the consideration. You are obligated the gentleman will you are obligated not to schedule, you made your ruling, it is the order to appeal. The gentleman will suspend. I have a parliamentary inquiry. I will not recognize a parliamentary inquiry at this time. Is this when we just hear staff ask question of other staff and the members get dealt out of this whole hearing . The gentleman for the next four hours, to try to overturn the results of an election. The gentleman will suss sepe the gentleman is not recognized. Basically, you had the president being the central player in the scheme and then you had the republicans trying to stomp down that hearing at any moment that they could. And trying to drive this home that this is about overturning the 2016 election. From both sides, how strong are these arguments . Representative swalwells line of questioning to counsel Daniel Goldman was the most effective moment of the day. You had him staccato rapid fire responding that President Trump was the answer to all of these questions, and he was the central figure. And of course, then many points of order, and parliamentary inquiries, really flushed out a larger argument for the republicans, which was that the process here, they say, has been unfair. We havent had enough time. We havent had any procedural protections. It really is sort of a story of were not going to argue the substance as much but the procedure, very much like in a criminal case, when the procedure is unfair, that can taint the entire prosecution itself. Danny cevallos, appreciate it my friend. I want to dig now deeper into the report among the key findings that the investigation into russia and the Trump Campaign was not politically motivated. Back with us from washington, nbc news correspondent Julia Ainsley. Julia, take us through what stood out to you first and foremost in the report . I think what stood out to me is that top line, that there was no evidence, either to the testimony or through documents that the Inspector General found of political bias. Now, he did though say, and this is the other takeaway, that there are some significant problems in the fisa process. He said that they were inaccurate, incomplete and unsupported, the fisa warrants applications that the fbi turned over to the judge. And now, the Inspector General has launched a new investigation, into the fisa process. If you can remember back, were thinking a number of debates weve had, this country, over fisa and how our country should, how american citizens should be surveilled by their own government. The fisa process always comes to the top. It is something Edward Snowden talked a lot about. This is something that has long been an issue, and it is coming up again, it is rearing its head again. And i thought that was really interesting, the way that stood out. Unfortunately the debate we are having is not over the fisa process. It is still over the political bias because republicans are seizing on that. And then the Inspector General said that while he ruled out political bias, as a motivation for opening the investigation, he still isnt satisfied with the answers for why those mistakes were made on the fisa application process. He doesnt say that he has evidence of bias, but he wants, he wanted more answers than he was supplied. Julia, with such perspective as to what, differing perspectives as to what this i. G. Report came to conclude, is there a worry, amidst the fbi, and the Justice Department, that americans can no longer trust those institutions . I think we have to pull apart the fbi and the Justice Department right now, which is unusual, because usually we talk about them in the same vein, but the way we saw both of those institutions respond yesterday were very different. So the fbi director is saying, you know what, were going to do a review, we will look at everyone involved in this fisa application, we will review to see if there was any misconduct and look at our own policies and the Justice Department, the attorney general william barr, basically accuses the Inspector General of not being hard enough on his own institution. Thats not the way you would normally see the head of an agency respond to an Inspector General report. So were seeing a schism there and i think it is one that we will continue to see play out. Officials quote failed to tell the truth about the war in afghanistan throughout the 18year campaign, making rose ny pronouncements they knew to be false and hiding unmistakable evidence the war had become unwinnable. Documents dubbed the afghanistan papers include 2,000 pages of previously unpublished notes of interviews of those who played a direct role in the war and obtained by the Washington Post and a project examining the failure of the longest Armed Conflict in u. S. History. And it is a threeyear freedom of information act battle. Nbc news has not been able to independently verify these findings as of yet. The post reports though that the vast delays interview quote underscore how george w. Bush and barack obama and donald trump and the military commanders have been unable to deliver on their promises to prevail in afghanistan. The u. S. Officials acknowledge that the war fighting strategies were fatally flawed and washington wasted enormous sums of money trying to remake afghanistan into a modern nation. Upon release of the papers, a Defense Department spokesperson told nbc news, quote, this, there has been no intent by the department of defense to Mislead Congress or the public. Defense Department Officials have consistently briefed the progress and challenges associated with our efforts in afghanistan, and the department provides regular reports to congress that highlight these challenges. Since 2001, more than 775,000 u. S. Troops have been deployed to afghanistan, and of those, 2300 people have died there. And over 20,000 were wounded in action. Amazon claims that it lost a bid with a ten billion dollars contract with the pentagon because of the president s personal gripes with jeff bezos. What more can you tell us about this . Amazon have filed a legal complaint saying the reason they lost that 10 billion Cloud Computing contract with the pentagon is because of personal reasons and because President Trump has personally interfered in the process. They quote improper pressure to divert the project away from amazon to microsoft. Theyre claiming that pentagon were using outdated submissions and overlooked some key areas of technical expertise. Now, before the contract was awarded to microsoft, amazon were the front runner to secure this contract also nope known a jedi contract. The president has been vocal about jeff bezos, not least because hes the owner of the Washington Post and President Trump has said that particular News Organization has helped propagate fake news. So thats a story thats ongoing. But there may be good signs on the trade front. The president says negotiations for a new north american trade deal are going well and that we could potentially see a deal as soon as today being signed. This comes after months of deadlock between the u. S. , canada, mexico and House Democrats to revise that trade agreement. And of course here im referring to the nafta that was put in place in 1994, a deal which the president has called one of the worst trade deals ever made in history. Its one of his Top Priorities to have it revised. It looks like theres some optimism in site and ght. M. , National Political reporter for axios, jonathan swan. Jonathan, good morning to you. Good morning. Talk to me about axios one big thing today. Well, when impeachment and all the rest of these scandals in washington are dominating news coverage, we lose sight sometimes of the really big dramatic, worldchanging developments that are happening in the Trump Administration. And today is a perfect example of that. Something far more important and potentially long lasting than anything that happens with impeachment this week. So, today the World Trade Organization, a very key part of it, which is the appeals body where nations go to resolve their trade disputes, it will essentially cease to function. And that is because of the actions of the Trump Administration. They have allowed these judges terms to expire because theyre fed up with the way that the World Trade Organization is functioning. They dont believe that theyre pushing back enough on china. And so today two more judges terms expire. There will be one judge left on that appeals body which means that they cant actually resolve or rule on any of these disputes. Why does this matter . It matters because this is 25 years of the World Trade Organization formed in 1995 to create a system governing global trade to resolve these disputes. And the Trump Administration has essentially ended that era or ended the era as we have known it. And theyve done very deliberately. Theyve got very deep grievances with the way the wto has functioned. But had is one of the sort of haul marks of what President Trump calls america first. So many different narratives coming out today as the next 12 hours or so develop. Lets also talk about this, jonathan. Former Vice President joe biden as you remember capitalized on the video of World Leaders mocking, basically, President Trump at the nato sum submit with a Digital Campaign ad claiming the world is laughing at the president. What is axios reporting now about that . So my colleague, Alexi Mccammond reports that that ad did extremely well on social media getting somewhere near 12 million views across different platforms. So the Biden Campaign has decided to put it on television. Theyre throwing it as part of a 4 million ad buy heading into the iowa caucuses. Look, biden is really trying to emphasize Foreign Policy and judgment and leadership of his campaign and this ad fits right into it. Its not just the g7, it splices together footage of World Leaders, largely the europeans mocking President Trump. And as we head into 2020, political advertising going to be ramped up to say the least. What else is axios reporting about advertising by these 2020 candidates . So my colleague sara fisher reports President Trump and Pete Buttigieg, actually, spending reasonably significant amounts for the platform on snapchat about the same amount. The facebook spending dwarves it, but thats a channel that were sealing now. Buttigieg in particular to engage College Students and very colorful advertising. But the Trump Campaign, look, i covered President Trump for 4 1 2 years now. People have consistently underestimated their ability to use social media and their digital platform. They have not stopped spending money since the 2016 campaign and its only when you spend money at that scale on platforms like facebook that you actually master the ability to manipulate consumer behavior.
