Is he sharing anything about the plan of attack against the indictment, why they are trying to slow things down . Yes. Weve got three different legal theories. I say they are different, i dont know if he can use them on the courtroom. On the one hand, he claims it is a First Amendment case, although it is pretty clear, without the title in charge, i dont see it its hard to believe that the First Amendment defensively works in the courtroom. And that is more political defense and political spin. He floated the idea of well, he was only acting on the sound legal advice he got from his, he called john eastman, one of the coconspirators, and esteemed legal scholar. So, one of the defenses maybe he got bad advice from lawyers. Now, he would have to take the stand for that, which is something i pointed out to him and john lauro indicated he didnt think he had to put mr. Trump on the thing to do that, which tells you he doesnt want to put to trump on the stand. The third thing is this idea, well, thats happened while trump was president was long standing Justice Department policy that you cant be charged with a crime based on actions you took as president. The question is whether it actually took, as the head of the executive branch or was it done as an individual to remain head of the executive branch is going to be there. I think the idea is lets see if this sticks, lets see if this sticks. And he also floated the idea of relitigating the 2020 election. I dont think all of those legal defenses will be used once they end up in court. Oh my goodness. That is a lot of spaghetti to throw at the wall and see what sticks. We will see what happens, looking forward to watching that interview, chuck, thank you so much for joining us this morning and given us that insight. While there are no magic numbers, a doctor we talked to recommends teenagers get mad at half hours of sleep while younger kids that as much as 11. To get more stories like this, join us for today in the bay monday to friday mornings from 5 00 to 7 00 a. M. And 7 00 a. M. On my favorite streaming platform. Im laura garcia, back to you, kira. Former President Donald Trump was indicted for the third time in the past four months. The latest charges, as we discussed, focus on trumps actions leading up to the january 6, 2021 insurrection but they include fraud in the united states, obstructing the congressional effort to confirm the Election Results and depriving people of the right for their vote to count. Political analyst eric gersten is here. Good morning, great to see you as always. Is this latest indictment more of the same or something totally different . I know he has different attorneys covering each case as well. I wonder if there are any attorneys left. It is different. If you think about this, we are talking about overturning the government, really leaving out or echoing our right to vote. These are pretty heavy, this is what democracy is about. This is what makes this country so different from other countries. The fact is, we do have a say over who runs our government and we can replace it. It is different. It is a lot. I want to talk about your belief. Do you believe that this new indictment might resonate with voters differently from what weve already seen . I understanding he said something along the lines of everything he gets indicted, his poll numbers go up or Something Like that. That has been true historically. Lets take a step back for a second, kira think about these three different indictments, what they might mean to people wanting to think about it not as seriously as we might all along. First time around, what is it . Misuse of Government Funds to pay off a star. Interesting but so what . Second time, the sun it boxes with documents withheld from the government. Maybe there was something wrong there but whatever. Third time, think about those visuals. Assaulting the capitol. Thousands of people there. People hurt, people killed, people darting friend in the nation. You dont think that those pictures right there are going to have a big impact on people . A lot of people who watch this think it will. That could be a big factor. A lot of people thinking the payments was a personal thing to the documents by the toilet seemed distance from all of us. This seems to impact us closely. What do you think it is doing two republicans . We talked about how trumps power goes up. Maybe not so much anymore. This could be the time to we look at a couple of polls. The first poking before the third indictment. Republicans know, how do you think about the president s behavior in 2020 and leading up to the insurrection . Lo at that, 71 . The publ said it doesnt matter, he was okay. Only 21 said he was threating democracy. That was before the third indictment. Fastforward couple, three weeks to a poll taken after the indictment. We are going to Say Something radically different. In this poll, we are going to see close to have paid half of the bl saving we dont really think we are going to vote for him if he convicted of a felony. Look at that data. We are t going to vote if hes convted of a felony. These are republicans, that same who said weeks before he hasnt done anything wrong. Thats what you have to worry about. Thats what you have to think about. Republicans looking at those pictures, the same way we looked at those pictures. Some of this might make a difference to me. To be able to be that interested in voting for him now. That could be dramatic. We will have to see. Polls change all the time. For now, this may be a tipping point. Perhaps as people learn more they make more informed decisions. Remains to be seen. As always, larry, thanks for your insight this morning to it is 7 52. Up next, a quick look at the to welcome back.
