His campaign challenged the vote count in pennsylvania and asked the u. S. Supreme court to get involved. This is absolute fraud. Weve seen it in philadelphia before. Theyre trying to make a mockery of the election of this country. Reporter the Trump Campaign also filed a lawsuit over the vote count in michigan. And with the biden camp demanding all votes be counted and the trump camp seeking to stop the vote count, it seems all but certain the next battleground in this election will be a courtroom. Heres a live look at a prayer vigil just getting underway in san jose. This is one of several rallies happening right now pushing to count every vote. Youre going to hear that line a lot, count every vote. Silicone valley faith leaders are hosting this event. They planned this to include both republicans, democrats anda independents. Theyre taking a stand for a peaceful transition no matter who wins. We demand and call that all legitimate votes be counted. We support the democratic process. We condemn any form of tyranny. We need to stand up and say that our votes must be counted, that our votes must be strong and that its integrity must be maintained. Count them all and call out disinformation on social media. Another protest, this one held at facebook headquarters in menlo park. Facebook users and activists are demanding the social media giant prevent candidates from spreading lies about the Election Results on their platforms. And a similar rally held in San Franciscos japan town, protesters there Holding Signs outside Unitarian Universalist church. Theres an effort stated publicly by the president , regime in power, to abort the counting if its not going their way and to try to utilize the courts to somehow win a victory that they dont actually win. Were concerned about that, and thats why were here. And similar rallies underway in other big cities, including new york, liz . Voters from both sides of the aisle are feeling optimistic about the results. I know today can be a volatile day. I know theres probably 50 of the people that are happy and 50 of the people that are unhappy, although its yet to be decided, so im feeling optimistic. There are aspects i know im pessimistic about, but optimistic. Oh, i think the republicans are grasping at straws. Theyre talking about recounts. Those hardly ever work. I hope the republicans keep the senate because thatll keep the people from going off the rails. I spoke with election law expert Bertrall Ross about the president s Legal Options going forward, many people are asking is a court battle the president s only option at this point . Right now there are still votes to be counted in nevada, arizona has only been called by some networks. Theres a possibility there. I think he has to win one of those two states. Those states are looking unlikely based on the outstanding ballots, so hes going to court, and hes bringing claims about the ballot count that are designed to slow the ballot count and to hopefully get him over the finish line in those two states in particular. Well, we saw what happened certainly in 2000, bush v. Gore. Could the court stop the counting this time . I think its unlikely, based on the complaints brought by the Trump Campaign, it seems they arent particularly strong. The claims being brought in states like pennsylvania and michigan are about transparency and the ballot count. The claim is that Trump Campaign officials have not been able to observe the ballot count. Theres no factual allegations to support these claims. I think its unlikely to serve as a basis for the court do stop the count. The one piece of litigation in pennsylvania, which is about ballots that were received in pennsylvania by the pennsylvania election board on the day after the election and through friday. And the president has promised that this is going to ultimately end up at the Supreme Court, but wondering how the makeup of the court, you know, his recent appointees are likely to affect the outcome. The appointment of Amy Coney Barrett to the Supreme Court now has put the court makes the court and the composition of the court more favorable, in many eyes, to President Trump. I think there are very few claim that is can ultimately lead the court to overturn this election from biden to trump if it comes to that, but there is a possibility out there, especially if pennsylvania becomes pivotal and if that becomes the case and the Supreme Court that seems to be more favorably disposed to President Donald Trump might be in a position to hand him the election. I hope it doesnt come to that, but its a possibility. Well let the process play out. Bertrall ross, thank you so much for your time. In santa clara and san mateo counties, registrars are working double time to get every ballot counted with an unprecedented number of mailin ballots turned in this year. Kpix 5s Wilson Walker is live in San Francisco where Election Officials say inperson voting on election day was at a record low, wilson . Reporter yeah, the its a complicated melong that makes up the votes. Im here at the voting station where theyre breaking down. I remarked yesterday as to how few people were here. That turns out to be a trend around the bay area, and in some cases, that might prevent your county from breaking a record. On election day we had a 6 turnout of inperson voting at the polling places, which we just did not expect that. I mean, i thought a low number would be 15 . Reporter whether it was Civic Center Plaza or your neighbors garage, very few people in San Francisco voted in person this year. Mail inballots, however, will be enough to push the city to about 85 turnout. That is within a whisker of the record. Yeah, yeah. So 86 is the most recent high turnout for an election. That was in 1956 and 1960. Well, our exuberance about recordsetting turnout may have been a little bit over the top. Reporter Contra Costa County is a similar story with a different result. There was a flood of early voting. Here they were largely dropoff ballots. Extra precaution, yes. Reporter but that wave of voting trailed off in the final days. Yeah, things didnt move much after monday, starting on monday. You know, after the weekend the numbers really didnt move. Reporter thats something a lot of counties saw. For example, only 45,000 people in Alameda County voted in person, a fraction of the nearly 1 million registered voters there. Alameda does not yet have an estimated final turnout, but in contra costa, the late fizzle was enough to dash any hopes of a record. So we were at 79 in 2016, and were going to land just about on that same number. Reporter all right, they were hoping to get into the mid or upper 80s in Contra Costa County. Theyre well short of that. So who is in the upper 80s . Marin county, 87 . Your record would be 89 , and thats a situation we are seeing in some counties, theyre pulling close to that record but not necessarily going to, you know, go blowing past it. Think back to two or three weeks ago, a lot of counties thought they might crush records. But the tailing off of that big surge of voters in the last sort of couple days, maybe even the last week of the campaign, that is going to pull things back from a whole bunch of records falling. Were just not going to see that. Now, what have we learned from this incredible election of 2020 . That mean that is rideshare drivers remain classified as independent contractors and not company employees. Reporter prop 22 was a grand deal, uber, lyft, doordash got to keep drivers as independent contractors and did not have to give them the full benefits of an employee. The voters agreed with uber and lyft and passed prop 22. Disappointment today among some rideshare drivers over the passage of proposition 22. I feel completely like people were bamboozled. Reporter the prop, which lets rideshare and Delivery Companies treat their workers as independent contractors rather than fulltime employees, was the most expensive in california history. Uber, lyft and doordash spent more than 205 million to win the approval of voters. Its actually incredible how much money was spent on this campaign. And it worked. Reporter drivers told kpix that voters were fed lies about the law. I feel like it was made with a lot of lies and people did not really understand on top of not a lot of people knowing that mostly the driver that is are out there are drivers who are doing it full time. The people who do it as just gig work are not those drivers who are putting in all the work and effort. Uber and lyft, they call us independent contractors, and they still control everything we do except when we sign on and off the app. You know, where you drive. You cant reject too many rides. The wage, what kind of independent contractor cant get better at their job and earn more money . Reporter labor rides experts say the proposition sets a terrible precedent for the future. This wont have a broad effect on freelancers, but what it does do is drive down standards because now as these companies expand and thats part of their business model, potentially we will see more and more workers enter the gig work force and be working for subminimum wage. Not having any benefits or health care. Thats going to lower standards for all of us. I got a feeling that this aint over, as they say. Legal challenges, have you heard about any to come . Well, allen, at this point, its california, its a proposition, absolutely there are going to be legal challenges. It seems the Labor Coalition is going to take on the seven eighths clause inside that proposition saying that is unconstitutional to require that high of a margin to overturn something under the california constitution. But this is a twoway street. Uber and lyft had already stockpiled money and lawyer for their own protracked legal battle if, in fact, prop 22 did not pass. The 49ers did not have any tests, but within the last hour, two were placed on the covid list, meaning they cant play tomorrow night. The packers are dealing with a similar situation after their rookie running back a. J. Dillon tested positive on monday. They had two additional players ruled out. The rest of the packers are scheduled to arrive in the bay area tonight. So al and liz, the 49ers without debow samuel, brandon, george kittle, their top three receivers wont play tomorrow night. The packers are bringing all those linebackers up to the line of scrimmage to try and stop the run and dpar the 49ers to pass. Its 2020, what do you expect . Well, Contra Costa County is hitting the brakes on reopening. Its in response to an increase in covid19 cases and hospitalizations. Under the latest health order from the county, outdoor bars are now banned. Indoor dining and movie theaters are only allowed at 25 occupancy. No more than 100 people. The same goes for religious services and card rooms can no longer operate indoors. The county is recording a rate of 4. 9 cases per 100,000 people, and as of monday, 40 people were hospitalized due to covid compared to 17 in midoctober. All right, well, you know what, the niners are going to look different tomorrow, but the weathers going to be the same. Right, until friday morning. Ah, then the change. The big change is going to happen just after the game wraps up thursday evening. That cold front comes in friday morning. Big changes in store for us. But one more warm day on the way tomorrow. Temperatures will start off mostly in the low 50s. Warm up to 70s and 80s inland. 60s and 70s by the water. Then breezy and much cooler on friday. And as a bonus, a chance of some light rain showers of well check out those day by day chances of rain in just a second. Its still going to be cool this weekend. A few more showers possible. Looks like sunday is the best chance for additional rainfall. Were not talking about a lot, but a decent chance of a passing shower on friday and then a 30 chance on saturday. None of these days are a washout and that 50 chance doesnt mean its going to rain for half the day across the entire bay area. It means that if you just pick any one spot on the map theres a 50 50 chance its going to rain at some point during the day on friday. In terms of how much, lets add it up. The forecast models indicating anywhere from hardly anything for portion of the north bay to almost a quarter inch of precipitation, rainfall, along the coast. And a little bit more in the higher terrain of the Santa Cruz Mountains and the diablo range as well. Well take what we can get. And thats just through saturday. Maybe more on top of that on sunday. The first winter storm watch for the high sierra. Above 5,000 feet, expected snow is in the 3 to 8 inch range. Up to a foot locally. Treacherous travel conditions are going to be possible there. We add it up with the forecast models, theyre not quite as impressed with the total amounts, at least in the populated areas, about 3 to 6 inches of total snowfall, which seems reasonable for the first chance of the season. Beautiful sunset in progress. That fog trying to creep a little bit closer. Its not going to be a major factor as we head through early tomorrow morning. Its nice right now. Temperatures in the 60s and 70s. Anywhere from 64 in the city to 76 degrees in concord. Futurecast, again, does not produce nearly as fog as the past couple of days, and it should dissipate quickly on obstructive visibility by late tomorrow morning. Temperatures will start off in the 40s and 50s. Most of us in the low to mid50s early tomorrow morning. Just a tiny bit above average for early november. The cooler spots dip into the mid to upper 40s. One more day of above average temperatures, highs in the upper 60s and low to mid70s. Farther inland, 70s and 80s. Upper 70s for the santa clara valley. A mix of 70s and 80s for the north bay. And then mostly in the 80s farther inland in the east bay. Temperatures drop off significantly for everybody beginning on friday and then that cooler air sticks around as we head through the weekend and into the first half of next week. Yes for less a night of violence in oakland a confrontation with police and suspects ended with an officer involved shooting. Around 10 00 last night, officers were investigating a report of a robbery at a marijuana grow on 92nd avenue. When they tried to detain the suspects, Authorities Say there was a violent confrontation. Multiple officers were injured and an officer opened fire. Its not clear if anyone was hit or if there were any arrests. In a second incident involving a marijuana business, two security guards were shot during an attempted robbery. It happened just after 11 00 last night on baldwin street. No word on their conditions and so far no arrests have been made in that incident. Oakland police also responded to a triple shooting just before midnight. A witness claims he heard at least 10 to 15 gunshots and found multiple shell casings on the ground. And in fruitvale, witnesses say nearly a dozen cars pulled up to a mall to loot a starbucks shortly after a car smashed into a nearby dispensary where several items were taken. Caltrans worker was hit by a car in San Francisco now has severe injuries. Chp telling us the crash happened southbound 280 near the mariposa street onramp just before 10 00 a. M. Two lanes were closed as a result, no word on what led up to that crash. And a garage fire forced six people out of their homes in San Franciscos valley overnight. Citizen app video shows the flames going across the roof of a house and smoke billowing from a second home. The fire was contained within a couple of hours, and one firefighter was injured but is expected to be okay.
