Thank you both so much. The National Reckoning over Racial Injustice and Police Misconduct has reverberated through society, and sharpened demands for criminal justice reforms nationally and locally. This week, the santa clara District Attorney, jeff rosen, announced he would no longer seek the Death Penalty. He also announced the creation of a new board for Greater Public oversight into Police Misconduct. Ud but some, inclg Santa Clara County public defender, molly oneill, argued more needs to be done to change the culture of policing. Last month, a blog post dion revealed racist and anti muslim posts, made by current joand former san Police Officers on facebook. Joining me now by skype from san jose are Santa Clara County District Attorney, heff rosen, o, jeff. And molly oneal. Just, as recently as a year ago, you publicly supported the Death Penalty, what led you to f this change policy and change of heart . My thinking about the Death Penalty has evolved, some things that were very impactful, visited the equal justice initiatives Legacy Museum in montgomery, alabama, very recently with the church group and a synagogue group, and also the national lynching memorial, and was incredibly moved by those experiences and what i learned about the history and legacy of slavery, reconstruction, jim crow and mass incarceration, and then th last several months, all of the attention and focus on Law Enforcement in our society and the righteous calls of protest, i was very moved by, really devastated by, the murder of george floyd, and i had a visceral reaction when i saw that. And the reaction i d was, i am not seeking the Death Penalty anymore, i dont think or society has the moral hority Authority Given the systemic racism that is asin every ct of our society, which is reflected in our criminal Justice System. So, i said, i am not seeking the Death Penalty anymore. Molly, you support this change, can you tell us why yo think itis so important . It is huge, i really applaud our District Attorney for making this move, the Death Penalty has always been a racist killing machine, it has been applied disproportionately always and it has been a meslow mo in the country to abolish it and this is a good step in that direction. Jeff, you also announced other criminal justice reforms this week, could you take us through one or two ghlights . I think a big one is, when we file criminal charges, we are going to ask ourselves, what shou we prove, not what can we prove, and those are two very different things, so, we are going to look at our charging decisions, what sentenchng enhancements to ge or not charge, the lens of race in equity and ask what charge, an another t wh can significant reform that is really on the other end of the spectrum in terms of not going to charge driving on a suspended license for failure to pay fines and fees as a misdemeanor, we are going to charge that as an infraction, that is 4000 ses a yearbut is about 10 of the cases we prosecute, this is a way of keeping people out of the criminal Justice System and not building up a criminal record, it is a way of not penalizing poor people who get these offenses. I know youre also not bgoi going after standalone charges for resisting arrest, molly, will any of these refos make a significant differ ce in how yooffice conducts business . I applaud all of the reforms and partilarly the standalone one, we have spent decades g dealth cases where our clients tell us they were pulled over for no apparent reason, they were stopped thin r own neighborhood, they were africanamerican, they live in palo al, so thatis a really important move, as i understand, there are roughly 450 to 500 cases like that a at year, will, that will move a huge fight around those cases, that is a very big deal, the other reform announced that i really applaud is dethe sion not to attach gang enhancements to enhancements are almost always attached to cases of communities of color, andso, at is a big deal, i would li to see further discussion and we are engaged in that e discussion with strict Attorneys Office about the use of gang enhancements. Big news. Jeff, the san jose Police Officers association is strongly critical of thes m refosures, how do you respond to their assertions that these changes will make it harder for officers to do their job . I have been a prosecutor for 25 years, i have worked closely with Police Officers and for all of my professional life, i have great respecand admiration for the work that Police Officers do, and think that in, our counthe vast majority of Police Officers we t,have are excellen but there is no organization that is perfect, and i view the reforms i am putting forward, specifically as they relate to police oversight, as a way of helping polidepartments weed out bad ficers and help the good officers in those officers who become guardians and protectors of mmour ity, i view the reforms i am making as a way ofincreasing trus between the community and Law Enforcement, which is ultimately what will make all of us, including Police Officers, favor. Some of that trust was broken recently with the news about racist comments that were made by sosan jose Police Officers on facebook, four officers have been placed on leave following the discovery of discriminatory statements against muslims and lack lives matter that were ma in this group, molly, do you think this is a case of a few bad apples, or do you thinracism runs widely through the San Jose Police department . I think there are plenty of good men and women who serve as Police Officers in communitieca all across fornia, i do not think this was an isolated incident, we had, not only active office, activeduty officers, but retired officers are participating in these posts which included comments about lack lives dont really matter d pulling her jobs over Muslim Womens ces, i dont believe that is isolated, i think part of the deep rooted sue is that there is a code of silence, e if you a good cop and you know bad cops are maki racist comments, you are pretty much silenced, that is the culture i believe really has to change, must change, and we are at that point in time where there is momeum to not just make small changes, to the criminal Justice System, but make huge once. That is a fundamentapart of that. Yet, you havent joined this call nationally that we have heard to defund the police, why no i wouldnt sai amnot in the Defund Police camp, i would say i dont like the language, because people, different people use the language to be, until wehave a clear meaning of what we are talking about, i think it is, it is used too widely, what i would say is i very much infavor of repurchasing some of the funding that currently goes to the police and putting it to better use, for example, the money that pays for internal affairs, i think that money should be repurposed, money that pays for officers campus, i think officers on campus dont make the process safer, i think that money re should be rposed, also money that is used for Mental Health response is it best use of that way, my thinkiis we really should take a good hard look at how taxpayer dollars are used to fund the police and repurpose. In foaddition to s like juan soto who might get fixed, there are other Baseball Players who have opted out of playing like buster posey, how much of an impact will the absence of some of these big names have on the game and al on fansand morale . Reporter i think for fans, they will be missing something, fans are different right now y than thave ever been, stands right now are just glad and that iswelcome distractio there, you were looking at a pretty low bar in terms of gathering fan interestteand aining people and whatnot. I think there is something emotional that is certainly lost, i dont know if fans are going to look at this season as a real season, whoever wins the ampionship, is that real champion . I am curious about the changes that have been made, like the cardard cutouts, the crowd sounds being played, ball hit into the stands and there is no one there to catch it, it going to roll and roll, the changes like the cardboard , cutouts and soune those being made for the players to feel more like it usually is e are thbeing made for the tv audiences .
