Reporters about that incident that caused those three women to be kicked out of the jury. But we started off the week with jury drama and now we are dealing with another curveball and that is scheduling issues. We learned today from the judge that three jurors made travel plans, booked travel plans during the month of september. So now the judge has to figure out, do i allow the jurors to take the time off from the deliberation time into october and she had warned the 12 members of the jury and the alternates, clear your schedules until the month of october. That is how long this thing could possibly last. It appears three jurors did not follow that order because she told us that one juror booked a travel flight, travel plans during june. And this was when deliberations rather testimony i should say was still underway. Two other jurors also booked some travel plans while deliberation was underway. So it looks like these jurors thought this would be over a lot earlier and that is not the case. So we just heard from curtis griggs, a defense attorney for max harris and tells us hes still confident the jury could make a unanimous decision and still has faith in them and called the jurors hero, for putting their Job Responsibilities and life on hold while this is playing out. Another curveball that the judge has to deal with. Well continue to follow melissa colorado live from oakland. Our other top story, the Trump Administration announcing a rule change that could allow authorities to detain undocumented families in custody indefinitely. Part of the white house effort to revamp immigrant laws. Kris sanchez has more on that. Reporter the Trump Administration said this is about closing a loophole contributing to the crisis at the border. So the changes affect the 2015 flores agreement which stated that families could ome be detained up to 20 days. Under the new proposaled rule announced today families would be detained as long as immigration proceedings take which right now is two months. President trump said in morning he should get credit for trying to keep families together. Obama and others brought the families apart but im the one that kept the families together. With what were doing now, well do even more of that but it will make it almost impossible for people to come into our country illegally. The Trump Administration has been trying to change the flores agreement for years, resulting in the 2018 zero toll lance policy where we first saw the children separated from their parents while in detention. According to the department of Homeland Security data, 97 of detained immigrants who are ordered deported are actually removed from the country. So the vast majority. However only 18 of immigrants who are released during the proceedings and are ultimately ordered to deport are actually taken out of the country. Dhs said 66 of families released during the detention preparedings do not show up in court. The administration is expected to file the rule this week to make it official and it is safe to say we expect immediate legal challenges. Continue to follow that. Thank you very much, kris. Words of hate discovered on the south bay Largest College campus as students return to class for the start of the semester. Bob redell is live at san jose state this morning with a look at the school. Reporter as students start the first day of class for the fall semester at san jose state, the university has emailed them to let them know someone posted flyers on campus with racist and antiimmigrant language. We learned a group called the american identity movement, this is a group that promoted white pride did post flyers around the city of san jose a few days ago. This is an image of one that scott budman posted from the twitter account and the flier reads Diversity Destroys nation. Not clear if they also posted these kind of flyers at sjsu but this group does target campuses and tries to recu recruit yog people. But the University President posted online, sjsu and other campuses nationwide recently discovered fliers with racist and antiimmigrant content and the items were removed immediately because they violated our time and place and manner regulation. He wrote these are troubling times given the number of hate crimes and shootings and they denounce the nationalist hate groups and prides itself on being one of the most diverse campuses in america. It is difficult times. People should be more better. With the environment we have lately it feels more welcoming people are more opening with hate speech. And to see it here, im not that surprised considerk the shooting in gilroy but im not surprised, im just disappointed. Federal prosecutors are talking for the first time about what they call one of the biggest immigration scams in california history, involving wellknown oakland businessman who they say defrauded Foreign Investors out of 110 million. Brian carmody said officers pounded on the front door with a sledgehammer and they had a warrant and wanted to i. D. His source about the death of jeff adachi. A new lawsuit is seeking to find out what role city leaders played. In june the coalition asked the San Francisco Police Department and the mayor london breeds office for public documents. Police denied the request calling it an active investigation. The Mayors Office released internal emails but the coalition is not satisfied with the response. There is more to the story. We dont know what happened behind the scenes. We dont know what kind of orders were giving to the Police Department, specifically the chief. We asked the mayor and the Police Department to respond and they both referred us to the City Attorney office who said they will respond in court once it has reviewed it. In the wake of the deadly matt shooting in gilroy, state lawmakers are taking action. This week they ask nevada counter parts to meet this fall on the issue of gun control. Now weve been reporting that the gilroy gunman purchased the ak47 used in the shooting elly in nevada. This type of weapon cannot be purchased in california. According to the atf, more than 1,500 guns recovered in 2017 in the state were originally purchased in nevada. Officials say that many of the weapons were found at crime scenes. There may be a new Movement Today on proposed gun control changes for the bay areas biggest city. The mayor wants san jose to become the first city in the country to require gun owners to buy insurance. A Committee Takes up the proposal this afternoon. If passed it will require gun owners to carry Liability Insurance for firearm they ov and cover accidental discharge and any damage done by someon if a gun is stolen. After the mass shooting from gilroy, two people were from san jose. Newm across the nation. If you havent seen it yet, a ocean rescue after a Small Plane Crash on the peninsula. The pilot was waving his arms before spotted by the coast guard. Now it all happened yesterday when the pilot and his passenger crashed about eight miles west of Half Moon Bay. Both are alive and well this morning. And they are sharing their story. Also the moment of the impact caught on video as today in the bay ian cull shows us in his report. Reporter this is the moment of impact when denver pilot david lesh crashed with one friend in the passenger seat and his other friend filming from another aircraft because they were doing a midair photo shoot of his plane. Reporter add he and his brother kept an eye on their position for 30 minutes luckily the rescue helicopter was already in the area on a training mission. I was 3,000 feet agl and lost power and did everything to get the motor going again and it wasnt happening so i put it into the pacific. Reporter he spoke with us alongside the men and women who found them in the ocean south of Half Moon Bay and incredible lifesaving rescue. Those guys were awesome. The coast guard we would have been dead for sure. If i was out there another half an hour, i dont think i could have my muscles would have been working. Reporter eye an cul, today in the bay. The pilot said he only had the plane for three months but had the adequate training. Parts of the amazon forest on fire now. Look at the destruction that could see some space. When president obama temporarily cut that tax back in 2011 it saved the average family about a thousand dollars a year. President trump last pledged to cut taxes during the midterms. Napa reaching 87 degrees. So in some spots it is hotter but till finding places to cool out.
